Items numbered 1 through 15 on the agenda filed on February 4, 2000 shall remain the same. The

addendum thereof.
16. Site Plan — Forest Creek Business Park — A request for review of a site plan for the Forest
Creek Business Park., a commercial and warehousing development proposed for part of the
NE /4 SE /4 SE /4 of Section 30, T -21 -N, R -14 -E. The subject property is located on the west
side of the Owasso Expressway, north of E 76'h Street N. This is the site of the previously
proposed Twister's development.

BACKGROUND
The City has received a request for review of a site plan for Forest Creek Business Park. The
applicant proposes an office /warehousing on a site north of E 76" Street N on the west side of the
Owasso Expressway. The subject property is further described as Block 1, Lots 3, 4, & 5, and
Reserve "A" of Forest Drive Industrial Park and is zoned CS (Shopping Center Commercial).
Abutting the subject property are a real estate office to the southeast and two automotive repair
businesses to the northeast. The businesses reside in the Forest Drive Industrial Park and are zoned
IL (Light Industrial). Abutting the subject property on the west is the Owasso Public Schools bus
depot. To the north of the subject property is a narrow strip of CG (General Commercial) property
that remains undeveloped save for an undedicated extension of Second Street. The south side of
the subject property faces the rear of Streets, a commercial shopping center fronting on E 76" Street
N.
A large drainage ditch, actually an unnamed Bird Creek tributary, flows generally north to south
through the middle of the subject property. According to the current FEMA (Federal Emergency
Management Agency) floodway map panel for the subject site, most of the subject property lies in
the 100 year floodplain, with a significant portion in the actual floodway of the tributary. A copy of
the flood map with approximate lot lines sketched by staff is included for your information and
review. This site is not described as an FD (Floodway Supplemental District), thus Chapter 9 of the
Owasso Zoning Code does not apply to this site. Nevertheless, the subject property is defined as an
area of special flood hazard and applicants must comply with City regulations. Specifically,
Owasso Zoning Code Appendix C, Chapter 4, "Flood Hazard Regulations" and Owasso City Code,
Part 12, Chapter 4, "Flood Damage Prevention" will require the applicants to submit an application
for a Development Permit. The floodplain administrator will review the permit for compliance with
the aforementioned codes. One of the duties of the floodplain administrator is to ensure that all
state and federal permits are obtained prior to approving a development permit.
Construction involving alteration of a FEMA defined floodway and/or floodplain will require
review and approval by the US Army Corps of Engineers, most likely in the form of a Section 404
permit. No development permit will be issued until this and any other required permits are

received and all local requirements are met.
The proposed 34,000 square foot office and warehousing requires 1 space per 500 square feet of
floor area. Parking is adequate for a facility of this size and type. Traffic circulation on site is
adequate.
The Technical Advisory Committee reviewed the site plan at its January 26, 2000. There were very
few questions regarding the proposal.
RECOMMENDATION
Staff recommends approval of the site plan with the following conditions:
1) That the applicants submit an application for a development permit. Further, that this
application be accompanied by all required state and federal permits,
2) That detailed drainage plans be submitted for approval by the City Engineer,
3) That acceleration/deceleration lanes and sidewalks be installed on the Owasso
Expressway frontage,

