The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
November 7, 2001 at 5:00 PM.
1. CALL TO ORDER - Ray Haynes called the meeting to order at 7:00 PM and declared a
quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF OCTOBER 9, 2001 REGULAR
MEETING - The Commission reviewed the minutes of October 9, 2001 Regular
Meeting, Charles Willey moved to approve the minutes. The motion was seconded by
Bill Williams. A vote on the motion was recorded as follows:

4. Detachment - Larkin Bailey Foundation - A request for detachment of 268.79 acres,
more or less, generally described as a portion of the East Half (E2) of the Northeast
Quarter (NE /4) and the Southeast Quarter (SE /4) of Section 25, Township 21N, Range
13E, along with a portion of the Southwest Quarter (SW /4) of the Northwest Quarter
(NW /4) and a portion of the West Half (W /2) of the Southwest Quarter (SW /4) of Section
30, Township 21N, Range 14E. The subject property is located at the north of E. 76
Street N. and west of the A.T.& S.F. Railroad right -of -way. (Ward 4)
This itdm was tabled until recommendation by the Annexation Committee.
5. OPUD -01 -04 & OZ -01 -09 - Pittman Poe & Associates - A request for review of a
planned unit development for Robinson Business Park. The 89.3 acre subject property is
located at the approximately i/4 mile south of E. 116' Street N. (State Highway 20) and
west of N. 145" E Avenue and is described as a portion of the East Half (E /2) of Section
9, Township 21 North, Range 14 East, Tulsa County, State of Oklahoma. (Ward 1)

Donna presented the item and described the location. Donna explained that his PUD
application is accompanied by a zoning application OZ- 01 -09. The plan calls for 8.14
acres of OM (Office Medium), 35.92 acres of CS (Commercial Shopping), 10.01 acres of
CG (Commercial General), and 35.26 acres of IL (Industrial Light). The applicant also is
proposing the option of 14.64 acres of CS (Commercial Shopping) being converted to
RM -2 (Residential Multi- Family, High Density). The approval for this will require
approval of a special exception by the Owasso Board of Adjustment or rezoning of the
subject portion. Do to the extension of the water and sewer this property will be subject
to an interceptor payback fee assessment at the time of platting.
Staff recommends approval of OPUD -01 -04 and OZ -01 -09 subject to the following
conditions:
1. The primary east -west road and service road as shown on the Outline
Development Plan shall be developed as collector roads.
2. Sidewalks along the perimeter of the development, except at those locations where
the future business will actually front the arterial or service road shall be installed
at the time of development. All other sidewalks shall be installed at the time of
site construction.
3. Acceleration/deceleration lanes shall be required at all access points along arterial
and service road.
4. A detailed drainage report shall be submitted to and approved by the Public Works
department prior to the processing of any plat associated with the PUD.
5. Detailed covenants and restrictions incorporating all conditions of the PUD and
governing the unified design and function of the PUD shall be required at the time
of platting.
6. The applicant's Outline Development Plan and Text shall be filed of record in the
office of the Tulsa County Clerk and two recorded copies provided to the City
Planner prior to the processing of any plat associated with the PUD.
7. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the OM (Office Medium) district.
8. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the CS (Commercial Shopping)
district.
9. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the CG (Commercial General) district.
10. Unless specifically set out in the standards and conditions of this PUD, office
development shall meet all requirements of the IL (Industrial Light) district.
11. Prior to development of the optional RM -2 (Residential Multi - Family, High
Density), a special exception shall be granted by the Owasso Board of Adjustment
or a rezoning application approved. No amendment to the PUD shall be required
as long as the development is in accordance with the approved Outline
Development Plan.

