consideration and recommendation.
OPUD 16 — The Lakes at Bailey Ranch — A request for approval of a planned unit
development for Kourtis Properties, LLC. The applicant has submitted the Lakes at
Bailey Ranch, a mixed -use development plan for the north half (N /2) and portions of the
southwest quarter (SW /4) of Section 18, T -21 -N, R -14 -E, City of Owasso, Oklahoma.
The property is located between Mingo Road and Garnett Road and E 96" Street N and E
106'h Street N and contains 408.7 acres more or less. Due to an erroneous legal
description presented in the December 8, 1998 Agenda, City Council has referred the
item back to the Planning Commission for consideration and recommendation
6. Annexation Request — A & W Land Development — A request for the annexation of
property for A & W Land Development, Incorporated. The subject property is described
as a tract of land lying in Section 6, Township 21 North, Range 14 East, Tulsa County,
Oklahoma, containing 71.62 acres, more or less. The subject property is located to the
northwest of N 109' E Avenue, adjacent to the Country Estates II subdivision.
Revised Final Plat — Country Estates III — a request for review of a final plat for Country
Estates III a 17.37 acre, 61 -lot subdivision. The subject property is zoned RS -3
(Residential Single- Family High Density) and is generally located west of the Country
Estates I Addition.
8. Report on monthly building permit activity.
9. Report on planning items previously forwarded to City Council.

The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
November 30, 1998 at 3:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF NOVEMBER 10, 1998 REGULAR
MEETING. - The Commission reviewed the minutes of November 10, 1998 Regular
Meeting, Charles Willey moved, seconded by Bob Randolph to approve the minutes as
written. A vote on the motion was recorded as follows:

4. Anneal of Site Plan Review - Bob Ary - A request for a reduction in landscaping
requirements on a site plan for the Tire Barn, a proposed automotive center, located on
Lots 6 & 7, Block 19, original plat of Owasso. The proposed building is generally
located at 112 & 116 W Broadway Street, on the southeast comer of the intersection of
Broadway and Atlanta Streets. The site plan was reviewed and approved at the
November 10, 1998 regular meeting.
Theron Warlick presented the item to the Commissioners. The location of the property
was described. At the November 10, 1998 regular Owasso Planning Commission
meeting this site plan was reviewed and approved subject to the following conditions:
1) That the developer install a concrete detention device in the swale on the
south side of the subject property per OPWA specifications,
2) That a continuous sidewalk be installed on the Broadway side of the
property,
3) That signage will be reviewed by separate sign permit,

4) And that the developer eliminate the easternmost two (2) parking spaces
and establish a vegetative buffer area in their place.
Ray Haynes stated that the public library, which will be across the street, represents a
substantial investment in the downtown area and should be protected. Mr. Ary, the
applicant, addressed the Commissioners. He was concerned that the elimination of
parking spaces would effect his ability to conduct business and that he needs all the
parking he can get. He also stated that he will do the very best he can to have ample
landscaping around the area. Ray Haynes recommended the City of Owasso work on a
landscape ordinance.
After discussion, Larry Helton moved to grant the applicant's request to exclude item //4,
but Mr. Ary will landscape the project as extensive as possible. Charles Willey seconded
the motion. A vote on the motion was recorded as follows:

Annexation - Preston Lakes. LLC - A request for the annexation of property for Preston
Lakes, LLC. The subject property is located in the north half of the southwest quarter
(N /2 SW /4) of the Section 22, T -21 -N, R -14 -E, Rogers County, Oklahoma. The subject
property is further described as a 60 acre tract located east of N 145th E Avenue between
E 86th Street N and E 96th Street N.
Theron Warlick briefed the Commissioners on this item. The property lies in
unincorporated Rogers County and is currently zoned AR (Agricultural Residential).
Upon annexation it would be zoned to the City's comparable AG (Agricultural) zoning
district. Acceleration /deceleration lanes and sidewalks will be required along North
145th East Avenue. The Owasso Technical Advisory Committee reviewed the request
at their November 25, 1998 regular meeting. No comments were received. The Owasso
Annexation Committee reviewed and approved the request at the November 30, 1998
special meeting. There will be no building permits issued until the approval of the water
and sewer. A surrounding property owner to the north was present and had concerns
regarding what type of development was going into this area.

