The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
October 8. 1999 at 12:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF SEPTEMBER 14, 1999 REGULAR
MEETING - The Commission reviewed the minutes of September 14, 1999 Regular
Meeting, Bob Randolph moved, seconded by Bill Ellison to approve the minutes. A vote
on the motion was recorded as follows:

4. OZ -99 -10 — City of Owasso — Zoning Map Amendment— City of Owasso planning staff
recommends the rezoning of property located in the E/2 of Section 31, T -21 -N, R -14 -E.
The subject property includes tracts owned by Owasso Public Works Authority and
Owasso Economic Development Authority. Staff proposes a rezoning from AG
(Agriculture) and RM -1 (Residential Multi - Family) to IL (Industrial Light Manufacturing
and Research and Development District). The proposed rezoning affects property that is
already developed and will change the zoning classifications to be reflective of existing
uses.
Theron presented the item to the Commissioners and described the location of the
property. The subject property contains the City Solid West Facility, City Recycling
Center, Old City Garage and the New City Maintenance Facility. Staff is recommending

a map amendment to change the zoning to be more reflective of these existing uses. The
property was posted and notice was published in the Owasso Reporter. Letters were
mailed to surround property owners. One call was received wanting clarification on the
property. Theron also stated that the City is working on the dedication of 5' Avenue.

5. OZ -99 -09 - KMO Development - A request to rezone property located on the south side
of E 96' Street N west of the Owasso Expressway (US 169). The subject property is
described as a part of the NEA of T -21 -N, R -14 -E. To be considered is a rezoning from
RM -2 (Residential Multi- Family) to CS (Shopping Center) District.
Theron reviewed this item with the Commissioners. The location of the property was
described. The proposed zoning change is consistent with surrounding land use for the
area. The property was posted and notice was published in the Owasso Reporter. Also
letters were mailed to surrounding property owners. The planning department received
no calls. The applicant was present to answer questions. Charles Willey stated that the
subject property map shows the water tank, he questioned if it was included in this
rezoning. Theron assured the Cotntnissioners that the rezoning does not include the land
in which the water tank is on.
Ray Haynes moved to approve the rezoning request, Charles Willey seconded the motion.

6. Final Plat - Preston Lakes - A request for review of a final plat for Preston Lakes, a 272
lot, 86.09 acre subdivision described as a portion of the SWl4 of Section 22, T -21 -N, R-
14-E, Rogers County, Oklahoma. The subject property is located northeast of the
intersection of E 86' Street N and N 145' E Avenue.
Theron briefed the Commissioners on this item. This final plat proposal is approximately
one -half of a Preston Lakes PUD. The preliminary plat was approved in April of 1999.
The Technical Advisory committee reviewed the final plat at their September 29, 1999
regular meeting. All comments at this meeting have been included on the revised plat
with the exception of the adjustments that need to be made to the sidewalk easement
connecting N 151" E Avenue and N 152' E Avenue. Ray Haynes had questions
regarding the curb cuts that are off of 145" on the commercial property. Mr. David
Charney, the developer, addressed the Commissioners. He explained the concept of the
affordable single - family residential portion of this development.
Charles Willey moved to approve the final plat subject to TAC requirements and
adjustments be made to the requested sidewalk easement so that a continuous walk
connecting N 1515` E Avenue and N 152'a E Avenue can be placed and maintained in this
area. Larry Helton seconded the motion. A vote on the motion was recorded as follows:

7. Site Plan - Oklahoma Central Credit Union - A request for review of a site plan for
Oklahoma Central Credit Union, a proposed retail banking facility located on the
southeast side of N 121 E Avenue, south of E 86th S°eet N. The subject property is
located to the Southeast of the existing ONG offices.
Mr. Dennis Hodo, the engineer for this project, requested that this item be tabled.

