The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
October 1, 2001 at 5:00 PM. The notice for the Addendum to Agenda was posted in the Owasso
City Hall, 207 S Cedar, on October 3, 2001 at 5:00 PM.
1. CALL TO ORDER - Charles Willey called the meeting to order at 7:00 PM and declared
a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF SEPTEMBER 17, 2001 SPECIAL
MEETING - The Commission reviewed the minutes of September 17, 2001 Special
Meeting, Bill Ellison moved to approve the minutes. The motion was seconded by Bill
Williams. A vote on the motion was recorded as follows:

The motion carried 3-0.
Charles Willey stated that case #OZ- 01 -05, rezoning for First Baptist Church property,
was tabled at the September 17, 2001 special meeting. The tabling of this item needs to
be extended to the November 2001 regular meeting.
4. Annexation - City of Owasso - A request for review of an annexation of street right -of-
way located at the southeast corner of the intersection of E. 8& Street N. and N. 145''
Street N. and generally described as a portion of the Northwest Quarter (NW /4) of the
Northwest Quarter (NW /4) of Section 27, Township 21 North, Range 14E, Rogers
County, States of Oklahoma.
Donna presented the item and described the property location. The property is zoned AG
(Agriculture) and would remain AG. Two legal notifications will appear in the October
11' and 18°i editions of the Owasso Reporter prior to submittal to the City Council. The
Technical Advisory Committee reviewed this request with utility providers asking for
information regarding utility locations near the subject property. The Owasso Annexation
Committee reviewed the request and recommended approval.

5. Annexation - Charnev & Charney - A request for review of an annexation of a tract of
land located north of east 96' Street N. and East of the U.S. Highway 169 right -of -way
and generally described as a portion of the Northwest Quarter (NW /4) of the Southwest
Quarter (SW /4) of Section 16, Township 21 North, Range 14 East, Tulsa County, State
of Oklahoma.
Donna presented the item and described the location. This property is zoned AG
(Agriculture) and contains approximately 3.94 acres. Two notifications will appear in the
October 11' and 18' editions of the Owasso Reporter. The Technical Advisory
Committee reviewed the request with the utility providers asking for information
regarding utility locations. The Owasso Annexation Committee reviewed the request and
recommended approval.

6. Annexation - Pittman Poe & Associates - Request for review of an annexation of a tract
of land located south of E. 116' Street N. (State Highway 20) and west of N. 145' E.
Avenue and generally described as a portion of the East Half (E /2) of Section 9,
Township 21 North, Range 14 East, Tulsa County, States of Oklahoma.
Donna presented the item and described the location of the property. This property is
currently zoned AG (Agriculture) and totals approximately 89.34 acres. The Technical
Advisory Committee reviewed the request at their September 26, 2001 meeting. The
Owasso Annexation Committee reviewed the request also and recommended approval.
Acceleration/deceleration lanes will be required along N. 145' E Avenue at the time of
platting.

Staff recommends approval of this annexation request subject to the following condition:
1. A sealed engineering report or letter confirming the ability of Washington
County RWD3 to provide adequate fire protection standards prior to
approval of any plat associated with the annexed property.

7. OPUD -01 -03 & OZ -01 -08 - Charm & ChaMey - Request for review of a planned
unit development for Lake Valley. The 160 acre subject property is located at the
northeast corner of E. 106' Street N. and N. 145" E Avenue and is described as the
Southwest Quarter (SW /4) of Section 10, Township 21 North, Range 14 East, Rogers
County, States of Oklahoma. (Ward 1)
Donna stated that staff is proposing a concurrent review of OPUD -01 -03 and OZ- 01 -08.
She also explained the location of the property and the concept of a Planned Unit
Development. The plan calls for four acres of CG (Commercial General) located at the
intersection of E. 106'' Street N. and N. 145' E. Avenue with the remainder being RS -3
(Residential Single - Family Detached, High Density). The single - family will consist of
107 acres of Executive Homes, 23 acres of Garden Homes and 26 acres of Patio Homes.
This proposed rezoning is in compliance with the Comprehensive Plan, with the exception
that no corporate technical development is proposed.
Staff recommends approval of OPUD -01 -03 and OZ -01 -08 subject to the following
conditions:
1. The primarily east -west road proposed shall be developed as a collector road.
2. All cul -de -sac lots and lots along curves shall meet the minimum lot width
within five feet of the front yard setback or rear property line.
3. Sidewalks along all public rights -of -way be required at the time of platting.
4. Acceleration/deceleration lanes be required at the time of platting.
5. Detailed covenants and restrictions governing the unified design and function
of the PUD be required at the time of platting.
6. The applicant's Development Text shall be considered the Outline
Development Plan and shall be filed of record in the office of the Tulsa
County Clerk.

