The agenda for the meeting was posted in the Owasso City Hall, 207 S Cedar, on May 7, 1997
at 4:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF APRIL 8, 1997 REGULAR
MEETING - The Commission reviewed the minutes of April 8, 1997, Jerry Cole moved,
seconded by Bill Ellison to approve the minutes as written. A vote on the motion was
recorded as follows:

4. Utility Easement Closing Request - Lawrence Carden - A request for the closing of the
southeasterly 7.5 feet of the northwesterly 17.5' utility easement located on Lot 9, Block
1, of Barrington Point, an addition to the City of Owasso. The subject property is
further described as 8934 N. 130th E. Ave.
The Chair introduced the case and the staff review was given by Mr. Rooney. The
partial closing of the utility easement is requested in order for them to build an in- ground
swimming pool. It is necessary for the applicant to obtain closure of that portion of the
utility easement before a pool permit is issued. Technical Advisory Committee met on
April 30, 1997, two utility companies had concerns with the request and later met with
the owners. After that meeting there were no objections to the request.
Ray Haynes moved to approve the utility easement closing request, Bill Ellison seconded.

5. Utility Easement Closing Request - Suzanne Carter - A request for the closing of the
southerly 1.4 feet of the northerly 11' utility easement located on Lot 13, Block 2,
Copper Meadows Addition, an addition to the City of Owasso. The subject property is
further described as 7828 N. 132nd E. Avenue.
The Chair introduced the case and the staff review was given by Mr. Rooney. The
Technical Advisory Committee reviewed the easement closing request at the April 30,
1997 meeting and had no objections. A Variance request is also required due to the
dwelling being located only 9.6' from the north property line and a minimum of 10' is
required.
Following discussion, Jerry Cole moved to approve the utility easement closing, subject
to obtaining a Variance of the RS -3 property development standards from the Owasso
Board of Adjustment for .4'. Ray Haynes seconded the motion. A vote on the motion
was recorded as follows:

6. Amendment to Chapter 10 of the Owasso Zoning Code, Wireless Communication Tower
Ordinance - Review and appropriate action relating to a proposed amendment to Chapter
10 of the Owasso Zoning Code, allowing for the regulation of wireless communication
towers.
A review of this item was given by Mr. Rooney. Ordinance No. 541 (a sixty day
moratorium on the construction or modification of all types of communication towers)
was approved and adopted at the March 18, 1997 regular meeting of the Owasso City
Council. This proposed amendment was a result of staff's review of the Owasso Zoning
Code regarding towers and attending a conference that was held on March 24 and 25,
1997 in Dallas, Texas. This proposed amendment which would amend Chapter 10,

Section 1004 of the Zoning Code by adding "wireless telecommunication and utility
facilities.
After discussion, Charles Willey moved to approve the Amendment to Chapter 10,
Section 1004 of the Owasso Zoning Code, Jerry Cole seconded. A vote on the motion
was recorded as follows:

Accessory Vendors by Special Exception Only - Review and appropriate action relating
to a proposed amendment to Chapter 10 of the Owasso Zoning Code, requiring all non-
permanent accessory vendors to be approved by Special Exception through the Owasso
Board of Adjustment only.
Mr. Rooney reviewed the proposed amendment with the Commissioners. By obtaining
a Special Exception through the Owasso Board of Adjustment, all property owners within
300 feet of the property would receive notification, a legal ad published, a site plan
would be required for review, and a public hearing would be conducted. If adopted as
an amendment to the Zoning Code, it would not be applicable to the current vendors.
Jerry Cole moved to approve the proposed amendment to Chapter 10 of the Owasso
Zoning Code, the motion was seconded by Charles Willey. A vote on the motion was
recorded as follows:

FINAL PLAT
DATE: June 5, 1997
BACKGROUND
The City of Owasso has received a request to review a final plat for Brentwood Estates II.
Brentwood Estates II is located immediately north of Brentwood Estates and immediately east
of Barrington Estates. The subject property contains 50 RS -2 (Residential Single - Family
Medium Density) zoned lots on 20.49 acres, more or less. An area map is enclosed for your
information and review.
The Technical Advisory Committee reviewed the final plat for Brentwood Estates II at their May
28, 1997 regular meeting. At that meeting, utility companies and staff provided the following
comments /corrections for the submittal:
1. Change the Building Lines off of N. 138th E. Avenue for Lots 1 and 3 of
Block 4 to 15 feet.
2. Remove the second paragraph of Item #12 "Set -Back Lines" within the
covenants
3. Correct Item No. 2 (A) in covenants to read "Dwellings in excess of a
single -story shall have a minimum living space of 2250 square feet at the
lower level.
4. Numerous requests for easements were also made by the utility companies,
a complete list of which are attached for your information and review.
All of the above identified corrections have been made and are included within the enclosed plat
and covenants for Brentwood Estates II. Construction plans have been submitted for review and
minor revisions have been required. If the final plat is approved by the Planning Commission,
no action will occur on the final plat by the Council until DEQ issues the permits for water and
sanitary sewer.
RECOMMENDATION
Staff recommends Planning Commission approval of the final plat for Brentwood Estates II as
submitted.

SITE PLAN

BACKGROUND:
Bank of the Lakes has submitted a site plan for a financial institution to be located at 12401 E.
86th Street North. The subject property is further described as a portion of the S/2 of the SE /4
of Section 20, T21N, R14E. The lot on which the proposed facility is to be located was created
via a lot split in December of 1996. An area map is attached for your information and review.
The current zoning of the property is OL (Office Light) which would allow for the development
of the site as a financial institution. A review of the site plan indicates a proposed facility that
is approximately 5,500 square feet, with 5 drive -thru lanes and 1 ATM lane. A total of 19
parking spaces are required based on the size of the facility, and 27 are indicated on the enclosed
site plan. Staff would recommend that one of the parking spaces located in the front parking
lot be designated for handicapped parking.
In addition to the site plan, a detailed landscaping plan is also enclosed for your information and
review. The Technical Advisory Committee reviewed the request at their May 28, 1997
meeting. No concerns regarding the site plan were voiced by staff or the utility companies.
If approved by the Planning Commission, construction is anticipated to begin shortly thereafter.
A separate permit would need to be issued for the proposed signage indicated on the site plan.

1. Label one of the parking spaces in the front parking area for handicapped parking.

SUBJECT: ANNEXATION REQUEST
MURIEL JOHNSON LIVING TRUST
DATE: June 5, 1997
BACKGROUND:
The City of Owasso has received a request for the annexation of an approximate 20 acre parcel
of land located on the north side of E. 96th Street North, directly north of the Pleasant View
Addition. The subject property is owned by the Muriel Johnson Living Trust and the subject
map and legal description are attached for your information and review.
The subject property is currently zoned RE (Residential Estates) within Tulsa County. The
Owasso Zoning Code allows for the City Council to annex and zone property under one
ordinance if the property retains the existing zoning classification once annexed. To summarize
what this means, if an applicant already had zoning established in Tulsa County and wants to
maintain that same zoning in the city limits, no zoning process is necessary. The applicant has
not indicated a desire to maintain RE zoning, therefor, zoning would revert to AG (Agriculture).
The Technical Advisory Committee reviewed the annexation request at their May 28, 1997
regular meeting. At that meeting, area utility providers and staff are afforded the opportunity
to provide comments regarding the annexation. No utility providers had comments regarding
the request.
Copies of the City of Owasso's annexation policies and procedures are attached for your
information and review. The subject property would meet all of the noted policy guidelines.
The notice for annexation was published in the May 29th and June 5th additions of the Owasso
Reporter to notify the public of any possible Planning Commission action related to the
annexation request. The notice for annexation will also be published in the June 12, 1997
Owasso Reporter to notify the public of any possible Council action.
The Annexation Committee reviewed the request at their May 29, 1997 regular meeting and
unanimously recommended approval of the request.
Staff recommends approval of the annexation request.

