Consider Approval of the Minutes of the November 10, 1999 Regular Meeting. PUBLIC HEARING 4. OZ -99 -12 — Oklahoma Baptist Retirement Center — Bradford Park — A request to rezone a 15.84 acre tract located on the south side of E 76" Street N, west of N 129" E Avenue. The proposed rezoning is from RS -1 (Residential Single - Family Low - Density) District to RD (Residential Duplex) District and will serve as a portion of the underlying zoning for OPUD -17. 5. OPUD -17 — Bradford Park — A request for approval of a Planned Unit Development. The subject property contains 32.33 acres, more or less, and is generally located on the south side of E 76" Street N, west of N 129" E Avenue. This area is to be considered for a Planned Unit Development. 6. O_Z -99 -13 — Sokolos /Vines — A request to rezone two adjacent 15.4 acre tracts located on the east side of Mingo Road (N 97" E Avenue), north of E 106" Street N. The northernmost tract is proposed to change from AG (Agriculture) District to RS -3 (Residential Single - Family High- Density) District. The southernmost tract is proposed to change from AG (Agriculture) District to CG (General Commercial) District. 7. Site Plan — C.W. Fry — A request for approval of a site plan for a site plan on property located in the SEA of Section 30, T- 21- N,.R -14 -E. The property is located at 410E 2 "' Street. 8. OLS- 99 -11- Witten — A request for a lot split located on Lot 7, Three Lakes Industrial Park, Phase II. The subject property is generally located on the east side of N 1100 E Avenue. The applicant wishes to attach the south 20 feet of Lot 7 to Lot 8. 9. Site Plan — Faith Lutheran Church — A request for approval of an expansion at Faith Lutheran Church. The applicant proposes a 11,865 square foot sanctuary and office area. The subject property is described as a part of the S/2 NEA of Section 19, T -21 -N, R -14 -E and is located at 9222 N Garnett Road. 10. Reports on monthly building permit activity. 11. OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Tuesday, November 9, 1999 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Charles Willey Bob Randolph Bill Ellison Larry Helton MEMBERS ABSENT Ray Haynes STAFF PRESENT Theron Warlick Marsha Hensley The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on November 3, 1999 at 10:00 AM. 1. CALL TO ORDER — Vice Chairperson Charles Willey called the meeting to order at 7:05 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF OCTOBER 12, 1999 REGULAR MEETING - The Commission reviewed the minutes of October 12, 1999 Regular Meeting, Bob Randolph moved, seconded by Bill Ellison to approve the minutes. A vote on the motion was recorded as follows: Bob Randolph - Yes Bill Ellison — Yes Charles Willey - Yes Larry Helton — Yes The motion carried 4 -0. 4. OZ -99 -11 — Charnev — A request to rezone property located on the east side of Garnett Road, north of E 86' Street N, and to the north of Morton Marine. To be considered is a request for rezoning from AG (Agriculture) District to CG (General Commercial) District. Theron presented the item to the Commissioners and described the location of the property. This is a request for a rezoning of 7.06 acres, from AG District to CG District. The property was annexed into the city in August 1998 and reverted from RE District to AG District. Mr. David Charney, the attorney and agent for the property owners was present to address concerns. Notices were sent to surrounding property owners and a legal advertisement was published in the Owasso Reporter. Staff received no comments regarding this request. Bob Randolph moved to approve the rezoning request, Charles Willey seconded the motion. OLS -99 -08 - Bud and Judy Pruitt - A request for a lot split on property described as Lots 11 -13, Three Lakes Industrial Park II. The subject tracts are located to the southeast of the junction of E 81" Street N and N 116' E Avenue. Theron reviewed this item with the Commissioners. Theron explained that the proposed lot split will created two lots from the three existing. Mr. Pruitt was present to any answer questions or concerns from the Commissioners. The Owasso Technical Advisory Committee reviewed the lot split and had no comments. Bob Randolph moved to approve the lot split request, Bill Ellison seconded the motion. A vote on the motion was recorded as follows: Bob Randolph - Yes Bill Ellison - Yes Charles Willey - Yes Larry Helton - Yes The motion carried 4 -0. 6. OLS -99 -10 - Owasso Market. L.L.C. - A request for a lot split on property described as Lots 1 -2, Block 1, Owasso Market. The subject property is located on the north side of E 96"' Street N, west of the Owasso Expressway. Theron briefed the Commissioners. He stated that the proposed lot split will take away 230.88 square feet from Lot 1 and attached it to Lot 2. Mr. Ted Sack with Sack & Associates was present to answer questions. Mr. Sack said it was actually a correction of a lot line and the area would be used for equipment for Wal -Mart. Charles Willey moved to approve the lot split. Larry Helton seconded the motion. Site Plan - Owasso Market - A request for a review of a site plan for the Owasso Market. The subject property is located on the north side of E 96' Street N, west of the Owasso Expressway. The site plan includes changes from a plan previously approved by the Owasso Planning Commission in June 1999. The property is undeveloped land and is zoned CS (Shopping Center) District. The revised site plan contains minor variations in building sizes. The variations include Lot 3 being dropped, landscaping has been added and the parking stalls are angled at 90° opposed to diagonal. Mr. Ted Sack stated that the changes