PUBLIC HEARING
OZ -99 -03 — Bob Ary — A request for rezoning from RS -3 (Residential Single - Family
High - Density District) to CG (General Commercial District) for Lot 7, Block 1, Nichols
Heights Addition. The applicant requests a rezoning of a t 0.18 acre lot, more or less,
located on the south side of E 86h Street N, east of Main Street. The subject property is
adjacent and to the east of the Owasso Tire Bam.
6. OZ -99 -04 — Charles Norman — A request for rezoning from OL (Office Low Intensity
District) and RS -3 (Residential Single - Family High - Density District) to CS (Shopping
Center District), OL, and RS -3. The subject properly is located on the north side of E 96'
Street N, west of the Owasso Expressway and contains 14.76 acres, more or less.
7. OZ -99 -05 — Owasso First Church of the Nazarene — A request for rezoning from AG
(Agriculture District) to OM (Office Medium Intensity District) for a ± 5.0 acre tract,
located on the west side of N 145'h E Avenue, North of E 86's Street N.
8. OZ- 99 -06- Preston Lakes L.L.C. — A request for rezoning of ± 314 acres currently zoned
AG (Agriculture District). The subject property is located in the south half of Section 22,
T -21 -N, R -14 -E, City of Owasso, Rogers County, Oklahoma, generally located on the
north side of E 8& St. N between N 145" E Ave. and N 161' E Ave. The proposed
zoning is as follows: from AG to RS -2 (Residential Single - family Medium Density
District) t 260.0 acres, RM -2 (Residential Multi- family District) ± 12.6 acres, CS
(Shopping Center District) ± 21.67 acres, OM (Office Medium Intensity District) ± 15.0
acres, and CG (General Commercial District) ± 5.0 acres.
9. PUD 15 — Preston Lakes — A request for review of a planned unit development on ± 314
acres, located in the south half of Section 22, T -21 -N, R -14-E, City of Owasso, Rogers
County, Oklahoma, generally located north of E 86's St. N between N 145"' E Avenue
and N 161' E Avenue. The development includes the addition of 60 acres on N 145' E
Avenue but is otherwise identical to the plan reviewed by the TAC in July 1998.
10. Preliminary Plat - Preston Lakes - A request for review of a preliminary plat for Preston
Lakes Addition, a 128.00 acre, 230 lot subdivision located on the north side of E 861"
Street N, east of N 145b E Avenue. The subject property is described as a subdivision in
the southwest quarter of Section 22, T21N, R14E, Rogers County, Oklahoma.
11. Annexation — Lowe — A request for annexation of ± 10.00 acres located in the Northeast
Quarter (NE 14) of Section 7, T -21 -N, R -14-E. The property is further describes as a
tract on the south side of E 116' Street N, between Garnett Road and Mingo Road (N 97s'
E Avenue), east of the Owasso Sports Complex. The property is currently zoned CS
(Commercial Shopping Center District) in Tulsa County and the applicants have requested
that the property be assigned the CS (Shopping Center District) designation by the City of
Owasso upon Annexation.
12. Easement Closing — Heritage Construction — A request to close a portion of a utility
easement on Lot 5, Block 6, Country Estates H. The subject property is located at 11106
E 120'h Street N. A newly constructed home encroaches into the utility easement by a
distance of 0.1 feet.
13. Final Plat — Fairways IV Extended — A request for review of a final plat for Fairways IV
Addition, an 8.23 acre, 22 lot subdivision described as part of the NW /4 NW /4 of Section
19, T -21 -N, R =14 -E. The subject property is located on the south side of E 966' Street N
to the West of Fairways IV Addition.

The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on March
5, 1999 at 12:00 PM.
CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 9, 1999 REGULAR
MEETING. - The Commission reviewed the minutes of February 9, 1999 Regular
Meeting, Bob Randolph moved, seconded by Bill Ellison to approve the minutes. A vote
on the motion was recorded as follows:

4. Vacation of Plat - Forest Drive Industrial Park (Twisters) - A request to vacate Lots 3, 4,
& 5, and Reserve "A" of the Forest Drive Industrial Park Addition. The subject property
is located on the west side of the Owasso Expressway, north of E 76" Street N and is
further described as a tract of land located in the NE /4 SE4 of Section 30, T -21 -N, R -14-
E, Tulsa county, Oklahoma. This item was table at the February 9, 1999 meeting.
Theron Warlick presented the item to the Commissioners. Theron explained that this
item was tabled at the February 9, 1999 meeting due to the property owners needing to
obtain consent from 60% of the surrounding property owners within the addition. The
portion is approximately six acres in size. The Owasso Technical Advisory Committee
reviewed the plat vacation at its January 27, 1999 regular meeting. Easements by
separate instrument are required for all utilities. Southwestern Bell required an eleven
foot utility easement on the south side of Parcel C of the lot split (Lot 5). Staff
recommends approval of the site plan subject to the above conditions being met.

TAC recommendations. Bob Randolph seconded the motion. A vote on the motion was

5. Site Plan — Twisters — A request to review a site plan for Twister, a motion picture
theater on property currently described as Lots 3, 4, & 5, and Reserve "A" of the Forest
Drive Industrial Park. The subject site is located on the west side of the Owasso
Expressway, north of E 76°i Street N. This item was table at the February 9, 1999
meeting.
Theron Warlick presented the item. The subject property was described. According to
the current FEMA floodway map most of this property lies in the 100 year floodplain.
The Owasso City Code, Part 12, Chapter 4, will require the applicants to submit an
application for a Development Permit. The proposed 45,000 square foot facility has
adequate parking. The parking is located on tracts A and C. The applicants have
suggested that Broadway or First Streets could be extended through their development site
to intersect with the Owasso Expressway. The Technical Advisory Committee reviewed
the site plan request at their January 27, 1999 meeting. No comments or concerns were
recorded from the utility companies. Owasso Public Works Authority at the Technical
Advisory Committee meeting approved the drainage plan. Discussion was held regarding
the water run off and detention. The applicant, Raymond Lord was present to answer
questions regarding the drainage of the site. Staff recommends approval of the site plan
with the following conditions:
1) That the applicants submit an application for a development permit.
2) That this application be accompanied by all required state and federal permits.
3) Acceleration/deceleration lanes and sidewalks to be shown on a revised site plan
and be reviewed by the Planning Commission.