The undersigned, constituting not less than three- fourths of the registered voters and being
owners of not less than three- fourths (in value) of the hereinafter described real estate situated
in Tulsa County, Oklahoma, to -wit:
The West Half of the Southeast Quarter of the Southwest Quarter of Section 16, Township 21
North, Range 14 East of the Indian Base and Meridian, Tulsa County, State of Oklahoma,
according to the US Government Survey thereof, containing 20 acres, more or less
being territory adjacent and contiguous to the incorporated City of Owasso, Oklahoma, and not
presently embraced within the Limits thereof, hereby consent to the City Council of the City of
Owasso, Oklahoma, to annex the aforementioned real estate into the City Limits of said City.

You are hereby advised that the above consent for annexation was filed with the Community
Development Director of the City of Owasso on the 9th day of May, 1997, and that said request
will be presented to the Owasso Planning Commission, at the Owasso Community Center, 301
South Cedar, ,Owasso, Oklahoma at 7:00 PM on the 10th day of June, 1997.
All persons interested in this matter may be present at the hearing and give their objections to
or arguments for the proposal. The Planning Commission will submit its recommendation to
the City Council of the City of Owasso for its consideration and action, as provided by law.

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable. n
2. All properties should be contiguous to existing city limits.
3. All properties should be. annexed into the city. limits as the
lowest zoning classification, that is, -. AG, agricultural.
Landowners may then petition for rezoning if -they desire
further development of their property. All legal uses annexed
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
and accepted by the city Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a'city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation .for a six month period after
rejection by the City Council.

1. CALL TO ORDER - Tim Rooney called the meeting to order at 5:07 PM.
2. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 3, 1997 - Phil Lutz
moved, seconded by Robert Carr, to approve the minutes. Motion carried 2 -0.
ANNEXATION REVIEW
3. Muriel Johnson - A request for annexation of an approximate 20 acre parcel of land
described as the W/2 of the SE /4 of the SWA of Section 16, Township 21 North, Range
14 East.
Mr. Rooney presented the annexation item. The property is zoned RE (Residential
Estates) and the applicant has not indicated a desire to maintain the property at RE
zoning, therefore, the zoning revert to AG (Agriculture). The Technical Advisory
Committee reviewed the annexation request at their May 28, 1997 regular meeting. There
were no comments or problems from the TAC members on this item.
Robert Carr moved, seconded by Phil Lutz, to approve the annexation. Motion carried
2 -0.
4. ADJOURNMENT - Phil Lutz moved, seconded by Robert Carr, for adjournment.

SITE PLAN
DATE: June 5, 1997
BACKGROUND:
Owasso First Assembly of God has submitted a comprehensive site plan for an expansion of
their current facility located at 9341 N. 129th E. Avenue. The subject property is further
described as Lot 1, Block 1, Owasso Assembly of God. The subject property was annexed in
January of 1997, is zoned OM (Office Medium), and contains 8.90 acres, more or less An area
map is attached for your information and review, as well as a copy of the Owasso Assembly of
God plat and site plan.
As one can see, 95 percent of the building area has been constructed /developed to date. The
proposed site plan indicates the addition of a bus garage, additional parking, and a playground.
Landscaping is also indicated throughout the entire site plan. The proposed bus barn's
dimensions are 40' x 80' and is setback approximately 70' from the shared property line of that
of the Windsor Lake Addition.
As stated during the annexation and rezoning process of this property, staff recommended that
the applicant be required to seek a site plan approval from the Planning Commission prior to any
additional construction occurring at the church site. The Technical Advisory Committee
reviewed the site plan at their May 28, 1997 regular meeting and unanimously recommended
approval of the request.
Staff's only comments regarding the request are concerning the size of the existing detention
facility. While it appears the detention facility was designed to address storm water run -off for
the entire site, this site developed within Tulsa County jurisdiction. Staff recommends that the
Planning Commission require the applicant to submit the engineering report regarding the
detention capacity prior to permit approval and /or parking lot expansion.
RECOMMENDATION:
Staff recommends approval of the proposed site plan as presented with the following condition:
1. An engineering report regarding the detention capacity, including run -off calculations at
build -out of the site, prior to the issuance of a building permit and /or parking lot
expansion.