12. Within the PUD, the maximum number of multi -family dwelling units, if
applicable, shall not exceed 243.
13. All conditions imposed by the Owasso Technical Advisory Committee for
subdivision plat approval shall be met as conditions of the PUD.
14. A detailed, certified drainage report be submitted to and approved by the Public
Works department prior to Planning Commission review of the first plat
associated with the PUD.
15. All covenants of any subdivision plat containing property within the PUD shall
incorporate all PUD standards and conditions of approval and make the City of
Owasso beneficiary.
16. No building permit shall be issued within any portion of the PUD until all criteria
outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the
developer.
17. Detailed landscape plans for individual sites shall be submitted at the time of site
plan review.
18. Area markers, including associated landscaping and lighting, shall be submitted to
and approved by the Owasso Planning Commission as required by the Sign
Ordinance.
19. The Planning Commission reserves the right to prescribe additional buffering,
screening and setbacks during the platting process.
Mr. Haynes asked if there were any comments from the Commissioners or the attendees.
Mr. Brooks Pittman from Pittman -Poe & Associates, Inc. requested a brief presentation.
He displayed a surrounding zoning map along with a layout map, showing the acreage
and zonings that are proposed for this PUD. Mr. David Chamey was present and stated
he felt this development coordinates well with the surrounding proposed developments to
the north (Interchange Business Park) and to the south (Tulsa Technology Center). Mr.
Charney also stated that he would like to see Item #f3 of the staff recommendations read
"deserve the right to require acceleration/deceleration lanes ". A discussion was held
regarding the drainage problem on the southeast corner of this tract. A few property
owners from that area were present to express their concerns.
Ray Haynes moved to approve OPUD -01 -14 and OZ -01 -09 subject to the above staff
recommendations, along with the addition of the following two items:
20. Limit the point of access off of the service road.
21. Pay close attention to the drainage on the southeast corner of this property.

6. OLS -01 -06 and Lot Tie - Charngy & Charney - Request for review of a lot split and
concurrent review of a Lot Tieing Agreement for Lot 62, Block 1, Fairways V, located at
9009 N. 100' E Avenue. (Ward 2)
Donna presented the item and described the location of the property. She stated that the
builder mislocated the property corners prior to construction and the property does not
encroach into any easements. If approved, the lot tieing agreement will be forwarded to
the City Council. After approval from the City Council, the lot split and lot tieing
agreement should be filed with Tulsa County Clerk. At that time the applicant should
provide two recorded copies of each to the City Planner. Staff recommends approval of
OLS -01 -06 and the associated Lot Tieing Agreement. Mr. Pete Kourtis, the developer,
was present to address concerns. Mr. Kourtis explained that the property pin was pulled
off by mistake. He also stated that the builder is very conscientious and would never
create this problem intentionally. A discussion was held regarding the requirement of a
footing survey on all lots prior to approval of a footing inspection. Bill Ellison expressed
his concerns regarding this dilemma. He stated that he expects something to be done,
such as an ordinance, to prevent such encroachments from happen again. Mr. Ellison
confirmed to the Commissioners that he would vote no if American Heartland came
before the Planning Commission with another encroachment.
Bill Williams moved to approve the above lot split and lot tie request, Ray Haynes

7. Preliminary Plat - Metro Heights II - Request for review of a preliminary plat for
Metro Heights 11, a 15.42 acre, 38 Residential and 1 Commercial lot subdivision located
at the northeast corner of E. 106th Street N. and N. Mingo Road and generally described
as a portion of the West Half (W /2) of the Southwest Quarter (SW /4) of Section 7,
Township 21 North, Range 14 East. (Ward 1)
Donna presented the item to the Commissioners. She explained that the plat is consistent