recommendations, Larry Helton seconded. A vote on the motion was recorded as

6. Annexation — Terry and Colleen McGill - A request for the annexation of property
located in the east half of the east half (E /2 E /2) of Section 17, T -21 -N, R -14 -E, Tulsa
County, Oklahoma. The subject property is further described as a 4.72 acre tract, more
or less, located on the west side of N 129' E Avenue, north of E 96i° Street N.
The subject property is surrounded on three sides by portions of the Johnson property and
is zoned AG (Agriculture) in Tulsa County and would be zoned AG (Agriculture) upon
annexation into the City of Owasso. The subject property lies in Washington County
Rural Water District #3. Notification of this request was published in the Owasso
Reporter on February 18, 1999. This will also be published two consecutive weeks on
March 4 and March 11, 1999 in able to notify the public of City Council action regarding
the request.

7. Final Plat — Nottingham Estates III - A request for review of a final plat for Nottingham
Estates III, a 17.15 acre, 27 lot subdivision located south of E 96' Street N, west of N
145th E Avenue. The subject property is described as a subdivision containing a part of
the NEA if Section 21, T21N, R14E, Tulsa County, Oklahoma.
Theron Warlick presented the item to the Commissioners. The drainage system for this
property is constructed in this phase of the development. The Owasso Technical
Advisory Committee reviewed this plat at their February 24, 1999 regular meeting. The
applicant has made all of the changes requested by TAC. Steve Compton, the applicant,
was present to address drainage concerns.

8. Final Plat - Nottingham Estates 1V - A request for review of a final plat for Nottingham
Estates IV, a 14.17 acre, 20 lot subdivision located on the south side of E 96° Street N,
west of N 145' E Avenue. The subject property is described as a subdivision containing
a part of the NE /4 of Section 21, T21N, R14E, Tulsa County, Oklahoma.
Theron Warlick presented the case and described the subject property. The Owasso
Technical Advisory Committee reviewed the final plat on February 24, 1999 regular
meeting and had several comments, all of which have been addressed on this final plat.
The applicant withdrew his request for a variance of the Owasso Subdivision Regulations.
Mr. Steve Compton with Tyann Development addressed the Commissioners to explain
the variance request and also explain the withdraw. He stated that he will comply with
Section 3.4 of the Owasso Subdivision Regulations. Although he would like to state that
he would like to see the same treatment for all developers of Owasso subdivisions
regarding sidewalks, which are required according to the above Section, to be on both
sides of all streets. The entrance fencing was discussed briefly.
Bob Randolph moved to approve the final plat. Lang Helton seconded the motion. A
vote on the motion was recorded as follows:

9. Site Plan - German Comer Gymnastics - A request for review of a site plan for a
gymnastics facility located on the southwest comer of E 1161' Street N and N 97'h E
Avenue (Mingo Road). The subject property is described as Lot 1, Block 1, Hillside
Estates Addition.
Theron Warlick presented the item. The applicant proposed 34 parking spaces, two of
which will be handicapped. With on -site circulation in the front of the facility will
generally be one way, the second driveway offers the opportunity to enhance on -site
circulation. Landscaping is shown in the site plan. Also shown is a monument sign
located between the two driveways. All signage will be reviewed through the sign
permitting process. The Technical Advisory Committee reviewed the site plan at the
February 24, 1999 meeting. Mr. Kent Schmeeckle was present to represent the applicant
and answer questions regarding the site plan. The plan was reviewed at the Owasso
Technical Advisory Committee meeting on February 24, 1999. ONG noted that gas was

located approximately 900 feet to the west of the property, PSO asked that the pine trees
on the perimeter of the site be moved out of the easements. OPWA requested a more
detailed drainage plan. This detailed drainage plan will need approval prior to issuance of
a building permit. There was discussion regarding the congestion of traffic in the area.
Ray Haynes suggested the possibility of a sign or a caution light be installed to slow
traffic down. If a caution light is installed, it would only need to be on during class
hours.
Bob Randolph moved to approve the site plan, subject to the above staff
recommendations. Ray Haynes seconded the motion and added to the motion that due to
the congestion in the area, signage or a caution light should be installed. A vote on the
motion was recorded as follows:

10. Lot Split OLS -99 -01 - A request for a lot split on unplatted land located on the south side
of E 96' Street N, between the ONG building and Owasso Expressway. The subject
property is described as a part of the NE /4 of Section 20, T21N, R14E,.Tulsa County,
Oklahoma.
Theron Warlick described the location of the property. The owner of the proposed
easternmost tract is Mark Enterline. The City of Owasso owns the westernmost tract and
it is the site of a water tank. Both are zoned RM -2 (Residential Multi - Family). The sale
of the property occurred in 1987 and at the time Tulsa County allowed the sale of tracts
over 2.5 acres by legal description only, with no lot split or plat required. A lot split
should have been made at the time of sale. The Technical Advisory Committee reviewed
the proposed lot split at their February 24, 1999 meeting and had no objections. Staff
recommends approval of the proposed lot split with the condition that a survey denoting
the newly created tracts be submitted for signature of the Chairman of the Planning
Commissioners.

