OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Tuesday, April 10, 2001 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Charles Willey Bill Ellison MEMBERS ABSENT STAFF PRESENT Donna Sorrells Marsha Hensley Stan Ewing The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on April 6, 2001 at 9:30 AM. 1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF MARCH 13, 2001 REGULAR MEETING - The Commission reviewed the minutes of March 13, 2001 Regular Meeting, Charles Willey moved, seconded by Bill Ellison to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison — Yes Charles Willey - Yes The motion carried 3 -0. Mr. Haynes stated that Item #6 has been pulled from the agenda and is rescheduled for May 8, 2001. 4. Proposed Citizen - Sponsored Zoning Code Amendment — Charles Norman — A request for review of a proposed amendment to Chapter 10, Section 1011.4, Off -street parking and loading requirements for medical office facilities. Donna presented the item. The information on this item was submitted to the Commissioners at the March 13, 2001 meeting in order to give the Commissioners time to review the code amendment request. Donna stated that the applicant is requesting a reduction in the required parking for all medical office buildings, from 1 space per 150 square feet to 1 space per 200 square feet. Several municipalities were surveyed and felt that 1 space per 200 square feet was adequate. Any amendment to the zoning code would not affect the parking requirement for the approved site plan for the Owasso Medical Center. Staff recommends approval allowing parking standards of 1 space per 200 square feet of building floor area on medical office facilities larger than 50,000 square feet in size. Mr. Charles Norman was present on behalf of SJSF Venture, to answer any questions. Also, Mr. Jon Eshelman with Traffic Engineering Consultants, Inc. was present to address concerns regarding the reports enclosed in the packets. Mr. Norman requested to address the Commissioners. Mr. Norman explained that he understood why the Board of Adjustment denied the variance request in September of 2000, due to the fact OWASSO PLANNING COMMISSION April 10, 2001 Page No. 2 that there were no hardships and the facts did not exist. After that denial a decision was made to apply for an Amendment of the Code. We are requesting 1 space per 200 square feet of building floor, which would be a reduction of only 25 %. Mr. Norman suggested that the present requirement of 1 space for 150 square feet could remain applicable to medical offices and clinics with 10,000 square feet or less. He asked the Commissioners to consider 1 parking space for each 200 square feet for facilities over 10,000 square feet of floor area. Ray Haynes questioned the breaking point on building size of other cities. Mr. Norman replied that other municipalities did not calculate off of facility sizes. Charles Willey suggested a graduated proposal such as, the first 15,000 square feet would require 1 space for 150 square feet, and any additional would be 1 space per 200 square feet. Mr. Jon Eshelman stated that he was still convinced that 1 per 200 square feet per building space of 10,000 is still valid. He also explained that he is sensitive to spill over traffic and would not be comfortable if it wasn't right and fair and does not want to cause traffic problems with the city. Charles Willey moved to approve a graduated proposal of the first 15,000 square feet of the building area to be 1 parking space for 150 square feet, any additional square footage will be 1 parking space for 200 square feet. This would apply only to medical office facilities. Bill Ellison seconded the motion. OZ -01 -02 — Dale & Lee's — A request for rezoning of Lot 1, Block 2, Original Town of Owasso from RS -3 (Residential Single Family, High Density) to OL (Office Light). The subject property is located at 302 S. Birch and contains approximately 9,600 square feet. (Ward 4) Donna presented the item and described the location. Donna stated that the above property contains a vacant residential structure although, this structure would be removed if the rezoning were approved. The residences north and east of the property are oriented away from the subject property. Letters were mailed to surrounding property owners and legal notification was published in the March 22, 2001 edition of the Owasso Reporter. One call was received by staff with concerns, which were similar to the items the applicant addressed in a letter dated April 5, 2001. Staff recommends approval of the rezoning. Mr. David Charney, the attorney for the applicant, was present to answer questions. Mr. Dale DeBoer, the owner of the property was also present. Mr. Charney requested to speak before the Commissioners. He stated that he was aware that there were a few neighbors that objected to this rezoning. Also discussed was the possibility of covenants if it is rezoned to Office Light. Mr. Ellison and Mr. Willey expressed concerns with