5. Annexation- Joe Wolf — A request for annexation of land described as a portion of the
NW /4 SE /4 of Section 28, T -21 -N, R -14 -E. The subject property consists of 22 acres, more
or less, and contains a 20 acre tract as well as Lot 9, Block 1, Graceland Acres Addition.
The subject is generally located between Graceland Acres Addition and the Greens at
Owasso golf course, north of E 960' Street N.
6. Annexation — David Chamey - Royse — A request for annexation of property describes as
portions of the NE /4 of Section 16, NW /4 of Section 16, and SE /4 of Section 9, all in T-
21-N, R -14 -E. The subject property is represented by two large sites, Tracts B -F, located
on the southwest corner of E 106 "' Street N and N 145 "' E Avenue and containing 160
acres, more or less, and Tracts G -I, located on the west side of N 145 "' E Avenue, north of
E 106 "' Street N and containing 30 acres, more or less. Tract A is a 5.00 foot wide strip
of land located in the right -of -way on the west side of N 145 "' E Avenue. Tract A extends
approximately 1.5 miles, from the existing Owasso City Limits south of E 96 "' Street N to
Tracts G -1, located north of E 106 "' Street N.
7. Annexation Request — David Chame — Deen — A request for annexation of property
described as the S/2 E/2 SE /4 SE /4 of Section 13, T -21 -N, R -13 -E. The subject property
is located on the northwest corner of E 96 "' Street N and Mingo Road (N 97 "' E Avenue)
and contains 10.00 acres, more or less.
8. Annexation Request — David Chame - McMahon — A request for annexation of property
described as the E/2 SW /4 of Section 7, T -21 -N, R -14 -E. The subject property is located
on the N side of E 106'h Street N, south of the Owasso Sports Park and contains 80.00
acres, more or less.
9. Site Plan — Heng Lim, DDS — Preston Lakes — A request for review of a site plan for a
dentist office. The subject property is described as Lot 6, Block 10 Preston Lakes
Addition, and is located at 8801 N Owasso Expressway. The applicant proposes a 3,700
square foot building on a lot containing 0.50 acres, more or less.
10. Final Plat — RCB Center — A request for review of a final plat for RCB Center, a three (3)
lot, 5.66 subdivision located in the NW /4 NEA, of Section 20, T -21 -N, R -14 -E, City of
Owasso, Tulsa County, Oklahoma. The subject property is located on the south side of E
96'h Street N, west of the Owasso Expressway.
11. Site Plan — RCB Bank — A request for review of a site plan for a bank located on the
proposed Lot 2, Block 1 RCB Center Addition. The subject property is located on the
south side of E 96"' Street N, west of the Owasso Expressway. The applicant proposes
the construction of a 6,000 square foot bank building.
12. Site Plan — Attic Storage — A request for review of a site plan for two additional 9,500
square foot, multi -unit storage buildings at the existing Attic Storage site. The subject
property is located at 11500 E 80'h Street N and is described as a portion of Lot 1, Block
19, Elm Creek First Addition.
13. Final Plat — Country Estates IV — A request for review of a final plat for Country Estates
IV Addition, a 158 lot, 44.57 acre subdivision described as a part of the S/2 of Section 6,
T -21 -N, R -14 -E, City of Owasso, Tulsa County, Oklahoma. The subject property is
located to the northwest of Country Estates II. The addition is an extension of E 118 "'

The agenda for the special meeting was posted in the Owasso City Hall, 207 S Cedar, on January
14, 2000 at 5:00 PM.
1. CALL TO ORDER — Chairperson Ray Haynes called the meeting to order at 6:40 PM
and declared a quorum present.
2. ROLL CALL
3. JOINT PRESENTATION AND DISCUSSION WITH THE OWASSO CITY
COUNCIL RELATING TO THE COMPREHENSIVE PLAN.
Mr. Rooney presented the item and introduced Mr. Karl Fritschen, Mr. Fritschen gave a
brief presentation to the City Council and the Planning Commissioners regarding the
process that was taken. He described the meetings that were held with the Committee and
also the open meetings that were held for public input. Staff then compiled the reports
from these meetings, with the result of the displayed Owasso 2010 Land Use Map. The
desire of the ending product to be a fold out brochure was discussed. Mr. Fritschen
suggested that an update should be performed every two to three years. The different
land use categories shown on the map were also described.
Ms. Joyce Snyder, a local Tulsa County property owner, was present to express her
concerns with the nearby commercial zoning. Ms. Snyder stated that she was very
impressed with the final product of the master plan but would like to see more support
from the City of Owasso when it comes to any future rezoning in her area. She stated
that her property is not in the city limits of Owasso but is within the fenceline and they
would like to have representation from the City if ever necessary. Mr. Rooney
introduced members of the Master Plan Steering Committee and thanked them, along with
the citizens of Owasso, for their input and suggestions.
4. CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ADOPTION OF A COMPREHENSIVE PLAN FOR THE CITY OF OWASSO,

objectives. Ray also thanked Karl for his efforts and the time that was involved in putting

3. CONSIDER APPROVAL OF THE MINUTES OF NOVEMBER 10, 1999 REGULAR
MEETING - The Commission reviewed the minutes of November 10, 1999 Regular
Meeting, Charles Willey moved, seconded by Bob Randolph to approve the minutes. A

4. OZ -99 -12 — Oklahoma Baptist Retirement Center — Bradford Park — A request to rezone a
15.84 acre tract located on the south side of E 76' Street N, west of N 129' E Avenue.
The proposed rezoning is from RS -1 (Residential Single - Family Low - Density) District to
RD (Residential Duplex) District and will serve as a portion of the underlying zoning for
OPUD -17.
Theron explained to the Commissioners that the rezoning request and the proposed
Planned Unit Development would be discussed as one item. Although a separate vote
will be needed on Item H4 and Item 1/5. The rezoning request is to change 15.84 acres
from RS -1 (Residential Single Family Low - Density) to RD (Residential Duplex). The
applicant proposes 209 family units (154, 4- plexes and 55 duplexes) along with a
commercial building and a community center. The Technical Advisory Committee
reviewed the request. At that meeting, Mr. Phil Lutz of OPWA requested a capacity
analysis of the existing sewer line and drainage analysis for platting. Notices were sent to
surrounding property owners and Community Development Department did not receive

