The subject property is located south of E. 86`h Street N. and west of N. Main Street and is generally described as a portion of the West Half (W /2) of Section 30, Township 21N, Range 14E. (Ward 4) 5. Preliminary Plat — The Summit III at Southern Links — A request for review of a preliminary plat for The Summit III at Southern Links, a 59 lot subdivision containing 19.21 acres, more or less. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE MAY 8, 2001 REGULAR MEETING AND MAY 17, 2001 SPECIAL MEETING. Bill Williams moved to approve the minutes on the May 8, 2001 Regular Meeting and May 17, 2001 Special Meeting with the exception of the May 17, 2001 minutes noting the following corrections: Bill Ellison was not in attendance Bill Ellison removed from the vote on Item #3 and Item #4 Bill Williams added to the vote on Item #3 and Item #4 Charles Willey seconded the motion. OPUD -01 -02 - The Lakes at Bailey Ranch - A request for review of a Planned Unit Development for The Lakes at Bailey Ranch. The subject property is located south of E. 106`s Street N. and east of N. Mingo Road and is generally described as a tract of land in the Northwest Quarter (NW /4) and the Northeast Quarter (NE /4) and the Southwest Quarter (SW /4) of Section 18, Township 21N, Range 14E. (Ward 1) Donna presented the item to the Commissioners and described the location. The applicant is proposing 39.9 acres of multi - family residential, 226.9 acres of single family residential and 37.4 acres for commercial and office use. The Planning Commission approved this request on January 12, 1999 and the City Council approved the PUD at their January 19, 1999 meeting. Due to the two (2) year time limit to file a plat as stated in the Owasso Zoning Code, this item requires review once again. Notices were mailed to surrounding OWASSO PLANNING COMMISSION Tune 13, 2000 Page No. 2 property owners and legal notification was published in the Owasso Reporter. Several calls were received requesting information about what was planned on the property. Staff recommends approval of OPUD -01 -02 subject to the following conditions: 1. The Development Text and Conceptual Development Plan be considered the Outline Development required by the Owasso Zoning Code, Chapter 8 "Planned Unit Development," and 2. That, unless specifically set out in the standards and conditions of this PUD, all development within the subject property shall be in accordance with and shall meet all requirements of the underlying zoning as described in OZ- 98 -14. 3. That a subdivision plat be approved by the Owasso City Council and filed with the Tulsa County Clerk's office prior to the issuance of a building permit. The covenants associated with said plat shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary, and 4. That a reference on page 23 of the PUD development text pertaining to a lien being placed on a Property Owners' Association member's "personal property" be changed to "real property", and 5. That minor transfers (15% increase in a development area's density) of dwelling units from one residential development area to another may occur if a significant change in the character of either development area is not created, and 6. That no building permits shall be issued within any portion of the PUD unit all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits" are fulfilled and 7. All conditions imposed by the Owasso Technical Advisory Committee for approval of the PUD be met as conditions of the PUD, and 8. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as condition of the PUD, and 9. That a detailed drainage report, certified by an engineer, be submitted at the time of platting, and 10. That within the PUD the maximum number of dwelling units shall not exceed 1,898 units, and 11. That acceleration/deceleration lanes shall be installed at access points along E. 96'" & E 106" Streets N. and N. Garnett and N. Mingo Roads. Provision of acceleration/deceleration lanes should be included within the deed of dedication of any associated plats, and 12. The developer shall incorporate access management techniques in the development commercial areas. Such techniques may include but not be limited to: unified circulation and parking plans, joint access and parking lot cross access, restriction of the number of driveways per parcel, controlling driveway spacing, sight distance and corner clearance, and 13. That a barrier fence be erected between SKO Railroad property and proposed commercial area near the corner of E. 106" Street N. and N. Mingo Road and the abutting multi - family residential area, and OWASSO PLANNING COMMISSION June 13, 2000 Page No. 3 14. Detailed landscape plans, including plant type and size, location and irrigation shall be submitted with site plans of any commercial development. Said plans shall be reviewed by staff and approved by the Planning Commission, and 15. That all landscaping plans for the entrances of the development shall be reviewed and approved by the Planning Commission at the time of platting and the landscaping installed prior to occupation of buildings, and 