The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
December 5, 2000 at 10:00 AM.

4. Preliminary Plat - Moon Commercial Center - A request for review of a preliminary
plat for the Moon Commercial Center, a 2.5 acre, 2 lot subdivision located at E. 116'
Street N. and N. 100' E Avenue, and generally described as the NE /4 of the NW /4 of the
NE /4 of Section 7, Township 21N, Range 14E. (Ward 1)
Donna presented the case to the Commissioners and described the property location. The
Technical Advisory Committee reviewed the plat at their November 29, 2000 meeting.
There were several comments noted and the applicant has responded to those items. Ray
Haynes had questions regarding entrances into the center. Donna explained that there
would be two entrances, one off of East 110 s Street North and the other off of East 109`"
Street North. Also discussed briefly was the drainage easement. Mr. Kevin Vanover,
from the engineering firm, DeShazo, Tang & Associates was present to answer any
questions or address concerns.
Staff recommends approval of the Preliminary Plat for Moon Commercial Center subject
to the following conditions:

1. All TAC comments shall be addressed prior to submittal of the Final Plat.
2. Sidewalk shall be installed along E. 116'h Street N. at the time of
development.
3. Acceleration/deceleration lanes shall be installed at the entrances from E.
116' Street N. at the time of development.

TAC recommendations being met; Charles Willey seconded the motion. The vote on the

5. Preliminary Plat — Country Estates V — A request for review of a preliminary plat for
Country Estates V, a 53.83 acre, 188 lot subdivision located north of E. 116'h Street N.
and west of N. Garnett Road, and generally described as a portion of the S/2 of the NE /4
of Section 6, Township 21N, Range 14E. (Ward 1)
Donna presented the case and described the property. The Planning Commission
approved the rezoning request subject to the storm drainage and streets within all previous
phases of Country Estates are accepted by Public Works and City Council prior to
Planning Commission approval of the final plat for Country Estates V. The Technical
Advisory Committee reviewed the preliminary plat at their November 29, 2000 meeting.
Several comments were made at that meeting; a list is included within the packet. The
applicant should respond to these comments prior to the final plat being submitted.
Drainage issues on Garnett Road were discussed briefly. Also discussed were gas line
easements affecting two lots within the subdivision. The applicant was not present to
answer questions.
Staff recommends approval of the Preliminary Plat for Country Estates V subject to the
following conditions:
1. All TAC comments shall be addressed prior to submittal of the Final Plat.
2. The developer or agent for the developer shall coordinate with Public
Works to bring all storm drainage and streets within previous phases of
Country Estates into required compliance for acceptance by the Owasso
City Council.
3. Sidewalks shall be required along all public rights -of -way. Sidewalks

along N. Garnett Road shall be installed by the developer at the time of
development.

Lakes Industrial Park. (Ward 3)
Donna stated that The Owasso Land Trust requested to withdrawn this item.
7. Site Plan - Chili's Grill & Bar - A request for review of a site plan for Chili's Grill &
Bar, 4081 square foot restaurant facility located north of E. 96' Street N. and west of N.
129'h E. Avenue and generally described as a portion of Lot 1, Block 1, Owasso Market.
(Ward 1)
Donna presented the item and described the location. The applicant is proposing a 4081
square foot building. Based on the parking requirements, the applicant has provided more
than enough parking spaces. The site plan shows 90 spaces, including 5 handicap
accessible spaces. The dumpster area is located at the rear of the building. A landscape
plan has been submitted and is enclosed in the packet. The Technical Advisory
Committee reviewed the preliminary plat at the November 29, 2000 meeting. Several
comments were noted and those comments will be addressed prior to the issuance of a
building permit. Due to the weather the applicant was not present. Charles Willey
requested the parking in the front of the building to be removed due to the danger of
backing up into traffic. He also suggested that the handicap parking be moved to the side
of the building.

Staff recommends approval of the site plan for Chili's Bar & Grill subject to the following
condition:
1. All TAC Comments shall be addressed prior to issuance of a building
permit.
Ray Haynes moved to approve the site plan subject to the staff and TAC
recommendations being met. Also, subject to the parking spaces shown directly in front
of the building to be relocated, due to the danger of backing out onto a primary drive.

