CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. ELECTION OF PLANNING COMMISSION SECRETARY - The Chair opened the floor for nominations for Secretary. Ray Haynes nominated Bill Ellison, with the nomination being seconded by Charles Willey. Hearing no further nominations, the nominations were declared closed and Bill Ellison was elected Secretary by acclamation. 4. CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 9, 1997 REGULAR MEETING - The Commission reviewed the minutes of December 9, 1997, Bob Randolph moved, seconded by Charles Willey to approve the minutes as written. OZ -98 -03 - Lindsey Management - A request for a rezoning of property from RD (Residential Duplex), RS -3 (Residential Single - Family High Density), and RS -2 (Residential Single - Family Medium Density) to RM -2 (Residential Multi - Family High Density). The subject property is located south of E. 86th Street North, between N. 129th E Avenue and N. 145th E. Avenue and contains 93.143 acres, more or less. Although, separate action will be taken on each item. A presentation was given, along with a brief video by Mr. Jim Lindsey, Chairman of the Board for Lindsey Management Company, Inc. Approximately 60 surrounding property owners were present to protest. The following list was compiled-from comments made by citizens and Commission members. -- - -- CITIZENS: I. Concerns with Owasso supporting two (2) golf courses. - Willis Roberts 2. Traffic problems in the area. - Herb Cunningham 3. Traffic concerns on 76th Street North, feeding an additional 100 houses. - Gary Baxter 4. Worries regarding the turn over rate of multi - family housing. - Jose Romero 5. Questions on the sewer plan for the multi- family units. - Curtis Brazeal 6. Interest regarding his land being locked in. - Roy Armstrong 7. Concerns with the studies done on the surrounding property values and traffic concerns on 86th Street North more so than 76th Street North. - Tammy Cleveland 8. Water drainage questions. - Joe Wolfe 9. Egressing out of area around 8th Grade Center. - Curtis Newton 10. Worries regarding the sell of any apartment units. - Dallin Roberts COMMISSION MEMBERS: 1. Questions concerning the reason why the single- family portion cannot stay RE (Residential Estates). - Bill Ellison Mr. Rooney presented a staff report explaining the concept of a PUD and a staff analysis. The following are staff recommendations: -- — - 1. Staff recommends amended approval of OZ- 98 -03, a..sequest to rezone property -- -- - - from RD (Residential Duplex), RS -3 (Residential Single- Family High Density), and RS -2 (Residential Single - Family Medium Density) to RM -1 (Residential Multi - Family Low Density) at: ltt`at M;ital Mitt i"atnlMl 2. Staff recommends approval of OZ- 98 -04, a request to rezone property from RS -3 (Residential Single - Family High Density), RS -2 (Residential Single- Family Medium Density), and RE (Residential Estates) to OM (Office Medium). 3. Staff recommends approval of OZ- 98 -05, a request to rezone property from RE (Residential Estates) to RS -1 (Residential Single - Family Low Density). 4. Staff recommends approval of OPUD -98 -01 subject to the following conditions: A. That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. B. That unless specifically set out in the standards and conditions of this PUD, single - family development shall meet the requirements of a typical RS -1 district. C. That the square footage of any single- family dwelling be a minimum of 2,250 square feet. D. That unless specifically set out in the standards and conditions of this PUD, all multi - family development shall meet the requirements of a typical RM -1 district. E. That unless specifically set out in the standards and conditions of this PUD, all office development shall meet the requirements of a typical OL district. F. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. J. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. K. That no building permits be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. L. That no occupancy of any multi- family dwelling unit be permitted until golf course construction is substantially completed. M. Acceleration/Deceleration lanes at each access point to the subject property along the arterial streets (E. 86th Street North, N. 129th E. Avenue, N. 145th E. Avenue). N. The inclusion of sidewalks along the abutting arterial streets and the interior drives within the proposed development O. The realignment of the E. 86th-Street access near the Eighth Grade Center, eliminating the offset. P. The subject property is located south of E. 86th Street North, between N. 129th E. Avenue and N. 145th E. Avenue and contains 149.647 acres, more or less. Ray Haynes moved to approve the request for the rezoning of OZ -98 -04 subject to staff recommendations, seconded by Charles Wihfy. Bill Ellison addressed Mr. Lindsey with concerns as to why this property could not be kept at RE (Residential Estates). Mr. Ellison stated bigger lots were much more attractive than smaller ones. Charles Willey moved to approve the rezoning of OZ -98 -05 subject to staff recommendations, seconded by Ray Haynes. OPUD -98 -01 - Lindsey Mana eg rn - A request for the approval of a Planned Unit Development which would allow for the creation of single - family housing, multi - family housing, and a golf course. The subject property is located within the square mile section bounded by E. 86th Street North, E. 76th Street North, N. 129th E. Avenue, and N. 145th E. Avenue and contains 288 acres, more or less. The subject property is located immediately east and north of the Bank of the Lakes property and would create two lots of 1.04 and 2.24 acres respectively. Tim Rooney presented the staff report. The first tract to be created would measure 200 x 227 and would front onto E. 86th Street North. The second lot would be located north — - - of the previously created Bank -of the Lakes -lot. -The- Technical Advisory- Committee- - reviewed the lot split at their January 5, 1998 meeting. An additional 17.5' utility easement was requested along the east property line of the two tracts to be created. Staff recommends approval of OLS -98 -01 with the following conditions: 1. Provide an additional 17.5' utility easement along the east property line of both lots to be created. 2. Detention layout be provided at site plan review. 3. A stabilized construction entrance to provided at the time of construction. Ray Haynes moved to approve the lot split subject to the above recommendations by TAC and staff, seconded by Charles Willey. The subject property is located north of E. 86th Street North, directly east of the Bank of the Lakes property, and contains 1.04 acres., more or less. Mr. Rooney gave a brief report. Notices were mailed to property owners on December 18, 1997. No calls regarding this rezoning were received by the Community Development Department. Charles Willey moved to approve the rezoning from OL to CS, seconded by Bob Randolph. OLS -98 -02 - Omni Entertainment - A request for the approval of a lot split request. The subject property is located within the NE /4 of the SE /4 of the SE /4 of Section 30, T21N, R14E within the Forrest Drive Industrial Park, west of the Owasso Expressway. Mr. Rooney presented a staff report. This lot split would combine four lots within the Forest Drive Industrial Park and create three lots for development. The Technical Advisory Committee reviewed the lot split request on January 5, 1998. The Committee requested an additional 17.5' utility easement along the outside boundaries of the entire lot split subject property. PSO and SWBT commented that line relocation may be necessary prior to any development. Several surrounding property owners were present with concerns regarding drainage in that area. Staff recommends approval with the following conditions: 1. Provide a perimeter 17.5' utility easement along the outside boundary of the subject property. 2. A detailed detention report be submitted with site plan application. 3. A stabilized construction entrance by provided at the time of construction. Charles Willey moved to approve the lot split subject to the above staff recommendations, seconded by Bob Randolph. OZ -98 -02 Omni Entertainment - A request for a rezoning of property from IL (Light Industrial) to CG (Commercial General). The subject property is described as Lots 3, OWASSO PLANNING COMNIISSION January 13, 1998 Page No. 9 4, 5, and Reserve Area "A" of Forrest Drive Industrial Park, west of the Owasso Expressway. Mr. Rooney presented a staff report. The applicants are requesting a rezoning of land approximately 6.47 acres in area from IL (Light Industrial) to CG (Commercial General) in order to allow for a family entertainment center. The City of Owasso is in the process - -- — -- of taking step'4 beautify this corridor --and the-- City -feels that.a- commercial- use_of this_ property would be more appropriate that an industrial use. Notices were mailed to surrounding property owners on December 18, 1997 and no calls were received. Ray Haynes moved to approve the rezoning from IL to CG, seconded by Charles Willey. The subject lot to be created is south of the Wendy's Restaurant located at 7591 Owasso Expressway, Owasso, OK. Staff recommends approval of OLS -98 -03 with the following condition of approval: 1. Provide additional 17.5' utility easement along the south and east boundaries of the lot to be created. 2. A detailed detention report be submitted with site plan application. 3. A stabilized construction entrance be provided at the time of construction. Ray Haynes moved to approve the lot split, seconded by Charles Willey. Site Plan - Attic Storage - A request for the review of a site plan for the expansion of Attic Storage. The subject property is located at 11500 E. 80th Street North, Owasso, OK. Mr. Rooney presented a brief report. The applicant is planning on constructing five additional mini - storage units. The Technical Advisory Committee reviewed the site plan at their January 5, 1998 regular meeting. No comments were noted by the utility companies. Staff recommends approval of the site plan with the following condition: 1. Final grading occur in such a manner that a majority of the storm water run -off be directed to the drainage detention basin in the southwest corner of the subject site. Charles Willey moved to approve the site plan subject to the above staff recommendation, seconded by Ray Haynes. Site Plan - CIP Incorporated - A request _for the review of a site plan for CIP Incorporated. The subject property is described as Lot 7, Block 1, Ram Plaza Addition. A staff report was given. The current zoning is CS (Commercial Shopping) which would allow for the development of the site as retail or office. The Technical Advisory Committee reviewed the request and no concerns were voiced. Staff recommends approval with the following conditions: 1. A separate permit needs to be obtained for any signage. 