with the requirements of RS -3 zoning. Although, Lot 28, Block 2, the commercial lot at
the south end of the subject property, is showing a 25' front building setback along N.
Mingo and E 106' St North where a 50' setback is required. Donna also stated that a
neighborhood meeting regarding drainage is required prior to the review by City Council.
The Owasso Technical Advisory Committee reviewed this request at their October 31,
2001 regular meeting. Mr. Brian Kellogg, the engineer for this project, was available to
address questions. Charles Willey addressed the issue of the need for a barrier between
the railroad tracks and the subdivision. He feels it is the City's responsibility to make
sure there is protection for the children of this proposed subdivision. Mr. Kellogg
assured Mr. Willey that this condition would be added to the covenants.
Staff recommends approval of the Preliminary Plat for Metro Heights 11 subject to the
following conditions:
1. That all TAC comments be addressed prior to approval of the final plat, and
2. That no building permits shall be issued within any portion of the proposed
development until all requirements of the Owasso Subdivision Regulations,
Chapter 8 `Building Permits ", are fulfilled, and
3. Provision of perimeter and internal sidewalks and acceleration/deceleration lanes
along E. 106' Street N. and N. Mingo Road shall be included within the deed of
dedication of the plats, and
4. Maintenance of open space and detention facilities shall be provided within the
text of the deed of dedication, and
5. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Owasso Subdivision Regulations and the Owasso Zoning
Code" shall be added to the text of the plat, and
6. A covenant stipulating that "All improvements shall be 1) constructed and
accepted by the Owasso City Council, or 2) insured by performance bond naming
the City of Owasso co- obligee" shall be added to the text of the plat.
Ray Haynes moved to approve the preliminary plat request with the addition of the
following conditions:
7. A screened, uniformed privacy fence along the railroad track is required and is to
be constructed concurrently.
8. A neighborhood meeting regarding the drainage is required.

Preliminary Plat - The Village of Silver Creek - Request for review of a Preliminary
Plat for the Village of Silver Creek, a 16.63 acre, 63 lot subdivision located north of E.
86'' Street N. and west of N. 145' E Avenue and generally described as a portion of the
East Half (E /2) of the Southeast Quarter (SE /4) of Section 21, Township 21 North, Range
14 East. The subject property is located within the Silver Creek PUD (OPUD -14).
(Ward 3)
Donna described the location of the property and explained that the preliminary plat is
consistent with most of the requirements of the PUD. Although, the submitted plat is in
conflict with the executive homesites requirement of 65' width and a 25' rear yard setback
requirement. The Owasso Technical Advisory Committee reviewed the preliminary plat
at their October 31, 2001 regular meeting.
Staff recommends approval of the Preliminary plat for The Village of Silver Creek subject
to the following conditions:
1. That all TAC comments be addressed prior to approval of the final plat, and
2. All lots shall meet the minimum standards as set forth under the Executive
Homesite section of the Silver Creek PUD, and
3. That no building permits shall be issued within any portion of the proposed
development0 until all requirements of the Owasso Subdivision Regulations,
Chapter 8 "Building Permits ", are fulfilled, and
4. Provision of perimeter and internal sidewalks and acceleration/deceleration lanes
along E. 86' Street N. and 145' E Avenue shall be included within the deed of
dedication of the plats, and
5. Maintenance of open space and detention facilities shall be provided within the
text of the deed of dedication, and
6. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Silver Creek Planned Unit Development (OPUD -14), the
Owasso Subdivision Regulations and the Owasso Zoning Code" shall be added to

,accepted by the Owasso City Council, or 2) insured by performance bond naming

9. Preliminary Plat - Silver Creek Church of the Nazarene - A request for review of a
preliminary plat for Silver Creek Church of the Nazarene, a 18.06 acre, 1 lot subdivision
located north of E. 86'h Street N. and west of N. 145` E Avenue and generally described
as a portion of the East Half (E /2) of the Southeast Quarter (SE /4) of Section 21,
Township 21 North, Range 14 East. (Ward 3)
Donna presented the item and described the location of the property. The preliminary
plat is consistent with OM District requirements. Although, no front yard setback is
shown on the plat. A 50' setback is required. The covenants speak about a reserve area
for detention, yet none is shown on the plat. The Technical Advisory Committee
reviewed the plat their October 31, 2001 regular meeting. Mr. Ron Tracy, the consultant
for this project, was present to answer questions.
Staff recommends approval of the Preliminary plat for the Silver Creek Church of the
Nazarene subject to the following conditions:
1. That all TAC comments be addressed prior to approval of the final plat, and
2. That no building permits shall be issued within any portion of the proposed
development until all requirements of the Owasso Subdivision Regulations,
Chapter 8 "Building Permits ", are fulfilled, and
3. Limits of No Access shall be defined on the plat, and
4. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Owasso Subdivision Regulations and the Owasso Zoning
Code" shall be added to the text of the plat, and
5. A covenant stipulating that "All improvements shall be 1) constructed and
accepted by the Owasso City Council, or 2) insured by performance bond naming
the City of Owasso co- obligee" shall be added to the text of the plat.
Bill Williams moved to approve the preliminary plat request subject to the above staff
recommendations. Also, subject to detention facilities being located onsite if the unified

