CALL TO ORDER - Charles Willey called the meeting to order at 7:05 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF AUGUST 14, 2001 REGULAR MEETING - The Commission reviewed the minutes of August 14, 2001 Regular Meeting, Bill Williams moved to approve the minutes. The motion was seconded by Bill Ellison. A vote on the motion was recorded as follows: Charles Willey - Yes Bill Williams - Yes Bill Ellison - Yes The motion carried 3 -0. 4. OZ -01 -05 - First Baptist Church of Owasso (Current Location) - A request for review of the rezoning of a 4.5 acre tract from RS -3 (Residential Single - Family, High Density) to CG (Commercial General). The subject property is generally described as a portion of the Northeast Quarter (NE /4) of the Northeast Quarter (NE /4) of Section 29, Township 21N, Range 14E and located at the southeast corner of E. 86°i Street N. and N. 1251' E Avenue. (Ward 3) Donna presented the item and described the property location. Donna explained that the applicant is requesting rezoning on approximately 7 acres. The property is surrounded by CG (Commercial General) and RM -1 (Residential Multi - Family, Low Density) with CS (Commercial Shopping) also in the area. Letters were mailed to surrounding property owners and legal notification was published in the Owasso Reporter. Staff did receive calls concerning drainage in the area. Donna stated that the Planning Commission, upon site plan review, would review drainage of the property. Staff recommends approval of the rezoning request. Several surrounding property owners were present. Mr. Willey asked if there were any comments from the attendees. The following are concerns that were expressed: OWASSO PLANNING COMMISSION September 17, 2001 Page No. 2 James Hamilton - Concerns with stormwater runoff. The drainage problems occurred when the Ehn Creek Mini Storage was built. Stan Seaton - He owns property behind the church. He stated that it is like a river when it rains and will only get worse if they build on the field behind the church. He also had questions regarding a screening fence. Would like to see the rear portion approved for residential. Jan Brockman - She feels that the regulations to prevent flooding are not correct and need to be updated. Mandi Price - She would also like to see the front portion of the property zoned commercial and the rear portion residential. Discussion was held regarding the possibility of a split zoning for this property such as, four acres approved for CG (Commercial General) and three acres RS (Residential single - family). Bill Williams moved to table this item until the next regular Planning Commission meeting, in order to resolve drainage problems. Charles Willey seconded the motion. Sokoloskv - A request for rezoning of a 12.95 acre, more or less, tract from CG (Commercial General) to RS -3 (Residential Single - Family, High Density). The subject property is generally described as the north 1236.24 feet of the south 1766.24 feet, lying west of the Atchinson, Topkea and Sante Fe Railroad, of Lot 4 and Lot 5 of Section 7, Township 21N, Range 14E, of the Indian Base and Meridian, Tulsa County, State of Oklahoma and is located west of N. Mingo Road and north of E. 106' Street N. (Ward 1) Donna presented the item and described the location. She explained that the property is approximately 12.95 acres. Staff recommends approval of this request because of the less intense use. Letters were mailed to surrounding property owners and legal notification was published in the Owasso Reporter. A binder of photographs was presented to the Commissioners showing the drainage problems in the area. Jan Brockman of 7623 East 116th Street North had concerns regarding stormwater retention in the area. She stated that she feels there is something wrong with the engineering standards. She also stated OWASSO PLANNING COMMISSION September 17, 2001 Page No. 3 that flood maps are incorrect, it seems the developments are going in faster than they can keep up. She would like the Commissioners to hold off on any new development until new flood maps are produced. Ms. Brockman also questioned if there was going to be any type of buffering between the railroad tracks and the houses. Mr. Sokolosky was present to address any concerns. Infrastructure problems were also discussed along with water pressure problems. Charles Willey explained that there would have to be stormwater retention shown on the plat, at that time it would be reviewed by the Commissioners. Mr. Willey did have concerns regarding the safety of the residents so close to railroad tracks but stated once again, that these issues will be addressed at the time of platting. Bill Williams moved to approve the rezoning, Bill Ellison seconded the motion. Sokoloskv - Request for rezoning of a 15 acre tract from IL (Industrial Light) to RS -3 (Residential Single - Family, High Density). The subject property is generally described as a portion of Government Lot One (1), located in the Northwest Quarter (NW /4) of the Northwest Quarter (NW /4), and a portion of the Northeast Quarter (NE 14) of the Northwest Quarter (NW /4) of