CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL Ray Haynes welcomed new Commissioner Dale Prevett. 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 10, 2002 REGULAR MEETING - The Commission reviewed the minutes of June 10, 2002 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Abstain Charles Willey - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 4 -1. 4. OZ -02 -06 - Randy Loescher - A request to rezone Lot 1, Block 1 of Hillside Estates from OL (Office Light) to IL (Light Industrial). The subject property is located at the southwest corner of E. 116'' Street North and Mingo Road, Owasso. Tim presented the item and described the location. The subject property is undeveloped and is currently zoned OL (Office Light). In August of 1998, a request to rezone the property from AG (Agriculture) to CS (Commercial Shopping Center) was heard with public opposition. The application was amended for a rezoning to OL (Office Light) instead of CS and the request was approved. Tim stated that industrial zoning is not appropriate at this location. It would be spot zoning and also zoning that is not consistent with patterns in the immediate area. The applicant wants to construct mini - storage units OWASSO PLANNING COMMISSION July 8, 2002 Page No. 2 on the subject property. A CS rezoning of this property would be appropriate in staff's opinion and would allow for a public input process upon the review by the Board of Adjustment. Letters were mailed to surround property owners and legal advertisement was published in the Owasso Reporter. Staff has received no phone calls or letters. Staff recommends denial of the rezoning request from OL (Office Light) to IL (Light Industrial), but recommends approval of the rezoning from OL (Office Light) to CS (Commercial Shopping). The following are comments made by surrounding property owners: Mr. T. W. Biggs - 9727 E 116 St No - Concerns with the trash generated by mini- storage units. Also has traffic concerns at that particular intersection, expressed the need for a stoplight or stop sign. Ms. Lisa Young Benn - 11420 N 96 E Ave - Concerns with traffic at the intersection of 97th East Avenue and 116' Street North. Mrs. Marjorie Brown - 9603 E 115 St No - Than intersection is very dangerous. Concerns with stormwater run off and property value declining. Might pull together a petition with signatures from the entire neighborhood, objecting to the possibility of mini - storages in that location. A representative for the applicant requested a brief presentation to the Commissioners. He explained that there are some trash problems at mini- storages, but that can be taken care off. From time to time unwanted property that is left behind is hauled off. After lengthy discussion, Charles Willey explained, to the surrounding property owners, that if approved for CS (Commercial Shopping) zoning, the applicant could take the request to the Board of Adjustment for a Special Exception request. In that case, the Board could put restrictions and conditions on the development. Ray Haynes moved to deny the request for IL (Industrial Light) zoning but approved to rezone the subject property from OL (Office Light) to CS (Commercial Shopping), Dewey Brown seconded the motion. OWASSO PLANNING COMMISSION July 8, 2002 Page No. 3 5. Plat Amendment - Closings of Tulsa - A request for an amendment to a building line on Lot 11, Block 5 of the Willows of Silver Creek. The subject property is located at 14101 E 90'h Street North. Tim presented the item and described the property location. The dwelling encroaches into the front building line but meets minimum front yard setback requirements for the zoning district; it is in conflict with what is shown on the plat and per the restrictive covenants. The Technical Advisory Committee at their regular meeting on June 26, 2002 reviewed the amendment. No opposing comments were received. The requirement for amending this plat is the "sign off" by 100% of the owners within the addition. Staff recommends that the Commissioners state in their motion that a review of the signatures should be complete prior to review by the City Council. Staff recommends approval of an amendment to the building lines as presented. Ray Haynes moved to approve the plat amendment subject to the review of signatures prior to the City Council review, Bill Williams seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Williams - Yes Charles Willey - Yes Dewey Brown - Yes Dale Prevett - Yes The motion carried 5 -0. 