The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on August
9, 2001 at 5:00 PM.
1. CALL TO ORDER - Charles Willey called the meeting to order at 7:00 PM and declared
a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF JULY 10, 2001 REGULAR
MEETING - The Commission reviewed the minutes of July 10, 2001 Regular Meeting,
Bill Williams moved to approve the minutes subject to a correction on Item #7. On Item
#7 the vote on the motion should read as follows:

The motion was seconded by Bill Ellison to approve the minutes with the above

4. OZ -01-04 - Tulsa Teacher's Credit Union - A request for review of the rezoning of a
4.5 acre tract from AG (Agriculture) to CS (Commercial Shopping). The subject
property is generally described as a portion of the South Half (S /2) of the Southwest
Quarter (SW /4) of the Southwest (SW /4) of Section 17, Township 21N, Range 14E and
located north of E. 96' Street N. and east of N. Garnett Road. (Ward 1)
- Donna presented the item and described the property location. Letters were mailed to
surrounding property owners and legal notification was published in the Owasso
Reporter. No calls were received regarding this request. Discussion was held regarding
an access easement running between Lowe's and the existing detention facility. It is

staff's opinion that the rezoning is appropriate for this site. Staff recommends approval of
OZ- 01 -04.

5. Site Plan - Mowery Funeral Home - A request for review of a site plan for the
expansion of the Mowery Funeral Home generally described as Lot 1, Block 5, Ator
Heights Third Addition and located at 9110 N Garnett Road. (Ward 2)
Donna presented the item and described the location. The applicant is requesting
approval for a 1,267 square foot addition and a new 4,667 square foot chapel to the north
of the existing building. The site plan shows ample parking spaces. Discussion was held
regarding the 50 foot building setback required along, all arterial service roads and
freeways. This property abuts old U.S. Highway 169 /North Garnett Road and the access
road lies within that right -of -way. A variance request will be held on August 28, 2001 at
the Owasso Board of Adjustment meeting. The Technical Advisory Committee reviewed
the site plan request at the August 1, 2001 meeting.
Staff recommends approval of the site plan for the Summit Commercial Center subject to
the following conditions:
1. All TAC comments shall be addressed prior to the issuance of a building
permit.
2. A variance allowing for a 25 foot building setback be approved by the.
Owasso Board of Adjustment prior to the issuance of a building permit.
3. All parking associated with Mowery Funeral Service shall be pave with
curb and cutter as required be code, with the exception of the internal
islands that do not abut pedestrian circulation routes.

Downtown Development District Land Use Plan and request for recommendation to City
Council. (Wards 2 & 4)
Stan Ewing gave a presentation of the plan. Charles Willey moved to recommend
forwarding the Downtown Development District Land Use Plan to the City Council for
adoption, Dewey Brown seconded the motion. A vote on the motion was recorded as
follows:

BACKGROUND
First Baptist Church of Owasso, applicant, has submitted a request for rezoning from RS -3
(Residential Single - Family, High Density) to CG (Commercial General) on property located at
the southeast corner of E. 86`h Street N. and N. 125`h E. Avenue. The subject property is
approximately 7 acres in size.
The subject property is the current location of the First Baptist Church of Owasso. The site is
bound on the east by the Springer and Warren Clinics, zoned CG (Commercial General); on the
west by N.. 125`h E. Avenue, and further by the Cornerstone Shopping Center, zoned CG
(Commercial General); on the north by E. 86`h Street N. and further by the Dickinson Theater
Schlotzsky's and the Lakeridge Shopping Center, zoned CS (Commercial Shopping), and Bank
of the Lakes, zoned OL (Office Light); and on the south by the Elm Creek Condominiums, zoned
RM -1 (Residential Multi - Family, Low Density) and Elm Creek Estates, zoned RS -3 (Residential
Single - Family, High Density).
ANALYSIS
The applicant is requesting rezoning on a parcel of land, approximately 7 acres in area, from RS-
3 (Residential Single - Family, High Density) to CG (Commercial General).
The Owasso 2010 Land Use Master Plan designates this land as public and low- intensity
commercial. The subject property is primarily surrounded by CG (Commercial General) and
RM -1 (Residential Multi - Family, Low Density), directly adjacent to the property and CS
(Commercial Shopping) opposite the property. It is staffs opinion, given these factors, that the
requested rezoning is appropriate for this site.
The First Baptist Church of Owasso will soon be relocating to E. 96`h Street N. and, if approved,
the rezoning request would improve the functionality and marketability of the subject property.
Letters were mailed to surrounding property owners on August 21, 2001 and legal notification of
the proposed rezoning was published in the August 23, 2001 edition of the Owasso Reporter.
Staff received no calls from citizens regarding this application.
Staff recommends approval of OZ- 01 -05.