8. Preliminary Plat — Owasso Commercial Plaza — A request for review of a preliminary plat
for a 4 lot, 5.71 acre subdivision described as a portion of the NW /4 NE /4 of Section 20,
T -21 -N, R -14 -E, Tulsa County, Oklahoma. The subject property is located on the south
side of E 96' Street N, east of N 121 E Avenue.
Theron presented the item to the Commissioners. He described the location of the
property. The Technical Advisory Committee reviewed this plat at their April 28, 1999.
All changes have been made subject to the request from city staff, SWBT and ONG.
Staff recommends approval subject to the following conditions:
1. That the applicant provide a stormwater analysis and indicate a drainage plan for
the final plat,
2. That sidewalks be constructed on the E 96'h Street N and N 121 E Avenue sides
of the subject property per Subdivision Regulations,
3. That the applicant provides a detailed cost estimate for roadway improvement on
E 96th Street N for final platting of the subject property.
4. The first sentence of the memorandum should read a 3 lot, 5.71 acre
subdivision.
The proposed lane lay out for E 96'h Street North was discussed. Also discussed was the
possibility of diverting the stormwater to another direction. Mr. Kevin Coutant addressed
the Commissioners. He explained that this drainage plan was engineered for the ONG
site and this site. He also assured the Commissioners that they will have it done correctly
by the time the final plat is presented. Ray Haynes had concerns with the increase of the
flow of stormwater.
Ray Haynes moved to approve the preliminary plat subject to TAC recommendations and
with the correction of the description of the property being 3 lot, 5.71 acre subdivision.
Also the motion is subject to, Mr. Phil Lutz with OPWA, to work on the engineering of
the ONG drainage pond onto the west so that it doesn't increase the flow. Larry Helton
seconded the motion. A vote on the motion was recorded as follows:

9. Preliminary Plat - George Young Ministorage - A request for review of a Site Plan for a
mini storage facility on a 1.30 acre property described as a portion of the NE /4 of Section
31, T -21 -N, R -14 -E, Tulsa County, Oklahoma, further described as property previously
recorded as Lots 2 -4, Block 34, Owasso Original Town Plat. The subject property is
located on the south side of 4" Avenue, west of Main Street. The applicant has requested
that this plat be reviewed as a final plat.
Theron described the location of the property. The property is zoned IL (Industrial Low
Intensity). The applicant proposes to use the parking lot to detain stormwater for a period
and allow a slow release into an existing drainage ditch on the north side. The Technical
Advisory Committee reviewed the plat at their September 29, 1999 meeting. Phil Lutz of
OPWA noted that the ditch might need to be regraded to allow proper flow. Staff
recommended that the underlying lots in the Original Town plat be vacated. Theron also
suggested that the street might need some improvements in order for water flow to Work
properly. The applicant was present to answer any questions or concerns.

10. Site Plan - George Young Ministorage - A request for review of a site plan for a mini
storage facility on a 1.30 acre property described as a portion of the NE /4 of Section 31,
T -21 -N, R -14 -E, Tulsa County, Oklahoma, further described as property previously
recorded as Lots 2 -4, Block 34, Owasso Original Town Plat. The subject property is
located on the south side of 4h Avenue, west of Main Street. The applicant has requested
that this plat be reviewed as a final plat.

The property location was described. The proposed construction will be approximately
21,900 square feet of ministorage. The zoning district, landscaping is not a high priority,
although staff recommends that the applicant landscape wherever possible. The Technical
Advisory Committee reviewed the plat at their September 29" meeting. Phil Lutz noted
that the ditch may need to be regraded and Hoot Marlar noted that there was an existing
hydrant located across 4b Street. The applicant, Mr. George Young described the various
sizes of storage units that will be used. He also stated that there would be approximately
150 units.

11. Lot Split - OLS -99 -07 - Robert Long Office Center - The proposed lot split affects Lot
1, Block 1, of the Robert Long Office Center, located at 12315 E 861' Street N. The lot
split will move an existing property line approximately 30 feet to the east.
Theron presented the case to the Commissioners. The Technical Advisory reviewed the
lot split and had no comments. The lot split will shift a lot line 30 feet to the east,
moving between two buildings.
Ray Haynes moved to approve the lot split request, Bob Randolph seconded the motion.