2. Submittal of a drainage report upon the direction of the Public Works Department (if necessary). The subject property is immediately south of the National Steak and Poultry facility. Staff report was given by Mr. Rooney. The applicant is proposing the construction of five industrial use buildings. The Technical Advisory Committee reviewed this request no comments were expressed at that time. Staff would prefer to address parking at this facility in the following manner: Staff will review the proposed use of each facility for compliance with code parking requirements, as well as appropriate labeling of handicapped parking spaces. REQUESTED ACTION AND PURPOSE: A request for-the rezoning of lKnsyerty from – — RS -3 (Residential Single- Family High Density) to CS (Commercial Shopping) to allow for expansion of the Dale and Lee's Heat and Air Conditioning business located immediately west of the subject property. dt) 5ez1abino#tz is alp av LOCATION AND SIZE: The property is located on the northwest comer of Birch and Third Street, directly east of Dale and Lee's Heat and Air Conditioning. The subject property is described as Lot 1, Block 2, Original Town of Owasso and measures 64' x 150' or .22 acres, more or less. A location map is attached for your information and review. EXISTING LAND USE: The subject property is currently developed with a vacant dwelling. SURROUNDING LAND USE: The subject property is abutted on the north by existing residential development zoned RS -3 (Residential Single - Family High Density). The subject property is abutted on the east by Birch Street, while farther east lies RS -3 zoned property which is vacant. The subject property is bordered to the south by Third Street while farther south lies RS -3 zoned property that is developed with a residential dwelling. The subject property is bordered on the west by the existing Dale and Lee's business zoned CS (Commercial Shopping Center). APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments ", Chapter 6 "Commercial Land Uses ". SITE INFORMATION: No unusual development hardships are noted. APPLICABLE ZONING MSTORY: The current Dale and Lee's property (abutting the subject property to the west) is a pre - existing non - conforming use. The Board of Adjustment approved a Variance in November of 1990 in order to allow for the expansion of Dale & Lee's at that time. The minutes from that meeting are attached for your information and review. Staff Report OZ -98 -06 Page 2 of 3 ANALYSIS In review, the applicant is requesting a rezoning of the subject property from RS -3 (Residential Single - Family High Density) to CS (Commercial Shopping Center). It is staff's understanding that the applicant is requesting this zoning change in order to allow for the expansion of Dale & Lee's business on to the subject property. - As you can imagine, a rezoning- uest of this-nature is- likely -tabe controversial and evoke - great emotion from protestants. Part of a Planner's responsibility, as viewed by staff, is to ensure a harmonious interaction between differing land uses whenever possible. When it is not possible, or when the co- existence of the different uses will be detrimental to the health, safety, and welfare of the community, a recommendation for denial is in order. When the applicant approached staff about the "type" of zoning needed on the subject property in order to allow for expansion of the current business, staff recommended the applicant seek a CS (Commercial Shopping Center) zoning classification. There are several factors in that recommendation for CS zoning. The first being that although a CG (Commercial General) zoning would allow for the expansion of the business by right, it would also be considered "spot zoning" and not a logical expansion of the CS zoning found to the west. Secondly, it was staff's opinion that the additional types of activities that would be permitted if CG zoning were to be approved could be undesirable for the nearby homeowners. For example, uses by right in a CG district could allow for automotive body and paint shops and other similar activities without any public input whatsoever. Finally, by obtaining a CS zoning rather than a CG zoning, the applicant would be required to go before the Board of Adjustment in order to expand the business operations. This would then allow for staff, as well as neighboring property owners, to explore additional safeguards to ensure compatible. coexistence that could not be explored