BACKGROUND
D. M. Sokolosky, applicant, has submitted a request for rezoning from CG (Commercial
General) to RS -3 (Residential Single - Family, High Density) on property located east of N.
Mingo Road and 530 feet north of E. 106`h Street N. The subject property is approximately
12.95 acres in size.
The subject property is bound on the west by rural residential, zoned AG (Agriculture); on the
north by Metro Heights subdivision, zoned RS -3 (Residential Single - Family, High Density); and
on the east by railroad right -of -way and further east and on the south by vacant, undeveloped
land zoned AG (Agriculture).
ANALYSIS
The Owasso 2010 Land Use Master Plan designates the subject property as commercial/office.
The Owasso Planning Commission and City Council approved rezoning of the subject property
to CG (Commercial General) in December 1999.
As the request currently before the Planning Commission represents a use less intense than that
reflected on the comprehensive plan, staff is supportive.
Letters were mailed to surrounding property owners on August 21, 2001 and legal notification of
the proposed rezoning was published in the August 23, 2001 edition of the Owasso Reporter.
Staff received one e-mail message from a citizen regarding this application. A copy of the e-
mail is attached for you information and review.
RECOMMENDATION
Staff recommends approval of OZ- 01 -06.

To the City Planner,
We are opposed to the rezoning of these two properties. Until the City of Owasso can work with Tulsa County Engineers
to prevent the flooding that occurs along Mingo and 106th streets, there should absolutely be no more homes built in this
area. The current runoff from Country Estates has increased the amount of flood water runoff that is occurring in the area,
despite the developers' and the City's contention that they have supplied detention ponds.

BACKGROUND
D. M. Sokolosky, applicant, has submitted a request for rezoning from IL (Industrial Light) to
RS -3 (Residential Single - Family, High Density) on property located approximately 1/8 mile east
of N. Mingo Road and south of E. 116`h Street N. The subject property is approximately 15 acres
in size.
The subject property is bound on the north by rural residential and the Kingdom Hall of
Jehovah's Witnesses, zoned AG (Agriculture); on the east by railroad right -of -way and further by
the Owasso Sports Complex, zoned AG (Agriculture); on the west by vacant undeveloped
property zoned RD (Residential Duplex) and CS (Commercial Shopping); and on the south by
vacant undeveloped land zoned AG (Agriculture).
ANALYSIS
The Owasso 2010 Land Use Master Plan designates the subject property as light industrial. The
Owasso Planning Commission and City Council approved rezoning of the subject property to IL
(Industrial Light) in February 2001 and April 2001, respectively.
As the request currently before the Planning Commission represents a use less intense than that
reflected on the comprehensive plan, staff is supportive. If, however, the requested rezoning is
approved, the corresponding Planned Unit Development, OPUD- 01 -01, shall subsequently
require amendment or abandonment prior to the processing of any plat associated with the
subject property.
Letters were mailed to surrounding property owners on August 21, 2001 and legal notification of
the proposed rezoning was published in the August 23, 2001 edition of the Owasso Reporter.
Staff received one e-mail message from a citizen opposing, and one letter supporting this
application. Copies of the correspondence are attached for your information and review.
RECOMMENDATION
Staff recommends approval of OZ- 01 -07.

We are opposed to the rezoning of these two properties. Until the City of Owasso can work with Tulsa County Engineers
to prevent the flooding that occurs along Mingo and 106th streets, there should absolutely be no more homes built in this
area. The current runoff from Country Estates has increased the amount of flood water runoff that is occurring in the area,
despite the developers' and the City's contention that they have supplied detention ponds.

BACKGROUND
Mansur Daubert Strella, on behalf of the First Baptist Church of Owasso, is requesting the
closing of a 15' Sanitary Sewer and a 15' Water easement, recorded by Plat No. 5519, Book
6505, Page 1758 of the Tulsa County Records, and approval of a newly located 15' Sanitary
Sewer Easement.
The subject property is located north of E. 96`h Street N. and east of N. 129`h E. Avenue.
ANALYSIS
The 15' Sanitary Sewer Easement, as recorded, is affected by a revision of the proposed access
drive into the subject property. The access drive has shifted to the west as is the proposed new
easement. Copies of the existing and proposed easements are attached for your information and
review.
The 15' Water Easement, as recorded, was platted to accommodate an existing, undersized water
line, now to be abandoned. The new water line will be installed within a 10' easement, also
previously recorded at the time of platting, along the east boundary of the property. A copy of
the easement is attached for your information and review.
RECOMMENDATION
Staff recommends approval of the closing of the 15' Sewer Easement and 15' Water Easement as
recorded by Plat No. 5519, Book 6505, Page 1758 of the Tulsa County Records as well as

