CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 9, 2004 REGULAR MEETING - The Commission reviewed the minutes of February 9, 2004 Regular Meeting, Dale Prevett moved, seconded by Ray Haynes to approve the minutes. CONSIDER APPROVAL OF THE MINUTES OF MARCH 1, 2004 SPECIAL MEETING - The Commission reviewed the minutes of March 1, 2004 Special Meeting, Marilyn Hinkle moved, seconded by Ray Haynes to approve the minutes. OWASSO PLANNING COMMISSION March 8, 2004 Page No. 2 5. OA 04-02 - A request for the approval of an annexation of 42 acres located in the northwest corner of E. 106' St. N. and U. S. Highway 169. The Chair introduced the item and Duane Cuthbertson gave the staff review. The applicant is requesting this annexation petition in order to begin a process that will result in the development of facilities to the site which would include an addition to the existing church, private faith -based school and day care and the addition of senior housing and sports fields. The applicant is aware that their entire site must meet city standards before any additional development is permitted. Staff published legal notice of the annexation petition and letters of notification were mailed to property owners within 300' of property. On February 25, 2004 the Owasso Annexation Committee unanimously recommended approval of the request. Mr. Mike Culbreath was present on behalf of the applicant. Staff recommends approval of OA 04 -02 to annex the subject property into the city limits of Owasso. Ray Haynes moved to approve the annexation request (OA 04 -02), seconded by Dale Prevett. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Yes Marilyn Hinkle - Yes Kevin Vanover - Yes Duane Coppick - Yes The motion carried 5 -0. 6. OA 04-03 - A request for the approval of an annexation of approximately 29.8 acres located in the 12300 block of N. Garnett Road, immediately north of the Country Estates VI addition. The Chair introduced the case and Duane presented the item. The applicant is requesting this annexation petition in order to begin a process that will result in the development of a single - family subdivision similar to the Country Estates additions. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards. Staff published legal notice of the annexation petition and letters of notification were mailed to property owners within 300' of property. On February 25, 2004 the Owasso Annexation Committee unanimously recommended approval of the request. The applicant's engineer was present. Staff recommends approval of OA 04 -03 to annex the subject property into the city limits of Owasso. Ray Haynes moved to approve the annexation request (OA 04 -03), Duane Coppick seconded the motion. Chairperson Haynes requested Item #12, to be heard at this time. 7. Consider appropriate action relating to a proposed change of the zoning ordinance Eric Wiles, Community Development Director, reviewed the staff report. He stated that staff was directed to revisit Section 650 of the Owasso Zoning Code and present a proposed amendment to the Planning Commission and City Council. The Zoning Code states no sexually- oriented business shall be located within 500 ft of a church, school, or park, or within 300 ft of areas zoned residential or within 300 ft of a nonarterial street. Staff recommends increasing the required distance between the businesses and churches, schools, and parks from 500 ft to 1;000 ft, between the businesses and residentially -zoned areas from 300 ft to 1,000 ft, and between the businesses and nonarterial streets providing access to residentially -zoned areas from 300 ft to 1,000 ft. Chairperson Haynes asked if there were any questions or concerns from the Commissioners or the public in attendance. Mr. Michael Loffer, a nearby property owner requested the definition of a sexual- oriented business. He also inquired about the 1,000 -foot requirement whether it would be measured from the front door of a church sanctuary or the corner of the building. Following a brief discussion, Ray Haynes moved to approve the amendment of the Owasso Zoning Code, Section 650 - Location of Sexually- Oriented Businesses. Duane Coppick seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Yes Marilyn Hinkle - Yes Kevin Vanover - Yes Duane Coppick - Yes The motion carried 5 -0. 