10. Final Plat - OuikTrip Commercial Center #62R - Request for review of a final plat for
QuikTrip Commercial Center #62R, a 1.739 acre, 1 lot subdivision located at the
southeast corner of U.S. Highway 169 and E. 116' Street N. (State Highway 20) and
generally described as a portion of the North Half (N /2) and Northeast Quarter (NE /4) of
Section 9, Township 21N, Range 14 East. The subject property is located within the
Interchange Business Park PUD (OPUD -21). (Ward 1)
The item was presented and the location was described. Donna explained that access to
the site will be from N. 1401' E Ave. Stormwater detention is required whether
accommodated within unified PUD detention or on -site. The Technical Advisory
Committee reviewed the final plat at the October 31, 2001 meeting. Mr. Steve Powell
with Deshazo, Tang and Associates was present to answer questions. Questions
regarding the access were addressed. Mr. Powell stated that all access would be off of
the service road, not U.S. Highway 20.
Staff recommends approval of the preliminary plat for Quik Trip Commercial Center
#62R subject to the following conditions:
1. All TAC comments shall be addressed prior to release of the final plat for filing,
and
2. The plat shall meet all requirements established be the Interchange Business Park,
and
3. A covenant stipulating that "the proposed subdivision shall meet or exceed all
requirements of the Owasso Subdivision Regulations and the Owasso Zoning
Code" shall be added to the text of the plat prior to forwarding the plat to
Council, and
4. A covenant stipulating that "All improvements shall be 1) constructed and
accepted by the Owasso City Council, or 2) insured by performance bond naming
the City of Owasso co- obligee" shall be added to the text of the plat prior to
forwarding the plat to Council.

11. Easement Closing - Larry Young - A request for review of a partial easement closing
for Lot 12, Block 4, Hale Acres Second Addition located at 10605 E. 114'' Street N.
(Ward 1)
Donna presented the item. This request is due to an error with the location of the house.
The builder applied for a variance request to the Owasso Board of Adjustment to reduce
the required front yard building setback and was approved at the October 23, 2001
regular meeting. Apparently the builder decided to align the residence with the existing
30 -year -old homes that run along that street. There were no objections at The Technical
Advisory Committee at the October 31, 2001 meeting. Staff recommends approval of the
partial closing of the existing 25' utility easement located on Lot 12, Block 4, Hale Acres
Second Addition, as described in the attached legal description. The Commissioners
discussed a letter of warning being sent to Mr. Max Hutchinson, the builder, to advise
him that this will not be tolerated a second time.
Bill Williams moved to approve the easement closing request, subject to a letter from
staff to the builder, stating that he has been warned and another request, such as this, will
not be tolerated from the Planning Commission, Ray Haynes seconded the motion. A vote

BACKGROUND
Mr. Roy Cartright, Trustee, Larkin Bailey Foundation has submitted a petition to the City of
Owasso for detachment of 312 acre, more or less, parcel of land located north of E. 76`h Street N.
and west of the SK &O Railroad. The subject property is zoned AG (Agriculture) and is vacant
and undeveloped.
The subject property is bound on the east by railroad right -of -way, and further by the Railroad
Depot, Original Town of Owasso, and further north, Southern Links; it is bound on the north by
E. 86`h Street N. and unincorporated rural residential/agricultural uses which also occur along the
west of the property; and is bound on the south by E. 76`h Street N. and further by unincorporated
rural residential/agriculture /flood plain.
ANALYSIS
The Owasso Annexation Committee first reviewed the request at the August 30, 2001 special
meeting and, at that time, postponed recommendation until additional information could be
provided to the committee by the applicant. The annexation committee requested the following
three items:
1. Written explanation of the reason for the detachment being requested.
2. Detailed legal description, including overall acreage.
3. Detailed descriptive boundary map.
The Owasso Annexation Committee reviewed the petition a second time on November 8, 2001
and, again, withheld recommendation until all requested information was received.
Staff has received the requested items and they are included within your agenda packet for your
review.
The Annexation Committee reviewed the request once again on December 6, 2001 and
recommended approval.
Staff recommends approval of this requested detachment.