any calls opposing this request. A representative from Bryce & Associates, Mr. Alan
Ringel, made a brief presentation. He stated that the quadplexes and duplexes would be
upscale housing and the architectural design will be consistent with the surroundings. He
also explained that having commercial property in the area would give them the
opportunity to build a small store and a community -type center to be used by the residents
only. A four -acre detention pond has been designed with walking trails around it. He
discussed the square footage and the approximate cost of the units. The following
statements were made from several surrounding property owners that were present:
Jo Koening - 7403 N 119 E Ave - She presented a written statement (attached) to the
Commissioners. Concerns with drainage and soil erosion in the area. Also concerns that
erosion is progressively getting worse.
Jerry Keys - 7104 N 129 E Ave - Water run off concerns. Suggested to increase of the
size of drainage ponds for future developments.
Trevor Baldwin - 7251 N 129 E Ave - Buffer area concerns.
Mr. Alan Ringel addressed the above property owners stating that in the platting process,
the drainage problems will be addressed. He assured them that he did not want to
damage their property. He also suggested a meeting with these property owners prior to
the site plan review. Mr. David Hall, the Administrator of the Baptist Retirement Center,
stated that a meeting will be planned and the above residents will be notified.
Commissioner Bob Randolph explained that he would recuse from the vote because he
has a family member that is employed with the Baptist Retirement Village.
Ray Haynes moved to approve the rezoning request, Charles Willey seconded the motion.

5. OPUD -17 - Bradford Park - A request for approval of a Planned Unit Development.
The subject property contains 32.33 acres, more or less, and is generally located on the
south side of E 76 " Street N, west of N 129 "' E Avenue. This area is to be considered for
a Planned Unit Development.

Theron reviewed this item along with item #!4. Staff recommends approval of the PUD
subject to the following conditions:
A. That the applicant's Development Text, and Outline Development be considered
to be the Outline Development Plan as required by the PUD Chapter of the
Owasso Zoning Code;
B. That single - family attached dwelling shall be constructed to the stands specifically
set out in the test of this PUD,
C. That the proposed accessory commercial development conform to the PUD
accessory commercial requirements of the Owasso Zoning Code,
D. That within the PUD, the maximum number of dwellings shall not exceed 209,
E. That as this proposal already meets the maximum allowable development
densities, only decreases in development will be allowed as minor transfers (10%
decrease in a development area's density), and then only so long as there is no
significant change in the character of the development,
F. That a detailed drainage report be submitted at the time of platting, and
certification of such document by an engineer,
G. All covenants of any subdivision plat containing property within the PUD shall
incorporate all PUD standards and conditions of approval and make the City of
Owasso beneficiary,
H. That no building permits are issued within any portion of the PUD until all criteria
outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the
developer.
I. That Acceleration/Deceleration lanes are required at the access point to the subject
property along the arterial street (N 129' E Ave.),
J. That the development will include sidewalks along the abutting arterial streets and
the interior drives within the proposed development,
K. The Planning Commission reserves the right to prescribe additional buffering and
screening as it deems necessary during the platting process. To the extent that the
developer chooses to vary from the outline PUD, the developer can and should
expect additional buffering requirements as is necessary to ensure compatibility
with surrounding land uses.
Mr. Randolph requested to recuse because of a fancily member that is employed at the
Baptist Retirement Village.
Ray Haynes moved to approve Planned Unit Development request subject to the above
staff recommendations. Also with the condition that the developer meets with the parties
that own property to the south and west (Baldwin, Keys and Koenings) to discuss water
retention concerns. Larry Helton seconded the motion. A vote on the motion was

6. OZ -99 -13 - Sokolos , /Vines - A request to rezone two adjacent 15.4 acre tracts located
on the east side of Mingo Road (N 97' E Avenue), north of E 1061' Street N. The
northernmost tract is proposed to change from AG (Agriculture) District to RS -3
(Residential Single - Family High - Density) District. The southernmost tract is proposed to
change from AG (Agriculture) District to CG (General Commercial) District.
Theron reviewed the item with the Commissioners. He explained that because these
tracts are adjacent and similar, they would be reviewed as a single case. Although, the
Commissioners can offer separate motions. There is availability of sewer to the west of
the site. Theron also explained that Mr. Vines, the applicant on Tract B does not intend
to have commercial frontage on Mingo Road. Mr. Vines proposes a decorative fence that
would be consistent with Mr. Sokolosky's, applicant of Tract A, residential fence to the
north. Notices were sent to surrounding property owners and legal advertisements were
published. Staff received one call indicating that she does not want industrial uses on the
tract. There were several surrounding property owners present; the following are
comments made:
Sam Henderson - 10602 N 97 E Ave - Had questions regarding acceleration/deceleration
lanes into the subject property. Also had concerns with water pressure and the water
district that will represent this project.
Brenda Ward - 10714 N 97 E Ave - The manhole behind her property is not working
properly. She stated after a heavy rain the sewer shoots up 2'.
Mark Kaase - 10720 N 97 E Ave - Would like to see improvements on the sewer line in
the area. He has spoke with Mr. Hancock regarding this problem recently. Mr. Hancock
stated he would get with the property owners in this area for the next portion to continue
this project to the north.
Mr. Vines explained that developers from the area are trying to put projects together to
improve the sewer lines. He stated that there is a clay problem in that area.
After discussion, Charles Willey moved to approve the rezoning request. Larry Helton
seconded the motion. A vote on the motion was recorded as follows:

7. Site Plan - C.W. Fry - A request for approval of a site plan for a property located in the
SE /4 of Section 30, T -21 -N, and R -14 -E. The property is located at 410 E 2nd Street.
Theron described the property. The applicant is proposing a 3,000 square foot
commercial building. The proposed building requires 8 parking space, with one being
handicapped. Although the site plan shows only 5 spaces there is ample space for
addition parking. The Technical Advisory Committee reviewed the site plan at their
December 1, 1999 meeting. No comments were received other than the parking area are
required to be constructed of a hard, dust -free surface.
Staff recommends approval of the site plan with the following conditions:
1. That the applicant modify the plan to have eight parking spaces (1
handicapped),
2. That the applicant reconstructs the driveway (parking area and street) out
of a hard, dust -free, all- weather material as required by the Owasso
Zoning Code.
Commissioner Randolph requested to recuse do to a family member is employed at the
above establishment.
Larry Helton moved to approve the site plan subject to the above staff recommendations,
Charles Willey seconded the motion. A vote on the motion was recorded as follows:

8. OLS -99 -11 - Witten - A request for a lot split located on Lot 7, Three Lakes Industrial
Park, Phase I1. The subject property is generally located on the east side of N 116d' E
Avenue. The applicant wishes to attach the south 20 feet of Lot 7 to Lot 8.

Theron reviewed the item stating that the proposed lot split will attach the south 20 feet of
Lot 7 to Lot 8, located to the south. The Technical Advisory Committee reviewed the lot
split and had no comments.

9. Site Plan - Faith Lutheran Church - A request for approval of an expansion at Faith
Lutheran Church. The applicant proposes an 11,865 square foot sanctuary and office
area. The subject property is described as a part of the S/2 NE /4 of Section 19, T -21 -N,
R -14 -E and is located at 9222 N Garnett Road.
Theron presented the item and described the property. He stated that the Owasso Board
of Adjustment granted a Special Exception to permit expansion of the proposed church
facility in these zoning districts. Theron also explained that the applicant would need to
create additional two handicapped parking spaces.
Ms. Sandy Harrell, the property owner to the north, was present with concerns regarding
damage to her property. Ms. Harrell stated that the creek on her land use to be a lazy
creek. Now everything drains into the creek. She feels the creek needs to be cleaned by
the City and there are beaver problems. She has complained about the drainage problems
and feels that they are not being addressed.
Staff recommends approval of the site plan for the expansion of Faith Lutheran Church
subject to the following conditions:
1. That the applicant modify the plan to convert two spaces to handicapped parking,
2. That the applicant provides a detailed description of the drainage facilities on the
northern portion.
After discussion regarding drainage, Ray Haynes moved to approve the site plan subject
to the above recommendations also, a drainage retention pond redesigned a dry pond with
slow release and accommodates a 100 -year flood plain. Bob Randolph seconded the
motion. A vote on the motion was recorded as follows:

Regarding the proposed change in zoning
My name is Jo Koenning. Our property lies to the west, directly adjacent to the
Baptist Retirement Village. We have always felt them to be good neighbors and
and we have no objection to what they are planning. However, we do have
concerns on how this will effect us.
We have owned this property for over 20 years and lived here for 14 years
and we have seen the little creek go from an `every few years' over the bank
flooding to one `every time it rains'. Our neighbors to the north have raised their
land level along the creek with fill and that, along with the increased water run -off
from the other developments in the retirement community the past few years
to the North and East of us, has caused substantial soil erosion on our land.
Our pasture is sometimes flooded by so much run -off from the East that we
have lost most of the trees in a wooded area because of repeated high water
washing the soil from the roots. We have seen first hand that the retention areas
built to control this water has failed to be successful.
Naturally we have alot of concerns. The road to our property goes over the
creek and is frequently washed out and often we are stranded by high water.
At one time, on their plot, there were designated easements to and from our
property to 122 St.. It is important for us to see this addressed and how we should
go about getting a road from our place that doesn't flood.
We feel the erosion will be more extreme from this new proposal and we would
like our concerns to be recorded. The more blacktop, the more run -off.