CONCEPT OF A PUD
The concept behind a Planned Unit Development is to provide a creative alternative to a
conventional development where a particular tract is under common ownership or control, and a
detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed
and submitted for public input and review. The PUD allows for greater creativity and flexibility
than could be achieved by traditional zoning in the planning and development of large parcels of
land.
The use of a PUD technique is a way to amend a zoning ordinance in accordance with a
complete, coordinated plan of development for a larger parcel, rather than piecemeal the changes
by using variances of the zoning regulations.
BACKGROUND
Planned Unit Development #OPUD -01 -01 is 26.8 acres, more or less, all of which is
undeveloped. The subject property was annexed into the City of Owasso in September, 1998.
The property is located at the southeast corner of E. 116`h Street N. and N. Mingo Road. A
location map is attached for your information and review.
The subject property is bound on the north primarily by rural residential/agriculture land use; on
the west by Hillside subdivision, developed as a county subdivision and later annexed into the
City, and vacant OL (Office Light) parcel at the southwest comer of the intersection; on the
south by vacant, abandoned quarry; and on the east by S.K.O. Railroad right -of -way and the
Owasso Sports Complex.
The applicant is requesting approval of PUD supplemental zoning on the subject tract that would
be developed in accordance with the submitted Outline Development Plan and Text. The PUD
application is accompanied by a zoning application OZ- 01 -01. The plan and text call for the
development of 2.2 acres of CS (Commercial Shopping) located at the northwest corner of the
subject property, 9.6 acres of RD (Residential Duplex) located south and east of the commercial
corner and west of the natural drainage way through the site; and 15 acres of IL (Industrial Light)
zoning located east of the natural drainage way and west of the railroad tracks. A proposed land
use diagram is provided within the Outline Development Plan and Text for your review.
Required legal notification was published in the December 21, 2000 edition of the Owasso
Reporter and letters were mailed to surrounding property owners on December 20, 2000. A sign,
was posted on the property on December 20, 2000.
STAFF ANALYSIS
The Zoning Code mandates that the Planning Commission shall conduct a public hearing and
shall determine:
1. Whether the PUD is consistent with the Comprehensive Plan.
2. Whether the PUD is in harmony with the existing and expected development of the
surrounding areas.
3. Whether the PUD is a unified treatment of the development possibilities of the project
site.
4. Whether the PUD is consistent with the stated purpose and standards of the PUD
Ordinance.
a. Permit innovative land development while maintaining appropriate limitation
on the character and intensity of use assuring compatibility with adjoining and
proximate properties;
b. Permit flexibility within the development to best utilize the unique physical
features of the particular site;
c. Provide and preserve meaningful open space;
d. Achieve a continuity of function and design within the development.
CONSISTENCY WITH COMPREHENSIVE PLAN
The 2010 Land Use Master Plan is implemented through the use of the zoning process.
Therefore, PUD and rezoning requests are obliged to be consistent with the Comprehensive Plan
or logical reasons should be presented to show that the plan needs to be amended.
The proposed PUD reflects the approved land uses mandated by the Comprehensive Plan. It is
staff's opinion this proposed rezoning is in compliance with the Comprehensive Plan.
Harmony with Existing and Expected Development
The applicant has proposed a small 2.2 acre commercial area at the northwest corner of the
property which is adjacent to the intersection of N. Mingo Road and E. 116`h Street N. The
proposed use is appropriate as well as anticipated by the Comprehensive Plan. The southwest
corner of the adjacent intersection is presently zoned OL (Office Light). This is a typical land
use pattern for the intersection of arterials. If approved, the zoning designation would
accommodate the future need for an appropriately sized commercial parcel based on anticipated
growth within the immediate area. The submitted Outline Development Plan and Text is
attached for your information and review.
The Outline Development Plan and Text also proposes 9.6 acres of RD (Residential Duplex).
The Comprehensive Plan shows this area as high intensity residential. The location of this use,
wrapping around the commercial and backing up to the existing natural drainage way and the
associated native vegetative screen, is an ideal buffer between most of the surrounding
residences and the proposed 15 acre IL (Industrial Light). The applicant has stated light
industrial/manufacturing and/or research and development as potential uses for this area.
Considering its geographic setting between the S.K.O. Railroad right -of -way and the Owasso
Sports Complex to the east and the natural drainage way to the west, this portion of the subject
property is somewhat limited in feasible uses. The proposed IL zoning is in compliance with the
Comprehensive Plan and, staff contends, is the most appropriate use for that portion of the
subject property.
Overall, it is staff's opinion that the proposed development is consistent with existing and
expected development.
Legal, Planning and Site Engineering
The subject property is described by the applicant as "gently rolling pasture and lowland that
may be subject to periodic flooding." Future site engineering should anticipate the fill
requirements to elevate building pads 12" above the documented 100 year flood elevation. The
Outline Development Plan shows detention located in the south - central portion of the site and
incorporated with the natural drainage way.
The applicant has stated that water and sanitary sewer are available to portions of the site, with
easy extension to the unserved areas. The adequacy of the existing facilities must be determined
at the time of platting. Other utilities are available within the area of the subject property and
may be extended to the site by the developer.
The proposed organization of and access to the various land uses is well planned, in staff s
opinion. The applicant has proposed a single, unified, entrance from E. 116`h Street N. into the
industrial section of the PUD. The residential development is situated along two public rights -
of -way. One access will be located on E. 116`h Street N., another on N. Mingo Road. Two
access are proposed for the commercial area, one from N. Mingo Road and the other from the
proposed public right -of -way entering the site from E. 116`' Street N.
Sidewalks will be required at the time platting along all public rights -of -way within and adjacent
to the development.
Unified Treatment of the PUD Subject Area
The applicant effectively utilized the site and its existing features and thoughtfully located the
various land uses proposed within the PUD.
According to the Outline Development Plan, "To ensure continued maintenance and to provide
continuity of the overall development, a property owners' association will be formed as part of
the restrictive covenants at the time of final platting, if required." The possibility of future
dedication of the preserved open space as park may, at least, partially eliminate this requirement.
RECOMMENDATION
Staff recommends approval of OPUD -01 -01 & OZ -01 -01 subject to the following conditions:
1. The provision of sidewalks shall be required along all public rights -of -way within and
adjacent to the proposed development at the time of platting.
2. Provision for the perpetual maintenance of, or the dedication upon acceptance by the
City of the preserved open space shall be provided at the time of platting.
3. The natural drainage way and the associated native vegetation to remain shall be
protected during construction by the erection of orange mesh or equally appropriate
fencing along the outermost dripline of the tree canopy. No storage of equipment,
supplies or debris, and no construction staging activity shall occur within the
protective fencing.
4. The adequacy of the existing water and sewer facilities near the site to accommodate
the proposed uses shall be determined at the time of platting.