6. OLS -02 -03 - James G. Russell - A request for a lot split on Lot 18, Block 2, Nottingham Estates. The subject property is located at 9105 N 137' E Avenue. Tim presented the item to the Commissioners and described the property location. The northerly 10' of Lot 18 of Block 2 of Nottingham Estates contains a walking trail to a park contained within the subdivision. The developer failed to provide an easement for this access. The owner of Lot 18 is willing to split off the northern 10' portion in order to have this issue addressed. The Owasso Technical Advisory Committee reviewed the lot split and had no comments. Staff is requiring a Variance request to be approved by the Board of Adjustment and also recommends that the Commissioners prohibit the construction of any structure on the 10' strip as a condition of approval. Charles Willey moved to approve the lot split subject to the staff recommendation prohibiting the construction of any structure on the 10' strip, Dewey Brown seconded the motion. Site Plan - Owasso Center H - A request for the review of a site plan for Lot 1, Block 1, RCB Center. The subject property is located at 12130 E. 9611 Street North. Tim presented the item and described the subject property. All necessary parking requirements has been met and landscaping has been indicated on the site plan. The Owasso Technical Advisory Committee reviewed the site plan at their June 26, 2002 meeting. Staff recommends approval of the proposed site plan as presented with the following conditions of approval: 1. The applicant needs to install signage for handicapped accessibility parking in compliance with ADA standards. 2. Sidewalk will be required across the frontage of E. 96 h Street North. Ray Haynes moved to approve the site plan subject to the above Staff and TAC recommendations, Bill Williams seconded the motion. Final Plat - First United Methodist Church Addition - A request for review of a final plat for the First United Methodist Church Addition. The subject property is located south of E. 106°i Street North, between N. 129h Avenue and N. 145' E. Avenue and contains 11.86 acres, more or less. Tim introduced the item to the Commissioners. Staff is requesting the Planning Commission act on this plat as a final plat in nature. Staff recommends approval of the final plat. The Owasso Technical Advisory Committee reviewed this plat at their June OWASSO PLANNING COMMISSION July 8, 2002 Page No. 5 26, 2002 regular meeting. The following comments were submitted: 1. Washington County Rural Water District #3 requested a 20' utility easement along the north boundary of the plat. 2. Several of the utility companies requested that the easement on the west boundary of the plat be increased from 15' to 20'. 3. Certificate of Dedication needs to be provided. Below are additional requirements regarding this plat: 1. The Elm Creek Interceptor payback fee would need to be paid by the applicants prior to obtaining signatures on the final plat. The Elm Creek Interceptor payback fee is $1,580 per acre, or $18,738.80 for the subject property. 2. In addition to the Elm Creek Interceptor payback fee, the applicants must also address a payback fee to Owasso Land Trust, the entity that extended the sewer lines from the Elm Creek Interceptor. The applicable fee for that payback is $1,000 per acre, or $11,860 for the subject property. 3. There is a Storm Siren Fee of $16 per acre that would need to be paid by the applicants. This fee would amount to $189.76. 4. Sidewalks will be required along E. 106" Street North and N. 138's E Avenue. 5. Acceleration/Deceleration lanes will be required along E. 106'h Street North. 6. The address of 13800 E. 106' Street North needs to be added to the plat. Ray Haynes moved to approve the final plat subject to the above requirements being met, Charles Willey seconded the motion. Chairperson Secretary Date MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: ANNEXATION REQUEST NOBLE SOKOLOSKY DATE: August 8, 2002 Mr. Noble Sokolosky has submitted to the City of Owasso a petition for annexation of property totaling approximately 292.22 acres, more or less. The subject property is actually located in two different Sections and is described as the S/W Quarter of Section 12 and a portion of the S/E Quarter of Section 12, Township 21 North, Range 13 East, as well as a portion of the E/2 of Section 13, Township 21 North, Range 13 East, Tulsa County Oklahoma. The complete legal descriptions are included in the legal advertisement for annexation which is attached for your information and review. A subject map is also included in your packet. Tract A of the subject property, totaling 160 acres, is currently zoned RE (Residential Estates) in Tulsa County. All property annexed by the City of Owasso is required to be zoned the lowest zoning classification (AG) or may retain the zoning classification obtained in Tulsa County. In this case, the applicant has requested to maintain the RE (Residential Estates) zoning on that portion of his annexation request. Please note that initially, the applicant had neglected to inform staff that retaining the RE (Residential Estates) zoning was his original intent. This required additional advertising of the annexation request and postponement of this item from being reviewed by the Planning Commission meeting in July. Tracts B and C of the subject property, respectively, total 132.22 acres, more or less. Both are currently zoned AG (Agriculture) and would remain zoned AG if annexation is approved. Any future rezoning request on any of the Tracts (A, B, or C) would require notification to property owners within 300' of the subject property as well as publication of the legal advertisement. Each parcel would also be required to be posted with a rezoning sign. Additionally, if annexation is approved, the subject property would have to go through all platting requirements