BACKGROUND
Joe Wolfe has requested the annexation of approximately 22 acres of land described as a part of
the N/2 NW /4 SE /4 of Section 28, T -21 -N, R -14 -E. The subject property is generally located to
the north of E 76 "' Street N, between N 129"' E Avenue and N 145` E Avenue.
The subject property is located between The Owasso Golf and Athletic Club Owasso golf course
to the north and east of the subject property, Graceland Acres, a Tulsa County Subdivision, to the
south, an undeveloped 20 acre tract to the west. Copper Meadows is located approximately 1/8
mile to the west of the subject property.
City water is available to the site. The Elm Creek Sewer interceptor is located on the eastern
portion of the property.
The subject property is an internal tract and access to future development will need to be derived
from existing development. In this case, the developer has proposed the annexation of a lot located
in Graceland acres. The connection through Graceland acres should provide adequate access to the
site. Additionally, the anticipated scale and type of development in this area should not present a
substantial additional traffic burden for the existing subdivision.' Ultimately, the development of
the tract to the west will provide an additional connection to Copper Meadows addition. Copper
Meadows has a stub street that connects to allow future east/west traffic flow. The developer
should be aware of this connection and should plan on creating a means of access to the west.
Additionally, Elm Creek is located on the eastern portion of the subject property. The future
development of this site should be respectful of this fact so as not to cause additional disturbances
up or downstream from this site. Floodplain development restrictions and on -site detention
requirements will be discussed in greater detail when a development plan is submitted.
Notification of the annexation request was published in the Owasso Reporter on January 20, 2000
to notify the public of the annexation request before the Planning Commission meeting on February
8, 2000. This will be followed by notification published two consecutive weeks in the Owasso

Reporter on January 27, 2000 and February 3, 2000 to notify the public of possible City Council
action regarding the request on February 15, 2000. In addition to the annexation policy and

ANNEXATION POLICY
While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing city limits.
All properties should be annexed into the city limits as the lowest zoning classification,
that is, AG, agricultural. Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the city will be legal,
but non - conforming, which means that they may continue but cannot be expanded without
proper zoning.
4. All public infrastructures that do not met city standards will not be improved by the city
until brought to the city standard and accepted by the City Council. Such public facilities
must be improved at owners expense by the establishment of a special assessment district
or some other financing method.
Where a city limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for
a six month period after rejection by the City Council.

BACKGROUND
David Chamey has requested the annexation of two tracts and a portion of right -of -way located
in Sections 9, 16, and 21, all in T -21 -N, R -14 -E. The subject properties are in two locations on
the west side of N 145" E Avenue.
Tracts A is five foot wide strip of land located in the public right -of -way on N 145" E Avenue.
This strip does not include the roadway itself. Tracts B through F consist of a contiguous 160 acre,
more or less, tract that is located on the southwest comer of E 106" Street N and N 145', E Avenue.
This Owasso Comprehensive Plan calls for a combination of commercial and single - family uses
however, the zoning designation upon annexation will be AG (Agriculture). Rezoning on the
subject property will need to be submitted separately and can only be adopted by Council after the
subject property is officially annexed.
Tracts G through I are related to the proposed site for the Tulsa Technology Center. This property
consists of approximately 40 acres and is located approximately'' /4 mile north of E 106" Street N on
the west side of N 145" E Avenue.
These properties are located in the water service area of Rural Washington Water District #3. The
developer is proposing to extend the Elm Creek Sewer Interceptor to the north along N 145" E
Avenue. The extension of this sewer will be critical for the future development of this site.
Preliminary discussion of the sewer situation indicates that the developer is moving forward with a
plan to extend sewers to this area, which should eliminate this barrier to development.
The proposed annexation conforms to the City of Owasso Annexation Policy and was processed
according to our procedures involving a citizen sponsored annexation.
Notification of the annexation request was published in the Owasso Reporter on January 20, 2000
to notify the public of the annexation request before the Planning Commission meeting on February
8, 2000. This will be followed by notification published two consecutive weeks in the Owasso

BACKGROUND
David Chamey, on behalf of Owasso Land Trust, LLC, has requested the annexation of an 10
acre tract located on the northwest corner of E 96" Street N and Mingo Road (N 97`b E Avenue).
The subject property is described as the S/2 E/2 SE /4 SEA of Section 13, T -21 -N, R -13 -E.
E 96" Street N terminates just to the west of Mingo Road. To the east of the subject property is an
undeveloped portion of the Lakes PUD that is proposed to contain commercial development. To
the south is additional undeveloped land located in Tulsa County. The area to the south is a portion
of the original Bailey Ranch PUD and is proposed to contain light industrial uses. To the southeast
of the subject property is a large detention pond that is a portion of the Fairways golf course
development.
Water and sewer is reasonably close to the subject property site. Existing portions of the Fairways
addition are located approximately '' /a mile to the east of the subject property.
This property lies within the 1981 court settlement boundary and, although it is a portion of the
Rural Washington Water District #3, it can also be served by OPWA. So long as the developer pays
$50 per tap to the Rural Water District, provision of water by the City of Owasso is possible. As
noted in previous annexation cases, it is prudent to discuss the feasibility of providing water and
sewer to the subject property. At this time, it appears that water and sewer will be available to the