The Annexation Committee has reviewed,the attached detachment request two times in the past,
August 30, 2001 and November 8, 2001. Each review terminated with no recommendation and
additional information requested by the Committee including further documentation of the area
requested for detachment, verification of information submitted, and/or additional information.
Originally, the applicant was asked to provide the following items:
• A written explanation of the reason for the detachment requested; and
• A detailed legal description, including overall acreage; and
• A detailed descriptive boundary map.

Gentlemen:
The land owned by the Larkin. Bailey Trust north of 76th Street which is under request for
deannexation is being requested for the following reasons:
I. The land is more than 95% in the ranch creek floodplain and cannot be productive for any
type of use other than an agricultural or mineral use.
2. It is the intention of the trust to place this land into a cattle grazing crop type of operation and
the possibility of drilling some gas wells.
The trust has agreed to donate a portion of this land to be deannexed to the Sertoma Club.
This land falls in the southeast corner of the property. A small portion of this donated land
is out of the floodplain and another portion of the land to be donated to the Sertoma Club is
in the floodplain. This is the intent of the Larkin Bailey Trust.
Also requested by the city is a cad drawing of the legal description. This drawing is to follow as
soon as possible.

BACKGROUND
Soc's Realty, owner, is requesting review of the Final Plat for Metro Heights H, a 15.42 acre, 38
residential, 1 commercial lot proposed subdivision located north of E. 106th Street N. and east of
N. Mingo Road. The subject property is generally described as a tract of land in the West Half
of the Southwest Quarter (W /2 SWA) of Section 7, Township 21N, Range 14E. A location map
is shown on the plat for your convenience. The subject property is zoned RS -3 (Residential
Single - Family, High Density) and CG (Commercial General).
ANALYSIS
The submitted final plat is consistent with the requirements of the RS -3 and CG zoning districts.
The applicant has provided an area of open space between the residential and commercial portion
of the site that will accommodate required detention. Maintenance of the common open space
and detention areas has been defined within the covenants as the responsibility of the
homeowners' association. As a result of citizen concerns first expressed to the Commission and
then to the City Council, a neighborhood meeting was held so the applicant and their consultant
could inform those citizens who left their names and addresses with staff about the drainage
engineering proposed for the subdivision.
A $16 per acre siren fee, totaling $246.72, will be assessed on the property prior to release of the
final plat for filing.
The Owasso Technical Advisory Committee reviewed the preliminary plat at the November 28,
2001 regular meeting. A memorandum detailing TAC comments is attached for your
information and review.
RECOMMENDATION
Staff recommends approval of the Final Plat for Metro Heights H.

CROSSROADS BUSINESS PARK

BACKGROUND
Owasso Land Trust, L.L.C., applicant, is requesting review of a preliminary plat for the
Crossroads Business Park, a 39.92 acre, 12 lot subdivision located south of E. 116`h Street N.
(State Highway 20) between U.S. Highway 169 and N. 145`' E. Avenue and generally described
as a portion of the Northeast Quarter (NE /4) of Section 9, Township 21N, Range 14E. The
subject property is located within the Interchange Business Park Planned Unit Development
(OPUD -21). A location map is shown on the plat for your convenience. The subject property is
zoned contains various zoning districts with PUD (Planned Unit Development) supplemental
zoning. The following is a detailed summary of the zoning categories as related to the proposed
lots:
• CS (Commercial Shopping)

