The agenda for the regular meeting was posted at the north entrance to City Hall on July 15,
2002 at 12:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF JULY 8, 2002 REGULAR
MEETING - The Commission reviewed the minutes of July 8, 2002 Regular Meeting,
Bill Williams moved, seconded by Dewey Brown to approve the minutes. A vote on the
motion was recorded as follows:

4. Annexation Request — Noble Sokolosky — A request for the annexation of approximately
292 acres, more or less. The subject property is located west of Mingo Road, between E.
96" Street North and E. 106`h Street North and east of Memorial Drive, between E. 106'
Street North and E. 116`a Street North.
Tim presented the item and described the location. The subject property is located in two
different Sections. Tract A totals 160 acres and is zoned RE (Residential Estates) in
Tulsa County. The applicant has requested to retain this zoning classification. Tracts B
and C of the property total 132.22 acres. Both are zoned AG (Agriculture) and would
remain zoned AG if annexation is approved. Notification of the annexation request was
published in the Owasso Reporter. The Owasso Annexation Committee reviewed the
request and unanimously recommended approval, contingent upon the contiguous issue

being addressed. The property meets all of the requirements included within the
Annexation Policy. Contiguity was a question regarding Tract A, however the applicant
is proposing to annex the public right -of -way. Staff has received several phone calls and
emails regarding this request. Staff recommends approval of the annexation request. The
following are comments /concerns of several surrounding property owners that were in
attendance:
Matt Slavin - Not opposed to development on the subject property but has concerns with
stormwater runoff. Owns a $250,000.00 home down slope and does not want flooding
problems.
Jan Thomas - Wanted clarification on Item #5 of the Annexation Policy. Also had
questions regarding the police and fire coverage if annexation is approved. Requested a
definition of RE (Residential Estates) zoning, such as the minimum size of lots, curb and
guttering, sidewalks, etc. Doesn't want this subdivision to have the same flooding issues
as Metro Heights I and II. Would like to see postponement of the annexation in order to
make sure Tract C is correct.
Sue Piggott - Would like items carefully reviewed. Offered to show the Commissions
pictures of flooding within Metro Heights I and II.
Glen Hereden - Owns vacant property on Memorial Drive, had questions regarding the
supply of water. Also has a concern with the possibility of overloading the sewer system.
Bill Mitchell - Attorney obtained by Jim and Bonnie Williams. He has concerns with the
annexation of Tract C regarding the applicant annexing public right -of -way in order to
fulfill the contiguity requirement. He stated that Tract C is owned by Mr. And Mrs.
Williams. The location map does not show the curve on East 106' Street North and
wants to make sure that the Williams' property is not being taken in by this annexation.
Would like to have this request tabled until further notice in order to allow the
surrounding property owners to study the situation.
Phillip Barnes - Had questions regarding the amount of homesites Tract A will provide.
Lonnie Lamb - Stormwater and sewer line concerns. Wanted to know who would be
responsible if his land and house floods because of what the City of Owasso has
approved.
Audrey Hartcher - Questioned what Mr. Sokolosky and the City of Owasso is going to
do for the Ranch Creek subdivision residents if this land is annexed. Expressed a desire
for an environmental study to be performed prior to annexation.

Harold Ledbetter - Had stormwater concerns. Also had concerns regarding the
possibility of Mr. Sokolosky requesting a higher density such as RS -3 in the future.
Councilor Armstrong was present to address some of the citizen concerns. She explained
that the Community Development Department has hired some new staff members and
these issues will be reviewed. Ray Haynes stated that this is an annexation request, it will
go through the platting process both with Preliminary and Final Plat reviews.
Charles Willey asked if Tract B could be approved and table Tract A and Tract C until
further notice. Tim explained that if Tract A and Tract C are tabled they would more
than likely come before the Planning Commission for approval in September. Tract B
would go to City Council on August 20, 2002.
Following discussion, Ray Haynes moved to approve Tract B of the annexation request
and to table Tract A and Tract C until further notice is given to the Commissioners on the
legality of Tract C. Charles Willey seconded the motion. A vote on the motion was
recorded as follows:

Ray Haynes announced a 10- minute recess at 8:15 PM. The meeting reconvened at 8:25 PM.
5. Annexation Request - Owasso Sertoma Club - A request for the annexation of
approximately 1.019 acres, more or less. The subject property is located on E. 76° Street
North, immediately west of the SK &O railroad property.
Tim presented the item and described the property location. The Annexation Committee
reviewed the request and it was approved unanimously. No calls or letters have been
received regarding this request. Staff recommends approval of the annexation request.
Discussion was held regarding the platting process. Tim stated that Staff's goal is to
alleviate the platting requirements for civic clubs such as Owasso Sertoma Club.
Ray Haynes moved to approve the annexation request and to waive the platting
requirements, Dale Prevett seconded the motion. A vote on the motion was recorded as

6. Final Plat - Brookfield Crossine - A request for the review of a final plat for
Brookfield Crossing, a 38.4 acre subdivision containing 134, RS -3 residential lots. The
subject property is located east of the northeast corner of E. 116' Street North and
Garnett Road.
Tim presented the item to the Commissioners and described the property location. The
Technical Advisory Committee reviewed the request; all comments have been addressed.
Permits for the construction of water and wastewater improvements have been applied for
through DEQ. The installation of sidewalks along the arterial street frontage as well as
acceleration/deceleration lanes will be required. Staff recommends approval of the final
plat. Ray Haynes had questions regarding the water flow direction. Mr. Lincoln Sallee,
the applicant, was present to answer questions. Mr. Sallee explained that there is
drainage easement to the south of the subject property, Lot 33 and Lot 34, Block 2.
Ray Haynes moved to approve the final plat subject to the Staff and TAC
recommendations, Dewey Brown seconded the motion. A vote on the motion was

7. Preliminary Plat - Champion East and West - A request for the review of a
preliminary plat for Champion East and West, a 39.72 acre subdivision containing 126
RS -3 residential lots. The subject property is located north of E. 76`h Street North, west
of N. 145' E. Avenue, and east of the Graceland Acres.
Tim presented the item and described the subject property. The subject property was
zoned RS -3 with residential lots of 70' in width (as opposed to the permitted 65'). The
Technical Advisory Committee reviewed the preliminary plat and had several comments.

All of the comments have been incorporated into the plat. The developer is not required
to pay the Elm Creek Interceptor Payback Fee with this property. Emergency Siren Fee
in the amount of $635.52 will be required. Staff recommends approval of the preliminary
plat for Champion East and West. A representative from Kellogg Engineering was
present to address any concerns. A brief discussion was held regarding the right of way
on either side of North 145' East Avenue. Charles Willey wanted to verify that the Fire
Department was comfortable with the lay out of this subdivision. Tim stated that the Fire
Department reviewed the plat request at the TAC meeting and had no objections.

recommendations, Bill Williams seconded the motion. A vote on the motion was recorded

8. Preliminary Plat — Eggberts — A request for review for the preliminary plat for
Eggberts, a one lot, one block addition containing 1.35 acres, more or less. The subject
property is located on State Highway 20, immediately east of the newly constructed
QuikTrip.
Tim introduced the item to the Commissioners. Staff is requesting the Planning
Commission to act upon this plat as a final plat in nature. The Technical Advisory
Committee reviewed the preliminary plat and had a few corrections; the applicant has
addressed the concerns. Staff recommends approval of the final plat with the following
additional requirements:
1. Sidewalks will need to be added along the N. 140'h E. Avenue frontage.
2. The Elm Creek Interceptor payback fee would need to be paid by the
applicants prior to obtaining signatures on the final plat. The Elm Creek
Interceptor payback fee is $1,580 per acre, or $2,133.00 for the subject
property.
3. In addition to the Elm Creek Interceptor payback fee, the applicants must
also address a payback fee to Owasso Land Trust, the entity that extended
the sewer lines from Elm Creek Interceptor. The applicable fee for that
payback is $1,000 per acre, or $1,350 for the subject property.
4. There is a storm siren fee of $16.00 per acre that would need to be paid by
the applicants. This fee would amount to $21.60.