12. Street Vacation - OPWA - A request for the vacation of a portion of 151 Street between
OWASSO PLANNING COMMISSION
October 12, 1999

Main and Birch Streets. The proposed closing is in preparation for the construction of a
new municipal building.
Theron presented the case. He explained that upon vacation portions of the street would
revert to abutting property owners making the City beneficiary on either side of the
closing. The Technical Advisory Committee reviewed the request with comments from
ONG and Southwestern Bell. Both utilities stated that they might need to move or
protected by easements. Mr. John Groth was present to address the Commissions. Mr.
Groth requested that no action be taken on this item. He also stated that this vacation
might not be necessary, he would prefer to wait to see if it is needed. Ray Haynes asked
if Mr. Dale Johnson, Owasso Public Schools Superintendent, had any comments
regarding this vacation. Theron stated that he has not received any comments concerning
this request from Mr. Johnson. He also stated that the Commissioners would be
reviewing a City Hall site plan at a later date.
Ray Haynes moved to approve the vacation, contingent upon the need for this portion of
* Street to be closed on the final plans. Bob Randolph seconded the motion.

13. Easement Closing — Vicky Nance — A request for the closing of a portion of a utility
easement on Lot 19, Block 3, Central Park II, an addition to the City of Owasso. The
subject property is located at 12503 E 88°i Street N. The applicant requests a partial
closing of an easement to allow for the future construction of an enclosed porch.
Theron present the case to the Commissioners and described the property. The Technical
Advisory Committee reviewed the easement closing at their August 25, 1999 meeting.
No objections to the proposed easement closing were noted. Charles Willey had
questions with this request. He stated that if the builder knew the easements were there
why don't they build the house different. Theron explained that the approval would allow
for a future construction of an enclosed porch. The applicant was present to answer
questions. Ms. Vance stated that the house is 80% built and she was not aware that there
was a problem. The slab for the patio is poured but she would like to have it covered.

The Commissions stressed to Ms. Vance that there should be no overhang on the covered
porch that would encroach into the easement beyond the point of what is requested.
After discussion, Ray Haynes moved to approve the easement closing as described,
subject to no additional encroachments to overhang beyond this 4.5' area. A vote on the
motion was recorded as follows:

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: David Chamey is the attorney and agent for the
owners, Dorothy Hart and Everett and Barbara Roach.
REQUESTED ACTION AND PURPOSE: A request for review of a zoning change from AG
(Agriculture) District to CG (General Commercial) District.
LOCATION AND SIZE: The subject property consists of two adjacent tracts totaling 7.06 acres,
more or less. The subject property is described as a portion of the N/2 NW /4 NW /4 of Section 20,
T -21 -N, R -14 -E and is generally located between Garnett Road and the Owasso Expressway, north
of E 86t° Street N.
EXISTING LAND USE: The subject property currently contains six homes
SURROUNDING LAND USE: To the west of the subject property, across Garnett Road, is
existing commercial development zoned CG. To the south of the property is Morton Marine, zoned
CG in Tulsa County. To the north of the subject property is undeveloped property of the Smith
Farm PUD (OPUD -13), which calls for commercial, office, and light industrial uses. To the east of
the property is the Owasso Expressway.
APPLICABLE REGULATIONS: The Zoning Code of the City of Owasso, Chapter 15
"Amendments" and Chapter 6 "Commercial Land Uses."

The agent is requesting a rezoning of a 7.06 acres, from AG (Agriculture) District to CG (General
Commercial) District. This property was annexed into the City of Owasso in August 1998, and
upon annexation, the zoning classification reverted from RE (Residential Estate Lot) District in
Tulsa County, to Owasso AG district. At that time, it was anticipated that the property would be
developed as a portion of the new Wal -Mart facility, a facility that has since been relocated to E 96 °i
Street N.

Commercial land use exists, or is anticipated, on every side of this development. Although there
are several rental homes on this property at this time, redevelopment as commercial property,
according to the agent, is the highest and best use of the land. Staff agrees with this assertion.
The long established commercial importance of the Owasso Expressway corridor has been reflected
in many land use decisions, including the Smith Farm P.UD, and more recently, the Owasso
Market. As the demand for visibility and access grows, the City can expect more and more
requests of this nature. Staff anticipates that in the long term, our primary commercial corridor will
be the Owasso Expressway, and the Master Plan Committee's most recent draft of our land use plan
tries to reflect and accommodate this activity. We expect that commercial growth will continue to
move northward, from E 76ffi Street N, ultimately to our northern fenceline.
Although the 1985 Comprehensive Plan update calls for residential on this property, this
recommendation has been outdated by the previously mentioned land use decisions. Staff
considers the proposed rezoning to be consistent with the present area land use plans and
anticipated surrounding development.
Notices were sent to surrounding property owners within 300 feet of the subject property on
October 20, 1999 and a required legal advertisement was published in the Owasso Reporter on
October 21, 1999. Additionally, a public notice of the proposed rezoning was posted on the subject
property on October 21, 1999. As of this date, staff has received no comments from the public
regarding the proposed rezoning.
RECOMMENDATION
Staff recommends approval of the proposed rezoning.