of the City of Owasso prior to any development. The platting requirements consist of both Preliminary and Final Plat reviews before the Technical Advisory Committee and the Owasso Planning Commission, as well as Final Plat review before the City Council. All property development standards of the City of Owasso would be required to be adhered to such as paved streets, sidewalks, and storm water detention requirements. A copy of the City of Owasso's Annexation Policy is attached for your information and review. The subject property meets all of the requirements included within the policy. Originally, contiguity was a question regarding Tract A, however the applicant is proposing to annex public right -of -way in order to fulfill that requirement. Tract B is already contiguous via public right - of -way on Mingo Road. Notification of the annexation request was published a total of six times in the Owasso Reporter, due to the request to maintain RE zoning as well as the publication of an improper date. Originally, as mentioned previously within this report, the annexation request was published twice without the request to maintain the RE (Residential Estates) zoning classification. Those notifications were followed by one notification to notify the public of the annexation request to be heard by the Planning Commission on August 12, 2002, with the RE zoning included. That legal advertisement was followed by one of two required notifications to the public that the City Council would hear the annexation request on August 19, 2002. The August 19, 2002, date was incorrect, however, thus requiring correction. Those notices are being published August 8 and 15, 2002, respectively. The legal requirements for publication have been met and a copy of the Procedures for Annexation is attached for your information and review. The Owasso Annexation Committee reviewed the annexation request at their June 26, 2002, special meeting and unanimously recommended approval, contingent upon the contiguous issue being addressed. If approved by the Planning Commission, this item will be forwarded to the Owasso City Council for action at their August 20, 2002, regular meeting. If approved by the City Council, the subject property would be annexed and located in Ward 1. Staff received one visit and several phone calls and emails regarding the request. There is concern regarding how the subject property will develop (zoning density, development specifications, etc.) as well as storm water problems in the area. The City Manager, Mayor and Vice Mayor met with several of the property owners in the area regarding storm water concerns. This annexation request will likely generate large numbers of opposition relating to the above concerns. The primary question that needs to be addressed, however, is whether or not we (the City) feel it is in our best interest to have the city development standards govern how the subject property develops, rather than those of Tulsa County. It is staffs opinion that it is. RRCOMMENDATION- Staff recommends approval of the annexation request. 1. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2 All properties should be contiguous to existing city limits. 3. All properties should be annexed into the city limits as the lowest zoning classification, that is, AG, agricultural. Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the city will be legal, but non - conforming, which means they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by Council on March 1, 1988. The subject property is currently zoned AG (Agricultural) and would remain zoned AG upon annexation. All property annexed by the City of Owasso is required to be zoned the lowest zoning classification (AG) or may maintain the zoning classification obtained in Tulsa County. In this case, the zoning of the property in Tulsa County is AG (Agriculture). If annexation is approved, the subject property would have to go through all platting requirements of the City of Owasso prior to any development. The proposed use of the subject property is as a Bingo Hall. The Owasso Zoning Code classifies this type of use as a Use Unit 4, which is permitted by right in an (AG) Agriculture district. There are development challenges to the subject property as a portion of the property lies within the floodplain. It should be noted that prior to any development of the subject property it would be required to be raised above the floodplain level. Also, with the plans for Tulsa County to widen E. 76' Street North from the railroad right -of -way to the Cherokee Industrial Park, the requirement to add acceleration/deceleration lanes will be waived. Work on the E. 76" Street North widening is scheduled to start November 1, 2002. A copy of the City of Owasso's annexation policy is attached for your information and review. The subject property meets all of the requirements included within the policy with the exception of tract size. Note, however, that the annexation policy is a guideline and not an "inflexible" document and staff would recommend that the Planning Commission exercise that flexibility, especially when considering that the request to annex is from a civic club within our community.
