& 5, and Reserve "A" of the Forest Drive Industrial Park Addition. The subject property
is located on the west side of the Owasso Expressway, north of E 76" Street N and is
further described as a tract of land located in the NE/4 SEA of Section 30, T -21 -N, R -14
E, Tulsa County, Oklahoma. This item was tabled at the February 9, 1999 meeting.
5. Site Plan — Twisters — A request to review a site plan for Twisters, a motion picture
theater on property currently described as Lots 3, 4, & 5, and Reserve "A" of the Forest
Drive Industrial Park. The subject site is located on the west side of the Owasso
Expressway, north of E 76h Street N. This item was tabled at the February 9, 1999
meeting.
6. Annexation — Terry and Colleen McGill — A request for the annexation of property
located in the east half of the east half (E/2 E /2) of Section 17, T -21 -N, R -14 -E, Tulsa
County, Oklahoma. The subject property is further described as a 4.72 acre tract, more or
less, located on the west side of N 129"E Avenue, north of E 96"' Street N.
Final Plat — Nottingham Estates III — A request for review of a final plat for Nottingham
Estates III, a 17.15 acre, 27 lot subdivision located south of E 96" Street N, west of N
145' E Avenue. The subject property is described as a subdivision containing a part of
the NEA if Section 21, T21N, R14E, Tulsa County, Oklahoma.
8. Final Plat — Nottingham Estates IV — A request for review of a final plat for Nottingham
Estates IV, a 14.17 acre, 20 lot subdivision located on the south side of E 96h Street N,
west of N 145' E Avenue. The subject property is described as a subdivision containing
a part of the NE14 of Section 21, T21N, R14E, Tulsa County, Oklahoma.
9. Site Plan — German Comer Gymnastics — A request for review of a site plan for a
gymnastics facility located on the southwest comer of E 116°i Street N and N 97" E
Avenue (Mingo Road). The subject property is described as Lot 1, Block 1 Hillside
Estates Addition.
10. Lot Split OLS- 99 -01— A request for a lot split on unplatted land located on the south side

The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
February 4, 1999 at 4:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF JANUARY 12, 1999 REGULAR
MEETING. - The Commission reviewed the minutes of January 12, 1999 Regular,
Meeting, Charles Willey moved, seconded by Bob Randolph to approve the minutes. A
vote on the motion was recorded as follows:

4. Rezoning Request - OZ -99 -01 — Charles Norman, Johnson Property - A request for
rezoning of 4.26 acres, more or less, from OL (Office Low Intensity District) to CS
(Commercial Shopping Center District) .79 acres, from RS -3 (Residential Single- Family
High Density District) to CS 2.42 acres, and from RS -3 to OL 1.05 acres. The subject
property is located north of E 9611 Street No, west of the Owasso Expressway.
Theron Warlick presented the item to the Commissioners. The rezoning is relatively
small and "squares off" a tract that can then serve as a site for a new commercial
development, planned to front on the north side of E 96' Street North. This rezoning
creates 3.21 acres of CS property and is surrounded by a 1.05 acres buffer strip of OL
zoning. Mr. Charles Norman, applicant and attorney for purchaser, was present to
address any concerns or questions. Legal advertisement was published in the Owasso
Reporter on January 21, 1999 and notices were sent to property owners within 300'. No
comments /concerns were received by staff.

Rezoning Request — OZ -99 -02 — Charles Norman, Kaiser Francis Oil - A request for
rezoning of 9.46 acres, more or less, from OL (office Low Intensity District) to OM
(Office Medium Intensity District). The subject property is located on the south side of E
86' Street North approximately 700 feet east of the intersection of E 86th Street N and N
129'h E Avenue.
Theron Warlick presented the item. The property in discussion is undeveloped and is
planned to contain a large, two -story medical office facility. The rezoning request from
OL to OM is consistent with the established land use pattern. The proposal would change
the maximum allowable floor area ratio from 25 % to 50 %. Charles Norman presented a
brief presentation to the Commissioners. Legal advertisement was published in the
Owasso Reporter on January 21, 1999 and surrounding property owners were notified.

