4. OZ -99 -07 — A & W Land Development — A request for rezoning of A request for
rezoning of 71.62 acres, more or less, from AG (Agriculture) District to RS -3
(Residential Single - Family High Density) District. The subject property is described as a
tract of land in Section 6, Township 21 North, Range 14 East, Tulsa County, Oklahoma.
The subject property is located to the northwest of N 109' E Avenue, adjacent to the
Country Estates II subdivision.
5. Preliminary Plat — Country Estates IV — A request for review of a preliminary plat for
Country Estates IV Addition, a 44.74 acre, 168 lot subdivision, located to the north of
Country Estates III and west of Country Estates 11 The subject property is described as part
of the S/2 of Section 17, T -21 -N, R -14 -E, Tulsa County, Oklahoma.
6. Preliminary Plat — Owasso Market — A request for review of a preliminary plat for
Owasso Market, a 7 lot subdivision described as part of the S/2 of Section 17, T -21 -N, R-
14 -E, Tulsa County, Oklahoma. The subject property is located on the north side of E
96' Street N, west of the Owasso Expressway (U.S. Highway 169).
Easement Closing — Reasor's — A request for the closing of a portion of a 15 foot utility
easement, located in an area proposed for a building expansion. The subject property is
described as Lot 1, Block 1, Clark Plaza Fourth Addition, also known as 11815 E 86'
Street N.
Site Plan — Reasor's Expansion — A request for review of a site plan for expansion of
Reasor's Grocery, 11815 E 86°i Street N, located on the north side of E 86' Street N, east
of the Owasso Expressway. The applicant proposes expanding the floor area by 7,500
square feet, and would result in the elimination of an alley located on the north side of the
building between Reasor's and Drug Mart.
9. Site Plan — Rib Crib — A request for review of a site plan for the Rib Crib restaurant, on
property described as Lot 4, Block 1, ROC Owasso. The 0.73 acre subject property is
located on the east side of N 129` E Avenue, south of E 86th Street N.
X10. Preliminary Plat — The Vyne — A request for review of a preliminary plat for the Vyne, a
one -lot, 4.50 acre, subdivision located in the S/2 SW /4 of Section 22, T -21 -N, R -14 -E,
Rogers County, Oklahoma. The subject property is located north of E 86'h Street N, east
of N 145' E Avenue, and is surrounded by the plat for Preston Lakes, and is a part of the
Preston Lakes planned development. If there are no objections, the plat will be reviewed
as a final plat.
11. Site Plan — The Vyne — A request for review of a site plan for the Vyne, a 50 room
assisted living facility proposed to be located on the north side of E 861' Street N, east of
N 145' E Avenue. The proposed facility is a part of the planned Preston Lakes
development.
12. Report on monthly building permit activity.
13. Report on planning items previously forwarded to City Council.

The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on April
9, 1999 at 3:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:03 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF MARCH 9, 1999 REGULAR
MEETING. - The Commission reviewed the minutes of March 9, 1999 Regular Meeting,
Bob Randolph moved, seconded by Bill Ellison to approve the minutes. A vote on the
motion was recorded as follows:

4. Assistant City Manager Tim Rooney to make request for Special Meeting of the Planning
Commission after the May 11, 1999 Regular Meeting. Ray Haynes presented the
possibility of a special meeting of the Owasso Planning Commission to be held the last of
May
5. OZ -99 -03 - Bob Ary - A request for rezoning from RS -3 (Residential Single - Family
High - Density District) to CG (General Commercial District) for Lot 7, Block 1, Nichols
Heights Addition. The applicant requests a rezoning of a 0.18 acre lot, more or less,
located on the south side of E 86d' Street N, east of Main Street. The subject property is
adjacent and to the east of the Owasso Tire Barn.
Theron Warlick presented the item to the Commissioners. He described the location of
the property and stated that the subject property is developed as a single - family residence.
Any expansion of the operation will require the erection of a screening wall or fence
along the property line placed between the business and the residential housing. If Mr.