The submitted preliminary plat is consistent with the approved Outline Development Plan and
Text for Interchange Business Park PUD.
The westemmost lots are organized along the proposed service road along U.S. Highway 169.
The Owasso Zoning Code requires the provision of a 50' building setback line along all arterial
and service roads for all zoning categories more intense than residential. The applicant has
shown the setbacks along the service road and N. 145`h E. Avenue to be 25' in width. It is staff's
opinion that all lots currently proposed along the service road, with the exception of Lot 1, Block
2, are adequately served by a 25' setback as the service road is not directly adjacent to the
highway right -of -way. However, staff recommends Lot 1, Block 2 and any future proposed lots
fronting the service road as well as Lot 3, Block 3, adjacent to N. 145`h E. Avenue, conform to
the requirement of a 50' building setback. Staff also recommends limited curb cuts along the
service road.
The applicant has coordinated directly with the Oklahoma Department of Transportation
(ODOT) to locate access points along E. H& Street N. (State Highway 20). There will be two
full- motion intersections with Highway 20 at the proposed service road and the right -of -way
separating Blocks 2 and 3. The remaining intersections will be limited to right turns 'only.
According to the applicant, the right -of -way shown between is Lots 4 and 5, Block 2 will be
omitted.
Acceleration/deceleration lanes will be required at all access points from arterial streets and the
service road. As the schedule of improvements to State Highway 20 has yet to be determined,
staff would support an escrow arrangement for the installation of acceleration/deceleration lanes
along the highway after completion of those improvements.
Perimeter sidewalks shall be installed at the time of development along N. 145th E. Avenue. It is
staff s recommendation that the Planning Commission reserve the City's right to require
sidewalk along State Highway 20, pending coordination with ODOT at the time of future
proposed improvements to the highway. Sidewalks shall be provided along all internally
oriented rights -of -way at the time of individual lot development and will be required along the
service road at the time of development of future phases of the PUD.
It is assumed unified detention is planned for the PUD. All lots included within this plat must be
adequately served at the time of this development. The area within and extending south of the
boundary of Lot 1, Block 3 and, potentially, the southwest corner of Lot 1, Block 2 appear to be
the most appropriate locations for detention facilities. The applicant should coordinate directly
with Public Works regarding detention.
A sanitary sewer interceptor payback of approximately $1000 per acre is pending final
agreement. The subject property is included within the bounds of the payback area. An
emergency siren fee of $16 per acre shall be assessed on the property. All required assessment
fees shall be paid prior to release of the plat for recording.
The Technical Advisory Committee reviewed the preliminary plat at the November 28, 2001
regular meeting. At the time of the meeting, the electric service provider had yet to be
determined. Curtis Bryant with PSO encouraged the applicant to make that determination as
soon as possible to allow for system design. A memo detailing the comments received is
attached for your information and review.
RECOMMENDATION
Staff recommends approval of the Preliminary Plat for Crossroads Business Park subject to the
following conditions:
1. All TAC comments shall be addressed prior to submittal of the final plat; and,
2. A 50' building setback shall be provided along the service road adjacent to Lot 1,
Block 2 and any future proposed lots fronting the service road and along N. 145th E.
Avenue adjacent to Lot 3, Block 3; and,
Curb cuts shall be limited to the minimum necessary along the proposed service road;
and,
4. Acceleration/deceleration lanes shall be provided at all access points from arterial
streets and the service road; and,
5. Perimeter sidewalks shall be installed at the time of development along N. 145`h E.
Avenue; and,
6. The Owasso Planning Commission reserves the right to require sidewalk along State
Highway 20, pending coordination with ODOT at the time of future proposed
improvements to the highway; and,
7. All required improvements postponed until completion of future improvements to
Highway 20 will be insured by escrow; and,
8. Adequate detention to service this phase of the Interchange Business Park PUD shall
be provided at the time of development; and,
9. A covenant stating "All improvement shall be 1) constructed and accepted by the
Owasso City Council, or 2) insured by performance bond naming the City of Owasso
co- obligee prior to approval of the plat by the Owasso City Council" shall be included
within the plat covenants or the text of the plat; and,
10. The Deed of Dedication, Restrictions and Covenants shall be included within the text
of the plat or, if filed by separate instrument(s) shall include within their text specific
reference to one another; and,
11. The approved Outline Development and Text for Interchange Business Park PUD
(OPUD -21) shall be filed of record with the Tulsa County Clerk and two recorded
copies provided to the City Planner prior to approval of the final plat; and
12. As required by the Owasso Zoning Code for planned unit developments, a provision
for the establishment of a property owners' association shall be added to the
covenants associated with this plat; and,
13. The developer shall provide for the maintenance of any detention facility by the
property owners' association within the covenants associated with this plat.

