CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

MEETING - The Commission reviewed the minutes of January 13, 1998, Bob Randolph
moved, seconded by Charles Willey to approve the minutes as written. A vote on the

OZ -98 -06 - Noble Sokolosky - A request for a rezoning of property from RS -3
(Residential Single - Family High Density) to CS (Commercial Shopping Center). The
subject property is described as Lot Four (4), Block Seven (7), Original Town of
Owasso. The subject property is located on the northwest comer of Birch and Third
Street.
Mr. Rooney introduced the attorney for the applicant, Mr. Noble Sokolosky. A short
presentation was given by Mr. Sokolosky. He described the location of the property to
the Commissioner and also stated the subject property will be utilized as a building for
an office and a parking lot. Several surrounding property owners were present to protest
the rezoning. Ms. Pat Marlar of 306 North Birch, had concerns with the storm water
management in the area. Also, Ms. Marlar had concerns regarding additional junk and

debris on the property. Ms. Cindy Lollis, property owner to the north, expressed
concerns with the trash on the premises. Ms. Joy Reimbold of 312 North Birch, stated
the neighborhood was crowded by businesses and did not need more commercial. She
also had concerns with the property selling at a later date and a convenience store
purchasing the property. Mrs. Hazel Cook of 303 Main Street, stated the addition of an
office and parking lot would add to the comer, the vacant house that is presently on that
lot is an eye -sore.
Mr. Rooney presented a staff report. By obtaining a CS zoning rather than a CG, the
applicant would be required to go before the Board of Adjustment, to seek a Special
Exception, in order to expand the business operations. This would allow staff and
surrounding property owners to regulate landscaping, storage of materials, signage,
setbacks and screening requirements. Notice to property owners were mailed and legal
advertisement was published in the Owasso Reporter.
Charles Willey moved to deny the request for the rezoning of OZ- 98 -06, motion
was seconded by Bob Randolph. A vote on the motion was recorded as follows:

5. OZ -98 -07 - A/D Groun - A request for a rezoning of property from AG (Agriculture)
to CS (Commercial Shopping Center), RM -2 (Residential Multi - Fancily High Density),
OL (Office Light), RD (Residential Duplex), and RS -3 (Residential Single - Family High
Density). The subject property is located north and west of E. 96th Street North and the
Owasso Expressway and contains 168.692 acres, more or less.
Mr. Charles Norman, attorney for Mark Johnson was introduced by Tim Rooney and
made a presentation to the Commissioners. Approximately 175 surrounding property
owners were present to protest the rezoning. A map of the drainage pattern map of the
area was shown. Mr. Norman stated that storm water detention will be required and
carefully studied by the City of Owasso. Also, a utilities map and a topographical map
were displayed. Mr. Norman also noted, the present Owasso Comprehensive Plan calls
for this area to be used as High Intensity Industrial. The Master Development Plan was
reviewed as well as the traffic flow in the area. Staff modifications were discussed and

agreed upon by the applicant. Mr. Norman also stated, he and the A/D Group will be
more than happy to be available for the public to help plan this project.
Approximately 175 neighboring property owners were present to protest the request. The
following comments were made by citizens and Commission members:
1. Worries about 100th Street becoming a raceway. - Doyle Boyd
2. Against the rezoning of this property and requests tabling the item for 60 days in
order to organize property owners in the area and allow questions to be answered.
People move to Owasso to get away from the big city life - Joe Espisido
3. Concerns with Washington County water situation. - Lou Brown
4. This plan not being consistent with good land planning. Comprehensive Plan is
outdated. - Steve Compton
5. Deny the rezoning of this development in order for a Committee to come up with
a better plan. - Paul Jacobs
6. Concerns on streets at Sherrill Acres and. Bailey Ranch II being tied into the area
and storm water run off, would like 60 days for a compromise to be worked out.

