CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF SEPTEMBER 8, 1997 REGULAR MEETING - The Commission reviewed the minutes of September 8, 1997, Charles Willey moved, seconded by Dewey Brown to approve the minutes as written. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes Bob Randolph - Yes The motion carried 5 -0. 4. Site Plan - Steve Youne - A request for the review of a site plan for Lot 1, Block 34, Original Town of Owasso. The subject property is generally located on the southeast corner of 4th Avenue and Main Street, Owasso, OK. Mr. Rooney presented this item to the Committee. The current zoning is IL (Light Industrial) which would allow for the development of an automobile body shop. The total area of the facility is 6,000 square feet. The Technical Advisory Committee reviewed the plan at their October 1, 1997 meeting and no concerns were voiced. Ray Haynes moved to approve the site plan request, motion was seconded by Charles Willey. Site Plan - Hope Lumber - A request for the review of a site plan for Hope Lumber. The project site is located within Section 30, Township 21 North, Range 14 East; further described as being located immediately west of the Depot Restaurant, Owasso, OK. A review was given by Mr. Rooney. The current zoning of this property is CH (Commercial High Intensity) and has a total area of 3,000 square feet. There are concerns with the small amount of landscaping shown on the plan. Mr. Rooney explained that it has become customary for applicants to include larger areas of landscaping than what is required. Also, a separate permit for signage would be required. The perimeter fencing was discussed. Ray Haynes expressed concerns with traffic (vehicle and train) at that entrance. The Technical Advisory Committee reviewed the site plan and had no comments or concerns. Dewey Brown moved to approve the site plan request subject to a meeting with staff at the time of permit application to discuss additional landscaping and a separate permit issued for any signage, motion was seconded by Charles Willey. OLS -97 -05 - Chamey & Chamey - A request for the review of a lot split for the S/2 of the E/2 of the NE /4 of the NW /4 of the NE /4 of Section 7, Township 21 North, Range 14 East. The subject property is located at the southeast comer of N. 109th E. Avenue and E. 116th Street North and would contain 2.50 acres, more or less. The Chair introduced the case and the staff review was given by Mr. Rooney. The subject property is zoned IL (Light Industrial). The applicant is requesting to split the OWASSO PLANNING COMIVIISSION October 14, 1997 Page No. 3 lot into two parcels, which would be two 2.5 acre parcels. The Owasso Technical Advisory Committee reviewed the lot split request. Utility representatives requested 17.5' utility easements around the perimeter, with 11' utility easements along the proposed lot split line. Charles Willey moved to approve the lot split, Bob Randolph seconded. Site Plan - Chamey & Charney - A request for the review of a site plan for Woods Precision Products, Inc. The subject property is described as the S/2 of the E/2 of the NE /4 of the NW /4 of the NE /4 of Section 7, Township 21 North, Range 14 East. The subject property is located at the southwest corner of N. 109th E. Avenue and E. 116th Street North. The Chair introduced the case and the staff review was given by Mr. Rooney. The current zoning of this property is IL and would allow for the use of a machine shop. The facility has a total area of 31,250 square feet. No concerns or comments regarding the site plan were voiced by the Technical Advisory Committee. Ray Haynes moved to approve the site plan, Bob Randolph seconded the motion. OZ -97 -05 - Sokolosky Living Trust - A request for the rezoning of property from RS -2 (Residential Single - Family Medium Density) to RS -3 (Residential Single - Family High Density). The subject property is located west of the southwest comer of E. 96th Street North and Garnett Road and contains 11.34 acres, more or less. The property is currently undeveloped. • rezoning of this property to RS -3 would allow for the applicant to utilize the conceptual lot layout that was prepared and presented at the September meeting. Acceleration /deceleration lanes and sidewalks will be required along E. 96th Street North. Bob Randolph had concerns with the lift stations in that area handling the load of more single family developments. Ray Haynes moved to approve the rezoning request, Bob Randolph seconded. Annexation Request - Sidney Van Johnson, et al. - A request for the annexation of approximately 191,248 acres of property located in a portion of Section 17, Township 21 North, Range 14 East. The subject property is further described as being located northwest of E. 96th Street North and the Owasso Expressway. Mr. Rooney reviewed