CALL TO ORDER — Dan Draper called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3, CONSIDER APPROVAL OF THE MINUTES OF MAY 8, 2006 REGULAR MEETING - The Commission reviewed the minutes of May 8, 2006 regular Meeting. Kevin Vanover moved and Ray Haynes seconded the minutes for approval. A vote on the motion was recorded as follows: Ray Haynes - Yes Dan Draper - Yes Kevin Vanover — Yes Duane Coppick - Abstain The motion was approved 3 -0. 4. Annexation OA -06 -07 — A request to review and approve the annexation of approximately 3.5 acres, located at the southwest comer of East 100s` Street North and North 145h East Avenue. Duane Coppick presented the item and the staff report was reviewed. The development process and annexation process was described. It is the city's intent to develop the property as its 3r' fire station. Construction will begin later this summer. Staff has published legal notice in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. The Annexation Committee unanimously voted to recommend approval at their May 24, 2006 meeting. The staff recommends approval of annexation #OA 06 -07. Staff received a call from the neighbor to the west of subject property. He was in favor of the annexation. Ray Haynes moved to approve annexation #OA 06 -07; the motion was seconded by Dan Draper. Rezonine Request OPUD -06-02 — A request to review and approve a proposed 3.5 acre Planned Unit Development with an underlying zoning of RM -2 (Residential Multi - Family), located northwest of the interchange of East 106th Street North and the Owasso Expressway, immediately west of First Freewill Baptist Church. The applicant requested this item to be withdrawn from the agenda. 6. Easement Closure — A request to review and approve the closure of a utility easement located at 10106 North 114th East Avenue (Lot 2, Block 4, Sawgrass Park). Duane Coppick presented the item and the staff report was reviewed. The applicant is requesting this review in order to take appropriate action in order to approve the closure of one foot of an eleven foot utility easement located on the south side of the above address. The applicant built 4" over the southern I F utility easement. The Technical Advisory Committee reviewed the easement closure on May 24, 2006. No concerns were expressed. Lot Split OLS -06 -03 - A request to review and approve a lot split of approximately 38 acres, located northeast of the intersection of East 99th Street North and the Owasso Expressway, creating two lots. One lot is to be 31 acres and the other lot is to be 7 acres. Duane Coppick presented the item and the staff report was reviewed. The development Process and lot split process was described. The applicant is requesting this lot split in order to split a 38 acre tract. One lot is to be 31 acres (Tract A) and the other lot is to be 7 acres (Tract B). The proposed lot split was presented to the Owasso Technical Advisory Committee; no comments were expressed. The staff recommends approval of Lot Split #OLS- 06 -03. The mutual access easement was discussed. Mr. Rickey Jones with Tanner Consulting explained that the City of Owasso has required him to file the mutual access easement prior to the lot Split. Preliminary Plat — Tvann Plaza V — A request to review and approve a preliminary plat proposing 3 commercial lots on 22 acres, zoned CS (Commercial Shopping), located southeast of East 96h Street North and the Owasso Expressway, just east of the Tyann Plaza Shopping Center. Duane Coppick presented the item and the report was reviewed. The development process was explained. The property is zoned CG (Commercial General). The applicant is requesting this review in order to facilitate 3 commercial lots. The Technical Advisory Committee approved the request at the May 24, 2006. The following TAC recommendations was addressed 1. There are two errors in the graphical legal. The bearings need to match the traverse. 2. The applicant needs to show the dam and spillway on the plat. Staff recommends approval of the preliminary plat for Tyann Plaza V subject to the above conditions. There was discussion regarding the amount of lot splits that a plat is allowed. Eric explained that the code states that there can not be more than 2 lot splits on one platted property. Duane Coppick moved to approve the preliminary plat subject to the above TAC and Staff recommendations; the motion was seconded by Kevin Vanover. The applicant is requesting this review in order to facilitate a 12,430 sq ft educational facility addition on 74 acres, currently occupied by the Owasso 89' Grade Center and Haigh School. The Technical Advisory Committee approved the request at the May 24, OWASSO PLANNING COMMISSION June 12, 2006 Page No. 4 2006 with the following conditions: 1. Applicant must show topography 2. The applicant must show floodplain boundary as indicated on MDP or Corp. of Engineers Elm Creek mapping. 