Consider Approval of the Minutes of the May 8, 2001 Regular Meeting and the May 17, 2001 Special Meeting. Items 4 through 12 remain the same. A new item number 13, as shown below, has been added. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL - Mr. Haynes introduced the newly appointed Commissioners Mr. Dewey Brown and Mr. Bill Williams. 3. CONSIDER APPROVAL OF THE MINUTES OF APRIL 10, 2001 REGULAR MEETING - The Commission reviewed the minutes of April 10, 2001 Regular Meeting, Charles Willey moved, seconded by Bill Ellison to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey - Yes Bill Williams - Yes Dewey Brown - Yes The motion carried 5-0. Mr. Stan Ewing addressed the Commissioners and stated, due to an error on the agenda, Item # 6 will need to be continued at a later date. Also, the applicant of Country Estates V Final Plat, which is Item #9, has requested the plat review to be pulled from the agenda. 4. Annexation - Charney & Charnev - A request for annexation of a 160 acre, more or less, parcel of land located at the northeast comer of E. 106' Street N. and N. 145" E Avenue and generally described as the Southwest Quarter (SW 14) of Section 10, Township 21N, Range 14E. Donna presented the item and described the property location. The subject property would receive sewer service from the City main extensions. Rogers County Rural Water District #3 will provide water service. Letters were mailed to surrounding property owners and the Owasso Reporter published the legal notification. Staff received several calls from interested residents, none opposing. The Owasso Annexation Committee reviewed the request at their meeting and recommended approval. Mr. Haynes asked if OWASSO PLANNING COMMISSION May 8, 2001 Page No. 2 anyone in attendance had any comments or concerns. Ms. Sharlee Kuhns, a resident who lives on the east boundary had several concerns. Ms. Kuhns had concerns with the increase of noise to the area. Also, water problem concerns with the spillover of rainwater from Chestnut Farms. She stated that there has been rainwater almost to her back door. Mr. Haynes explained that Chestnut Farms is not within the city limits of Owasso. Therefore, Owasso has no jurisdiction over Chestnut Farms subdivision. Mr. Charney, the attorney for Dr. Donald & Beverly Dunaway, requested permission to address the Commissioners. Mr. Charney explained that the City has a very strict platting process, which includes drainage from stormwater. The problem with the abundance of traffic is due to the growth that Owasso is experiencing. Charles Willey expressed concerns regarding the 5' wide strip of land located in the right -of -way on the west side of N 145' E Ave. Staff recommends approval of this annexation request subject to the following condition: 1. A sealed engineering report or letter, confirming the ability of Rogers County Rural Water District #3 to provide adequate fire protection standards, as required by the State of Oklahoma, be submitted prior to approval of any plat associated with the annexed property. Ray Haynes moved to approve the annexation request, subject to the above staff recommendation, along with the addition of the following recommendation: 2. The applicant should request annexation of the remainder of the N. 145' E. Avenue right -of -way adjacent to the subject property and left out of the previous annexation associated with the Coffee Creek (formerly Woodridge) and Tulsa Technology Center properties, so as not to leave an "orphaned" stretch of right -of -way. Bill Ellison seconded the motion. OZ -01 -02 - Dale & Lee's - A request for rezoning of Lot 1, Block 2, Original Town of Owasso from RS -3 (Residential Single Family, High Density) to OL (Office Light). The subject property is located at 302 S. Birch and contains approximately 9,600 square feet. (Ward 4) Donna presented the item and described the location. Donna explained that this application was heard at the April 2001 regular meeting and was tabled at that time to allow for a full Commission vote. The applicant has had significant contact with the OWASSO PLANNING COMMISSION May 8, 2001 Page No. 3 surrounding property owners. Letters were mailed to surrounding property owners and legal notification was published in the Owasso Reporter. Staff recommends approval of this rezoning. Mr. Charney, the attorney for applicant, was present and requested to make a brief presentation. He stated that there is a vacant, dilapidated building on this lot that will be removed if this request is approved. He also explained that he feels it is unlikely that there will ever be another residential structure on this lot and there is a great deal of non - residential activity in the area. A lot- tieing agreement would be performed at a later date. Mr. Charney also explained that the applicant would provide sewer to the new building if necessary. Mr. Charney addressed several issues in response to neighbors concerns. (letter attached) Ms: Hazel Cook, a nearby property owner, stated that she would like to see the old dwelling removed, it would improve the area. Dale & Lee's agreed to make the following commitments with regard to the proposed office: 1. No vehicular access will be permitted from Birch Street into the property. 