4. OZ- 00 -01— Owasso Market — A request for the rezoning of property described as a portion
of the SE /4 SWA of Section 17, T -21 -N, R -14 -E. The subject property is 16.67 acres, more
or less, and is located on the north side of E 96" Street N, west of the Owasso Expressway.
Proposed is a rezoning from OL (Office Low - Intensity), RS -3 (Residential Single- Family
High - Density), and RS -2 (Residential Single - Family Medium - Density) to CS (Shopping
Center).
5. Annexation — Theresa Spears — A request for annexation of property described as portions
of the S/2 SW /4 SW /4 of Section 17, T -21 -N, R -14 -E. The subject property is located on
the northeast corner of E 96" Street N and Garnett Road and contains 8.25 acres more or
less,
6. Final Plat — Nottingham V — A request for review of a fmal plat for Nottingham V, a 44
lot, 24.57 acre subdivision described as a portion of the W/2 NEA of Section 21, T -21 -N,

7. Preliminary Plat — The Lakes at Bailey Ranch North — A request for review of a

8. Preliminary Plat — Oakwood — A request for review of a preliminary plat for Oakwood, a

9. Final Plat — Fairways VI — A request for review of a final plat for Fairways VI at Bailey
Ranch, a 42 lot, 15.37 acre subdivision described as a portion of the W/2 NW /4 of
Section 19, T -21 -N, R -14 -E. The subject property is located east of Mingo Road, south

and declared a quorum present.

4. CONSIDER APPROVAL OF THE MINUTES OF THE JANUARY 18, 2000
SPECIAL MEETING.
One correction was needed; the heading should read "Minutes of Special Meeting ".

5. Annexation - Joe Wolf - A request for annexation of land described as a portion of the
NW /4 SE /4 of Section 28, T -21 -N, R -14 -E. The subject property consists of 22 acres,

more or less, and contains a 20 acre tract as well as Lot 9, Block 1, Graceland Acres
Addition. The subject is generally located between Graceland Acres Addition and the
Greens at Owasso golf course, north of E 96" Street N.
Theron presented the item. Theron explained that there was a typing error in the Owasso
Reporter on this request. The paper stated that the meeting would be held on February
15, 2000. It should have read February 8, 2000 for the Planning Commission meeting.
He also described the location of the property. Theron stated that the property is an
internal tract and access into the development will need to be derived from existing
development. Mr. Wolfe has proposed the annexation of a lot located in Graceland acres.
The connection through Graceland should provide adequate access. Any type of
development built on this property would have to meet the City of Owasso requirements.
The Commissioners discussed and agreed that the construction access should be off of 76'"
Street North. Notification of the request was published in the Owasso Reporter on
January 20, followed by notification published two consecutive weeks in the paper on
January 27 and February 3, 2000 to notify the public of possible City Council action.
Bob Randolph moved to approve the annexation request subject to the construction access
to be off of 76' Street North. Mr. Haynes seconded the motion. The vote on the motion

6. Annexation - David Charney - Rovse - A request for annexation of property describes
as portions of the NE /4 of Section 16, NW /4 of Section 16, and SE /4 of Section 9, all in
T -21 -N, R -14-13. The subject property is represented by two large sites, Tracts B -F,
located on the southwest corner of E 106" Street N and N 145" E Avenue and containing
160 acres, more or less, and Tracts G -I, located on the west side of N 145' E Avenue,
north of E 106' Street N and containing 30 acres, more or less. Tract A is a 5.00 foot
wide strip of land located in the right -of -way on the west side of N 145' E Avenue. Tract
A extends approximately 1.5 miles, from the existing Owasso City Limits south of E 96'
Street N to Tracts G -I, located north of E 106" Streets N.
Theron presented the item and described the located of the annexation. Notification of the
request was published on January 20, 2000 and followed by two consecutive weeks on
January 27' and February 3, 2000. Mr. Don Sider (13813 E 100 St No) a surrounding
property owner was present to expressed concerns with the water runoff on that property.
Theron explained that Mr. Sider's concerns would be addressed prior to development of

the property. Mr. David Charney, the applicant, was present to answer any questions or
address concerns from the public.

