The agenda for the regular meeting was posted at the north entrance to City Hall on December
17, 2003 at 12:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 8, 2003 REGULAR
MEETING - The Commission reviewed the minutes of December 8, 2003 Regular
Meeting, Dewey Brown moved, seconded by Dale Prevett to approve the minutes. A vote
on the motion was recorded as follows:

4. OLS 04 -01 (Old First Baptist Church) — A request from Owasso Land Trust for the
approval of a Lot Split of approximately 6.75 acres located in the southeast corner of N.
125" E. Ave. and E. 86" St. N.
The Chair introduced the item and Duane Cuthbertson gave the staff review. The
applicant is requesting a lot split which will create two lots of fairly equal sizes so that
Owasso Land Trust may purchase the northern half currently occupied by the church
facility. The Owasso Technical Advisory Committee reviewed the request at their
December 30, 2003 regular meeting. No conditions were noted. Staff recommends
approval of OLS O4 -01.
Ray Haynes moved to approve the lot split request, seconded by Dale Prevett. A vote on

5. OPUD 18 -A (Coffee Creek Amendment) — A request from Owasso Land Trust for the
review and approval of an amendment to the Coffee Creek PUD — 18 to incorporate an
additional 0.94 acres into the to rezone approximately 15.00 acres, more or less from AG
(Agricultural General District) to RS -3 (Residential Single Family High Density District).
The subject property is located on the south side of E. 116' St N. approximately 1700
feet east of the E. 116" St. N. and N. Garnett Rd. intersection.
The Chair introduced the case and Duane presented the item. The surrounding land use
and surrounding zoning was described. This parcel of property is surrounded by the
Coffee Creek Planned Unit Development also being developed by Owasso Land Trust.
The applicant desires to incorporate the subject property into the Planned Unit
Development already established for the surrounding Coffee Creek area. Staff published
legal notice of the annexation petition in the Owasso Reporter and mailed notices to
property owners within a 300' radius of the site. Staff has received no phone calls or
correspondence in opposition. Staff recommends approval of OPUD 18 -A to incorporate
the subject property into the Coffee Creek PUD 18.
Dale Prevett moved to approve OPUD 18 -A, Dewey Brown seconded the motion. A
vote on the motion was recorded as follows:

6. Preliminary Plat — (Chelsea Park)— A request from Tulsa Engineering and Planning
Associates, Inc. for the review of a preliminary plat for the proposed Chelsea Park
residential subdivision containing 106 lots on 6 blocks within 25.59 acres located 1/2
mile south of E. 11616 St. No. on the west side of No. 145th East Avenue.
The Chair introduced the case and Duane gave staff review. He described the
surrounding land use and the surrounding zoning. The preliminary plat proposes 106 lots
on six (6) blocks and meets all requirements set forth in the Owasso Zoning Code except
where specified in the Technical Advisory Committee comments. The City of Owasso
will provide residential sewer service, while the rural water district #3 of Washington

County will provide water service. Mr. Tim Terrel with Tulsa Engineering was present
to answer any questions. Mr. Terrel presented a conceptual plan for stormwater
drainage. The 30' reserve area on the west side of the property was discussed.
The Owasso Technical Advisory Committee reviewed the plat and had the following
conditions:
1. Community Development - Establish provisions for accel /decel lanes along N. 1451
E. Ave. into the subdivision.
2. Community Development - Ensure that sidewalks are located along the subdivisions
parameter adjacent to N. 145' E. Ave. and along all reserved areas in the subdivision
abutting streets.
3. Community Development - The Elm Creek Sanitary Sewer fee and the Storm Siren
fee of $1580.00 per acre and $16.00 per acre respectively must be paid before a final
plat is approved and released.
4. Public Works - Drainage details for the subdivision must be submitted for city review
and approval before building permits may be released.
5. Fire Marshal - A fire hydrant must be placed in the southwest corner of the proposed
addition.
6. Washington County Rural Water - Establish a 15' Utility Easement along the front of
all residential lots.
7. Washington County Rural Water - Show existing water line on N. 145ih E. Ave.
Ray Haynes moved to approve the Preliminary Plat subject to the above staff and TAC
recommendations, Dewey Brown seconded the motion. A vote on the motion was
recorded as follows:

7. Preliminary Plat (Garrett Creek Center) - A request from Paragon Development
Group for the review of a preliminary plat for the proposed Garrett Creek Center
containing seven (7) lots on two (2) blocks within 9.65 acres of commercial property
located in the southwest corner of U.S. Hwy 169 and E. 116'h Street North.
The Chair introduced the item and Duane reviewed the staff report. The applicant is
requesting approval of the Garrett Creek Center preliminary plat so that they may plat and
eventually develop the property as a commercial shopping center. The developer would
like to divide the property into seven (7) lots on two (2) blocks. Access to and from the

properties will be limited along East 116`h Street North as a `Limit- of -No- Access' will be
established along the entire northern property line of the proposed plat with the exception
of Lot 1 in Block 1, two mutual access easements and the proposed service road. Traffic
control by way of access easements was discussed. Mr. Alan Blaksley was present to
address any concerns.
The Owasso Technical Advisory Committee reviewed the plat and had the following
conditions:
1. Name the service road: North 135' East Avenue
2. Show addresses on the plat as follows:
Block 1, Lot 1: 13302 East 116' Street North
Block 1, Lot 2: 13308 East 116' Street North
Block 1, Lot 3: 13314 East 116' Street North
Block 1, Lot 4: 13318 East 116'h Street North
Block 2, Lot 1: 11507 North 135'h East Ave
Block 2, Lot 2: 13506 East 116`h Street North
Block 2, Lot 3: 11503 North 135'h East Ave.
3. Show a 50' building setback line from East 116h Street North and U. S.
Highway 169 on the plat.
4. Provide sidewalks along N. 116'h St. N.
5. Show the width of the Sewer Force Main Easement on the plat.
6. Provide site detention details to Public Works
7. Provide covenants that detail responsibility of maintenance and utility
provisions.
8. Drainage facilities must be approved and in place before any building permits
are approved.
Ray Haynes moved to approve the preliminary plat for Garrett Creek Center subject to
TAC and Staff recommendations and subject to a `Limit of No Access' is established on
Lot 1, Block 2. Dale Prevett seconded the motion. A vote on the motion was recorded

8. Final Plat ( Owasho of Owasso) — A request from Kellogg Engineering for the review
and approval of a final plat for the proposed Owasho of Owasso containing one (1) lot on
one (1) block consisting of approximately 0.65 acres of commercial property located 'h
mile north of E. 86 "' Street North on the east side of N. 145'h East Avenue.

The Chair introduced the case and Duane gave review. The owner is proposing to
purchase and develop 0.68 acres consisting of a portion of lots two (2) and three (3) of
block 11 in the existing Preston Lakes Addition. Staff recommends approval of the
Owasho of Owasso Final Plat subject to the successful executive of the TAC conditions.
Mr. Chad Williams with Kellogg Engineering was present to answer questions.
Discussion was held regarding the 5' drainage easement on the northern boundary. A
letter was presented to the Commissioners regarding an agreement to legally tie together
the remaining portion of Lot 2 into Lot 1, Block 11 in order for the property to be utilized
and buildable (copy of letter attached).
Ray Haynes moved to approve the Final Plat of Owasho of Owasso subject to TAC and
Staff recommendations, Dewey Brown seconded the motion. A vote on the motion was
recorded as follows:

9. Site Plan ( Owasho of Owasso) — A request from Kellogg Engineering for the review and
approval of a site plan for the proposed Owasho of Owasso Car Wash facility located 1/2
mile north of E. 86thfor the review of a site plan for the Storage Source containing
approximately 1.89 acres, more or less. The subject property is described as Lots 12 and
13, Block 5, Hale Acres Addition and is located on the west side of N. Garnett Rd.
approximately 200 feet north of the N. Garnett Rd. and E. 112" St. N. intersection.
The Chair introduced the item and Duane reviewed. The developer proposes to construct
a five (5) manual bay and one (1) automatic bay car washing facility. There is one
entry /exit provided to the site from N. 145' E. Ave. There already exists space for
automobile acceleration and deceleration on the arterial. An additional 5' drainage
easement is required to accommodate a drainage way on the northern side of the site.
Storm water run -off and detention is accommodated by a regional detention facility to the
east of the site however the site's specific detention plans must still be finalized and
approved by Public Works. Mr. Chad Williams with Kellogg Engineering was present to
address concerns. The Technical Advisory Committee reviewed the site plan and
submitted the following comments:
1. Community Development — Pay the City of Owasso $1074.40 for the Elm
Creek sewer extension before the Final Plat or Building permit is released.
2. Community Development — Pay $10.88 City of Owasso Storm Siren fee.

3. Public Works - Adjust the site paving so as to leave the 5' drainage
easement on the northern boundary unobstructed.
4. Public Works - Detention plans must be approved by the Owasso Public
Works Department before any building permit may be issued.
Ray Haynes moved to approve the site plan for Owasho of Owasso subject to the above
TAC and Staff recommendations and subject to an additional 5' drainage easement to
accommodate a drainage way on the northern side of the site. No development or paving
will be allowed on the drainage easement so that the channel may be kept clear of
obstruction. Dale Prevett seconded the motion. A vote on the motion was recorded as
follows:

10. Site Plan (Dirty Dawg Mini - Storage) - A request from D. J. Gall for the review and
approval of a site plan for the proposed Dirty Dawg Mini - Storage facility located in the
southeast corner of N. 1091h E. Ave. and E. 116" St. N.
The Chair introduced the item and staff review was given by Duane. The proposed site is
zoned IL (Light Industrial). The applicant proposes to build a 12,750 square foot
building containing a mini- storage facility on .94 acres. The applicant, Mr. D. J. Gall,
was present to address any concerns. Detailed drawings of the facility were presented to
the Commissioners. The Technical Advisory Committee reviewed the site plan at the
October 291h and at the December 30' regular meeting and submitted the following
comments:
1. Pay $50.00 per water tap to the Washington County Rural Water District
#3.
2. Locate a fire hydrant on site or in accordance with the Owasso Fire
Marshal.
3. Detention plans must be approved by the Owasso Public Works
Department before any building permit be issued.
Dale Prevett moved to approve the Site Plan for the Dirty Dawg Mini - Storage subject to
the above Staff and TAC conditions and subject to a properly sized drainage pipe, under
the paved road, to assure acceptable water flow. Ray Haynes seconded the motion. A
vote on the motion was recorded as follows:

STAFF REPORT
BACKGROUND
The City of Owasso has received a request from the Dominion Corporation, applicant /owner,
for the annexation of approximately 19.75 acres, more or less. It is the intention, at this time,
that if the request is approved the applicant would proceed with rezoning and developing the
property in a residential manner.
LOCATION
The property is located in the northwest corner of East 66a' Street North and N. 129a' E. Ave.

East: Rural residential, pasture land

PRESENT ZONING
AG (Agricultural District) — Tulsa County
SURROUNDING ZONING
The subject property is surrounded by AG (Agricultural District) — Tulsa County on all sides.
ANALYSIS
The City of Owasso has received a request from Dominion Corporation, applicant/owner, for the
annexation of approximately 19.75 acres, more or less. A general area map and complete legal
description are attached.
At this time it is our understanding the applicant is requesting this annexation petition in order to
begin a process that will result in the residential development of the property. If the property is
annexed into the city the applicant will be required to follow normal development procedures
which may include rezoning and preliminary and final plat. If annexed, any development
proposed for the property would be required to meet Owasso Zoning Code and Subdivision
Regulations. The property would be served water and sewer by the City of Owasso.
A copy of the City of Owasso's annexation policy is attached for your information and review.
The subject property meets all of the requirements included in the policy with the exception of
tract size, as stated above the tract size is 19.75 acres, a '/a of an acre less than the preferred 20
acres.
The Owasso 2010 Land Use Master Plan calls for residential development to occur in that
general area.
Staff published legal notice of the annexation petition in the January 8, 2004 edition of the
Owasso Reporter and letters of notification were mailed to property owners within a 300' radius.
To this date staff has received no phone calls or correspondence concerning the request.
ANNEXATION COMMITTEE
On January 28, 2004 the Owasso Annexation Committee convened to consider the request, the
Committee consists of City department directors, representatives of the Owasso City Council,
Planning Commission, the Owasso school board and citizens at large. The Owasso Annexation
Committee unanimously recommended approval of the request.
RECOMMENDATION
Staff recommends approval of OA 04 -01 to annex the subject property into the city limits of
Owasso.