Ary does not receive the approval for rezoning he will not need to erect a wall or fence.
Mr. Warlick stated that there is a need to accommodate growth and protect the existing
neighborhoods. The notice of the zoning change was published in the Owasso Reporter
and letters were sent to surrounding property owners. Mr. Bob Ary along with his
attorney, Mr. David Charney was present to answer any concerns or questions regarding
the request. Several surrounding property owners were present to voice their oppositions.
The following were comments /concerns expressed:
Mr. Burl Wilbanks - 201 East lls' - He presented a petition that was signed by the
majority of Nichols Heights residents opposing the rezoning. A total of forty -six
signatures were presented in the petition. Mr. Wilbanks read a portion of the covenants
concerning the restriction of this type of zoning. He also stated that it would degrade
their neighborhood and is a fire and health hazard. He feels that a screening fence or wall
would not change anything. He would like the rezoning denied.
Mr. Jack Morgan - 1012 North Ash - He was raised at this address and his mother still
resides there. There are problems with the gasoline trucks backing into his mother's
yard. Also trash is a huge problem. Would like the Planning Commission to deny the
rezoning request.
Theron Warlick stated that the City of Owasso does not enforce covenants and if the
surrounding property owners feel they need help regarding this problem, it would be a
civil manner. Mr. Warlick also stated that with the screening fence the traffic on 11'
Street would be lessened.
Mr. Charney addressed the Commissioners and surrounding property owners. He stated
that he would be willing to discuss the neighboring property owner's viewpoint but would
like to stress that the enforcement of covenants is a private matter. We need to look for a
way to accommodate growth, but maybe put some restrictions on Mr. Ary such as a
screening fence or wall. He also commented that sometimes screening could make
property look better than it did before. The Planning Commission can control the
problems with the site plan when it is reviewed.
Bob Randolph questioned the applicant regarding the semi trucks that have been left at
that location. Mr. Ary stated that he would move them if he needed to.
Ray Haynes moved to approve the rezoning request, subject to the erection of a screening
wall or fence along the property line between the business and surrounding residential
district. Charles Willey seconded the motion. A vote on the motion was recorded as

6. OZ -99 -04 - Charles Norman - A request for rezoning from OL (Office Low Intensity
District) and RS -3 (Residential Single - Family High - Density District) to CS (Shopping
Center District), OL, and RS -3. The subject property is located on the north side of E
96' Street N, west of the Owasso Expressway and contains 14.76 acres, more or less.
Theron Warlick presented the item and described the location of the property. He stated
that the OL portion of the proposed rezoning will join with an existing buffer strip to the
east of the subject tract. Ray Haynes had concerns regarding the OL portion of this
proposal. The Charles Norman, the applicant stated that the OL strip would be a road to
get around to the back side of the businesses but, will not lead to the loading areas, the
loading areas will be on the sides of the businesses. Mr. Norman also addressed curb cut
concerns.
Charles Willey moved to approve the rezoning request, Larry Helton seconded. A vote

7. OZ -99 -05 - Owasso First Church of the Nazarene - A request for rezoning from AG
(Agriculture District) to OM (Office Medium Intensity District) for a +5.0 acre tract,
located on the west side of N 145' E Avenue, North of E 8601 Street N.
Theron presented the item stating that The Church of the Nazarene is requesting OM
(Office Medium Intensity) zoning on the subject property because it is the lowest intensity
zoning district that will allow a church by "right ". Charles Willey questioned whether
the surrounding property owners are comfortable with the rezoning proposal. Mr. David
Charney stated that he was very comfortable and happy to have the church under way
across the street from Preston Lakes development. Mr. Tom Kimball stated that he was
in support with the rezoning and the church will be a great addition to the community.