6. Rezoning Request - OZ -98 -14 - Larkin Bailey Foundation — A request for rezoning of

Theron Warlick presented the item. Mr. Warlick explained that this item and OPUD -16
will be presented together since the rezoning request and the request for approval of the
PUD are related to one another. Although, the Commissioners will be voting on the
items #6 and #7 separately. The proposed zoning district sizes were described to the
Commissioners. Also noted was the proposed rezoning is identical to the Tulsa County
zoning that was in effect since 1991 prior to annexation of the property. The Technical
Advisory Committee reviewed the proposed zoning change at the November 25, 1998
meeting. Notices were mailed to the surrounding property owners and legal
advertisement was published in the Owasso Reporter on November 19, 1998.
The following are comments /concerns made by surrounding property owners:
Sam Henderson - Concerns with traffic on Mingo Road and the conditions of the
streets surrounding this area, especially 106th Street North.
Kelly McLaughlin - Commercial zoning at the intersections and the traffic it
would create. Concerns with the train track which runs through the northwest
corner of this property.
Connie Kannady - Moved to Owasso for the country atmosphere. Had concerns
regarding the traffic and against the area designated for commercial.
Pat Kirkland - Questions on flooding at Mingo & 96th since the golf course was
constructed.
Kim Griffin - Concerns on the maintenance of the lakes and park areas in this
proposed project.
Jay Hendrix - Sewer problems in the area.

Mr. Tim Terral of Pittman-Poe made a short presentation. Mr. Terral explained that the
preliminary plat and the final plat will come before the Owasso Planning Commission
for review and approval. There was also a discussion on flag lots.
Mr. Roy Cartwright, a member of the Larkin Bailey Foundation, addressed the
Commissions and surrounding properties owners. He stated this land will be developed
to please the public.

7. OPUD 16 - The Lakes at Bailey Ranch - A request for approval of a planned unit

E 96th Street N and contains 408.7 acres more or less.
Theron Warlick presented this item in conjunction with item #6. Staff recommends
approval of OPUD -12 with the following conditions:
1) That the applicant's Development Text and Conceptual Development Plan be
considered to be the Outline Development Plan as required by the PUD Chapter
of the Owasso Zoning Code,
2) That unless specifically set out in the standards and conditions of this PUD, all
development in the proposed subject site shall be in accordance with the
overlaying zoning districts as described in OZ -98 -14 and shall meet all the
necessary requirements of the respective overlay districts,
3) That a subdivision plat be approved by the Owasso City Council and filed with
the County Clerk's Office prior to the issuance of a building permit. Said
covenants shall incorporate all PUD standards and conditions of approval and
make the City of Owasso beneficiary,
4) That a reference on page 23 of the PUD text pertaining to a lien being placed on
a Property Owner's Association member's "personal property be changed to
"real property",

