Adjournment. i OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Tuesday, January 9, 2001 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Charles Willey Bob Randolph Bill Ellison Larry Helton MEMBERS ABSENT STAFF PRESENT Donna Sorrells Stan Ewing Marsha Hensley The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on January 4, 2001 at 4:00 PM. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL CONSIDER APPROVAL OF THE NIINUTES OF THE DECEMBER 12, 2000 REGULAR MEETING. Bob Randolph moved to approve the minutes of the December 12, 2000 meeting, Larry Helton seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Bill Ellison - Yes Charles Willey - Yes Larry Helton - Yes The motion carried 5 -0. 4. OPUD -01 -01 & OZ -01 -01 - Vines Properties - A request for review of a rezoning of a 25 acre, more or less, parcel of land located at the southeast corner of E. 116d' Street N. and N. Mingo Road. The subject property is generally described as a portion of Government Lot One (1), northwest quarter (NW /4) of the northwest quarter (NW /4) and a portion of the northeast quarter (NE /4) of the northwest quarter (NW 14) of Section 7, Township 21 North, Range 14 East (Ward 1). Donna presented the case to the Commissioners and described the property location. She stated that the land is undeveloped and is approximately 26.8 acres. The PUD request is calling for 2.2 acres of CS (Commercial Shopping) located on the northwest corner, 9.6 acres of RD (Residential Duplex) located on the south and east of the commercial area and 15 acres of IL (Industrial Light) zoning located east of the drainage way. Notification was published in the Owasso Reporter and letters were mailed to surrounding property owners. This proposed rezoning is in compliance with the Comprehensive Plan. Sidewalks will be required at the time of platting along all public rights -of -way within and adjacent to the development. Design intent was discussed along with utilities and access to the property. Construction of phase one will begin within the year 2001. The applicant OWASSO PLANNING COMMISSION January 9, 2001 Page No. 2 was present to answer questions. Staff recommends approval of OPUD -01 -01 and OZ- 01-01 subject to the following conditions: 1. The provision of sidewalks shall be required along all public rights -of -way within and adjacent to the proposed development at the time of platting. 2. Provision for the perpetual maintenance of, or the dedication upon acceptance by the City of the preserved open spaces shall be provided at the time of platting. 3. The natural drainage way and the associated native vegetation to remain shall be protected during construction be the erection of orange mesh or equally appropriate fencing along the outermost dripline of the tree canopy. No storage of equipment, supplies or debris, and no construction staging activity shall occur within the protective fencing. 4. The adequacy of the existing water and sewer facilities near the site to accommodate the proposed uses shall be determined at the time of platting. 5. Evaluate need for an environmental study. Mr. Haynes asked if there were any questions or concerns from the Commissioners or the public in attendance. The following were comments made: T. W. Biggs - 9727 E 116 St No - There are lots of problems with the subject property. For instance, there are mineral residues and coal because of the strip mining that use to take place on that land. Has lived there 28 years and has seen a lot of vehicle accidents on 116' Street North and Mingo. This street cannot support much commercial traffic. He would also like an environmental study to be done. Larry Fowler - 11621 N 103 E Ave - Concerns with heavy traffic in the area. The roads are already in bad shape. Bobby Pittenger - 10302 E 116 PI No - Would like to get his street fixed (Northl03th E Ave). Mr. David Charney made some brief comments on the request. He stated that the traffic problems are due to the rapid growth of Owasso. With acceleration/deceleration lanes installed this development could improve the traffic flow. Mr. Charney also stated that this request is in compliance with the 2010 Land Use Master Plan. He spoke of the demand in the Owasso area for IL (Light Industrial) zoning. Ray Haynes explained that there would be no construction prior to this zoning approval and site plan approval. He also stated that the site plan would come before the Owasso Planning Commission at a later date. Easement Closure - Keith Burd - A request for review of the partial closing of a 20' utility easement along the west boundary of Lot 1, Block 1, The Bradfords of Silvercreek located at 14102 E 86" Court N. (Ward 3) Donna presented