family development shall meet the requirements of a typical RS -3 district.
8. Unless specifically set out in the standards and conditions of this PUD,
commercial development shall meet the requirements of a typical CG district.
9. Within this PUD, the maximum number of dwelling unit shall not exceed 560
single - family residence.
10. Minor transfers (10% increase in a development area's density) of dwelling
from one residential development area to another may occur if a significant
change in the character of the development area is not created.
11. All conditions imposed by the Owasso Technical Advisory Committee for
subdivision plat approval be met as conditions of the PUD.
12. A detailed drainage report be submitted at the time of platting and the
document be certified by registered engineering.
13. All covenants of any subdivision plat containing property within the PUD shall
incorporate all PUD standards and conditions of approval and make the City
of Owasso beneficiary.
14. No building permit be issued within any portion of the PUD until all criteria
outlined within Chapter 8 of the Owasso Subdivision Regulations are met by
the developer.
15. Detailed landscape plans shall be submitted at the time of site plan review.
16. The Planning Commission reserves the right to prescribe additional buffering
screening and setbacks during the platting process.
There was discussion regarding Item #1 and Item #2 of the above staff recommendations.
Staff feels that the road between the east side of the open space to the west of North 145th
East Avenue needs to be developed as a collector road. Also, discussion was held
regarding drainage in the area. Mr. David Charney, the attorney for the applicant,
requested a brief presentation. Mr. Charney explained that engineers that are specialized
in this field calculate the runoff of stormwater. We plan to make this area better such as
what was done in at Preston Lakes. Although, water runoff is normally not discussed
until the platting process. We as developers do not want stormwater issues to arise and a
stormwater plan will be issued and reviewed by the City of Owasso engineers. He also
stated that a collector road is not needed for this development, there are much larger
developments without collector roads. He also expressed his concern on Item #2, which
requires all cul -d -sac lots, and lots along curves meet the minimum lot width within five
feet of the front yard setback or rear property line. He explained that the builders and
consumers love cul -de -sac lots, they feel safe with less traffic in front of their home. The
front yards may be small but they normally have large rear yards. Mr. Pete Kourtis
presented plats of several other Owasso developments that contain numerous cul -de -sac
lots. Mr. Charney asked the Commissioners to approve the PUD and rezoning but, not to
require Item #1 and Item #2 as conditions. Charles Willey suggested that if staff desires
the change in the minimum lot width of curved lots it needs to go through the proper
channels, adding these regulations to the design criteria and subdivision regulations. This
would allow the developers to understand the rules from the beginning of the process.

The following are comments made by surrounding property owners that were in
attendance.
Gale Beckman - 10990 No 155 E Ave - Drainage problems in the area.
Lydia Snyder - Overcrowding of the schools and concerns with drainage on East 106'
Street North.
David Hamlin - Expressed problems with drainage and questioned the liability for his
property flooding. Concerns with the amount of water runoff approximately 560 new
homes will cause. Also, stormwater detention pond questions.
Tony Swindel - 14511 E 102 St No - Stormwater runoff concerns.
Leslie Martini - 10113 N 151 E Ave - Stormwater concerns also, problems with the
ditches being too deep along various roads in Rogers County.
Larry Loffer - 13227 E 106 St No - Concerns regarding the conditions of roads, such as
East 106' Street North. Adding more houses and people will cause further deterioration.
Also, questions on acceleration/deceleration lanes.
Roy Crowe - 15901 E 109 St No - Questions on how far east the sewer system will go
Paula Hamlin - 15052 E 106 St No - More homes in the area adding more traffic on East
106'" Street North. Hopes that she will be able to exit her driveway.
Dale Albersmeyer - 10124 N 151 E Ave - Questioned when the property was annexed
into the city limits of Owasso. Has problems with stormwater runoff in the area. Stated
that there are five (5) homes that get land locked after a substantial rain. Emergency
vehicles are not able to reach these homes. Wants to see Owasso grow but, there is an
existing problem and we don't need additional problems in the area.
Tim Burrnett - 15675 E 110 St No - Questioned the size of the lots that will be in this
development. He and his family moved to Owasso for a rural setting.
Mr. Charney explained that the detention ponds are there to retain the water. These
ponds are designed to maintain the water then release in a controlled manner. Mr.
Charney assured the property owners that this plat would be reviewed very carefully and
that he would also check into the stormwaters problems running downstream.
Charles Willey moved to approve OPUD -01 -03 and OZ- 01 -08, subject to the above staff
and TAC recommendations, with the deletion of Item #1 and Item #2, Bill Williams
seconded the motion. A vote on the motion was recorded as follows:

8. OLS -01 -05 - Owasso Land Trust - Request for review of a lot split for property
described as Lot 1, Block 1, Three Lakes Industrial Park and located at 8291 Owasso
Expressway. (Ward 3)
Donna described the location of the property and explained that this property is zoned IL
(Industrial Light). Access to Tract 2 will be by way of a 25' mutual access easement
through Tract 1. The Owasso Planning Commission reviewed a site plan for the rear
portion at the January 9, 2001 meeting. No comments were recorded at the Technical
Advisory Committee which was held on September 26, 2001. Charles Willey
questioned the flow of traffic through the access easement.
Staff recommends approval of OLS -01 -05 subject to the following condition:
1. The 25' mutual access easement shall be recorded with the Tulsa County Clerk
prior to the issuance of a building permit.
Bill Ellison moved to approve the lot split request subject to the above condition, Charles
Willey seconded the motion. A vote on the motion was recorded as follows:

9. Final Plat - Sawgrass Park at Bailey Ranch - A request for review of a final plat for
Sawgrass Park at Bailey Ranch, a 53.24 acre, 179 lot subdivision located north of E. 96'
Street N. and east of N. Garnett Road and generally described as a portion of the West
Half (W /2) of Section 17, Township 21N, Range 14E. (Ward 1)
Donna presented the item and stated that this property is zoned RS -3 /PUD (Residential
Single- Family, High Density/Planned Unit Development. A short discussion was held
regarding the drainage ditch to the east. The drainage from this property will be detained
within the reserve areas located on the plat. Mr. David Charney made a brief
presentation regarding this matter. The Owasso Technical Advisory Committee reviewed
the plat at their regular meeting.