Section 7, Township 21N, Range 14E and is located approximately i/4 mile east of N. Mingo Road and south of E. 116' Street N. (Ward 1) Donna presented the item and described the location of the property. The request represents a use that is less intense than what shows on the comprehensive plan. If this request is approved the PUD will require an amendment or abandonment prior to processing the plat. Mr. Sokolosky was present to address concerns. Letters were mailed to surrounding property owners and legal notification was published in the Owasso Reporter. Easement Closine - First Baptist Church of Owasso (Future Location) - Request for review of the closing of a recorded 15' Sanitary Sewer Easement and 15' Water Easement, and request for review of a proposed 15' Sanitary Sewer Easement located within Lot 1, Block 1, First Baptist Church of Owasso. The subject property is located north of E. 96' Street N. and east of N. 129' E Avenue. (Ward 1) Donna explained the location of the property. She stated that the 15' sanitary sewer easement is affected by a revision of the proposed access drive into the property. The access drive has shifted to the west, as is the proposed easement. The new water line will be installed within a 10' easement along the east boundary of the property. Mr. Jim Sanders, the architect for the project, was present to answer any questions. Staff recommends approval of the closing of the 15' sewer easement and 15' water easement as recorded by Plat No. 5519, Book 6505, Page 1758 of the Tulsa County Records as well as approval of the proposed 15' sanitary sewer easement. Charles Willey moved to approve the easement closing of the 15' sewer easement and 15' water easement as well as approval of the 15' sanitary sewer easement, Bill Williams seconded the motion. Plat Amendment - Preston Lakes - Request for review of a resubdivision of Lots 120- 131, Block 1, and Lots 1 -6, Block 2, Preston Lakes. The subject property is located north of E. 86's Street N. and east of N. 145' E Avenue. (Ward 3) Donna described the location of the property. This request is for a plat amendment for Lots 120 -131, Block 1 and Lots 1 -6, Block 2. If approved this would amend the area to single- family detached housing. The duplex lots would be replaced with 30 single - family lots, although, the lots do not meet the minimum lot standards as required by the approved PUD. Staff recommends approval of the Plat Amendment but also recommends the Commissioners require the minimum standards of the PUD be met or an amendment to the PUD allowing for reduced lot widths. Charles Willey moved to approve the plat amendment request with the required minimum standards of the PUD being met or an amendment to reduce lot widths, Bill Ellison seconded the motion. Final Plat - Country Estates V - A request for review of a final plat for Country Estates V, a 187 lot subdivision containing 53.64 acres, more or less. The subject property is located north of E. 116' Street N. and west of N. Garnett Road and is generally described as a portion of the South Half (S /2) of the Northeast Quarter (NE /4) of Section 6, Township 21N, Range 14E. (Ward 1) Donna presented the item. The property is located north of the existing phases of Country Estates. The Owasso Technical Committee reviewed the final plat on April 25, 2001. An emergency siren fee is required in the amount of $16.00 per acre. Also, a $100.00 per tap fee will be required to Washington County Rural Water District #3. Staff recommends approval of the final plat subject to the following conditions: 1. All TAC comments shall be addressed prior to release of the final plat for filing. 2. A covenant stipulating that "the proposed subdivision shall meet or exceed all requirements of the Owasso Subdivision Regulations and Zoning Code" shall be added to the text of the plat prior to forwarding the plat to Council. 3. A covenant stipulating that "All improvements shall be 1) constructed and accepted by the Owasso City Council, or 2) insured by performance bond naming the City of Owasso co- obligee" shall be added to the text of the plat prior to forwarding the plat to Council. Final Plat - Tulsa Teachers Credit Union Owasso - Request for review of a final plat - of a one lot, 4.5 acre parcel of land generally described as a portion of the Southeast Quarter (SE /4) of the Southwest Quarter (SW /4) and the Southwest Quarter (SW /4) of Section 17, Township 21N, Range 14E, and located north of E. 96s Street N. and OWASSO PLANNING COMMISSION September 17, 2001 Page No. 6 approximately 1/4 mile east of N. Garnett Road. (Ward 1) The item was presented and the location was described. The subject property is directly west of the Owasso Market H. An emergency siren fee in the amount of $66.54 will be due, along with $325.00 per acre for the payback fee on the Ator Relief Line. The Technical Advisory Committee reviewed the final plat request at their August 29, 2001 meeting. The label of Lot 1, Block 2, Owasso Market II is incorrectly shown within the detention easement. This label should be correctly shown and detention easement should be labeled on the plat. Staff recommends approval of the final plat subject to the following conditions: 1. All TAC comments shall be addressed prior to release of the final plat for filing. 