CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 9, 1998 REGULAR MEETING. - The Commission reviewed the minutes of June 9, 1998 Regular Meeting, Charles Willey moved, seconded by Bob Randolph to approve the minutes as written. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Bob Randolph - Yes Larry Helton - Yes Charles Willey - Yes The motion carried 5 -0. 4. Site Plan - Kourtis Properties - A request for review of a site plan for Kourtis Properties. The subject site is located immediately northeast of Bank of the Lakes, 12404 E. 86th Street North, Owasso, OK. (This item was tabled at the June 9, 1998 regular meeting.) Mr. Rooney stated that he had spoke with Mr. Kourtis and requested this item to be tabled until the August 11, 1998 meeting. Preliminary Plat - Camden Park II - Trails End Development proposes a 13.86 acre, 42- lot subdivision. The subject property is zoned RS -2 (Residential Single - family Medium Density) and is generally located south of the Windsor Lake II Addition. (This is a resubmittal with changes of Windsor Lakes III which appeared before the Planning ` Commission in August, 1997.) Mr. Warlick gave a brief staff report. He stated that tieing in this subdivision with the surrounding neighborhoods will provide a much smoother traffic flow throughout the area. The Technical Advisory Committee reviewed this plat at their June 24, 1998 meeting with no major concerns or comments. All of the comments from this meeting have been addressed by the applicant. Concerns of a surrounding property owner were addressed regarding the name being changed to Camden Park II. Ray Haynes moved to approve the Preliminary Plat, Bill Ellison seconded. Preliminary Plat - Country Estates III - A & W Land Development, Inc., proposes a 17.37 acre, 62 -Lot subdivision. The subject property is zoned RS -3 (Residential Single - Family High Density) and is generally located west of the Country Estates I Addition. Mr. Warlick presented a brief report. The Technical Advisory Committee reviewed the preliminary plat at their June 24, 1998 meeting. Easement requests were provided by the utility representatives. Also, staff had some questions regarding a non - conforming lot and a proposed right -of -way. This plat contains all of the recommendations from staff and the utility companies. Charles Willey moved to approve the Preliminary Plat, Bob Randolph seconded the motion. OWASSO PLANNING COAT IISSION July 14, 1998 Page No. 3 7. Plat Amendment (Text) - Nottingham Estates II - The developer has requested an amendment to the covenants of Nottingham II. The developer wishes to allow lot splits within the subdivision so long as resulting lots are forever attached to the side yards of abutting neighbors. Mr. Warlick briefed the Commission on this item. This proposal will reduce the density in this subdivision. There are a total of 15 lots in Nottingham Estates IL There were - concerns expressed regarding the event of easements placed between the two lots. Mr. Steve Compton with Tyann Development, Inc. presented a brief report to the Commissioners. He explained that the easements would be studied at the time of lot split application and lot splits go before the Planning Commission. If this Plat Amendment is approved it would give the property owners the opportunity to purchase 11h lots opposed to 2 lots. Charles Willey moved to approve the Plat Amendment, Bill Ellison seconded. Thomas Slemons - The owner proposes a lot split of property located a 11505 E 83rd St No, further described as Lot 14F, Block 3, Three Lakes addition to the City of Owasso. The first, smaller lot proposes to contain an existing business ( Icky's Laundromat), and the second, larger lot will be marketed as commercial property. Mr. Warlick presented a brief report to the Commissioners. The smaller lot (.28 acre) would contain Icky's Laundromat, and the larger lot (1.27 acre) would be available for commercial development. The Technical Advisory Committee reviewed this request at their June 24, 1998 meeting with no comment. Questions were answered regarding the eastside drainage. Ray Haynes moved to approve the lot split request, Bob Randolph seconded. OWASSO PLANNING COABMSION July 14, 1998 Page No. 4 9. Easement Closing - J. Thomas Slemons - (This proposal concerns the same property described in Item 5). The owner requests the closing of an easement on the property. At this item, a 15 -foot utility easement runs east to west across the center of the property. Mr. Warlick presented the staff report. The Technical Advisory Committee reviewed this proposal at their June 24, 1998 meeting and had no comments or concerns. Ray Haynes moved to approve the easement closing, Charles Willey seconded the motion. Site Plan - Robertson Tire - The developer, Bill Robison, proposes to locate tire service center at 8341 Owasso Expressway, further described as Lot 14, Block 3, of the Three Lakes Addition to Owasso. Mr. Warlick presented the staff report. The site plan shows 12 parking spaces which includes 2 handicapped spaces. Signage will be addressed separately through the permitting process. The Technical Advisory Committee reviewed the site plan at their June 24, 1998 meeting. Concerns regarding the drainage were expressed. Questions were answered regarding the 8' x 4' tall retaining wall on the south side of the lot. Ray Haynes moved to approve the site plan subject to the following conditions: 1) All TAC comments be addressed by the applicant. 