APPLICANT AND STATUS OF APPLICANT: David Chamey is the attorney for the owner
Bob Ary.
REQUESTED ACTION AND PURPOSE: The applicant proposes the rezoning of ± 0.18
acres, more or less, from RS -3 (Residential Single- Family) to CG (General Commercial). The
proposed rezoning may allow the expansion of the tire center to the west of the subject property.
LOCATION AND SIZE: The subject property is generally located on the southeast corner of
Main Street and E 86" Street N. To the south and east of the subject property are single -family
residences also in an RS -3 district. To the west is the Owasso Tire Barn, located in a CG district.
To the north is additional property zoned CG. The subject property will lose the northernmost
5.89 feet in the forthcoming street project on E 86' Street N.
EXISTING LAND USE: The subject property is developed as a single - family residence.
SURROUNDING LAND USE: To the south and east of the subject property are single - family
residences also in an RS -3 district. To the west is the Owasso Tire Barn, located in a CG district.
To the north is additional property zoned CG.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", Chapter 4 "Residential District Provisions ", and Chapter 6 "Commercial District
Provisions ".
ANALYSIS
The 1985 Comprehensive Plan for Owasso recommends medium intensity commercial on the
southeast comer of E 86"' Street N and Main Street, surrounded by low density residential.
Although the existing tire facility to west is "grandfathered" as an existing non - conforming use,
any expansion of the operation will require the erection of a screening wall or fence along the

property line between the business and surrounding residential districts in order to comply with
the zoning code. This wall or fence will need to cross the existing driveways on the south side of
the tire facility and may result in loss of access to the facility from Eleventh Street on the south
side of the subject property, where vehicles are currently stored along a very wide driveway.
The wall or fence would also cross the driveway of the subject property. The erection of a
screening wall or fence may serve as an improvement for neighboring residents by screening the
view of the tire operation and eliminating the Eleventh Street access to the facility.
Traffic volumes have increased dramatically on E 86" Street N over the last several years and
will continue to increase as the growth in the Fairways and other areas to the west continues.
Certainly development pressure has increased along with the traffic counts. But changing
conditions should not automatically result in a modification of the comprehensive plan.
Accommodating growth and protecting the existing neighborhood are both objectives.
Fortunately, there are often practical ways to fulfill both objectives. The expansion of the zoning
district will not result not create an extremely large property. The resulting tract on the southeast
comer will only be approximately 1/2 acre. As long as commercial activity is oriented towards E
86' Street N, the impact on the abutting neighborhood to the south is manageable. In this case,
staff is comfortable with the degree of protection that the screening wall or fence will provide.
Notice of this zoning change was published in the Owasso Reporter and letters were sent to
property owners within 300 feet of the proposed zone change. A sign with information relevant
to the proposed zoning change was also posted on the subject property.
RECOMMENDATION
Staff recommends approval of the zoning change as submitted.

REQUESTED ACTION AND PURPOSE: A request for rezoning of 14.76 acres, more or less,
from RS -3 (Residential Single - Family High Density District) and OL (Office Low Intensity
District) to CS (Commercial Shopping Center District) (12.17 acres), from RS -3 and OL to OL
(2.19 acres), and from OL to RS -3 (0.40 acres).
LOCATION AND SIZE: The subject property is located north of E 96' Street N, west of the
Owasso Expressway. The subject tract is located in the interior of the SE /4 (NW /4 SWA SE /4)
of Section 17, T -21 -N, R -14 -E. This rezoning is similar to case (OZ- 99 -01), though somewhat
larger. The proposed rezoning of 14.76 acres will create additional room for commercial
development to front on the north side of E 96'b Street N. The rezoning proposes to add 12.17
acres of CS property, to be surrounded a 2.19 acre buffer strip of OL zoning.
The OL portion of the proposed rezoning will join with an existing buffer strip to the east of the
subject tract. The buffer strip is only 50 feet wide. This strip is suitable for a landscape
easement that will separate commercial from abutting residential property.
A map of the proposed rezoning and legal description of the subject property and proposed zoning
districts are attached for your information and review.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The surrounding property is undeveloped and zoned RS -3 to the
north and west, and CS to the east. Approximately 300 feet north of the subject property, Bailey
Ranch Estates II is under construction. The ONG building is located to the south across E 96a'
Street N. The proposed rezoning, which includes a 50 foot OL (landscape) buffer, makes adequate
provisions for the separation of land uses.

SITE INFORMATION: The site is relatively flat and serves as agricultural land. Although the
subject property lies within the service area of the Rural Washington Water District #3, there is also
a City 12 -inch water main available on the north side of E 96'b Street N. An 8 -inch sewer line is
available to the south of the subject property approximately one - eighth mile to the west of the
subject property. No obvious barriers to development were noted in the staff review.
ANALYSIS
The 1985 comprehensive plan update indicates high intensity industrial uses to be appropriate for
the subject property as well as for property to the east to the Owasso Expressway. The Johnson
rezoning has rendered this portion of the comprehensive plan obsolete. Instead, the Johnson
rezoning (April 1998) provides for a combination of commercial shopping center and single -
family high- density residential. Light office district serves as a buffer between the contrasting
uses. The OL zoning is too narrow for development and serves to provide room for a landscape
easement.
A conceptual master development plan was submitted with the April 1998 rezoning. The
original plan indicates that the major commercial shopping facility would front on the Owasso
Expressway. The proposed rezoning, like the previous rezoning (OZ- 99 -01), represents a minor
change that would allow the major tenant to front on E 96'b Street N. This change in zoning is
consistent with the previous zoning actions and will result in only a minor change in the previous
development plan.
The continued development of this property will require careful planning. The inclusion of
landscape easements, access points, and acceleration/deceleration lanes during the platting
process will be critical for the successful development of the property. The proposed zoning
change is consistent with previously approved changes, and there are no obvious barriers to
development noted at this time.
Staff recommends approval of OZ- 99 -04.