2. A covenant stipulating that "the proposed subdivision shall meet or exceed all requirements of the Owasso Subdivision Regulations and Zoning Code" shall be added to the text of the plat prior to forwarding the plat to Council. 3. Final Plat - Exchange Bank Owasso I - Request for review of a final plat of a one lot, 0.91 acre parcel of land generally described as a portion of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of Section 19, Township 21N, Range 14E, and located at the northeast corner of E. 86`s Street N. and N. Mingo Road. (Ward 2) Donna presented the item and stated that the property is with the Larkin Bailey Planned Unit Development. The Owasso Technical Advisory Committee reviewed the final plat at their August 29, 2001 meeting. An emergency siren fee in the amount of $14.56 will be accessed on the property. Mr. Stan Ewing handed out a memorandum (attached) to the Commissioners regarding the 40' wide access point on Mingo Road. He explained that due to the City of Owasso receiving funds on intersection improvements, he is OWASSO PLANNING COMMISSION September 17, 2001 Page No. 7 apprehensive about the way this is laid out. A lengthy discussion was held concerning the Limit of No Access. Charles Willey stated that he also has a problem with the proximately of the entrance being only 85' from the intersection and suggested to possibly table this item, giving the staff and applicant time to work on this matter. Staff recommends approval of the final plat subject to the following conditions: 1. All TAC comments shall be addressed prior to release of the final plat for filing. 2. A covenant stipulating that "the proposed subdivision shall meet or exceed all requirements of the Owasso Subdivision Regulations and Zoning Code" shall be added to the text of the plat prior to forwarding the plat to Council. 3. A covenant stipulating that "All improvements shall be 1) constructed and accepted by the Owasso City Council, or 2) insured by performance bond naming the City of Owasso co- obligee" shall be added to the text of the plat prior to forwarding the plat to Council. 4. The Limit of No Access be extended south, to close the 40' wide access point on Mingo Road immediately north of 86' Street North. Also, the two other access points be widened to 36' to provide for left and right egress lanes and one ingress lane at the northwest corner and southeast corner of the site. Charles Willey moved to approve the final plat request subject to the above staff and TAC recommendations, Bill Ellison seconded the motion. Site Plan - Exchange Bank Owasso I - Request for review of a site plan for Exchange Bank Owasso I located at the northeast corner of E. 86s' Street N. and N. Mingo Road and generally described as a portion of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of Section 19, Township 21N, Range 14E. (Ward 2) Donna presented the item to the Commissioners. She explained that the applicant is proposing a 5,966 square foot facility. The applicant has provided 35 spaces and 2 handicap spaces. One handicap space must be van accessible. Also, the applicant has not indicated a loading berth on the site plan, one will be required. Staff recommends the drive aisles to be 24' wide. The Technical Advisory Committee reviewed the site plan at their regular meeting. The architect and the engineer, for the project, were present to address concerns. Discussion was held regarding the necessity of a loading berth. OWASSO PLANNING COMMISSION September 17, 2001 Page No. 8 Staff recommends approval of the site plan for the Exchange Bank of Owasso I subject to the following conditions: 1. All TAC comments shall be addressed prior to the issuance of a building permit. 2. Provide one van accessible handicap parking space. 3. Provide 24' drive aisles within the proposed parking. 4. The south access drive along Mingo Road shall be eliminated or limited to right - in/right -out movement. Bill Ellison moved to approve the site plan request subject to the above staff and TAC recommendations, Bill Williams seconded the motion. Site Plan - Dale & Lee's - Request for review of a site plan for the Dale & Lee's expansion located at the northwest corner of E. 3rd Street and N. Birch Street, 302 No. Birch Street, and described as Lot 1, Block 2, Original Town of Owasso. (Ward 4) The item was presented to the Commissioners. A 3,150 square foot building is being proposed. An ample number of parking spaces are shown although, one handicap space must be van accessible. Upon the rezoning process, the property owner, Mr. DeBoer agreed to provide landscaping as well as the required 6' screening fence along the north property boundary. No landscape plan has been submitted. The drainage will be directed to the north side of East 3'd Street. The Technical Advisory Committee reviewed this site plan at their August 29, 2001 meeting. There was a short discussion on the requirements of sidewalks. Staff recommends approval of the site plan subject to the following conditions: 1. A landscape plan shall be submitted and approved prior to the issuance of a building permit. 