16. That sidewalks shall be provided along both sides of all internal roads and along the perimeter arterial road. Provision of sidewalks should be included within the deed of dedication of any associated plats, and 17. That the minimum side yard of any corner lot shall be no less than 25 feet, and 18. If needed, commercial lots may be required to provide on -site detention. This requirement shall be determined at the time of site plan review. Mr. Bob Pennington, a nearby property owner, had concerns regarding stormwater drainage in the area also, the lack of water pressure. Donna explained to Mr. Pennington that a detailed drainage report would be presented at the time of final plat review. At that time Mr. Pennington is welcome to review the report. Ray Haynes stated that the drainage design might change the calculation and improve the water problem in the El Rio Vista subdivision. Traffic concerns in the area were also discussed. Ray Haynes moved to approve OPUD -01 -02 subject to the above TAC and staff recommendations being met and subject to the stormwater drainage flow, to be taken into consideration, in the El Rio Vista subdivision. Also, subject to Mr. Bob Pennington being notified when a detailed certified drainage report is submitted, Bill Ellison seconded the motion. Preliminary Plat - Honey Creek - A request for review of a preliminary plat for Honey Creek, a 212 lot subdivision containing 64.17 acres, more of less. The subject property is located south of E. 106' Street N. and east of N. Mingo Road and is generally described as a portion of the Southwest Quarter (SW /4) of Section 18, Township 21N, Range 14E. (Ward 1) Donna presented the item and described the property location. She stated that a detailed certified drainage report is required at the time of platting and adequate detention must be provided at the time of Phase I development. The plat shows 15' side yard setbacks on the secondary frontage of corner lots. A minimum side yard setback on corner lots should be 25'. Also shown is an extension of existing 60' rights -of -way connecting from OWASSO PLANNING COMMISSION June 13, 2000 Page No. 4 Coventry Gardens to the south and Kelly Ann to the west. Staff recommends the east - west collector from Kelly Ann be extended to N. Mingo Road. The Technical Advisory Committee reviewed the preliminary plat at the May 30, 2001 meeting. Staff recommends approval of the Preliminary Plat for Honey Creek at Bailey Ranch subject to the following conditions: 1. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as condition of the PUD, and 2. Provision of acceleration/deceleration lanes should be included within the deed of dedication of any associated plats, and 3. The covenants associated with said plat shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary, and 4. That no. building permits shall be issued within any portion of the PUD until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits" are fulfilled, and 5. Provision of sidewalks and acceleration/deceleration lanes should be included within the deed of dedication of any associated plats, and 6. That all landscaping plans for the entrances of the development shall be reviewed and approved by the Planning Commission at the time of platting and the landscaping installed prior to occupation of buildings, and 7. That the minimum side yard of any corner lot shall be no less than 25 feet. 8. A detailed certified drainage report shall be provided. Adequate detention shall be provided at the time of Phase I development. 9. The east -west collector road originating in the Kelly Ann Addition shall be extended west to N. Mingo Road. Discussion was held regarding the maintenance of the street that contains seven (7) lots that front onto the Kelly Ann subdivision street. Charles Willey had concerns regarding the residents that purchase these lots expecting the City of Owasso to maintain the street. Mr. Alan Ringel from Bryce & Associate made a brief presentation. Mr. Ringel stated that the seven (7) lots could be omitted from this request or it could be noted on the deed of dedication that this street is not within the city limits of Owasso. He suggested that we excluded the lots in question (Lots 16 through 22, Block 4) until he researches the quality of the street and determine the cost in bringing it up to City of Owasso standards. Ray Haynes moved to approve the preliminary plat subject to the above recommendations. In addition to the above items being met, Mr. Haynes added the recommendation to review the certified, detailed drainage report for Phase I along with a drainage report for the entire Planned Unit Development for The Lakes at Bailey Ranch. Also added to the motion, remove Lots 16 through 22, Block 4, until issues are resolved. Issues, which would include, a core test on E. 98' Place No. meeting the City of Owasso street standards. If the lots remain as shown on this preliminary plat, the applicant shall add a note on the deed of dedication stating that these seven (7) lots front a Tulsa County street and is not within the city limits of Owasso. Charles