2. The lighting on the subject building will only be on the south side of the building. 3. The parking lot will be a solid surface parking lot, not gravel. 4. All equipment and materials must be stored in such a manner that they are not capable of being viewed from adjoining properties. 5. The owner must install decorative landscaping as indicated on the proposed site plan and in a manner consistent with recommendations from the city planning staff. 6. A new six-foot cedar privacy fence will be installed along the north perimeter of the property. Ray Haynes moved to approve the rezoning subject to the above commitments Mr. Charney has put upon the proposed office building, Bill Ellison seconded. OZ -01 -03 - Heritage Construction - A request for rezoning of a 37.42 acre tract of land in the South Half (S /2) of the Southwest Quarter (SW /4) of Section 5, Township 21N, Range 14E. The subject property is located north of N. 116th Street N. and east of N. Garnett Road. OWASSO PLANNING COMMISSION May 8, 2001 Page No. 4 Mr. Stan Sallee, the applicant, requested a Special Meeting for review of this rezoning request. Ray Haynes moved to review OZ -01 -03 at a Special Meeting to be held on June 12, 2001 at 6:00 PM. 7. Preliminary Plat — Denali Heights at Wolfe Creek — A request for review of a preliminary plat for Denali Heights at Wolfe Creek, a 51 lot subdivision containing 20 acres, more or less. The subject property is located north of E. 76' Street N. and west of N 145' E Avenue and is generally described as the North half (N /2) of the Northwest Quarter (NW /4) of the Southeast Quarter (SE 14) of Section 28, Township 21N, Range 14E. (Ward 3) Stan Ewing presented the item and summarized the lengthy history of this site. The original annexation request included Lot 9, Block 1 of Graceland Acres, but the lot did not meet City standards and was removed before ordinance adoption. It was rezoned to RS -3 in April of 2000. The applicant submitted a rezoning request to Tulsa County for Lot 9, Block 1 of Graceland Acres in October 2000. This request was tabled by TMAPC and no other action has been taken. At the April 2000, Owasso Planning Commission meeting for the rezoning the request was approved subject to access being shown by way of the 22' access easement to the west side of the adjacent property. The Technical Advisory Committee reviewed the request at the April 25, 2001 regular meeting. Mr. Joe Wolfe, the applicant was present to address questions and concerns. Mr. Willey stated that he thought the discussion on this plat was completed when it came before the Commissioners in April 2000. The Commissioners were clear when they voted at that time on the access, it was to be made by way of the 22' access easement to the east of the property. Mr. Willey continued explaining that this preliminary plat request does not meet any of the recommendations from the April 2000 meeting, it should not have been brought before the Commissioners again. -Mr. Ewing explained that apparently the applicant would like access through Lot 9, Block 1 of Graceland Acres. Bill Ellison asked the attendees what it is like when the bridge on 76ie Street North is under water and traffic must detour through your neighborhood. The residents that were present agreed that extra traffic due to a detour causes a problem. Mr. Wolfe requested a brief presentation before the Commissioners. Mr. Wolfe stated that he purchased Lot 9 because his land was locked. The City recommended and granted an easement of 22' wide from his property to 76' Street North. The easement runs through a floodplain and would not be financially feasible. Mr. Wolfe understood this easement was to be for construction traffic, not residential. He also discussed the minutes being amended six months after the April 2000 Owasso Planning Commission meeting. Donna explained to Mr. Wolfe that the correction of the minutes was done at the time of the rezoning request with TMAPC. The word "adjacent" was left out, at that time it was then brought before the Commissioners to review and initial. Mr. D. M. Sokolosky requested to address the Commissioners. Mr. Sokolosky stated that he spoke with Tulsa County Commissioner Collins and at that time he was assured that the streets in Graceland Acres would be due for an overlay in the near future. Several surrounding property owners made the following comments: OWASSO PLANNING "COMMISSION May 8, 2001 Page No. 5 Jim Allison — 7835 N 134 E Ave — Discussion on improving the streets in Graceland Acres continue, they might receive improvements but they will not be widen for more through traffic. Vicki West — 13631 E 76 St No — 76' Street North traffic has increased also flooding in that area which creates the detours through Graceland Acres creates a large amount of traffic. Mark Graham = 7834 N 134 E Ave — He was present at the April 2000 meeting and remembers the stipulations the Commissioners put on the property. There are a lot of elderly residents that walk for exercise, would hate to see more traffic in the neighborhood. Staff recommends approval of the preliminary plat for Denali Heights at Wolfe Creek subject to the following conditions: 1. A subdivision plat be approved by the Owasso City Council and filed with the County Clerk's office prior to the issuance of a building permit. 