1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

MEETING - The Commission reviewed the minutes of February 10, 1998, Bob
Randolph moved, seconded by Bill Ellison to approve the minutes as written. A vote on
the motion was recorded as follows:

4. OZ -98 -07 - A/D Group - A request for a rezoning of property from AG (Agriculture)
to CS (Commercial Shopping Center), OL (Office Light), RS -3 (Residential Single -
Family High Density), RS -2 (Residential Single - Family Medium Density) and RE
(Residential Estates). The subject property is located north and west of E. 96th Street
North and the Owasso Expressway and contains 168.692 acres, more or less.
Mr. Rooney introduced Mr. Charles Norman, the attorney for the applicant. Mr.
Norman presented a brief report to the Commissioners and the approximately 40
neighboring property owners that were present. He stated representatives from
surrounding properties met on February 24, 1998 to discuss concerns regarding this
rezoning. The stub streets from Sherrill Acres will not be required to be connected to
the subject property. The continuation of 106th Street North to 129th Street North is a
mandatory requirement of the City. The amended zoning pattern map was displayed and
discussed. The RM -1 (Residential Multi - Family) tract was removed, also the RD

(Residential Duplex) was removed from the original zoning recommendation. Questions
were answered regarding the frontage road off 129th East Avenue going into the
Commercial Shopping portion. Also, storm water concerns were addressed. Mr.
Rooney discussed the multiple zoning patterns on the amended zoning exhibit map.
Letters were sent to surrounding property owners within 300' of the subject property and
notification was published in the Owasso Reporter. Staff recommends approval of the
rezoning request, as amended.
Ray Haynes moved to approve the request as amended for the rezoning of OZ- 98 -07,
motion was seconded by Bob Randolph. A vote on the motion was recorded as follows:

5. OLS -98 -04 - Lincoln Ward - A request for review of a lot split request for Lots 16 and
17, Block 42, Ehn Creek Estates I. The subject properties are located at 12529 and
12533 E. 83rd Street North, Owasso, OK.
Mr. Rooney present a brief staff report. If this lot split is approved it would create a
"new" property for two properties. Each property owner would receive and release
small wedge shaped portions of their lot to the other. The item was reviewed by the
Technical Advisory Committee at their February 25, 1998 regular meeting and there
were no objections regarding the request.

Randolph. A vote on the motion was recorded as follows:

6. Site Plan - Wonder Bread Thrift Store - A request for review of a site plan for Wonder
Bread Thrift Store to be located on Lot 4, Owasso Commercial Center III. The subject
property is located at 11651 E. 76th Street North, Owasso, OK.

Mr. Rooney presented the staff report. The current zoning of the property is CS
(Commercial Shopping) which would be the appropriate zoning for this type of facility.
Ray Haynes moved to approve the site plan subject to the following recommendations:
1. Increase the turning radius off of E. 76th Street North per Public Works
Department specifications.
2. Sign shall be relocated outside of identified utility easements.
3. Install concrete headwalls for flume under driveway.
4. Separate permits are required for any signage.
5. Efforts should be taken (i.e. retention wall) along the east and west
property lines to address stormwater run -off.
The motion was seconded by Larry Helton. A vote on the motion was recorded as

7. Site Plan - Bailey Ranch Clubhouse Facility - A request for review of a site plan for
Bailey Ranch Clubhouse Facility. The subject property is located at 10105 Larkin Bailey
Boulevard, immediately west of the existing clubhouse facility.
Mr. Rooney gave the staff report. The subject property is not subdivided and therefor
has a metes and bounds legal description. The clubhouse will be approximately 6500
square feet. There are 162 parking spaces indicated on the site plan, 6 were indicated
for handicapped parking. The Technical Advisory Committee reviewed the site plan at
their February 25, 1998 meeting and had the following comments:
1. Culvert pipe with concrete headwalls will be needed along the driveway
off of Larkin Bailey Boulevard.
2. Locations of water and sewer service lines to the existing clubhouse need
to be verified prior to construction.
3. Detention needs to be addressed.
Bob Randolph moved to approve the site plan subject to the above recommendations,
seconded by Ray Haynes. A vote on the motion was recorded as follows:

OWASSO GOLF AND ATHLETIC CLUB
DATE: April 9, 1998
BACKGROUND
The City of Owasso has received a request to review a final plat from Lindsey Management for
their proposed development titled Owasso Golf and Athletic Club. Owasso Golf and Athletic
Club is located within Section 28 and is bounded by N. 129th E. Avenue, N. 145th E. Avenue,
E. 76th Street North and E. 86th Street North and totals 248.45 acres, more or less. The
subject property was recently rezoned as a Planned Unit Development in January by the Planning
Commission, with an underlying zoning of RM -1 (Residential Multi - Family Low Density) and
OM (Office Medium). The preliminary plat for Owasso Golf and Athletic Club was approved
by the Owasso Planning Commission at the February meeting.
The Technical Advisory Committee reviewed the final plat at their March 25, 1998 regular
meeting. At that meeting, the utility companies were afforded the opportunity to provide
comments regarding the final plat. No comments and /or corrections to the final plat were
submitted by the utility companies. Please understand that the lack of comments from the utility
companies is in large part due to the "blanket" easement granted to the utility companies. As
was presented during the preliminary plat review process, the applicants explained that their past
history when providing all required easements prior to construction often times results in
easement vacations and additional easements being required in order to address complications
that arise during construction. What the applicants proposed, and the utility companies agreed
to, was a blanket easement over the entire area of the plat for utility construction purposes. This
allows for the placement of utility lines within gpy area that is necessary to service every
proposed structure. Upon completion of a phase of construction, the utility easements would
then be filed by separate instrument for the exact location that the lines are located. This
prevents the platting of unneeded or unusable easements and results in easements only being
recorded where utilities are actually located.
Staff had the following recommended changes and /or corrections to the final plat:
1. Change "8th" Street to "86th" Street.
2. Add a 50' setback line along N. 129th E. Avenue.
3. Location of the pump for the detention ponds needs to be provided.
No additional comments and /or corrections were suggested.
As reported to you at the time of preliminary plat review, a condition of approval of the Planned
Unit Development required the realignment of the access drive opposite the Eighth Grade Center
in order to facilitate traffic flow. Review and inspection of field conditions indicate this would
be an expensive proposal due to drainage existing in the area. Please be advised that the
alignments will not be able to match up (centerline to centerline) as desired. The applicant has
pledged that all steps will be taken to insure the smooth flow of traffic in the area, including
signalization if necessary.
As is customary with final plats, acceleration/deceleration lanes are also required along the
arterial streets, as well as sidewalks. The City of Owasso is currently in the process of
exploring unique opportunities for the improvement of E. 86th Street North, from N. 129th E.
Avenue to N. 145th E. Avenue. The developer may be asked to place the construction costs of
these lanes along E. 86th Street North into an escrow account or provide a letter of credit rather
than making these improvements at this time. If the city is unable to address the widening of
E. 86th Street North in this manner, the developer will be required to make those
acceleration /deceleration lane improvements.
If the final plat is approved by the Planning Commission, final plat approval will be required
by the Council and site plan approval will need to be obtained by the Planning Commission (next
agenda item) in order for the permitting process to begin.
RECOMNMNDATION
Staff recommends Planning Commission approval of the final plat for Owasso Golf and Athletic
Club.

OWASSO GOLF AND ATHLETIC CLUB

BACKGROUND:
Crafton, Tull and Associates have submitted a site plan for a multi - family residential complex
and golf course to be located within the proposed Owasso Golf and Athletic Club Addition to
the City of Owasso. The subject property is generally described as the undeveloped property
between E. 76th Street North and E. 86th Street North and N. 129th East Avenue and N. 145th
East Avenue. An area map and site plan are attached for your information and review. Action
on this item is contingent to an approval of the final plat for Owasso Golf and Athletic Club
(previous agenda item).
The subject property is zoned PUD (Planned Unit Development) with underlying RM -1
(Residential Multi - Family Low Density) and OM (Office Medium) zoning. Both areas zoned
RM -1 and OM are consistent with the planned development of multi - family apartments and a
golf course in their respective zonings. The site plan, delivered with your packet of materials,
indicates a phased approach to the overall project with the construction of phase 1 of the
apartments and the golf course occurring simultaneously.
The site plan has been broken down into sectional sheets in order to provide for a more accurate
review. The overall site plan indicates several ponds that will be developed in order to address
detention concerns, accompanied by 2 clubhouses and pools (one for residents, one for public
use), a golf cart storage facility, as well as tennis, basketball and volleyball courts. A
landscaping plan has also been submitted and a wrought iron fence surrounds the golf course and
apartment complex. Ample parking has been provided and all interior streets are private.
The site plan was reviewed by the Technical Advisory Committee at their March 25, 1998
regular meeting. The following comments /corrections were submitted by staff and utility
companies at that meeting:
The only comment from the utility companies were to note that 4" conduit
should be provided at each structure to the intended service area. Again, the
reason for the lack of comment from the utility companies is in large part
due to the "blanket" easement that they have received.
Structures along N. 129th E. Avenue shall be setback a minimum of 50 feet.