2. Provide one van accessible handicap parking space. Chairperson Secretary Date MEMORANDUM TO: Planning Commission FROM: Stan Ewing, Director of Community & Economic Development y/ Agenda Items 11 & 12 (/ SUBJECT: Exchange Bank Owasso Final Plat and Site Plan DATE: September 17, 2001 Both of the above referenced documents illustrate a 40 -foot wide access point on Mingo Road immediately north of 86`h Street. I regret that this was not picked up at the Technical Advisory Committee meeting. I support the staff recommendation of eliminating this access point; however, can not support a right - in/right -out movement at this access point under any condition. An entrance of this type at the intersections of a Primary and a Secondary Arterial would be extremely hazardous. Good design practice has established 125 feet from the intersection ROW as an absolute minimum in this situation. I strongly recommend that the Limit of No Access (LNA) be extended south to close this access point. I also recommend that the other two access points be widened to thirty-six feet (36') to provide for left and right egress lanes and one ingress lane at the northwest comer and southeast corner of the site. Prior to this meeting, Mr. Lewis with Lewis Engineering has been contacted regarding this revised condition. We have not heard from the project architect or representatives of Exchange Bank. CITY OF OWASSO Planning Department ANNEXATION RIGHT- OF-WAY Staff Report Donna S. Sorrells — City Planner BACKGROUND The City of Owasso Public Works Department is requesting approval of the annexation of the right -of -way at the intersection of E. 86`h Street N. and N. 145`h E. Avenue not included in the corporate limits of Owasso. The subject property includes the southeast comer of the intersection. A site plan showing the subject property is attached for your information and review. The subject property is currently zoned AG (Agriculture) and would remain so upon annexation, as required under Owasso's Annexation Policy. A copy of the Annexation Policy is attached for your information. A letter from Rogers County consenting to the annexation has been received and is included for your review and information. If the Planning Commission approves the annexation request, the application will be forwarded to the City Council for review and approval. Two consecutive legal notifications will appear in the October 11`h and 18`h editions of the Owasso Reporter prior to submittal to the City Council A copy of the Procedure for Annexation is attached for your information. The Technical Advisory Committee reviewed the annexation request at the September 26, 2001 regular meeting. The utility providers were asked to present information regarding their utility locations near the subject property. Those submitted are attached for your review. The Owasso Annexation Committee reviewed the request at their meeting held September 27, 2001 and recommended approval. RECOMMENDATION Staff recommends approval of this annexation request. AVE INTERSECTION DATE: October 2, 2001 BACKGROUND: The 1998 Bond Issue includes funds for widening and signalization of the intersection at East 86'h Street North and North 145' East Avenue. Before the project is started, all Right -of -Way should be within City Limits so that the value of all improvements made by the City will be retained by the City. The portions of the intersection in Sections 21 (northwest corner), 22 (northeast comer), and 28 (southwest comer) have all been annexed in previous annexations for Silver Creek, Preston Lakes, and the Green's Apartments, respectively. On September 4, 2001, the City Council accepted ROW donation from the Owasso Public School System (see attachment 1). Prior to that date, 16.5 feet of ROW existed on the Pamela Hodson Elementary School site. The donation gave an extra 43.5 feet of ROW, bringing the ROW on the southeast comer of 145 E. Avenue up to 60 feet from centerline. The ROW on the school's property has never been within City Limits. On August 16, 2001, City staff sent Rogers County a letter requesting comments regarding possible annexation of the said ROW. A letter of response was received September 11, 2001, from the Rogers County Assistant District Attorney, stating that Rogers County had no objections to the proposed annexation (see attachment 2). It is understood that all ROW annexed will be maintained by the City. Sorrells — City Planner CONCEPT OF A PUD The concept behind a Planned Unit Development is to provide a creative alternative to a conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity and flexibility than could be achieved by traditional zoning in the planning and development of large parcels of land. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete, coordinated plan of development for a larger parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND Planned Unit Development #OPUD -01 -03 is 160 acres, more or less, all of which is undeveloped. The subject property is located at the northeast corner of E. 106th Street N. and N. 145th E. Avenue, is described as the Southwest Quarter (SW /4) of Section 10, Township 21 North, Range 14 East and is currently zoned AG (Agriculture). The property is bound by on all sides by rural agriculatural and residential property. However, the proposed future location of the Tulsa Technology Center is to be west of the subject property and the Coffee Creek development is located opposite the subject property at the southwest comer of E. 106th Street N. and N. 145th E. Avenue. The applicant is requesting approval of PUD supplemental zoning on the subject tract that would be developed in accordance with a submitted Outline Development Plan and text. The PUD application is accompanied by a zoning application OZ- 01 -08. The plan and text call for the development of 4 acres of CG (Commercial General) located at the intersection of E. 106th Street N. and N. 145th E. Avenue with the remainder being RS -3 (Residential Single - Family Detached, High Density). The single - family will consist of 107 gross acres of Executive Homes, 23 gross acres of Garden Homes and 26 gross acres of Patio Homes. Staff is proposing a concurrent review of OPUD -01 -03 and OZ- 01 -08. STAFF ANALYSIS The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall determine: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of the surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD Ordinance. a. Permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. Permit flexibility within the development to best utilize the unique physical features of the particular site; c. Provide and preserve meaningful open space; d. Achieve a continuity of function and design within the development CONSISTENCY WITH COMPREHENSIVE PLAN The 2010 Land Use Master Plan is implemented through the use of the zoning process. Therefore PUD and rezoning requests are obliged to be consistent with Comprehensive Plan or logical reasons should be presented to show that the plan needs to be amended. The Comprehensive Plan designates the subject property to be developed as single - family residential, park and recreation, corporate technical and commercial to be located at the corner. It is staffs opinion this proposed rezoning is in compliance with the Comprehensive Plan, with the exception that no corporate technical development is proposed. Harmony with Existing and Expected Development Approximately 1/4 mile to the east and 1/2 mile to the north and to the south of the subject property are existing rural residential developments. The remaining surrounding property is undeveloped rural residential /agriculture. This proposed PUD will constitute the first significant development of the area, so is difficult to identify as harmoniuos with existing development. As previously stated, the proposed development conforms with the developmental guidelines established in the Comprehensive Plan. Therefore, it is consistant with expected development trends in the area. It is staffs opinion that this development would be harmonious with existing and expected development. Legal. Planning and Site Engineering The applicant has identified the terrain of the subject property as "characterized by relatively flat terrain to slightly rolling terrain with drainageways that tend to flow from north to south ". The soils present "no unusual development problems ". Detention facilities are shown within the south - central and southeast portions of the site. Sewer and water have been extended north along the west side of N. 145th E. Avenue. The sanitary sewer will be collected by the Ehn Creek Sanitary Sewer Interceptor. As this property was not included in the sewer master plan and, consequently, not included in the Elm Creek Interceptor payback area, payback fees must be developed for the site. There are three primary roads proposed on the outline development plan. As no road is proposed at the north end of the property, along the half - section line, staff recommends the primarily east -west road be developed as a collector road. Sorrells — City Planner BACKGROUND Planned Unit Development #15A is a minor amendment to OPUD -15, approved by the Owasso Planning Commission at the August 11, 1998 regular meeting. The amendment, affecting only Lots 3, 8, 13 and 18, Block 1 Preston Lakes Amended, is necessitated by recent Preston Lakes plat amendment. With the recent plat amendment, 18 lots were converted from duplex lots to 30 single - family lots and the four lots listed do not meet the minimum width as established by the PUD. The subject property is located east of N. 145th E. Avenue and north of E. 86th Street N. The property is bound by rural residential to the north and rural agriculture to the south. A location map is attached for your information and review. STAFF ANALYSIS The applicant is requesting the PUD amendment to allow for a deviation from the previously approved minimum 65 foot width for single - family residential lots. This amendment is to accommodate 4 lots (Lots 3, 8, 13 and 18, Block 1, Preston Lakes) which do not meet the minimum 65 