9. Site Plan — Eg2berts Restaurant — A request to review a site plan for Eggberts
Restaurant. The subject property is located on State Highway 20, immediately east of the
newly constructed QuikTrip.
Tim presented the item to the Commissioners and described the location. The applicant
has met all necessary parking requirements. The property is zoned CS (Commercial
Shopping Center). A complete landscaping plan is required to be submitted by the
applicant at the time of building permit. The Technical Advisory Committee reviewed
the site plan; all corrections have been made. A brief discussion was held regarding
stormwater drainage. Staff recommends approval of the site plan with the following
conditions of approval:
1. A separate permit for the sign will need to be obtained.
2. The applicant will need to install signage for handicapped accessibility
parking in compliance with ADA standards.
3. Sidewalk will be required across the frontage of N. 140t' E. Avenue.
4. Coordination with the Owasso Fire Department regarding fire lane
locations at time of parking lot striping.

10. Site Plan - F & M Bank - A request for the review of a site plan for F & M Bank. The
subject property is described as Lot 2, Block 1, Owasso Market II and is located on E.
96'h Street North.
Tim described the location and stated that all necessary parking requirements have been
met. A complete landscaping plan is required at the time of building permit; the applicant
is aware of this requirement. All concerns /comments from the Technical Advisory
Committee meeting have been addressed. A brief discussion was held regarding concerns
with the entrance on the southeast corner being too close to the intersection. Also,
questions on stormwater flow. Tim stated that the stormwater will run to the detention
pond on East 96' Street North which is in front of the Tulsa Teacher's Credit Union.
Staff recommends approval of the proposed site plan as presented with the following
conditions of approval:
1. A fire hydrant needs to be located at the northwest area of the subject
property.
2. Coordination with the Fire Department regarding the location of the fire
lanes to occur at the time of parking lot striping.
3. Handicappped accessible parking will need to be signed in accordance with
ADA standards.
4. Washington County Rural Water District requested a copy of the water
line easement that is to be filed by separate instrument.
5. All signage will require separate permits.
6. Applicant to submit landscaping plan at time of building permit.

The by -laws of the Owasso Planning Commission state that the Commission shall have a
chairperson, vice - chairperson and secretary, and that election of said officers shall be held
biennially at the first meeting of the Commission after July 1 of each of the even -
numbered years. The term of each office shall be for two years beginning immediately
upon the election of each officer.
The Chair opened the floor for nominations for Chairperson. Ray Haynes was nominated
by Bill Williams, with the nomination being seconded by Dewey Brown. Hearing no
further nominations, the nominations were declared closed and Ray Haynes was elected
Chairperson by acclamation.

nominated by Bill Williams, with the nomination being seconded by Ray Haynes.

BACKGROUND:
At the August regular meeting of the Planning Commission, a request for annexation by Mr.
Noble Sokolosky was partially approved while a portion of the request was tabled. The portion
of the request that was tabled involved Tracts A and C.
There were significant questions relating to the described 10' strip of land, who owned the 10'
strip of land, and whether or not the contiguity requirements had been met by the applicant.
Attached, for your information and review, is correspondence from Mr. Sokolosky regarding his
application and the above described concerns. Additionally, Mr. Sokolosky will be in attendance
at Monday evening's meeting to answer questions you may have.
The original staff memo is also attached. Staff published the annexation request on Thursday,
August 5, 2002 to once again notify the public of possible Planning Commission action on this
item. As this item was continued from the last meeting, this notification was not required but I
felt it necessary considering the concern generated by the request at the last meeting.
I have also requested that Mr. Cates comment on the concerns regarding the statutory section
line right -of -way. That information will be presented to you at Monday evening's meeting.