the annexation request with the Commissioners. The property is zoned AG (Agriculture) within Tulsa County and would remain zoned AG upon annexation. The Technical Advisory Committee reviewed the request at their October 1, 1997 meeting. No comments or concerns were expressed. The subject property lies within the Washington County Rural Water District #3 and would need to meet all city specifications and standards. The Owasso Annexation Committee unanimously approved the annexation request at the October 6, 1997 Special Meeting, Charles Willey moved to approve the annexation request, motion was seconded by Dewey Brown. OWASSO PLANNING COADUSSION October 14, 1997 Page No. 5 10. Final Plat - The Bradfords at Silver Creek - A request for the review of a final plat for The Bradfords at Silver Creek. The subject property is described as a portion of the SE /4 of Section 21, T21N, R14E and is located immediately east of Brentwood Estates and Brentwood Park and contains 83 lots on 32.35 acres, more or less. The final plat contains 83 single - family lots on approximately 32.35 acres. The Technical Advisory Committee reviewed the plat and had no comments. Although, staff had the following comments: 1) Add the "North" designation to all of the north /south streets. For example, N. 141st E. Avenue and N. 140th E. Court rather than 141st E. Avenue and E 140th Court. 2) Change E. 140th Court off of E. 87th Terrace North to N. 140th E. Terrace. 3) Addresses are available and should be added to the plat prior to being forwarded to the City Council. 4) Change the corner side yard building line on Lots 20 and 21 of Block 3 to 20 feet rather than 15 feet. Ray Haynes moved to approve the final plat, subject to the above staff recommendations, motion was seconded by Charles Willey. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes Bob Randolph - Yes The motion carried 5 -0 and the meeting was adjourned at 8:00 PM, Chairperson Secretary Date MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: OWASSO AUTO CARE SITE PLAN DATE: November 5, 1997 BACKGROUND: Owasso Auto Care has submitted a site plan for a new quick lube facility to be located at the northwest comer of Main and West Third Streets. The subject property is further described as Lot 1, Block 3, Original Town of Owasso and is zoned CS (Commercial Shopping Center). An area map is attached for your information and review. The current zoning of the property is CS (Commercial Shopping Center) which would allow for the development of the site as for an oil and lubrication service facility providing it does not exceed three work bays. The proposed plans of the structure, submitted with the site plan, indicate that this facility would only have three work bays. Off street parking and loading requirements are "not applicable" for development meeting the classification of "Use Unit 16 ", however three parking spaces have been provided, one of which is labeled for handicapped parking. A copy of the Use Unit 16 regulations are attached for your information and review, as well as the property development standards for Commercial zoning districts. When property develops in a CS district that is classified as a Use Unit 16 the following regulations apply: No open air storage is permitted except the incidental open air display of tires, batteries, lubricants, and automobile accessories. 2. Whenever abutted by property zoned residential, the commercial use shall be screened along the lot line(s) in common with the residential district by the erection of a screening wall or fence. A review of those requirements and the submitted site plan, while indicating the existence of a chain link fence, do not indicate that the fence is site obstructing. Staff would recommend that the Planning Commission require the applicant to install a site obstructing fence and prohibit outdoor storage (other than that which is permitted by the Zoning Code) as a condition of site plan approval. The Technical Advisory Committee reviewed the site plan for Owasso Auto Care at their October 29, 1997 regular meeting. No comments requesting additional items were received at that meeting. If approved by the Planning Commission, construction is anticipated to begin shortly thereafter. RECOMMENDATION: Staff recommends approval of the proposed site plan with the following conditions of approval: 1. No outdoor storage other than what is permissible by the Zoning Code 2. The installation of a site obstructing fence along the common lot lines of the residential district (west and north). 1. Area map 2. Use Unit 16 Regulations 3. Property Development Standards for Commercial Zoning Districts SECTION 1016 USE UNIT 16 GASOLINE SERVICE STATIONS 1016.1 Description Establishments engaged in the retail sale of gasoline, lubricants, tires, batteries, and automobile accessories and performing minor repair, installation, and maintenance services. 