PRELIMINARY PLAT REQUIREMENTS:

larger. All printing shall be clear and legible. All sheets shall be of a consistent size of
twenty -four inches (24 ") by thirty-six inches (36 ") or larger. Each sheet shall be sealed
by a registered professional engineer or surveyor. The Preliminary Plat shall contain or
be accompanied by the following:

The Owasso Technical Advisory Committee reviewed your request for a final plat on the above -
referenced property at the November 28, 2001 regular meeting and the following comments were
recorded:
1. Community Development - Draft covenants are required for preliminary plat review.
2. Community Development - A $16 /acre siren fee, totaling $638.72, will be assessed
on the property prior to release of the final plat for recording.
3. Community Development - A $1000 /acre sewer interceptor payback fee, totaling
$39920.00, will potentially be assessed on the property and said be prior to release of
the final plat for recording.
4. Public Works - Acceleration/Deceleration lanes will be required at all access points

feel at this time we will probably serve since this will all be annexed into the City of
Owasso. We will work with the developer on a layout as soon as our management gives
us the go- ahead.
Metro Heights II looks good. Tulsa Teachers' Credit Union also looks good. Joe Green
will work with the contractor to provide service for construction and permanent service.

BACKGROUND
Owasso Land Trust, L.L.C., applicant, is requesting review of a preliminary plat for Lake Valley,
a 24.85 acre, 83 lot subdivision located north of E. 106`x' Street N. and east of N. 145' E.
Avenue and described as a portion of the Southeast Quarter (SE /4) of Section 10, Township 21N,
Range 14E. The subject property is located within the Lake Valley Planned Unit Development
(OPUD- 01 -03). A location map is shown on the plat for your convenience. The subject property
is zoned RS -3/PUD (Residential Single - Family, High Density/Planned Unit Development).
ANALYSIS
The submitted preliminary plat is consistent with the approved Outline Development Plan and
Text for Lake Valley PUD.
The applicant has provided a 100' wide reserve area general spanning the subject property from
east to west. Maintenance of the reserve area is provided for within the covenants. It is unclear
if this reserve area will accommodate detention facilities required for this phase of the
development. A deed of dedication shall be submitted for review.
Acceleration/deceleration lanes will be required at all access points from arterial streets.
Perimeter sidewalks shall be installed at the time of development along N. 145`h E. Avenue.
Sidewalks shall be provided along all internally oriented rights -of -way at the time of individual
lot development.
The Technical Advisory Committee reviewed the preliminary plat at the November 28, 2001
regular meeting. At the time of the meeting, the electric service provider had yet to be
determined. Curtis Bryant with PSO encouraged the applicant to make that determination as
soon as possible to allow for system design. A memo detailing the comments received is
attached for your information and review.
RECOMMENDATION
Staff recommends approval of the Preliminary Plat for Crossroads Business Park subject to the
following conditions:
1. All TAC comments shall be addressed prior to submittal of the final plat; and,
2. Acceleration/deceleration lanes shall be provided at all access points from arterial
streets; and,
3. Perimeter sidewalks shall be installed at the time of development along N. 145th E.
Avenue; and,
4. Adequate detention to service this phase of the Lake Valley PUD shall be provided at
the time of development; and,
5. A covenant stating "All improvement shall be 1) constructed and accepted by the
Owasso City Council, or 2) insured by performance bond naming the City of Owasso
co- obligee prior to approval of the plat by the Owasso City Council" shall be included
within the plat covenants or the text of the plat; and,
6. The Deed of Dedication, Restrictions and Covenants shall be included within the text
of the plat or, if filed by separate instrument(s) shall include within their text specific
reference to one another; and,
7. The approved Outline Development and Text for Lake Valley PUD (OPUD- 01 -03)
shall be filed of record with the Rogers County Clerk and two recorded copies
provided to the City Planner prior to approval of the final plat; and
8. The developer shall provide for the maintenance of any detention facility by the
property owners' association within the covenants associated with this plat.