OWASSO FIRST CHURCH OF THE NAZARENE
DATE: April 6, 1999
APPLICANT AND STATUS OF APPLICANT: Owasso First Church of the Nazarene,
purchaser.
REQUESTED ACTION AND PURPOSE: The applicant proposes rezoning of 5.00 acres, more
or less, from AG (Agriculture District) to OM (Office Medium Intensity). The applicant plans to
construct a church on this site.
LOCATION AND SIZE: The subject property is generally located on the west side of N 145' E
Avenue, north of E 86' Street N.
EXISTING LAND USE: The subject property is undeveloped.
SURROUNDING LAND USE: To the west and south of the subject property, Silver Creek
Addition is now under development. To the east of the property, across N 145' E Avenue is the
Preston Lakes development. To the north is an additional undeveloped 2'h acre tract.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", Chapter 3 "Agricultural District Provisions ", and Chapter 5 "Office District
Provisions ".
ANALYSIS
The Church of the Nazarene is requesting OM (Office Medium Intensity) zoning on the subject
property because it is the lowest intensity zoning district that will allow a church by "right" and
not by special exception of the Board of Adjustment. However, all zoning cases should be
addressed without respect to the exact use and attention should be paid to all possible types of
development that the requested district will allow. The 1985 Comprehensive Plan for Owasso
recommends medium intensity commercial on the northwest comer of E 86' Street N and N 145'
E Avenue, surrounded by medium intensity residential, then low density residential. The subject

property lies in a low density residential area along N 145b E Avenue. The Elm Creek sewer
interceptor now under construction has increased the development potential of the entire area.
Preston Lakes to the east and the Greens at Owasso to the south are examples of higher intensity
land use than was predicted by the 1985 comprehensive plan. The proposed OM zoning will be
located across the street from commercial development in the Preston Lakes (a pending case also
on this agenda). The proposed zoning appears very consistent with the development patterns
unfolding in this area.
Because of the increased development intensity nearby, both proposed and existing, staff supports
enlarging the land area on both sides of N 1451e E Avenue, north of E 8611 Street N for
commercial and office purposes. Staff recommends that the comprehensive plan be amended to
reflect these changes during the normal course of the update process that is now underway.
Any development on the subject tract will need to be preceded by a plat and site plan. These
items will be reviewed separately by the Planning Commission.
Notice of this zoning change was published in the Owasso Reporter and letters were sent to
property owners within 300 feet of the proposed zone change. A sign with information relevant
to the proposed zoning change was also posted on the subject property.
Staff recommends approval of the zoning change as submitted.

BACKGROUND
Please note that this zoning change is substantially identical to a previous case (0Z-98 -11),
which was approved by the Planning Commission and City Council in July and August of 1998.
The plan is virtually the same as the original submission, but includes an additional 60 acres to
the original 254 acres. The applicant submitted a certified list of residents living within 300 feet
of the subject property. Unfortunately, an omission of several houses was later discovered. The
failure to notify all residents within 300 feet of the proposed zoning change resulted in an
invalidation of the previous action.
APPLICANT AND STATUS OF APPLICANT: The applicant is Preston Lakes LLC.
REQUESTED ACTION AND PURPOSE: The applicant proposes a rezoning of 314 acres of
land, more or less, currently zoned AG (Agriculture). The applicant is also requesting a PUD
supplemental zoning district described in the Preston Lakes PUD application elsewhere in this
agenda. The proposed zoning change and PUD will serve as a large, mixed -use development,
including commercial, multi - family apartments, and single - family housing.
LOCATION AND SIZE: The subject property is located in the south half of Section 22, T -21-
N, R -14 -E, City of Owasso, Rogers County, Oklahoma, generally located north of E 86" St. N
between N 145' E Ave. and N 161' E Ave. The proposed zoning is as follows: from AG to RS-
2 (Residential Single - Family Medium Density District) ± 260.03 acres, RM -2 (Residential Multi -
Family District) ± 12.6 acres, CS (Shopping Center District) ± 21.67 acres, OM (Office Medium
Intensity) ± 15 acres, and CG (General Commercial District) ± 5.0 acres.
The subject property was annexed in June 1998 and is the first parcel of land in Rogers County to
become part of the City of Owasso. The planned Elm Creek Sewer Interceptor will, for the first
time, make development to City of Owasso standards in Rogers County feasible. The interceptor
will have the capacity to serve this area as well as other tracts of undeveloped land nearby.
The 1985 Owasso Comprehensive Plan recommends medium intensity commercial, surrounded
by medium intensity residential for the northeast corner of E 86" St. N and N 145" E Ave.

Although the proposed CS (Shopping Center Commercial), CG (General Commercial), and RM-
2 (Residential Multi - Family) Districts are slightly larger than the 1985 plan suggests, the
importance of this node has also increased. When the comprehensive plan was drafted 12 years
ago, few predicted that this area would have so much potential for development. Unforeseen
conditions such as the growth of the 86' St. corridor and construction of the sewer interceptor
have changed the outlook for this area. These changing conditions should be accounted for in the
Comprehensive Plan update currently being developed.
The Comprehensive Plan also calls for low- density residential development on the remainder of
the tract. The developer proposes an appropriate RS -2 (Residential Single - Family Medium
Density) District for the same area. Large floodplain areas near Elk Creek would make a full
build out of this site very costly and difficult. In the accompanying PUD plan, the developer
shows large tracts of open space conserved in these floodplain areas.
Notice of this zoning change was published in the Owasso Reporter and letters were sent to
property owners within 300 feet of the proposed zone change. A sign with information relevant
to the proposed zoning change was also posted on the subject property.
The zoning proposal for this tract appears to generally conform with the existing Comprehensive
Plan, and to the Owasso Zoning Code. Staff recommends approval of the zoning proposal as
submitted.

