Sorrells — City Planner BACKGROUND DLH Engineers, agent for the owner, has submitted a request for rezoning from AG (Agriculture) to RS -3 (Residential Single - Family, High Density) on property located north of E. 116`h Street N. and east of N. Garnett Road. The subject property is approximately 37.42 acres in size. The subject property is currently vacant and undeveloped. The property is bound on the west by N. Garnett Road and, further, by Country Estates, also zoned RS -3; on the north and east by undeveloped farmland and large -lot county subdivisions; and on the south by commercial and county residential. ANALYSIS The applicant is requesting rezoning on a parcel of land, approximately 37.42 acres in area, from AG (Agriculture) to RS -3 (Residential Single - Family, High Density). The Owasso 2010 Land Use Master Plan designates this land as low- intensity residential. Therefore, the proposed use of single- family detached residential is appropriate for the property. During the discussion prior to annexation approval for the subject property, Mr. Lawrence Poyner stated that through an historical agreement with previous landowners, a portion of his septic field lies within the subject property. The applicant and the applicant's agent have been made aware of Mr. Poyner's claim, and have agreed to look into the matter. This issue should be resolved by the time of final platting of the property. Letters were mailed to surrounding property owners on April 17, 2001 and legal notification of the proposed rezoning was published in the April 19, 2001 edition of the Owasso Reporter.