Mr. Rooney gave a staff report and reviewed the different types of zoning that is
being presented on with this undeveloped tract of land. Also, the acreage that is
involved in each individual portion was noted. Mr. Rooney described the proposed fifty
(50) foot landscaping buffer and pedestrian trail.
Mr. Rooney stated the zoning pattern is acceptable to staff and is recommending approval
of the rezoning, with the following modifications:
1. The northerly 200' of both tracts identified for RD and RS -3 be zoned
RE.
2. That the RM -2 zoning be reduced to RM -1.
3. That the portions of the RS -3 zoning request that abut the planned Bailey
Ranch Estates II development be zoned RS -2 (rather than RS -3) at a depth
not to exceed 125 feet. (If desired)
After lengthy discussion, Ray Haynes moved to table the item for thirty (30) days, to
give the citizens and the applicant more time to work out a reasonable solution. Also,
Mr. Haynes suggested that all involved, decide upon a date and time for a meeting, to
discuss the rezoning and when this item goes before the Commission on March 10, 1998,
the meeting needs to be conducted in a civil manner. Finally, Mr. Haynes requested the
opposed citizens to use rationale in their request to the developer. Mr. Norman
suggested getting a steering committee together of approximately ten to twelve
surrounding property owners and only this committee appear at the meeting. Mr.
Norman stated that he will speak to staff regarding the connection of the streets in
Sherrill Acres. Mr. Rooney stated, a street tie -in would be required into Bailey Ranch
Estates but, he will review Sherrill Acres street tie -ins with the Owasso City Council.
The motion was seconded by Charles Willey with the comment that he does not care for
the multi - family zoning and the duplex zoning needs consideration. A vote on the motion
was recorded as follows:

Chairperson Ray Haynes recessed the meeting at 9:30 PM and it was reconvened at 9:45 PM.
6. Preliminary Plat - The Owasso Golf and Athletic Club - A request for a review of a
preliminary plat for the Owasso Golf and Athletic Club. The subject property is located
between E. 76th Street North and E. 86th Street North, east of N. 129th E. Avenue and
contains 248.45 acres, more or less.
Mr. Rooney presented a brief staff report. The Technical Advisory Committee reviewed
this plat at their January 28, 1998 regular meeting. At that meeting the plat depicted a
one lot, one block addition with a 17.5 utility easement. The applicants requested that
no additional utility easements be shown on either the preliminary or final plat. The
applicants proposed a blanket easement over the entire area of the plat for utility
construction purposes. This will allow for the placement of utility lines within any area
that is necessary. After completion the utility easements would then be filed by separate
instrument for the exact location of the lines. This will prevent the platting of unneeded
easements. In addition to final plat approval, a site plan and landscaping plan approval,
as well as permits from DEQ for water and sewer line construction, will need to be
secured prior to any construction. Staff recommends approval of the preliminary plat.
Ray Haynes moved to approve the preliminary plat subject to staff recommendations,
seconded by Bob Randolph. A vote on the motion was recorded as follows:

7. Annexation Correction - Rick Kramer - Staff will present a correction to a previously
approved annexation request (February 1981) in order to correct a scriveners error
contained within a legal description. The subject property is located north of the Hale
Addition.
Mr. Rooney gave a brief staff report. In order to correct this error, staff needs to draft
a new ordinance which would amend Ordinance No. 299 by adding the proper legal
description.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Wayne Alberty, agent for Mark Johnson,
owner.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
AG (Agricultural) to CS (Commercial Shopping Center); OL (Office Light); RS -3
(Residential Single - Family High Density); RS -2 (Residential Single - Family Medium Density);
and RE (Residential Estates).
LOCATION AND SIZE: The property is generally located west and north of E. 96th Street
North'and the Owasso Expressway, south of Sherrill Acres and west of the planned Bailey
Ranch Estates II. The subject property contains approximately 168.692 acres.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the south by E. 96th
Street north, while farther south lies CS (Commercial Shopping Center), OM (Office
Medium), OL (Office Light) and RM -2 (Residential Multi - Family High Density) zoned
property, a portion of which is developed with the new ONG Work Center.
The subject property is abutted on the east by
Avenue, while farther east lies the Glenn -Mir
RE (Residential Estates).
the Owasso Expressway and N. 129th E.
Acres Addition (Tulsa County) which is zoned
The subject property is bordered on the north by the Sherrill Acres Addition and additional
property owned by the Johnson, both of which are zoned RE (Residential Estates).
The subject property is bordered on the west by the planned Bailey Ranch Estates II zoned
Planned Unit Development with an underlying zoning of RS -2 (Residential Single - Family
Medium Density) and additional property which has developed residentially (Tulsa County)
and is zoned AG (Agriculture).

APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", Chapter 4 "Residential District Provisions ", Chapter 5 "Office District
Provisions ", and Chapter 6 "Commercial District Provision ".

SITE INFORMATION: No unusual development hardships are noted.
ANALYSIS
The applicant's original submittal, reviewed by the Planning Commission on February 10,
1998, was tabled in order to allow for representatives from surrounding neighborhoods to
meet with the applicant to discuss their concerns. Staff secured both parties a meeting place
and time for that meeting and it was conducted on Tuesday, February 24, 1998 at 7:00 PM
at the Owasso Community Center.
The meeting was conducted in an orderly manner and logical concerns from neighboring
property owners were brought to the table. As a result of that meeting, slightly over an hour
in length, the applicant removed both the multi - family and duplex portions from the
application (replaced with RS -3 and CS), removed a portion of the commercial zoning along
N. 129 E. Avenue (replaced with OL), and extended the proposed RS -2 buffer along the
subject property's west property line.
The proposed rezoning as amended, would create multiple zonings on one large, undeveloped
tract of land. The tract contains a total of 168.692 acres which is proposed for several
different zoning classifications (Residential, Commercial, and Office) of varying intensity.
Because the request before you contains multiple zonings, staff will review each individual
portion of the zoning request separately, concentrating on that individual request, its
relationship to existing and what is proposed, and review of basic.planning principle as
applied to the individual request in that area.
CS - Commercial Shopping Center
The applicant's request contains one large area (57.23 acres, approximately 34% of the entire
tract under zoning consideration) in which they are requesting commercial zoning. The area
is located along the south and southeast portions of the parcel. This area would abut E. 96th
Street North, the Owasso Expressway, and a small portion of N. 129th E. Avenue. The
Comprehensive Plan for the City of Owasso does identify this area for commercial
development. Specifically, it defines this area as being a "Type Two Activity Center"
located at the intersections of primary arterial streets. A "Type Two Activity Center" is
forty (40) acres, ten (10) acres distributed to each corner. While the applicants request is
slightly larger than what the Comprehensive Plan deems appropriate, it is consistent with that
which is found at the intersection of E. 86th Street North and the Owasso Expressway.
It is important to note that while the Planning Commission should consider surrounding
property zoning and uses, one of the most important factors to be considered is the
appropriate zoning of this parcel today. Certainly the location of the property itself, more

specifically the portion of which that CS zoning is being sought, lends itself to commercial
development. Direct access would appear to be limited to E. 96th Street North (primary
arterial), with nearby access to the Owasso Expressway, would support large scale
commercial development. Access to N. 129th E. Avenue would occur through the proposed
OL zoning, and should not adversely impact those neighbors east of N. 129th E. Avenue.
Please note that the Comprehensive Plan, while identifying a 10 acre parcel on the comer for
commercial development, did not identify the remainder of this area for commercial
development but rather for High Intensity Industrial Development. Staff would strongly
suggest that the Comprehensive Plan is outdated in this area and that a commercial use of the
property would be more appropriate.
OL - Office Light
The applicants request contains two areas in which they are requesting office zoning. The
first area, located along N. 129th E. Avenue immediately north of the tract in which the
applicants are requesting CS (Commercial Shopping Center) zoning and contains 5.65 acres
(3 % of the entire tract). While the Comprehensive Plan does not identify this area for office
development (identified in the 1985 Comprehensive Plan as Residential), it should be noted
that the Plan may be outdated in this area as well. The likelihood of Low Density
Residential occurring immediately adjacent to CS development is improbable; not to mention
that it is also improbable for property within the City Limits of Owasso required to have
sanitary sewer to develop as low density at all, whether it abutted Commercial zoning or not
The Office zoning which is proposed would allow for such uses as medical, dental,
insurance, and professional offices and could include a hair styling salon by Special
Exception. Generally, retail type uses are excluded in any OL district. OL zoning at this
location may be considered to be a preferred buffer from any possible commercial
development within the subject property to the south and the existing residentially developed
property to the east and the proposed residential development (RE) to the north. The staff
and other applications considered by the Planning Commission have established a pattern of
utilizing OL zoning as a buffer between Commercial and Residential property, most recently
along the Owasso Expressway near the Three Lakes Addition (Castle Point), as well as E.
86th Street North.
The second area, located west of the proposed CS zoning, is located near the southwest
comer of the entire subject property and contains 10 acres (6% of the entire tract). Similar
to the other area of the subject property in which OL zoning is being requested, the
Comprehensive Plan identifies portions of this area as being appropriate for both High
Intensity Industrial and Residential development. The applicants request for office