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the lowest zoning classification,
that is, AG, agricultural. Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the city will be legal,
but non - conforming, which means that they may continue but cannot be expanded without
proper zoning.
4. All public infrastructures that do not met city standards will not be improved by the city
until brought to the city standard and accepted by the City Council. Such public facilities
must be improved at owners expense by the establishment of a special assessment district
or some other financing method.
Where a city limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for
a six month period after rejection by the City Council.

authority to sell its own water tap and install a water tap
,within the shaded area at the location described on the tap
receipt obtained from RWD {3.
1. The parties have further agreed that in the event
there are any water lines or improvements within the area
herein granted OPWA, that OPWA will negotiate with RWD U for
the purchase of said lines or improvements taking into consid-
eration only the cost thereof less depreciation. The parties
have further agreed that any persons now served by RWD 13 may
continue to purchase water from RWD 13 until such time as OpWA
takes title to said lines by paying RWD (3 therefor.
5. The parties have further agreed that RWD 13 would
charge persons desirous of purchasing a water tap from OPWA
':the sum of $50,00 for each tap requested not to exceed

BACKGROUND
David Chamey has requested the annexation of an 80 acre tract located on the north side of E
106'h Street N, east of Mingo Road (N 970'E Avenue) two individually owned, 15.4 acre tracts
totaling approximately 30.8 acres. The subject property is described as the E/2 SWA of Section
7, T -21 -N, R -14 -E.
The subject property abuts the existing City Limits on the E 106" Street N (south) side. Opposite E
1060' N, the Lakes at Bailey Ranch, a large planned unit development. The subject property is
undeveloped and presently zoned AG (Agriculture) in Tulsa County. Upon annexation, the subject
property will be given the City of Owasso AG designation.
To the west of the subject property, an existing rural residence is located approximately '/4 mile
north of E 10601 Street N on a deep, but narrow tract. To the north of the subject property is the
Owasso Sports Park. To the east of the subject property is approximately Gres of additional
undeveloped land. Meadowcrest subdivision is also located approximately 1/8 mile to the east of
the subject property.
The development of this tract will most likely be in conjunction with the development of the Lakes
PUD to the south of E 10601 Street N. It is most likely that sewer collection for the subject property
will be interconnected in some fashion with the system that is developed at the Lakes.
This property lies within the 1981 court settlement boundary and, although it is a portion of the
Rural Washington Water District #3, it can also be served by OPWA. So long as the developer pays
$50 per tap to the Rural Water District, provision of water by the City of Owasso is possible. As
noted in previous annexation cases, it is prudent to discuss the feasibility of providing water and
sewer to the subject property. However, since development plans have not been prepared, the
discussion of these critical facilities remains somewhat abstract. Nevertheless, it appears that there
will be multiple options for providing adequate water and sewer service to the subject property.
The developer will ultimately need to provide an adequate alternative during later stages of the
development.

3. The parties being advised by the Court, it was the
I opinion of the Court that charges for water taps payable to
li RWb 13 should be collected by RWD 13 and upon presentment of
the receipt for payment thereof, OPWA would then have the
authority to sell its own water tap and install a water tap
within the shaded area at the location described on the tap
receipt obtained' ftcm RWD 13.
4. The parties have further agreed that in the event
there are any water lines or improvements within the area
herein granted OPWA, that OPWA will negotiate with RWD 13 for
the purchase of said lines of improvements taking into consid-
eration only the cost thereof less depreciation. The parties
have further agreed that any persons now served by RWD 13 may
continue to purchase water from RWD i3 until such time as OpWA
tltakes title to said lines by paying RWD 13 therefor.
5. The parties have further agreed that RWD 13 would
charge persons desirous of purchasing a water tap from OpWA
•!the sum of $50,00 for each tap requested not to exceed
it

BACKGROUND
The applicant, Dr. Heng Lim, proposes a site plan for a dentist office. The subject property is
described as Lot 6, Block 10 Preston Lakes Addition, and is located at a80 so
Exer. The subject property is more generally located on the east side of N 145"' E
Avenue, north of E 86h Street N. The applicant proposes a 3,700 square foot building on a lot
containing 0.50 acres, more or less.
The subject property is located in the Preston Lakes PUD. There is little development in the
vicinity of the site at this time: An assisted living facility (The Vyne) is under construction to the
east of the site. The current zoning will allow the construction of the proposed facility. Parking
is adequate for a building of this size and type. The applicant proposes 29 spaces (1
handicapped). The requirement for this facility is 24 spaces. There is only one driveway shown
on N 145"' E Avenue. This is desirable and in accordance with the conditions of the Preston
Lakes PUD. There is an additional driveway on E 88°i Place N and a cross - connection has been
provided for future commercial development to the north. There is a separate driveway and
parking lot in the rear of the facility, presumably for staff. The parking and circulation for the
facility is adequate.
Landscaping is referenced on the site plan, however, the architect has indicated that a more detailed
landscape plan is being prepared. The applicant indicates a sign location at in the southwest corner
of the lot: All signs are reviewed by separate permit. Staff suggests that the applicant consider a
ground -type monument sign as opposed to a pylon sign.
The site plan notes that the applicant will provide on -site detention. Using the parking areas
themselves as detention devices, the site will allow a slow release of storm water at a pre -
development rate. The parking lots will be designed to act as bowls, and storm water will be
slowly released via pipe to the existing detention pond to the east of the subject property.
Sidewalks are not indicated on the last draft, but the applicant has agreed to provide them on the N
145 "' E Avenue and E 88 "' Place N sides of the subject property. Sidewalks are required on streets
throughout all Owasso subdivisions. This is especially necessary with Hodges elementary and the