the heating and air conditioning units stacked up outside the building. Mr. OWASSO PLANNING COMMISSION April 10, 2001 Page No. 3 Willey also had concerns with covenants not being a good enough tool, if the neighbors wanted to complain they would have to hire an attorney in order to get the problem resolved. Ms. Pat Marlar (306 North Birch) was present to expressed objection. Ms. Marlar stated that the property was grandfathered into the City of Owasso and had concerns with attaching an office light zoning to a commercial shopping zoning. She also stated that drainage in the area was very poor and would rather see a residential house built on the lot, the Owasso Comprehensive Plan states that it will protect residents from commercial property. Mr. Charney suggested that Ms. Marlar take a part in reviewing the site plan prior to the Commissioner's review. The City has ordinances that help protect citizens. Mr. DeBoer stated that they have tried to address problems that have arisen and they are trying to be good neighbors. Ray Haynes announced a recess at 8:35PM for approximately 10 minutes. The meeting was called back to order at 8:45PM. Ray Haynes stated that he had problems with this issue because of the two vacancies on the Planning Commission, it would take a unanimous vote to pass. To be fair to both parties involved we feel that we need to table this item. After discussion, Ray Haynes moved to table the item until the next Planning Commission meeting, Bill Ellison seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey — Yes The motion carried 3 -0. 6. Site Plan — Summit Commercial Center — A request for review of a site plan for Summit Commercial Center described as a portion of Lot 1, Block 1, The Summit Commercial Center. The subject property contains 111,475 square feet and is located at the southwest corner of E. 861" Street N. and N. Main Street. (Ward 4) The applicant requested this item to be pulled from the agenda. 7. Site Plan — Speedy Bob's Auto — A request for review of a site plan for Speedy Bob's Auto described as Lot 14 & 15, Block 5, Hale Acres. The subject property contains 82,400 square feet and is located south of E. 116" Street N. and west of the N. Garnett Road. The property was described and Donna explained that the detention would be within the parking lot, which will have continuous curb and guttering. The Owasso Technical Advisory Committee reviewed the plat at the March 28d' meeting. Staff recommends approval of the site plan for the Speedy Bob's Auto subject to the following conditions: OWASSO PLANNING COMMISSION April 10, 2001 Page No. 4 1. All TAC comments shall be addressed prior to the issuance of a building permit. 2. Sidewalk shall be provided along N. Garnett Road as required by Section 3.4 of the Owasso Subdivision Regulations. The applicant was present to address concerns. Ray Haynes questioned the purpose of a sidewalk along North Garnett Road. Donna explained that it might not be fair to require a sidewalk and may want to strike item #2 of the staff recommendations. Ray Haynes moved to approve the site plan with the omission of item #2 on the above staff recommendations, Charles Willey seconded. Sorrells — City Planner BACKGROUND Charney & Charney, attorneys for Dr. Donald & Beverley Dunaway, has submitted to the City of Owasso a petition for annexation of a 160 acre, more or less, tract of land generally described as the Southwest Quarter (SW /4) of Section 10, Township 21N, Range 14E. A location map is attached for your information and review. The subject property is currently zoned AG (Agriculture) and would remain so upon annexation, as required under Owasso's Annexation Policy. A copy of the Annexation Policy is attached for your information. If the annexation is approved, the subject property will require rezoning and platting prior to development. The subject property would receive sewer service from City main extensions currently in progress northward along N. 145a' E. Avenue. Further study may be required of the applicant to determine the City of Owasso's ability to provide the required capacity with current facilities. Water service will be provided through Rogers County Rural Water District #3. However, it is staff's opinion, water service should meet all City of Owasso standards at the time of development. If the Planning Commission approves the annexation request, the application will be forwarded to the City Council for review and approval at the May 15, 2001 regular meeting. Two consecutive legal notifications will appear in the May 3 & May 10, 2001 editions of the Owasso Reporter prior to submittal to the City Council. Letters were mailed to adjacent property owners on May 1, 2001. A copy of the Procedure for Annexation is attached for your information. The Owasso Annexation Committee reviewed the request at their meeting held April 5, 2001 and recommended approval. RECOMMENDATION Staff recommends approval of this annexation request subject to the following condition: A sealed engineering report or letter, confirming the ability of Rogers County Rural Water District 93 to provide adequate fire protection standards, as required by the State of Oklahoma, be submitted prior to approval of any plat associated with the annexed property. Sorrells — City Planner BACKGROUND David Chamey, attorney for the owner, has submitted a request for rezoning from RS -3 (Residential Single - Family, High Density) to OL (Office Light) on property located at 302 N. Birch. The subject property is approximately 9,600 square feet in size. This application was heard at the April 10, 2001 regular meeting and was tabled at that time to allow for a full Commission vote. The subject property currently contains a vacant, dilapidated residential structure. To meet the structure setback requirements of the Office zoning district, the existing structure would be removed and a compliant structure would be erected. The property is bound -on the north by RS- 3 (Residential Single - Family, High Density), on the west by CS (Commercial Shopping) including Dale & Lee's, on the south by RS -3 and the First United Methodist Church, and on the east by RS -3 zoning and use. ANALYSIS The applicant is requesting rezoning on a parcel of land, approximately 9,600 square feet in area, from RS -3 (Residential Single- Family, High Density) to OL (Office Light). While the request is not in line with the Comprehensive Plan, staff feels this particular property is oriented to the surrounding residential in such a way as to not encourage future redevelopment or reuse of the property as residential. The subject property lies just south of the point where N. Ash and N. Birch split and diverge from N. Birch. The residences north and east of the subject property are oriented away from the subject property. The property directly east at the northeast corner of E. 3`a Street and N. Birch is primarily vacant other than some detached accessory buildings. The applicant has had significant contact with the surrounding property owners and has worked directly with certain property owner's to ensure their concerns are addressed. A letter from the applicant to an adjacent property owner is attached for your information and review. Letters were mailed to surrounding property owners on March 19, 2001and legal notification of the proposed rezoning was published in the March 22, 2001 edition of the Owasso Reporter. Staff received one call from a concerned citizen regarding this application. While the citizen had concerns, it was staff s impression that the concerns were similar to those which the applicant had addressed in the previously mentioned letter and the caller's concerns would be addressed. Avenue. The subject property is generally described as tract of land in the North Half (N /2) of the Northwest Quarter (NW /4) of the Southeast Quarter (SE /4) of Section 28, Township 21N, Range 14E. A location map is shown on the plat for your convenience. The subject property is zoned RS -3 (Residential Single - Family, High Density). The subject property was annexed in March of 2000. The original annexation request included the subject property along with Lot 9, Block 1 of Graceland Acres, which was subsequently removed prior to ordinance adoption. It was determined the lot did not meet City standards, therefore did not conform with the City's Annexation Policy. The property was rezoned to RS -3 in April of 2000. Copies of Planning Commission and City Council minutes of pertinent public meetings regarding the annexation and rezoning of the subject property are attached for your information and review. In October, 2000, the applicant submitted a rezoning request to Tulsa County regarding Lot 9, Block 1 of Graceland Acres. A letter was sent to Jo Casey, INCOG, at that time stating the Owasso Planning Commission's wishes regarding access. A copy of the letter is attached for your information and review. The rezoning application was subsequently tabled by the Tulsa Metropolitan Area Planning Commission and no other action has been taken. A copy of the TMAPC minutes is attached for your information and review. During each of the previous processes, several residents of Graceland Acres have participated in the public meetings. Of particular concern to the Graceland Acres residents is access being made to site through their neighborhood, on county roads not constructed to City of Owasso standards. Meeting minutes of the previous Planning Commission and City Council actions, a partial plat of the Owasso Golf and Athletic Club, and a plat of Graceland Acres, as well as photographs depicting the environment are attached for your information and review. At the time of Planning Commission review of the rezoning, the request was approved subject to access being shown by way of the 22' access easement, provided at the applicant's request, to the west side of the adjacent property at the time of platting. Also, at that time, the residents of Graceland Acres were invited