Staff recommends approval of the preliminary plat subject to the following conditions:
1. All TAC comments shall be addressed prior to release of the final plat for
filing.
A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Bailey Ranch Planned Unit Development Amended
(OPUD -12A), the Owasso Subdivision Regulations and the Owasso Zoning
Code" shall be added to the text of the plat prior to forwarding the plat to
Council.
3. A covenant stipulating that "All improvements shall be 1) constructed and
accepted by the Owasso City Council, or 2) insured by performance bond
naming the City of Owasso co- obligee" shall be added to the text of the plat
prior to forwarding the plat to Council.

recommendations, Bill Ellison seconded the motion. A vote on the motion was recorded

10. Final Plat - Preston Lakes H - Request for review of a final plat for Preston Lakes II, a
32.62 acre, 120 lot subdivision located north of E. 864' Street N. and east of N. 145' E
Avenue and generally described as a portion of the South Half (S /2) and Northeast
Quarter (NE /4) of Section 22, Township 21N, Range 14E. (Ward 3)
The item was presented and the location was described. The subject property is zoned
RS -2 /PUD (residential Single - Family, Medium Density /Planned Unit Development). The
Technical Advisory Committee reviewed this plat at their September 26, 2001 meeting.
This property lies within the Elm Creek Sanitary Sewer Interceptor payback area and is
subject to $1580.00 per acre assessment.
Staff recommends approval of the final plat subject to the following conditions:
1. All TAC comments shall be addressed prior to release of the final plat for
filing.
2. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Preston Lakes Planned Unit Development (OPUD -15), the
Owasso Subdivision Regulations and the Owasso Zoning Code" shall be added
to the text of the plat prior to forwarding the plat to Council.

11. Site Plan - Leo Roberts Office Buildine - Request for review of a site plan for Leo
Roberts Office Building located at 8809 N. 145' E Avenue and described as Lot 4, Block
10, Preston Lakes. (Ward 3)
Donna presented the item and stated that the property is zoned CS /PUD (Commercial
Shopping /Planned Unit Development). The applicant is proposing a 4,000 square foot
office facility. More information is needed on the landscape plan that was submitted to
staff, such as quantity and method of installation. There will be a common access to their
parking, which will be shared with Chumley & Associates Office Building. Also, Donna
stated that recommendation item #3 should be taken out, along with item #4 should read
"Occupancy" permit.
Staff recommends approval of the site plan for the Leo Roberts Office Building subject to
the following conditions:
1. All TAC comments shall be addressed prior to the issuance of a building
permit.
2. Provide curb and gutter along the entire perimeter of the parking.
3. Provide acceleration/deceleration lanes along N. 145' E Avenue prior to the
issuance of a building permit.
4. Provided sidewalks along N. 145' E. Avenue prior to the issuance of a
building permit.
5. Provide landscape quantity, type and specifications prior to the issuance of a
building permit.
Charles Willey moved to approve the site plan request subject to the deletion of Item #3,
of the above staff recommendations and a modification on Item #4. Item #4 condition
should read as follows:

12. Site Plan - Chumlev & Associates Office Building - Request for review of a site plan
for Chumley & Associates office Building located at 8813 N 145' E. Avenue and
described as Lot 3, Block 10, Preston Lakes. (Ward 3)
Donna presented the item to the Commissioners. The subject property adjoins the
property of the previous item and is also a part of the Preston Lakes PUD. The applicant
is proposing a 2,709 square foot office facility. Donna suggested that Item #3, regarding
acceleration/deceleration lanes be taken out, along with item #4, should read
"Occupancy" permit. More information is needed on the landscape plan that was
submitted to staff, such as quantity and method of installation. The Technical Advisory
Committee reviewed the site plan at the September 27, 2001 regular meeting.
Staff recommends approval of the site plan subject to the following conditions:
1. All TAC comments shall be addressed prior to the issuance of a building
permit.
2. Provide curb and gutter along the entire perimeter of the parking.
3. Modify the one handicap accessible space to be van accessible.
4. Provide acceleration/deceleration lanes along N. 1451' E Avenue prior to the
issuance of a building permit.
5. Provided sidewalks along N. 145°i E Avenue prior to the issuance of a
building permit.
6. Provide landscape quantity, type and specifications prior to the issuance of a
building permit.
Bill Ellison moved to approve the site plan request subject to the deletion of Item #3, of
the above staff recommendations and a modification on Item #4. Item #4 condition
should read as follows:

13. OPUD -15A - Preston Lakes PUD Amendment - Request for review of a minor
amendment to the Preston Lakes Planned Unit Development. The subject property is
located north of E. 86' Street N. and east of N. 145`" E Avenue and is generally described
as a portion of the Southeast Quarter (SE /4) of Section 22, Township 21 North, Range 14
East. (Ward 3)
The location of the property was described. This amendment request is to allow for a
deviation from the approved minimum 65 foot width for single - family residential lots. If
approved it will accommodate lots 3, 8, 13 and 18, Block 1, Preston Lakes. Mr. David
Charney made a brief presentation.
Staff recommends approval subject to the following conditions:
1. All conditions of approval of OPUD -15 shall be conditions of approval of
OPUD -15A.
2. No variance to the required setbacks shall be granted by the Owasso Board of
Adjustment on Lots 3, 8, 13 and 18, Block 1, Preston Lakes.