2) The developer apply for a separate permit for any signage. 3) All handicapped parking and accessibility features conform to ADA standards. 4) That the drainage plans be reviewed and approved by Phil Lutz, City Engineer. 5) That a dumpster location with a screening fence be shown on a plan. 6) A letter from ONG and PSO regarding the verification of a utility easement. Charles Willey seconded the motion. Site Plan - ROC Owasso (Albertson's) The developer, KMO Development Group, Inc. proposes the construction of a grocery store at 12912 E 86th St No, further described as Lot 1, Block 1, of the ROC Owasso addition to the City of Owasso. Mr. Warlick presented the staff report. The developer has plans for a 56,000 sq ft supermarket on approximately 22.75 acres. A detailed landscape plan will be submitted to the Community Development Department for review. The site plan shows 685 parking spaces and 14 handicapped spaces which meets with the City of Owasso zoning code requirements. The Technical Advisory Committee reviewed this site plan at their regular meeting on June 24, 1998 with minimal concerns. The amount of curb cuts in this phase were addressed by the Commissioners. Ray Haynes moved to approve the site plan for ROC Owasso subject to the below conditions: 1) That the developer submit a detailed landscape plan. 2) That the developer submit a traffic detailed drawing illustrating on site traffic movements and traffic control devices to be used in the parking areas. 3) That plans for the storm water detention facility be approved by the City Engineer. 4) That landscaping and traffic issues by addressed to the satisfaction of staff prior to the issuance of a Certificate of Occupancy. 5) The developer shall apply for a separate permit for signage. 6) All handicapped parking and accessibility features shall conform to ADA standards. 7) A site plan review provided by the Owasso Fire Department. Chairperson Secretary Date MEMORANDUM TO: THE ANNEXATION COMMITTEE CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: ANNEXATION REQUESTS HART AND ROACH DATE: August 6, 1998 :T .41111Z Dorothy Hart and Mr. and Mrs. Everett Roach have submitted petitions to the City of Owasso requesting annexation of properties, which combined would total approximately 5.26 acres. The subject properties are located north of Morton Marine, east of Garnett Road. The subject properties are bordered on the east by the Owasso Expressway and on the north by the Hayward Smith property, zoned PUD (planned Unit Development). The subject properties are bordered on the west by excess right -of -way from Old Highway 169 which is located in the city limits of Owasso but is owned by Tulsa County, while farther west lies Garnett Road itself. The subject properties are bordered to the south by Morton Marine which is zoned`CG and located in Tulsa County. A subject map is enclosed within your packet for your information and review. The subject properties are currently zoned RE (Residential Estates) If annexation is approved, the zoning of the property would become AG (agriculture) the lowest zoning classification in the City of Owasso. The purchaser of the subject properties has indicated the intent to combine the lots with additional property to the north as a commercial site. Prior to any development of the subject properties, as well as the property to north, the developer would need to obtain the appropriate zoning and proceed through the platting and site plan review processes. It should be noted that upon any development of these properties, acceleration/deceleration lanes would need to be included for all entries along Garnett Road. Sidewalks would also be required. Water and sewer service to the subject properties are currently supplied by the City of Owasso as both parties lie within the city's water service area. Staff has addressed the annexation requests of both properties in one memorandum due to the proximity of the subject properties to each other, however sperate action would be required by the Planning Commission and Council on each item. Notification of the annexation request was published in the Owasso Reporter on July 23, 1998 to notify the public of the annexation request before the Planning Commission. That notification will be followed by notification published two consecutive weeks in the Owasso Reporter on July 30, 1998 and August 6, 1998 to notify the public of City Council action regarding the request. Copies of the Procedures for Annexation and the City of Owasso Annexation Policy are attached for your information and review. The Technical Advisory Committee reviewed this request at their July 29, 1998 meeting. At that meeting, area utility companies and staff are afforded the opportunity to address any problems or concerns they have with the annexation request. No comments opposing the request for annexation were received at that meeting. The Owasso Annexation Committee reviewed the subject ptoperty attheit August 5,° 1998 meeting and °unanimously recommended approval of:the-� annexation request. A review of the annexation policy indicates that the subject properties meet the policy guidelines with the exception of tract size. Please note that requirement was intended as a guideline in order to prevent the spot annexation of properties into, the city limits of Owasso. Obviously these parcels are adjacent to the existing city limits and will assist ongoing efforts to eliminate Tulsa County parcels surrounded by property that is in the City of Owasso. All properties should be contiguous to existing city limits. All properties should be annexed into the city limits as the lowest zoning classification, that is, AG, agricultural. Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by Council on March 1, 1988. Rooney Assistant City Manager MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: ANNEXATION REQUEST KOURTIS PROPERTIES, LLC DATE: August 6, 1998 Kourtis Properties, LLC has submitted a petition to the City of Owasso requesting annexation of property totalling approximately 408.7 acres. The subject property is bordered on the north by E. 106th Street North, while farther north lies AG -R lots located in Tulsa County. The subject property is bordered on the West by Mingo Road, while the subject property's south and east boundaries vary depending upon the exact location. Generally, the subject property is all of the remaining undeveloped land in the square mile area bounded by E. 96th Street North, Mingo Road, E. 106th Street North, and Garnett Road (It does not include the Kelly Ann Addition). A subject map is enclosed within your packet for your information and review. The subject property is currently zoned PUD (Planned Unit Development) with underlying zoning of CS (Commercial Shopping), OL (Office Light), RS (Residential Single - Family) and AG (Agriculture). If annexation is approved, the PUD and the underlying zoning of the property would be abandoned and the zoning would become AG. The applicant has indicated the intent to develop the subject property predominately in a residential manner and has conducted preliminary discussions with staff about PUD zoning. Prior to any development, the subject property would then need to obtain zoning and proceed through the platting process. It should be noted that upon any development of this property, acceleration/deceleration lanes would need to be included for all entries along Mingo Road, E. 106th Street North, Garnett Road and E. 96th Street North. Sidewalks along these arterial streets would also be required. This annexation request is similar in nature to the previous agenda item in the sense that the subject property lies in the water service area that was a portion of the District Court settlement between Washington County Rural Water District #3 and the City of Owasso. As a part of that settlement, the City of Owasso was granted an opportunity to provide water service in an area that is within Washington County Rural Water District #3 service area (generally the area is bounded by 96th Street North, Mingo Road, 126th Street North, and Garnett Road). At the time that water service to the subject property is desired, the owner would need to pay Washington County Rural Water District a fee of $50.00 for each tap desired. A complete copy of the District Court settlement is attached for your information and review. That notification will be followed by notification published .two consecutive weeks in the Owasso Reporter on August 6, 1998 and August 13, 1998 to notify the public of City Council action regarding the request. Copies of the Procedures for Annexation and the City of Owasso Annexation Policy are attached for your information and review. The Technical Advisory Committee reviewed this request at their July 29, 1998 meeting. At that meeting, area utility companies and staff are afforded the opportunity to, address any problems or concerns they have with the annexation request. No comments opposing the request for annexation were received at that meeting. The Owasso Annexation Committee reviewed the subject property at their meeting on Monday, August 3, 1998 and unanimously recommended approval of the annexation request. If annexed, the subject property would be located in Ward One. RECOMMENDATION: Staff recommends approval of the annexation request as the subject property meets the policy requirements. All properties should be contiguous to existing city limits. 3. All properties should be annexed into the city limits as the lowest zoning classification, that is, AG, agricultural. Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by Council on March 1, 1988. The subject property is bordered on the north by E. 116th Street North, while farther north lies AG -R lots located in Tulsa County. AT &SF Railroad borders the subject property on the east, while farther east lies the Owasso Sports Park zoned AG (Agriculture). The subject property is bordered on the south by additional undeveloped property zoned AG and located in Tulsa County. The subject property is bordered on the west by Mingo Road, while farther west lies the Hillside Estates Addition, zoned AG and located within the city limits of Owasso. (Please note the Planning Commission will review a rezoning request from AG to CS (Commercial Shopping Center) on a portion of property in the Hillside Estates Addition on August 11, 1998) A subject map of the annexation request has been attached for your information and review. All properties should be contiguous to existing city limits. 3. All properties should be annexed into the city limits as the lowest zoning classification, that is, AG, agricultural. Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. Where a city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by Council on March 1, 1988. The subject property is located generally on the north side of E 86' St. N, west of Bank of the Lakes. The subject property resides in an OL (Office Low Intensity) zoning district. It is surrounded by single - family residential development zoned RS -3 (Residential Single - Family High Density) district to the north and west, a vacant lot also in an OL district to the east, and CG (General Commercial) district property to the south across E 86' St. N. The existing lot is irregular in shape (roughly triangular) and relatively shallow, but this is due to the existence of a large drainage ditch located along northwest side of the property. The subject property contains a one- story, brick office building with two tenants. The owner proposes a lot split on a line that is perpendicular to E 86' St. N and located 93.5 feet west of the existing eastern property boundary. The split would form two new lots, described as Tract "A" and Tract `B" on the attached map. The subject property is relatively small at 2.56 acres, and it is difficult to envision a medium density residential buffer that would function on this site. Bulk and Area Requirements for the CS District would limit the building setbacks to a minimum of 10 feet to abutting residential property. It is also anticipated that proposed commercial facilities, such as the gymnastics center (Use Unit 11 — Offices and Studios), would be required to submit site plans to the Planning Commission through a separate process. Section 1530 of the Owasso Zoning Code regarding zoning map amendments confers jurisdiction to the Planning Commission to act on the proposed CS zoning, or a zoning district of lesser intensity. In this case the Planning Commission could also act on OM (Office Medium Intensity) District or OL (Office Low Intensity) District, or any combination thereof. A recommendation of a lower intensity land use would not change parking or setback requirements, and would only serve to limit the types of facilities that can locate at this site. The 1985 Owasso Comprehensive Plan recommends medium intensity commercial, surrounded by medium intensity residential for the northeast corner of E 861, St. N and N 145'" E Ave. Although the proposed CS (Shopping Center Commercial), CG (General Commercial), and RM- 2 (Residential Multi - Family) Districts are slightly larger than the 1985 plan suggests, the importance of this node has also increased. When the comprehensive plan was drafted 12 years ago, few predicted that this area would have so much potential for development. Unforeseen conditions such as the growth of the 861, St. corridor and construction of the sewer interceptor have changed the outlook for this area. These changing conditions should be accounted for in the Comprehensive Plan update currently being developed. The Comprehensive Plan also calls for low- density residential development on the remainder of the tract. The developer proposes an appropriate RS -2 (Residential Single - Family Medium Density) District for the same area. Large floodplain areas near Elk Creek would make a full build out of this site very costly and difficult. In the accompanying PUD plan, the developer C: \Owasso\Planning Commission %- 11- 98 \07. The proposal for Preston Lakes PUD is quite large, and made possible only by the new Elm Creek Sewer Interceptor. The developer proposes a combination of single - family housing (131.3 acres), villa townhouses (8.0 acres), multi - family apartments (18.5 acres), and commercial (11.0 acres). The developer also proposes a 70.2 acre park, in areas which do not lend themselves to development, primarily because of the floodplain. A stated goal of the development is to fulfill a need for a diverse range of housing types, reflective of the needs of today's and tomorrow's home buyer. The proposal offers a wide variety of land uses on a single site, and the developer proposes to use the topography, as well as other vegetative and man-made buffers to separate the more intense from the less intense land uses. The highest intensity land uses are shown at the southwest corner of the property, near the intersection of E 86' St. N and N 145'" E Ave. This generally conforms to the recommendations of the 1985 Comprehensive Plan for the City of Owasso. With such a large site, the developer is seeking flexibility in the form of a PUD. The underlying zoning for the PUD very closely resembles the land use calied for in the 1985 Comprehensive Plan. A copy of the land use map is attached herein. The overall densities for residential and commercial, would be very consistent with the Comprehensive Plan. Although the commercial and higher density housing areas are slightly larger (about 25 %) than the plan calls for, the importance of this node has also increased. Unfortunately, the Comprehensive Plan does not provide any direct guidance in the use of the PUD. The Comprehensive Plan Map of 1985 includes text that was drafted in 1978. At that time, the PUD was not widely used. As a result, there is no information regarding the PUD in the Comprehensive Plan. This should be remedied in the Comprehensive Plan update currently being developed. For guidance we can turn to the Zoning Code, Chapter 8, regarding Planned Unit Development. The PUD was created to address certain conditions and situations where conventional zoning would be ineffective, or even detrimental. Such conditions might include unique topographical