7. Annexation Request - David Charney - Deen - A request for annexation of property
described as the S/2 E/2 SE /4 SEA of Section 13, T -21 -N, R -13 -E. The subject property
is located on the northwest corner of E 96" Street N and Mingo Road (N 97'h E Avenue)
and contains 10.00 acres, more or less.
Theron presented the item to the Commissioners. The property lies within a portion of
the Rural Washington Water District /E3. He also explained that the water could be served
by OPWA as long as the developer pays $50.00 per tap to the Rural Water District.
Notification was published by the Owasso Reporter on January 30th, January 27th and
February 3, 2000. Ms. Wanda Nash (9900 N 97 E Ave) expressed concerns regarding
the sewer run off in the area. Theron stated that the plat would go to DEQ to be
approved prior to any construction. Mr. David Charney explained that there are no plans
for this tract. He also requested the citizens that were present to give him their name and
phone numbers in order to contact them when a decision is made to develop this land.
Several surrounding property owners were present to complain about the trash being
dumped there. Mr. Charney assured them that the land will be cleaned up and a "No
Dumping" sign will be erected at that spot.

8. Annexation Request David Charngy - McMahon - A request for annexation of
property described as the E/2 SW /4 of Section 7, T -21 -N, R -14 -E. The subject property

is located on the N side of E 106' Street N, south of the Owasso Sports Park and contains
80.00 acres, more or less.
Theron presented the annexation request. He described the location of the request and
explained that this tract will likely be in conjunction with the development of the Lakes
PUD to the south of E 106" Street N. This is an 80 acre tract, which is located on the
south side of the Sportspark. Notification was published in the Owasso Reporter on
January 20'", January 27th and February 3, 2000.

9. Site Plan - Hene Lim. DDS - Preston Lakes - A request for review of a site plan for a
dentist office. The subject property is described as Lot 6, Block 10 Preston Lakes
Addition, and is located at 8801 N Owasso Expressway. The applicant proposes a 3,700
square foot building on a lot containing 0.50 acres, more or less.
Theron described the location of the site plan. He explained that the current zoning
would allow the construction of the proposed facility. Parking is adequate for a building
of this size and type. Landscaping is shown on the site plan although, the architect
indicates that a more detailed landscape plan is being prepared. All signs for the facility
will be reviewed by a separate permit. The parking areas will be used as detention
devices and will allow a slow release of water at a predevelopment rate. Sidewalks are
required throughout all Owasso subdivisions. The site plan was approved at the
Technical Advisory Committee meeting on January 26, 2000. A lengthy discussion on
the possibility of sharing the access lane to the north, as a temporary set up until the third
lane is developed. Also accel /decel lanes were discussed. Mr. Charney stated that
instead of accel /decel lanes, there would be a third lane and also assured the
Commissioners that if this were a condition of the approved site plan by the
Commissioners, it would be done. Water detention and traffic circulation on site were
discussed. Ray Haynes had concerns with the possibility of traffic bottling up. Mr.
Haynes suggested to close the front entrance (N. 145" E Ave) and to close the westerly
entrance (E. 88' PI No).
Staff recommends approval subject to the following conditions:

1. That a landscape detail will be provided to the City Planner within 30 days.
2. That sidewalks be installed on the E 88 ° Place N and N 145 h E Avenue sides of
the subject property.
Ray Haynes moved to approve the site plan subject to the above conditions. Also, subject
to the construction of a shared access on the front (to the north) and to close the westerly
entrance of 88" Place North. Finally, approval is subject to designing an east and west
access to join lots. The vote on the motion was as follows:

10. Final Plat - RCB Center - A request for review of a final plat for RCB Center, a three
(3) lot 5.66 subdivision located in the NW /4 NE /4, of Section 20, T -21 -N, R -14 -E, City
of Owasso, Tulsa County, Oklahoma. The subject property is located on the south side
of E 96' Street N, west of the Owasso Expressway.
Theron presented the item to the Commissioners. After describing the property he stated
that the Owasso Technical Advisory Committee reviewed the final plat at the January 26"'
meeting. All of the changes have been addressed on this plat. Mr. Frank Enzbrenner
was present to address any concerns. The applicant is required to construct sidewalks and
accel /decel lanes. The applicant has agreed to participate financially in the sidewalk and
roadway improvements up to $30,000.00.