made are for a better development. Staff recommends approval of the site plan with the understanding that signage will be reviewed under a separate permit. Larry Helton moved to approve the site plan subject to the above staff recommendation in reference to the signage to be reviewed and under a separate permit. Bob Randolph seconded the motion. A vote on the motion was recorded as follows: Bob Randolph - Yes Bill Ellison - Yes Charles Willey - Yes Larry Helton - Yes The motion carried 4 -0. S. ROW Dedication - The Lakes - A request to dedicate right -of -way for use by the public. The subject property is located on the south side of E 106' Street N between Mingo Road (N 97' E Avenue) and Garnett Road, the west-side of Garnett road from the intersection with E 106` Street N extending approximately one half mile to the south, and the east side of Mingo Road from the intersection with E 106' Street N extending approximately one quarter mile to the south. Theron presented the item to the Commissioners. The dedication is generally located on the north, northeast and northwest sides of the Lakes PUD. This will result in 50' of right -of -way (from center), which will be consistent with out thoroughfare plan requirements. Bob Randolph moved to approve Larry Helton seconded the motion. Chairperson Secretary Date MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: THERON WARLICK CITY PLANNER SUBJECT: REZONING— OZ -99 -12 OKLAHOMA BAPTIST RETIREMENT CENTER DATE: December 9, 1999 APPLICANT AND STATUS OF APPLICANT: The Oklahoma Baptist Retirement Center, a not - for - profit, Oklahoma Corporation, is the owner and applicant for rezoning of the subject property. REQUESTED ACTION AND PURPOSE: A request for review of a zoning change for 15.84 acres, more or less from RS -1 (Residential Single - Family Low - Density) to RD (Residential Duplex). The proposed rezoning will serve as a portion of the underlying zoning for OPUD -17, also contained within this agenda. LOCATION AND SIZE: The subject property is generally located on the west side of N 129' E Avenue, south of E 76h Street N, and consists of 15.84 acres, more or less. EXISTING LAND USE: The subject tract is currently undeveloped. SURROUNDING LAND USE: Other facilities in the Oklahoma Baptist Retirement Center are located to the north of the subject property. To the south of the subject property is additional undeveloped land, some of which is located within the 100 -year floodplain. To the east of the subject property across N 129" E Avenue are approximately four single - family homes. To the west are approximately two single- family homes on large tracts. . ANALYSIS Because this case is related to OPUD -17, staff will request that both zoning items be discussed at the same time. Each item is a separate zoning issue, however, and each will require a separate vote. Because of the potential to abandon all or a portion of a PUD, the Planning Commission should be comfortable with the underlying zoning that is proposed for this site as well as the PUD. The proposed rezoning would allow a substantial expansion of the Oklahoma Baptist Retirement Center. The 1985 Comprehensive Plan Update calls for Public Facilities on this site. The proposal for RD (Residential Duplex) zoning will allow an expansion of the retirement facility and is consistent with the plan. Notices were sent to su rrounding property owners within 300 feet of the subject property and legal advertisements were published. Additionally, a public notice of the proposed rezoning was posted on the subject property. As of this date, staff has received no calls or letters regarding the rezoning or PUD. The applicant proposes up to 209 family units (154 Quadruplexes, 55 Duplexes) along with accessory commercial buildings, parks, and a community building. The proposal for Bradford Park PUD is substantial, nearly doubling the size of the Retirement Center and creating a new neighborhood that will be unique in our City. A goal of the development is to fulfill a need for a independent senior housing, reflective of the needs of a growing number of today's and tomorrow's Owasso resident. At first glance, the rectangular geometry of the streets in the outline development plan stands out. Typically, we would prefer curvilinear streets. In this case, the more efficient rectilinear geometry will ensure that residents throughout the development will have easy walking access to the accessory commercial buildings, park, and community center. The higher density (a maximum of 60% land coverage on lots) is reflective of the community it will serve. There will less demand for private open space, which can often produce maintenance problems with older families. Incidentally, the Owasso Fire Department has noted that the rectangular street layout should speed emergency response time. Chapter 8, Planned Unit Development, describes the purpose of the PUD: Generally, a PUD permits flexibility within the development, while preserving open space, maintaining appropriate limits on the character and intensity of land use, and assuring compatibility with the adjoining and proximate properties. The developer is given the flexibility to arrange land use freely within the PUD, irrespective of the location of the underlying zoning districts. However, the aggregate land use must conform to the underlying zoning. In this case, the underlying zoning on the subject property consists of 16.49 acres of RS -1 (Residential Single - Family Low - Density) and 15.84 acres of RD (Residential H: \thcron_warlick\ Owasso \PC \12- 14- 99 \OPUD- 17\MEMORANDUM OPUD- 17.doc Duplex). The maximum number of dwelling units allowed with the underlying zoning