Willey seconded the motion. Preliminary Plat - Longford at Windmill Creek - A request for review of a preliminary plat for Longford at Windmill Creek, a 228 lot subdivision containing 66.42 acres, more or less. The subject property is located north of E. 96'1 Street N. and west of N. 129h E Avenue and is generally described as a portion of the Southeast Quarter (SE /4) of Section 17, Township 21N, Range 14E. (Ward 1) Donna Sorrells presented the item. Donna explained that a large area of open space along the western boundary will accommodate the required detention. Maintenance of the open space should be defined within the covenants and restrictions. If East 100"' Street North is extended to North 12921 East Avenue acceleration/deceleration lanes will be required. The Technical Advisory Committee reviewed this plat at their May 30, 2001 meeting. Charles Willey stated that the covenants should have something stating that there would be no rear vehicular access on lots backing up to East 98t1 Street North. Staff recommends approval of the Preliminary Plat for Longford at Windmill Creek subject to the following conditions: 1. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met, 2. Provision of acceleration/deceleration lanes (if necessary) should be included within the deed of dedication of any associated plats, and 3. Provision of sidewalks and acceleration/deceleration lanes should be included with the deed of dedication of any associated plat, and 4. That no building permits shall be issued within any portion of the subject property until all requirements of the Owasso Subdivision Regulation, Chapter 8 "Building Permits" are fulfilled, and 5. That all landscaping plans for the entrances of the development shall be reviewed and approved by the Planning Commission at the time of platting and the landscaping installed prior to occupation of dwellings, and 6. A 20' side yard setback shall be required on corner lots with side loading garages. Bill Williams. moved to approve the preliminary plat subject to the above recommendations, and subject to the below wording being added to the covenants and restrictions: No vehicular access shall be allowed from E. 98 St. No. to lots fronting E. 99i1 St No. OWASSO PLANNING COMMISSION June 13, 2000 Page No. 6 Charles Willey seconded the motion. Preliminary Plat - The Summit H at Southern Links - A request for review of a preliminary plat for The Summit 11 at Southern Links, a 20 lot subdivision containing 7.5 acres, more or less. The subject property is located south of E. 86s' Street N. and west of N. Main Street and is generally described as a portion of the West Half (W /2) of Section 30, Township 21N, Range 14E. (Ward 4) Donna described the property location and explained that the preliminary plat was originally submitted and approved by the Planning Commission at the August 12, 1997. Final platting was not accomplished within one year causing the preliminary plat to expire. The PUD conditions of approval require a Property Owners' Association for those additions with publicly rights -of -way be established throughout the PUD. Past precedent has established separate associations north and south of E. 86" Street No. No covenants and restrictions were submitted with this preliminary plat. A landscape plan must be submitted and approved by the Planning Commission prior to occupancy within the development. The required left turn lane at the entrance along E. 86' Street N. has not been constructed. Staff recommends this obligation be met prior to issuance of building permits. The Technical Advisory Committee reviewed this plat at their May 30, 2001 meeting. Staff recommends approval of the Preliminary Plat for the Summit II at Southern Links subject to the following conditions: 1. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as condition of the PUD, and 2. A detailed design for a dedicated left turn lane at the entrance into the South Links subdivision along E. 86' Street N. be submitted to Public Works and approved prior to approval of a final plat for the proposed additions, and 3. The covenants associated with said plat shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. Covenants and restrictions shall be submitted prior to approval of a final plat and 4. That no building permits shall be issued within any portion of the PUD until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits ", are fulfilled, including formal acceptance of the streets and drainage within the Summit, Phase I, by the City Council, and OWASSO PLANNING COMMISSION June 13, 2000 Page No. 7 5. Provision of sidewalks along shall be included within the deed of dedication of the plats, and 6. That all landscaping plans for the eastern boundary of the development shall be reviewed and approved by the Planning Commission at the time of final platting and the landscaping prior to occupation of buildings, and 7. That the minimum side yard of any corner lot with drive access shall be no less that 20 feet, and 8. Dedication detention facilities and drainage easements shall be provided to the satisfaction of