Annexation Request - Owasso First Assembly of God - A request for annexation of an
8.90 acre parcel of land on which the Owasso First Assembly of God Church is located.
The subject property is located south of the southeast corner of E. 96th Street North and
Garnett Road.
6. Right -of -Way Closing - Section 6, T21N. R14E - A request for a closing of dedicated
right -of -way located north and west of the northwest corner of E. 116th Street North and
Garnett Road. The right -of -way to be closed exists on paper only and is located within
a portion of the planned Country Estates II addition.
7. Request to Change the February Meeting Date - A request to change the February
meeting date of the Owasso Planning Commission from February 11, 1996 to February
13, 1996 due to meeting conflict.

The agenda for the meeting was posted in the Owasso City Hall, 207 S Cedar, on December
5, 1996 at 8:00 AM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:05 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF NOVEMBER 12, 1996 REGULAR
MEETING - The Commission reviewed the minutes of November 12, 1996, Jerry Cole
moved, seconded by Dewey Brown to approve the minutes as written. A vote on the
motion was recorded as follows:

4. OLS -96 -10 - Owasso Properties One. Inc. - A tract of land located within the S/2 of the
SE /4 of Section 20, T21N, R14E.
The Chair introduced the case and the staff review was given by Mr. Rooney. The
location of the requested lot split is immediately west of the Warehouse Market property.
The individual tract to be split measures 185' x 217' and would consist of 40,145 square
feet or .92 acres. The only comment received by the Technical Advisory Committee was
a request for a 17.5' utility easement around the perimeter of the proposed lot split.
Ray Haynes moved to approve the lot split, Dewey Brown seconded. A vote on the
motion was recorded as follows:

5. OLS -96 -11 - Roark Family L.L.C. - The East 28 feet of Lot 1, Block 2 and the West
72 feet of Lot 2, Block 2, Ram Plaza Addition. The Chair introduced the case and the
staff review was given by Mr. Rooney. Mr. Rooney reviewed the lot split history
regarding this property. The applicant, Mr. Roark was present to answer any questions.
Following discussion, Jerry Cole moved to approve the lot split subject to documentation
stating a 20' access easement along the west side of the property to help with the loading
and unloading of shipments. The motion was seconded by Dewey Brown. A vote on
the motion was recorded as follows:

6. Site Plan - Larry Sherman - A request for a review of a site plan for Lot 5, Block 1, Elm
Creek Condominiums Amended.
The Chair introduced the case and the staff review was given by Mr. Rooney. The
subject site is located immediately south of Southern Style Beauty Salon on N. 123rd E.
Ave. Review was made by the Technical Advisory Committee and no corrections,
deletions or additions were made. Staff recommends approval of the site plan with the
condition of the construction of a sidewalk along the entire property frontage abutting N.
123rd E. Avenue. The contractor of this project was present to answer questions or
concerns.
Dewey Brown moved to approve the site plan subject to staff recommendations, Jerry
Cole seconded. A vote on the motion was recorded as follows:

7. Site Plan - Mingo Manufacturing - A request for a review of a site plan for Mingo
Manufacturing located on Lot 1, Block 1, Mingo Commerce Center.

The Chair introduced the case and the staff review was given by Mr. Rooney. The
subject site plan is for an expansion of their current use for an additional shop building.
The Technical Advisory Committee reviewed the site plan, ONG commented that the
area in which the site plan indicates a desire to obtain gas service did not have a gas line
near it. Staff had three recommendations for the proposed site plan. First, the applicant
supply some method of getting storm water to the detention area by either crown road
and curb inlet or area inlet up stream of the detention pipe. Second, fencing along the
shared property line with Wildwood Apartments. Finally, a fire hydrant to be located
closer to the site.
Jerry Cole moved for approval of the proposed site plan as presented with the following
conditions:
1. Method to address storm water, as discussed above; said plans being
approved by the Engineering Division of Public Works.
2. Inclusion of a site obstructing fence meeting requirements contained within
the Owasso Zoning Code.
3. A fire hydrant placed closer to the proposed site.

