CALL TO ORDER — Dan Draper called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINU'T'ES OF APRIL 10, 2006 REGULAR MEETING - The Commission reviewed the minutes of April 10, 2006 regular Meeting. Dan Draper requested the following sentence to be stricken from Page #2: Dan Draper stated that he feels that annexation would be a good thing. Ray Haynes moved and Marilyn Hinkle seconded the minutes for approval. A vote on the motion was recorded as follows: Ray Haynes - Yes Dan Draper - Yes Marilyn Hinkle — Yes The motion was approved 3 -0. 4. Annexation OA -06 -06 — A request to review and approve the annexation of approximately 13 acres, located at the northwest comer E. 9e St N. and N. 101" E. Ave, just west of Larkin Bailey Elementary. Dan Draper presented the item and the staff report was reviewed. The development process and annexation process was described. Staff received a petition requesting that the City annex Coventry Gardens. The subdivision contains 38 houses and one undeveloped residential lot. The staff evaluated the condition of the subdivision and worked with the homeowners association to address issues of infrastructure that needed to be addressed. The areas of infrastructure were: 1) the relocation of a storm water drainage line, 2) detention, 3) sidewalks, 4) street signs and 5) sanitary sewer manholes. Each of these issues has been addressed. Staff has published legal notice in the Owasso Reporter and letters of notification OWASSO PLANNING COMMISSION May 8, 2006 Page No. 2 were mailed to property owners withui a 300' radius. The Annexation Committee unanimously voted to recommend approval at their April 26, 2006 meeting. The staff recommends approval of annexation #OA 06 -06. Ray Haynes moved to approve annexation #OA 06 -06; the motion was seconded by Marilyn Hinkle. Rezoning Request OPUD -06 -01 — A request to review and approve a proposed 38 acre Planned Unit Development with an underlying zoning of CG (Commercial General) and OM (Office Medium) districts, located east of the Owasso Expressway, between East 9811 Street North and East 101'r Street North, north of 1'` Baptist. Dan Draper presented the item and the staff report was reviewed. The development process was described. Staff has published legal notice in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. Staff recommends approval of OPUD -06 -01 rezoning request. Mr. Charles Norman made a brief presentation. The following are comments and concerns made by surrounding property owners: Steve Johnson — 9810 N 136 E Ave — Had concerns regarding the storm water runoff. Had questions on height limitations on the hotel. Don Sitter — 13813 E 100 St No — Supports the project. Had several meetings with the developers and feels comfortable. David Geer — 9856 N 136 E Ave — Would like to see the hotel placed in a different location. Expressed water run off concerns. Ilad concerns with the 7' screening wall not being tall enough. Rob Haskins — 13601 E 96 St No - Concerns that the access road can't handle additional traffic. Had water pressure concerns. Mr. Norman addressed the questions and concerns that the attendees had. He stated that there will be a 150' set back from the southeast comer. The screening fence will be 7' high, plus trees that are 12' high at planting. He also discussed infrastructure. Kevin Vanover moved to approve the rezoning request OPUD 06 -01; subject to TAC and Staff recommendations. Also subject to, the construction of barricades at the north end of N. 136 E. Ave. and at the west end of E. 100 St. No. prior to construction. The motion was seconded by Ray Haynes. Two tracts are proposed: one that is 0.437 acres and one that is 0.050. Dan Draper presented the item and the staff report was reviewed. The development process and lot split process was described. The proposed lot split was presented to the Owasso Technical Advisory Committee; no comments were expressed. The staff recommends approval of Lot Split #OLS- 06 -02. Marilyn Hinkle moved to approve Lot Split #OLS- 06 -02; the motion was seconded by Ray Haynes. Site Plan — Forest Creek Office Park — A request to review and approve a site plan proposing a 4,500 sq. ft. facility on 0.25 acres of property located on Lot 8, Block lof the Forest Creek Business Park. Dan Draper presented the item and the report was reviewed. The development process was explained. The applicant is requesting this review in order to facilitate a 4,500 sq. ft. building on one 0.24 acre tract. The property is zoned CG (Commercial General). The Technical Advisory Committee approved the request at the April 26, 2006 with the following one condition: Parking stalls need to be 18' deep with a 5' sidewalk. Staff recommends approval of the site plan for Forest Creek Office Park. Marilyn Hinkle moved to approve the site plan subject to the above condition and subject to TAC and Staff recommendations. The motion was seconded by Dan Draper. The property is owned by the City of Owasso; a fire station is proposed for the site. A general area map has been attached for your review. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan, The third step in the development of a piece of property in Owasso is platting. A preliminary plat. is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. ANNEXATION REVIEW PROCESS The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an . accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the request. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. ANALYSIS The City of Owasso is requesting to annex approximately 3.5 acres of property, located at the southwest corner of East 100'h Street North and North 145s' East Avenue. It is the City of Owasso's intent to develop the property as its P fire station. Construction is scheduled to begin in the summer of 2006, with a predicted completion of fall of 2007. Prior to construction, a site plan will be submitted to the Planning Commission for consideration. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. ANNEXATION COMMITTEE: The Owasso Annexation Committee reviewed the request at its meeting on May 24, 2006. At that meeting, the committee unanimously recommended approval for the annexation. The Prairie Village PUD proposes 40 apartment units for senior citizens with low to moderate incomes. The staff has verified that federal guidelines would prevent the development from changing in the future to allow non - senior citizens to occupy the apartments. EXISTING LAND USE Undeveloped SURROUNDING LAND USE North: Undeveloped South: Large Lot Residential East: First Freewill Baptist Church & Rejoice School West: Large Lot Residential /Undeveloped CONCEPT OF A PUD: The concept of a Planned Unit Development is to provide a creative alternative to conventional development where a particular tract is under common ownership or control and where a detailed development plan, outlining the development of the tract as a unit is proposed and submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete and coordinated plan of development for a larger parcel, rather than piecemeal individual changes using the variance process. The supplemental zoning district PUD must be approved by the City Council as a prerequisite to the Planned Unit Development. Ordinance No. 808, adopted in February, 2005 requires all new multi - family developments be included within a Planned Unit Development. ANALYSIS: OPUD 06 -02 (Prairie Village) is a proposed planned unit development (PUD) comprised of approximately 3.5 acres. The development concept behind the Prairie Village PUD is for a proposed housing development for seniors. The 3.5 acre site is located on East 10e Street North just west of Highway 169, The site has approximately 396 feet of frontage along East 106`x' Street North. The proposed development consists of a two story building, including parking and drives. A conceptual Site Plan is attached for your review as Exhibit "A ". The applicant is proposing a 35,000 sq. ft. building containing 40 dwelling units and related amenities. Unless modified by the Planning Commission, the proposed structure will consists of wood construction with 80% exterior brick masonry and 20% cementations board siding. All site lighting, landscaping, and signage will be in accordance with the requirements of the City of Owasso. Development Standards: Land Area: 3.5 Acres Maximum building Floor Area Ratio: 0.50 Proposed Floor Area Ratio: 0.23 Proposed Building Height: 45 Ft Parking Ratio: One space per unit The subject PUD application is part of a continuance of direction in the overall development scheme for the area. As the market has evolved, the property owners feel it is appropriate and feasible to develop the area for residential purposes, as prescribed by the Master Land Use Plans of both Tulsa County and the City of Owasso. The staff concurs that a transitional use would be consistent with the development pattern taking hold in north Owasso along the Owasso Expressway and this pattern of growth is compatible with the Owasso 2015 Land Use Master Plan. According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on any PUD application and determine the following: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance. a. To permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. To permit flexibility within the development to best utilize the unique physical features of the particular site; c. To provide and preserve meaningful open space; and d. To achieve a continuity of function and design within the development. FUTURE PLANNING ISSUES: Future planning issues must still be considered if the PUD is approved. If approved, the applicant must submit a plat, site plan, and infrastructure plans that must be approved by the City of Owasso. Sidewalks will be required along all public rights -of -way associated with the subject property. Perimeter sidewalks must be installed at the time of overall development, while the internal walks may be constructed as individual lots are developed. The applicant has identified the terrain of the area as relatively flat terrain. The existing soils on the site would appear to create no unusual development problems that are not typically encountered in development in and around the City of Owasso. Storm water detention is required and will be further defined at the platting stage. The developer will be responsible for extending sewer to the site. The staff published legal notice of the PUD request in the Owasso Reporter and mailed notices to property owners within a 300' radius of the subject property. Prairie Village, PUD A 0602 DEVELOPMENT CONCEPT & CHARACTER Prairie Village is a proposed housing development for seniors submitted as a Planned Unit Development (PUD) pursuant to the provisions of the Owasso Zoning Code. The site is approximately 3.5 acres parcel of land located on E. 106'h Street North just west of Highway 169. It is bounded on the East and North by a Rejoice Baptist Church & School and on the West by vacant land. The site has approximately three hundred ninety-six (396) feet of street frontage along E. 106'h Street North. The proposed development consists of a two -story building, including parking and drives. A Conceptual Site Plan is shown on Exhibit "A ". This building contains 40 units and related amenities. It has approximately 35,500 square feet of building area. Unless modified by the Planning Commission, the building framing will consist of wood construction with 80% exterior brick masonry and 20% of cementitious board siding. The exterior elevations of the buildings will be submitted to the City when design is available. Site lighting will be provided in accordance with the requirements of the City of Owasso. LANDSCAPING AND SCREENING The Prairie Village landscaping plan will be designed to enhance the street frontage, screen the view of interior parking from the residential areas, and to create a pleasant environment within the site. The planting theme will highlight the site entries and building, and will utilize plant selections indigenous to Northeast Oklahoma that are durable and require low maintenance. All landscaping shall be provided in accordance with the Owasso Zoning Ordinance, except as noted herein. The frontage along E. 106'h Street North will have a ten (10) foot wide landscaped edge. The landscaped area will be planted with trees and shrubs that meet or exceed the requirements of the Owasso Zoning Code. The interior parking areas will include landscaped