foot width. As the amendment affects only the four lots listed, staff has no objection to this amendment. RECOMMENDATION Staff recommends approval of OPUD -15A, Preston Lakes PUD Amendment subject to the following condition: 1. All conditions of approval of OPUD -15 shall be conditions of approval of OPUD -15A. 2. Sorrells — City Planner BACKGROUND Preston Lakes, L.L.C., applicant, has requested review of a plat amendment to a portion of the Preston Lakes Subdivision, Plat 019692, Book 1204, Page 0661, of the Rogers County Records. The amendment includes Lots 120 -131, Block 1 and Lots 1 -6, Block 2 of the plat recorded on December 16, 1999. The subject property is included within Preston Lakes Planned Unit Development (OPUD -15), dated May 4, 1999. The property is located east of the commercial lots along N. 145th E. Avenue and north of the Vyne at Preston Lakes. A location map is included on the plat for your information and review. ANALYSIS The applicant is requesting a plat amendment for Lots 120 -131, Block 1 and Lots 1 -6, Block 2. Currently, the subject area is platted to accommodate duplexes. This revision if approved would amend the subject area to single - family detached. The proposed plat amendment shows 30 single - family lots replacing the currently platted 18 duplex lots. All proposed lots, as presented, however, do not meet the minimum lot standards as required by the approved planned unit development. Staff recommends the Planning Commission require the minimum standards of the PUD be met or an amendment to the PUD allowing for reduced lot widths be required. The applicant is required to provide signatures of 60% of the property owners of the overall subdivision and 100% of the owners of the particularly affected area, supporting the proposed amendment. Staff received these items at the eleventh hour and, upon initial review, it appears this requirement has been met. Staff will, however, precisely confirm the required signatures have been received. WHEREAS, the Developer is the owner of Lots 120 -131 (inclusive), Block 1, and Lots 1 -6 (inclusive), Block 2, all in Preston Lakes, an Addition to the City of Owasso, Rogers County, State of Oklahoma; and WHEREAS, it is the desire of the Developer and the undersigned owners of the lots and blocks of Preston Lakes to amend the Plat of Preston Lakes, filed on December 6, 1999, in Book 1204, Page 661, in the Rogers County Land Records (hereinafter, the "Plat "), as it affects Lots 120 -131 (inclusive), Block 1, and Lots 1 -6 (inclusive), Block 2, all in Preston Lakes, an Addition to the City of Owasso, Rogers County, State of Oklahoma; and WHEREAS, it is the desire of the Developer and the undersigned owners of the lots and blocks of Preston Lakes to amend The Declaration of Covenants, Conditions and Restrictions for Preston Lakes dated December 2, 1999, and filed December 5, 1999, in Book 1204, Page 664 -679 (inclusive), in the Rogers County Land Records (hereinafter, the "Covenants, Conditions and Restrictions "). NOW, THEREFORE, in consideration of the covenants, conditions and restrictions contained herein, and other good and valuable consideration, the receipt of which is hereby acknowledged, the Developer and undersigned owners of said lots and blocks in Preston Lakes do hereby amend and modify the Plat and the Covenants, Conditions and Restrictions of Preston Lakes as set forth below: A. Lots 120 -131 (inclusive), Block 1, and Lots 1 -6 (inclusive), Block 2, all in Preston Lakes, an Addition to the City of Owasso, Rogers County, State of Oklahoma, are hereby replated as Lots 1 -20, Block 1, and Lots 1 -10, Block 2, Preston Lakes Amended, a Resubdivision in the City of Owasso, Rogers 1 FINAL VERSION; 09/05/01 County State of Oklahoma, as more particularly described in the Plat of Preston Lakes Amended. B. In order to establish a compatible system of development and preserve the character of Preston Lakes Amended ( "the Addition "), the Developer and aforesaid owners of said lots and blocks in Preston Lakes do hereby declare and establish the following protective covenants, conditions and restrictions for Preston Lakes Amended: ARTICLE I _Residential Dwelling and Lot Improvements - 30 Certain Lots [Lots 1 through 20, inclusive, Block 1; Lots 1 through 6, inclusive, Block 2j 1.1 Dwellings. Unless waived by the Developer in writing, the following standards shall apply to all dwellings in the Addition to be built upon the 30 lots identified immediately above: A. Dwelling Size. All single story dwellings shall have a minimum living space of at least 1,100 square feet. Dwellings in excess of a single story shall have a minimum living space of 575 square feet at the lower level and a total minimum Living space of at least 1,200 square feet. Square footage shall be computed on measurements over frame of the living space, exclusive of porches, patios, and garages. B. Masonry. All dwellings shalt have at least twenty -five per cent (25 %) of the exterior walls thereof comprised of brick or stone. The front exterior walls of the dwelling shall be 100% comprised of brick or stone; provided, however, that