The meeting was recessed at 8:10 PM and reconvened at 8:45 PM at Corbin James. No
items of planning significants were discussed.

SUBJECT: PRELIMINARY PLAT
CENTRAL PARK II
DATE: January 9, 1997
BACKGROUND
The City of Owasso has received a request to review the preliminary plat for Central Park II,
an addition to the City of Owasso. Central Park II is located southwest of the Central Park
addition, and east of the Lakeridge addition. The subject property is zoned RS -3 (Residential
Single - Family High Density). The preliminary plat for Central Park II is enclosed, as well as
a copy of Central Park plat.
The subject property contained within the Central Park II plat has been under several different
development scenarios since first platted in a preliminary nature in 1994. In 1994, a preliminary
plat for Central Park II was approved by the Planning Commission and contained a portion of
the property contained within the plat currently before you. In 1995, after a change of
ownership, a preliminary plat for Cardinal View was approved by the Planning Commission.
This property contained a portion of the property contained within the plat before you, as well
as the property where the regional detention pond is located and the Owasso Ninth Grade
Center. Since that time, the property has once again changed ownership and the plat enclosed
within your packet is the latest application.
The preliminary plat was reviewed by the Technical Advisory Committee at their January 2,
1997 meeting. At that meeting, several comments /requests for additional utility easements were
made by utility companies and these are included within the current plat.
As you may recall from the December 1996 Planning Commission meeting, I informed the
Planning Commission that I had received an application for a preliminary plat for Central Park
II that I was not comfortable forwarding to the Planning Commission for action. Since that
meeting, the developer, engineer, and surveyor conducted a meeting with staff to discuss those
concerns. The enclosed plat is a result of that meeting, which has now resulted in a preliminary
plat with larger lots and a more uniform street layout.
One exception, however, of the Owasso Subdivision Regulations will be necessary in order for
this plat to become reality. The "intersection" that occurs in the northwest portion of the plat
does not meet the minimum distance required for streets to be offset. Staff is in strong support
of this exception, however, as only four (4) residential homesites are located around the
proposed "eyebrow" and should not create a substantial traffic flow challenge.
Covenants for Central Park II still need to be submitted, as well as all construction plans for this
addition. It is staff's understanding that the covenants are intended to resemble those of Central
Park. Please be advised that the construction plans will need to be approved by the Engineering
Division of Public Works prior to a final plat submittal to the Owasso Planning Commission.
Finally, I would like to add that although the preliminary plat for this addition did create some
initial challenges both to staff and the developer and his technical support staff, I am 100%
comfortable with this plat proceeding further in the development process.
RECOMMENDATION
This plat being preliminary in nature, thus gives staff, planning commission and TAC members
the opportunity to review it again. Therefore, staff recommends approval of the preliminary plat
for Central Park II.

SUBJECT: ANNEXATION REQUEST
OWASSO FIRST ASSEMBLY OF GOD, INC.
DATE: January 10, 1997
BACKGROUND:
Owasso First Assembly of God, Inc., has submitted to the City of Owasso a petition for
annexation of property located south of the southeast corner of E. 96th Street North & N. 129th
E. Avenue containing 8.90 acres, more or less. The subject property is described as Lot One
(1), Block One (1) of Owasso Assembly of God, and contains the Owasso First Assembly of
God church. A subject map is attached for your information and review.
The subject property is currently zoned AG (Agriculture) and would remain zoned AG upon
annexation pending any rezoning application. The Zoning Code allows for the City Council to
annex and rezone property under one ordinance if the property has been given previous zoning
in Tulsa County, however in this case, AG is also the established zoning in the county.
Churches, described as being a Use Unit 5 in the Owasso Zoning Code, are required to operate
via Special Exception in zoning districts other than OM (Office Medium) and any commercial
zoning. The subject property did go through this process with Tulsa County and obtained a
Special Exception several years ago. If annexed, the Owasso First Assembly of God church
would be a "pre- existing non - conforming" use, thus allowing the church to continue to operate
at that location, provided that there is no expansion or increase in size /area. If the applicants
desire to expand their facility, they would first need to rezone to either OM (Office Medium)
or a form of commercial (Note that any form of commercial zoning would not be supported
by staff), or process a Special Exception request through the Board of Adjustment. It is staff's
understanding that the applicants want to pursue OM zoning upon annexation.
The Technical Advisory Committee reviewed the annexation request at their January 2, 1997
meeting. At that meeting, staff and area utility companies were present to offer comments on
the annexation request. No comments opposing the annexation request were discussed at that
meeting.