6. Vacation of Plat — ROC Owasso - A request to vacate Lot 8, Block 1, ROC Owasso
Addition. The subject property is located east of the Albertson's site on E 86'h Street N.
The vacation will allow the platting of ROC Owasso Il.
Theron Warlick presented a brief presentation. This proposal would remove all of the
easements; the primary utilities will come from the west border of the property. This
vacation is one of the steps that are required to create the planned two -story medical mall.
There were no comments or concerns regarding this plat at the Technical Advisory
Committee meeting. Mr. Ricky Jones of Tanner Consulting was present to address the

Commissioners. There were concerns expressed regarding easements. Mr. Jones
explained that there would be an increase in easements, changing the west side from 25'
to 45'. It was also stated that the CS (Shopping Center Commercial) zoning to the west
will remain in place and the eastern nine acres will be OM (Office Medium Intensity).
After discussion, Charles Willey moved to approve the vacation request, Larry Helton
seconded the motion. A vote on the motion was recorded as follows:

7. Final Plat — ROC Owasso II - A request for review of a final plat for ROC Owasso II,
A 16.83 acre, one lot subdivision described as part of the NW /4 of Section 28, R- 21 -N,.
R -14 -E. The subject property is located on the south side of E 86' Street N, West of
ROC Owasso and north of the Greens at Owasso Additions.
Theron Warlick made a brief presentation. The property is zoned CS (Shopping Center
Commercial) and OL (Office Low Intensity), with a proposal to rezone the OL portion of
the subject property to OM (Office Medium Intensity). The bulk and area requirement
for CS and OM districts is virtually identical, as are regulations. Since this proposed lot
contains split zoning, the most restrictive zoning district shall govern the manner in which
the entire property is developed and maintained. The engineer for the developer has
corrected the plat to reflect the recommendations that were addressed at the Technical
Advisory Committee meeting. Staff recommends approval with the following conditions:
1. That so long as the proposed lot contains split zoning, with respect to bulk and
area requirements only; the most restrictive zoning district shall govern the
manner in which the entire property is developed and maintained.
2. That all requirements of the Technical Advisory Committee shall be fulfilled.
Ray Haynes moved to approve the final plat, subject to the above staff recommendations.

8. Prelhninary Plat - Fairways W Extended - A request for review of a preliminary plat for
Fairways IV Addition, an 8.23 acre, 22 lot subdivision described as part of the NW /4
NW /4 of Section 18, T -21 -N, R -14 -E. The subject property is located on the south side
of E 96" Street N to the West of Fairways IV. Addition.
Theron Warlick presented the case to the Commissioners. He stated that the property is
zoned PUD (Planned Unit Development) which allows for several different types and
sizes of single - family residential development. Drainage will be conveyed from east to
west and released into the drainage pond to the west of the subject property via a pipe to
be located between lots 10 and 11. The Technical Advisory Committee reviewed the plat
at their January 27, 1999 regular meeting.
Ray Haynes moved to approve the preliminary plat subject to staff and TAC
recommendation. Larry Helton seconded the motion. A vote on the motion was

9. Final Plat - Friendship Baptist Church - A request for review of a final plat for
Friendship Baptist Church, a one lot subdivision consisting of 14.98 acres, more or less.
The tract is described as part of the NE /4 NE /4 Section 28, T -21 -N, R -14 -E and is
located on the south side of E 85t"Street N, west of N 145" E Avenue.
Theron Warlick presented the item. The Owasso Technical Advisory Committee
reviewed this plat at their January 27, 1999 regular meeting. The engineer for the
developer has amended the plat to reflect the Technical Advisory Committee
recommendations. Staff recommends approval of the final plat with the condition that
sidewalks be installed on E 86' Street North. Mr. Gary Johnson, the applicant, had
concerns regarding the construction of sidewalks. He asked if the sidewalks could be
delayed until both sides of this property are developed. Mr. Johnson also stated that the
money would be put into an escrow account for the acceleration/deceleration lanes and for
the sidewalks, since 86' Street North has plans of being widen. Charles Willey had
concerns with 86"' Street North being narrow at that point and would like to see the
acceleration/deceleration lanes installed at this time to take care of the traffic flow. Mr.
Dennis Hodo the engineer for the project was present to answer questions. Mr. Hodo
stated that since this is a church, the traffic would be at different times than the schools

and the shopping traffic. The traffic should be mainly on Sunday mornings, Sunday
evenings and Wednesday evenings. Staff recommends approval with the condition that
sidewalks be installed and acceleration/deceleration lanes be constructed as designed on
the plat.
Ray Haynes moved to approve the final plat, subject to the above staff recommendations
being met and the construction of acceleration/deceleration lanes as designed on the plat,
along with the construction of sidewalks. Bill Eillison seconded the motion. A vote on