8. OZ -99 -06 - Preston Lakes L.L.C. - A request for rezoning of +314 acres currently
zoned AG (Agriculture District). The subject property is located in the south half of
Section 22, T -21 -N, R -14 -E, City of Owasso, Rogers County, Oklahoma, generally
located on the north side of E 86° St. N between N 145' E Ave. and N 1615` E Ave. The
proposed zoning is as follows: from AG to RS -2 (Residential Single - family Medium
Density District) + 260.0 acres, RM -2 (Residential Multi - family District) + 12.6 acres,
CS (Shopping Center District) + 21.67 acres, OM (Office Medium Intensity District) +
15.0 acres, and CG (General Commercial District) + 5.0 acres.
Theron Warlick presented the item to the Commissioners. He stated that he would like to
address the zoning and the PUD case at the same time but a separate vote would be
required. The subject property was annexed into the City of Owasso in June 1998. The
Elm Creek sewer interceptor will have the capacity to serve this area. This request is for
approximately 314 acres of AG (Agriculture) to a mixed -use proposal. Notice of the
zoning change was published and letters were sent to property owners within 300 feet of
the proposed change. Staff recommends approval of the rezoning request and the PUD
but would like to have the removal of the word "setbacks" from Item P. Concerns were
also expressed regarding the acceleration/deceleration lanes that will be required and the
escrow accounts being set up. Ray Haynes questioned the time frame on the intersection
repairs and the time frame on the escrow accounts. Mr. Charney had concerns with
building the acceleration/deceleration lanes if they are going to be torn out. He stated that
the lanes and the sidewalks need to be constructed in coordination with the bond issue.
The following are concerns expressed by several surrounding property owners:
Rene Koesler - 15702 E 92 St No - He had received notice to property owner letter and
opposes any development in that area. He stated that he did not want to see traffic
problems or problems with flash flooding.
Dave Thompson - Whispering Pines - Concerns with the size of the lots that will be in
Preston Lakes. Drainage concerns also.

Susan Kapuchuck - Whispering Pines - Concerns with high waters during a heavy rain.
Questioned if she could possibly get on city sewer eventually.
Mr. Charney explained that this is a zoning case not a site plan review. The Planning
Commission would address lot size concerns and joining 9151 Street when the site plan is
reviewed. He also stated that since this is a PUD, a building permit in the park area
would not be permitted. He also discussed the PUD condition mandating privacy fences
and trees.
Tom Kimball the developer of SilverCreek stated that he has a large amount of money
invested in the area and feels very comfortable that a good job will be done.
Ray Haynes moved to approve the rezoning, subject to staff recommendations. Bob

9. PUD 15 - Preston Lakes - A request for review of a planned unit development on +314
acres, located in the south half of Section 22, T -21 -N, R -14 -E, City of Owasso, Rogers
County, Oklahoma, generally located north of E 86b St. N between N 145' E Avenue
and N 1615` E Avenue. The development includes the addition of 60 acres on N 145'" E
Avenue but is otherwise identical to the plan reviewed by the TAC in July 1998.
Theron Warlick presented the case and described the subject property. This item and
item # 8 was addressed at the same time.
Staff recommends approval of the PUD subject to the following conditions:
A. That the applicant's Development Text, Text Addendum, and Conceptual
Development Plan be considered to be the Outline Development Plan as required
by the PUD Chapter of the Owasso Zoning Code;
B. That unless specifically set out in the standards and conditions of this PUD,
single - family development shall meet the requirements of a typical RS -2 district.
C. That unless specifically set out in the standards and conditions of this PUD, multi-
family development shall meet the requirements of a typical RM -2 district,
D. That unless specifically set out in the standards and conditions of this PUD,
shopping center commercial development shall meet the requirements of a typical