ANNEXATION POLICY
The following annexation policy for the City of Owasso is provided as a guideline and should not
be construed as inflexible requirements for annexation.
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City limits.
3. All properties should be annexed into the City limits as the lowest zoning classification, that
is, Agricultural (AG). Landowners may then petition for rezoning if they desire further
development of their property. All legal uses annexed into the City will be legal, but non-
conforming, which means that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not meet City standards will not be improved by the City until
brought to the City standard and accepted by the City Council. Such public facilities must be
improved at owners expense by the establishment of a special assessment district or some
other financing method.
5. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a six
month period after rejection by the City Council

ANNEXATION REVIEW
3. ANNEXATION REQUEST OA 04-01 — A request for the annexation of 19.75 acres
located in the northwest comer of E. 66h Street North and N. 129x` E. Ave.
Duane Cuthbertson presented the annexation request. Mr. Cuthbertson stated that he
discussed the request with most of the City department directors, specifically Public Works,
Police and Fire. All directors gave their assurance that development on this property would be
serviceable. It was stated that the request was consistent with the Annexation Policy. Mr.
Wiles added that the intention of residential development for this property is consistent with the
Owasso 2010 Land Use Master Plan. Mr. Hayes motioned to approve the annexation request.
Mr. Cates seconded the motion. The motion carried 6 -0.
4. ADJOURNMENT — Mr. Cates moved, seconded by Mr. Cataduella, for adjournment. The
motion carried 6 -0. The meeting was adjourned at 5:10 PM.

BACKGROUND
The City of Owasso has received a request for approval from Owasso Land Trust L.L.C.,
applicant, to rezone approximately 3.2 acres in the City of Owasso. The applicant
proposes to rezone the property from its current designation of RS -3 (Residential Single
Family District) to CG (Commercial General District. At the January Planning
Commission the applicant requested and was granted a lot split for this property. This
subject site was separated from the vacant property to the south. It is our understanding
at this time that it is the intention of the owners to convert to or replace the existing
church facility with a Commercial General type use, although no specific plans have been
received by the Owasso Community Development Department.

ANALYSIS
The applicant wishes to rezone the subject property from RS -3 to CG. Approval of this
request would allow the applicant to develop and operate a• number of Commercial
activities on the property. It has been presented to us that owners of the property at this
time would like to locate restaurants on the property. Restaurants fall under the
provisions of Use Unit 12 (Eating Places other than Drive -Ins) which is allowed by right
within CG zoned districts.
The applicant is requesting CG zoning specifically so as to be consistent with the
surrounding zoning. Property on either side of the subject site are currently zoned CG.
The request is compatible with the goals of the Owasso 2010 Land Use Master Plan. The
Plan states within its `Goal Statements and Action Plans Addressing Key Issues and
Needs':
Land Use and Development
Issue # 4 `Protect tracts of land for high quality commercial... "
Issue # 10 `Protecting residential areas from commercial and industrial
encroachment"
The site fronts the 8e Street Corridor. This particular street is a high intensity corridor
more suitable for high intensity zoning districts such as CG. It seems to reason that an
RS -3 zoning district with all of its possibilities might not be the most appropriate zoning
designation for the subject site. In addition, allowing residential development on the site
would be inconsistent with the Master Plan.
If the request is approved any future development would be required to meet the
provisions set forth in the Owasso Zoning Code and the Owasso Subdivision Regulations
and any appropriate site engineering standards as proscribed by Public Works including
but not limited to paved streets and sidewalks.
Public notices were mailed to property owners with 300' of the subject site as was the
request published in the January 8u' edition of the Owasso Reporter. To date the
Community Development Department has received no inquiries communicating negative
concern over the requested rezoning. However, some of the phone calls received did
address a concern for future development and its impact on the drainage situation in the
neighborhood south of the area. The Community Development Department responded to
the callers that that specific issue would be resolved during any subsequent site
development planning and that this request pertains only to the appropriateness of
rezoning the property.
RECOMMENDATION
Because the request is consistent with the Goals of the 2010 Land Use Master Plan and
compatible and appropriate for its location on one of Owasso primary commercial
arterials staff recommends approval of OZ 04 -01.

