CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:05 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 10, 1996 REGULAR MEETING - The Commission reviewed the minutes of December 10, 1996, Jerry Cole moved, seconded by Ray Haynes to approve the minutes as written. A vote on the motion was recorded as follows: Ray Haynes - Yes Jerry Cole - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes The motion carried 5 -0. 4. Preliminary Plat - Central Park II - A request to review a preliminary plat for Central Park II, an addition to the City of Owasso located immediately south of Central Park and east of Lakeridge. Said addition to contain 96 single - family residential lots zoned RS -3 (Residential Single - Family High Density) on 41.56 acres, more or less. The Chair introduced the case and the staff review was given by Mr. Rooney. The Technical Advisory Committee reviewed the preliminary plat at their January 2, 1997 meeting. Several requests for addition utility easements were made by the utility companies. Concerns regarding the "intersection" at the northwest portion of the plat, not meeting the minimum distance for streets to be offset, were discussed by the Commission. OWASSO PLANNING COMMISSION January 14, 1997 Page No. 2 Ray Haynes moved to approve the preliminary plat for Central Park II subject to TAC evaluations and staff recommendations, Charles Willey seconded. A vote on the motion was recorded as follows: Ray Haynes - Yes Jerry Cole - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes The motion carried 5 -0. 5. Annexation Request - Owasso First Assembly of God - A request for annexation of an 8.90 acre parcel of land on which the Owasso First Assembly of God Church is located. The subject property is located south of the southeast corner of E. 96th Street North and 129th E. Ave. The Chair introduced the case and the staff review was given by Mr. Rooney. The subject property is described as Lot One (1), Block One (1) and is currently zoned AG. The Technical Advisory Committee reviewed this request and there was no comments of opposition. Also, the Annexation Committee reviewed the request at their special meeting on January 9, 1997 and approved the request. Charles Willey summarized some of the comments that were made at the Annexation Committee meeting regarding the Fire Department's concerns. Following discussion, Jerry Cole moved to approve the annexation request, Ray Haynes seconded. A vote on the motion was recorded as follows: Ray Haynes - Yes Jerry Cole - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes The motion carried 5 -0. 6. Right -of -Way Closing - Section 6, T21N. R14E - A request for a closing of dedicated right -of -way located north and west of the northwest corner of E. 116th Street North and Garnett Road. The right -of -way to be closed exists on paper only and is located within a portion of the planned Country Estates II addition. The Chair introduced the case and the staff review was given by Mr. Rooney. No concerns regarding this request were expressed at the Technical Advisory Committee meeting. Staff recommends approval of this request. Charles Willey moved to approve the right -of -way, Dewey Brown seconded. Chairperson Secretary Date MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: ANNEXATION REQUEST EDISON FAMILY DATE: February 4, 1997 BACKGROUND: The City of Owasso has received consent for the annexation of an approximate 20 acre parcel of land located south of the southwest corner of E. 96th Street North & Garnett Road. The subject property is owned by the Edison family and a subject map and legal description are attached for your information and review. The subject property is currently zoned RMT (Residential Multi - Family Townhouse) within Tulsa County. Residential Multi - Family Townhouse allows for the development of attached single - Family townhouse dwellings, on separate lots, which are designed expressly for separate ownership, in a higher density than conventional detached single - family dwellings. The Owasso Zoning Code (reference material attached) allows for the City Council to annex and zone property under one ordinance if the property retains the existing zoning classification once annexed. To summarize what this means, if an applicant already had RMT zoning in Tulsa County and wants to maintain the same zoning in the city limits, no zoning process is necessary. This is an option that the Council can consider in addition to rezoning the property to AG (Agriculture). The Technical Advisory Committee reviewed the annexation request at their January 2, 1997 meeting. At that meeting, staff and area utility companies were present to offer comments on the annexation request. No comments opposing the annexation request were voiced at that meeting. Copies of the City of Owasso's annexation policies and procedures are attached for your information and review. The subject property would meet all of the noted policy guidelines with the exception of being rezoned to AG (Agriculture). Please note, however, that the annexation policies were developed as guidelines and the request to continue the established zoning of the property is within the purview of the process. Staff Report Annexation Request Page 2 of 2 The notice for annexation was published in the January 23 and 30, 1997 additions of the Owasso Reporter to notify the public of any possible Planning Commission action related to the annexation request on February 13, 1997. The notice for annexation will be published in the February 2, 1997 Owasso Reporter to notify the public for any Council action. The Annexation Committee conducted its review of the annexation request at their February 3, 1996 Special Meeting and unanimously approved the request. SECTION 110 PURPOSES, ON INTERPRETATION, AND JURISDICTION 110.1 Purposes This code is enacted for the purposes of promoting the health, safety, peace, morals, comfort, convenience, prosperity, order and general welfare; to reduce the danger and congestion of public transportation, to provide