the area of all windows, covered porches and doors located in the exterior walls shall be excluded in the determination of the area of said exterior walls. On corner lots, there shall be a wainscoat of masonry along the side of the house that faces the street. in all cases, the masonry shall extend to the ground line, whereby the foundation shalt be concealed. In particular cases, the Developer reserves the right to permit Dryvit brand or similar exterior construction material in lieu of brick or stone. C. Vinyl Siding. All exterior surfaces not covered with brick or stone pursuant to sub - paragraph B above shall be covered with vinyl siding. D. Garages. rages. No glass, plastic or other transparent material shall be permitted for use in the overhead garage door. Carports shall not be permitted. E. Patio Covers. ALL patio covers shall be an integral part of the residence such that they are contained within the roofline and shall be constructed with the same design, shingle color and materials as the residence. F. Driveways. All driveways into a lot from any street shall be constructed of concrete and shall not be less than ten (10) feet in width. G. Mailboxes. All mailboxes shall be of uniform structure and color and shall be approved by the Developer prior to installation. H. Roof Pitch, Materials. The roof of the dwelling shall have a pitch of at least 5/12 over 75 percent of the total roof area, and none of the roof area shall have a pitch of less than 4/12. Roof materials shall be Heritage II or equal composition shingles and shall be dark earth tone in color to resemble weathered wood. I. Sodding; Landscaping. The front yard of each lot must be fully sodded. Each lot shall have a reasonable landscape package in the front yard prior to completion of the construction of any residence. Also, please see Article 4.13 hereof. Corner lots, however, must be fully sodded on front, back and side yards. 1.2 Approval Of Plans. For the purpose of further insuring the development of the Addition as an area of high standards, the Developer reserves the power to control the buildings, structures and other improvements placed on each lot, as well as to make such exceptions to these covenants as the Developer shall deem necessary and proper. In its review of plans or consideration of any request for waiver herein authorized, the Developer may take into consideration the nature and character of the proposed building or structure, the materials of which it is to be built, the availability of alternative materials, the site upon which it is proposed to be constructed, and the harmony thereof with, the surrounding area. The Developer shall not be liable for any approval, disapproval or failure to approve hereunder, and its approval of building plans shall not constitute a warranty of or responsibility for building methods, materials, procedures, structural design, grading, drainage, restrictive covenant compliance or code compliance. The approval, disapproval or failure to approve of any building plans shall not be deemed a waiver of any restrictions, unless the Developer is herein authorized to grant the waiver and the Developer did, in fact, grant the waiver. It is the responsibility of each lot owner, and 3 FINAL VERSION; 09/05/01 not the Developer, to insure that such owner's grantor and /or builder has caused the subject lot, and all improvements thereto, to be in full compliance with all relevant covenants and restrictions imposed upon the Addition. 1.3 Set -back Lines. No buildings, outbuildings, structures, or parts thereof shall be constructed or maintained on lots nearer to the property lines than the set -back lines provided herein or shown on the accompanying plat. Unless otherwise provided by easement or set -back tines shown on the accompanying plat, the minimum building set- back lines for dwellings or other outbuilding structures shall be:, Front yard: 25 feet Side yard: 5 feet Other side yard: 10 feet Back yard: 20 feet 1.4 Fences. The following restrictions shall pertain to fencing: No fence or wall shall be erected, placed or altered on any lot nearer the street than the minimum set -back lines established herein. No fence shall be erected on any lot closer to any street than the main structure without the written approval of the Developer, and no fence on any lot shall exceed six (6) feet in height without the written approval of the Developer. No fences shall be constructed on overland drainage easements or upon walkway or access easements which would impair or hinder the intended use thereof. 1.5 Outbuildings. All tool sheds, hobby rooms, or other outbuildings shall conform to the basic architectural styling of the dwelling and shall consist of at least twenty -five percent (25 %) masonry conforming to the dwelling. All such outbuildings shall be shingled with the same color and type of shingle as the dwelling. 1.6 Antennae. No television, radio, or other antennae or reception devices, other than an eighteen (18) inch or smaller television satellite dish, shall be constructed or maintained on any lot without the written approval of the Developer.