is 209, which is exactly the same as the number of dwelling units proposed in the Bradford Park PUD. Staff calculated that in order to meet livability space requirements, the developer will need to provide a total of 45% open space. The developer proposes a minimum open space of 40% per lot, and an additional 5% open space with parks, thus meeting the livability space requirement of 45 %. Although no incompatibility problems have been noted with the surrounding properties, the Planning Commission can act to prevent problems through the prescription of buffering, screening, and setbacks during the platting process. At this time, staff sees no need for additional buffering or screening. Within the PUD, the developer has provided a set of Development Standards for each type development proposed in the PUD. Minimum standards for Single - Family Attached Dwellings, (whether in duplexes or quadroplexes) is given within the text of the PUD. The yards and setbacks of buildings are fairly consistent with other development in Owasso and should not create any particular problems. During the platting process, a review of the proposed Development Standards will ensure that the developer adheres to these standards and is consistent with the Outline Development Plan. Any deviation should be in conformance with the proposed development standards, or the underlying zoning code. The 1985 Comprehensive Plan calls for Public and Quasi- public land uses on this site. The proposed retirement community fulfills this requirement. Unfortunately, the Comprehensive Plan does not provide any direct guidance in the use of the PUD. At that time our current comprehensive plan was drafted, the PUD was not widely used and there is no specific mention of PUDs in our Comprehensive Plan. Surrounding land uses can be broken down into three effected areas: 1) Areas near undeveloped land. Areas to the south of the subject property are undeveloped. The nature of the proposed development will not create any barriers to the future development of this land. Drainage is indicated on the outline plan and the residential character of the proposed development should allow a wide variety of compatible development on adjacent tracts. 2) Areas near existing single- family development. To the east across N 129` E Avenue, there are several existing single - family homes. The plan proposes only one point of access onto N 129" E Avenue, which should limit the turning conflicts with these homes. Many of these homes can expect an increase in traffic, but the traffic volumes generated by this development alone should not substantially affect the character of this road. Additionally, accel/decel lanes will be required, which should improve access to the site. The single - family homes to west are set back on very large tracts should be effected minimally, if at all. 3) Areas within the Retirement Center. The existing retirement center features a great deal of open space, as well as many other complementary facilities. Were it not for the existing amenities available to potential residents, this proposal would certainly not be as strong. The strategic location of each land use should result in very few incompatibilities with the surrounding land uses. Under the rules of the PUD, the developer has the ability to reallocate each of these land uses within the development. If the developer chooses this option, the Planning Commission may require additional buffering to ensure compatibility in and around the development. Whether the PUD is a unified treatment of the development possibilities of this site. The proposed development is consistent throughout. It is a high- density development designed to cater to families 55 or older. The facility features a community center, accessory commercial, and parks that will be within easy walking distance of all of the residents of the community. c) Whether the PUD is consistent with the stated purposes and standards of the Zoning Code, Chapter 8, Planned Unit Development. The purpose of the Planned Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes PUD. The PUD also conforms to the standards set forth in Chapter 8. The developer has submitted the appropriate application materials and has established a plan that should conform to the requirements of the Owasso Zoning Code. Staff does not anticipate any difficulties in the administration of the Bradford Park PUD as proposed. RECOMMENDATION Staff recommends approval of the PUD subject to the following conditions: A. That the applicant's Development Text, and Outline Development be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code; B. That single - family attached dwelling shall be constructed to the standards specifically set out in the test of this PUD, C. That the proposed accessory commercial development conform to the PUD accessory commercial requirements of the Owasso Zoning Code, D. That within the PUD, the maximum number of dwellings shall not exceed 209, E. That as this proposal already meets the maximum allowable development densities, only decreases in development will be allowed as minor transfers (10% decrease in a development area's density), and then only so long as their is no significant change in the character of the development, F. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer, G. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary, H. Sokolosky proposes a rezoning from AG (Agriculture) District to RS -3 (Residential Single - Family High - Density). The 1985 Comprehensive Plan Update indicates agriculture for this area, however, there are several changes in this area that would render this recommendation obsolete. First, the availability of sewer to the west of the site has made higher density development of the area feasible. Second, the gravel mining operation to the north of the subject property has ceased which has substantially changed the environment for other forms of development. Hillside estates and other higher density housing developments have been located nearby, fiuther changing the potential of the area. Finally, the location of the Owasso Sports Park to the northeast of the site, represents an amenity that would enhance the quality of life for persons living in the vicinity. Because of these factors, the 1985 comprehensive plan recommendation for agriculture in this area may no longer be appropriate, and the Planning Commission may find that higher density forms of development are more appropriate at this site. M On the southernmost tract (Tract B), David Vines proposes a rezoning of 15.4 acres from AG District to CG (General Commercial) District. The 1985 Comprehensive Plan Update indicates a desire for commercial land use at the intersection of N 97a' E Avenue and E 106th Street N. This is the typical recommendation for intersections throughout our planning area. Vines proposal for commercial zoning is larger than is recommended in the 1985 Comprehensive Plan Update. As with Tract A, there are factors that strongly support a larger area. First, the unusual narrow configuration of the property, especially the narrow frontage on E 106°i Street N, makes a small rezoning on the comer somewhat impractical. In order for the stated goal of commercial property here to be fulfilled, the tract would need to be larger in order to allow for a reasonable commercial configuration and good access from Mingo Road, avoiding access from E 106" Street N. To the southeast of the site, the Lakes PUD contemplates some commercial and multi - family development near the intersection. To the southwest, plans are being drawn up for a new subdivision that will feature a commercial tract at the intersection. Further to the west on E 106' Street N, there are plans for even more single - family housing at higher densities. There are five houses across Mingo Road to the west of this location, and a sixth home under construction. Surrounding development will have a significant impact regardless of the activity across the street. The introduction of the North Owasso Sewer Interceptor has increased the value of the surrounding properties as well as the land that these homes occupy. The 1985 Comprehensive Plan Update calls for commercial and multifamily residential near the intersection with residential housing to the north. Even though some of these homes are not consistent with the long range plan, they were there first and certainly deserve some consideration. Mr. Vines has voluntarily submitted a sketch plan showing his development intentions for the site, which is included within this packet. Note that Mr. Vines does not intend to have commercial frontage on Mingo Road. Further, there are only two points of access and he proposes a decorative fence that would be consistent with Mr. Sokolosky's residential fence to the north, if approved. The proposed development offers a sensitive screening for the existing housing to the west. Notices were sent to surrounding property owners within 300 feet of the subject property and legal advertisements were published. Additionally, a public notice of the proposed rezoning was posted on the subject property. As of this date, staff has received one call from a concerned neighbor. She has indicated that she does not want industrial uses on the tract, and that ideally she would prefer to see housing at on Tract B. Staff explained that only commercial uses would be permitted by right and that Warehousing and Light Manufacturing at this location could only be permitted by Special Exception of the Board of Adjustment, which would require notification in the newspaper as well as by mail. Therefore, neighboring property owners would receive advance notice and an opportunity to review and comment on any such proposal. RECOMMENDATION Staff recommends approval of the proposed rezoning. Drainage will be directed to an existing detention pond in southwest corner of the site. The Owasso Technical Advisory Committee reviewed the proposed site plan at their December 1, 1999 regular meeting. The proposed site appears to be out of the 100 year floodplain. The subject property is described as a part of the S/2 NE /4 of Section 19, T -21 -N, R -14 -E, and is located at 9222 N Garnett Road. The subject property is zoned AG (Agriculture) District and RS -2 (Residential Single - Family Medium - Density) District. On November 23, 1999, the Owasso Board of Adjustment granted a Special Exception of the Owasso Zoning Code to permit expansion of the proposed church facility in these zoning districts. The floor area of the new sanctuary is approximately 3,800 square feet. The parking requirement a facility of this type is 1 space per 40 square feet of sanctuary floor area. Based on this calculation, the applicant would need to provide at least 95 parking spaces on site. The applicant has provided 140 spaces. The only problem noted with parking for the facility is that the applicant will need to create an additional two handicapped parking spaces to go along with the existing three. Drainage will be directed to the north portion of the site. Staff has requested additional detail regarding detention for the site. RECOMMENDATION Staff recommends approval of the site plan for the expansion of Faith Lutheran Church subject to the following conditions: 1. That the applicant modify the plan to convert two spaces to handicapped parking, 2.