CS district.
E. That unless specifically set out in the standards and conditions of this PUD,
general commercial development shall meet the requirements of a typical CG
district.
F. That within the PUD, the maximum number of dwellings shall not exceed 1,030
(530 multi - family, 500 single - family)
G. That minor transfer (10% increase in a development area's density) of dwelling
units from one residential development area to another can occur if a significant
change in the character of either development area is not created.
H. That all conditions imposed by the Owasso Technical Advisory Committee for
subdivision plat approval be met as conditions of the PUD.
I. That a detailed drainage report be submitted at the time of platting, and
certification of such document by an engineer.
J. All covenants of any subdivision plat containing property within the PUD shall
incorporate all PUD standards and conditions of approval and make the City of
Owasso beneficiary.
K. That no building permits are issued within any portion of the PUD until all criteria
outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the
developer.
L. Acceleration/Deceleration lanes at each access point to the subject property along
the arterial streets (two locations on E 86' St N, one location on N 145' E Ave).
M. The inclusion of sidewalks along the abutting arterial streets and the interior drives
within the proposed development.
N. That the applicant provides easements for pedestrian accessways between lots as
required by the Planning Commission to facilitate access to the proposed park.
The location of these accessways shall be determined as the development evolves
to the platting stages,
0. The submittal of detailed landscaping plans to the submitted at the time of site plan
review, said plans to be reviewed by staff and the Planning Commission for
approval.
P. The Planning Commission reserves the right to prescribe additional buffering,
screening and setbacks during the platting process. To the extent that the
developer chooses to vary from the outline PUD, the developer can and should
expect additional buffering requirements as is necessary to ensure compatibility
with surrounding land uses.
Ray Haynes moved to approve the PUD subject to the sixteen (16) conditions stated
above, with a slight amendment on Item P with the removal of the word "setbacks ".

10. Preliminary Plat - Preston Lakes - A request for review of a preliminary plat for Preston
Lakes Addition, a 128.00 acre, 230 lot subdivision located on the north side of E 86'
Street N, east of N 145' e Avenue. The subject property is described as a subdivision in
the southwest quarter of Section 22, T21N, R14E, Rogers County, Oklahoma.
Theron Warlick presented the item. The property represents one -half of the proposed
Preston Lakes PUD. The Technical Advisory Committee reviewed the plat at their
March 23, 1999 meeting. Staff recommends approval of the plat with the condition that a
pedestrian access easement connecting Phase I and Phase R through the center of the
development will be shown in the final plat. The access should be at least 15 feet wide.
Concerns whether this is going to be a private park or a city park was expressed. Mr.
Charney assured the Commissioners that it is going to be a private park and the
Homeowner's Association will take care of it.
Ray Haynes moved to approve the Preliminary Plat, subject to the above staff
recommendations regarding a pedestrian access easement being provided. Charles Willey

11. Annexation - Lowe - A request for annexation of + 10.00 acres located in the Northeast
Quarter (NE /4) of Section 7, T -21,N, R -14 -E. The property is further described as a
tract on the south side of E 116" Street N, between Garnett road and Mingo Road (N97th
E Avenue), east of the Owasso Sports Complex. The property is currently zoned CS
(Commercial Shopping Center District) in Tulsa County and the applicants have requested
that the property be assigned the CS (Shopping Center District) designation by the City of
Owasso upon Annexation.
Theron Warlick described the location of the property. The subject property is
completely surrounded by the city limits of Owasso. Notification of the annexation and
rezoning request was published in the Owasso Reporter. The Annexation Committee

reviewed and approved the request on April 5, 1999 special meeting.

12. Easement Closing - Heritage Construction - A request to close a portion of a utility
easement on Lot 5, Block 6, Country Estates H. The subject property is located at 11106
E 120 Street N. A newly constructed home encroaches into the utility easement by a
distance of 0.1 feet.
Theron Warlick presented the request. The applicant requests that the Planning
Commission recommend approval of the closing of the westernmost 0.2 feet of the
easement. This will still need to go to Board of Adjustment to get the side yard variance
approved. The easement closing would run the full length of the property. The applicant
was present to answer concerns or questions regarding the closing.