considerations. Elm Creek may qualify as a unique situation. b) Whether the PUD is in harmony with the existing and expected development of surrounding areas. Surrounding land uses can be broken down into three affected areas: 1) Areas near the proposed commercial. Around the proposed commercial area lies: an undeveloped 80 acre tract to the north, Hodson Elementary and additional undeveloped land to the south, and Silver Creek Addition that will likely expand to abut some of the commercial areas of the PUD along 145'n E C: \Owasso\Planning Commission \8- 11- 98 \08. The commercial areas appear to be compatible with the surrounding land use, both existing and anticipated. A buffer to the north is recommended (and shown in the text addendum to the PUD includedin this packet) simply because °the�commercial area is F R� relatively large, and the anticipated development in the 80 acre tract will likely of a lower density. The developer will need to pay special attention to pedestrian movement to ensure complete compatibility with the elementary school (this is also reflected in the text addendum). 2) Areas near the proposed multi- family. Again, the multi- family area is fairly insulated. The 80 acre tract lies to the north, proposed commercial to the west across a buffer zone, proposed single - family to the east across a buffer zone, and vacant land to the south across 86' St. N, also buffered. The proximity to Hodson Elementary is desirable for families with children who may live in the multi- family area. Nearby convenience commercial is also a plus for higher density residential as it may help to reduce the overall number of vehicle trips. The developer has tried to ensure that the multi- family will be compatible with surrounding land use. 3) Areas near the park and single- family development. Single - family housing is proposed to abut the rear lots of existing estate lots to the north. Although the proposed housing will probably be of a higher density, the abutting properties are reasonably compatible with one another. The proposed park could serve as an amenity for all of the neighboring properties. The Premier Homesites in the SE comer of the PUD will be located opposite existing estates lots to the south across E 86' St. N. Again, this should be compatible with existing land use. The proposed Villa townhouses will be located to the north of the Premier Homesites and south of the park. Although this is a higher density development, the proximity of the park should provide openness and feeling of space. A large undeveloped 40 acre strip along N 16151 E Ave. abuts the proposed PUD to the east. This may be developed as residential, or a combination of residential and commercial near the intersection of 86'h St. and 161` E Ave. Both of these possibilities will be reasonably compatible with the surrounding park and residential areas. In summary, the developer has located each of the proposed land uses appropriately within the development. The strategic location of each land use should result in very few incompatibilities with the surrounding land uses. The possibility of a well- maintained park nearby may even enhance the quality of life of the neighbors. Under the rules of the PUD, the developer has the ability to reallocate each of these land uses within the development. If the developer chooses this option, the Planning Commission may require additional buffering to ensure compatibility in and around the development. c) Whether the PUD is a unified treatment of the development possibilities of this C: \Owasso\Planning Commission \8 -11- 98\08. The purpose of the Planned Unit Development as defined in Chapter 8 is fulfilled by the proposed Preston Lakes PUD. The PUD would: 1) Permit innovative land development while maintaining appropriate limits on the character and intensity of use and assure compatibility with adjoining and proximate properties; 2) Permit flexibility within the development to best utilize the unique physical features of the particular site; 3) Provide and preserve meaningful open space; 4) Achieve a continuity of function and design within the development. The PUD also conforms to the standards set forth in Chapter 8. The developer has submitted the appropriate application materials and has established a plan that should conform to the requirements of the Owasso Zoning Code. Staff does not anticipate any difficulties in the administration of the Preston Lakes PUD as proposed. Certain details regarding ownership of the park and maintenance of drainage facilities are unresolved but it is not necessary to resolve these issues for approval of the PUD concept. Maintenance agreements as well as dedication of land for public purposes can and should be resolved during the platting process. RECOMMENDATION Staff recommends approval of the PUD subject to the following conditions: A. That the applicant's Development Text, Text Addendum, and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code; B. Theoretically a response by the Owasso Fire Department could require an 800 foot hose lay. This by far exceeds the desired hose lay of 150 feet. A water line and hydrant could be installed by accessing the water main that crosses the west end of their property. I understand that this would greatly increase the cost of any future growth for the company, but the long hose lay could be detrimental to the firefighting abilities of the fire department.