8. OZ 04 -02- A request for approval to rezone approximately 35.3 acres located south and west of the southwest corner of E. 96h St. N. and N. 129" E. Ave. adjacent to the east side of U.S. Highway 169 from RS -3 /OM to CS. OWASSO PLANNING COMMISSION March 8, 2004 Page No. 4 The Chair introduced the case and Duane gave staff review. If the application is approved, the property would be zoned CS (Commercial Shopping Center District). Letters were mailed to surrounding property owners on February 12, 2004 and legal advertisement was published in the Owasso Reporter. No phone calls or correspondence in opposition were received. Mr. Steve Compton with Tyann Development was present to answer any questions. Staff recommends approval of OZ- 04 -02, rezoning approximately 35.3 acres, from OM /RS -3 to CS. Dale Prevett moved to approve the rezoning of 35.3 acres, from OM /RS -3 (Office Medium Intensity /Single Family Residential) to CS (Commercial Shopping). Marilyn Hinkle seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Yes Marilyn Hinkle - Yes Kevin Vanover - Yes Duane Coppick - Yes The motion carried 5 -0. 9. Lot Split (OLS 04 -03) - A request for the approval of a Lot Split for property located 1/4 mile east of U. S. Highway 169 on the south side of E. 116" St. N. The Chair introduced the item and Duane reviewed the staff report. The requested lot split is in anticipation of the current owners selling the property to a buyer interested in developing a bank outlet on the site. The applicant proposes to split off a parcel of property containing 1.78 acres. During the review process the Oklahoma State Department of Transportation was given the opportunity to provide input as the proposed new lot would be accessed from a state highway. Mr. Pete Kourtis of Owasso Land Trust was present to answer any questions. Staff recommends approval of the Lot Split request. Access into the property was discussed briefly. Mr. Kourtis explained that access will be on the east side of the property. Ray Haynes moved to approve the lot split. Kevin Vanover seconded the motion. OWASSO PLANNING COMMISSION March 8, 2004 Page No. 5 10. Lot Split (OLS 04 -04) - A request for the approval of a Lot Split for property located in the northeast corner of the U. S. Highway 169 service road and E. 103rd St. N. in the Coffee Creek Addition. The Chair introduced the case and Duane gave the staff review. The property location was described. The applicant to requesting approval of a lot split proposing to create a separate parcel of property containing approximately 3.27 acres within the Coffee Creek development. The requested lot split is in anticipation of selling the property to a buyer interested in developing a bowling alley on the site. Staff recommends approval of the lot split request. Ray Haynes moved to approve the Lot Split request, Marilyn Hinkle seconded the motion. Site Plan (Twenty First Properties) - A request for the review and approval of a Site Plan proposing an addition retail building in the Mingo Valley Shopping Center located in the northeast corner of U.S. Hwy 169 and E. 86" Street North. The Chairperson presented the item and Duane reviewed the staff report. The owner /applicant is requesting a review of this site plan for the addition of an 8,400 sq. ft. retail building in the southwestern corner. The site will be served water and sewer by the City of Owasso. The Board of Adjustment approved a variance in January 2004 allowing the southwest corner of the structure to encroach upon the western boundary's 50' setback requirement. The Technical Advisory Committee reviewed the site plan and recommended approval with the following conditions: 0. Community Development - Provide a sidewalk along the U.S. Hwy 169 service road for the length of the pad site. 0. Community Development - Be aware that no additional free standing signage will be allowed with this additional building unless it is in coordination with an overall Shopping Center sign plan. 0. Public Works - Revise the site plan to illustrate a sanitary sewer connection in the southeast corner of the building as that is the location of the sanitary sewer. Discussion was held regarding the requirement of a sidewalk along the property line adjacent to the Owasso Expressway service road. Mr. Greg Simmons with Twenty First OWASSO PLANNING COMMISSION March 8, 2004 Page No. b Properties was present on behalf of the applicant. Commissioner Vanover expressed concern with the lack of landscaping on the site plan. Mr. Simmons stated that landscaping the parking lot islands would be considered. He also explained that the asphalt would be excavated before the foundation is laid and a 35' driving lane in the rear of the proposed building. The developer also proposes to add 14 parking spaces in front of the building which will include the required amount of handicapped accessible spaces. Ray Haynes moved to approve the Site Plan subject to the TAC and Staff recommendations being met, Dale Prevett seconded the motion. The By -Laws of the Owasso Planning Commission state that the Commission shall have a chairperson, vice- chairperson and secretary. The Chair opened the floor for nominations for Vice- Chairperson. Dale Prevett was nominated by Ray Haynes, with the nomination being seconded by Marilyn Hinkle. Hearing no further nominations, the nominations were declared closed and Dale Prevett