* Several fire hydrants need to be relocated to different areas for ease of
access. Please verify these locations with Mr. Marlar of Fire Inspection
Services.
* While a sufficient number of trash receptacles have been provided, all should
be placed in an area enclosed on three sides by fencing and /or walls.
* Wind and Trash fencing around each site under construction will be
recommended as a condition of approval of the Owasso Golf and Athletic
Club. No building inspections will be conducted unless this fencing is
installed.
* Separate permits will need to be obtained for any signage.
* Staff would strongly encourage the requirement of Speed Bumps to eliminate
vehicular speed on site, especially in light of the fact that most vehicle would
be backing out into oncoming traffic.
* Handicapped parking shall be in compliance with ADA requirements.
Additionally, while floor plans and elevation profiles of the various structures were not
submitted with the site plan, staff will have copies of each available for your review on Tuesday
evening as these have been submitted for plan review. Sidewalks are shown to be provided
within the site and as a reminder, sidewalks will be required along N. 129th E. Avenue, E. 86th
Street N and N. 145th E. Avenue as well as acceleration /deceleration lanes, as a portion of the
platting requirements.
The applicant has stated that 24 -hour on -site security will be provided during actual building
construction, and staff has agreed to allow occupancy of apartment buildings as they are
completed, provided that areas remaining under construction have controlled access and are
"fenced off" from areas containing residents.
This is perhaps the largest site plan ever reviewed by the Planning Commission. If, during your
review process, you identify areas of concern that have not been addressed by staff, please
contact me so that I may address your concerns.
RECOMMENDATION:
Staff recommends approval of the site plan with the following conditions:

SITE PLAN

BACKGROUND:
Patel Construction has submitted a site plan for a Super 8 Motel with a restaurant to be located
at 7571 Owasso Expressway. The subject property is further described as a portion of Lot 1,
Block 1, Fleming Center. An area map is attached for your information and review, and a site
plan is enclosed.
The current zoning of the property is CH (Commercial High Intensity) which would allow for
the development of the site as a hotel and restaurant. A review of the site plan indicates a hotel
with 54 rooms proposed, thus requiring a total of 54 parking spaces. Please note that a total of
66 are shown on the site plan. Depending on the seating area of the restaurant and its size, the
remaining 12 spaces may or may not be adequate. Staff will review the parking requirement for
the restaurant at the time of building permit application.
The Technical Advisory Committee reviewed the site plan at their March 25, 1998 regular
meeting. The following comments were received at that meeting:
1. Please show the 17.5 utility easement within the front setback area.
2. Relocate hydrants to parking island areas.
3. Pole sign shall be relocated northward to island area (outside of easement).
4. All handicapped parking shall meet ADA requirements.
No additional concerns regarding the site plan were noted.
As stated earlier, a copy of the site plan is enclosed within your packet. Please note that this
site plan does not include the corrections required from the Technical Advisory Committee
meeting. A site plan providing those corrections will be provided to you at Tuesday evening's
meeting. If approved by the Planning Commission, construction is anticipated to begin shortly
thereafter. A separate permit would need to be issued for the proposed signage.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Rick Kramer, applicant and owner.
REQUESTED ACTION AND PURPOSE: A request to rezone the subject property from
AG (Agriculture) to RS -3 (Residential Single - Family High Density) in order to allow for
residential development.
LOCATION AND SIZE: The subject property is described as a portion of the Southeast
Quarter of the Northwest Quarter of Section 30, T21N, R14E and totals .58 acres, more or
less. The subject property is located directly north of 704 N. Carlsbad.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by property
located outside of the City Limits zoned AG (Agriculture) that is developed with a single -
family residence, while farther north lies the Village at Southern Links, zoned Planned unit
Development (underlying zoning of RS -3). The subject property is bordered to the east by
property located outside of the City Limits also zoned AG, while farther east lies residential
development that fronts onto Atlanta Street zoned RS -3. The subject property is bordered on
the south by residential property within the City Limits zoned RS -3. The subject property is
bordered on the west by property located within the Bailey Golf Ranch PUD. Recently, the
subject property was annexed by the City Council as a result of correcting a previous
annexation request.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 4 "Residential Land Uses ".
SITE INFORMATION: No unusual development hardships are noted.
ANALYSIS
The applicants are requesting a rezoning of a parcel of land totalling .58 acres in area from
AG (Agriculture) to RS -3 (Residential Single - Family High Density) in order to allow for
single - family residential development. The subject property was recently annexed by the
City of Owasso with an accompanying AG zoning.