5) That minor transfers (15% increase in a development area's density) of dwelling
units from one residential development area to another can occur if a significant
change in the character of either development is not created,
6) That no building permits be issued within any portion of the PUD until all items
in Chapter 8 "Building Permits" of the Owasso Subdivision Regulations are
fulfilled,
7) All conditions imposed by the Owasso Technical Advisory Committee for
subdivision plat approval be met as conditions of the PUD,
8) That a detailed drainage report be submitted at the time of platting and
certification of such document by an engineer,
9) That within the PUD, the maximum number of dwelling units shall not exceed
1,898 units,
10) That acceleration /deceleration lanes will be required at intersections with PUD
collector streets on E 96th Street N, E f06th Street N, Garnett Road, and Mingo
Road,
11) That the developer shall incorporate access management techniques in the
development of commercial areas. Such techniques may include but not be
limited to: unified circulation and parking plans, joint access and parking lot cross
access, restriction of the number of driveways per parcel, controlling driveway
spacing, sight distance and comer clearance.
12) That a barrier fence be erected between the SKO Railroad tracks and proposed
commercial area near the corner of E 106th Street N and Mingo Road and the
abutting multi- family area,
13) Detailed landscaping plans (type, species, size, location, and irrigation) shall be
required to be submitted with site plans of any commercial development. Said
plans will be reviewed by staff and must be approved by the Planning
Commission.
14) That sidewalks be provided on all road frontage within the subject property,
including E 96th Street N, E 106th Street N, Garnett Road and Mingo Road,
15) That the minimum side yard of any comer lot be no less than 25 feet,
16) That all landscaping plans for the entrances shall be reviewed and approved by
the Owasso Planning Commission and installed prior to the occupancy of any
buildings,
17) That no flag lots are permitted within any portion of the PUD,
18) If needed, commercial areas may be required to provide on -site detention. This
is to be determined at site plan review for commercial property.
After lengthy discussion, Charles Willey moved to approve the request subject to the all
of the above staff recommendations. Bob Randolph seconded the motion. A vote on the

8. Preliminary Plat (Revised) - Country Estates III - A request for review of a revised
preliminary plat for Country Estates IH a 17.37 acre, 61 -lot subdivision. The subject
property is zoned RS -3 (Residential Single - family High Density) and is generally located
west of the Country Estates HI and Westport Additions.
Theron Warlick presented this item. A preliminary plat was approved at the July 14,
1998 regular meeting of the Owasso Planning Commission. One change was made on
this revised plat. A change in the street layout (East 118th Court North) to allow for a
new access to the planned Country Estates IV addition. The Technical Advisory
Committee reviewed the preliminary plat at their November 25, 1998 meeting. The
following are the comments made at that meeting:
ONG - Label 17.5' easement on Lot 27, Block 5.
PSO - U/E declared on south side of Block 5, Lots 1 -3.
Ray Haynes moved to approve the preliminary plat, subject to the provision of the TAC

9. Preliminary Plat - Country Estates IV - A request for review of a preliminary plat for
Country Estates IV, a 46.29 acre, 164 lot subdivision. The subject property is described
as part of the S/2 of Section 6, T21N, R14E, and is located west of Country Estates II
and north of Country Estates III and Westport Additions.
This item was withdrawn by the applicant.
10. Site Plan - Children's Deoot - A request for review of a site plan for the Children's
Depot, a day care center proposed for part of Lots 2 & 3, Block 1, Castle Point
Addition, City of Owasso. The subject property is generally located north of Owasso
Wal -Mart Addition, between E 86th Street N and E 96th Street N on the east side of the
Owasso Expressway.

Theron Warlick briefed this item with the Commissioners. The subject property is
currently zoned CG (Commercial General) and OM (Office Medium Intensity). A
daycare is defined as a Use Unit 5 within the zoning code. All uses that are described
as in Use Unit 5 are permitted by right in the CG district. Twenty -three parking spaces,
two of which are designated handicapped are shown on the site plan. The Technical
Advisory Committee reviewed the site plan at their November 25, 1998 meeting. No
comments or concerns were expressed. Stormwater would be directed to a ditch in the
front of the property and a detention pond for Castle Point Addition in the rear. Also
a separate permit will be needed for signage.

The Owasso Planning Commission acted on this agenda item in its present form on December 8,
1998. An erroneous legal description of the subject property appeared in the December 8, 1998
Planning Commission Agenda. Because of this technical error, the item has been referred back to
the Planning Commission for consideration and action. A rehearing of this item is not required.