BACKGROUND
The City of Owasso has received a request for a lot split on Lots 11 -13, Block 1, Three Lakes
Industrial Park Phase H. The subject property is generally located on the south side of E 81"
Street N and the east side of N 116`h E Avenue and is zoned IL (Industrial Low - Intensity)
District.
The proposed lot split will create two lots from the three existing. Both proposed lots contain
buildings: four storage buildings are located on the proposed Tract A, and Pruitt's Body Shop is
located on the proposed Tract B. Both proposed lots with their existing structures will satisfy the
requirements of the Owasso Zoning Code. As there are no minimum side yards required for
buildings in IL districts, the proposed lot split will cause no encroachments.
The Owasso Technical Advisory Committee reviewed the proposed lot split at their October 27,
1999 regular meeting. No comments were offered. Staff has no objection to this proposal.
RECOMMENDATION
Staff recommends approval of OLS- 99 -08.

OWASSO MARKET

BACKGROUND
The City of Owasso has received a request to review a site plan for Owasso Market, a 45.94 acre, 7
lot site located in the S/2 of Section 17, T -21 -N, R -14 -E, Tulsa County, Oklahoma. The subject
property is located on the north side of E 96" Street N, west of the Owasso Expressway.
The subject property is undeveloped land zoned CS (Shopping Center) District. To the south of the
subject property, across E 960' Street N, is the ONG facility located in the Oak Tree Business Park.
Areas to the north and west of the subject property are undeveloped and zoned RS -3 (Residential
Single - Family High- Density) District. A 50 foot strip of OL (Light Office) District is surrounds the
subject property and is intended to serve as a buffer strip between the abutting residential areas. To
the east of the subject property is the Owasso Expressway.
The site plan contains minor revisions from the plan that was originally reviewed and approved by
the Planning Commission in June 1999. There are minor variations in building size that do not call
for any changes in parking. Most notably, Lot 3 where the Dickenson Theater was originally
proposed, has been dropped from the revised site plan. The Owasso Technical Advisory
Committee reviewed the site plan at their October 27, 1999 meeting. There were no comments.
Drainage will be handled in two, large off -site detention basins, one to the west of Lot 7, and one to
the east of Lot 1. Phil Lutz of Owasso Public Works noted that the detention facilities will need to
be constructed in the first phase of development.
The applicant is providing a total of 3,330 parking spaces, which exceeds the minimum zoning
code requirement of 2,028 by 64 %. Parking is adequate for a facility of this size and type. The
applicant has indicated signage dimensions that far exceed the City of Owasso requirements. Since
signs are reviewed under separate permit, this information can be disregarded. The applicant has
also enclosed a landscape plan for your information and review.
RECOMMENDATION
Staff recommends approval of the site plan for Owasso Market with the understanding that
signage will be reviewed under separate permit.

THE LAKES AT BAILEY RANCH
DATE: February 3, 1999
Wednesday, November 3, the City of Owasso received an offer to dedicate a large amount of
right -of -way for use by the public. The subject property is located on the south side of E 106'"
Street N between Mingo Road (N 97h E Avenue) and Garnett Road, the west side of Garnett road
from the intersection with E 106"' Street N extending approximately one half mile to the south,
and the east side of Mingo Road from the intersection with E 106th Street N extending
approximately on quarter mile to the south.
The right -of -way dedication is generally located on the north, northeast, and northwest sides of
the Lakes PUD. The applicants dedication will result in 50 feet of right -of -way (from center)
along existing roadways, which will be consistent with our thoroughfare plan requirements.
RECOMMENDATION
Staff recommends acceptance of the right -of -way.