assisted living center located nearby.
The site plan was reviewed at the January 26, 2000 meeting of the Owasso Technical Advisory
Committee. The applicant has provided a perimeter utility easement and telephone conduit per
request of the utility companies. It was noted that the parking areas encroach into the easements.
While this is acceptable, the applicant is advised that should it be necessary to gain access to the
easement area, the neither the City nor the utility companies is obligated to reconstruct the parking
areas within the easements.
RECOMMENDATION
Staff recommends approval of the site plan for the offices of Dr. Heng Lim subject to the following
conditions:
1. That a landscape detail will be provided to the City Planner within 30 days,
2. That sidewalks be installed on the E 880' Place N and N145th E Avenue sides of the subject
property,

BACKGROUND
The City of Owasso has received a request to review a final plat for RCB Center, a 5.66 acre, 3 lot
subdivision located in the NW /4 NEA of Section 20, T -21 -N, R -14 -E. The subject property is
located on the south side of E 96h Street N, west of the Owasso Expressway. The preliminary plat
was approved in October 1999, under the name Owasso Commercial Plaza.
The subject property is undeveloped land zoned CS (Shopping Center) District. To north of the
subject property is the Owasso Market, currently under construction. To the east is the Owasso
Expressway. To the west of the subject property is N 121'` E Avenue. To the southwest is a
proposed credit union. And further to the west across n 121" E Avenue is the ONG facility.
The Owasso Technical Advisory Committee reviewed the final plat at their January 26, 2000
meeting. The applicant has addressed Phil Lutz's concern regarding the maintenance of private
streets. The owner and not the City will maintain the streets. Bruce Rothell, the applicant's
engineer, has provided a grading plan to Phil Lutz. He has indicated that on -site detention will be
provided on each of the three commercial lots. Mr. Lutz indicated that the plan is acceptable. PSO
had also requested that the private roads also be labeled as utility easements on the face of the plat.
The applicant has also provided access to the City water tank that lies to the south of the subject
property. The TAC changes have been shown on the plat within your packet.
As with all plats, the applicant is required to construct sidewalks and accel/decel lanes on all arterial
roads. In this case, roadway improvements for the Owasso Market are imminent and the applicant
has agreed to participate financially in the sidewalk and roadway improvements up to $30,000.
The applicant has successfully addressed all planning, zoning, and subdivision requirements, as
well as the requests of the Technical Advisory Committee. The final plat is consistent with the
preliminary plat submitted in October 1999. The completed plat is included within your packet.
The final' draft of the dedication and covenants is also included within the packet.
RECOMMENDATION
Staff recommends approval of the final plat for RCB Center.

BACKGROUND
The City of Owasso has received a request to review a site plan for RCB Bank, a proposed retail
banking facility located on a the proposed the proposed Lot 2, Block 1 RCB Center Addition.
The subject property is located on the south side of E 96d' Street N, west of the Owasso
Expressway. The applicant proposes the construction of a 6,000 square foot bank building. The
final plat for RCB Center is presented for approval elsewhere in this agenda. The subject
property is zoned CS (Shopping Center) District.
The ONG Building is located in the Oak Tree Business Park across N 121st E Avenue, to the west
of the subject property. The proposed development is south of the Owasso Market Development.
Parking is adequate for a facility of this size and type. The requirement for this facility is 20 spaces
(1 handicapped). The applicant proposes 45 spaces (2 handicapped). The applicant shows a drive
through banking facility on the south side of the subject property. On -site circulation for the
facility is adequate. Traffic will access the site via the private roads. It is anticipated that there will
be a traffic light on N 121" E Avenue, and although there is a single driveway onto E 96h Street N
shown to the northwest of the subject property, it is anticipated that most traffic will access the site
using N 121' E Avenue.
The Owasso Technical Advisory Committee reviewed the site plan at the January 29, 2000 regular
meeting. Southwestern Bell requested that the applicant provide an underground conduit at the
northwest comer of the site. Phil Lutz discussed plans for drainage detention on the site. The
applicant's engineer noted that they intended to provide detention on site using the ample parking
lot. Phil Lutz was in agreement that this was feasible and requested that the applicant submit
drainage calculations of post - development runoff rates. Although lot coverage on the site is fairly
thorough, planning staff requests that the applicant provide a landscape detail.
A final comment should be reflected in the report. Improvements to E 96" Street N are imminent,
and RCB has agreed to provide funds for a sidewalk and an additional lane in this area. It should
be noted for the record that the driveway location and lane layout for the proposed bank will need
to be changed to accommodate the coordinated plan for E 968' Street N improvements.