the case and described the location of the property. She explained that the subject property is approximately 11,000 square feet and is zoned PUD /RS -2. The Board of Adjustment on January 2, 2001 approved the 20' building setback. The Technical Advisory Committee reviewed the easement closing and there were no comments or objections. Staff recommends approval of the partial closing of the existing 20' utility easement. The applicant was not present. Mr. Tom Kimball, the developer for Bradfords of Silver Creek, answered a few questions that the Commissioners had regarding the request. Mr. Kimball stated that this was a model home for two years and the current residents were the first owners. Apparently the surveyor staked the lot incorrectly. Ray Haynes suggested that the item be tabled until the next Planning Commission meeting, giving Mr. Burd a chance to explain some of the issues with the closing. Ray Haynes moved to table the easement closure until the next meeting which would be February 13, 2001 at 7:OOPM, Bob Randolph seconded the motion. Site Plan - Dunaway Medical Center - A request for review of a site plan for Dunaway Medical Center, a 0.60 acre site located north of E. 76" Street N. and east of the Owasso Expressway, and generally described as a portion of Lot 1, Block 1, Three Lakes Industrial Park. (Ward 3) OWASSO PLANNING COMMISSION January 9, 2001 Page No. 4 Donna presented the item and described the location. The medical center will be 5075 square feet in area. She described the parking situation, stating that the total parking for this building and the Optometrist office should equal 48 spaces including 2 handicap accessible spaces of which one must be van accessible. Donna explained that the drainage is directed to the east and detention will be provided within the parking area. The Technical Advisory Committee reviewed the site plan with comments, which involved coordination with Public Works. Staff recommends approval of the Site Plan for Dunaway Medical Center subject to the following conditions: 1. The total parking for the two buildings shall equal 48 spaces including 2 handicap accessible spaces of which one must be van accessible. 2. Dumpster refuse collection, if required, shall not reduce the required parking and shall be enclosed with opaque fencing. Ray Haynes moved to approve the site plan subject to the above staff recommendations, Bob Randolph seconded the motion. Site Plan - Owasso Industrial Park West - A request for review of a site plan for the Owasso Industrial Park West, a 3 acre site located at the southwest comer of E. 5' Avenue and S. Cedar and generally described as portion of the Northeast Quarter (NE /4) of Section 31, Township 21 North, Range 14 East. (Ward 4) Donna presented the item and described the location. The total building area is 40,102 square feet. The applicant needs to provide 80 spaces including 3 handicap spaces. The parking along with the proposed 70 spaces meets the parking requirement. The site plan shows four loading births. Drainage is directed to the southeast and southwest corners of the site. The Technical Advisory Committee reviewed the site plan at the December 27, 2000 regular meeting. The comments involved coordination with Public Works. Staff recommends approval of the site plan for Owasso Industrial Park West subject to the following conditions: 1. All vehicular circulation and parking within the subject property shall be paved. Sorrells — City Planner BACKGROUND Heritage Construction Corporation has submitted to the City of Owasso a petition for annexation of their property totaling 38.39 acre, more or less. A location map is attached for your information and review. The subject property is currently zoned AG (Agriculture) and would remain so upon annexation, as required under Owasso's Annexation Policy. A copy of the Annexation Policy is attached for your information. If annexation is approved, the subject property will require rezoning and platting prior to development. Acceleration/deceleration lanes will be required along N. Garnett Road at the time of platting. If the Planning Commission approves the annexation request, the application will be forwarded to the City Council for review and approval. Two consecutive legal notifications will appear in the February 15th and 22 "a editions of the Owasso Reporter prior to submittal to the City Council. A copy of the Procedure for Annexation is attached for your information. The Technical Advisory Committee reviewed the annexation request at the January 31, 2001 regular meeting. No comments were generated at that time. The Owasso Annexation Committee reviewed the request at their meeting held