development in this area would again act as a buffer between the proposed Commercial
development and the residential development proposed to the west.
Additionally, the OL zoning being requested includes a finger parcel of proposed OL zoning
connecting the area of OL zoning along N. 129th E. Avenue to the OL zoning along E. 96th
Street North, directly adjacent to the CS zoning (3% of the entire tract). Once again, this
portion would act as a buffer between the proposed commercial zoning and the residential
zoning being proposed by the applicant. Staff would expect that this portion would develop
as a combined landscape buffer and pedestrian trail area, the concept of which is not only
strongly endorsed by staff, but by planning professionals throughout our country.
RS -3 Residential Single- Family High Density
The applicants have requested one large area designated for single - family residential high
density which is located along the western and northern portions of the subject property.
This portion contains 70.63 acres, representing 42% of the entire subject property.
The applicants request for RS -3 zoning is a natural transgression of land uses from the more
intense to less intense. When the entire subject property and the proposed zoning changes
are reviewed as a whole, the zoning pattern requested makes sense. The most intense land
use (Commercial) is followed by Office then Single - Family High Density, which is then
abutted by Single- Family Medium Density to the west (Bailey Ranch Estates). While the
applicant did not request a planned unit development, this is a rather comprehensive approach
to the development potential of the site.
The applicant has included two buffers to those abutting properties to the north and west.
The first buffer area is along the northern boundary of the subject property. The applicant
has reserved the northerly 200' of the RS -3 proposal (abutting Sherrill Acres) for RE
(Residential Estates) zoning in order to protect those property owners and represents 8.99
acres or 5% of the subject tract. A similar buffer was required by the applicants of the
Bailey Ranch Estates zoning case in 1994.
The second buffer area is located along the western boundary of the subject property. In this
area the applicant has supplied a 125' of RS -2 (Residential Single - Family Medium Density)
buffer, representing 10.86 acres or 6% of the subject property. The land east of Bailey
Ranch Estates is zoned RS -2, and the buffer proposed would ensure comparable lot sizes
abutting that property as well. The RS -2 buffer is continued by the applicant from the
southern boundary of the proposed Bailey Ranch Estates H to E. 96th Street North.

In reviewing whether or not the streets from Sherrill Acres would be required to connect to
streets within the subject property at the time of development, staff met with the City
Manager and reviewed the stub streets from Sherrill Acres. This meeting and review has
resulted in the city's position that the streets will not be required to be connected to the
subject property. The streets within Sherrill Acres have bar ditches for stormwater drainage
and no curb and gutter. To tie this type of street into a street with curb and gutter would be
difficult at best. Additionally, the applicant has stated that these street connections are not
vital to the success of their future development, nor do the property owners in Sherrill Acres
desire to have the streets connected.
Prior to the initial public hearing on February 10, 1998, staff received numerous calls
regarding the zoning voicing opposition to various portions of the request. Numerous letters
were also submitted to staff which were forwarded to you at the February 10, 1998 meeting.
Since the public hearing, staff has received one letter regarding the proposal and conducted
one meeting with two nearby property owners. The letter was from a Bailey Ranch Estates
resident that had concerns regarding commercial intrusion, multi- family, and the traffic
development would bring to Bailey Ranch Estates. Items discussed at the meeting with
nearby property owners were questions regarding minimum property development standards,
whether or not commercial zoning was appropriate at that location, and street connections.
Please note that the meeting and the letter were conducted prior to the February 24, 1998
meeting between neighborhood representatives and the applicant. At the time of packet
preparation for this agenda, staff has received no additional comments opposing the
applicants amended application since February 24, 1998.
Letters were sent to surrounding property owners within 300' of the subject property and
notification was published in the Owasso Reporter. Copies of those original letters to
property owners and the legal advertisement are attached for your information and review.
Staff has asked the applicant to be prepared to present his request prior to the staff
presentation of the report, in order for the applicant to answer as many questions as possible
regarding the amended request.
RECOMMENDATION
Staff is recommending approval of the rezoning request, as amended.