11. Site Plan - RCB Bank - A request for review of a site plan for a bank located on the
proposed Lot 2, Block 1 RCB Center Addition. The subject property is located on the
south side of E 96" Street N, west of the Owasso Expressway. The applicant proposes
the construction of a 6,000 square foot bank building.

Theron presented modifications of the site plan to the Commissioners. The Technical
Advisory Committee reviewed the site plan at their January 29, 2000 meeting. Theron
explained that improvements to E 96fl' Street N are imminent, RCB has agreed to provide
funds for a sidewalk and an additional lane. Staff recommends approval of the site plan
subject to the following conditions:
1. That sidewalks and lane improvements be constructed according to the
coordinated plan for improvements to E 96' Street N,
2. That site plan approval is subject to the final approval of the RCB Center plat by
the Owasso City Council.
3. That the applicant provide drainage calculations for post development runoff for
approval by the Public Works department,
4. That a landscape plan be submitted to the Owasso Planning Commission for
approval prior to the issuance of a certificate of occupancy.
Ray Haynes moved to approve the site plan subject to the above staff recommendations.

12. Site Plan — Attic Storage — A request of a site plan for two additional 9,500 square foot,
multi -unit storage buildings at the existing Attic Storage site. The subject property is
located at 11500 E 80'" Street N and is described as a portion of Lot 1, Block 19, Elm
Creek First Addition.
Theron presented the case to the Commissioners and described the location of the
property. He explained that the site plan is a continuation of the development of mini -
storage on the property. The applicant proposes concrete surfaces around the new
buildings. Mr. Rick Herron, the applicant, was present to discuss his concerns with the
drainage and dust problems. He stated that he has a problem was dust in the storage units
due to the property to the south. Also, there is a drainage problem coming from the same
property. Mr. Herron explained that he has spoke with Mr. Tim Rooney and Mr.
Rooney was to send a letter to that property owner. The site plan was reviewed at the
January 26, 2000 meeting Owasso Technical Advisory Committee.
Ray Haynes moved to approve the site plan for Attic Storage subject to contact being
made to the property owner to the south, to discuss the dust and water detention problem,
Charles Willey seconded the motion. The vote on the motion was as follows:

13. Final Plat - Country Estates IV - A request for review of a final plat for Country
Estates IV Addition, a 158 lot, 44.57 acre subdivision described as a part of the S/2 of
Section 6, T -21 -N, R -14-E, City of Owasso, Tulsa County, Oklahoma. The subject
property is located to the northwest of Country Estates H. The addition is an extension of
E 118°i Court N and N 111' E Avenue.
Theron presented the case and explained that there is a Consent Order on the City of
Owasso from DEQ stating no extensions of sewer shall be allowed in this area. Mr. Phil
Lutz of OPWA explained that the developer has DEQ permits to construct contingent
upon completion of the northside interceptor. Theron also stated that the developers of
this subdivision are aware of the consent order. Mr. David Cantrell, the engineer for
Country Estates IV was present to address any concerns. Ray Haynes had questions
regarding the process of approving drainage plans for developments with the city limits.
The Technical Advisory Committee reviewed the plat at their January 26, 2000 meeting.
The plat reflects the requested changes.

proposes to create a .92 acre property on the southwest corner of E 106'h Street N and
Garnett Road.
Theron presented the lot -split case to the Commissioners. The property is a portion of the
Lakes at Bailey Ranch and will serve as a commercial corner. The Technical Advisory
Committee reviewed the lot split at their January 26, 2000 meeting and had no objections.

15. OLS -00 -02 — Lot Split — Larkin Bailey Foundation — A request for a lot split for part of
the SW /4 SW /4 SW /4 SW /4 of Section 19, T -21 -N, R -14 -E, Owasso, Oklahoma. The
applicant proposes to create a .92 acre property on the northeast corner of E 86' Street N
and Mingo Road.
Theron explained that this is a portion of Bailey Ranch PUD and will serve as a
commercial corner. The Technical Advisory Committee reviewed the request at their
January 26' meeting and had no concerns.
The vote on the motion was as follows:

16. Site Plan — Forest Creek Business Park A request for review of a site plan for the
Forest Creek Business Park, a commercial and warehousing development proposed for
part of the NE /4 SE /4 SE /4 of Section 30, T -21 -N, R -14 -E. The subject property is
located on the west side of the Owasso Expressway, north of E 76 Street N. This is the
site of the previously proposed Twister's development.
Theron described the property location. He stated that a large drainage ditch flows
generally north to south through the property. Drainage on the property was discussed.
According to FEMA the subject property lies in the 100 -year floodplain. Mr. Raymond
Lord, the applicant, was present to answer questions. Mr. Lord explained that this site
plan is for Phase I, which includes nine buildings. There will be three phases to the
business park. Theron explained that parking is adequate for a facility this size and type.
The Technical Advisory Committee reviewed the site plan at their January 26' meeting.
Staff recommends approval with the following conditions:
1. That the applicant submits an application for a development permit. Further, that
this application be accompanied by all required state and federal permits.
2. That detailed drainage plans be submitted for approval by the City Engineer,

3. That acceleration/deceleration lanes and sidewalks be installed on the Owasso
Expressway frontage.

BACKGROUND

APPLICANT AND STATUS OF APPLCANT: Charles E. Norman, attorney for
contract purchaser of subject property.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property
from OL (Office Light), RS -3 (Residential Single - Family High Density), and RS -2
(Residential Single - Family Medium Density) to CS (Commercial Shopping
Center) to allow for additional commercial development that would be included in
the Owasso Market tract.
LOCATION AND SIZE: The property is generally located north of E. 96th Street
North and west of the Owasso Expressway. The subject property would be at
the western edge of what is known as the Owasso Market. The subject property
contains 16.67 acres, more or less.
EXISTING LAND USE: The subject property is currently undeveloped, with the
exception of a large detention facility that has been constructed to serve the
subject property and the Owasso Market development.
SURROUNDING LAND USE: The subject property is abutted on the south by E.
96th Street North, while farther south lies CS (Commercial Shopping Center), OM
(Office Medium), (Office Light), and RM -2 (Residential Multi - Family High Density)
zoned property, a portion of which is the ONG Work Center.
The subject property is abutted on the east by the planned Owasso Market
development which is zoned CS (Commercial Shopping Center) and will contain
Super Wal -Mart, Kohl's Department Store, a commercial shopping center
connecting the two anchor tenants, and several commercial pads likely to be
developed as restaurant sites. Farther east is the Owasso Expressway.