Dear Tim:
I am pleased to respond, at your request, to Mr. Williams's objection to our annexation
request. My understanding is that Mr. Williams has no legal objection to the annexation petition;
rather, he just doesn't want a fifteen foot strip of his property annexed into the city limits.
First, I do not believe that the fifteen foot strip is even necessary in order for my two
parcels to be considered "adjacent or contiguous ". Section 21 -102 provides that the two tracts
shall be considered adjacent if they are separated only by the highway right of way:
Where any territory to be annexed is se par from the corporate limits of the
municipality only b a railway right -of -way, an intervening strip less than four
(4) rods wide, or a highway right -of -way, the territory shall be considered
adjacent or contiguous to the municipality.
11 O.S.Supp.1999, § 21- 102(emphasis supplied). My two parcels are separated only by the
county highway right of way just as my Mingo tract is separated from the existing city limits only
by the railroad right of way.
Second, there is no constitutional, statutory or city charter provision requiring that a fifteen
foot strip(even if required) must be within a roadway easement or right of way. Even if there
were such a requirement, the subject strip is clearly within the 16.5 foot statutory roadway right
of way. We could have put the strip along Mr. Williams's east and north boundary and, because
we have the requisite qualifying property, done so without his consent.
The annexation does not impair Mr. Williams's use of his property and the fifteen foot strip
would have to be dedicated as right of way upon any platting of the property, whether by the city
or the county.

SUBJECT: ANNEXATION REQUEST
NOBLESOKOLOSKY
DATE: August 8, 2002
Mr. Noble Sokolosky has submitted to the City of Owasso a petition for annexation of property
totaling approximately 292.22 acres, more or less. The subject property is actually located in
two different Sections and is described as the S/W Quarter of Section 12 and a portion of the S/E
Quarter of Section 12, Township 21 North, Range 13 East, as well as a portion of the E/2 of
Section 13, Township 21 North, Range 13 East, Tulsa County Oklahoma. The complete legal
descriptions are included in the legal advertisement for annexation which is attached for your
information and review. A subject map is also included in your packet.
Tract A of the subject property, totaling 160 acres, is currently zoned RE (Residential Estates) in
Tulsa County. All property annexed by the City of Owasso is required to be zoned the lowest
zoning classification (AG) or may retain the zoning classification obtained in Tulsa County. In
this case, the applicant has requested to maintain the RE (Residential Estates) zoning on that
portion of his annexation request. Please note that initially, the applicant had neglected to inform
staff that retaining the RE (Residential Estates) zoning was his original intent. This required
additional advertising of the annexation request and postponement of this item from being
reviewed by the Planning Commission meeting in July.
Tracts B and C of the subject property, respectively, total 132.22 acres, more or less. Both are
currently zoned AG (Agriculture) and would remain zoned AG if annexation is approved. Any
future rezoning request on any of the Tracts (A, B, or C) would require notification to property
owners within 300' of the subject property as well as publication of the legal advertisement.
Each parcel would also be required to be posted with a rezoning sign.
Additionally, if annexation is approved, the subject property would have to go through all
platting requirements of the City of Owasso prior to any development. The platting requirements
consist of both Preliminary and Final Plat reviews before the Technical Advisory Committee and
the Owasso Planning Commission, as well as Final Plat review before the City Council. All
property development standards of the City of Owasso would be required to be adhered to such
as paved streets, sidewalks, and storm water detention requirements.
A copy of the City of Owasso's Annexation Policy is attached for your information and review.
The subject property meets all of the requirements included within the policy. Originally,
contiguity was a question regarding Tract A, however the applicant is proposing to annex public
right -of -way in order to fulfill that requirement. Tract B is already contiguous via public right -
of -way on Mingo Road.
Notification of the annexation request was published a total of six times in the Owasso Reporter,
due to the request to maintain RE zoning as well as the publication of an improper date.
Originally, as mentioned previously within this report, the annexation request was published
twice without the request to maintain the RE (Residential Estates) zoning classification. Those
notifications were followed by one notification to notify the public of the annexation request to be
heard by the Planning Commission on August 12, 2002, with the RE zoning included. That legal
advertisement was followed by one of two required notifications to the public that the City
Council would hear the annexation request on August 19, 2002. The August 19, 2002, date was
incorrect, however, thus requiring correction. Those notices are being published August 8 and
15, 2002, respectively. The legal requirements for publication have been met and a copy of the
Procedures for Annexation is attached for your information and review.
The Owasso Annexation Committee reviewed the annexation request at their June 26, 2002,
special meeting and unanimously recommended approval, contingent upon the contiguous issue
being addressed. If approved by the Planning Commission, this item will be forwarded to the
Owasso City Council for action at their August 20, 2002, regular meeting. If approved by the
City Council, the subject property would be annexed and located in Ward 1.
Staff received one visit and several phone calls and emails regarding the request. There is
concern regarding how the subject property will develop (zoning density, development
specifications, etc.) as well as storm water problems in the area. The City Manager, Mayor and
Vice Mayor met with several of the property owners in the area regarding storm water concerns.
This annexation request will likely generate large numbers of opposition relating to the above
concerns. The primary question that needs to be addressed, however, is whether or not we (the
City) feel it is in our best interest to have the city development standards govern how the subject
property develops, rather than those of Tulsa County. It is staffs opinion that it is.
Staff recommends approval of the annexation request.

