CALL TO ORDER - Bill Ellison called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 12, 2001 REGULAR MEETING - The Commission reviewed the minutes of June 12, 2001 Regular Meeting, Bill Williams moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Dewey Brown - Yes Bill Ellison - Yes Bill Williams - Yes The motion carried 3 -0. 4. Preliminary Plat - The Summit II at Southern Links - A request for review of a preliminary plat for The Summit II at Southern Links, a 20 lot subdivision containing 7.5 acres, more or less. The subject property is located south of E. 866 Street N. and west of N. Main Street and is generally described as a portion of the West Half (W /2) of Section 30, Township 21N, Range 14E. (Ward 4) Donna presented the item and described the property location. This plat was originally submitted to and approved by the Planning Commission at the August 12, 1997 meeting. Final platting was not accomplished within one year causing expiration. An extensive landscape buffer is a condition of approval at the eastern boundary. The landscaping shall consist of fencing, berms and evergreen and deciduous plants and be approved by the Planning Commission prior to occupancy within the development. A design for a dedicated left turn lane at the entrance along E. 86th Street N. needs to be submitted and approved prior to approval of a final plat and issuance of building permits. The applicant needs to coordinate with Public Works regarding the water line location along the eastern boundary. The Technical Advisory Committee reviewed this plat at the May 30, 2001 meeting. Staff recommends approval of the preliminary subject to the following conditions: OWASSO PLANNING COMMISSION March 13, 2001 Page No. 2 1. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as condition of the PUD, and 2. A detailed design for a dedicated left turn lane at the entrance into the Southern Links subdivision along E. 86 h Street N. be submitted to Public Works and approved prior to approval of a final plat for the proposed additions, and 3. The covenants associated with said plat shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary, and 4. That no building permits shall be issued within -any portion of the PUD until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits ", are fulfilled, including formal acceptance of the streets and drainage within the Summit, phase I, by the City Council, and 5. Provision of sidewalks along all streets shall be included within the deed of dedication of the plat, and 6. That all landscaping plans for the eastern boundary of the development shall be reviewed and approved by the Planning Commission at the time of final platting and the landscaping installed prior to occupation of buildings, and 7. That the minimum side yard of any corner lot with drive access shall be no less than 20 feet, and 8. Dedicated detention facilities and drainage easements shall be provided to the satisfaction of the Public Works Department, and 9. The design of N. 100'h E. Avenue shall be coordinated with Public Works to ensure protection of the existing City of Owasso water main. The applicant, Mr. Noble Sokolosky, requested to address the Commissioners. 'He stated that he had concerns with the some of the staff recommendations. For instance, Mr. Sokolosky was in need of clarification on Item #6 regarding landscape plans for the eastern boundary of the property. He explained that his plan was to install a 6 -foot perimeter fence on the east side going to the south. Dewey Brown agreed to review the landscaping plan at the time of a final plat review. He also discussed the shifting of the pavement to where it would only cross over a small portion of the water line along N. 100' E. Avenue. Another issue Mr. Sokolosky had concerns with was the dedicated left turn lane at the entrance along 86`s Street N. being constructed prior to the issuance of building permits as stated in a June 28, 2001 letter from Donna Sorrells to Mr. Sokolosky (attached). Also discussed briefly was the detention facility and drainage easements for this phase. Donna explained to the Commissioners that she had discussed the above conditions with Mr. Ron Cates and he had no issues with them. After lengthy discussion, Bill Williams moved to approve the preliminary plat request subject to the above staff recommendations, Dewey Brown seconded the motion. Preliminary Plat - The Summit III at Southern Links - A request for review of a preliminary plat for The Summit III at Southern Links, a 59 lot subdivision containing 19.21 acres, more or less. The subject property is located south of E. 86' Street N. and west of N. Main Street and is generally described as a portion of the West Half (W /2) of Section 30, Township 21N, Range 14E. (Ward 4) Donna presented the item and described the location. She stated that this preliminary plat is consistent with most of the requirements of OPUD -9. The requirement of a left turn lane at the entrance into the addition along E. 861° Street N. has not been achieved. The Technical Advisory Committee reviewed this plat at their May 30, 2001 meeting. Staff recommends approval of the Preliminary Plat for the Summit II at Southern Links subject to the following conditions: 1. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as condition of the PUD, and 2. A detailed design for a dedicated left turn lane at the entrance into the Southern Links subdivisions along E. 86'h Street N. be submitted to Public Works and approved prior to Council approval of a final plat for the proposed additions, and 3. Preliminary Plat - Brookfield Crossing - A request for review of a preliminary plat for Brookfield Crossing, a 134 lot subdivision containing 38.4 acres, more or less. The subject property is located north of E. 116' Street N. and east of N. Garnett Road and is generally described as a portion of the Southwest Quarter (SW /4) of Section 5, Township 21N, Range 14E. (Ward 1) The location of the property was described. Detention will be provided by an area of open space within the southwest quarter of the property. The Technical Advisory Committee reviewed the preliminary plat at the April 30, 2001 meeting. Staff recommends approval of the Preliminary Plat for Brookfield Crossing subject to the following conditions: 1. That all TAC comments be addressed prior to approval of the final plat, and 2. That no building permits shall be issued within any portion of the proposed development until all requirements of the Owasso Subdivision Regulations, Chapter 8 `Building Permits ", are fulfilled, and 3. Provision of perimeter and internal sidewalks and acceleration/deceleration lanes along E. 116' Street N. shall be included within the deed of dedication of the plats, and 4. Maintenance of open space and detention facilities shall be provided within the text of the deed of dedication. Site Plan - Summit Commercial Center - A request for review of a site plan for Summit Commercial Center described as a portion of Lot 1, Block 1, The Summit OWASSO PLANNING COMMISSION March 13, 2001 Page No. 5 Commercial Center. The subject property contains 111,475 square feet and is located at the southwest corner of E. 86" Street N. and N. Main Street. (Ward 4) Donna presented the item to the Commissioners. The applicant is proposing a 26,297 square foot building. A medical clinic will be located at the east end and a restaurant at the west end. The parking requirements for the restaurant and medical office are 1 space per 150 square feet of building floor. The applicant has provided ample parking spaces, although none of the handicap spaces are shown for van accessibility. Staff recommends one of the handicapped spaces be revised to van accessibility. The Technical Advisory Committee reviewed this plat-at their March 28, 2001 meeting. Staff recommends approval of the site plan for the Summit Commercial Center subject to the following conditions: 1. All TAC comments shall be addressed prior to the issuance of a building permit. 2. Sidewalks shall be provided along N. Main, E. 86" Street N. and W. 11" Street as required by Section 3.4 of the Owasso Subdivision Regulations. 3. Acceleration/deceleration lane construction, as well as storm sewer connection, should be coordinated directly with Public Works to ensure property synchronization with proposed E. 86" Street improvements. Chairperson Secretary Date CITY OF OWASSO Planning Department SITE PLAN MOWERY FUNERAL SERVICE Staff Report Donna S. Sorrells — City Planner BACKGROUND Salsman, Patton & Roberson, agent for Mowery Funeral Service, has requested review of the Site Plan for Mowery Funeral Service expansion located on Lot 1, Block 5, Ator Heights Third Addition at the southwest comer of E. 19th Street and N. Garnett Road. A location map is attached for your information and review. The subject property is zoned CG (Commercial General). ANALYSIS The applicant has proposed a 1,267 square foot addition to the existing building, and a new 4,667 square foot free- standing chapel to the north of the existing building. The total square footage for the overall facility 10,500 square feet. According to the Owasso Zoning Code, the parking requirement for this facility is 1 space per 40 square feet of assembly area and 1 space per 300 square feet of non - assembly area. Based on this requirement, the applicant is required to provide 82 spaces including 4 handicap accessible spaces. The applicant has provided 96 spaces including 4 handicap accessible spaces. One handicap accessible space must be van accessible. The service /loading area will be accommodated at the portico area on each building. The Zoning Code requires a 50 foot building setback along all arterial and freeway service roads. There has been some disagreement regarding whether this building is required to meet that setback due to the "access" road west of N. Garnett Road. The subject property abuts the Old U.S. Highway 169/N. Garnett Road right -of -way and the access road lies within that right -of- way. Had the access road not been installed, it would be clear that the property abuts an arterial right -of -way and the 50 foot setback would be required. Therefore, it is staff s opinion that approval of this site plan should be contingent upon the applicant receiving approval of a variance to the required setback. A variance application has been received by staff and this issue will be heard at the August 28, 2001 regular meeting of the Owasso Board of Adjustment. The parking/circulation area associated