1016.2 Included Uses Gasoline service stations, oil and lubrication service (3 bay maximum) tune -up service (3 bay maximum). 1016.3 Use Conditions a. The uses included in Use Unit 16, when located on a lot which is abutting an R district, shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district. b Within the CS district there shall be no open air storage or display of merchandise offered for sale or rental within 300 feet of an adjoining R district, except the incidental open air display of tires, batteries, lubricants, and automobile accessories. 1016.4 Off- Street Parking and Loading Requirements Not applicable. SECTION 1017 USE UNIT 17 AUTOMOTIVE AND ALLIED ACTIVITIES 1017.1 Description Automotive and allied activities 1017.2 Included Uses Sales: aircraft, agricultural, implement, automobile (new and used), boat, camper, mobile home, motorcycle, and truck; and services: automobile ren- tal, auto wash, vehicle repair and service and mini storage. 1017.3 Use Conditions a. The uses included in Use Unit 17, when located on a lot which is abutting an R district, shall be screened from the abutting R district by the erection and maintenance of a screening wall or fence along the lot line or lines in common with the R district. b. Within the CS district, there shall be no open air storage or display of merchandise offered for sale within 300 feet of an adjoining R district. 75 b. Accommodate the grouping of certain commercial and light indus- trial uses which are compatible with one another. 600.4 Purposes of the CH Commercial High Intensity District The CH District is designed to accommodate high intensity commercial and related uses. SECTION 610 PRINCIPAL USES PERMITTED IN COMMERCIAL DISTRICTS The principal uses permitted in the Commercial Districts are designated by use units. The use units are groupings of individual uses and are fully described, including their respective off - street parking, loading, and screening requirements and other use conditions in Chapter 10. The subject property is generally located behind those buildings located at the Ator Heights Shopping Center which front onto the Garnett Service Road. The current zoning of the subject property is CG (Commercial General). Copies of the area map, as well as the site plan, are attached for your information and review. The site plan submitted indicates a desire to construct one additional building on the site. The proposed structure is proposed to be 3,000 square feet in area. The additional building is proposed for a storage use and the amount of additional parking spaces required would be 6, one of which would need to be handicapped accessible. While the additional parking spaces are not shown on the site plan, it would appear that there is ample area within the subject property to supply those parking spaces. Please note that a meeting was conducted on November 5, 1997 with the property owners to the west, the developer, and the City to discuss drainage concerns. It would appear that all drainage concerns have been met by the developer, and the remaining items to be completed are a retaining wall, a site obstructing fence above that wall, and the planting of some additional pine trees. These items are anticipated for completion within the next thirty (30) days. Mr. Lutz of the Engineering Division of Public Works will be in attendance on Tuesday evening to answer any questions you may have regarding this issue. The site plan was reviewed by the Technical Advisory Committee at their regular meeting on October 29, 1997. No additional requested easements or information was requested by any of the utility companies. Staff has no objections to this request. ROC Owasso is located on the southeast corner of E. 86th Street North and N. 129th E. Avenue, immediately south of Owasso High School. The subject property contains 7 CS (Commercial Shopping Center) zoned lots on 25.568 acres, more or less. An area map is enclosed for your information and review, as well as Bulk and Area Requirements for property zoned CS. The Technical Advisory Committee reviewed the preliminary plat for ROC Owasso at their October 29, 1997 regular meeting. At that meeting, utility companies and staff provided the following comments /corrections for the submittal: Add Limits of No Access to those areas along E. 86th Street North and N. 129th E. Avenue. 2. A 17.5' perimeter utility easement is requested. 3. Add language to covenants to address maintenance of storm water detention. 4. Add additional utility easement along E. 86th Street North. 5. Information regarding the drainage structure was requested. 