if permitted by right. For instance, landscaping, storage of materials, signage, setbacks and screening requirements above and beyond what is required by the zoning code. This would then hopefully, allow for the expansion of a vital business within our community and also rp otect the neighboring property owners from any adverse impact that might have occurred. As stated previously within the staff report, this is likely to be a controversial rezoning request. Staff encourages the members of the Planning Commission to visit the site of the rezoning request prior to Tuesday evening's meeting and review the physical conditions of the subject property and surrounding properties. While it is understood that there are no "guarantees" that if zoning were to be approved that another use that is permitted in a CS district wouldn't locate there, staff's recommendation is Staff Report OZ -98 -06 Page 3 of 3 based upon the assumption that if approved, the applicant will desire to expand existing operations, thus requiring Board of Adjustment action. It should also be understood by all parties Planning Commission, the applicant, and neighboring property owners that a thorough review of any proposed site plan would occur and extensive safeguards to protect the residentially zoned properties should be anticipated. RECOMMENDATION It is staff's opinion that an expansion of the current Dale & Lee's business to the subject property could occur while protecting the interests of the neighborhoods, primarily through safeguards required through the Special Exception process of Board of Adjustment. OBOA -135 DALE AND LEE DEBOER (3014) - A Request for a Variance of Section 1220 of the Owasso Zoning Code, Nonconforming Use of Buildings or Buildings and Land in Combination to Expand Their Existing Building to Allow for Inside Storage of Supplies and Equipment and to Provide Exterior Paved Customer Parking. Chairperson Borgna introduced the case and requested staff presentation of the case. The subject tract is located at the northeast corner of Third and Main Street and is zoned CS (Commercial Shopping). The applicants are requesting to be allowed to construct a 76' x 32' addition to the west side of their existing building for enclosed space to store materials and repair equipment. The code does not permit an air conditioning and heating service store in a CS zoning district; but, because the store has existed at this location for many years, it has been classified as a non - conforming use. The applicants want to clean up their property so that it will not become a detriment to the neighborhood. The code does not allow the improvements they want; therefore, a hardship has been created on the applicant. Staff recommends approval of the requested variance subject to the ` -- following requirements: Owasso Board of Adjustment Minutes of November 28, 1990 Page 2 1) the site plan and all the conditions stated on said plan, 2) any outside lighting be directed downward and away from existing residential dwellings, 3) no outside storage of material or heating and cooling equipment, 4) signage be limited to wall signs meeting the requirements of the code, 5) approval by the City Planner and installation of a landscape plan prior to occupancy, and 6) since being a good neighbor in this matter is of such significant importance, that the exterior maintenance of this building and landscaping be a condition of approval. The applicants and their attorney, Harold Charney, were present to answer questions. The Chairperson introduced the case and staff presented the case background. The subject tract is located at the end of a cul -de- sac, abutted on three sides by single family dwellings and on the remaining side by a recreational pond. Because of easements and a neighborhood sidewalk, the applicant is limited on where he can build an addition to the house. He is requesting a variance to be allowed a 9.5" encroachment into the required 10' side yard in order to put a small addition on the house. Staff recommends approval of the requested variance. OBOA -138 EMMETT ATWOOD (2914) - A Request for a Variance of Section 430 of the Owasso Zoning Code, Bulk and Area Requirements in Residential Districts, to Reduce the Side Yard Requirement in an RS -3 (Residential Single Family High Density) District From 10 Feet to 8 Feet. Chairperson Borgna introduced the case and requested staff presentation of the case. The subject tract is located at the end of East 82nd Place North and contains the concrete footing for a single - family dwelling. The original builder went bankrupt and the applicant has purchased the lot with the existing foundation in place; however, one corner of the existing foundation encroaches 1.2' into the required 10' side yard. The applicant wants to use the foundations as it exists and avoid removal and replacement costs. The applicant was present; no surrounding property owners were present. Following discussion and the satisfactory answering of questions, Richard Helm moved to approve the requested Variance. Motion was seconded by M O Eckel. OBOA -139 BAPTIST GENERAL CONVENTION (3214) - A Request for a