13. Final Plat - Fairways IV Extended - A request for review of a final plat for Fairways IV
addition, an 8.23 acre, 22 lot subdivision described as part of the NW /4 NW /4 of Section
19, T -21 -N, R -14 -E. The subject property is located on the south side of E 96' Street N
to the West of Fairways IV Addition.
Theron Warlick briefed the Commissioners on this item. He stated the property could be
described as a continuation of residential development on the northern portion of the golf

course. It is zoned PUD which allows for several different types and sizes of single -
family residential development. The Technical Advisory Committee reviewed the final
plat at their March 23, 1999 meeting. All of the comments addressed at that meeting
have been addressed. Staff recommends approval of this plat.

14. Annexation Request - Owasso Public Works - A request for annexation of 20 tracts of
land of various sizes located in unincorporated Tulsa and Rogers Counties. Each tract is
located entirely within the public right -of -way and all are being annexed for roadway
improvements and maintenance.
This item was tabled until further notice.

APPLICANT AND STATUS OF APPLICANT: A & W Land Development, Inc., owner.
REQUESTED ACTION AND PURPOSE: A request for rezoning of 71.62 acres, more or less,
from AG (Agriculture) District to RS -3 (Residential Single - Family High Density) District to
allow for residential development.
LOCATION AND SIZE: The 71.62 acre subject property is described as a tract of land in
Section 6, Township 21 North, Range 14 East, Tulsa County, Oklahoma. The subject property is
located to the northwest of N 109' E Avenue, adjacent to the Country Estates II subdivision.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: Country Estates III and West Port Additions are located to the
south of the subject property. To the east of the subject property lies Country Estates H. Country
Estates II and III are zoned RS -3. West Port is zoned AG. Country Estates II is being developed as
single - family housing and Country Estates III is proposed to provide additional single - family
homesites for this rapidly growing area.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", Chapter 4 "Residential District Provisions ".
SITE INFORMATION: The site is relatively flat. The subject property lies in the service area of
Rural Washington Water District #3, although the City of Owasso, as a result of a 1988 court
settlement, will serve the southern portion. City of Owasso sewer is available to the site. No
obvious barriers to development were noted in the staff review.
ANALYSIS
The 1985 comprehensive plan update indicates low- intensity residential on the subject property
and the proposed RS -3 zoning is highly consistent with this plan. The proposed rezoning will
allow the continuation of residential development in the area. Access to the site is available via

City streets from three locations.
Notice was posted on the subject property and letters were mailed to residents within 300' of the
subject property. Notice also appeared in the Owasso Reporter. Staff received one call from a
resident on E 1200' Street to the west of the subject property in unincorporated Tulsa County.
She expressed a concern that she did not want street connection between the subdivision and her
street. Staff noted that the request, while not a zoning issue, will be conveyed to the Planning
Commission. No other objections were noted.
RECOMMENDATION
Staff recommends approval of OZ- 99 -07.

BACKGROUND
The City of Owasso has received a request to review a preliminary plat for Country Estates IV, a
44.74 acre, 168 lot subdivision. The subject property is located to the north of Country Estates III
and west of Country Estates II, and is currently zoned AG (Agriculture) District. An application to
rezone the property to RS -3 (Residential Single - Family High- Density) District is also included in
the agenda (OZ- 99 -07).
ANALYSIS
The Technical Advisory Committee reviewed the preliminary plat at their November 25, 1998. At
that meeting, utility representatives and the Public Works department were invited to comment on
the proposed plat. The requested easements are within your packet. A portion of the original 184
lot subdivision was located within the service area of Rural Washington Water District #3. Because
of questions regarding the design and construction of two water systems within the same addition,
the applicant has chosen to reduce the size of the plat by 16 lots and eliminate the portion that lies
in Rural Washington Water District. The City of Owasso will provide water to the remainder of the
subdivision.
The lot sizes conform to the requirements for an RS -3 District. Due to the unusual shape of the
subject property, there are approximately four triangular shaped lots in the proposed subdivision.
These lots are larger than typical, and offer the buildable space. N 108' E Avenue is shown as a
collector street and the plat indicates 60 feet of right -of -way. Although the shape of the addition
is somewhat unusual, the street pattern appears adequate, with most streets intersecting at right
angles and good sight distance is shown throughout the subdivision. The subdivision will tie into
existing developments at three locations: 1) To West Port Addition at the south end of N 107' E
Avenue, 2) To Country Estates III at the south end of E 118'" Court N, and 3) To Country
Estates II and N I 11 s E Avenue.
The applicant has satisfied platting requirements as required in the Owasso Subdivision
Regulations.