BACKGROUND
Please note that this is a resubmission of OPUD -15, which was approved by the Planning
Commission and City Council in July and August of 1998. The plan includes an additional 60
acres to the original 254 acres. The additional 60 acres includes a church site.
The applicant, Preston Lakes LLC, proposes a Planned Unit Development (PUD) on ± 314
acres, located in the south half of Section 22, T -21 -N, R -14 -E, City of Owasso, Rogers County,
Oklahoma, generally located north of E 86" St. N between N 145" E Ave. and N 161x` E Ave.
The applicant proposes up to 500 single - family detached dwelling units, 80 villas/townhouses,
and up to 450 multi - family units, and ± 11 acres of commercial development with a maximum
floor area of 217,800 square feet.
The proposal for Preston Lakes PUD is quite large, and made possible only by the new Elm
Creek Sewer Interceptor, which should be completed this spring. The developer proposes a
combination of single - family housing ( ±159.6 acres), villa townhouses (±8.0 acres), multi - family
apartments ( ±18.5 acres), a church site ( ±15.0 acres), and commercial (±42.7 acres). The
developer also proposes a ±70.2 acre park, in areas which do not lend themselves to
development, primarily because of the floodplain. A goal of the development is to fulfill a need
for a diverse range of housing and living types, reflective of the needs of today's and tomorrow's
Owasso resident.
The proposal offers a wide variety of land uses on a single site, and the developer proposes to use
the topography, as well as other natural and man -made features to separate the more intense from
the less intense land uses. The highest intensity land uses are shown at the southwest corner of
the property, near the intersection of E 86" St. N and N 145" E Ave. The plan proposes
commercial and multifamily development. Commercial activity is concentrated on N 145" E
Avenue and increases in intensity as one draws near the intersection with E 86m Street N. The
proposed commercial /office and multi- family areas are somewhat larger than what was originally
called for in the 1985 Comprehensive Plan. However, there are several factors that justify
increased intensity at this location:

1. The Elm Creek Sewer Interceptor will allow residential development at a higher
intensity than the 1985 plan anticipated. A balance that allows some multi - family
represents an efficient use of this new infrastructure. Additionally, more commercial
and office to serve these areas is also appropriate,
2. More specifically, the development of the Greens at Owasso apartments to the
southwest of the subject property, and the higher intensity residential proposed within
the proposed PUD highlight a particular need for commercial services within the
immediate area,
3. Approximately 20% of the commercial/office area is proposed for a church site.
Churches certainly have periods of peak land use intensity, but overall the intensity is
low and they are generally compatible with residential and other low intensity uses,
4. An additional 25% of the commercial area will be needed for drainage ponds that will
alleviate an existing condition, the intermittent flooding of E 86"' Street near 1451" E
Avenue (Note: the development will not be able to completely prevent the more
frequent flooding that occurs midway between N 145' and N 161' E Avenues). The
drainage areas will also provide capacity for neighboring proposed residential sites.
5. As with many PUDs, the proposed maximum intensities represent development limits
that are often difficult, impractical, or unmarketable due to the natural constraints of
the site, even with the added flexibility that the PUD allows.
Because of the increased development intensity nearby (proposed and existing), as well as the
natural features and drainage conditions that occur in this area, staff supports increasing the land
area for commercial and office purposes and recommends that the comprehensive plan be
amended during the normal course of the update process that is now underway.
With such a large site, the developer is seeking flexibility in the form of a PUD. The developer
anticipates that it will take at least five years to develop this site and believes that the PUD will
grant him the flexibility he needs to adapt to changing market conditions.
As we review the proposal, it is important to also review the PUD, in terms of.
1) Its flexibility as a supplemental zoning district,
2) Adherence to the underlying zoning districts,
3) And variance from the outline development plan presented with this agenda.
Chapter 8, Planned Unit Development, describes the purpose of the PUD. Generally, a PUD
permits flexibility within the development, while preserving open space, maintaining appropriate
limits on the character and intensity of land use, and assuring compatibility with the adjoining
and proximate properties.
The developer is given the flexibility to arrange land use freely within the PUD, irrespective of

the location of the underlying zoning districts. However, the aggregate land use must conform to
the underlying zoning. For instance, the developer proposes 5 acres of CG commercial uses.
He can place those land uses anywhere on the tract so long as, in the end, he does not exceed the
proposed 5 acres.
The Planning Commission can act to prevent through the prescription of buffering, screening,
and setbacks during the platting process. At this time, the proposed outline PUD appears to have
adequate buffering to ensure compatibility of land uses.
Within the PUD, the developer has provided a set of Development Standards for each type
development proposed in the PUD. Minimum standards for Single - Family Detached Residential
(Executive and Premier Homesites), Single - family Attached (Villas), Multifamily, and
Commercial, are given in the text of the PUD. During the platting process, a review of the
proposed Development Standards will ensure that the developer adheres to these standards and is
consistent with the Outline Plan. Any deviation should be in conformance with the proposed
development standards, or the underlying zoning code.
TAC COMMENTS
The original 254 acre plan was reviewed by the Owasso Technical Advisory Committee July 29,
1998. They offered the following comments:
Community Development Department
1. 1985 comprehensive plan recommends medium intensity commercial, surrounded by
medium intensity residential. The commercial area is larger than plan suggests. Since
the new sewer interceptor has helped to increase the significance of this node, the
Comprehensive Plan should be revised to reflect new conditions,
2. Need more detail on commercial area: parcels and traffic flow, including curb cuts,
3. 1985 Comprehensive Plan calls for medium intensity housing surrounding commercial.
Multifamily is slightly larger than plan recommends and of higher intensity. Recommend
a strong integration with and clear access to open space in neighboring park. Also
recommend clear pedestrian access through commercial areas for access to schools.
Additional screening and vegetative buffering to the north,
4. Plan shows 372 single - family lots, reconcile with Data Summary.