adequate light and air, public utilities, facilities and service, and other public requirements; to promote productive and enjoyable harmony between man and his environment; to achieve a balance between population and resource use which will permit high standards of living and a wide sharing of amenities; to prevent overcrowding of land and undue encroach- ment thereon; to promote efforts which will prevent or eliminate danger to the environment; to stimulate and assure for all citizens safe, healthful, productive, and aesthetically and culturally pleasing surroundings; to encourage the residential, commercial, and industrial growth of the com- munity as well as the most appropriate use of land; and to encourage the development of the community in accordance with a Comprehensive Plan. 110.2 Interpretation a. Validity of Other Laws Where this code imposes a greater structures or land or upon height quires larger open space or yards ordinances, laws, or regulations, shall not be construed to prevent ordinances, laws, or regulations limitations. b. Tense and Definition For the purpose of this code certain terms and words are to be used and interpreted as defined in Chapter 16 of this code: words used in the present tense shall include the future tense; words in the singular number include the plural and words in the plural number include the singular, except where the natural con- struction of the writing indicates otherwise. The words "shall" and "will" are mandatory. 110.3 Jurisdiction a. Territorial Jurisdiction This code shall be in full force and effect and shall apply to all lands within the incorporated limits of the City of Owasso, Oklahoma. Annexed Territory When any territory shall be brought into the zoning jurisdiction of the City of Owasso by annexation or otherwise, such territory shall be deemed to be in the AG Agriculture district, provided, however, that the City Council may annex and rezone in one ordinance properties given previous zoning in Tulsa County. This provision shall not operate to preclude subsequent rezoning of such property by amendment in the manner set forth in Chapter 15. c. Property owned, leased or operated by the City of Owasso, Okla- homa, or any other public or governmental body or agency shall be °i subject to the terms of this code. SECTION 120 ENACTMENT 120.1 Planning Commission Approval and Recommendation The Owasso Planning Commission after Public Hearing does hereby approve and recommend to the City Council that this new Zoning Code and Zoning Map be adopted. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing city limits. 3. All properties should be annexed into the city. limits as the lowest zoning classification, that is,. AG, agricultural. Landowners may then petition for rezoning if -they desire further development of their.property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a "city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation .for a six month period after rejection by the City Council. 1. Adopted by Council on March 11. 1988. CONSIDER APPROVAL OF THE MINUTES OF JANUARY 9, 1997 - Robert Carr motioned, seconded by Ray Haynes, to approve the minutes. Motion carried 3 -0. ANNEXATION REVIEW 3. Geraldine Francis Haas Edison - A request for annexation of an approximate 20 acre parcel of land located south of the southwest corner of E. 96th Street North and Garnett Road. The subject property is further described as the S/2 of the NEA of the NE /4 of Section 19, Township 21 North, Range 14 East. Mr. Rooney presented the annexation item. (Rodney Ray enters at 5:10) Ray Haynes asked for clarification regarding the statement in staff's memorandum regarding the incoming zoning of the property if it was annexed. Mr. Rooney responded that when an applicant requests annexation, the city has the option of maintaining the established zoning of the property (in this case RMT) or annexing the property into the city with AG (Agriculture) zoning. Upon completion of the discussion, Ray Haynes motioned to approve the annexation, seconded by Robert Carr. Motion carried 4 -0. 4. ADJOURNMENT - Councilor Helm moved, seconded by Charles Willey, for adjournment. The meeting was adjourned at 5:31 PM. MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: LAKESHORE GREENS PRELIMINARY PLAT DATE: February 4, 1997 BACKGROUND The City of Owasso has received a request from the Larkin Bailey Foundation, current owners, for the review of a preliminary plat for Lakeshore Greens. Lakeshore Greens is located north of the northeast corner of E. 86th Street North and Mingo Road along the northern portion of the Bailey Golf Course. An area map has been enclosed for your information and review. The subject property is zoned PUD (Planned Unit Development), with the underlying designation of Residential Multi - Family Low Density. RM -1 zoning allows for the development of multi- family housing (apartments) outright at that location. Please note, however, that no tax credit, low- income, or rent subsidized housing is being proposed by the applicants. The preliminary plat which contains 2 lots with an acreage total of approximately 14.18 acres, was reviewed by the Technical Advisory Committee at their regular meeting on January 29, 1997. At that meeting, the only comment from utility companies was from PSO. PSO requested an additional 12.5' utility easement along the east side of the 50 feet of Mingo Road right -of -way. This was the only comment from utility companies. Staff provided comments in the following areas: 1. Limits of no access will need to be added along the property line abutting the Mingo Road right -of -way to match up with that of the submitted site plan. Please note, only one access point is being recommended by staff at this time. 2. Sidewalks will be required along Mingo Road. 3. Acceleration /Deceleration lanes will be required along Mingo Road at the entrance. 