6. Addresses will be assigned for the lots at time of final plat. All of the requested corrections have been addressed by the applicants and are included on the preliminary plat within your packet. A copy of the covenants is also included for your information and review. The construction plans are not required to be submitted for preliminary plat stage. Discussion was conducted, however, at the TAC meeting regarding potential ways in which to serve the various lots with sanitary sewer and manners in which to address storm water detention. Construction plans are required to be submitted at the time of final plat application Please note that this plat is preliminary in nature and the name of the plat is likely to change between preliminary approval and final plat application. Caudle Estates is a proposed 39 lot residential addition located on a 11.34 acre tract. The subject tract is located west of the southwest corner of E. 96th Street North and Garnett Road. A location map is attached for your information and review. As you are aware, the subject property was recently rezoned by the Planning Commission and City Council. The subject property is now zoned RS -3 (Residential Single - Family High Density) rather than RS -2 (Residential Single- Family Low Density). The zoning that is now established on the subject property would support the lot sizes being proposed by the applicant. A copy of the RS -3 property development standards are attached for your information and review. The Technical Advisory Committee reviewed the preliminary plat (for a second time) at their October 29, 1997 regular meeting. At that meeting, no additional comments were made by the area utility companies. As you may recall, there were several items identified by the Technical Advisory Committee when it was first reviewed in August and all of those items are included on the enclosed plat within your packet. Please note that staff does anticipate some opposition to this plat from the owners of the property to the south. It is staff's understanding that the owners of that property are desirous in obtaining access through the Caudle Estates property via a stub street. It is staff s opinion that this is not only undesirable, but it is also not necessary. With the property to the south of Caudle Estates being zoned RMT (Residential Multi - Family Townhome) and access via Garnett Road, additional access through the Caudle property is not needed. The routing of traffic associated with a development in a higher density zoning district (RMT) through a lower density (RS -3) would not be recommended. What would appear to be more appealing would be the routing of that traffic through the commercial zoning also established on the property. This is a preliminary plat, and if approved, the Planning Commission would review it again. No action by the Council will occur on any final plat until the construction plans have been approved by the Engineering Division of the Public Works Department and permits to construct have been issued by the Oklahoma State Health Department. The subject property is also bordered to the south and west by IL zoned property, while farther west lies AG (Agriculture) property. The subject property is bordered on the east by the Owasso Expressway. An area map is attached for your information and review. The City of Owasso has been in negotiations with the applicant to obtain right -of -way for the proposed extension of S. Fifth Avenue from the National Steak and Poultry facility to the service road. As a portion of that negotiation process, the applicant expressed a desire to construct a billboard on his property, more specifically, at the location described in the detachment request. Because the subject property is on the southern boundary of the city limits and because billboards are not permitted in the City of Owasso, staff advised the applicant to seek a detachment request from the city rather than a Variance from the Board of Adjustment. Quite simply, a billboard would be permitted on the neighboring property to the south (outside the city limits) and to extend that ability eighty (80) feet to the north was more desirable than opening the door for additional billboards throughout the city if the Board of Adjustment were to grant a Variance. Notification of the detachment request was published in the Owasso Reporter and is attached for your information and review. The Technical Advisory Committee reviewed this request at their October 29, 1997 meeting. At that meeting, area utility companies and staff are afforded the opportunity to address any problems or concerns they have with the detachment request. No comments opposing the request for detachment were received at that meeting. While the City of Owasso policy and procedure regarding annexation does not contain any requirements for action on a detachment request from the Annexation Committee, staff felt it would be more consistent to forward this type of request to the Annexation Committee.