BACKGROUND
Mr. Roy Cartright, Trustee, Larkin Bailey Foundation has submitted a petition to the City of
Owasso for detachment of 268.78 acre, more or less, parcel of land located north of E. 76`h Street
N. and west of the SK &O Railroad. The subject property is zoned AG (Agriculture) and is
vacant and undeveloped.
The subject property is bound on the east by railroad right -of -way, and further by the Railroad
Depot, Original Town of Owasso, and further north, Southern Links; it is bound on the north by
E. 86`h Street N. and unincorporated rural residential/agricultural uses which also occur along the
west of the property; and is bound on the south by E. 76`h Street N. and further by unincorporated
rural residential/agriculture /flood plain.
ANALYSIS
The Owasso Annexation Committee first reviewed the request at the August 30, 2001 special
meeting and, at that time, postponed recommendation until additional information could be
provided to the committee by the applicant. The annexation committee requested the following
three items:
Written explanation of the reason for the detachment being requested. This
information was provided to staff on November 2, 2001. A copy of the letter of
explanation is attached for your information and review.
2. Detailed legal description, including overall acreage. The legal description has been
provided to staff, however, the overall acreage has not, to date.
Detailed descriptive boundary map. As of this date, staff has not received this
information.
The information not received to date will be provided to the Commission prior to the meeting.
The Owasso Annexation Committee will review the petition again at 5:00 p.m., November 8,
2001. The recommendation of the Committee will be available at the Planning Commission
meeting.
RECOMMENDATION
Staff reserves recommendation at this time.

Gentlemen:
The land owned by the Larkin Bailey Trust north of 76th Street which is under request for
deannexation is being requested for the following reasons:
1. The land is more than 95% in the ranch creek floodplain and cannot be productive for any
type of use other than an agricultural or mineral use.
2. It is the intention of the trust to place this land into a cattle grazing crop type of operation and
the possibility of drilling some gas wells.
The trust has agreed to donate a portion of this land to be deannexed to the Sertoma Club.
This land falls in the southeast corner of the property. A small portion of this donated land
is out of the floodplain and another portion of the land to be donated to the Sertoma Club is
in the floodplain. This is the intent of the Larkin Bailey Trust.
Also requested by the city is a cad drawing of the legal description. This drawing is to follow as
soon as possible.