BACKGROUND
Tulsa Teachers' Credit Union, applicant, has requested review of a final plat for a 4.159 acre, 1
lot subdivision located north of E. 96`h Street N. and east of N. Garnett Road. The subject
property is generally described as a portion of the Southeast Quarter (SE /4) of the Southwest
Quarter (SW /4) of the Southwest Quarter (SW /4) of Section 17, Township 21 N, Range 14 E. A
location map is shown on the plat for your convenience. The subject property is zoned CS
(Commercial Shopping).
ANALYSIS
The subject property is located directly west of the Owasso Market II.
An emergency siren fee of $16.00 /acre, totaling $66.54, shall be accessed on the subject
property. The property is also subject to $325 /acre Ator Relief Line payback fee, totaling
$1351.68.
No provision has been made within the text of the deed of dedication for the installation and
dedication of sidewalks and acceleration/deceleration lanes as required by the Owasso
Subdivisions Regulations.
Section H. of the Deed of Dedication and Restrictive Covenants requires clarification that the
Tulsa Teachers' Credit Union will retain ownership of the detention easement. Maintenance of
the facilities will be the exclusive responsibility of the Tulsa Teachers' Credit Union.
The applicant has shown a 40' Access at the east edge of the property, which should allow access
through the proposed detention easement. This eastern access should be eliminated and the
Limits of No Access extended to the eastern boundary.
The label of Lot 1, Block 2, Owasso Market II is incorrectly shown within the detention
easement for Owasso Market. This label should be correctly shown and the Owasso Market
Detention Easement should be labeled on the plat prior to release of the plat for filing.

Final Plat shall be drawn at a scale of one hundred feet (100') to one inch (1 ") or
larger. All printing shall be clear and legible. All sheets shall be of consistent size of
twenty -four inches (24 ") by thirty -six inches (36 ") or larger. The drawing surface of any
such plat shall have a binding margin of two inches (2 ") at the left side of the plat and a
margin of not less than one inch (1") at the right side. Where the proposed plat is of
unusual size, the Final Plat may be submitted on two or more sheets of the same
dimensions and scales. If more than two sheets are required, an index sheet of the same
dimensions shall be filed showing the entire development. Each sheet shall be sealed by
a registered professional engineer or surveyor. The Final Plat shall contain or be
accompanied by the following:
"The name of the subdivision, city, county and state. The subdivision name shall not
duplicate or too closely resemble names of existing subdivisions in Tulsa or Rogers
Counties.
`The names and addresses of the owner(s) of record, the subdivider(s), and the registered
engineer or land surveyor preparing the plat. Official seals of the engineer or surveyor
are required.
� The accurate legal description of the subdivision referenced to the section, range and
township, based on an accurate traverse, giving angular and linear dimensions which
must mathematically close, the allowable error of closure on any portion of a final plat
shall be one foot (1') in five thousand feet (5000').

Geodetic Sun-ey data or the nearest established street lines, including true angles and

The names of all streets to be dedicated.
The dimensions of all lots and lot lines, and the bearings of those lot lines not parallel or
perpendicular to the street right -of -way line.
The location and dimensions of all easements to be dedicated. All easements shall be
denoted by fine dashed lines, clearly identified, and if already on record, the recorded
reference of such easements. The width of an easement with sufficient ties to locate it
definitely with respect to the subdivision must be shown.

unusual size, the Final Plat may be submitted on two or more sheets of the same
dimensions and scales. If more than two sheets are rewired, an index sheet of the same

BACKGROUND
Exchange Bank, applicant, has requested review of the Site Plan for Exchange Bank Owasso I
located at the northeast corner of E. 86`h Street N. and N. Mingo Road. A location map is
attached for your information and review. The subject property is zoned CS/PUD (Commercial
Shopping/Planned Unit Development).
ANALYSIS
The applicant has proposed a 5,966 square foot bank facility. According to the Owasso Zoning
Code, the parking requirement for this facility is 1 space per 300 square feet building floor area.
Based on this requirement, the applicant is required to provide 20 spaces including 4 handicap
accessible spaces. The applicant has provided 35 spaces and 2 handicap spaces. One handicap
space must be van accessible. One loading berth is required by code for this facility. The
applicant has provided no loading berths.
The drive aisles shown within the parking for the facility are shown to be 22' wide. Staff
recommends the drive aisles be 24' wide.
The applicant has shown two access drive along N. Mingo Road. The northerly drive aisle is
proposed as exit only with full movement proposed at the south. Given current and potential
future traffic patterns at the intersection of E. 86`h Street N. and N. Mingo Road, it is staff s
opinion the full movement access located at the south end of the property is unsafe. Staff
recommends, at the very least, the south access along Mingo Road be limited to right- in/right -out
movement only.
A landscape plan for the subject property has been reviewed and approved by staff. No screen
fencing is required since the property does not abut residential.
Drainage will be provided in accordance with the master drainage plan for the associated Larkin
Bailey Planned Unit Development.
The Owasso Technical Advisory Committee reviewed the site plan at the August 29, 2001
regular meeting. A memorandum detailing the comments received is attached for you
information and review.
Staff recommends approval of the site plan for the Exchange Banks Owasso I subject to the
following conditions:
1. All TAC comments shall be addressed prior to the issuance of a building permit.
2. Provide one van accessible handicap parking space.
3. Provide one loading berth.
4. Provide 24' drive aisles within the proposed parking.
5. The south access drive along Mingo Road shall be eliminated or limited to right -
in/right -out movement.