the Public Works Department, and 9. The design of N. 100'" E Avenue shall be coordinated with Public Works and Community Development to ensure protection of the existing City of Owasso water main. A brief discussion was held regarding the need for covenants and restrictions to be submitted along with the preliminary plat. Charles Willey moved to table this item, in order for the applicant to complete the necessary paperwork, including draft covenants and restrictions, Bill Williams seconded the motion. (Ward 1) The required detention is shown in an area of open space within the southwest quarter of the property. The maintenance of this open space areas should be defined with the covenants and restrictions. The Technical Advisory Committee reviewed this plat at their April 30, 2001 meeting. Staff recommends approval of the Preliminary Plat for Brookfield Crossing subject to the following conditions: 1. That all TAC comments be addressed prior to approval of the final plat, and 2. Covenants and restrictions shall be submitted prior to approval of a final plat, and OWASSO PLANNING COMMISSION June 13, 2000 Page No. 9 3. That no building permits shall be issued within any portion of the proposed development until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits" are fulfilled and 4. Provision of sidewalks and acceleration/deceleration lanes along N. Garnett Road shall be included within the deed of dedication of the plats, and 5. That the minimum side yard of any corner lot with drive access shall be no less than 20 feet, and 6. Maintenance of open space and detention facilities shall be provided within the text of the deed of dedication. Final Plat - Country Estates V - A request for review of a final plat for Country Estates V, a 187 lot subdivision containing 53.64 acres, more or less. The subject property is located north of E. 116'h.Street N. and west of N. Garnett Road and is generally described as a portion of the South Half (S /2) of the Northeast Quarter (NE /4) of Section 6, Township 21N, Range 14E. (Ward 1) Donna presented the item and stated that the applicant has requested County Estates V Final Plat be tabled and presented at a later date. Ray Haynes moved to table this item at the applicant's request, Bill Williams seconded the motion. Site Plan Amendment - Owasso Medical Center - A request for review of a site plan amendment for Owasso Medical Center generally described Lot 1, Block 1, ROC Owasso II and located at 13600 E. 86th Street N. (Ward 3) OWASSO PLANNING COMMISSION June 13, 2000 Page No. 10 This amendment has been submitted as a result of the recent approval of the citizen - sponsored zoning code amendment revising the parking requirements for medical office facilities. According to the Owasso Zoning Code, The parking requirement for this type of facility is 1 space per 150 square feet of floor area for the first 15,000 square feet of building area and 1 space per 200 square feet of floor area for the remainder. The applicant has provided 196 spaces, including 16 handicap accessible spaces. The applicant has shown 185 standard spaces, exclusive of the 6 required handicap spaces. The Technical Advisory Committee reviewed the preliminary plat at their May 30, 2001 meeting. Staff recommends approval of the site plan for the Owasso Medical Center subject to the following condition: 1. Minimum 185 standard parking spaces shall be provided. Ray Haynes moved to approve the site plan amendment subject to the above recommendation being met, Bill Williams seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Dewey Brown - Yes Bill Williams - Yes Charles Willey - Yes Bill Ellison - Yes The motion carried 5 -0. 12. Site Plan - The Shoppes at Lakeridge - A request for review of a site plan for the Shoppes at Lakeridge located north of E. 86' Street N. and west of N. 129' E Avenue (across from N. 125' E Avenue). Donna presented the item to the Commissioners and described the location. She stated that the applicant has provided the required amount of parking spaces. Although none of the handicap parking is shown to be van accessible. Staff recommends one van accessible handicap parking space be provided. Also, the applicant has not provided any loading berths. Staff recommends one loading berth be provided as required by the Owasso Zoning Code. The Technical Advisory Committee reviewed the plat at their April 25, 2001 meeting. Discussion was held regarding the drive to the east. Ray Haynes questioned the amount of room it takes for an emergency vehicle to turn. Staff recommends approval of the site plan for the Lakeridge Shopping Center subject to the following conditions: 1. All TAC comments shall be addressed prior to the issuance of a building permit. 2. A landscape plan shall be submitted and approved prior to the issuance of a building permit. 