Southeast Corner of N. Mingo Road and E. 1160i Street North
Site Investigation:
The site can best be described as gently rolling pasture and lowland that may be subject
to periodic flooding. The site is covered in two distinct types of vegetation. The lower
areas of the tract are vegetated in small young stands of trees undergrowth and brush. The
higher areas have been hayed in the past and are described as meadows or natural fields.
Review of the FEMA floodplain document indicates that a large area bisecting the center
of the tract is considered to be within the 100 -year floodplain and may be periodically
flooded. This area has been delineated on the site map.
Design Intent:
It is the intent of the developer to create a multi -use area that compliments the residential,
commercial and industrial base of the City of Owasso. Intended uses will include
approximately 2.2 acres of Commercial zoning 9.6 acres of Residential Duplex zoning
and 15 acres of Industrial/Light Manufacturing/Research and Development zoning.
The commercial property will be located in the Northwest corner of the tract of land. This
area will be developed in a use that would serve the neighboring residential development
as well as the future residents within the development area. Uses may include
convenience type establishments, restaurants or small merchant operations. The size of
this area has been restricted to prevent large commercial ventures from occurring in this
area.
The land adjacent to the commercial area and lying west of the channel area will be
constructed in attached housing units. Due to the location of the 100 -year floodplain, the
PUD designation will allow the clustering of the home in the area of land not considered
to be within this area. It is likely that in this type of development common area will be
integrated into the plan. To insure the continued maintenance and to provide continuity of
the overall development, a property owners association will be formed as a part of the
restrictive covenants at the time of final platting if required.
The floodplain area will be retained for open recreational use and flood detention and
protection. Consideration will be given to participation with the City of Owasso to create
a linear park in this area. It is the desire of the developer to leave as much of the
floodplain area in its natural state.
The remainder of the tract lying east of the drainage channel will become an industrial -
light manufacturing/research and development tract. Uses will be strictly limited to
protect the surrounding community from harm and disturbance. The PUD document will
limit the type of activity that occurs on this tract to those that create minimal impact on
sound, light, noise and odors. Only those uses that are manufactured or constructed
within the confines of a building will be allowed. As referenced in the single - family area,
this tract is also bounded by the floodplain. Limited disturbance of this area is proposed.
The natural vegetation in the floodplain will provide a buffer between the industrial use
and the residential structures located on the western portion of the tract.
Utilities:
Within the last year a sanitary sewer system has been installed along the western
boundary of the tract. This sanitary sewer can be extended to the east along the southern
boundary of the tract to pick up the residential area as well as the industrial tract.
Ample water is available to the site. Lines exist along the Northern and eastern
boundaries of the tract. In each case, road bores of Mingo Drive and 116 h Street North
will be required to facilitate the water service directly to the tract.
Private Utilities are such as: telephone, natural gas, electric, and cable television are
available to the area and can be extended at the developer's expense to serve the tract.
At the time of preliminary plat and final plat, utility easements of the appropriate size and
location will be coordinated with all utility companies and delineated in these documents.
Access:
Two main arterial roadways provide access to the site: Mingo Drive and 116'b Street
North. To minimize the traffic conflicts between vehicles traveling these arterial streets
and traffic generated by the development, limits of no access will be created at the time
of platting of the property. In general, two points of access are planned along both arterial
roads. Mingo Drive will have one point of access entering the Residential Duplex District
and one drive entering the Shopping Center District. On East I I Street North, the
access to the Shopping Center District and the Residential Duplex District will be
through a shared access roadway. The access to the Industrial Light Manufacturing
/Research and Development will be limited to a single Drive.
More detailed information concerning the exact placement of the drives, widths, etc will
be provided at the time of platting and site development plan approval.
Access to the site can also be accomplished through the existing railway. If the occupant
of the Industrial area finds rail access necessary, a small loading spur can be constructed
to provide such access.
Development Plan:
Upon approval of the overall Planned Unit, it is the intent of the developer to begin the
process of completing design and construction documents for the industrial portion of the
property followed by development plans for the remainder of the property. It should be
noted that under PUD requirements, the City will require Detailed Site Plans and
Construction Documents. Public hearings must be held to allow public input in the final
design of the Planned Unit Development. The final design and construction drawings of
this development will meet or exceed all requirements and regulations outlined in the
City of Owasso Zoning and Subdivision Regulations.
To facilitate the development of the entire tract, it is the developer's intention and desire
to have stormwater detention facilities for the entire tract constructed during the first
phases of construction. This facility will be located within the open space area located
between the Industrial and Residential areas of the tract and will be constructed in such a
manner as to serve as a site amenity for the entire development.
Construction of the first phase is anticipated to begin within the year 2001.