4. Construction plans will be required at the time of final plat submittal. As stated earlier in the memo, the preliminary plat is for property that contains an RM -1 underlying zoning classification and allows for multi - family housing. If approved, the Planning Commission should anticipate a site plan application for review at the March regular meeting. RECOMMENDATION Staff recommends Planning Commission approval of the preliminary plat for Lakeshore Greens providing the outlined recommendations contained within the memorandum are conditions of approval. HIGH L RS-3 A •':�IIU TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: FINAL PLAT COUNTRY ESTATES H DATE: February 4, 1997 BACKGROUND The City of Owasso has received a request from A &W Development to review a final plat for Country Estates II. Country Estates II is located north of Country Estates and is north and west of the northwest corner of E. 116th Street North and Garnett Road. A location map, as well as a copy of the Country Estates plat have been attached for your information and review. The proposed final plat would contain approximately 193 single - family residential high density lots on 48.14 acres, more or less. The subject property was rezoned from AG (Agriculture) to RS -3 (Residential Single- Family High Density) in May of 1995. The Technical Advisory Committee reviewed the preliminary plat for Country Estates II at their May 1, 1996 regular meeting. At that meeting, area utility companies had the opportunity to request additional service easements, as well as utility easements for street lighting. All of these requested easements were included on the final plat reviewed and approved by the Planning Commission on May 14, 1996. The final plat was reviewed by the Technical Advisory Committee at their January 29, 1997 regular meeting. Staff had identified several missing lot lines as well as errors within the covenants of the plat prior to the TAC meeting and met with the applicant's engineer and all of those concerns were addressed and the corrections are included within the plat enclosed. At the TAC meeting, however, utility companies added the following comments: The 5' utility easements located on the property lines of Lots 5 and 6, Block 1 need to be changed to the property lines between Lots 6 & 7, Block 1. 2. South of Lots 5 thru 9, Block 12 a separate 11' utility easement needs to be filed by separate instrument. All other concerns by staff and the utility companies have been addressed at this time. Construction plans have been reviewed and approved by the Engineering Division of Public Works and a permit from DEQ has been applied for by the applicant. As you are aware, if the final plat is approved by the Planning Commission, no final plat is reviewed by the City Council until those permits are received from DEQ. Additionally, sidewalks will be required along N. 129th E. Avenue, as well as acceleration /deceleration lanes. RECOMMENDATION Staff recommends Planning Commission approval of the final plat for Country Estates II subject to the inclusion of the easement changes /additions requested from the Technical Advisory Committee. Rooney - Community Development Director BACKGROUND APPLICANT AND STATUS OF APPLICANT: Owasso First Assembly of God, Inc. REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from AG (Agriculture) to OM (Office Medium) to allow recently annexed property that contains a church to be permitted outright. LOCATION AND SIZE: The property is located south of the southeast corner of E. 96th Street North and N. 129th E. Avenue and is described as Lot 1, Block 1, Owasso Assembly of God. The subject property contains approximately 8.90 acres, more or less. EXISTING LAND USE: The subject property is developed as a church. SURROUNDING LAND USE: The subject property is abutted on the north by a residence and undeveloped property, both located in Tulsa County, zoned CS (Commercial Shopping Center) while further north lies E. 96th Street North. The subject site is bordered on the west by N. 129th E. Avenue, while further west lies additional OM (Office Medium) zoning which is not developed. The subject property is bordered on the south by AG zoned property, also in Tulsa County, developed as a church. East of the subject property lies the Windsor Lake Addition zoned RS -2 (Residential Single - Family Medium Density). APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments" and Chapter 5 "Office Land Uses ". SITE INFORMATION: No unusual development hardships are noted. ANALYSIS The proposed rezoning, if approved, would allow the Owasso First Assembly of God church to operate as a permitted use at that location. The applicants, upon annexation, had 4 options: 1. To exist as a non - conforming use until anytime they planned future enlargement of their facility. 2. To obtain a Special Exception through the Owasso Board of Adjustment in order to operate under the AG (Agriculture) zoning. 3. To rezone the property to any Commercial designation in order to be permitted by right. 4. To rezone the property to an OM designation in order to be permitted by right. Staff was clear at the time of annexation that commercial zoning would not be supported and the applicants were clear that they had intended to pursue OM zoning if annexed. OM zoning is established immediately west of the subject property and appears to be a logical buffer to the RS -2 zoning found to the east... commercial zoning at this location would not be logical in the event the property ever changed hands. With the subject property being developed as a church, OM zoning allows for the applicants to build extensions to the existing facility without the Board of Adjustment approval process. Please understand, however, that any expansion larger than 2,000 square feet would still require Planning Commission site plan review. Letters were sent to surrounding property owners within 300' of the subject property and notification was published in the Owasso Reporter. Staff has received one comment in favor of the rezoning request and a copy of it, as well as copies of the legal advertisement and letter to property owners, are attached for your information and review.