STAFF REPORT
The City of Owasso has received a request from Bob Jones of Charney & Buss,
applicant, for appropriate action relating to matters allowing for the closure of a 10'
utility easement in the Coffee Creek Addition between lots 10 & 11 on block 3. A house
built on Lot 10 was constructed over the northern property line which included the
subject 10' utility easement along that line. In September of 2003 Capital Homes
requested and received a lot split that took property from Lot 11 and gave it to Lot 10
thereby making the lot 10 wide enough to accommodate the house. Although free of the
property line the house still lays on the northern utility easement. Consequently, the
applicant is requesting an easement closure that will allow the existing house on the
subject lot to lay free and clear of any title obstructions.
LOCATION
The easement in question is a 10' strip of property equally splitting lots 10 & 11 of block
3 in Coffee Creek Addition, a Subdivision in Owasso, Oklahoma; also described as along
the northern boundary line of 10220 N. 141` E. Court.

ANALYSIS
The applicant recently built a house on lot 10, block 3 in Coffee Creek. As previously
stated the house is built over the empty utility easement on the northern boundary of lot
10. As this easement is not currently being used and the lines of service from the utility
corTanies have already been established throughout the neighborhood the applicant is
requesting to vacate the easement. The applicant has cleared the requested easement
closure with all applicable utility providers. The utility providers were given the
opportunity to assess the necessity of the utility easement as it relates to present and
future service levels. Those providers include Oklahoma National Gas, Southwestern
Bell, AEP, Public Service Company of Oklahoma, City of Owasso, Washington County
Rural Water District #3 and Cox Communications. Attached you will find letters of
agreement from those easement users. It is the consensus of the utility providers that the
closure of this utility easement would not cause a disruption in their present ability to
provide services to the neighborhood.
Other than being built over a utility easement the house meets all Owasso Zoning Code
and Subdivision Regulations including side setbacks.
No vacation of a plat or any parts thereof, except by action of the District Court, shall be
valid or impart notice until after the required consent of such platted area is presented to
the City Council and the approval of the Council is entered thereon. All vacations or
alterations of a final approved filed plat shall require the approval of the Planning
Commission and City Council and the filing of a corrected plat, approved deed or
accepted easement. Alterations of a plat without approval shall constitute a violation of
these Regulations.
RECOMMENDATION
Staff recommends approval of the Easement Closure request by Bob Jones of Charney
and Buss.

Dear Mr. Cuthbertson:
We are preparing to file an action to vacate one easement and a portion of an
adjacent easement in Coffee Creek, both of which easements have been dedicated to
the public. As a preliminary step, we would like to request an ordinance release of

attached is a survey plat of the subject property. Both easements are shown,
bordering the original boundary line between Lot 10 and Lot 11. As shown, the
residence on Lot 10 encroaches across the first easement and into the second
easement and Lot 11. Capital Homes has already resolved with the City issues
relating to encroachment into set -back lines, etc. The home on Lot 10 has been sold
to Earl D. Williams and Kathy R. Williams. Our purpose in seeking to vacate the
easements is so that a clean title insurance policy may be issued. An ordinance
release from the City is, of course, necessary as a preliminary step towards vacating
the easements in a district court proceeding.
The easement on Lot 10 is to be vacated in its entirety. With respect to the
easement on Lot 11, only the portion of the easement into which the residence
encroaches is to be vacated. This small, triangular- shaped piece of land is described as
follows:
A part of Lot Eleven (11), Block Three (3), COFFEE CREEK, an addition to
the City of Owasso, Tulsa County, Oklahoma, according to the recorded
plat thereof, more particularly described as follows:
Commencing from the Southwest corner of said Lot 11; thence N
84 °30'24" E a distance of 79.78 feet to the Point of Beginning; thence N
71 °31'47" E a distance of 7.78 feet; thence S 18 °28'13" E a distance of
1.79 feet; thence S 84 °30'24" W a distance of 7.99 feet to the Point of
Beginning.
It is our understanding that there are no utility lines in the easement portions
to be vacated. Pursuant to your request, we will seek letters from each affected
utility company indicating no objection to vacating of these easements.