BACKGROUND
The City of Owasso has received a request to review a preliminary plat for Owasso Market, a 45.94
acre, 7 lot subdivision located in the S/2 of Section 17, T -21 -N, R -14 -E, Tulsa County, Oklahoma.
The subject property is located on the north side of E 96' Street N, west of the Owasso
Expressway.
The subject property is undeveloped land zoned CS (Shopping Center) District. To the south of the
subject property, across E 96's Street N, is the ONG facility located in the Oak Tree Business Park.
Areas to the north and west of the subject property are undeveloped and zoned RS -3 (Residential
Single - Family High - Density) District. A 50 foot strip of OL (Light Office) District is surrounds the
subject property and is intended to serve as a buffer strip between the abutting residential areas. To
the east of the subject property is the Owasso Expressway.
A press release and news article in the Owasso Reporter today indicated that the proposed plat
should serve as the location for a new supercenter grocery/retail outlet as well as an unnamed
department store and 10- screen movie theater. At 400,000 square feet, this will be the largest single
commercial development in Owasso. The applicant has submitted a plat that conforms to Owasso
zoning and subdivision regulations. In addition, staff has noted that the proposed Owasso Market
offers additional features that will also enhance vehicular access to the site. Areas of mutual access
are indicated in the gray shaded areas of the plat and only three points of access are shown opening
directly onto the E 96d' Street N. Two of these access points align with existing streets at ONG and
the exit ramp. The close proximity to the Owasso Expressway is an asset for a development of this
scale, as much of the traffic will be distributed directly onto the highway. A combination of
locational and access management considerations offer very promising indications that the
proposed development will minimize the potential for traffic problems.
The Technical Advisory Committee reviewed the preliminary plat at their April 28, 1999.
Comments are as follows:
A. Phil Lutz, OPWA
1. requested a statement in draft copy of covenants for the maintenance of common
(drainage) areas. Noted that detention would need to be constructed during the
first phase of development,
2. noted that the area was in the Ator Sanitary Sewer Relief area and that an

assessment of $325 /acre is required ($14,931 for 45.94 acres),
3. Sanitary sewer would need to be extended from east of ONG property to the west.
Phil suggested collaboration with Tanner who is designing new development on
the south side of E 96'h Street N,