10. Site Plan - Friendship Baptist Church - A request for review of a site plan for Friendship
Baptist Church, a church facility proposed on the south side of E 86h Street N, west of N
145' E Avenue.
Theron Warlick presented the item to the Commissioners. Four handicapped spaces and
436 parking spaces are shown on the site plan, which is a sufficient amount for this size
and type of building. However, handicapped parking will need to be increased from four
to nine spaces. Staff has requested the applicant limit access onto E. 86" Street and align
the access with the entrance to Silvercreek Addition. Discussion was held on the
acceleration/deceleration lanes. The Technical Advisory Committee reviewed this site
plan at their January 27, 1999 meeting. Staff recommends approval of the site plan with
the following conditions:
1. That the number of handicapped parking spaces be increased from four to
nine spaces and that all handicapped parking shall conform to ADA
standards,
2. That the applicants shall submit a landscaping plan for Planning
Commission approval prior to construction,
3. That landscaping must be installed prior to issuance of a certificate of
occupancy,
4. That sidewalks shall be installed on E 86" Street No,
5. The developer shall apply for a separate permit for signage.
Charles Willey moved to approve the site plan, subject to the above staff

11. Vacation of Plat - Forest Drive Industrial Park (Twisters) - A request to vacate Lots 3, 4
& 5, and Reserve "A" of the Forest Drive Industrial Park Addition. The subject property
is located on the west side of the Owasso Expressway, north of E 76h Street N and is
further described as a tract of land located in the NE /4 SE /4 of Section 30, T -21 -N, R -14-
E, Tulsa County, Oklahoma.
Due to the lack of signatures required for this vacation of plat, this item was tabled for 30
days.
12. Site Plan - Twisters - A request to review a site plan for Twister, a motion picture
theater on property currently described as Lots 3, 4 & 5, and Reserve "A" of the Forest
Drive Industrial Park. The subject site is located on the west side of the Owasso
Expressway, north of E 76' Street N.
Ray Haynes moved to table this item for 30 days in order to give the applicant ample time
to resubmit a workable site plan which will show parking redesigned and Lot "C"
removed. Bill Ellison seconded the motion. A vote on the motion was recorded as
follows:

13. Site Plan - Doherty Office Building - A request to review a site plan for an office
building proposed as Lots 3 -5, Block 19, Owasso Original Town Plat. The subject site is
located on the south side of Broadway Street between Main and Atlanta Streets.
Theron Warlick presented the case. He explained the developer proposes 13 parking
spaces including 2 handicapped spaces. The builder has also provided a landscaping plan.
The Technical Advisory Committee reviewed the site plan at their January 27, 1999
meeting. Public Service of Oklahoma stated that an easement would be required to

provide service from the alley. The diversion of water in the area was discussed briefly.
The applicant was present to answer any questions or concerns. Charles Willey had
questions regarding the amount of traffic flow in the area. Ray Haynes questioned the
applicant on the construction of the building. The applicant stated that the building would
have a brick facade.
Ray Haynes moved to approve the site plan, subject to staff recommendations. Bob
Randolph seconded the motion. A vote on the motion was recorded as follows:

Ray Haynes called a 10 minute recess at 8:40 PM in order to give the applicant for the next item
ample time to appear before the Owasso Planning Commission to address concerns.
Ray Haynes reconvened and called the meeting to order at 8:52 PM.
14. Site Plan - Owasso High School Auditorium - A request to review a site plan for a public
auditorium on the grounds of the Owasso Public High School. The subject property is
located on the northeast comer of N 129' E Avenue and E 86' Street N.
Theron Warlick presented the item to the Commissioners. He stated that parking and
loading is satisfactory for a building of this size and type. The site plan shows 1,217
parking spaces. Staff had concerns with the interior traffic movement and too many
access points on the property. It was stated that the most frequent use of the auditorium
will be when the parking lot is least needed for other purposes. He also explained the
difficulty with the fire lanes was addressed by installing a road between the tennis courts
and the proposed auditorium. This plan would improve the circulation of traffic around
the entire high school site and improve access around the auditorium. The Technical
Advisory Committee reviewed the proposal; utility companies had no problems with the
site plan. Staff recommends approval of the site plan with the following conditions:
1. That the applicant provide fire lanes as needed for fire protection of the
auditorium,
2. That the applicant install a roadway between the tennis courts and auditorium for
emergency access around the auditorium,
3. That the applicant agrees to meet with concerns City officials and their agents
regarding access management issues within the next 60 days.