ANNEXATION REQUEST
A & W LAND DEVELOPMENT, INC.
January 4, 1999
A & W Land Development, Inc., has submitted a petition to the City of Owasso requesting
annexation of property totaling approximately 71.62 acres. The subject property is described as a
tract of land in Section 6, Township 21 North, Range 14 East, Tulsa County, Oklahoma. The
subject property is located to the northwest of 109'h E Avenue, adjacent to the Country Estates
II subdivision.
Country Estates III lies to the south of the subject property and the revised final plat for this
subdivision is the next item on the current agenda. To the southeast of the subject property lies
Country Estates IL Country Estates II and III are zoned RS -3. Country Estates II is being
developed as single- family housing and Country Estates III is proposed to provide additional
single- family homesites for this rapidly growing area.
The subject property is zoned AG (Agriculture) in Tulsa County and would also be zoned AG
(Agriculture) upon annexation into the City of Owasso. The developer plans to construct Country
Estates IV on the subject property, which will provide additional property for homesites. If
annexation is approved by City Council, rezoning and platting of the property would be necessary
prior to development.
The Owasso Annexation Committee will review the subject property at their January 11, 1999
meeting. The recommendation will be presented at the January 12, Planning Commission meeting..
A copy of the City of Owasso's annexation policy is attached for your information and review.
The subject property was reviewed at the November 25, 1998 meeting of the Owasso Technical
Advisory Committee. The City of Owasso can provide water and sewer to the site. It was noted,
however, that the northern portion of the subject property lies in the water service area of
Washington County Rural Water District #3. Much of the development in the western portion of
Owasso, including the Fairways and Country Estates, has taken place in the Washington County
Water District service area, but the development has taken place in a special district established by
a district court settlement. In 1981, a court settlement defined boundaries where the City of

Owasso was permitted to provide water service to these areas. In return, the developer was required
to pay a fee of $50 per tap to the Water District. A portion of the subject property, however, lies to
the north of the boundaries defined in the court settlement. Staff has contacted Washington County
Rural Water District #3 regarding service to the northern portion of the subject property. Jerry
Gammill, Water Superintendent, discussed service with the Water District Board of Directors and
they have voted in favor of providing water service to the northern portion of the site.
While it appears that, through one means or another, water service will be available to the subject
site, staff anticipates that the developer may propose alternatives in order to avoid the additional
costs associated with designing two water systems. Having two water service providers within the
same subdivision may present some challenges for the City, particularly in the areas of billing and
maintenance, but the problems do not appear to be insurmountable.
This is an interior tract with no portion abutting an arterial road. There are three possible points of
access: N 103' E Avenue in the West Port Addition, E 118'e Court N in Country Estates III, and N
111 ' E Avenue. These access points will provide adequate means of ingressiegress for the subject
site.
Notification of the annexation request was published in the Owasso Reporter on December 17 and
December 24, 1998 to notify the public of the annexation request before the Planning Commission
on January 12, 1999. That was followed by notification published two consecutive weeks in the
Owasso Reporter on December 31, 1998 and January 7; 1999 to notify the public of possible City
Council action regarding the request on January 19, 1999. In addition to the annexation policy, a
copy of the procedures for annexation is also attached for your information and review.
Staff recommends approval of the proposed annexation request.

January, 1`481 by and between Aural Water District No. 3, '
- Washington County, hereinafter referred to as RWD 13, and
Owasso Public Works Authority hereinafter referred to as
OPWA.
Whereas the parties hereto have been involved in
Illitigation in the above entitled cause and wish to settle
';their differences and make agreements that will be binding
on each of the parties hereto. The parties hereto agree to

it is understood between the parties that the United States
District Attorney by and through its Assistant District

Attorney. Ken Snoke, has informed the parties and the Court
that Farmers Home Administration has agreed to the settle-
ment as hereinafter set out.
2. The parties have agreed that the shaded area in