was elected Vice - Chairperson by acclamation. The Chair opened the floor for nominations for Secretary. Marilyn Hinkle was nominated by Ray Haynes with the nomination being seconded by Kevin Vanover. Chairperson Secretary Date i CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OA 04 -04 (Owasso Land Trust) STAFF REPORT The City of Owasso has received a request from the Owasso Land Trust, applicant/owner, for the annexation of approximately 35.46 acres. At this time it is our understanding the applicant is requesting this annexation petition in order to begin a process that will result in the development of a single - family subdivision quite similar to the currently developing Remington Estates immediately north of the subject property. LOCATION The property is located south of the developing Remington addition and east of the German Acres mobile home park, south of E. 116 h St. N. and east of N. Garnett Rd. A general area map has been attached for your review. EXISTING LAND USE Vacant SURROUNDING LAND USE North: Remington addition, single family homes abut a portion of the northern boundary of the proposed site. Other portions the northern boundary of the subject site are abutted by two workshop buildings to the northeast and vacant property to the northwest. South: Vacant East: Rural/Low density residential West: German acres mobile home park abuts the northwest corner of the subject site the rest of abutting property to the west is vacant. AG (Agricultural District) — Tulsa County SURROUNDING ZONING North: RS -3 (Residential Single Family District) South: AG (Agricultural District) — Tulsa County East: AG (Agricultural District) — Tulsa County West: AG (Agricultural District) — Tulsa County/WW-1 (Residential Mobile Homes District) ANALYSIS Staff received a petition from Owasso Land Trust, requesting the city to annex approximately 35.46 acres of property. At this time it is our understanding the applicant is requesting this annexation petition in order to begin a process that will result in the development of a single - family subdivision similar in nature to the currently developing Remington Estates. In fact the applicant is intending to connect any proposed development to Remington Estates. If the property is annexed into the city the applicant will be required to follow normal development procedures which would include rezoning, preliminary and final plat review. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works including but not limited to paved streets and sidewalks. The property would be served sewer by the City of Owasso and water by the Rural Water District 93 of Washington County. The Owasso 2010 Land Use Master Plan calls for residential development in that general area. Residential development on the subject property would have the ability to connect and be accessed from two directions, north through Remington Estates and east on E. llla' St. N. through Fox Meadows. Staff published legal notice of the annexation petition in the March 18, 2004 edition of the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. To this date staff has received no phone calls or correspondence in opposition of the request. ANNEXATION COMMITTEE On March 31, 2004 the Owasso Annexation Committee convened to consider the request, the Committee consists of representatives of the Owasso City Council, Planning Commission, the Owasso school board, citizens at large and City department directors. The Owasso Annexation .Committee concluded that the request is consistent with the Owasso Annexation Policy and thereby unanimously recommended approval of the request. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing City limits. 3. All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the City will be legal, but non- conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow City employees and citizens to know where the City boundaries are. 6. Garnett Road and E. 116th St. N. Mr. Cuthbertson presented the annexation request. Mr. Cuthbertson stated that the request was discussed with representatives of the city departments, specifically Public Works, Police and Fire. All directors gave their assurance that development on the subject property would be serviceable. Mr. Cuthbertson stated that the subject property would be served water by Washington County Rural Water District 93 and sewer by the City of Owasso and that the request was compliant with the criteria set forth by the Owasso Annexation Policy. The building space is divided into two structures; a primary L shaped structure forming the south/west section of the square and a smaller pad site forming the northeast corner. Ave. The subject property is located in the rapidly developing commercial node of the 96b St. and U.S. Hwy 169 intersection. This site is zoned CS — Commercial Shopping. According to the Owasso Zoning Code