Bob Randolph moved to table this item due to the applicant being absent.
Charles Willey stated that he would like to see the entrance off 86' St North line up with
the fire lane to make it a straight shot in for the fire trucks. He also suggested to have a
line of south side parking spaces be removed to have the road continue all the way around
the facility. Finally, he requested a curb cut be closed on the west side of the parking lot
and a new one made further north. (Exhibit "A" attached). Mr. Willey also requested
this fire lane to be paved.
Mr. Dale Johnson, Owasso Public Schools Superintendent, arrived at 9:30 PM and Mr.
Randolph withdrew his motion to table the item.
Theron Warlick showed Dale Johnson what the Commissioners had drawn up containing
the above suggestions. Mr. Warlick stated this plan would allow traffic to flow around
the building and would create access for emergency vehicles. Making the fire lane off of
86' Street North a straight run was discussed. Charles Willey expressed concern with
cars parking in the fire lane. He would like to see curb stops along the lane so people
won't park there and so the cars will not stick out and block traffic. Mr. Johnson stated
that the fire safety lane will always stay open and that he would have this lane striped red.
Ray Haynes moved to approve the site plan, subject to the above staff recommendations
and Exhibit "A ", (see attached) which shows a fire protection loop. This loop would be
constructed of a hard, dust -free surface. Charles Willey seconded the motion. A vote on

SUBJECT: VACATION OF PLAT
FOREST DRIVE INDUSTRIAL PARK

BACKGROUND
Vacatiod of a portion of Forest Drive Industrial Park is required for approval of a site plan for
Twisters movie theater. This item was tabled at the February 9, 1999 meeting because the owners
were required to obtain consent from at least 60% of the property owners within the addition. The
applicants have now obtained the required approval and the item is ready for consideration by the
Planning Commission.
The applicants have requested the vacation of a portion of the Forest Drive Industrial Park (March.
1980). The subject property is described as part of the NEA SEA SE/4 of Section 30 T -21 -N R -14-
E, Tulsa County. The subject property is further described as Block 1, Lots 3, 4, & 5, and Reserve
"A" of Forest Drive Industrial Park. The subject property is located north of E 76h Street N on the
west side of the Owasso Expressway and is the planned site for Twisters theater. A copy of the
Forest Drive Industrial Park plat is attached for your information and review.
The portion proposed for vacation is approximately six acres in size. The Planning Commission
typically sees reserve areas set aside on plats for the purpose of drainage. As there is a large
drainage ditch to the west of the property, drainage was not the purpose of this reserve area.
Reserve area "A' of this plat was set aside specifically for "...future replatting into streets, lots, and
blocks and any additional easement as necessary all according to the City of Owasso Code and
prior to the issuance of any building permit for any structure upon Reserve "A " ".
In January 1998, the Planning Commission approved a lot split that created three new lots on the
subject property'. A copy of the lot split drawing is also attached for your information and review.
In order to develop however, the applicant must vacate the underlying portions of the old plat. The
applicant has not requested to remove the existing easements on the property at this time. A 15 foot
utility easement between Lots 1 -6 and Reserve "A' (used by PSO) will remain as will a 10 foot
ONG easement (by separate instrument) and an additional 10 foot easement also located along the
north property boundary.
The Owasso Technical Advisory Committee reviewed the plat vacation at its January 27, 1999
regular meeting. The comments are as follows:

This item was tabled at the February 9, 1999 meeting due to problems noted in the review. The
applicant was given an opportunity to resolve parking and landscape issues. The revised site plan
addresses the parking issue, but does not contain drainage plans as in the previous submission. The
applicant has asked that the drainage plan from the original submission be considered. He notes
that the building configuration and layout is similar and the drainage plans will not change. A copy
of the drainage plan is included on an 11" X 17" plan within your packet. Landscaping plans have
not been submitted.
The City has received a request for review of a site plan for Twisters. The proposed movie theater
is located north of E 76" Street N on the west side of the Owasso Expressway. The subject property
is further described as Block 1, Lots 3, 4, & 5, and Reserve "A" of Forest Drive Industrial Park and
is zoned CS (Shopping Center Commercial).
Abutting the subject property are a real estate office to the southeast and two automotive repair
businesses to the northeast. The businesses reside in the Forest Drive Industrial Park and are zoned
IL (Light Industrial). Abutting the subject property on the west is the Owasso Public Schools bus
depot. To the north of the subject property is a narrow strip of CG (General Commercial) property
that remains undeveloped save for an undedicated extension of Second Street. The south side of
the subject property faces the rear of Streets, a commercial shopping center fronting on E 76" Street
N.
A large drainage ditch, actually an unnamed Bird Creek tributary, flows generally north to south
through the middle of the subject property. According to the current FEMA (Federal Emergency
Management Agency) floodway map panel for the subject site, most of the subject property lies in
the 100 year floodplain, with a significant portion in the actual floodway of the tributary. A copy of
the flood map with approximate lot lines sketched by staff is included for your information and
review. This site is not described as an FD (Floodway Supplemental District), thus Chapter 9 of the
Owasso Zoning Code does not apply to this site. Nevertheless, the subject property is defined as an
area of special flood hazard and applicants must comply with City regulations. Specifically,
Owasso Zoning Code Appendix C, Chapter 4, "Flood Hazard Regulations" and Owasso City Code,
Part 12, Chapter 4, "Flood Damage Prevention' ' will require the applicants to submit an application

for a Development Permit. The floodplain administrator will review the permit for compliance with
the aforementioned codes. One of the duties of the floodplain administrator is to ensure that all
state and federal permits are obtained prior to approving a development permit.
Construction involving alteration of a FEMA defined floodway and/or floodplain will require
review and approval by the US Army Corps of Engineers, most likely in the form of a Section 404
permit. No development permit will be issued until this and any other required permits are
received and all local requirements are met
The proposed 45,000 square foot facility has a parking requirement of 1 space per 200 square
feet of floor area. Parking is adequate for a facility of this size and type. Traffic. circulation on
site is adequate. The subject property was subdivided with a lot split (OLS- 98 -02). A copy of the
lot split drawing is attached for your information and review. The building is located on Tract B of
the lot split. Parking is located on tracts A and C. Off - street parking is permitted as a principal use
within a CS district, however, the applicants are advised that any change from the proposed uses on
Lots A and C will require a revised site plan for the movie theater and/or a parking variance from
the Board of Adjustment.
The applicants show a paper road going from east to west on the subject property. It is important to
note that this road is not a dedicated street as evidenced by the location of parking within the
implied road boundaries. The applicants have suggested that Broadway or First Streets could be
extended through their development site to intersect with the Owasso Expressway. While this may
be feasible and even offer new redevelopment opportunities in downtown, it seems highly unlikely,
that the City would extend a street to this property so long as it remains a mere paper road on a site
plan. Future discussion of the possibility of a street extension would best be initiated with a
dedication of right -of -way on the subject property.
Drainage for the south half of the site will flow to the center of the parking lot into a 24 inch pipe
that will convey water to the tributary. Drainage on the north half will be handled similarly through
a pipe at the northeast comer of the site.
The Technical Advisory Committee reviewed the site plan at its January 27, 1999 meeting. There
were very few questions regarding the proposal. The applicants are planning to submit a detailed
landscape plan, but have not done so at this time.
RECOMMENDATION
Staff recommends approval of the site plan with the following conditions:
1) That the applicants submit an application for a development permit. Further, that this
application be accompanied by all required state and federal permits,
2) That detailed drainage plans be submitted for approval by the City Engineer,
3) That acceleration/deceleration lanes and sidewalks be installed on the Owasso
Expressway frontage,

BACKGROUND
Terry and Colleen McGill have submitted a petition to the City of Owasso requesting annexation
of property totaling approximately 4.72 acres. The subject property is described as a tract of land
in the east half of the east half (E /2 E /2) of Section 17, T -21 -N, R -14 -E, Tulsa County,
Oklahoma. The subject property is located on the west side N 129th E Avenue, north of E 96`b
Street N.
The subject property is surrounded on three sides by portions of the Johnson property. The Johnson
property is a large tract that has been rezoned for a variety of uses including commercial, office,
single - family residential, and multi - family residential. The portions of the Johnson tract to the
north and west of the subject property are zoned RE (Residential Estate District), which permits the
development of single - family housing on lots of 1/z acre or larger. The RE zoned areas will serve as
a buffer between higher intensity uses and neighboring estate lots located in unincorporated Tulsa
County to the northwest of the subject property. Another estate lot addition, Glen -Mur, is located
to the east of the subject property. To the south of the subject property is a portion of the Johnson
tract zoned OL (Light Office District).
The subject property is zoned AG (Agriculture) in Tulsa County and would also be zoned AG
(Agriculture) upon annexation into the City of Owasso. If annexation is recommended for
approval by the Annexation Committee and the Planning Commission and annexed by the City
Council, the property must then satisfy City zoning, planning, and subdivision requirements prior
to any development.
The site lies in the service area of Washington County Rural Water District #3, and it is likely that
the Water District will provide water service to the subject property instead of the City.
Wastewater service can be provided through an existing line located on the south side of E 96`s
Street N. The subject property will probably derive access via N 129t" E Avenue, which should
provide adequate means of ingress /egress for the subject site.
Owasso annexation policy states that tracts 20 acres or larger are preferred. However, the proposed