Exhibit •Aa which is attached hereto and made a part hereof
defines the area within Rural Water District Mo. 3 that can be
11 served by OPWA. In addition, it is agreed that OPwA can serve
iithe subdivisions and additions to the town of Owasso, Oklahoma
(known as Meadowcrest, Hillside, Horthdale, Steeq, Westport I and
(and II and Male Acres I and II subdivisions without further
IIlauthority from RWD 13. RWD' #3 has agreed that no charges will
be made to any persons for permission to hook onto Op1;1A water
.,system in the above enumerated subdivisions.
3. The parties being advised by the Court, it was the
opinion of the Court that charges for water taps payable to
RWb #3 should be collected. by RWD #3 and upon presentment of
the receipt for payment thereof, OPWA would then have the
authority to sell its own water tap and install a water tap
within the shaded area at the location described on the tap
receipt obtained' from RWD 0.
t. The partiea have further agreed that in the event
there are any water lines or improvements within the area
herein granted OPWA, that OPWA will negotiate with RWD #3 for
the purchase of said -lines of improvements taking into consid
only the cost thereof less depreciation. The parties
have further agreed that any persons now served by RWD #3 may
continue to purchase water from RWD #3 until such time as OpWA
takes title to said lines by paying RWD #3 therefor.
5. The parties have further agreed that RWD #3 would
charge persons desirous of purchasing a water tap from opWA
';the sum of $50.00 for each tap requested not to exceed

(would have the right to sell water to said persons With no
further liability on behalf of said persons; firms or cor-
porations or OPWA. M.
6. IT IS FURTHER AGREED that within the territory
(granted in Paragraph 2, supra, that there is no objection on
the part of OPWA to the FRO 43 serving a territory with one
('tap for 2:1* acres or more if a developer or owner, requested
Ilservice from RWD 13 rather OPWA. It is understood however
that OPWA in not obligated to furnish any city services or

=sewer service to property connected to RWD t3 water -system
irather than the OPWA cater s4'stem.
7. RWD !3 is to be
paid $50,00 for each tap already in
(place in E1 Rio vista subdivision but OPWA shall not be
' responsible for 'the collection thereof.

East of the Santa Fe Railroad right -a -way is in the area
allocated to OPWA as contemplated in this agreement.

COUNTRY ESTATES III
DATE: January 6, 1999
BACKGROUND
The City of Owasso has received a request to review a revised final plat for Country Estates III.
Country Estates III is a 17.37 acre development adjacent to Westport to the west, and the other
phases of Country Estates to the east and northeast. The subject site is proposed to contain 61 lots
in an existing RS -3 (Residential Single - Family High Density) zoning district.
The subject property lies between Country Estates I & II Additions to the east and Westport
Addition to the west. Country Estates III will tie into Westport at 116" Place N, Country Estates
II at N 109" E Avenue, and Country Estates I at E 1171, Street N and E 118'" Street N, and the
planned Country Estates IV at E 118" Court N. N 109" E Avenue runs north to south through
Country Estates III and terminates at an intersection with E 116" Street N. Country Estates III
should improve access to E 116" Street N for all of the above - mentioned streets and subdivisions.
The developer has allowed sufficient right -of -way for the construction of acceleration/
deceleration lanes and sidewalks on E 116" Street N. The developer is required to complete
these facilities during the construction phase of the subdivision.
A revised preliminary plat for Country Estates III was reviewed and approved at the December 8,
1998 regular meeting of the Owasso Planning Commission. As mentioned in the preliminary plat
review, the plat contains only one change from the original plat proposed in July 1998. The
developer proposes a change in the street layout to allow for a new access to the planned Country
Estates IV Addition. E 118" Court N is a proposed stub street on the northeast side of Lot 17 Block
5. This stub street also eliminates one residential lot.
The Technical Advisory Committee reviewed the plat at their November 25, 1998 meeting. Their
recommendations have been incorporated into the final plat.
RECOMMENDATION
Staff recommends approval of the revised final plat for Country Estates III with the following
condition:
1. That acceleration/deceleration lanes and sidewalks on E 116" Street N be completed during the
construction phase of the subdivision.