Variance of Section 430 of the Owasso Zoning Code, Bulk and Area Requirements in Residential Districts, for the Reduction of the Front Setback from 25 Feet to 20 Feet. The Chairperson introduced the case and staff presented the case background. The subject tract is a corner lot that is part of the Baptist Retirement Center. Because of a curve in 122nd East Owasso Board of Adjustment Minutes of November 28, 1990 Page 4 Avenue, the northern end of the lot is narrow, and the applicant is requesting to be allowed to let the northwest corner of a proposed duplex encroach 5' into the 25' front setback to avoid encroachment into an easement along the back lot line. Both the applicant and the applicant's builder were present to answer questions. Several area residents were also present, protesting the construction of a structure on the lot. The general feeling of the residents is that the duplexes are being placed too close together. The applicant stated that the structure would be built even if the variance is not granted. Following discussion and the satisfactory answering of questions, Jim Smalley moved to deny the requested Variance. Motion was seconded by Richard Helm. Two members of the Board with interests in the Retirement Center abstained from the voting procedure. Rooney - Community Development Director BACKGROUND APPLICANT AND STATUS OF APPLICANT: Wayne Alberty, agent for Mark Johnson, owner. REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from AG (Agricultural) to CS (Commercial Shopping Center); OL (Office Light); RD (Residential Duplex); RS -3 (Residential Single - Family High Density) and RM -2 (Residential Multi - Family High Density). LOCATION AND SIZE: The property is generally located west and north of E. 96th Street North and the Owasso Expressway, south of Sherrill Acres and west of the planned Bailey Ranch Estates II. The subject property contains approximately 168.692 acres. EXISTING LAND USE: The subject property is currently undeveloped. SURROUNDING LAND USE: The subject property is abutted on the south by E. 96th Street north, while farther south lies CS (Commercial Shopping Center), OM (Office Medium), OL (Office Light) and RM -2 (Residential Multi - Family High Density) zoned property, a portion of which is developed with the new ONG Work Center. The subject property is abutted on the east by the Owasso Expressway and N. 129th E. Avenue, while farther east lies the Glenn -Mir Acres Addition (Tulsa County) which is zoned RE (Residential Estates). The subject property is bordered on the north by the Sherrill Acres Addition and additional property owned by the Johnson,. -both of which are zoned RE (Residential Estates), The subject property is bordered on the west by the planned Bailey Ranch Estates II zoned Planned Unit Development with an underlying zoning of RS -2 (Residential Single - Family Medium Density) and additional property which has developed residentially (Tulsa County) and is zoned AG (Agriculture). APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments ", Chapter 4 "Residential District Provision ", Chapter 5 "Office District Provision ", and Chapter 6 "Commercial District Provision ". Staff Report OZ -95 -05 Page 2 of 6 SITE INFORMATION: No unusual development hardships are noted. ANALYSIS The proposed rezoning, if approved, would create multiple zonings on one large, undeveloped tract of land. The tract contains a total of 168.692 acres which is proposed for -- - - - several different zoning classifications (Residential, C Dmiercial, and Office) of- varying — sizes. Because the request before you contains multiple zonings, staff will review each individual portion of the zoning request separately, concentrating on that individual request, its relationship to existing and what is proposed, and review of basic planning principle as applied to the individual request in that area. CS - Commercial Shopping Center The applicant's request contains one large area (53.975 acres, approximately 32% of the entire tract under zoning consideration) in which they are requesting commercial zoning. The area, located along the south, southeast, and portions of the eastern boundaries of the parcel. This area would abut E. 96th Street North, the Owasso Expressway, and N. 129th E. Avenue. The Comprehensive Plan for the City of Owasso does identify this area for commercial development, as it defines this area as being a "Type Two Activity Center" located at the intersections of primary arterial streets. A "Type Two Activity Center" is forty (40) acres, ten (10) acres distributed to each comer. While the applicants request is slightly larger than what the Comprehensive Plan deems appropriate, it is consistent with that which is found at the intersection of E. 86th Street North and the Owasso Expressway. It is important to note that while the Planning Commission should consider surrounding property zoning and uses, one of the most important factors to be considered is the appropriate zoning of this parcel today. Certainly the location of the property itself, more specifically the portion of which that CS-zoning is being sought, lends itself to commercial