primary cable (I've highlighted in red) and the Northerly portion of the house constructed
on Lot 10. As 1 advised, PSO will not object to the vacation of (i) the general utility
casement on the North 5 feet of Lot 10 or (ii) that portion of the general utility casement
on the South 5 feet of Lot 10 on which the corner of the house sits (a very small,
triangular piece).
We will, however, need to be granted an additional 5 feet of easement on Lot 11 in order
to protect the primary cable from encroachment. To that end, I have prepared and enclose
the I)roposed Underground Right -oPWay Easement for execution by the President of
Premier llomcs, Inc. The question did nrisc in my mind as to whether PSO should also
request subordination of the existing mortgage on Lot I 1 to this new PSO Easement,
however, I concluded that this mortgage will no doubt be released in the not too distant
future and that, ihcrefore, jumping through the hoops of a subordination was not
necessary.
Once the Easement is signed and notarized, assuming it meets with your approval, please
forward to me for recording at the above address, following which I will send you a copy
that reflects the Clerk's recording information thereon.

applicant /owner, for the review, approval and acceptance of a final plat for the Garrett
Creek Center consisting of approximately seven (7) lots, in two (2) blocks on 9.65 acres,
more or less. It is the intention of the property owner to subdivide and develop the
property in a commercial manner.

ANALYSIS
The Paragon Development Group is requesting approval of the Garrett Creek Center
Final Plat so that they may plat and eventually develop the property as a Commercial
shopping center. The final plat is a part of the Garrett Creek PUD (OPUD 02 -02) which
outlines the use of the property as commercial thereby making the proposed use legal
according to the Owasso Zoning Code.
According to the final plat, the developer would like to divide the property into seven (7)
lots on two (2) blocks. The layout meets the standards of the Owasso Zoning Code and
the Owasso Subdivision Regulations and the conditions of the Garrett Creek PUD- 02 -02.
The site will be served sewer by the City of Owasso. The property will attain water from
Washington County Rural Water District #3.
The Owasso Technical Advisory Committee reviewed the Garrett Creek Center
Preliminary Plat at its December 30, 2003 meeting and had the following conditions:
1. Name the service road: North 135'' East Avenue.
2. Show addresses on the plat as directed by the Community Development
Department.
3. Show a 50'building setback line from East 116th Street North and U.S. Highway
169 on the plat.
4. Provide sidewalks along N. 116th St. N.
5. Show the width of the Sewer Force Main Easement on the plat.
6. Provide site detention details to Public Works as part of the Final Plat.
7. Provide covenants that detail responsibility of maintenance and utility provisions.
8. Drainage facilities must be approved and in place before any building permits are
approved.
Additional comments were provided by the Technical Advisory Committee during a
review of the Final Plat of Garrett Creek Center at the regularly scheduled January 28,
2004 meeting, those comments included:
1. Community Development: Provide lines of Limits of No Access (LNA) along
the entire northern boundary except where a 30' Mutual Access Easement exist
between lots 1,2 & 3 in block 2 and between lots 2 & 3 in block 1, where the 80'
ROW for N. 135h E. Ave. intersects E. 116'h St. N. and on lot 1 of block 1.
2. Public Works: Create an exclusive 5' drainage easement (DE) along the Mutual
Access Easement within Block 2.
3. Public Works: Provide public access to Sanitary Sewer lift station behind lot 2
of block 1.
All of these conditions have been addressed in the final plat.
Additionally, any development on the property will be subject to a site plan review and
must comply with the development guidelines set forth by the Owasso Zoning Code and
Subdivision Regulations.
RECOMMENDATION
Staff recommends approval of the Garrett Creek Center final plat.