CONCEPT OF A PUD
The concept behind a Planned Unit Development is to provide a creative alternative to a
conventional development where a particular tract is under common ownership or
control, and a detailed plan (Outline Development Plan) for the development of the tract
as a unit is proposed and submitted for public input and review. The PUD allows for
greater creativity and flexibility than could be achieved by traditional zoning in the
planning and development of large parcels of land.
The use of a PUD technique is a way to amend a zoning ordinance in accordance with a
complete, coordinated plan of development for a larger parcel, rather than piecemeal the
changes by using variances of the zoning regulations.
BACKGROUND
Planned Unit Development #OPUD -01 -04 is 89.3 acres, more or less, all of which is
undeveloped. The subject property is located approximately 1/4 mile south of E. 116`h
Street N. (State Highway 20) between U.S. Highway 169 and N. 145`h E. Avenue and is
generally described as a portion of the East Half (E /2) of Section 9, Township 21 North,
Range 14 East, of the Indian Base and Meridian, Tulsa County, State of Oklahoma. The
subject property is currently zoned AG (Agriculture).
The property is bound on the north by the Interchange Business Park PUD to which this
proposed development will be closely related; on the east by N. 145`h E. Avenue and,
further, by rural residential/agriculture; on the south by the future Tulsa Technology
Center; and on the west by U.S. Highway 169.
Pittman Poe & Associates, agent for the owner, is requesting approval of PUD
supplemental zoning on the subject tract that would be developed in accordance with a
submitted Outline Development Plan and Text. The PUD application is accompanied by
a zoning application OZ- 01 -09. The plan and text call for the development of 8.14 acres
of OM (Office Medium), 35.92 acres of CS (Commercial Shopping), 10.01 acres of CG
(Commercial General), and 35.26 acres of IL (Industrial Light). The applicant has
proposed, within the PUD text, the option of approximately 14.64 acres of CS
(Commercial Shopping) being converted to RM -2 (Residential Multi- Family, High
Density). The option will require either rezoning of the subject portion or approval of a
special exception by the Owasso Board of Adjustment to allow for the use within the CS
zoning district.
Staff is proposing concurrent review of OPUD -01 -04 & OZ- 01 -09.
STAFF ANALYSIS
The Zoning Code identifies that the Planning Commission shall conduct a public hearing
and shall determine:
1. Whether the PUD is consistent with the Comprehensive Plan.
2. Whether the PUD is in harmony with the existing and expected development
of the surrounding areas.
3. Whether the PUD is a unified treatment of the development possibilities of the
project site.
4. Whether the PUD is consistent with the stated purpose and standards of the
PUD ordinance.
a. Permit innovative land development while maintaining appropriate
limitation on the character and intensity of use assuring compatibility with
adjoining and proximate properties;
b. Permit flexibility within the development to best utilize the unique
physical features of the particular site;
c. Provide and preserve meaningful open space;
d. Achieve a continuity of function and design within the development.
CONSISTENCY WITH COMPREHENSIVE PLAN
The Owasso 2010 Land Use Master Plan identifies the subject property as High Intensity
Commercial and High Intensity Corporate /Technical, for which appropriate zoning
districts would be commercial, office and/or light industrial. It is staff s opinion this
application is in conformance with the Comprehensive Plan.
Harmony with Existing and Expected Development
As previously stated, this development abuts the Interchange Business Park PUD located
to the north of the subject property. The proposed PUD is directly related to the previous
PUD in coordinated circulation, use types and arrangement, and overall organization.
The proposed PUD also provides excellent support possibilities for those businesses
which will want direct association with the future Tulsa Technology Center. Anticipated
development activities east of N. 145'h E. Avenue include additional Corporate /Technical
and high density single - family residential. Staff considers this development to be
harmonious with existing and expected development in the area.
Legal, Planning and Site Engineering
The applicant has identified the terrain of the subject property as relatively flat with two
minor ridge lines and one minor drainageway which flows north to south and soils which
are typical for the area and create no unusual development problems.
Detention facilities are not specifically designated within the subject property. If unified
detention facilities are to be proposed, all facilities must be constructed and functional
prior to release of a building permit for a site which will utilize such facilities. A detailed
drainage report is required by the Public Works department at the time of the first plat
submitted within the PUD.
Sewer and water have been extended to the north along the west side of N. 145`h E.
Avenue. This property will be subject to an interceptor payback fee assessment at the
time of platting. -
It is the opinion of both the Community Development and Public Works departments that
the east -west road and service road shown on the Outline Development Plan should be
developed as collector roads.
Sidewalks will be required along all public rights -of -way associated with the subject
property. Perimeter sidewalks must be installed at the time of overall development, while
the internal walks may be constructed as individual lots /sites are developed.
Acceleration/deceleration lanes are required at all access locations along arterial and
service roads.
Unified Treatment of the PUD Subject Area
The applicant has effectively utilized the site and its existing features and thoughfully
arranged various land uses proposed within the PUD. A property owners' association
will be established, and, at the time of platting, detailed covenants and restrictions
incorporating all conditions of the PUD and governing the unified design and function of
the various uses shall be submitted.
RECOMMENDATION
Staff recommends approval of OPUD -01 -04 and OZ -01 -09 subject to the following
conditions:
1. The primary east -west road and service road as shown on the Outline Development
Plan shall be developed as collector roads.
2. Sidewalks along the perimeter of the development, except at those locations where
the future business will actually front the arterial or service road shall be installed at
the time of development. All other sidewalks shall be installed at the time of site
construction.
3. Acceleration/deceleration lanes shall be required at all access points along arterial and
service roads.
4. A detailed drainage report shall be submitted to and approved by the Public Works
department prior to the processing of any plat associated with the PUD.
5. Detailed covenants and restrictions incorporating all conditions of the PUD and
governing the unified design and function of the PUD shall be required at the time of
platting.
6. The applicant's Outline Development Plan and Text shall be filed of record in the
office of the Tulsa County Clerk and two recorded copies provided to the City
Planner prior to the processing of any plat associated with the PUD.
7. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the OM (Office Medium) district.
8. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the CS (Commercial Shopping) district.
9. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the CG (Commercial General) district.
10. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the IL (Industrial Light) district.
11. Prior to development of the optional RM -2 (Residential Multi - Family, High Density),
a special exception shall be granted by the Owasso Board of Adjustment or a
rezoning application approved. No amendment to the PUD shall be required as long
as the development is in accordance with the approved Outline Development Plan.
12. Within the PUD, the maximum number of multi - family dwelling units, if applicable,
shall not exceed 243.
13. All conditions imposed by the Owasso Technical Advisory Committee for
subdivision plat approval shall be met as conditions of the PUD.
14. A detailed, certified drainage report be submitted to and approved by the Public
Works department prior to Planning Commission review of the first plat associated
with the PUD.
15. All covenants of any subdivision plat containing property within the PUD shall
incorporate all PUD standards and conditions of approval and make the City of
Owasso beneficiary.
16. No building permit shall be issued within any portion of the PUD until all criteria
outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the
developer.
17. Detailed landscape plans for individual sites shall be submitted at the time of site plan
review.
18. Area markers, including associated landscaping and lighting, shall be submitted to
and approved by the Owasso Planning Commission as required by the Sign
Ordinance.
19. The Planning Commission reserves the right to prescribe additional buffering,
screening and setbacks during the platting process.

The Owasso Technical Advisory Committee reviewed your request for a final plat on the above -
referenced property at the October 31, 2001 regular meeting and the following comments were
recorded:
1. Community Development - Potentially subject to sewer interceptor payback
assessment.
2. Public Works - Service Road and east -west streets should be constructed as collector
roads.
3. Public Works - Acceleration/Deceleration lanes will be required at all access points
along N. 145`h E. Avenue and the service road.

BACKGROUND
Kourtis Properties, LLC, has requested review of a lot split and subsequent lot tieing agreement
to accommodate a 6 -8' encroachment over the north property line of Lot 63, Block 1, Fairways
V, a zero lot line property. A location map is shown on the Plat of Survey attached for your
information and review.
The builder, American Heartland, mislocated the property corners prior to construction. A copy
of the approved building permit and plot plan is attached for your information and review.
ANALYSIS
As the structure and driveway located on the subject property are encroaching over the property
line, the only viable solution is provide a lot split, separating a portion along the south property
line of Lot 62, Block 1, Fairways V. That portion separated by the lot split could then be tied to
Lot 63.
The structure does not encroach into any easements.
If approved, the lot tieing agreement will be forwarded to the City Council for approval. Both
the lot split and the lot tieing agreement shall be filed of record with the office of the Tulsa
County Clerk per the requirements of that office. The applicant should then provide two
recorded copies of each to the City Planner.
Staff recommends approval of OLS -01 -06 and the associated Lot Tieing Agreement.