BACKGROUND
Dale and Lee's, applicant, has requested review of the Site Plan for the expansion of the existing
facility located at the north of E. 3rd street between N. Main and N. Birch Streets. A location
map is attached for your information and review. The subject property is zoned OL (Office
Light).
ANALYSIS
The applicant has proposed a 3,150 square foot office addition. According to the Owasso
Zoning Code, the parking requirement for this facility is 1 space per 300 square feet building
floor area. Based on this requirement, the applicant is required to provide 11 spaces including 1
handicap van accessible space for the new facility. The applicant has provided 16 spaces; none
are shown as handicap accessible. One handicap space must be van accessible. One loading
berth is required by code for this facility. Loading area is provided within the existing area.
At the time of rezoning of the subject property the applicant made an agreement with
surrounding property owners to provide decorative landscaping as well as the required 6' opaque
fence along the north property boundary. No landscape plan was submitted for review. A copy
of the agreement letter is attached for your information and review.
Drainage will be directed to a swale along the north side of E. 3`a Street.

SUBMIT THIS CHECKLIST TOGETHER WITH APPROPRIATE APPLICATION
FORM WITH ALL MATERIAL REQUIRED FOR PLANNING COMMISSION
REVIEW. IN ORDER TO MAINTAIN THE PROCESSING SCHEDULE,
INCOMPLETE SUBMITTAL PACKAGES CANNOT BE ACCEPTED. WE
RECOMMEND A "PREAPPLICATION CONFERENCE" TO DETERMINE SPECIFIC
SITE PLAN ISSUES. PLEASE CHECK (7) ITEMS ADDRESSED.
SUBMITTAL REQUIREMENTS:
Site Plan application packets must be submitted to the City Planner no later than the dadline
shown on the official City of Owasso calendar. The Site Plan shall be accompanied by an
application and checklist, as provided by the City Planner, along with the following information:

Re: Re- zoning application by Date Et Lee's
Dear Ms. Martar:
Pursuant to our meeting the week before last, I am enclosing a copy of the
relevant portion of the zoning code for the City of Owasso. Also enclosed is a copy of
the site plan for the proposed office building.
Also, in response to your concerns and the concerns of your neighbors, Date Et
Lee's will make the following commitments with regard to the proposed office:
1. No vehicular access will be permitted from Birch Street into the
property.
2. The lighting on the subject building will only be on the south side of the
building.
3. The parking lot wilt be a solid surface parking lot, not gravel.
4. ALL equipment and materials must be stored in such a manner that they
are not capable of being viewed from adjoining properties.
5. The owner must install decorative landscaping as indicated on the
proposed site plan and in a manner consistent with recommendations
from the city planning staff.
6. A new six -foot cedar privacy fence will be installed along the north
perimeter of the property.
Please understand that the proposed structure is planned to be a metal
building with a color scheme that is consistent with the existing Dale Et Lee's
structure. It was the owner's intention to have the structures appear to be
aesthetically consistent with each other rather than "hodge- podge" in nature.

Both of the above referenced documents illustrate a 40 -foot wide access point on
Mingo Road immediately north of 86`h Street. I regret that this was not picked up at the
Technical Advisory Committee meeting. I support the staff recommendation of
eliminating this access point; however, can not support a right - in/right -out movement at
this access point under any condition. An entrance of this type at the intersections of a
Primary and a Secondary Arterial would be extremely hazardous. Good design practice
has established 125 feet from the intersection ROW as an absolute minimum in this
situation.
I strongly recommend that the Limit of No Access (LNA) be extended south to
close this access point. I also recommend that the other two access points be widened to
thirty -six feet (36') to provide for left and right egress lanes and one ingress lane at the
northwest corner and southeast corner of the site.
Prior to this meeting, Mr. Lewis with Lewis Engineering has been contacted
regarding this revised condition. We have not heard from the project architect or
representatives of Exchange Bank.