to request future notification at the platting stage of project. Those who requested notification were notified of the preliminary plat review by letter dated April 21, 2001. A copy of the letter is attached for your information and review. ANALYSIS The original preliminary plat for Denali Heights was submitted including lots shown on and access through Lot 9, Block 1, Graceland Acres. The applicant was informed at that time the City of Owasso could not process a plat containing property not under the jurisdiction of the City of Owasso. The plat was revised to reflect only the property within Owasso's city limits with access still shown to E. 79`h Street N. The applicant has provided information on the plan sheet of the plat showing Joe Wolfe as owner and D.M. & Phyllis Sokolosky as trustees on the certificate sheet. A copy of the Warranty Deed for the property shows Mr. Wolfe as owner, simply. Therefore, Mr. Wolfe should be reflected as such in the certificate. A copy of the warranty deed is attached for your information and review. The subject property lies within the Elm Creek Sewer Interceptor Payback Area. An fee of $1580.00 per acre is assessed on defined properties benefited by the improvement. The subject property contains 20.0 acres and, therefore, a fee of $31,600.00, as well as storm siren fees, at $16.00 per acre, totaling $320.00 will be due prior to release of the final plat for filing. The eastern 4 acres, more or less, of the applicant's property is not included within the limits of this preliminary plat. It is staff s opinion, if stormwater detention for this development is to occur within that 4 acres, the area should be included within the plat boundary and maintenance of the area provided for within the text of the covenants. Staff recommends the east -west right -of -way shown on the preliminary plat be modified to stub out at the west property boundary of this proposed subdivision for future connection to and access through Copper Meadows. The Technical Advisory Committee reviewed the preliminary plat at the April 25, 2001 regular meeting and comments were note. A copy of a memorandum summarizing comments made by the committee is attached for your information and review. RECOMMENDATION Staff recommends approval of the preliminary plat for Denali Heights at Wolfe Creek subject to the following conditions: 1. A subdivision plat be approved by the Owasso City Council and filed with the County Clerk's office prior to the issuance of a building permit. 2. Show correct ownership on certificate. 3. All water lines installed within the subdivision boundary shall meet the City of Owasso's standards. Water pressure shall also meet the City of Owasso and ODEQ standards. 4. AN ORDINANCE PROVIDING FOR THE ANNEXATION OF NORTH 145" EAST AVENUE Mr Rooney said that the City Council approved annexation of the above - mention tract, plus Lot 9, Block 1 of Graceland Acres addition, at their February 15, 2000 meeting. Since that meeting, the annexation has been reviewed and the annexation request revised to exclude the lot in Graceland Acres. Graceland Acres is a Tulsa County subdivision, and excluding this lot is more consistent with the City's annexation policy. Ordinance 4635 reflects that revision. The city main that caused the damage to the residence has now been repaired. Mr Rooney presented the item.. The City has received a request from RCB Bank, applicant and owner, for the review of a final plat for RCB Center, a 5.66 acre, 3 lot subdivision, located at the southwest corner of E 96`h St N and U.S. Highway 169. A standard requirement of all platting adjacent to arterial streets in the community is the inclusion of acceleration/deceleration lanes and sidewalks. Plans are already under way for the E 96`h St N Improvements, and RCB Bank has agreed to participate financially for the portion of the improvements that would be attributed to them, as well as to assist with funding for the proposed traffic signal at N 1215` East Ave and E 96'h St N. All planning, zoning, subdivision, and Technical Advisory Committee requirements have been addressed. The Planning Commission approved the final plat for RCB Center at their February 8, 2000 meeting. He also had questions regarding the easement for access into the addition. Robert Thomas - Concerns regarding the street in which the traffic will be using. Jim Phillips - Questioned as to whether the property is annexed into the City. Maxine Thomas - Drainage concerns in the area. Does not like the idea of access into the subject property going through the lot Mr. Wolfe owns in Graceland Acres. Bob Bates - Concerned with the water run off in the area. Ray Haynes stated that tonight's discussion is on the zoning change of the property. The platting process will show the drainage plan and that will be at a later date. He suggested that if the nearby homeowners would put an asterisk by their name on the sign -in sheet, he would send them notification when the platting process begins.