4.72 acre tract is surrounded on three sides by the City, and the proposal presents an excellent
opportunity to infill an area and avoid another "out -of -city" pocket. A copy of the City of
Owasso's annexation policy is attached for your information and review.
Notification of the annexation request was published in the Owasso Reporter on February 18, 1999
to notify the public of the annexation request before the Planning Commission meeting on March 9,
1999. This will be followed by notification published two consecutive weeks in the Owasso
Reporter on March 4 and March 11, 1999 to notify the public of possible City Council action
regarding the request on March 16, 1999. In addition to the annexation policy_ , a copy of the
procedures for annexation is also attached for your information and review.
Staff recommends approval of the proposed annexation request.

ANNEXATION POLICY
While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the lowest zoning classification,
that is, AG, agricultural. Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the city will be legal,
but non - conforming, which means that they may continue but cannot be expanded without
proper zoning.
4. All public infrastructures that do not met city standards will not be improved by the city
until brought to the city standard and accepted by the City Council. Such public facilities
must be improved at owners expense by the establishment of a special assessment district
or some other financing method.
5. Where a city limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for
a six month period after rejection by the City Council.

The developer, Tyann Development, has submitted a final plat for Nottingham Estates III, a 17.15
acre, 23 lot subdivision in the NEA of Section 21, T -21 -N, R -14-E, generally located to the east of
Nottingham Estates H, on the east side of N 138 ' E Avenue.
The Planning Commission approved the preliminary plats for Nottingham Estates II -V in May of
1996. The preliminary plat for the subject properties includes a coordinated drainage system based
on an engineering study to serve sections II -V. This drainage system is to be constructed in this
phase of the development. The drainage reserve is shown on the plat as well as on an attached
diagram.
The Owasso Technical Advisory Committee reviewed the final plat on February 24, 1999 regular
meeting with the following comments:

The applicant's engineer has made changes to the plat to reflect the recommendations of the
Technical Advisory Committee. Those changes are included on the plat within this packet. The
corrected instrument conforms to the platting requirements of the Owasso Subdivision Regulations,
Owasso Zoning Code, and to the preliminary plat for Nottingham Estates III.
RECOMMENDATION
The final plat conforms to the previously approved preliminary plat. The final plat also conforms
to the platting requirements of the Owasso Subdivision Regulations, and the Owasso Zoning Code.
Staff recommends approval of the plat.

One change in the proposed final plat is that N137th E Court and N 139' E Court have been
mirrored, or "flipped". The change moves the entrances to these cul -de -sacs to the south and
further away from the intersection of N 138" E Avenue and E 96" Street N. This is a desirable
change and does not effect the number of lots or the overall street pattern in any major way. Staff
considers this change to be minor and finds no reason to recommend a revised preliminary plat.
The Owasso Technical Advisory Committee reviewed the final plat on February 24, 1999 regular
meeting with the following comments:

The applicant's engineer has made changes to the plat to reflect the recommendations of the
Technical Advisory Committee. Those changes are included on the plat within this packet. The
corrected instrument conforms to the platting requirements of the Owasso Subdivision Regulations,
Owasso Zoning Code, and generally to the preliminary plat for Nottingham Estates IV.
Request for Variance of Subdivision Regulations
The applicant has requested a variance of subdivision regulations. Section 3.4 of the Owasso
Subdivision Regulations states:
"Sidewalks shall be installed along both sides of all streets in all zoning categories other
than industrial. The design and location shall be in accordance with the Owasso Design,
Criteria. Where possible, subdivisions should include sidewalks located in such a manner
that pedestrian access is provided to adjacent land uses such as parks, schools, commercial
centers and the like."
The applicant has submitted a request in writing for permission not to install sidewalks on E 96"
Street N and on either side of N 138' E Avenue, north of the intersection with N 137' E Court and
139" E Court. Per section 1.7 of the Owasso Subdivision Regulations, the Planning Commission,
upon review of a written request from the applicant, may grant a variance under the following
conditions:
1. That strict application of the Subdivision Regulations, because of unusual
conditions, would result in a hardship or inequity for the applicant,
2. That the public welfare and interests of the City are protected and that the purpose
and intentions of the regulations are preserved.
The request is attached in this packet. The applicant cites other examples where sidewalks have
not been required along arterial roads and even within the subdivision along entranceways. The
applicant also correctly notes that the sidewalks would lead "nowhere ".
Few could have anticipated the rapid growth of E 86' Street N in recent years. Certainly there
have been areas where sidewalks seemed pointless just a few years ago. The noticeable absence
of sidewalks in many of these same areas presents an inconvenience, if not a hardship, for our
City's pedestrians. A recurring theme in Owasso Master Plan Committee meetings is the need to

provide pedestrian access throughout the community; the need for greenways, trails, and
sidewalks has been voiced by several people and on numerous occasions. While the applicant
has his valid points, a complete waiver would essentially eliminate access in the area and could
possibly be injurious to the goals of the community. The installation of sidewalks is a
subdivision requirement. If the requirement is waived without regard to the future, the City will
become sole owner of the problem, and the solution.
Staff recommends a compromise solution. While it does not make sense to install sidewalks to
"nowhere ", a connection to E 96' Street N may someday be needed. Staff recommends that that
sidewalks be installed on E 96' Street N and at least one side of N 138' E Avenue, north of the
intersection with N 137' E Court and N 139'b E Court. Considering the potentially long time
frame for installation of sidewalks on adjacent properties, staff recommends as an alternative that
an amount of money sufficient to build the walks be placed in an interest bearing escrow fund
until such time as sidewalks to the east or west of the subject property along E 960' Street N are
constructed. The estimate for sidewalk installation shall be based upon the design criteria of the
City and approved by Owasso Public Works.
A variance in the subdivision regulations requires a (314) vote of the Planning Commission. A
separate vote on the variance request is recommended.
Variance request - Staff recommends that that sidewalks be installed on E 96" Street N and at
least one side of N 138" E Avenue, north of the intersection with N 137' E Court and N 1391' E
Court. Considering the potentially long time frame for installation of sidewalks on adjacent
properties, staff recommends as an alternative that an amount of money sufficient to build the

SUBJECT: Minor Waiver of Sidewalk Requirement at Nottingham Estates
I have prepared this memorandum, at your request, to formally ask the Planning Commission and
City Council to grant Nottingham Estates a minor waiver of the sidewalk requirement along and
on either side of 138th East Avenue from 96th Street North south to the first 4 -way intersection
(approximately 540). Please fine attached a copy a plan showing the locations of our decorative
concrete and wrought iron walls for the new entry.
First, please note that we have design the area along both sides of 138th East Avenue to be a part
of our 96th Street entry. Within the I F to IT of right -of -way remaining on either side of the
street pavement, we locating the new decorative wall and extensive landscaping. Space is simply
not available to locate a sidewalk.
Second, a sidewalk located north of the 4 -way intersection on 138th East Avenue leads to
"nowhere" and serves no purpose. The purpose of a sidewalk is to provide for safe pedestrian
access throughout a subdivision and and from one subdivision to another subdivision. We have
made pedestrian access within Nottingham readily accessible by providing a trail through our
private park system and with the use of typical sidewalks located along the fronts of each lot. This
pedestrian access system also ties into adjacent subdivision such as Barrington, Brentwood,
Camden Park, and Silver Creek. At the 96th Street entry there are only small acreage lots located
outside the city limits and the Pleasant View Addition also located outside the city, none of which
have or will have sidewalks in the future.
Third, as noted above these sidewalks would lead to "nowhere ". If required to be put into place
they would act as funnels pushing pedestrian traffic into a dangerous intersection to do battle with
cars and trucks. 96th Street is an Arterial Street and we have been required to make 138th East
Avenue as a Collector Street which would mean that traffic from Nottingham, as well as
Barrington, Brentwood, Silver Creek, Camden Park, and cross traffic from 86th Street could be
using this street and intersection. This could be a very dangerous situation and open liability
questions that Tyann Development and I would prefer not to be parry to.
Fourth, It should be noted that other subdivisions which have extended entryways (e.g.. Southern
Links, Fairways west entry, Conventy Gardens, etc.) have not been required to have sidewalks
within their entryways.
Fifth, It should be noted that any access, pedestrian or vehicular, to the back sides of the adjacent
lots will not be allowed by Nottingham Plat or City Ordinances. Access will be restricted to the
fronts of the lots where sidewalks will be provided.
Finally, I would suggest that given the above reasons our request for a minor waiver of the
sidewalk be approved.