The developer addressed those issues satisfactorily. An additional review of the new submittal
was conducted on March 23, 1999. No additional recommendations were made.
PUBLIC HEARING AND PLANNING COMMISSION ACTION
The Owasso Zoning Code, Section 880.5, requires the Planning Commission to determine the
following:
a) Whether the PUD is consistent with the Comprehensive Plan. The underlying
zoning for the PUD very closely resembles the land use called for in the 1985
Comprehensive Plan. A copy of the land use map is attached herein. The overall
densities for residential and commercial would be very consistent with the
Comprehensive Plan. Although the commercial and higher density housing areas are
slightly larger (about 25 %) than the plan calls for, the importance of this node has
also increased.
Unfortunately, the Comprehensive Plan does not provide any direct guidance in the
use of the PUD. The Comprehensive Plan Map of 1985 includes text that was
drafted in 1978. At that time, the PUD was not widely used. As a result, there is no
information regarding the PUD in the Comprehensive Plan. The flexibility in land
use that is allowed within a PUD may reallocate densities recommended in the
comprehensive plan. As a result, the Planning Commission may look at overall the
density recommended in the plan with the understanding that geographical constraints
may prevent an exact duplication of the recommendation of the comprehensive plan.
For additional guidance in the use of PUDs, we can tam to the Zoning Code,
Chapter 8, regarding Planned Unit Development. The PUD was created to address
certain conditions and situations where conventional zoning would be ineffective, or
even detrimental. Such conditions might include unique topographical
considerations. Elm Creek may qualify as a unique situation.
b) Whether the PUD is in harmony with the existing and expected development of
surrounding areas. Surrounding land uses can be broken down into three affected
areas:
1) Areas near the proposed commercial. Around the proposed commercial
area lies: an undeveloped 80 acre tract to the north, Hodson Elementary and
additional undeveloped land to the south, and Silver Creek Addition that will
likely expand to abut some of the commercial areas of the PUD along 145d' E
Ave. Near the intersection of 86' St. N and 145' E Ave., 7 acres of
commercial development is anticipated. The commercial areas appear to be
compatible with the surrounding land use, both existing and anticipated. A
buffer to the north is recommended (and shown in the text addendum to the

PUD included in this packet), simply because the commercial area is
relatively large, and the anticipated development in the 80 acre tract will
likely of a lower density. The developer will need to pay special attention to
pedestrian movement to ensure complete compatibility with the elementary
school (this is also reflected in the text addendum).
2) Areas near the proposed multi- family. Again, the multi- family area is
fairly insulated. The 80 acre tract lies to the north, proposed commercial to
the west across a buffer zone, proposed single- family to the east across a
buffer zone, and vacant land to the south across 86`s St. N, also buffered.
The proximity to Hodson Elementary is desirable for families with children
who may live in the multi - family area. Nearby convenience commercial is
also a plus for higher density residential as it may help to reduce the overall
number of vehicle trips. The developer has tried to ensure that the multi-
family will be compatible with surrounding land use.
3) Areas near the park and single- family development. Single - family
housing is proposed to abut the rear lots of existing estate lots to the north.
Although the proposed housing will probably be of a higher density, the
abutting properties are reasonably compatible with one another. In addition,
the proposed park could serve as an amenity for all of the neighboring
properties. The Premier Homesites in the SE comer of the PUD will be
located opposite existing estates lots to the south across E 86' St. N. Again,
this should be compatible with existing land use. The proposed Villa
townhouses will be located to the north of the Premier Homesites and south
of the park. Although this is a higher density development, the proximity of
the park should provide openness and feeling of space. A large undeveloped
40 acre strip along N 161' E Ave. abuts the proposed PUD to the east. This
may be developed as residential, or a combination of residential and
commercial near the intersection of 86' St. and 161' E Ave. Both of these
possibilities will be reasonably compatible with the surrounding park and
residential areas.
In summary, the developer has located each of the proposed land uses appropriately
within the development. The strategic location of each land use should result in very
few incompatibilities with the surrounding land uses. The possibility of a well-
maintained park nearby may even enhance the quality of life of the neighbors.
Under the rules of the PUD, the developer has the ability to reallocate each of these
land uses within the development. If the developer chooses this option, the Planning
Commission may require additional buffering to ensure compatibility in and around
the development.
c) Whether the PUD is a unified treatment of the development possibilities of this
site. The unified treatment of the site begins with an understanding that construction
in the floodplain should be avoided; a sound decision. Rather than concentrate on
increasing the amount of developable land, the creators have tried to made the open
space a key feature which ties the development together, enhancing the value of the

remaining properties. In return for preserving the open space, the developer is
requesting that the Planning Commission allow him to develop at higher densities in
the areas that are more suited to development.
The additional 60 acres that has been added is somewhat less integrated with the
original 254 acres, but street there is a street connection that physically ties the PUD
together. Staff also recommends a pedestrian access connection in the southeast
comer of the additional 60 acres. This will facilitate access to the proposed park.
d) Whether the PUD is consistent with the stated purposes and standards of the
Zoning Code, Chapter 8, Planned Unit Development. The purpose of the Planned
Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes
PUD. The PUD would:
1) Permit innovative land development while maintaining appropriate limits on
the character and intensity of use and assure compatibility with adjoining and
proximate properties;
2) Permit flexibility within the development to best utilize the unique physical
features of the particular site;
3) Provide and preserve meaningful open space;
4) Achieve a continuity of function and design within the development.
The PUD also conforms to the standards set forth in Chapter 8. The developer has
submitted the appropriate application materials and has established a plan that should
conform to the requirements of the Owasso Zoning Code. Staff does not anticipate
any difficulties in the administration of the Preston Lakes PUD as proposed. Certain
details regarding ownership of the park and maintenance of drainage facilities are
unresolved but it is not necessary to resolve these issues for approval of the PUD
concept. Maintenance agreements as well as dedication of land for public purposes
can and should be resolved during the platting process.
RECOMMENDATION
Staff recommends approval of the PUD subject to the following conditions:
A. That the applicant's Development Text, Text Addendum, and Conceptual Development Plan
be considered to be the Outline Development Plan as required by the PUD Chapter of the
Owasso Zoning Code;
B. That unless specifically set out in the standards and conditions of this PUD, single - family
development shall meet the requirements of a typical RS -2 district,
C. That unless specifically set out in the standards and conditions of this PUD, multi - family
development shall meet the requirements of a typical RM -2 district,