development. Access to N. 129th E. Avenue and E. 96th Street North (both primary arterials) as well as the Owasso Expressway, should support the type of traffic demands that are common with commercial development. Please note that the Comprehensive Plan did not identify this area for commercial development potential, but rather for High Intensity Industrial Development. Staff would suggest that the Comprehensive Plan is outdated in this area and that perhaps a commercial use of the property would be more appropriate. Staff Report OZ -95 -05 Page 3 of 6 OL - Office Light The applicants request contains two areas in which they are requesting office zoning. The first area, located along N. 129th E. Avenue immediately north of the tract in which the applicants are requesting CS (Commercial Shopping Center) zoning and contains 5.322 acres (3% of the entire tract). While the Comprehensive Plan does not identify this area for office development (identified in the-1985 Comprehensive Plan as Residential), it uld be noted - - -- - - -- -- that the Plan may be outdated in this area as well. The likelihood of Low Density Residentially occurring immediately adjacent to CS development is not desirable, not to mention that it is certainly not desirable abutting High Intensity Industrial which is called out for in the Comprehensive Plan. The Office zoning which is proposed would allow for such uses as medical, dental, insurance, and professional offices and could include a hair styling salon by Special Exception. Generally, retail type uses are excluded in any OL district. OL zoning at this location may be considered to be a preferred buffer from any possible commercial development within the subject property to the south and the existing residentially developed property to the east and the proposed residential development (RE) to the north. The staff and other applications considered by the Planning Commission have established a pattern of utilizing OL zoning as a buffer between Commercial and Residential property, most recently along the Owasso Expressway near the Three Lakes Addition (Castle Point), as well as E. 86th Street North. The second area, located west of the proposed CS zoning, is located near the southwest comer of the entire subject property and contains 10.770 acres (6% of the entire tract). Similar to the other area of the subject property in which OL zoning is being requested, the Comprehensive Plan identifies portions of this area as being appropriate for both High Intensity Industrial and Residential development. The applicants request for office development in this area would again act as a buffer between the proposed_ Commercial development and the residential development proposed to the west. Additionally, this portion of OL zoning includes a finger parcel of proposed OL zoning along the northwest portion of the CS zoning being proposed. Once again, this portion would act as a buffer between the proposed commercial zoning and the residential zoning being proposed by the applicant. Staff would expect that this portion would develop as a combined landscape buffer and pedestrian trail area, the concept of which is strongly endorsed by staff. Staff Report OZ -95 -05 Page 4 of 6 RM -2 - Residential Multi - Family High Density The applicants request contains one area in which they are requesting residential multi - family zoning. RM -2 zoning is the most intense form of residential development permitted in the City of Owasso and is proposed to be located immediately west of the proposed commercial zoning in areas that are not covered by the proposed office zoning. The size of the RM -2 - zoning being proposed -contains 11.750 &i ibs (7% of the total tract). The c^arriprelt nsivE — - Plan does identify this area as being appropriate for low density residential development. Again, it should be noted that the Comprehensive Plan may be outdated in this area as it is highly unlikely that low density residential development would occur abutting Commercial property. Assuming the RM -2 zoning would be approved and the property would develop in a multi- family manner, this would allow for slightly less than 14 dwelling units per acre, or a total of approximately 162 units (if all were two - bedroom units). Staff does have concerns about this type of intense residential development being located within this portion of the community with very little open space accompanying the request. While staff is supportive of a multi - family zoning designation at this location as a buffer between the proposed commercial and single - family residential development, staff would suggest that perhaps an RM -1 zoning would be more appropriate. RM -1 zoning would allow for approximately 10 dwelling units per acre or 117 total units. Please be advised as is the case with any multi - family zoning request, concerns regarding the possibilities of low income housing surface. As you are aware, the City of Owasso adopted an ordinance more than two years ago regarding low income tax credit applications for multi- family projects which allows for the Council to deny such a request. If such a request were made for