RECOMMENDATION
Staff recommends approval of the site plan for RCB Bank subject to the to the following
conditions:
1. That sidewalk and lane improvements be constructed according to the coordinated plan
for improvements to E 96 "' Street N,
2. That site plan approval is subject to the final approval of the RCB Center plat by the
Owasso City Council,
3. That the applicant provide drainage calculations for post development runoff for approval
by the Public Works department,
4. That a landscape plan be submitted to the Owasso Planning Commission for approval
prior to the issuance of a certificate of occupancy.

BACKGROUND
The applicant, Rick Herron, proposes a two additional 9,500 square foot, multi -unit storage
buildings at the existing Attic Storage site. The subject property is located at 11500 E 80" Street
N and is described as a portion of Lot 1, Block 19, Elm Creek First Addition.
The site plan is a continuation of the development of mini- storage on the subject property. The
applicant noted that there are two existing drainage inlets near the Letters "T" & "N" on your site
plan that were designed to handle drainage for this expansion. The applicant proposes concrete
surfaces around the new storage building. Building S is proposed to be constructed soon, but
Building T is reserved for future development.
The site plan was reviewed at the January 26, 2000 meeting of the Owasso Technical Advisory
Committee. No comments were received. Staff has notes foresees no difficulties with the proposed
expansion.
RECOMMENDATION
1. Staff recommends approval of the site plan for the expansion of Attic Storage.

COUNTRY ESTATES IV

BACKGROUND
The City of Owasso has received a request to review a final plat for Country Estates IV, a 44.57
acre, 158 lot subdivision. The subject property is located to the north of Country Estates III and
west of Country Estates II, and is currently zoned RS -3 (Residential Single - Family High- Density)
District.
The Technical Advisory Committee reviewed the final plat at their January 26, 2000 regular
meeting. At that meeting, utility representatives and the Public Works department were invited to
comment on the proposed plat. Phil Lutz of Public Works requested that the applicant include
language that explains that the Country Estates IV Homeowners Association will maintain the
detention area. Community Development staff provided addresses for the subdivision. ONG had
requested utility easements on Lots 1 & 15, Block 4. The plat within your packet contains the
requested changes.
The City of Owasso will provide water to the subdivision. According to Phil Lutz of Public Works,
Country Estates IV has received conditional approval for extension of the main sewer line.
The lot sizes conform to the requirements for an RS -3 District. Due to the unusual shape of the
subject property, there are two triangular lots in the proposed subdivision. These lots are larger than
typical, and offer the adequate buildable space. Although the shape of the addition is somewhat
unusual, the street patter appears adequate, with most streets intersecting at right angles and good
sight distance is shown throughout the subdivision. The subdivision will tie into existing
developments at three locations: 1) To West Port Addition at the south end of N 107"' E Avenue, 2)
To Country Estates III at the south end of E 118" Court N, and 3) To Country Estates II and N
111 d' E Avenue.
The applicant has satisfied platting requirements as required in the Owasso Subdivision
Regulations. The final plat is consistent with the preliminary plat presented in May 1999.

BACKGROUND
The applicant, Roy Cartwright, has requested a lot split for part of the NE /4 NE /4 NE /4 of Section
18, T -21 -N, R -14 -E, Owasso Oklahoma. The applicant proposes to create a.92 acre property on
the southwest corner of E 106'b Street N and Garnett Road.
The subject property is a portion of the Lakes at Bailey Ranch PUD and will serve as a commercial
corner lot. The right -of -way requirements for the intersection of Garnett Road and E 106" Street N
are shown.
The Technical Advisory Committee reviewed the proposed lot split at the January 26, 2000

BACKGROUND
The applicant, Roy Cartwright, has requested a lot split for part of the SW /4 SW /4 SW /4 SW /4 of
Section 19, T -21 -N, R -14 -E, Owasso Oklahoma. The applicant proposes to create a .92 acre
tract on the northeast comer of E 860' Street N and Mingo Road.
The subject property is a portion of the original Bailey Ranch PUD and will serve as a commercial
corner lot. The right -of -way requirements for the intersection of Mingo Road and E 861' Street N
are shown.
The Technical Advisory Committee reviewed the proposed lot split at the January 26, 2000
meeting and had no objections to the proposal. Staff notes no other unusual conditions or
circumstances.
RECOMMENDATION
Staff recommends approval of the proposed lot split.