2. Show correct ownership on certificate. 3. All water lines installed within the subdivision boundary shall meet the City of Owasso's standards. Water pressure shall also meet the City of Owasso and ODEQ standards. 4. Sidewalks and acceleration/deceleration lanes be provided for within the text of the deed of dedication. 5. All residential public rights -of -way shall be a minimum 50' in width as required by the Owasso Subdivision Regulations. 6. On -site detention shall be provided and included within the plat boundary. Maintenance of the detention facility and all common open space shall be provided for within the text of the covenants. 7. All sewer payback and storm siren fees shall be paid prior to release of the final plat for filing. 8. Access to the development shall be made by way of the 22' access easement provided to the east of the subject property. 9. Show and label the recorded access easement along the east property boundary. 10. The east -west right -of -way shown on the preliminary plat be modified to stub out at the west property boundary. 11. Show the lot lines of the adjacent properties, particularly the east lot line of Lot 9, Block 1, Graceland Acres on the plat. Ray Haynes moved to deny the preliminary plat request, the plat needs to be redesigned according to the motion from the Owasso Planning Commission meeting of April 2000, showing the access by way of the 22' access easement to the west side of the adjacent property. Charles Willey seconded. Final Plat - Lakeridge Shopping Center - A request for review of a final plat for the Lakeridge Shipping Center, a 1 lot, 2.89 acre subdivision located west of N. 129' E. Avenue and north of E. 86"' Street N. and generally described as a tract of land in the South Half (S /2) of the Southeast Quarter (SE /4) of Section 20, Township 21N, Range 14E. (Ward 3) Donna presented the item and described the location of the property. This property is located directly behind and to the west of Bank of the Lakes site. This plat request was brought before the Planning Commission in March 2001, where it was tabled to allow the applicant to revise the plat to address TAC comments. Stormwater detention will be reviewed at the time of site plan review. An emergency fee of $16.00 per acre will be accessed on the property. Technical Advisory Committee reviewed at the February 28, 2001 meeting. Mr. Pete Kourtis, the property owner, was present to answer any questions. Mr. Kourtis addressed questions regarding the mutual access. Staff recommends approval of the preliminary plat subject to the following conditions: 1. Sidewalk along E. 86'" Street N. shall be provided for within the text of the deed of dedication prior to forwarding the plat to City Council. 2. Add ONG standard text to the deed of dedication prior to forwarding the plat to City Council. 3. The emergency siren fee, totaling $46.24 shall be paid prior to forwarding the plat to City Council. Ray Haynes moved to approve final plat subject to the above staff and TAC recommendations being met, Bill Williams seconded. Avenue and is generally described as a portion of the South Half (S /2) of the Northeast Quarter (NE /4) of Section 6, Township 21N, Range 14E. (Ward 3) Donna presented the item.' She stated that the Technical Advisory Committee reviewed this request on April 25, 2001. An emergency siren fee of $16.00 per acre shall be accessed on this property and be paid prior to the release of the final plat for filing. Staff recommends approval of the final plat subject to the following conditions: 1. The applicant has provided 541 spaces, including 16 handicap accessible spaces. A landscape and utility plan must be submitted and approved by staff prior to the issuance of a building permit. The Technical Advisory Committee reviewed the site plan at their April 25, 2001 meeting. Staff recommends approval of the site plan for the Central Baptist Church subject to the following conditions: 1. All TAC comments shall be addressed prior to the issuance of a building permit. Proposed is a rezoning from AG (Agriculture) to RS -3 (Residential Single Family, High Density). The subject property is located north of N. 116' Street N. and east of N. Garnett Road. (Ward 1) Donna presented the item to the Commissioners. She described the location and explained that the property is currently vacant. The proposed use will be single - family detached residential. Letters were mailed to surrounding property owners and legal notification was published in the Owasso Reporter. Staff received no calls. Mr. Lawrence Poyner was present and stated that a portion of his septic field lies with the property. The applicant is aware of W. Poyner's claim and will look into the matter. There also was a brief discussion regarding the possibility of