APPLICANT AND STATUS OF APPLICANT: Keith Burd, Builder
REQUESTED ACTION AND PURPOSE: The applicant has requested the partial closing of
an existing 20' utility easement situated along the west property line of the subject property to
accommodate a 4.1' encroachment into the easement.
LOCATION AND SIZE: The subject property is approximately 11,000 square feet in size and
is located at 14102 E. 86th Court N. A location map is attached for your information and review.
EXISTING LAND USE: The current zoning on the subject property is PUD/RS -2 (Planned
Unit Development/Residential Single - Family, Medium Density) with an existing dwelling.
SURROUNDING LAND USE: The lot is located within The Bradfords of Silver Creek and
surrounded by similar lots on the north east and west. The lot is bound by E. 86`h St. N. on the
south and further south is the future Greens at Owasso apartments and Friendship Baptist
Church.
SITE INFORMATION: The subject property is located at the southeast corner of the
intersection of E. 86th Court N. and N. 141St E. Avenue. The dwelling is oriented to E. 86`h Court
N.
ANALYSIS
The applicant has requested a partial closing of the platted 20' Utility Easement to accommodate
a 4.1' encroachment by the dwelling structure. A request for a variance to the Owasso Zoning
Code to reduce the associated 20' Building Setback was approved by the Board of Adjustment at
the January 2, 2001 special meeting. A survey plat and legal description of the proposed closure .
are attached for your information and review.
The easement closing was reviewed by the Technical Advisory Committee at the December 27,
2000 regular meeting and no comments and/or objections were recorded.
RECOMMENDATION
Staff recommends approval of the partial closing of the existing 20' Utility Easement located on
Lot 1, Block 1, Bradfords of Silver Creek, as described in the attached legal description.