D. That unless specifically set out in the standards and conditions of this PUD, shopping center

F. That within the PUD, the maximum number of dwellings shall not exceed 1,030. (530 multi-
family, 500 single - family)
G. That minor transfers (10% increase in a development area's density) of dwelling units from
one residential development area to another can occur if a significant change in the character
of either development area is not created.
H. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision
plat approval be met as conditions of the PUD.
I. That a detailed drainage report be submitted at the time of platting, and certification of such
document by an engineer.
J. All covenants of any subdivision plat containing property within the PUD shall incorporate
all PUD standards and conditions of approval and make the City of Owasso beneficiary.
K. That no building permits be issued within any portion of the PUD until all criteria outlined
within Chapter 8 of the Owasso Subdivision Regulations are met by the developer.
L. Acceleration/Deceleration lanes at each access point to the subject property along the arterial
streets (two locations on E 86'h St. N, one location on N 1450, E Ave.).
M. The inclusion of sidewalks along the abutting arterial streets and the interior drives within the
proposed development.
N. That the applicant provides easements for pedestrian accessways between lots as required by
the Planning Commission to facilitate access to the proposed park. The location of these
accessways shall be determined as the development evolves to the platting stages,
0. The submittal of detailed landscaping plans to be submitted at the time of site plan review,
said plans to be reviewed by staff and the Planning Commission for approval.
P. The Planning Commission reserves the right to prescribe additional buffering, screening, and
setbacks during the platting process. To the extent that the developer chooses to vary from
the outline PUD, the developer can and should expect additional buffering requirements as is
necessary to ensure compatibility with surrounding land uses.

Supplement To Planned Unit Development for Preston Lakes,
Dated July 15, 1998, As Previously Submitted To City of Owasso, Oklahoma
This supplement hereby adopts and incorporates herein each and every aspect of the Planned Unit
Development for Preston Lakes, Dated July 15, 1998, as previously submitted to the City of
Owasso, as well as Addendum #1 thereto Dated August 4, 1998 (hereafter collectively referred
to as "The Original PUD').
This supplement to the Original PUD is for the purpose of adding thereto an additional Sixty (60)
acre tract of land located adjacent to the 254 acre tract referred to in the Original PUD. The
Development Concept of the new 314 acres will remain the same. Naturally, the Statistical
Summary regarding the total project area and the related number of dwelling units, floor areas,
etc., will increase somewhat with the addition of the new 60 acres. I have attached to this
supplement as "Attachment 1" a revised Statistical Summary indicating the new project areas,
dwelling units, floor areas, etc. The Existing Conditions on the additional 60 acre site are quite
similar to the conditions found along and within the original 254 acre site. Similarly, the Existing
Utilities Analysis contained in the Original PUD are still applicable to the larger 314 acre tract.
Insofar as the Hydrology Analysis is concerned, the storm water retention for the entire 314 acres
shall be accomplished within the park area and open space buffers.
The Soil Analysis and the Surrounding Zoning Analysis are exactly as contained in the Original
PUD. The Proposed Zoning for the original 254 acre site is precisely as originally set forth in
the Original PUD. The proposed Zoning for the additional 60 acre tract is set forth on that certain
document known as Preston Lakes Preliminary Master Plan - Underlying Zoning, dated March
10, 1999, and submitted simultaneously herewith.
All of the Development Standards contained in the Original PUD are applicable to this
supplement, as well. The only necessary addition is regarding 15 acres of OM zoning which has
been included within this supplement for the purpose of allowing Central Baptist Church, Inc.
to construct a church facility on said 15 acre site. This 15 acre site is located in the Northwest
Comer of the project, with 660 feet of frontage along 145th East Avenue. The development
standards for the OM zoning are set forth on "Attachment 2" hereto. All other aspects of the
Original PUD are hereby incorporated into this supplement, including, but not limited to, those
portions of the PUD addressing: A) Homeowners' Association, B) Unit Transfer, C) Architectural
Review Committee, D) Site Plan Review and Platting Requirement and E) Expected Schedule
of Development.