3. A utility plan shall be submitted and approved prior to the issuance of a building permit. OWASSO PLANNING COMMISSION June 13, 2000 Page No. 11 4. A 6' opaque fence shall be required along the northwest and north boundaries of the site. Ray Haynes moved to approve the site plan subject to the above recommendations also, subject to the Owasso Fire Marshall reviewing the eastside drive area between the theater and the proposed building in order to insure that an emergency vehicle has ample turning space. Partial Easement Vacation - A request for review of a partial closing of a drainage easement as recorded and filed in Book 6431, Page 520, Tulsa County and located within Lot 1, Block 2, Owasso Market H. The subject property is located north of E. 96' Street N. and east of N. Garnett Road. Donna presented the case and described the location. Sorrells — City Planner BACKGROUND This item was first heard by the Commission at the June 12, 2001 regular meeting where it was tabled due to the lack of draft restrictive covenants as required by Section 2.3.2Q of the Owasso Subdivision Regulations. Trails End Development, Inc., applicant, is requesting review of the Preliminary Plat for Summit II at Southern Links, a 7.5 acre, 20 lot proposed subdivision located south of E. 86th Street N. and west of N. Main Street. The subject property is generally described as a tract of land in the West Half (W /2) of Section 30, Township 21N, Range 14E. A location map is shown on the plat for your convenience. The subject property is zoned RS -3/PUD (Residential Single - Family, High Density/Planned Unit Development). A preliminary plat for the subject property was originally submitted to and approved by the Planning Commission at the August 12, 1997 regular meeting. Final platting of the property was not accomplished within one year causing the expiration of the preliminary plat. ANALYSIS The submitted preliminary plat is consistent with most of the requirements of the Bailey Ranch Golf & Community Development PUD (OPUD -9). According to the conditions of approval for OPUD -9, the maximum number of dwelling units within the PUD is 1506. To date, Fairways and Southern Links residential developments total 794 units. This preliminary plat will bring the total units to 814. The PUD conditions of approval also require a unified Property Owners' Association for those additions with publicly dedicated rights -of -way be established throughout the PUD. However, past precedent has established separate associations north and south of E. 86th Street N. No covenants and restrictions were submitted with this preliminary plat as required by Section 880.4 of the Owasso Zoning Code and section 2.3.2 of the Owasso Subdivision Regulations. Another condition of approval for the PUD is the provision of an extensive landscape buffer, varying in width from 10' to 25', at the eastern boundary of this subdivision. The landscape buffer shall consist of a combination of fencing, berms, and evergreen and deciduous plant materials. A landscape plan must be submitted to and approved by the Planning Commission prior to occupancy of any buildings within the development. Staff would recommend the Planning Commission require the landscape plan be submitted concurrent with the final plat for the Summit II at Southern Links. The applicant has proposed the road be constructed over the water line. Otherwise the mislocated line, in it's current location, causes the property owner a hardship. Staff recommends the applicant coordinate directly with Public Works regarding the resolution of this issue. Brookfield Crossing, L.L.C., applicant, is requesting review of the Preliminary Plat for Brookfield Crossing, a 38.4 acre, 134 lot proposed subdivision located north of E. 116th Street N. and east of N. Sorrells — City Planner BACKGROUND ISD Architects, agent for the Classic Development, has requested review of the Site Plan for Summit Commercial Center located on Lot 1, Block 1, The Summit Commercial Center at the southwest comer of N. Main and E. 86`h Street N. A location map is shown on the site plan for your information and review. ANALYSIS The applicant has proposed a 26,297 square foot facility on the subject property. Each end unit of the commercial center is 4,072 square feet. The Sokolosky Clinic will be located in the east end unit and Trails End Restaurant will be located in the west end unit with typical commercial shopping between. According to the Owasso Zoning Code, the parking requirement for both restaurant and medical office is 1 space per 150 square feet of building floor area while the requirement for retail shopping is 1 space per 200 square feet of building floor area. Based on this requirement, the applicant must provide 145 parking spaces, including 5 handicap accessible spaces. One of the five handicap accessible spaces must be van accessible. The applicant has provided 151 spaces, including 5 handicap accessible spaces, although none of these spaces is shown to be van accessible. Staff recommends one of the handicap accessible spaces be revised to be van accessible. Two loading berths are required according to the Code. The applicant has provided four. The service area at the rear of the building will function as the loading area, also. The service /loading area will be screened from the adjacent residential by a 6' cedar fence.