planting islands and shade trees, with a minimum of 1 tree per 15 parking spaces, and no parking space more than 75 feet from a landscaped area. Along the North and West sides of tire property, a landscape buffer is proposed between this development and the adjacent properties. In this landscape buffer at least 1 tree per 25 lineal feet shall be installed along the entire property, and at least one -half of the trees shall be evergreen. An attempt will be made to save the existing large trees along the West side of die property. All trees will be selected from the approved tree list contained in the Owasso Zoning Code; trees required by code will be planted at a minimum size of 2" caliper. Shrubs required by code will be planted at a minimum 3- gallon container size. All landscape areas will be irrigated with an automatic irrigation system, and maintained per requirements of the Owasso Zoning Code. DETAIL SITE PLAN REVIEW A detailed Site Plan is required for approval by the City of Owasso Planning Commission prior to the issuance of a building permit on this development. The applicant shall submit the Site Plan to the City and supply all information required. All trash dumpsters shall be screened with an opaque fence that is at least 6 -feet high and taller than the proposed dumpster. GRADING & UTILITY PLANS A Site Grading & Utility Plan will be submitted to the City of Owasso Public Works Department for approval. The Conceptual Grading & Drainage Plan is shown on Exhibit B. The storm water from drainage areas will be conveyed downstream toward the off -site detention pond to be constructed by others. The Conceptual Site Utility Plan is shown on Exhibit C. All utilities are available to serve this development. Drainage and utility plans will be prepared in accordance with the City of Owasso requirements. ACCESS & CIRCULATION Access to the Prairie Village will be limited to one (1) porn on E. 106'h Street North. A secondary access will be through the adjacent Rejoice Baptist Church property. A general area map is attached. EXISTING LAND USE: Existing property is undeveloped. SURROUNDING LAND USE: North: Logans Road House South: Undeveloped East: Home Depot West: Tyann Plaza PRESENT ZONING: CS (Commercial Shopping District) DEVELOPMENT PROCESS: The four primary steps in the development of commercial property in Owasso include annexation, zoning, platting, and site planning. The third step in the development of property is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. ANALYSIS: The applicant is requesting this review in order to facilitate 3 commercial lots, on approximately 21.73 acres of property zoned to CS (Commercial Shopping). The Preliminary Plat meets all Owasso Zoning Code Bulk and Area requirements. The lot and block specifications established in the plat layout are adequate for commercial development. In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use Master Plan, as the area is forecasted for commercial development. Already, there is an emerging pattern of commercial uses occurring in the general area. TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the preliminary plat at the May 24, 2006 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns. The following TAC recommendation was addressed: 1. There are two errors in the graphical legal. The bearings need to match the traverse. 2. The applicant needs to show the dam and spillway on the plat. EXISTING LAND USE Owasso 8 Grade Center SURROUNDING LAND USE North: Residential South: Undeveloped East: Residential West: Owasso High School DEVELOPMENT PROCESS: The primary steps in the development of property in Owasso include annexation, zoning, platting, and site planning. The subject property is now at the site planning stage of development. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, detention, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. SITE PLAN REVIEW PROCESS: The Site Plan review process is initiated when a developer or builder of a particular project submits an application for a site plan review to the City of Owasso. The application typically includes a site plan, grading and drainage plan, erosion control plan, utility plan, and landscape plan. The review of the site plan begins with a thorough analysis by the City Planner and City Engineer for compliance with the Owasso Zoning Code, Subdivision Regulations, and Engineering Design Criteria. The Site Plan is then presented to the Owasso Technical Advisory Committee (TAC) for review. The TAC review board provides comments on the technical aspects of the plan and presents a recommendation along with the City staff to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the site plan is compliant with city standards. The Planning Cormnission may grant approval of the plan as presented or with conditions. If the Planning Commission grants approval, the applicant then makes any and all prescribed changes and submits a final copy to the City Planner. Once the final site plan is received and reviewed for compliance with the conditions of approval, the applicant may proceed with the development process. CONSIDERATIONS OF A SITE PLAN REVIEW: During the review of a site plan elements for consideration include specific site details such as street details, parking lots, building. size and placement, sidewalks, and drainage details. The Owasso Zoning Code, Subdivision Regulations, and Owasso Engineering specifications provide appropriate guidelines for the review of all site plans conducted by city staff, the Technical Advisory Committee and the Planning Commission. ANALYSIS: The applicant is requesting this review in order to facilitate a 12,430 sq ft educational facility addition on 74 acres, currently occupied by the Owasso 8a' Grade Center and High School. The proposed development is consistent with the Owasso 2015 Land Use Master Plan, it is also complimentary with the current development in the area. The site plan meets all Owasso Zoning Code and Subdivision regulations with the exception of the requirements stated as part of the Technical Advisory Committee recommendations. TECHNICAL ADVISORY COMMITTEE The Owasso Technical Advisory Committee reviewed the site plan at the May 24, 2006 regular meeting.