Dear Donna:
Subsequent to our last conversation regarding our lot split application for the captioned
matter, I had an opportunity to confirm with Pete Kourtis that the'PUD Development Standards for
the captioned lots are the Patio Home standards (copy enclosed), and not the Garden Home
standards. As you will note on the enclosed copy of the Plat for The Fairways V at Bailey Ranch,
the minimum lot frontage in Fairways V is fairly consistent at 54 feet to 55 feet. As reflected on the
attached Plat of Survey, the minimum lot frontage for the proposed new Lots 62 and 63 exceed this
standard.
As you know, the existing structure on Lot 63 does not encroach on the building line nor does
it encroach into a utility easement (home is constructed on a zero lot line). Further, the proposed lot
size of the new Lot 62 is well in excess of the required lot size (by approximately 1,500 feet). In as
much as our proposed lot split and lot tie requests do not violate development standards, we request
that you place the same on the Planning Commission's agenda for consideration.
For your convenience, I am enclosing a copy of the Plat of Survey with complete legal
descriptions for Lots 62 and 63, a copy of the Plat for Fairways V, original Architectural Committee
approval by the property owner's association for Fairways V, and original Lot Tie Agreement
executed by the current owners of Lots 62 and 63. If there is any additional information you need,
please contact me.

AGREEMENT
THIS AGREEMENT made and entered into this 9th day of October, 2001, by and
between Bobby D. Berry and Sandra S. Berry, husband and wife (hereinafter,
"Berry "), and Kourtis Properties, L.L.C., an Oklahoma limited liability company
(hereinafter, "Kourtis ") (Berry and Kourtis are hereinafter collectively referred to as
"First Parties "), and the CITY OF OWASSO,' OKLAHOMA, a municipal corporation,
hereinafter designated "Second Party ".
WITNESSETH:
WHEREAS, Berry is the record owner of the following described real property
situated in the City of Owasso, Tulsa County, State of Oklahoma, to -wit:
Lot 63, Block 1, Fairways V at Bailey Ranch, an Addition to City of
Owasso, Tulsa County, State of Oklahoma, according to the recorded plat
thereof (hereinafter designated "First Property "); and
WHEREAS, Kourtis is the record owner of the following described real property
situated in the City of Owasso, Tulsa County, State of Oklahoma, to -wit:
Lot 62, Block 1, Fairways V at Bailey Ranch, an Addition to City of
Owasso, Tulsa County, State of Oklahoma, according to the recorded plat
thereof (hereinafter designated "Second Property"); and
WHEREAS, the First Parties have requested the Second Party grant their
application to split a part of the Second Property to permit the existence of a single
family structure built over the common lot tine of the First and Second Properties;
and
WHEREAS, the Second Party is willing to grant the aforesaid requests of the
First Parties, all upon the terms and subject to the conditions hereinafter set forth.
NOW THEREFORE, in consideration of the mutual covenants and agreements
herein contained, the parties hereto do hereby agree as follows:
1) Subject to the conditions hereinafter set forth, the Second Party does hereby
grant unto the First Parties, their grantees, lessees, successors and assigns the
following:
a) The right to construct a single family dwelling on the common tot tine of
both the First and Second Properties; and
b) The right to use said Properties of the First Parties as though said real
property constituted a single platted lot instead of two separately
platted lots.
2) The rights granted by the Second party under the provisions of paragraph (1)
above are subject to the following conditions:
a) That the aforesaid First and the following parcel of the Second Property
may not be sold, mortgaged or otherwise encumbered separate and
apart from each other, to -wit: Lot 63, Block 1, of Fairways V at Bailey
Ranch, an Addition to City of Owasso, Tulsa County, State of Oklahoma,
AND a part of Lot 62, Block 1, Fairways V at Bailey Ranch, an Addition to
City of Owasso, Tulsa County, State of Oklahoma, more particularly
described as follows: Beginning at the Southeast corner of said Lot 62;
THENCE S 88 041'42" W and along the South line of said Lot 62, a
distance of 159.61 feet to the Southwest corner of said Lot 62; THENCE
Northwesterly on a curve to the right, and along the West line of said
Lot 62, having a radius of 325.00 feet for a distance of 8.68 feet;
THENCE S 88 016'13" E a distance of 161.37 feet to the Point of
Beginning; and
b) That construction of buildings and other improvements on said
Properties of the First Parties shall otherwise comply with all ordinances
of the City of Owasso, Oklahoma.
3) In consideration of the covenants and agreements of the Second Party herein
contained, the First Parties do hereby agree that so long as this Agreement is_in force
and effect they will not sell, mortgage or otherwise encumber Lot 63, Block 1, of
Fairways V at Bailey Ranch, an Addition to City of Owasso, Tulsa County, State of
Oklahoma, AND a part of Lot 62, Block 1, Fairways V at Bailey Ranch, an Addition to
City of Owasso, Tulsa County, State of Oklahoma, more particularly described as
follows: Beginning at the Southeast corner of said Lot 62; THENCE S 88 °41'42" W and
along the South line of said Lot 62, a distance of 159.61 feet to the Southwest corner
of said Lot 62; THENCE Northwesterly on a curve to the right, and along the West line
of said Lot 62, having a radius of 325.00 feet for a distance of 8.68 feet; THENCE S
88 °16'13" E a distance of 161.37 feet to the Point of Beginning, separate and
independent of each other.
4) This Agreement shall automatically terminate:
a) Upon the replatting of the above described Properties into a single lot as
required by law.
Upon the occurrence of the event described in subparagraph (a) of this paragraph 4,
the Second Party shall, immediately upon the request of the then record owner of the
above - described properties, execute in recordable form a release or mutual release
of this Agreement.
5) This Agreement shall be binding upon the parties hereto and each of them,
their respective successors and assigns.