BACKGROUND
The City of Owasso has received a request to review a preliminary plat for Preston Lakes, an 86.09
acre, 261 lot subdivision located in the southwest quarter of Section 22, T -21 -N, R -14 -E, Rogers
County, Oklahoma. The subject property is located on the north side of E 86' Street N, east of N
145' E Avenue.
The property represents approximately one -half of the proposed Preston Lakes PUD. At this time
the subject property is zoned AG (Agriculture). Please note that affirmative approval by Council of
the Preston Lakes PUD (OPUD -15) as well as the underlying zoning (OZ- 99 -06) should be made a
condition of approval of this plat. The Preston Lakes PUD and rezoning were originally presented
in August 1998. However, the application contained an error in the property owner's list and as a
result not all property owners within 300 feet were notified. The rezoning was considered invalid.
The Technical Advisory Committee reviewed the preliminary plat at their March 23, 1999 regular
meeting. PSO noted that an overhead line would be located along the southern edge of Block 7 and
the eastern edge of block 4. City Community Development staff noted that there was only one
street connection between Phase I and Phase II to the west. As a result, access to the proposed park
was somewhat restricted. Staff noted that also the park is relatively near, the path of travel along
existing streets to the park could exceed %: mile. To facilitate pedestrian access to the park, staff
recommended pedestrian access easement between Phase I and Phase II. The access easement
should be at least 15 feet wide and should provide east/west pedestrian access through the center of
the platted area. The access should provide service for multi- family as well as the single - family
development in the subdivision. No other comments or recommendations were received.
The construction plans are separate process from the platting process. Applicants are required to
submit construction plans between the preliminary and final plat stages of development. The final
plat will not be acted upon by the City Council until construction plans are approved by the
Engineering Division of the Public Works Department, and water and sewer permits have been
issued by the Oklahoma Department of Environmental Quality.
Staff recommends approval of the plat with the condition that a pedestrian access easement
connecting Phase I and Phase II through the center of the development will be shown in the final
plat.

Lewis Dean Lowe and Donald Allen Lowe, the owners, have submitted a petition to the City of
Owasso requesting annexation of property totaling approximately 10.00 acres, more or less. The
subject property is described as a tract of land in Section 7, Township 21 North, Range 14 East,
Tulsa County, Oklahoma. The subject property is located on the south side of E 116's Street N,
east of the Owasso Sports -Plex.
The subject property lies in unincorporated Tulsa County but is completely surrounded by the City
of Owasso. The City of Owasso Annexation Policy indicates that normally tracts of 20 acres or
more are desired, the fact that this tract is surrounded the City of Owasso makes it a likely
candidate for annexation, regardless of its size.
To the north of the subject property across E 116'b Street N lies entrance to Country Estates III, to
the south is Hale Acres Addition, to the west is the Owasso Sports Complex, and to the east is
approximately 5 acres of undeveloped land zoned AG (Agriculture).
The subject property is that it is zone CS (Commercial Shopping Center) in Tulsa County. An
atypical aspect of the proposed annexation is that the applicants have requested in their petition that
the property be assigned the same CS (Shopping Center) designation in the City of Owasso.
Section 110.3 (b) of the Owasso Zoning Code specifically allows Council to annex and rezone
property in one ordinance for properties previous zoning in Tulsa County. Owasso annexation
policy specifically states that all annexed property given zoning designation of AG (Agriculture).
However, the "downzoning" of property may serve as a disincentive to many property owners
because of real or perceived losses in property value or limitations on land use. The combined
annexation and rezoning procedure removes this deterrent and may be favorably considered when
the proposed zoning is consistent with the comprehensive plan for our community.
The bulk and area requirements of the County and City districts are identical. There are some
variations in the allowable use units and the applicants have been informed of these changes.
Namely, in the City CS district, the applicants will lose the right to build single - family housing by

exception and gain the ability to build a gasoline service station by right (instead of by exception).
Notification of the annexation and rezoning request was published in the Owasso Reporter on April
1, 1999 to notify the public of the annexation request before the Planning Commission meeting on
April 13, 1999. That will be followed by notification published two consecutive weeks in the
Owasso Reporter on April 8, 1999 and April 15, 1999 to notify the public of possible City Council
action regarding the request on April 20, 1999. In addition to the annexation policy, a copy of the
procedures for annexation is also attached for your information and review.
The Owasso Annexation Committee reviewed the request at its April 5, 1999 special meeting. The
Committee unanimously recommended to approve the annexation request.
RECONEWENDATION
Staff recommends approval of the proposed annexation request.

ANNEXATION POLICY
While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the lowest zoning classification,
that is, AG, agricultural. Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the city will be legal,
but non - conforming, which means that they may continue but cannot be expanded without
proper zoning.
4. All public infrastructures that do not met city standards will not be improved by the city
until brought to the city standard and accepted by the City Council. Such public facilities
must be improved at owners expense by the establishment of a special assessment district
or some other financing method.
5. Where a city limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for
a six month period after rejection by the City Council.

FAIRWAYS IV EXTENDED

BACKGROUND
The City of Owasso has received a request to review a final plat for Fairways IV Extended
Addition, a 17.37 acre development adjacent to E 96 h Street N to the north, Fairways IV to the
south and east, and Bailey Ranch Golf Course to the west. The subject property is previously
unplatted land, proposing to contain 22 lots.
The property can be described as a continuation of residential development on the northern portion
of the golf course. The subject property is zoned PUD (Planned Unit Development) which allows
for several different types and sizes of single - family residential development. No commercial,
office, or multi- family development is proposed in this final plat. The lot sizes are larger than the
minimum standard in an RS -3 zoning district. Although the subdivision abuts E 96h Street N, there
are no new access points proposed on the arterial street. Instead, the subdivision will derive access
from a collector street in Fairways IV (N 101'` E Avenue). Drainage will be conveyed from east to
west and released into the drainage pond to the west of the subject property via a pipe to be located
between lots 10 and 11.
The Technical Advisory Committee reviewed the final plat at their March 23, 1999 regular
meeting. At that meeting, utility representatives and the Public Works department were invited to
comment on the proposed plat. Phil Lutz of the Public Works Department required a drainage
easement between Lots 10 and 11. Community Development staff noted that street names would
need to be completed on the plat. PSO required several utility easements that are shown on the
revised copy within your packet. There were no other concerns voiced regarding the plat.
The final plat will not be acted upon by the City Council until construction plans are approved by
the Engineering Division of the Public Works Department, and water and sewer pernuts have been
issued by the Oklahoma Department of Environmental Quality.
RECOMMENDATION
Having had all plat comments addressed by the applicant, staff is recommending approval of the
final plat of Fairways IV Extended.