BACKGROUND
Woods - Associates, agent for the owner, has requested review of the Site Plan for the Tulsa
Teachers' Credit Union located north of E. 96`h Street N. and west of N. 119`h E. Avenue directly
west of Lowe's and north of the Owasso Market detention facility. A location map is shown on
the site plan for your information and review. The subject property is zoned CS (Commercial
Shopping).
ANALYSIS
The applicant has proposed a 5,866 square foot facility. According to the Owasso Zoning Code,
the parking requirement for this facility is 1 space per 300 square feet building floor area. Based
on this requirement, the applicant is required to provide 20 spaces including 1 handicap van
accessible spaces. .The applicant has provided 50 spaces including 2 handicap spaces. One
loading berth is required by code for this facility. Although this use will not require any large-
vehicle -deliveries, loading may be accommodated at the north side of the building.
A landscape plan for the subject property has been reviewed and approved by staff. While this
property does not abut a residential zoning district, and therefore, the applicant is not technically
required to provide screen fencing, the property does directly abut small lot rural residential,
zoned AG (Agriculture) along the west side of the property. It is staffs recommendation that
screening from these homes be required.
A detention facility located along the south property frontage has been provided to accommodate
site drainage.
The Owasso Technical Advisory Committee reviewed the site plan at the November 28, 2001
regular meeting. A memorandum detailing the comments received is attached for you
information and review.
RECOMMENDATION
Staff recommends approval of the site plan for the Tulsa teachers' Credit Union subject to the
following conditions:
1. All TAC comments shall be addressed prior to the issuance of a building permit.
2. Provide a 6' opaque fence or wall along the west boundary of the property.

referenced property at the November 28, 2001 regular meeting and the following comments were
recorded:
1. Public Works - 12" City water line is shown incorrectly on site plan.
2. Public Works - Provide 6" water line to hydrant. 6" water line will be required to be
extended in the future if required to serve a rear lot.
3. Fire Department - Maintain 12' minimum drive isle at commercial drive -thru and 18'
minimum drive isle around perimeter.
4. ONG - Coordinate directly with ONG for service location(s).

Crossroads Business Park and Lake Valley are still up in the air as to who will serve. I
feel at this time we will probably serve since this will all be annexed into the City of
Owasso. We will work with the developer on a layout as soon as our management gives
us the go- ahead.
Metro Heights II looks good. Tulsa Teachers' Credit Union also looks good. Joe Green
will work with the contractor to provide service for construction and permanent service.

The City of Owasso recently experienced numerous requests to the City Council, Planning
Commission and /or Board of Adjustment to accommodate builders' errors in locating structures
resulting in encroachments over building setback lines, property lines and /or easements.
While it is understood that mistakes may happen, the encroachments recently reviewed have been
rather significant in nature. Both the Planning Commission and Board of Adjustment have
expressed concern about the feasibility of continuing to approve the requests for relief, and each
have stated a dedication to not approving those requests from builders who have made similar
requests previously.
Denial of such requests would most often affect the purchaser of the property rather than the
builder, it is foreseeable relief might be sought through civil action by the purchaser.
In an effort to avoid negative circumstances for all involved, the Community Development
department is strongly recommending builders provide the Building Inspector a footing
survey cont-rrming proper location of structures prior to continuing construction beyond the
footing.