the proposed shopping center is categorized under Use Unit #13 and/or # 14 (Convenience Goods and Services and Shopping Goods and Services) and is allowed by right. The proposed development is not in conflict with the Owasso 2010 Land Use Master Plan as it calls for intense commercial activity in the area By reason of potential adverse effects on public services or to neighboring land uses, site plan review and approval is required for any commercial developments for the purposes of assuring proper accessibility, circulation, functional relationships of uses, and compatibility with adjoining and nearby development. No building permit shall be issued nor use commenced within this development except in accordance with an approved site plan. The developer is proposing a shopping center consisting of 36,590 ft2 building area. As stated earlier the site will be divided into two buildings, a primary L shaped structure forming the southwest section of the center and a smaller pad site in the northeast comer. The site layout provides a logical circulation pattern and necessary parking space for vehicles, including emergency. The site is accessible from all surrounding developments and roadways. Sidewalks are shown on the site plan along both public right of ways, N. 129' E. Ave. and N. Owasso Expressway service road. The site will be served sewer and water by the City of Owasso. Adequate utility easements are shown on the site plan. A final plat establishing such service provisions is concurrently being reviewed by appropriate municipal bodies. This site plan is contingent on the final plat for this site being approved as presented to the City of Owasso. Any modifications to the final plat must be reflected and accommodated on the final site plan before a building permit may be issued. Storm water run -off and detention is accommodated by on -site detention facilities. ANALYSIS The Lanes at Coffee Creek Final Plat is in anticipation of Sparks Holding Company locating a full service multi -lane bowling alley in the Coffee Creek development area on the northeast comer of E. 103`d St. N. and U.S. Highway 169 service road. Whenever any subdivision of land is proposed, before any permit for the erection of a structure in such proposed subdivision shall be granted, the owner of the land or his agent shall apply for and secure both Planning Commission and City Council approval of a final plat for such proposed subdivision. As stated above, Sparks Holding Company is proposing to provide accommodations for a multi -lane bowling alley. Public access would be derived from E. 103'd St. N. and/or U.S. Highway 169 service road. The proposed plat demonstrates ample spacing and street frontage for needs generally associated with large scale recreational uses such as bowling alleys. Adequate right -of —way has been established on the plat for E. 103rd St. N. and Owasso Expressway service road. The property is served water by rural water district #3 of Washington County and sewer is provided by the City of Owasso. In regards to sewer, the property is in the Elm Creek Sanitary Sewer Relief area and the Tulsa Technology Center Interceptor area. In order to develop the land in these areas of the city, the sanitary sewer system had to be extended from its pre - existing location south. Property owners located in the two benefiting areas are required to reimburse the city and other appropriate parties $2580.00 per acre for those extensions prior to personal utilization of those sewer services, payable to the City of Owasso. In addition, any new development in the City of Owasso is assessed $20 per acre to contribute to the city -wide storm siren system. There exist two utility easements on the plat that are currently in the process of being closed. These utility easements run toward the center of the plat. Obviously the location of these easements are an obstacle to developing the property and with proposal of utility easements being established along the parameter of the plat area these two mid block easements would not be necessary to serve any future development. The proposed plat meets the Owasso Zoning Code's lot and block requirements as it contains more than adequate spacing and frontage for the proposed use and its zoning designation. The proposed plat also meets the criteria set forth in the Owasso Subdivision Regulations. TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee reviewed The Lanes at Coffee Creek Final Plat at the March 3 V' regular meeting. At that meeting, utility providers and city staff are afforded the opportunity to comment on the application and request any changes or modifications. The Owasso Technical Advisory Committee had the following comments: 1. Establish a 20' utility easement along the northwest boundary line of the proposed plat, adjacent to the Owasso Expressway. 2.