BACKGROUND
The City of Owasso has received a request for review of a site plan for a tract of land described
as Lot 1, block 1, Three Lakes Industrial Park. The subject property is located east of the
Owasso Expressway and north of E. 76th Street N. at the rear of 8291 Owasso Expressway (Dr.
Bode's Office). A location map is shown on the site plan for your convenience.
ANALYSIS
Dunaway Medical Center will be 5075 square feet in area. The parking requirement for this
facility is 1 space per 150 square feet of building area. Based on this requirement, the applicant
would need to provide 34 spaces, including 2 handicap accessible spaces, of which one must be
van accessible. The applicant has provided 34 spaces, but has only provided 1 handicap
accessible space which is not van accessible. The existing Optometrist office building was
approved, according to the applicant, in the 1970's with 14 spaces. Therefore, the total parking
requirement for the site is 48 spaces. No loading birth is required for this facility.
Drainage is directed to the east to the existing 55' drainage easement at the rear of the property
and detention will be provided within the parking area.
Refuse collection has not been addressed on the site plan. If dumpster type refuse collection is
anticipated it should be located so as not reduce the required parking and should be screened
with opaque fencing.
The Technical Advisory Committee reviewed the site plan at the December 27, 2000 regular
meeting. Several comments were made, most involved coordination with Public Works which
was not represented at the meeting. The applicant met with Public Works and acceptable
solutions have been presented.
RECOMMENDATION
Staff recommends approval of the Site Plan for Dunaway Medical Center subject to the
following conditions:
1. The total parking for the two buildings shall equal 48spaces including 2 handicap
accessible spaces of which one must be van accessible.
2. Dumpster refuse collection, if required, shall not reduce the required parking and
shall be enclosed with opaque fencing.

BACKGROUND
The City of Owasso has received a request for review of a site plan for a 3 acre parcel of land
located at the southwest corner of E. 5`h Avenue and S. Cedar Street. The subject property is
described as a portion of the northeast quarter (NE /4) of Section 31, Township 21 North, Range
14 East. A location map is shown on the site plan for your convenience.
ANALYSIS
Owasso Industrial Park West will incorporate 2 existing buildings and 3 new buildings. The use
specified by the applicant for the existing and proposed buildings is warehouse. The total
building area is 40,102 square feet. The parking requirement for warehouse facilities is 1 space
per 500 square feet of building area. Based on this requirement, the applicant should provide 80
spaces including 3 handicap spaces, one of which must be van accessible. There are 10 existing
parking spaces at the northeast portion of the site associated with the larger existing building.
This parking along with the proposed additional 70 spaces meets the parking requirement. One
loading birth will be required for each new building for a total of three. The applicant has
provided four loading births. However, the zoning code requires a minimum 10'x30' birth
exclusive of drive aisles and this requirement has not been met on two of the births. All
vehicular circulation and parking areas within this site must be paved.
Drainage is directed to detention facilities located at the southeast and southwest corners of the
site.
Screened refuse collection is provided at the northwest area of the site.