that type of credit in this area, staff would recommend denial. RD Residential Duplex The applicants request contains one area designated for residential duplex development immediately north of the proposed RM -2 zoning, immediately south of existing RE (Residential Estates) zoning located in Sherrill Acres and additional RE zoning on land owned by Mr. Johnson. This tract contains 10.519 acres or 6% of the total property. While RD zoning is often encouraged by Staff as a buffer between commercial or multi- family development and single - family residential, all former cases for such recommendations have occurred when the single - family residential that is being buffered is of a medium or high density. The existing RE zoning that has developed in Tulsa County is not medium or high density but rather low density. Staff Report OZ -95 -05 Page 5 of 6 While staff is not entirely opposed to RD zoning on the proposed tract, a protection of the residential characteristics of those citizens located within the RE zoning is deserved. Members of the Planning Commission may remember that this was also a heavily discussed concern when the property that contains Bailey Ranch Estates was seeking their RS -2 zoning. Property owners from Sherrill Acres opposed RS -2 zoned lots along their shared property line and staff recommended, and the Planning Commission and Council concurred, that those -1ots that backed up to Sherril Ac:esshould -be larger. Staff-::ould recommend-that -,he- same - - - - - -- - principals that applied to that property in 1994 should also be applied to this property in 1998. Therefore, staff would recommend that the northerly 200' of the proposed RD zoning be provided a classification of RE zoning. RS -3 Residential Single- Family High Density The applicants have requested one area designated for single - family residential high density which is located along the western portions of the subject property. This portion contains 76.356 acres, representing 45% of the entire subject property. The applicants request for RS -3 zoning is a natural transgression of land uses from the more intense to less intense. When the entire subject property and the proposed zoning changes are reviewed as a whole, the zoning pattern requested makes sense. The most intense land use (Commercial) is followed by Office, Multi- Family, and Single - Family High Density, which is then abutted by Single - Family Medium Density to the west (Bailey Ranch Estates). While the applicant did not request a planned unit development, this is a rather comprehensive approach to the development potential of the site. As was the case with the proposed RD tract, staff would also recommend that the northerly 200' of the RS -3 proposal (abutting Sherrill Acres) also be reserved for RE (Residential Estates) zoning in order to protect those property owners as was required during the Bailey Ranch Estates caning case. Additionally, the Planning Cinmission may want to consider requiring the portions of the RS -3 zoning request that abut the planned Bailey Ranch Estates II to be zoned RS -2. If this is deemed necessary, staff would recommend that it be no greater than 125' in depth. Staff received numerous calls regarding the zoning voicing opposition to various portions of the request. No written comments were received at the time of staff report preparation. Letters were sent to surrounding property owners within 300' of the subject property and notification was published in the Owasso Reporter. Copies of the letters to property owners and the legal advertisement are attached for your information and review. Staff Report OZ -95 -05 Page 6 of 6 A large public turnout at this public hearing is anticipated. Due to the anticipated turnout, staff has asked the applicant to be prepared to present his request prior to the staff presentation of the report, in order for the applicant to answer as many questions as possible regarding the request. RECOMMENDATION Staff is recommending approval of the rezoning, as requested, with the following modifications: 1. The northerly 300' of both tracts identified for RD and RS -3 be zoned RE. 2. That the RM -2 zoning be reduced to RM -l. 3. That the portions of the RS -3 zoning request that abut the planned Bailey Ranch Estates II development be zoned RS -2 (rather than RS -3) at a depth not to exceed 125 feet. Rooney Community Development Director MEMORANDUM TO: THE OWASSO PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: PRELIMINARY PLAT OWASSO GOLF AND ATHLETIC CLUB DATE: February 4, 1998 BACKGROUND The City of Owasso has received a request to review a preliminary plat from Lindsey Management for their proposed development titled Owasso Golf and Athletic Club. Owasso Golf and Athletic Club is located within Section 28 and is bounded by N. 129th E. Avenue, N. 145th E. Avenue, E. 76th Street North and E. 86th Street North and totals 248.45 acres, more or less. The subject property was recently rezoned as a Planned Unit Development in January by the Planning Commission, with an underlying zoning of RM- 1 (Residential Multi- Family Low Density) and OM (Office Medium). The Technical