supplying sewer to Ms. Deborah Hale's property. Ray Haynes moved to approve the rezoning request, Bill Williams seconded. Sorrells — City Planner BACKGROUND Pittman, Poe & Associates have submitted for review OPUD -01 -02 The Lakes at Bailey Ranch. The Planning Commission originally reviewed and approved the PUD (OPUD -16) on December 8, 1998. Due to an error in the legal description in the December 8, 1998 agenda, the item was returned to the Planning Commission for approval on January 12, 1999. The City Council approved the PUD at the January 19, 1999 regular meeting and the associated Ordinance No. 603 on February 2, 1999. The Owasso Zoning Code, Chapter 8, Section 880.3 "Time Limit' states that "Failure to file a plat, after approval, for a Supplemental PUD designation within two (2) years shall relinquish the Supplemental PUD designation. OPUD -01 -02 reflects precisely the same Outline Development Plan and Text as was previously approved by the Commission and Council. ANALYSIS The subject property contains 408.7 acres and is located between E. 96th and E. 106`h Streets N. and between N. Garnett and N. Mingo Roads. The subject property, less 29.5 acres of rural residential/agriculture along N. Mingo Road, constitutes the remaining undeveloped land within Section 18, Township 21N, Range 14E. Existing development within Section 18 includes El Rio Vista in the Southeast Quarter, Kelly Ann Addition, Larkin Bailey Elementary School, and Coventry Gardens, all located along E. 96"' Street N. The applicant has proposed 39.9 acres of multi - family residential, apartments located at the southeast comer of E. 106`h Street N. and N. Mingo Road, and townhomes located south of E. 106`" Street N. along N. Garnett Road. Single family residential is proposed on 226.9 acres, with 67.8 acres of open space greenways distributed throughout. Commercial and office are proposed on 37.4 acres distributed at the northeast, northwest and southwest corners of the Section. A 36.7 acre church site is located directly north of El Rio Vista. The appropriate underlying zoning for this PUD was established by the approval of OZ -98 -14 by the Planning Commission and City Council at the same meetings that OPUD -16 was approved. Preservation of the floodplain areas and the use of these and additional areas as coherent links to the various developed land uses acts as a unifying element for this PUD and provides adequate area for stormwater detention. The open spaces also provide a logical buffer between incompatible land uses. Previous conditions of approval stated that acceleration/deceleration lanes should be constructed at the intersections of PUD collector roads and adjacent arterial roads. It is staff's opinion this will not be sufficient in that it does not require lanes at the locations of the commercial, church, school, and multi - family residential sites. Notices were mailed to surrounding property owners on May 21, 2001 and legal notification was published in the May 24, 2001 edition of the Owasso Reporter. Staff received several calls regarding this application. Most were requesting information about what was planned on the property and, upon explanation that it was a re- submittal of the expired PUD, stated they had no objection. RECOMMENDATION Staff recommends approval of OPUD -01 -02 subject to the following conditions: 1. The Development Text and Conceptual Development Plan be considered the Outline Development required by the Owasso Zoning Code, Chapter 8 "Planned Unit Development ", and 2. That, unless specifically set out in the standards and conditions of this PUD, all development within the subject property shall be in accordance with and shall meet all requirements of the underlying zoning as described in OZ- 98 -14, and 3. That a subdivision plat be approved by the Owasso City Council and filed with the Tulsa County Clerk's office prior to the issuance of a building permit. The covenants associated with said plat shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary, and 4. That a reference on page 23 of the PUD development text pertaining to a lien being placed on a Property Owners' Association member's `personal property" be changed to "real property", and 5. That minor transfers (15% increase in a development area's density) of dwelling units from one residential development area to another may occur if a significant change in the character of either development area is not created, and 6. That no building permits shall be issued within any portion of the PUD unit all requirements of the Owasso Subdivision Regulations, Chapter 8 `Building Permits" are fulfilled, and 7. All conditions imposed by the Owasso Technical Advisory Committee for approval of the PUD be met as conditions of the PUD, and 8. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as condition of the PUD, and 9. That a detailed drainage report, certified by an engineer, be submitted at the time of platting, and 10. That within the PUD the maximum number of dwelling units shall not exceed 1,898 units, and 11. That acceleration/deceleration lanes shall be installed at access points along E. 96`h & E. 106`h Streets N. and N. Garnett and N. Mingo Roads. Provision of acceleration/deceleration lanes should be included within the deed of dedication of any associated plats, and 12. The developer shall incorporate access management techniques in the development of commercial areas. Such techniques may include but not be limited to: unified circulation and parking plans, joint access and parking lot cross access, restriction of the number of driveways per parcel, controlling driveway spacing, sight distance and corner clearance, and 13. That a barrier fence be erected between the SKO Railroad property and proposed commercial area near the corner of E. 106`h Street N. and N. Mingo Road and the abutting multi - family residential area, and 14. Detailed landscape plans, including plant type and size, location, and irrigation shall be required to be submitted with site plans of any commercial development. Said plans shall be reviewed by staff and approved by the Planning Commission, and 15. That all landscaping plans for the entrances of the development shall be reviewed and approved by the Planning Commission at the time of platting and the landscaping installed prior to occupation of buildings, and 16. That sidewalks shall be provided along both sides of all internal roads and along the perimeter arterial road. Provision of sidewalks should be included within the deed of dedication of any associated plats, and 17. That the minimum side yard of any comer lot shall be no less than 25 feet, and 18. ANALYSIS The submitted preliminary plat is consistent with most of the requirements of the Lakes at Bailey Ranch PUD, resubmitted after expiration, concurrently with this plat. The applicant has shown 15' side yard setbacks on the secondary frontage of corner lots. The recommended conditions of approval for the PUD stated the minimum side yard setback on corner lots should be 25'. CITY OF OWASSO Planning Department PRELIMINARY PLAT SUMMIT II AT SOUTHERN LINKS Staff Report Donna S. Sorrells — City Planner BACKGROUND Trails End Development, Inc., applicant, is requesting review of the Preliminary Plat for Summit H at Southern Links, a 7.5 acre, 20 lot proposed subdivision located south of E. 86`h Street N. and west of N. Main Street. The subject property is generally described as a tract of land in the West Half (W /2) of Section 30, Township 21N, Range 14E. A location map is shown on the plat for your convenience. The subject property is zoned RS -3/PUD (Residential Single - Family, High Density/Planned Unit Development). A preliminary plat for the subject property was originally submitted to and approved by the Planning Commission at the August 12, 1997 regular meeting. Final platting of the property was not accomplished within one year causing the expiration of the preliminary plat. ANALYSIS The submitted preliminary plat is consistent with most of the requirements of the Bailey Ranch Golf & Community Development PUD (OPUD -9). According to the conditions of approval for OPUD -9, the maximum number of dwelling units within the PUD is 1506. To date, Fairways and Southern Links residential developments total 794 units. This preliminary plat will bring the total units to 814. The PUD conditions of approval also require a unified Property Owners' Association for those additions with publicly dedicated rights -of -way be established throughout the PUD. However, past precedent has established separate associations north and south of E. 86`h Street N. No covenants and restrictions were submitted with this preliminary plat as required by Section 880.4 of the Owasso Zoning Code and section 2.3.2 of the Owasso Subdivision Regulations. Another condition of approval for the PUD is the provision of an extensive landscape buffer, varying in width from 10' to 25', at the eastern boundary of this subdivision. The landscape buffer shall consist of a combination of fencing, berms, and evergreen and deciduous plant materials. A landscape plan must be submitted to and approved by the Planning Commission prior to occupancy of any buildings within the development. Staff would recommend the Planning Commission require the landscape plan be submitted concurrent with the final plat for the Summit 11 at Southern Links. The requirement of a dedicated left turn lane at the entrance to the Southern Links additions along E. 86`' Street N. to be constructed by the applicant has not yet been met. Staff recommends this obligation be met prior to the issuance of building permits within this or other proposed phases of development. The submitted preliminary plat does not show the existing City of Owasso water main located along the eastern boundary of the subject property. Past review of the proposed subdivision generated extensive discussion regarding this line. Previously, staff suggested the applicant be allowed to shift the pavement within the 50' right -of -way to accommodate the water line. Staff was unable to evaluate the newly submitted road alignment since the line is not shown. The applicant's consultant has agreed to provide additional information to staff regarding this issue.