A rezoning of the subject property to RS -3 would allow for the applicant to develop the
subject property in a residential nature, possibly even tying in the residential lots to be
created into the Southern Links residential development immediately to the west. When
reviewing the request, it would appear consistent and harmonious with surrounding
development as well as proposed development. A majority of the nearby property has
developed, or will be developed, under the RS -3 property development standards. In short,
the request is a logical extension of existing zoning patterns in the area and staff has no
identified concerns with the request.
Notices were mailed to surrounding property owners on March 16, 1998 and the legal
advertisement was published in the Owasso Reporter on March 19, 1998. A copy of both
have been attached for your information and review. Additionally, the subject property was
posted the week of March 16, 1998. No calls requesting information regarding the request
have been received by the Community Development Department, and no written comments
opposing the request were received.
RECOMMENDATION
Staff recommends approval of the rezoning request from AG (Agriculture) to RS -3
(Residential Single - Family High Density).

BACKGROUND
The City of Owasso has received a request to review the final plat for The Fairways IV at Bailey
Ranch, an addition to the City of Owasso. The Fairways IV at Bailey Ranch is located
immediately north of The Fairways II at Bailey Ranch, and is best described as a continuation
of the residential development surrounding the northern portion of the golf course (that area
between E. 86th Street North and E. 96th Street North).
The Fairways IV at Bailey Ranch consists of 69 lots on 23.7 acres, more or less. The entire
subject property is zoned PUD (Planned Unit Development) and allows for several different size
residential lots. No commercial, office, or multi- family development is included within this final
plat area. A location map is attached for your information and review, as well as copies of the
final plats for Fairways I and II. The preliminary plat for The Fairways IV at Bailey Ranch was
approved by the Planning Commission at the July 1997 regular Planning Commission meeting.
The Owasso Technical Advisory Committee reviewed the final plat for Fairways IV at their
March 25, 1998 regular meeting. At that meeting, the area utility companies were present to
comment on the final plat. The comments on the Fairways IV plat were limited to the
following:

Staff comments regarding the final plat were limited to an addressing correction provided for
Lot 1, Block 5, as well as comments regarding the "flag" lots located in Blocks 1 and 6. As
was stated at the time of preliminary plat review, while these types of lots are generally not
encouraged in residential platting, lots of a similar layout were contained in Fairways I and II
and were also included in the conceptual layout and plan as a portion of the Golf Course Planned
Unit Development. While the Planning Commission did not express concern regarding this type
of lot layout, concern was expressed at the Council level. Once again I have advised the
applicant, Mr. Kourtis, that he should be prepared to discuss these lots at both the Planning
Commission and Council level, should you have any concerns.
Acceleration /Deceleration lanes are required along the entrance to this addition off of E. 96th
Street North, as well as sidewalks. Street and Storm Sewer Construction Plans are currently
awaiting revisions, while Water and Sanitary Sewer Construction Plans have been approved by
the Engineering Division of the Public Works Department. The permits to construct the Water

and Sanitary Sewer have been received from the State Health Department and are attached for
your information and review.
A copy of the Fairways IV plat is enclosed. The Deed of Dedication is provided on the enclosed
plat. Covenants, while usually provided by the developer on the plat, are not required to be
submitted as this is a private agreement between the developer and the purchasers of the lots
within the addition. The applicant has indicated that the covenants will be similar to those found
within Fairways I and II.
RECONEVIEENDATION
Having had all items from the TAC meeting addressed, staff recommends approval of the final
plat for The Fairways IV at Bailey Ranch.