3. The applicant must show easements and setbacks 4. Chairperson Vice Chairperson Date OWASSO PLANNING CONEMSSION June 12, 2006 Page No. 5 MEMORANDUM TO: PLANNING COMMISSION CITY OF OWASSO FROM: ERIC WILES COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: ELECTION OF OFFICERS DATE: June 19, 2006 BACKGROUND: Appendix D — `By -Laws of the Owasso Planning Commission" of the Owasso Zoning Code requires that officers be elected on the first meeting following July 1" of all even numbered years. The election of officers is being placed on the July 10, 2006 Planning Commission agenda. RECOMMENDATION: While the staff will refrain from recommending particular members to the specific posts, the staff does recommend that the Planning Commission elect a Chair and Vice Chair to serve through July, 2007. MEMORANDUM TO: PLANNING COMMISSION CITY OF OWASSO FROM: ERIC WILES COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: CHANGING THE TIME OF PLANNING COMMISSION MEETINGS DATE: June 19, 2006 BACKGROUND: Article seven of Appendix D — `By -Laws of the Owasso Planning Commission" of the Owasso Zoning Code sets the time of Planning Commission meetings at 7:00 p.m., and further states that the Commission may set another time. The staffbelieves that a time change moving the start of Planning Commission meetings from 7:00 p.m. to 6:00 p.m. would be appropriate. Such a change would increase the convenience of the Planning Commission staff to be able to attend the meetings, and would not seem to hinder the ability of citizens to attend the meetings. Twice in the past year Planning Commission meetings have lasted past 11:00 p.m., and moving up the meeting time by an hour would significantly reduce the chances of future meetings lasting past 11:00 P.M. RECOMMENDATION: The staff recommends that the starting time of Owasso Planning Commission meetings be moved from 7:00 p.m. to 6:00 p.m. The meetings will still be held on the Monday following the first Tuesday of every month. MEMORANDUM TO: PLANNING COMMISSION CITY OF OWASSO FROM: CHIP MCCULLEY CITY PLANNER SUBJECT: ANNEXATION — (OA- 06 -09) DATE: July 1, 2006 BACKGROUND The City of Owasso has received request to review and approve the annexation of approximately 78.47 acres, located on the west side of North 129" East Avenue, approximately '/z mile north of East 66'h Street North, just south of the Baptist Retirement Village. EXISTING LAND USE Undeveloped SURROUNDING LAND USE North: Baptist Retirement Village (Residential Multi- Family) South: Large Lot Residential / Agriculture East: Large Lot Residential / Agriculture West: Large Lot Residential / Agriculture PRESENT ZONING AG (Agriculture District) Tulsa County DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. ANNEXATION REVIEW PROCESS The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the request. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. ANALYSIS The applicant is requesting to annex approximately 78.47 acres, located on the west side of North 129'h East Avenue, approximately %: mile north of East 66`s Street North, just south of the Baptist Retirement Village. It is the applicant's intent to develop the property for residential single - family use. Phase one of the development containing approxamently 139 residential lots on 39.06 is in the preliminary stages of development. The preliminary plat will be submitted to the Planning Commission next month with the Rezoning application. The development will be served water by Roger County Rural Water District and sewer by the City of Owasso. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. ANNEXATION CONDIMEE• The Owasso Annexation Committee reviewed the request at its meeting on June 28, 2006. At that meeting, the committee unanimously recommended approval of the annexation. These areas include property that is undeveloped and surrounded by municipal boundaries, the right -of -way of Hwy. 169, two elementary schools, and a church. Specifically, the areas of property are: 1. 12919 East 96`s Street North 2. 12901 East 96"' Street North 3. 12937 East 96"' Street North 4. 9302 North 129"' East Avenue 5. 9441 North 129"' East Avenue 6. 9309 North 129"' East Avenue 7. The undeveloped tract at the southeast corner of East 96"' Street North and North 129'h East Avenue 8. The right -of -way of Hwy. 169 from East 96 "' Street North to East 126"' Street North, and the right -of -way of Hwy. 169 from East 76"' Street North to the railroad overpass 3/4 mile to the south 9. The new Barnes Elementary School, 7809 East 76"' Street North 10. Hodson Elementary School, 14500 East 86"' Street North The staff arrived at the determination of properties that should be annexed by evaluating recent growth patterns and the level of service that could be provided to the areas of annexation. Particular weight was given to properties that are completely surrounded by corporate limits, and weight was also given to undeveloped acreages. PROCESS OF ANNEXATION: The staff has contacted the property owners affected by the proposed annexation and told them of the possibility of the City of Owasso annexing their property. Further, the staff has prepared a map of the proposed annexation and arranged for legal descriptions of the properties to be prepared. CONSENTUAL ANNEXATION — In most cases, before a city may annex territory, it must obtain the consent of the owners of at least a majority of the acres to be annexed to the municipality. The state law goes on to prescribe requirements for notice and a public hearing on the proposed annexation. However, there are two ways that a city can annex territory without having to obtain consent for a majority of the acres. ANNEXATION OF TRACTS LESS THAN FIVE ACRES EACH — If the territory to be annexed is subdivided into tracts or parcels of less than five acres and contains more than one residence, then the city is not required to obtain consent for a majority of the acres. THREE -SIDED ANNEXATION — The second type of annexation where consent is not required is one where three sides of the territory to be annexed are adjacent or contiguous to the property already within the city limits. In this type of annexation, the adjacent city property on each side must be at least 300 feet wide at its narrowest point (excluding adjacent right -of -way). ANNEXATION SERVICE PLAN — Before the city publishes and mails public notice of the annexation