BACKGROUND
Soc's Realty, owner, is requesting review of the Preliminary Plat for Metro Heights H, a 15.42
acre, 38 residential, 1 commercial lot proposed subdivision located north of E. 106th Street N.
and east of N. Mingo Road. The subject property is generally described as a tract of land in the
West Half of the Southwest Quarter (W /2 SW /4) of Section 7, Township 21N, Range 14E. A
location map is shown on the plat for your convenience. The subject property is zoned RS -3
(Residential Single - Family, High Density) and CG (Commercial General). The plat mistakenly
represents the commercial lot as IL (Industrial Light).
ANALYSIS
The submitted preliminary plat is consistent with the requirements of the RS -3 zoning district.
However, Lot 28, Block 2, the commercial lot located at the south end of the subject property, is
showing a 25' front building setback along N. Mingo Road and E. 106th Street N. where a 50'
setback is required. The applicant has been made aware of this issue through TAC comments.
The applicant has provided an area of open space between the residential and commercial portion
of the site that will accommodate required detention. Maintenance of the common open space
and detention areas should be defined as the responsibility of the homeowners' association within
the covenants and restrictions.
A $16 per acre siren fee, totaling $246.72, will be assessed on the property prior to release of the
final plat for filing.
The Owasso Technical Advisory Committee reviewed the preliminary plat at the October 31,
2001 regular meeting. A memorandum detailing TAC comments is attached for your
information and review.
RECOMMENDATION
Staff recommends approval of the Preliminary Plat for Metro Heights II subject to the following
conditions:
I. That all TAC comments be addressed prior to approval of the final plat, and
2. That no building permits shall be issued within any portion of the proposed
development until all requirements of the Owasso Subdivision Regulations, Chapter 8
"Building Permits ", are fulfilled, and
3. Provision of erimeter and internal sidewalks and acceleration/deceleration lanes
along E. 106` Street N. and N. Mingo Road shall be included within the deed of
dedication of the plats, and
4. Maintenance of open space and detention facilities shall be provided within the text
of the deed of dedication, and
5. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Owasso Subdivision Regulations and the Owasso Zoning Code"
shall be added to the text of the plat, and
6. A covenant stipulating that "All improvements shall be 1) constructed and accepted

BACKGROUND
Blaksley/Morris Properties, owner, is requesting review of the Preliminary Plat for The Village
of Silver Creek, an 16.63 acre, 63 lot proposed subdivision located north of E. 86`h Street N. and
west of N. 145`h E. Avenue. The subject property is generally described as a tract of land in the
East Half of the Southeast Quarter (E /2 SE /4) of Section 21, Township 21N, Range 14E. A
location map is shown on the plat for your convenience. The subject property is zoned RS -2
(Residential Single - Family, Medium Density).
ANALYSIS
The submitted preliminary plat is consistent with most of the requirements of the Silver Creek
PUD (OPUD -14) zoning district. However, the covenants and restrictions state the minimum lot
width for Executive Homesites shall be a minimum of 65' wide and have a 25' rear yard setback.
The submitted plat is in conflict with these two items.
The applicant has provided an area of open space in the southeast portion of the site that will
accommodate required detention. Maintenance of the common open space and detention areas
should be defined as the responsibility of the homeowners' association within the covenants and
restrictions.
A $16 per acre siren fee, totaling $266.08, will be assessed on the property prior to release of the
final plat for filing. The property was mistakenly identified at the TAC meeting as being
included within the Elm Creek Interceptor Payback area.

Church of the Nazarene, an 18.06 acre, 1 lot proposed subdivision located north of E. 86`h Street
N. and west of N. 145th E. Avenue. The subject property is generally described-as a tract of land
in the East Half of the Southeast Quarter (E /2 SE /4) of Section 21, Township 21N, Range 14E.
A location map is shown on the plat for your convenience. The subject property is zoned OM
(Office Medium).
ANALYSIS
The submitted preliminary plat is consistent with the requirements of the OM zoning district.
However, no front yard setback is shown on the preliminary plat. A setback of 50' from N. 145`h
E. Avenue is required.
This site is not technically included in the Silver Creek PUD. It is, however, surrounded by and
closely associated with the PUD. The church property will utilize the unified detention of the
Silver Creek PUD or will provide on -site detention. The draft covenants and restriction speak
about a reserve area for detention, yet none is shown on the plat, so it is unclear to staff what the
intention of the developer is in this regard.
A $16 per acre siren fee, totaling $288.96, will be assessed on the property prior to release of the
final plat for filing. The property is also subject to a $1580 per acre Elm Creek Sanitary Sewer
Interceptor Payback assessment totaling $28,534.80.