Advisory Committee reviewed the preliminary plat at their January 28, 1998 regular meeting. At that meeting, the utility companies were presented with a preliminary plat for the Owasso Golf and Athletic Club that depicted a one lot, one block addition with a 17.5 utility easement. Because of the scope of the project (please refer to tentative building layouts provided), the applicants requested that no additional utility easements be shown on either the preliminary or final plat. The applicants explained that their past history when providing all required easements prior to construction often times results in easement vacations and additional easements being required in order to address complications that arise during construction. What the applicants proposed, and the utility companies agreed to, was a blanket easement over the entire area of the plat for utility construction purposes. This allows for the placement of utility lines within M area that is necessary to service every proposed structure. Upon completion of a phase of construction, the utility easements would then be filed by separate instrument for the exact location that the lines are located. This prevents the platting of unneeded or unusable easements and results in easements only being recorded where utilities are actually located. While staff understands that this is a different approach than what is common when reviewing subdivision plats, there is a significant difference between a standard single - family plat and a multi - family plat with a golf course. As you may recall, on two separate occasions the Planning Commission was required to take action, once at a special meeting, to rededicate, close, or alter easement locations and property lines for Bailey Golf Ranch. It is staff's opinion that if the proposed process eliminates the possibilities of future rededication and closures (which it Staff Report Preliminary Plat - Owasso Golf and Athletic Club Page 2 of 2 apparently can) than this is a process that should be explored. Additionally, a condition of the Planned Unit Development approval required the realignment of the access drive opposite the Eighth Grade Center in order to facilitate traffic flow. Initial review and inspection of field conditions indicate this would be an expensive proposal due to drainage existing in the area. Please be advised that it is highly likely that the alignments will not be able to match up (centerline to centerline) as desired. The applicant has pledged that if the alignments cannot match as previously desired, all steps-will-be taken to insure the smooth flow of traffic in the area. Covenants have not been submitted with the plat at this time but are required at the time of final plat application. All conditions of approval from the Planned Unit Development are required to be included within the covenants. The developers have had several meetings with the Engineering Division of the Public Works Department regarding the construction plans. Those plans are also required to be submitted at the time of final plat application. In addition to final plat approval, a site plan and landscaping plan approval as well as permits from DEQ for water and sewer line construction will need to be secured prior to any construction. NINE MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: ANNEXATION CORRECTION ORDINANCE NO. 299 DATE: February 4, 1998 The City of Owasso received a request from Mr. Rick Kramer in December to review Ordinance No. 299 which was approved by the City Council in February of 1981. Ordinance No. 299 provided for the annexation of property located within the northwest quarter of Section 30, T21N, R14E of Tulsa County. Specifically, the property is located immediately north of the Hale Addition in Owasso, immediately west of the Village /Summit at Southern Links. A location map is attached for your information and review. Staff review of Ordinance No. 299 resulted in the finding that the legal description described in the first paragraph of Ordinance No. 299 did not "close" the property to be annexed. In fact, it describes a dimension along the southern boundary of the subject tract, as well as the western boundary, but it does not describe the northern boundary and eastern boundary. Upon discussion with Mr. Cates and the Mr. Kramer, it is staff's opinion that this was a scrivener's error at the time that Ordinance No. 299 was drafted. In order to correct this error, staff would need to draft a new ordinance which would amend Ordinance No. 299 by adding the proper legal description. Because this item was the result of a scrivener's error, staff did not forward this item to the Annexation Committee, as staff believes the subject property was theoretically approved for annexation in 1981 by the City Council. Staff does, however, feel that the Planning Commission should take formal action on this item prior to forwarding this item to the City Council. RECOMMENDATION Staff recommends Planning Commission approval of the drafting of an ordinance that would amend Ordinance No. 299, thus providing the correct legal description of the property which was annexed in 1981.