BACKGROUND
The City of Owasso has received a request to review a preliminary plat for the Fairways at
Bailey Ranch - Phase IV, an addition to the City of Owasso. Fairways IV is immediately north
of Fairways I and II and would contain 54 lots on 17.5 acres, more or less. The subject
property is zoned PUD (Planned Unit Development) with an underlying zoning of RS -3
(Residential Single - Family High Density). A location map is attached for your information and
review, as well as copies of the final plats for Fairways I and II.
The preliminary plat was reviewed by the Technical Advisory Committee at their June 25, 1997
regular meeting. At that meeting, staff as well as area utility companies are afforded the
opportunity to comment and request additional requirements be adhered to by the applicant. The
following is a list of comments regarding the Fairways IV preliminary plat:
1. Covenants need to be submitted with the final plat application.
2. Provide a lot area total sheet.
3. Street names and addresses are available for final plat.
4. No occupancy of any homes will be permitted in Fairways IV until Mingo
acceleration /deceleration lanes are completed.
5. Several requests for utility easements.
6. Construction plans need to be submitted with final plat application.
Street names and the requested utility easements have been included on the preliminary plat
within your packet. A lot area total sheet has been provided and all other comments are
advisory in nature and need to either be considered by the applicant are addressed prior to final
plat application.
It should also be noted that Lots 18 and 23 of Block 4 represent "flag" lots. While not typically
encouraged in residential platting, lots of a similar layout were contained in Fairways I and II
and were also included in the conceptual lot layout and plan as a portion of the Golf Course
Planned Unit Development. While the Planning Commission did not express concern regarding
this type of lot layout, concern was expressed at the Council level. I have advised the applicant,

Enclosed is Permit No. SL000072980112 for the construction of 6,050 L.F. of eight (8) inch sewer
line and appurtenances to serve the Fairways IV at Bailey Ranch Sewer Line Project, City of
Owasso, Tulsa County, Oklahoma.
The project authorized by this permit should be constructed in accordance with the plans approved
by this department on February 17, 1998. Any deviations from the approved plans and
specifications affecting capacity, flow or operation of units must be approved, in writing, by the
Department before changes are made.

Pursuant to O.S. 27A 2 -6 -401, the City of Owasso is hereby granted this permit to construct 6,050
L.F. of eight (8) inch sewer line and appurtenances to serve the Fairways IV at Bailey Ranch Sewer Line
Project, located in part of the W 1/2 of Section 19, T -21 -N, R -14 -E, City of Owasso, Tulsa County,
Oklahoma, in accordance with the plans and specifications approved on February 17, 1998.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in accordance
with Discharge - OPDES (NPDES) rules OAC 252:605 and to comply with the state certification laws,
Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted thereunder regarding the
requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receive supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of
approval or the phases not under construction will be resubmitted for approval as a new
project.
3) That no significant information necessary for a proper evaluation of the project has been
omitted or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with OAC 252:655- 9 -1(h) of the Standards for Water
Pollution Control Construction Standards.
5) That tests will be conducted as necessary to insure that the construction of the sewer lines will
prevent excessive infiltration and that the leakage will not exceed 200 gallons per inch of pipe
diameter per mile per day.
6) That the Oklahoma Department of Environmental Quality shall be kept informed of occurrences
which may affect the eventual performance of the works or that will unduly delay the progress
of the project.
7) That the permittee will take steps to assure that the connection of house services to the
sewers is done in such a manner that the functioning of the sewers will not be impaired and
that earth and ground water will be excluded from the sewers when the connection is
completed.
8) That any deviations from approved plans or specifications affecting capacity, flow or operation
of units must be approved by the Department before any such deviations are made in the
construction of this project.

13) That all manholes shall be constructed in accordance with Water Pollution Control Construction

Quality.
14) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in
Water Pollution Construction Standards OAC 252:655- 9 -1(f) and OAC 252:655- 9 -1(g),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested to the highest pressure obtainable under the most severe head conditions of
the collection system prior to backfilling in accordance with Water Pollution Construction
Standard OAC 252:655 -9 -1 (h).
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will
constitute acceptance of the permit and all conditions or provisions.