RECOMMENDATION
Staff recommends approval of the Preliminary Plat for the Silver Creek Church of the Nazarene
subject to the following conditions:
1. That all TAC comments be addressed prior to approval of the final plat, and
2. That no building permits shall be issued within any portion of the proposed
development until all requirements of the Owasso Subdivision Regulations, Chapter 8
"Building Permits ", are fulfilled, and
3. Limits of No Access shall be defined on the plat, and
4. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Owasso Subdivision Regulations and the Owasso Zoning Code"

Nazarene" is the owner in fee simple of the following described real estate
situated in the city of Owasso, Tulsa County, State of Oklahoma, to -wit:
The NE14 of the SE14 of the NE14 of the SEA and the SE14 of the NE14 of the NE14
of the SE14 and the East 12.5 of the SW14 and the East 12.5 feet of the NW14 of the
SEA of the NE14 of the SE14 of Section 21, township 21 North, Range 14 East
of the 1.B &M, Tulsa County, Oklahoma, containing 5.2 acres of land, more
or less.
The owner has caused the same to be surveyed, staked, platted and
subdivided into lots, blocks, reserves and streets as shown by the
accompanying plat and survey thereof, and which plat is made a part hereof,
and the owner has given to said plat the name of "Silver Creek Church of

repairing, removing and replacing any and all public utilities, including, storm
and sanitary sewers, telephone lines, cable television lines, electric power
lines and transformers, gas lines and water lines, together with all fittings and

A. Limits of No Access

B. Stormwater Detention — Reserve Area

nearest gas main or gas structure to the point of usage located on the
building shall hereby be granted as an easement, forever, to the supplier

D. Ingress, Egress and Walkways
Construction of acceleration lanes, deceleration lanes and sidewalks shall
be completed by the owner, within the public dedication along North 145th
East Avenue, as required by and in accordance with the standards of the
City of Owasso, Oklahoma.
E. Water and Sanitary Sewer Lines
The owner shall be responsible for the protection of water and sanitary
sewer lines. Activity which interferes with said lines is prohibited. The
public works department or its successors shall be responsible for ordinary
maintenance of said lines.

BACKGROUND
Owasso Land Trust, applicant, has requested review of a final plat for Quik Trip Commercial
Center #62R, a 2.081 acre, 1 lot subdivision located south of E. 116`h Street N. (State Highway
20) immediately east of U.S. Highway 169. The subject property is generally described as a
portion of the North Half of the Northeast Quarter (N /2 NEA) of Section 9, Township 21 N,
Range 14 E. A location map is shown on the plat for your convenience. The subject property is
zoned CG/PUD (Commercial General/Planned Unit Development).
ANALYSIS
The subject property is located within the Woodridge Planned Unit Development (OPUD -21),
more recently referred to as Coffee Creek. The minimum setback from public /private streets
defined within the text of the PUD is 50'. While the setback along E. 116`h Street N. (State
Highway 20) is shown correctly, the setback shown along N 140`h E. Avenue is shown as 25'.
Access to the site will be from N. 140 E. Avenue, the right -of -way for which is shown on and
dedicated by this plat.
Stormwater detention is required for this site whether accommodated within unified PUD
detention areas or on -site.
An emergency siren fee of $16.00 /acre, totaling $28.64, shall be accessed on the subject
property. The property is also potentially subject to either an existing sanitary sewer payback or
one that is currently being formulated. This assessment should be clarified prior to release of the
final plat for filing
No provision has been made within the text of the deed of dedication for the installation and
dedication of sidewalks and acceleration/deceleration lanes as required by the. Owasso
Subdivisions Regulations.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Larry Young, Owner
REQUESTED ACTION AND PURPOSE: The applicant has requested the partial closing of
an existing 25' utility easement situated along the south property line of the subject property to
accommodate a 37 encroachment into the easement.
LOCATION AND SIZE: The subject property is approximately 18,398.4 square feet in size
and is located at 10605 E. 114th Street N. A location map is attached for your information and
review.
EXISTING LAND USE: The current zoning on the subject property is RS -3 (Residential
Single - Family, High Density) with an existing dwelling.
SURROUNDING LAND USE: The lot is located within Hale Acres Second Addition and
surrounded by similar lots on all sides.
SITE INFORMATION: The subject property is located west of N. Garnett Road and north of
E. 114`h. Street N.
ANALYSIS
The applicant has requested a partial closing of the platted 25' Utility Easement to accommodate
an error in the location of the structure on the property by the builder, Maximum Control.
Conversations with the builder revealed a conscious decision to align the residence with the
existing homes along the street built approximately 30 years ago. Those structures, if the
alignment is precise, would also be encroaching into the platted 25' front yard setback.
However, staff has not been made aware of any other property title issues within the subdivision.
A copy of the approved building permit is attached for your information and review.
A variance request to the Owasso Board of Adjustment to reduce the require front yard building
setback was approved at the October 23, 2001 regular meeting.
The easement closing was reviewed by the Technical Advisory Committee at the October 31,
2001 regular meeting and no comments and/or objections were recorded. Those letters of
approval received by staff are attached for your information and review.
RECOMMENDATION
Staff recommends approval of the partial closing of the existing 25' Utility Easement located on
Lot 12, Block 4, )=Tale Acres Second Addition, as described in the attached legal description.