hearing, the city must prepare a plan to extend municipal services including, but not limited to, water, sewer, fire protection, law enforcement and the cost of such services appropriate to the proposed annexed territory. This annexation service plan must be made a part of the city's capital improvements plan, and the plan must be implemented within 120 months (10 years). APPLICATION OF LAW TO THE SUBJECT PROPERTIES: The staff finds that, using the guidance of the Oklahoma Statutes, the City of Owasso could annex six of the ten properties listed above without being required to obtain consent for the annexation of a majority of the acres included within those properties. The staff has been told by representatives of Owasso Public Schools and the Oklahoma Department of Transportation that their four properties, the two elementary schools and the highway right -of -way, will receive annexation consent. The City of Owasso can annex the four remaining areas of property, located near the intersection of East 90 Street North and North 129'x' East Avenue, by way of the three -sided type of annexation. LAND USE - Within the annexation ordinance, the City of Owasso has the choice of either incorporating the properties as AG Agricultural or as the zoning the properties have been given by the County. The staff intends to recommend that the properties be annexed with the zoning classification given to them previously by Tulsa County. The 10 acres at 9302 North 129v' East Avenue and the Episcopal Church are each zoned AG Agricultural. The properties located at the intersection of East 96'a Street North and North 129h East Avenue are zoned CS Commercial. It should be noted that annexation does not change the current land use of the properties. If a property that is annexed is occupied by a residential structure, that structure may remain and the use of that structure may continue indefinitely. Similarly, if a property is being used for the upkeep of livestock, the keeping of livestock may continue indefinitely. STEPS FOR ANNEXATION BY A MUNICH'ALTTY: First, the City Council, by adoption of Resolution 2006 -15 on June 20"', has directed the city staff to prepare and publish notice of two public hearings concerning the annexation. This resolution also directs that an annexation services plan be prepared for the affected properties. The Planning Commission will conduct the first public hearing and make a recommendation regarding the annexation to the City Council. The City Council would conduct the second public hearing, followed by its consideration of possible action related to the annexation. Finally, an ordinance effectively annexing the properties would have to be adopted. ANALYSIS: It is the staff's findings that the ten properties under consideration for annexation are a part of the Owasso community and ought to be a part of the Owasso incorporated area. After all, the two schools serve Owasso residents, the highway right -of -way is sandwiched by Owasso's corporate limits, and the residents who live in this territory shop in Owasso, go to church in Owasso, are part of the Owasso school district, have the Owasso zip code, and in large part consider themselves to be contributing parts of Owasso. This annexation would be another step in a continuing attempt to make the city's boundaries more uniform, and to remove many of the gaps within Owasso's corporate limits. Past decisions by the Tulsa County Board of Commissioners, made contrary to the designs of the Owasso Master Plan, have shown that it is reasonable that the City should examine unincorporated parts of the community throughout the area for the purpose of bringing uniformity to the city boundaries. ANNEXATION SERVICES PLAN: Owasso has prepared an annexation services plan as part of the annexation process, and this plan will have to be implemented as part of the Capital Improvements plan within ten years. The annexation services plan is included as an attachment to this memorandum. Owasso fire and ambulance service already serve the area. Police and Community Development services will extend to the territory immediately upon annexation. Water lines are in place and currently serve the area. Sewer mains lie in the immediate vicinity of the areas and will be extended to the properties at the owners' request and expense. Refuse collection service will be made available to the properties, but not mandatory; the City of Owasso will not forcibly take over the area from existing refuse collection providers. The roads and stormwater drainage systems within the territory will be maintained to the levels of their current condition. RESOLUTION 2006 -15: Resolution 2006 -15 constitutes a directive from the City Council to the municipal staff to publish and mail notice of two public hearings by July 4, 2006 for the City to consider the annexation — one by the Planning Commission and one by the City Council. Additionally, the resolution directs the staff to prepare an annexation services plan that is to be included within the Capital Improvements Plan, to be available for public inspection by July 3, 2006. After annexation, the remaining steps in the development process include rezoning, platting, and site planning. One form of property division in addition to platting is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. LOT SPLIT REVIEW PROCESS The Lot Split review process is initiated when a property owner submits an application to the City of Owasso requesting the review and approval of a lot split. Upon receipt of a complete application, the staff reviews the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering specifications