This planned project, located on the southwest corner of 116`11 Street
North and State Highway 169, is a multi -use residential and commercial
community of 126.05 acres. The primary part of the residential community
consists of 191 single family lots on 53.54 acres in the western half of the tract.
The first phase of this element consists of 91 lots on 23.05 acres. These lots are
designed and molded into the terrain to minimize grading and to reflect the
latest in standard single family layouts.
The street pattern discourages through traffic without being difficult for
those that live there. A central feature of the neighborhood is the existing four+
acre lake and park which also will serve as storm water detention. Forty lots
will back up to this feature, but the park area will be accessible to all residents.
In addition a large lake, stream, and park system will provide buffering of the
neighborhood from the more intense uses on the eastern portion of the tract.
The preservation of this natural stream and site feature will include at least two
additional lakes and natural storm water facilities as well as preserve many of
the specimen trees along the stream bank. The linear open space in this system
will stretch over 1500 feet on a generally north/south axis and will connect the
lakes, park, and community center with pedestrian trails that connect the major
activity centers and land uses throughout the development.
Another 32 single family lots, most of the buffering town home areas, as
well as many apartment areas, will also abut this open space system.
Other land use in the community will consist of a series of planned unit
developments over time that will further reflect and enhance the overall design
theme reflected on the enclosed development plan. In concept, these will be a
planned mix of uses including various types of apartments and town homes as
well as offices, restaurant clusters, banks, a hotel/motel complex, and desirable
highway oriented commercial enterprises. An extensive overall design plan is
currently underway and it will further define - as well as enhance - the current

ANALYSIS
The Paragon Development Group is requesting the review and approval of The Falls at
Garrett Creek preliminary plat so that they may plat and eventually develop the property
as a Residential Subdivision. The proposed plat is a part of the Garrett Creek PUD
(OPUD 02 -02) which outlines the use of the property as residential thereby making the
proposed use legal according to the Owasso Zoning Code.
According to the preliminary plat, the developer would like to divide the property into
104 lots on four (4) blocks.
RECOMMENDATION
Staff recommends approval of the Falls at Garrett Creek preliminary plat.

Planning Concept:
Garrett Creek Planned Unit Development

This planned project, located on the southwest corner of 1161h Street
North and State Highway 169, is a multi -use residential and commercial
community of 126.05 acres. The primary part of the residential community
consists of 191 single family lots on 53.54 acres in the western half of the tract.
The first phase of this element consists of 91 lots on 23.05 acres. These lots are
designed and molded into the terrain to minimize grading and to reflect the
latest in standard single family layouts.
The street pattern discourages through traffic without being difficult for
those that live there. A central feature of the neighborhood is the existing four+-
acre lake and park which also will serve as storm water detention- Forty lots
will back up to this feature, but the park area will be accessible to all residents.
In addition a large lake, stream, and park system will provide buffering of the
neighborhood from the more intense uses on the eastern portion of the tract.
The preservation of this natural stream and site feature will include at least two
additional lakes and natural storm water facilities as well as preserve many of
the specimen trees along the stream bank. The linear open space in this system
will stretch over 1500 feet on a generally north/south axis and will connect the
lakes, park, and community center with pedestrian trails that connect the major
activity centers and land uses throughout the development.
Another 32 single family lots, most of the buffering town home areas, as
well as many apartment areas, will also abut this open space system.
Other land use in the community will consist of a series of planned unit
developments over time that will further reflect and enhance the overall design
theme reflected on the enclosed development plan. In concept, these will be a
planned mix of uses including various types of apartments and town homes as
well as offices, restaurant clusters, banks, a hotel/motel complex, and desirable
highway oriented commercial enterprises. An extensive overall design plan is
currently underway and it will further define - as well as enhance - the current

open space design theme and further illustrate how the land use and focal point
mix will blend and be compatible throughout the overall design. Each element