5. Are 119'" and 98ffi Street public (yes)? Is proposed entrance across from ONG
entrance (yes)?
B. Phil Sewell, SWBT
1. Stated that they preferred a 17.5'perimeter easement instead of 11'. (Developer's
engineer noted that 50' R/W was being dedicated separately on the north and west
sides of the development and that would provide additional room for utilities),
C. Bob Pierce, PSO
1. Asked about the utility setback from adjacent MAE. (There is none.) Stated that
they would prefer not to have utilities paved over. (The developer's engineer
indicated that that was their plan.) Utilities agreed that they wanted utilities at
least 10 feet from the edge of paving in the MAE,
2. Plans overhead on the west and north perimeter, wanted language in covenants to
reflect overhead,
D. Doyle Goins, ONG
1. Also wanted 17.5' perimeter u/c instead of 11'.
E. Theron Warlick, Community Development
1. Asked the engineer to review the right -of -way request around the west and north
side of the development in order to ensure that there is adequate room for
cornering and placement of a vegetative buffer between the development and
nearby residential,
2. Noted that the proposed number of access points (3 onto E 96" Street N and 2
onto service drive) for a development of this scale was encouraging. Alignment;
with existing drives, and ramp on the south side of E 96" Street N were good,
3. Noted that accel/decel lanes were required at all access points to the arterial road
and that sidewalks were also required,
4. Encouraged cross -lot access for lots 4 -7,
[ The applicant has addressed a major concern by expanding the perimeter easement from 11 feet
to 17.5 feet. Utility companies called for an "underground" meeting. The developer's engineer
noted that the major users of the potential development are currently reviewing utility plans as
well and have additional requests and comments. It was agreed that the results of the
underground meeting would be included in the final plat for Owasso Market. TAC issues have
been addressed and included on the revised plat within your packet. It is possible that additional
changes will be required after the underground meeting and those changes can be included in the
final plat for Owasso Market.
Staff noted at the TAC meeting that the proposed OL zoned buffer now included N 119' E Avenue
and E 98' Street N. At the last Planning Commission meeting, Chairman Haynes noted that streets
alone did not provide the form of buffer that was intended by this zoning. In a forthcoming site
plan, the applicant has agreed to show a substantial vegetative buffer that will include a portion of
the OL district, as well as portions of the rear of the subject property. I
N 119" E Avenue and E 98" Street N will provide access to additional commercial, office, and

residential areas to the north, and will provide service access for the proposed development. In
order to enhance the compatibility of these different uses, the applicant has indicated that loading
will occur on the sides of the commercial facility, as opposed to the rear. It is anticipated that with
the introduction of a substantial vegetative buffer, the commercial and residential can be
compatible.
Drainage will be handled in two, large off -site detention basins, one to the west of Lot 7, and one to
the east of Lot 1. Phil Lutz of Owasso Public Works noted that the detention facilities will need to
be constructed in the first phase of development.
The construction plans are separate process from the platting process. Applicants are required to
submit construction plans between the preliminary and final plat stages of development. The final
plat will not be acted upon by the City Council until construction plans are approved by the
Engineering Division of the Public Works Department, and water and sewer permits have been
issued by the Oklahoma Department of Environmental Quality.
RECOMMENDATION
Staff recommends approval of the preliminary plat for Owasso Market.

The City of Owasso has received a request to review a site plan for the expansion of the Reasor's
Grocery Store, located on the north side of E 86th Street N, east of the Owasso Expressway. The
store is located on a 5.8 acre lot described as Lot 1, Block 1, Clark Plaza Fourth Addition.
The proposed expansion total 7,460 square feet, the majority of which will involve the infill of an
alley between Reasor's and Drug Mart to the north of the subject site. The expansion will require
the vacation of a portion of a utility easement, a proposal that is also included in this agenda.
The Owasso Technical Advisory Committee reviewed this proposal at the April 28, 1999 meeting.
No utilities are located in this easement and no concerns were noted.
The proposed expansion provides an opportunity to address some long - standing problems with
neighboring residential properties to the east of the subject site in Three Lakes Addition. Along
with the expansion, the applicant proposes to provide an enclosure to house dumpsters that will
help control odor and debris problems that have been a subject of concern for neighbors for years.
Additionally, the applicant has agreed to change their overnight truck parking policy. Delivery
trucks often park and idle in the rear of the facility overnight generating noise for the abutting
residences. In the future overnight truck parking will be on the south or west side of the store.
The 7,000 square foot expansion will not present a substantial additional burden on parking
requirements. No changes in the existing drainage patterns are indicated.
RECOMMENDATION
Staff recommends approval of the site plan for the site plan for the Reasor's Expansion subject to
the following condition:
1. That the applicants shall receive an easement closing from City Council.