with the existing hearse garage is not now paved as required by code. Although this particular situation is existing, the amount of modification to the property does require the entire site be brought into compliance with the code. It is typical that, for public safety, drive aisles of a minimum of 18 feet (for one -way) are required where fire trucks are circulating. Staff, including the Fire Marshall, has requested that the access from access road be at least 18 feet. While the drive between the buildings has been modified in answer to that request, the drive aisle from the access has not. It is in the interest of public safety, staff does recommend a drive aisle width of 18 feet be required at that location. The Owasso Technical Advisory Committee reviewed the preliminary plat at the August 1, 2001 regular meeting. A memorandum detailing the comments received is attached for you information and review. RECOMMENDATION Staff recommends approval of the site plan for the Summit Commercial Center subject to the following conditions: 1. All TAC comments shall be addressed prior to the issuance of a building permit. 2. A variance allowing for a 25 foot building setback be approved by the Owasso Board of Adjustment prior to the issuance of a building permit. 3. All parking associated with Mowery Funeral Service shall be paved with curb and gutter as required by code, with the exception of the internal islands that do not abut pedestrian circulation routes. The following comments were noted: 1. Community Development - Approval recommendation is - subject to subsequent approval of the requested building setback variance. 2. Community Development - Remove "existing" from the architectural note inside the proposed addition to the existing building. 3. Community Development - All parking, existing and proposed shall be paved, including curb and gutter as required by the Owasso Zoning Code. Staff recommends an exception to this requirement in the case of the internal islands that do not abut pedestrian access only. 4. Sorrells — City Planner Tulsa Teachers' Credit Union, applicant, has submitted a request for rezoning from AG (Agriculture) to CS (Commercial Shopping) on property located north of E. 96th Street N. and east of N. Garnett Road. The subject property is approximately 4.5 acres in size. The subject property is currently vacant and undeveloped. The property is bound on the west by rural residential, zoned AG (Agriculture) and, further; by CG (Commercial General) at the northeast corner of N. Garnett Road and E. 96th Street N.; on the north by rural residential, zoned AG (Agriculture) and, further by Bailey Ranch Estates, zoned RS -2/PUD (Residential Single - Family, High Density/Planned Unit Development); on the east by Owasso Market, zoned CS (Commercial Shopping); and on the south by rural residential and Oklahoma Natural Gas, zoned AG (Agriculture), and further east, RCB Center, zoned CS (Commercial Shopping). ANALYSIS The applicant is requesting rezoning on a parcel of land, approximately 4.5 acres in area, from AG (Agriculture) to CS (Commercial Shopping). The Owasso 2010 Land Use Master Plan designates this land as low- intensity residential. However, it is apparent that the Comprehensive Plan shows a commercial boundary in the area of the subject property that conforms exactly to the first plat of Owasso Market. The subsequent addition of land and platting of Owasso Market II, established a precedence for the extension of the commercial to the west. The Comprehensive Plan shows commercial on the south side of E. 96th Street N. west to a point aligned with the west side of the subject property. It is staffs opinion, given these factors, that the requested rezoning is appropriate for this site. The proposed used for the south portion of the subject property abutting E. 96`h Street N. is a Tulsa Teachers' Credit Union branch. This is a low- intensity use which will provide a positive buffer between the residential and Owasso Market. The northern (rear) portion of the site will be reserved for future development and will be, subject to a recorded access easement, oriented toward the new N. 119th E. Avenue running between Lowe's and the existing detention facility. Letters were mailed to surrounding property owners on July 21, 2001 and legal notification of the proposed rezoning was published in the July 26, 2001 edition of the Owasso Reporter. The Plan was prepared by Alaback Design Associates of Tulsa, Gould Evans Goodman of Kansas City, Community Futures of Denver and C.H. Guernsey of Tulsa. The Primary effort in the development process was a community charrette conducted in late January and early February. The Charrette began with an evening meeting in the First United Methodist Church. This was an issues and opportunity session to establish goals for the Downtown District. Daytime workshops were conducted for two days follow -up with a plan selection and more goal identification. The consultants presented the final Plan to the public in July. There was a question and answer session after the presentation. The OEDA accepted the Plan at their August 9`h meeting & forwarded the Plan to the Planning Commission for consideration and recommendation to the City Council for adoption.