NOTICE TO THE PUBLIC
You are hereby advised that the above petition for annexation was filed with the Community
Development Department of the City of Owasso on the 8th day of July, 2002, and that said
petition will be presented to the Owasso Planning Commission at the Owasso Community Center,
301 South Cedar, Owasso, Oklahoma at 7:00 PM on the 12th day of August, 2002.
All persons interested in this matter may be present at the hearing and give their objections to or
arguments for the proposal. The Planning Commission will submit its recommendation to the
City Council of the City of Owasso for its consideration and action, as provided by law.

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
All properties should be contiguous to existing city limits.
All properties should be annexed into the city limits as the lowest zoning classification,
that is, AG, agricultural. Landowners may then petition for rezoning if they desire
ftirther development of their property. All legal uses annexed into the city will be legal,
but non - conforming, which means they may continue but cannot be expanded without
proper zoning.
4. All public infrastructures that do not meet city standards will not be improved by the city
until brought to the city standard and accepted by the City Council. Such public facilities
must be improved at owners expense by the establishment of a special assessment district
or some other financing method.
5. Where a city limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.

Council.
5. Notice published two consecutive weeks in the Owasso Reporter of a City Council
Hearing which will include a map and text of the proposed annexation.
6. City Council hearing and action on the proposal.
7. If the proposal is approved by the City Council, an Ordinance will be prepared,
approved, published, and filed of record with the office of the County Clerk, with a map
of the property annexed.
CITIZEN SPONSORED ANNEXATION:

BACKGROUND:
The City of Owasso has received a request from Mr. John Cook, agent for TLC Homes to
review a plat amendment to Country Estates V, amending the deed of dedication. More
specifically, to amend the previously approved building setback lines of Lot 1, Block 8, and Lot
9, Block 3, from 25 feet to 21 feet and from 25 feet to 23.5 respectively. All other setback lines
currently conform to the approved deed of dedication. A general area map and a site specific
map are included in your packets.
As a requirement for amending a plat, the applicant must supply the City of Owasso with the
signatures of 60% of the property owners within the addition endorsing the approval of the
proposed amendment. Attached are copies of those signatures for your review.
ANALYSIS:
As you can see from the attachments, the structure located on Lot 1, Block 8, currently
encroaches into the front building line by approximately 4 feet. The encroachment into the front
building line of Lot 9, Block 3, is approximately 1.5 feet. Staff feels that although both homes
are near completion and were legally permitted by the Community Development Department, for
purposes of having a free and clear title, the plat amendment is necessary.
Normally, staff would require that this issue be resolved through a variance request to the Board
of Adjustment. However, given the necessity to resolve the issue and the lack of sufficient
justification necessary for the approval of a variance, namely the hardship criteria, staff has no
objections to the request to change the building lines on Lot 1, Block 8 and Lot 9, Block 3,
Country Estates V. If the proposed amendments were to be approved by this Commission and
the buildings completed neither would create any visibility problems nor prove to cause any
substantial detriment to the surrounding properties.
TECHNICAL ADVISORY COMMITTEE•
The Technical Advisory Committee at their August 28, 2002 regular meeting reviewed the plat
amendment. At that meeting, several utility companies and City of Owasso staff were afforded
an opportunity to comment on the proposed amendment and site any concerns regarding the
request. No comments were received.
Upon Planning Commission approval, this item will be forwarded to the City of Owasso City
Council.
RECOMMENDATION
Staff recommends approval to amend the building setback lines of Lot 1, Block 8, and Lot 9,
Block 3, from 25 feet to 21 feet and from 25 feet to 23.5 respectively.

COUNTRY ESTATE V
This amendment to the Deed of Dedication of the Country Estate 5, and Addition to the
City of Owasso, Tulsa County, State of Oklahoma, the same being dated October 30. 2001, filed
November 14, 2001 at 11:26 am, Document No. 01131380, Book 6633/ Page 1361 -1361, Plat
No. 5575 of the records of the Tulsa County Clerk, is executed the date and year listed below,
written by TLC Homes, Inc., an Oklahoma Corporation.
Whereas, it is the desire of the undersigned to amend the above described Deed of
Dedication as set forth hereinafter.
Now, THEREFORE, the Undersigned being the receipt of good and valuable
consideration, receipt and sufficiency of which is hereby acknowledged, do hereby amend the
Deed of Dedication of Country Estate 5, an Addition to the City of Owasso, Tulsa County, State
of Oklahoma, the same being dated October 30. 2001, filed November 14, 2001 at 11:26 am,
Document No. 01131380, Book 6633/ Page 1361 -1361, Plat No. 5575 of the records of the Tulsa
County Clerk, as follows, to wit:
Section II. Restrictions, of said Deed of Dedication, is hereby amended to read as
follows, to wit:
B. 2. Required Yards
(a) No building shall be erected or maintained nearer to the front or side street
lines than the building setback lines shown on the accompanying plot, nor shall it
be nearer than 20 feet from the rear property line.
The above mentioned setback requirements, Section II. B. 1(a), shall not apply to Lot 1, Block
8; or to Lot 9 Block 3, both comer lots, Country Estate V, and Addition to the City of Owasso,
Tulsa County, according to the recorded Plat thereof. The minimum setback lines for said lots
shall be as follows:
Corner yard setback of 20 feet (for both streets)
Back yard setback of 20 feet
Side yard setback of 5 feet.
The said Deed of Dedication and Plat are hereby amended accordingly.
That attached hereto is an original Special Certificate prepared by the Smith Brothers Abstract
and Title Company, Inc., dated August 2, 2002 at 7:00 am, reflecting the owners of the various
lots within the Country Estate V, an addition to the City of Owasso, Tulsa County, State of
Oklahoma, according to the recorded Plat thereof.
The Undersigned, Owner of the affected lots, and owners of lots in the County Estates V, do
hereby ratify and incorporate by reference, and affirm all parts of the said Plat and Deed of
Dedication and Restrictive Covenants which are not amended hereby and which are consistent
herewith. This Amendment shall be effective from the date hereof, and shall be enforceable to
the same extent and in the same manner as originally set forth in the original Plat and Deed of
Dedication of Country Estate V.
This Amendment shall be binding upon the parties affected and the Undersigned, their heirs,
successors and assigns.