February 1, 2001 and recommended approval. The applicant's consultant was advised, at that time, that the property was not contiguous. The resulting agreement was the applicant would annex a contiguous utility easement, upon agreement with the landowner, extending east from N. Garnett Road to the subject property. RECOMMENDATION Staff recommends approval of this annexation request subject to the following condition: 1. A sealed engineering report or letter confirming the ability of Washington County RWD3 to provide adequate fire protection standards be submitted prior to approval of any plat associated with the annexed property. ANALYSIS The First Baptist Church of Owasso will be 60,000 square feet with an additional 29,000 square feet proposed in Phase 2. The Owasso Zoning Code requires 1 parking space per 40 square feet of sanctuary floor area, including and 1 loading birth per 10,000 to 200,000 square feet of building area. Of the 60,000 square foot building proposed for Phase 1, approximately 12,000 square feet is sanctuary, according to the builder. Therefore, the applicant is required to provide 300 parking spaces, including 7 handicap accessible spaces, and 1 loading birth. One of every eight handicap accessible spaces shall be van accessible. The applicant has provided 252 spaces, including eight handicap accessible spaces, for Phase 1. The building proposed in Phase II will house the new sanctuary, when constructed. The Phase 1 sanctuary will then convert to a fellowship hall. The Phase 2 facility is 29,000 square feet in size. Based on the parking requirement, the church will be required to provide 725 parking spaces, including 10 handicap accessible, for the facility. Sorrells — City Planner BACKGROUND Elite Pools, owner, has requested review of the Site Plan for Elite Pools, located on Lot 2, Block 9, Ator Heights 3rd Addition, north of E. 86`h Street N. and west of the Owasso Expressway. A location map is shown on the site plan for your convenience. The subject property is zoned CG (Commercial General). ANALYSIS The applicant has proposed placement of a 1440 square foot "office trailer" on the subject property. The trailer must meet the BOCA building code standards. According to the Owasso Zoning Code, the parking required is 1 space per 200 square feet of building area. Based on this requirement, the applicant must provide 7 spaces, including one handicap /van accessible space. The applicant has provided 9 spaces including the required handicap accessible space. No loading birth is required for the building. The parking shall be paved with curb and gutter. The parking lot will act as the detention facility for this site. The applicant intends to have pool, spa and pond displays located in the front of the proposed building. This area shall be fenced and remain locked while not attended by employees. Sorrells — City Planner BACKGROUND Mike Roark, owner, has requested review of the Site Plan for a buildin§ located within Ram Plaza P.U.D. (OPUD -11), north of E. 866' Place N. and west of N. 129 E. Avenue. A location map is attached for your information and review. The subject property is zoned PUD /CS (Planned Unit Development with Commercial Shopping underlying zoning). ANALYSIS The proposed commercial building is 9320 square feet. According to OPUD -11, Ram Plaza P.U.D., the parking requirement is 1 space per 300 square feet of building area. Based on this requirement, the applicant should provide 31 spaces, including 2 handicap accessible. One of every eight handicap spaces must be van accessible. The applicant has shown 40 spaces on the site plan. Staff is requesting the plan be approved less the 5 parallel spaces shown along the north property line of the site. The applicant could then shift the building north and provide sidewalk between the building and the south parking adjacent to the building. No refuse collection area is defined on the site plan. If dumpsters are to be used, accommodations must be supplied and should be screened with opaque fencing. The Technical Advisory Committee reviewed the site plan at the January 31, 2001 regular meeting. A memorandum detailing the comments generated is attached for your information and review. The applicant has coordinated with Phil Lutz, Public Works, and has gotten the necessary guidance to complete grading and drainage, sedimentation and erosion control, and utility plans. Staff recommends approval be conditioned upon the completion and staff approval of these documents. No landscape plan was submitted for this site plan review. The P.U.D. Outline Development Plan and Text calls for the unified treatment of the overall development with respect to landscaping.