BACKGROUND
The City of Owasso has received a request from Lincoln Ward for a review of a lot split located
within the Elm Creek Estates I Addition. More specifically, the subject properties are described
as Lots 16 and 17, Block 42, Elm Creek Estates I and are further described as 12529 and 12533
E. 83rd Street North. A location map, as well as a plat of survey indicating the proposed lot
split, are attached for your information and review.
This lot split, if approved, would create a "new" property for two properties in the Elm Creek
Estates I Addition. The property owners contacted staff in November regarding what steps they
would need to take in order to redraw property lines between their two dwellings. Staff advised
both property owners that a lot split would be the best method of accomplishing that goal.
As you can see by the plot of survey, each property owner would receive and release small
wedge shaped portions of their lot to the other. This is a matter of aesthetics to both property
owners, as each feel their homes will look better with fences oriented in this manner, rather than
the original lot line.
This item was reviewed by the Technical Advisory Committee at their February 25, 1998
regular meeting. There were no objections and/or concerns regarding the request.
Staff has no objections to the lot split request

BACKGROUND:
Lestor & Associates have submitted a site plan for a Wonder Bread Thrift Store to be located
at 11651 E. 76th Street North. The subject property is further described as Lot 4 of Owasso
Commercial Center III. An area map is attached for your information and review, and a site
plan is enclosed within your packet.
The current zoning of the property is CS (Commercial Shopping) which would allow for the
development of the site as a retail facility. A review of the site plan indicates a proposed facility
that is approximately 3,200 square feet. Based on that square footage, a total of 16 parking
spaces are required, and 17 are indicated on the enclosed site plan, one of which is designated
for handicapped parking.
The Technical Advisory Committee reviewed the request at their February 25, 1998 meeting.
At that meeting, the following comments /corrections were provided by the area utility providers
and staff:
1. The turning radius off of E. 76th Street North into the parking area should
be increased to allow increased turning movement.
2. The proposed location of the pole sign should be relocated out of the
identified easement.
3. PSO commented that they have a pedestal located in the northwest comer of
the site and a transformer in the northeast corner of the site.
4. The flume placed under the driveway shall have concrete headwalls.
No additional concerns regarding the site plan were noted.
If approved by the Planning Commission, construction is anticipated to begin shortly thereafter.
A separate permit would need to be issued for the proposed signage.
Staff recommends approval of the proposed site plan as presented with the following conditions:

BAILEY RANCH CLUBHOUSE FACILITY

BACKGROUND:
Mr. Brooks Pittman has submitted a site plan for the Bailey Ranch Clubhouse Facility. The
Clubhouse is proposed to be located at 10105 Larkin Bailey Boulevard, immediately northwest
of the current clubhouse facility. The subject property is not subdivided and therefor has a
metes and bounds legal description. A location map is attached for your information and
review and the proposed site plan is included within your packet.
The applicant indicates a total of 162 parking spaces, 6 of which would be reserved for
handicapped parking. This exceeds the amount of parking required and is the correct ratio of
handicapped parking spaces.
The Technical Advisory Committee reviewed the site plan at their February 25, 1998 regular
meeting. At that meeting, area utility providers and staff are afforded the opportunity to
comment and /or request additional easements. The following comments were noted:
1. Culvert pipe with concrete headwalls will be needed along the driveway off
of Larkin Bailey Boulevard.
2. Locations of water and sewer service lines to the existing clubhouse need to
be verified prior to construction.
3. Detention needs to be addressed.
The applicant has met with Mr. Lutz of the Public Works department regarding the detention
needs and has addressed Mr. Lutz's concerns. A new site plan is currently being developed
which will incorporate those detention areas for your review. This site plan was not completed
at the time of packet preparation, however, and will be provided to you Tuesday evening.
Please note that the layout of the clubhouse and parking lot do not change.
Staff has no other concerns regarding this request.
RECOMMENDATION:
Staff recommends approval of the proposed site plan as presented with the following conditions
of approval:
Culvert pipe with concrete headwalls beneath the driveway off of Larkin
Bailey Boulevard.