TECHNICAL ADVISORY COMMITTEE:
The Owasso Technical Advisory Committee reviewed the lot split at their August 28, 2002

BACKGROUND:
The City of Owasso has received a request to review a site plan submitted by Tulsa Metro
Builders, agent for I.G.H & Company, to construct a 7520 square foot (5760 square feet of retail
/ office space) multi -tenant office and retail facility to be located along 145' E. Avenue within the
Preston Lakes Addition. The subject property is located approximately 1100 feet north of the
intersection of E. 86'n Street North and 145' E. Avenue, and more specifically, Lot 5, Block 10,
Preston Lakes Addition. A general area map and a site plan are included in your packets.
ANALYSIS:
The subject property is zoned PUD / CS (Planned Unit Development / Commercial Shopping
Center) and a landscape plan, although minimal, has been submitted with the site plan. Careful
review of the site plan by staff indicated that several requirements had not been met. The
following items were addressed by staff at the August TAC meeting:
1. The applicant proposed 17 parking spaces where a total of 21 are required by City Code. (1
per 300 square feet of floor area for office uses and 1 per 200 square feet of floor area for the
salon use).
2. One loading berth should be shown at minimum of 10' X 30' on the site plan.
3. Parking stalls should be shown as 9' X 20', not 9' X 18'.
4. Handicapped spaces should be shown as 12' X 20' with an 8' wide access aisle (van
accessible).
5. Curb and gutter is required.
TECHNICAL ADVISORY COMMITTEE:
The site plan was reviewed by the TAC Committee at their August 28, 2002 meeting. The
following comments and /or concerns were noted at that meeting:
1. Sufficient easement should be granted along the northern property boundary and / or
utility meters are to be located within the easement to the west of the proposed facility.
2. A mechanical room and / or sufficient area will be required for the location of
telephone equipment.
3. Handicapped accessible parking will need to be signed in accordance with ADA
standards.
4. A sidewalk is required along 145`h E. Avenue.
5. No signage is indicated on the site plan. Signage will require a separate permit.
No other comments were noted by staff or utility providers. The site plan included in your
packet contains the recommended changes. Storm water detention for this lot, as well as others
in the Preston Lakes Addition, was handled through a comprehensive storm water plan for the
entire property.
RECOMMENDATION:

DATE: September 3, 2002
Michael Dwyer, A.I.A, agent on behalf of Gene Drake, D.D.S., has submitted a site plan for a
5507 square foot (3709 square feet of office space) dental clinic to be located along 145' E.
Avenue within the Preston Lakes Addition. The subject property is located at the southwest
corner of the intersection of 89' Street North and 145' E. Avenue, and more specifically, Lots 1
& 2, Block 10, Preston Lakes Addition. A general area map and a site plan are included in your
packets.
ANALYSIS:
The subject property is zoned PUD / CS (Planned Unit Development / Commercial Shopping
Center District). Review of the site plan by staff indicates that the applicant has met all parking
requirements, with the exception of stall length requirements. The applicant is proposing 30
parking spaces, which is more than sufficient to meet the requirements of the Code in that, 24
spaces are required (1 per 200 square feet of floor area for Dental Clinics). Proposed
landscaping was not addressed on the site plan, however, a completed landscape plan will be
required prior to the submittal of building permits.
TECHICAL ADVISORY COMMITTEE:
The site plan was reviewed by the TAC Committee at their August 28, 2002 meeting. The
following comments and /or concerns were noted at that meeting:
1. Parking stalls should be shown as 9' X 20', not 9' X 18'.
2. The elevation shown as "631" needs to be changed to "637 ".
3. Handicapped accessible parking will need to be signed in accordance with ADA
standards.
4. A sidewalk is required along 145" E. Avenue and 89" St. North.
5. No signage is indicated on the site plan. All signage will require separate permits.
No other comments were noted by staff or utility providers. The site plan included in your
packet contains the recommended changes. Storm water detention for this lot, as well as others
in the Preston Lakes Addition, was handled through a comprehensive storm water plan for the
entire property.
RECOMMENDATION:
Staff recommends approval of the proposed site plan as presented.