Copies of the annexation policy and procedures are attached for your information and review.
The subject property would appear to meet all requirements with the exception of tract size as
properties of larger than 20 acres are preferred. Staff feels that this requirement was directed
more at undeveloped property however, and annexation of this property would not be
detrimental.
The Owasso Annexation Committee reviewed the annexation request at their January 9, 1997
special meeting and unanimously approved the annexation request. A copy of the minutes from
that meeting are also attached for your information and review.
The notice for annexation was published in the January 2 and January 9, 1997 additions of the
Owasso Reporter for Planning Commission action and will be published in the January 16, 1997
Owasso Reporter for any possible Council action.
RECOMMENDATION:
Staff recommends approval of the annexation request.

1005.1 Description

in residential areas to serve the residents or need a residential environ-

ANNEXATION POLICY
1• While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the
lowest zoning classification, that is,. AG, agricultural.
Landowners may then petition for rezoning if -they desire
further development of their .property. All legal uses annexed
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
and accepted by the City Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a -city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation .for a six month period after
rejection by the City Council.

The agenda for the meeting was posted in the Owasso City Hall, 207 S. Cedar, on January 6,
1997 at 10:00 AM.
1. CALL TO ORDER - Mr. Rooney called the meeting to order at 5:05 PM.
2. CONSIDER APPROVAL OF THE MINUTES OF JUNE 27, 1996 - Charles Willey
motioned, seconded by Robert Carr, to approve the minutes. Motion carried 8 -0.
ANNEXATION REVIEW
3. Owasso First Assembly of God. Inc. - An approximate 8.90 acre tract located south and
west of the southwest corner of E. 96th Street North and N. 129th E. Avenue described
as Lot One (1), Block One (1), Owasso Assembly of God. The subject property contains
the Owasso First Assembly of God church.
Mr. Rooney presented the annexation item. Chief Allen commented on current fire
fighting abilities in the area of the Owasso First Assembly of God, as well as water
pressure. Currently, the ability of the fire department to fight a fire at that facility is
limited, however it is currently the fire department's responsibility to fight a fire at that
area.
Mr. Ray reviewed that the city would have no increased liability if this property was
annexed. Furthermore, ISO ratings could go up or down in the city whether or not the
church was annexed, due to the random selection process that exists when they perform
ISO visits and the fact that are abilities to fight fires at other structures currently within
the city limits are limited too.
With no further comments, Bob Allen motioned, seconded by Charles Willey, to
recommend approval of the annexation request to the Owasso Planning Commission.
The motion carried 8 -0.
4. ADJOURNMENT - Councilor Helm moved, seconded by Charles Willey, for
adjournment. The meeting was adjourned at 5:31 PM.

BACKGROUND:
The City of Owasso has received a request from A & W Development for the closing of public
right -of -way located within Section 6, Township 21 North, Range 14 East of Tulsa County. The
general location of the proposed closing is north and west of the northwest corner of E. 116th
Street North and Garnett Road and would be contained within the proposed Country Estates II
property.
The request is interesting in the sense that the proposed right -of -way to be closed exists in paper
form only and does not exist physically at the site. A copy of an area map, with the right -of-
way to be closed highlighted, is attached for your information and review. As you can see, this
right -of -way is located throughout much of what is proposed as Country Estates II. A physical
review of the area indicates that no street exists in this area.
The Technical Advisory Committee reviewed the request at their January 2, 1997 meeting. No
comments and /or concerns regarding the right -of -way closing were expressed at that meeting.
Staff has no objections to the closing of the right -of -way.
RECOMMENDATION:
Staff recommends Planning Commission approval of the right -of -way closing request.