RELATING TO HANDICAPPED PARKING

BACKGROUND:
In January of this year the Owasso City Council, as a result of citizen concerns, directed the
City Manager to review city ordinances relating to the parking of commercial vehicles in
residential areas, as well as handicapped parking. Staff created the Parking Review Committee,
which consisted of a Council and Planning Commission representative, as well as citizen and
commercial representation. A copy of the report from the Parking Ordinance Review Committee
to the City Council is attached for your information and review.
While the report recommended changes to the Code of Ordinances relating to the parking of
commercial vehicles in residential areas as well as handicapped parking requirements, the report
also contained a recommended amendment to the Owasso Zoning Code specifically relating to
handicapped parking. The amendment relates to the type of space that is required according to
ADA guidelines, as well as the ratio of handicapped spaces required. The recommended
amendments are not severe, but are simply necessary in order for the Zoning Code's
requirements for handicapped parking to be identical to that of ADA specifications.
While the City Council is the governing authority over the Owasso Code of Ordinances,
amendments to the Owasso Zoning Code are required to be reviewed by the Planning
Commission and forwarded to the City Council with a recommendation. The City Council
reviewed the Parking Ordinance Review Committee's report at their April 7, 1998 meeting and
accepted the committee's report, thus directing staff to draft the necessary ordinances to amend
the Code of Ordinances as well as presentation of the proposed text amendment to the Planning
Commission.
If the Planning Commission approves the proposed text amendment to the Owasso Zoning Code,
an Ordinance amending the Zoning Code will be presented to the City Council at their April 21,
1998 regular meeting.
RECOMMENDATION:
Staff recommends approval of the proposed text amendment to the Owasso Zoning Code.

MEETING RESULTS AND CHANGES

BACKGROUND:
In January of this year, the City Manager under the direction of the City Council, created a
committee to review the City of Owasso's regulations relating to both residential and
handicapped parking. Specifically, the committee was formed as a result of recent citizen and
customer concerns regarding the parking of large commercial vehicles in residential areas and
a lack of handicapped parking in conformance with ADA requirements. The committee was
comprised of the following individuals:

Mr. Bob Randolph - Planning Commission Representative
Ms. Kim Brimer - Citizen Representative
Dr. Mark Argo - Business Representative
Mr. Randy Cunningham - Police Department Representative
Mr. Ted McCord - Code Enforcement Representative
Ms. Marsha Hensley - Administrative Assistance
The committee conducted meetings on three separate occasions, the first of which occurred on
March 2, 1998. At that meeting, the "charge" of the committee was discussed, mutually
identified concerns regarding residential and handicapped parking were discussed, as well as
discussion regarding possible solutions and how to implement those solutions. Ms. Candace
Low, an Owasso resident and Associate Director of Ability Resources, Inc. also attended that
initial meeting and provided beneficial materials regarding handicapped parking requirements.
Ability Resources, Inc., is a non - profit organization partially funded by United Way, that assists
individuals and organizations in accessibility issues.
The second meeting was conducted on March 19, 1998. Committee members had previously
agreed to review the Code of Ordinances, as well as be prepared to make recommended changes
relating to both residential and handicapped parking concerns. At that meeting, the committee
agreed that the following language contained within the Code of Ordinances was unclear,
confusing, and did not adequately address concerns regarding commercial vehicle parking in
residential areas:

SECTION 15 -718 PARKING OF CERTAIN COMMERCIAL VEHICLES
ON PUBLIC STREETS IN RESIDENTIAL AND
COMMERCIAL AREAS.
A. No person shall park any commercial vehicle, other than pick -up
trucks of three- quarter (3/4) ton classification or lighter, on any
through street not on any street of thirty (30) feet or less in width
at night unless the person is in a residential area.
B. No person shall park any commercial vehicle, other than trucks of
one and one half (1/2) ton classification or lighter, or wider than
an ordinary passenger car, on any public street.
C. Notwithstanding the provisions of Subsection A and B above, a
commercial vehicle may be parked as not to create a traffic hazard
during active loading and unloading.
D. No person shall park a commercial vehicle at any time opposite
another vehicle on a street thirty -six (36) feet or less in width.
The term "street" as used herein, shall mean the entire width
between the curbs of every way publicly maintained when any part
thereof is open to the use of the public for purposes of vehicular
travel. (Prior Code, Chapter 20)
The following changes were recommended to replace Section 15 -718 by the committee:

A significant amount of time was spent during the first two meetings of the committ ee discussing
concerns regarding handicapped parking as well. As a result of those discussions, as well as
information provided by Ms. Low, it was determined that while ADA specifications for
handicapped parking mandate that all handicapped parking spaces be "posted" with the
International Symbol of Accessibility, ADA specifications do not mandate that the parking space
be painted. Discussion was held regarding whether or not the City should require the painting
of the space, however it was the consensus of the committee that often times that paint fades,
is difficult to see at night or during inclement weather, and would be difficult to enforce. In
order to clarify this specification, the following recommendation was arrived at by the
committee:
SECTION 15 -719 HANDICAPPED PARKING
A. It is unlawful for any person to place or park a motor vehicle in any parking
space on private property accessible to the public and where the public is
invited or public property that is designmed posted as a reserved area for
parking of motor vehicles of a physically disabled person unless such is
eligible for a detachable insignia or reflective insignia as a physically disabled
person under the provisions of Sections 15 -112 or 149.3 of Title 47 of the
Oklahoma Statutes, and such insignias are displayed as provided in Sections
15 -112 or 149.4 of Title 47 of the Oklahoma Statutes or regulations adopted
pursuant thereto.
Upon review of the Code of Ordinances, as well as the information provided by Ms. Low
regarding ADA requirements for handicapped parking, staff initiated a review of the Owasso
Zoning Code regarding the specifications for the type, amount, and location of handicapped
parking contained within that document. The following recommended changes would ensure
handicapped parking specifications within the Zoning Code would be incompliance with ADA
regulations:
SECTION 1140 DESIGN STANDARDS FOR OFF - STREET PARKING AREAS
A. A required off - street parking space shall be at least 9 feet in width and at
least 19 feet in length exclusive of access drives or aisles or equivalent
measurements for 45° or 60° angle parking.
B. A parking lot servicing each entrance pathway shall have a number of level
parking spaces, as set forth in the following table, identified by above -grade
signs, as being reserved for physically handicapped parking. Each parking
space so reserved shall not be less than 9 feet in width and must have an
access aisle that is at least 5 feet in width. In the event that only one (1)
handicapped parking space is needed, said space shall be accompanied by an
access aisle no less than 8 feet in width and designated van accessible.

In addition to these recommended changes, the committee discussed steps that could be taken
to obtain ADA compliance at existing business locations, as well as how new businesses could
be informed of ADA requirements in a clear and concise manner.
In an effort to address existing businesses within our community that had either fallen out of
compliance or were never in compliance with ADA guidelines, staff has developed a standard
letter (attached for your information and review) that would be sent by the Community
Development Department whenever a non - compliance condition exists. While the committee
was aware that the legal ability of the city organization to require existing businesses to obtain
a state of compliance is limited, the committee also felt that most business owners simply do not
know what the ADA specifications require, and once informed, would move swiftly toward
obtaining compliance. The letter would be sent to the owner of the business or property owner
informing them of their non - compliance and providing for a follow -up inspection in thirty (30)
days. Non - compliance after the thirty (30) day period would result in an additional letter of
notification. A continued state of non - compliance would result in assistance being sought from
the Department of Justice.
Accompanying the letter of notification would be the enclosed copy of the ADA Guide for Small
Businesses. The document, developed by the Department of Justice, appears to be the most
clear and concise definition of the ADA requirements. In addition to its use with the letter of
notification to businesses in a state of non - compliance, staff also strongly recommended that the
document be provided to all incoming businesses at the time of site plan and /or building permit
application. Additionally, copies of this document would be provided to the Chamber of
Commerce to assist in educating potential commercial development about ADA requirements
within our community.

In order to measure the results of the committee's recommendations, it was advised that a
follow -up meeting be planned six to nine months after implementation. At that time, additional
steps could be identified, if needed, to address any ongoing concerns. Continued scheduling of
follow -up meetings to monitor the success of the recommendations would also be scheduled at
that meeting, if desired.
In conclusion, staff would like to acknowledge and thank those committee members and citizens
that participated in this process. While the charge of the committee may have seemed easy, all
who participated were educated regarding residential and handicapped parking requirements.
A comprehensive review of those requirements was conducted, open and frank discussion
occurred, and recommendations that address concerns previously expressed to the Council were
realized.
If Council approves the recommendations submitted by the Parking Ordinance Review
Committee, staff will begin the process of business notification and follow -up, as well as
presentation to the Owasso Planning Commission and the drafting of the necessary ordinances
to amend the referenced documents.
RECOMMENDATION:
The Parking Ordinance Review Committee recommends Council approval of the amendments
to the Owasso Code of Ordinances and the Owasso Zoning Code, as well as the steps outlined
for business notification, thus directing staff to draft the necessary ordinances to amend those
documents.