The applicant has requested a review of a site plan for a restaurant on the east side of N 129' E
Avenue, south of E 86" Street N. The subject property is described as Lot 4, Block 1 ROC
Owasso. Albertson's Express convenience store is being constructed to the north of the subject
property and Albertson's grocery is located to the south.
The site plan shows 47 parking spaces (2 handicapped). This exceeds parking and handicapped
parking requirements for a facility of this size and type. Though the proposed facility utilizes
almost every portion of the lot, staff strongly encourages the applicant to provide landscaping,
including trees, in the islands at the comers of the facility. Signage will be addressed separately
through the permitting process, and as noted in the approval of the ROC plat, the street sign will be
a ground -type, monument sign.
The site plan was reviewed at the April 28, 1999 meeting of the Technical Advisory Committee.
Comments are as follows:
1. SWBT, Phil Sewell - noted that an underground conduit from the northwest comer of
the site would be required,
2. Owasso Fire Protection, Hoot Marlar — wanted fire hydrant available on site.
Suggested moving Albertson's Express hydrant to the southwest corner of AE lot or
northwest corner of Rib Crib lot,
3. Owasso Public Works, Phil Lutz — was not sure that the site plan reflected the
accel/decel lanes. Does the radius at the entrance allow for this? (Give detail)
Waterline to be extended from Albertson's 8" to the southeast of from 12" to the
north.
The applicant has revised the site plan to address the concerns of the Technical Advisory
Committee.
The plan provides an interior driveway connection to the rest of the ROC Owasso development on
the east side of the subject property, providing for good on -site circulation and coordinated access

BACKGROUND
The City of Owasso has received a request to review a preliminary plat for the Vyne, a 4.5 acre, one
lot subdivision located in the S/2 of the SWA of Section 22, T -21 -N, R -14 -E. The subject property
is located in the Preston Lakes PUD, north of E 86'h Street N, west of N 145' E Avenue. If there
are no objections, staff proposes that this plat be reviewed as a final plat.
This is the first development proposed in the Preston Lakes PUD. The site is proposed to contain a
50 unit assisted living facility. The site plan for the Vyne will is also included in this agenda, and is
attached to the plat within your packet.
As this is the first development in the area, there were several issues to resolve involving the
extension of utilities. The primary discussion at the April 28, 1999 TAC meeting centered on the
phasing of Preston Lakes development. Specifically, if the subject property is developed before the

Public Works Department approves construction plans. Because and water and sewer will need to
be extended to the site, the plat will also need to obtain permits from the Oklahoma Department of
Environmental Quality before Council action.

The City of Owasso has received a request to review a site plan for the Vyne, a 4.5 acre
development located in the S/2 of the SWA of Section 22, T -21 -N, R -14 -E. The subject property is
located in the Preston Lakes PUD, north of E 86' Street N, west of N 145d' E Avenue.
This is the first development proposed in the Preston Lakes PUD. The site is proposed to contain a
50 unit assisted living facility. Approval of this site plan must be conditioned on City Council
approval of the final plat for the Vyne Addition, also reviewed by the Planning Commission in this
agenda.
The comments from the April 28, 1999 TAC meeting are as follows:

Parking is roughly half of the zoning code requirement for a (74 required, 43 provided). The
applicant has indicated that parking is comparable to other facilities they have constructed and
claims that the 43 spaces is sufficient facility of this size and type. The applicant has applied for a
zoning variance before the Board of Adjustment and the Board has approved a similar request for
reduction with Beehive Homes in January, 1999. However, the applicant has indicated that they
will provide additional parking as required to meet zoning code or Board of Adjustment
requirements. On -site circulation for the facility is adequate.
An extensive landscaping plan is currently prepared for the subject property. The applicant
proposes to submit the plan for approval a date in the near future.
Staff recommends approval of the site plan for the Vyne subject to the following conditions:
1. That the applicants shall receive a parking variance from the Board of Adjustment,
2. That the applicants shall submit a detailed landscaping plan for approval by the
Planning Commission prior to the issuance of a building permit,
3. That the applicants or their agents shall construct an emergency access at a point
along the north property line. The location of the connection shall be shown on the
landscaping plan. Further, that this connection shall provide access for emergency
vehicles and/or evacuation, but may be gated or otherwise obstructed to prevent
normal traffic flow.