The proposed Lot Split is then presented to the Owasso Technical Advisory Committee (TAC) for review and recommendation. At that meeting, utility providers and City staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC then forwards a recommendation to the Planning Commission. The Owasso Planning Commission conducts a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission has the final determination on the application. ANALYSIS• As stated above, the request is for the approval of a Lot Split proposing the split of a 5 acre tract. Three tracts are proposed: two lots are to be 1 acre (Tract 1 and Track 2), and the other lot is to be 3 acres (Remaining Tract). The applicant is requesting the lot split in order to donate the two I acre lots to his children for the future_ construction of single family homes. A 15' mutual access easement as been provided to ensure access to the new properties. Annexation i, the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. Specific development concerns, such as drainage, traffic, water /wastewater services, and stormwater detention are not able to be considered at the zoning stage of the development process. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. After the preliminary plat has been reviewed by the City and various utility companies, construction plans for the development's infrastructure are typically submitted. These plans include specifications and drawings for stormwater drainage, streets and grading and erosion control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of other agencies, such as the Department of Environmental Quality for wastewater collection and the US Army Corps of Engineers for properties that may be development sensitive. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. A general area map is attached. PROPERTY CHARACTERISTICS: The property is approximately 0.41 acres in size and is zoned CG (Commercial General). The subject property is undeveloped. All surrounding property is also zoned CG (Commercial General). DEVELOPMENT PROCESS: The primary steps in the development of property in Owasso include annexation, zoning, platting, and site planning. The subject property is now at the site planning stage of development. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, detention, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. SITE PLAN REVIEW PROCESS- The Site Plan review process is initiated when a developer or builder of a particular project submits an application for a site plan review to the City of Owasso. The application typically includes a site plan, grading and drainage plan, erosion control plan, utility plan, and landscape plan. The review of the site plan begins with a thorough analysis by the City Planner and City Engineer for compliance with the Owasso Zoning Code, Subdivision Regulations, and Engineering Design Criteria. The Site Plan is then presented to the Owasso Technical Advisory Committee (TAC) for review. The TAC review board provides comments on the technical aspects of the plan and presents a recommendation along with the City staff to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the site plan is compliant with city standards. The Planning Commission may grant approval of the plan as presented or with conditions. If the Planning Commission grants approval, the applicant then makes any and all prescribed changes and submits a final copy to the City Planner. Once the final site plan is received and reviewed for compliance with the conditions of approval, the applicant may proceed with the development process. CONSIDERATIONS OF A SITE PLAN REVIEW During the review of a site plan elements for consideration include specific site details such as street details, parking lots, building size and placement, sidewalks, and drainage details. The Owasso Zoning Code, Subdivision Regulations, and Owasso Engineering specifications provide appropriate guidelines for the review of all site plans conducted by city staff Technical Advisory Committee and the Planning Commission. ANALYSIS: The applicant is requesting this review in order to facilitate a 4,500 sq ft building on one 0.41 acre . tract. The subject property is zoned CG (Commercial General). The proposed development is consistent with the Owasso 2015 Land Use Master Plan as it calls for Commerciat/Office zoning in the area. It is also complimentary with the current development in the area. The Forrest Creek site plan meets all Owasso Zoning Code and Subdivision regulations with the exception of the requirements stated as part of the Technical Advisory Committee recommendations. The bulk and area specifications for this site are more than adequate for the placement and accommodation of concurrent requirements imposed on commercial facility's such as that proposed in this site plan. The development must adhere to the City of Owasso's outdoor lighting, landscaping, and sign codes. Storm water calculations must be submitted to the city engineer and approved before the issuance of a building permit. The site.is within the City of Owasso's utility service district. It will be provided water and sewer services by the City of Owasso. TECHNICAL ADVISORY COMMITTEE The Owasso Technical Advisory Committee reviewed the site plan at the June 28, 2006 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns. At the meeting the committee recommended approval of the site plan with the following condition. 1. Applicant needs to show a bar scale on the site plan. 2. Applicant needs to allow for adequate handicap parking the meets all ADA requirements. 3. Applicant needs to show the impervious area for the site.