BACKGROUND
The applicant, Linda Meeker, proposes a site plan for a 9,600 square foot gymnastics facility on
2.56 acres, more or less. The subject property is generally located at the southwest comer of E
116" St. N and Mingo Rd., further described as Lot 1, Block 1, Hillside Estates Addition to the
City of Owasso. The subject property is surrounded by vacant, but subdivided, land to the south,
a single - family dwelling located outside the City Limits to the north across 116'" St., vacant land
to the east across Mingo Road, and farm property outside the City Limits to the west.
In August 1998, the Planning Commission and City Council approved a rezoning of the site from
AG (Agriculture) to OL (Light Office). The current zoning will allow the construction of the
proposed facility. Parking is adequate for a building of this size and type. The applicant
proposes 34 spaces (2 handicapped). When feasible, staff encourages one driveway access per
lot. Staff anticipates that on -site circulation in the front of the facility will generally be one -way,
with drop -offs occurring at peak periods coinciding with classes. The second driveway offers the
opportunity to enhance on -site circulation. The driveway spacing is 150 feet and the comer
clearance from the intersection of Mingo Road and E 116' Street N is 175 feet. These distances
are adequate for City arterial traffic. Staff is not opposed to the use of a second driveway in this
case.
Landscaping is shown in the site plan. The applicant shows a screening buffer of coniferous trees
on the site between adjacent residential properties. This buffer will enhance the compatibility
with surrounding properties and over time help to define an outdoor space behind the facility.
The applicant shows a small monument sign located between driveways. All signage will be
reviewed separately through the sign permitting process.
The 35' easement that runs from southwest to northeast on the subject property was probably
dedicated for City sewer; however, the sewer line currently stops at the southern property line.
There is an existing ditch on the north boundary of the subject property that will ultimately
handle drainage from the property. However, some drainage details are not addressed on the site
plan. The applicant is currently finalizing drainage plans with Phil Lutz of Owasso Public
Works. As a condition of approval, staff recommends that a drainage plan be approved by
OPWA prior to construction. Verification of drainage approval can be made at the time of the

submission of a building permit.
The site plan was reviewed at the February 24, 1999 meeting of the Owasso Technical Advisory
Committee. ONG noted that gas was located approximately 900 feet to the west of the property.
PSO asked that the pine trees on the perimeter of the site be moved out of the easements. OPWA
noted that a more detailed drainage plan was required.
Staff recommends approval of the site plan for German Comer Gymnastics with the condition
that the applicant must submit a detailed drainage plan for approval by OPWA prior to issuance
of a building permit.

The owner, Mark Enterline, has requested a lot split for unplatted land located on the south side
of E 96' Street N, between the ONG building and the Owasso Expressway. The owner of the
proposed easternmost tract is Mark Enterline. The City of Owasso owns the westernmost tract
and it is the site of a large ground storage water tank. Both properties are zoned RM -2
(Residential Multi - Family). At the time of sale in 1987, the property was located in Tulsa
County. In 1987, Tulsa County allowed the sale of tracts over 2'/2 acres by legal description
only, with no lot split or plat required. However, the water tank property was only 1.92 acres
and under the 2'/2 acre limit. A lot split should have been made at the time of sale.
The error was uncovered in a recent abstract review prior to the sale of the larger, 4.56 acre
property. In order to correct the problem, the Planning Commission can grant the lot split. The
applicant has provided legal descriptions of both tracts. The applicant should also provide a
survey with the subject tracts labeled "Tract A" and "Tract B ". The signed survey and legal
descriptions will ultimately need to be filed with Tulsa County.
The Technical Advisory Committee reviewed the proposed lot split at the February 24, 1999
meeting and had no objections to the proposal. Staff notes no other unusual conditions or
circumstances that merit the attention of the Planning Commission.
RECOMMENDATION
Staff recommends approval of the proposed lot split with the condition that a survey denoting the
newly created tracts be submitted for signature of the Chairman of the Planning
Commission.