The subject property would be abutted to the north by atrip of RS -2 zoning
that was required in OZ -98 -07 in order to serve as a buffer between the Owasso
Market development and Bailey Ranch Estates ll.
The subject property is abutted on the west by AG (Agriculture) zoned property
which has developed in a residential manner. A location map is attached for your
information and review, which also shows the area to be rezoned.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso,
Chapter 15 "Amendments ", Chapter 6 "Commercial District Provisions ".
MASTER PLAN: The Owasso 2010 Master Plan identifies the northwest corner
of E. 96th Street North and the Owasso Expressway as being appropriate for
Commercial /Office development.
SITE INFORMATION: No unusual development hardships are noted.
ANALYSIS
The proposed rezoning, if approved, would create additional land for commercial
development at the Owasso Market Center. The planned collector street through
the Owasso Market Center that would "loop" behind the center and serve future
residential development to the north, would be shifted to the west, and then back
to its original planned location. The additional commercial zoning would allow for
2 additional commercial pad sites that would face east served by the Collector
Street. Additionally, the commercial area that was previously east of the
Collector Street would also be enlarged, in order to provide for a significantly
larger commercial pad, most likely for another "anchor" tenant at the Owasso
Market site.
The two most significant concerns regarding this type of request are typically
traffic and buffers. As you are aware, the City of Owasso has entered into two
agreements with Seayco Development to provide signalization at the Owasso
Expressway southbound exit and E. 96th Street North. Signalization at this
location will also benefit the Owasso Market traffic as this will serve as the "main"
entrance to the shopping area. In addition to the signalization project, the City of
Owasso also entered into another agreement which provides for the widening of
E. 96th Street North along the subject property frontage. A third agreement with
Seayco Development, not yet finalized, would call for the complete widening of E.
96th Street North from the western edge of the subject property to the Owasso
Expressway and includes additional signalization. This agreement was reviewed
with the City Council in a recent work session and is likely to be acted on by the
Council at their March 21, 1999 regular meeting.
The second concern is ensuring that there is an adequate buffer for residential
development. While this rezoning would indeed remove the planned RS -2
(Residential Single - Family Medium Density) buffer on the western portion of the
subject property, the 125' RS -2 buffer would remain on the northern boundary to
buffer the Bailey Ranch Estates II development. Although the property to the
west of the subject property is zoned AG (Agriculture), it has developed in a rural
residential "farm home" type manner. While any existing dwelling in that area is
setback a significant distance from either of the commercial pads that would be
added, it would be staffs expectation that gny commercial development on these
sites would be sensitive to those residentially developed AG lots to the west. If
the rezoning is approved, staff will review any commercial site plan carefully for
possible problem areas and would encourage the Planning Commission
members to do the same.
Staff has received no phone calls or letters inquiring about or concerned about
the rezoning request at the time of the report preparation. As you may recall, this
is in stark contrast to the original rezoning of this property (OZ- 98 -07) which
occurred in February of 1998. Staff would attribute this apparent lack of concern
to the realization that the subject property is in the process of developing
commercially and the excitement that "new" commercial development generates.
The most frequent questions Community Development staff fields now is not
regarding "What do they want to do there ?" but rather "When will it be done ?"
Letters were sent to property owners within 300' of the subject property and
notification was published in the Owasso Reporter. Copies of the letters to
property owners and the legal advertisement are attached for your information
and review.
RECOMMENDATION
Staff recommends approval of the rezoning request, rezoning the subject
property from OL (Office Light), RS -2 (Residential Single - Family Medium
Density) and RS -3 (Residential Single - Family High Density) to CS (Commercial
Shopping Center).

Theresa Spears has requested the annexation of an ssleacre tract of land located at the northeast
corner of E. 96h Street North and Garnett Road. The subject property is further described as the
S/2 of the SWA of the SW /4 of Section 17, T -21 -N, R -14 -E. A subject map is attached for your
information and review.
The City of Owasso city limits abut the subject property on both the south and west (E. 96h Street
North and Garnett Road). The Smith property on the south side of E. 96h Street North and the
Mini -mart and El Rio Vista on the west side of Garnett Road are also within the City Limits. North
and east of the subject property area several tracts of land located within Tulsa County zoned AG
(Agriculture), while farther north lies Bailey Ranch Estates, while farther east lies the Owasso
Market site. The subject property currently contains a large pond and a farm house.
While the preferred size of annexation is 20 acres and this tract is only 8.25, the property does abut
the existing city limits and upon annexation, each comer of the intersection of E. 96h Street North
and Garnett Road would be within the City Limits. The existing zoning of the subject property is
AG (Agriculture) and it would remain zoned AG upon annexation.
While the applicant has not indicated what the future plans for the subject property consist of, staff
would anticipate a request for a rezoning to a commercial designation in the future if the annexation
is approved. The Owasso 2010 Master Plan indicates that the northeast comer of E. 96h Street
North and Garnett Road is appropriate for Medium Intensity Commercial Development. Both
water and sewer are available to the subject property.
Notification of the annexation request was published in the Owasso Reporter on February 24, 2000
to notify the public of the annexation request before the Planning Commission meeting on March
14, 2000. That notification is then followed by notification published two consecutive weeks in the
Owasso Reporter on March 2, 2000 and March 9, 2000 to notify the public of possible City Council
action regarding the request on March 21, 2000.
Copies of the annexation policy and procedures, as well as the legal advertisements, are attached for
your information and review.
The Owasso Annexation Committee reviewed the request at a March 9, 2000 Special Meeting and
unanimously approved the request.
RECOMMENDATION
Staff recommends approval of the annexation request.

BACKGROUND:
The City of Owasso has received a request from Tyann Development to review a final plat for
Nottingham Estates V. Nottingham Estates V is located immediately east of Nottingham Estates 11,
III, and IV, south of E. 96°i Street North. A location map is depicted on the Nottingham Estates V plat
which is included within your packet. The proposed final plat would contain 44 single- family
residential lots on 24.57 acres, more or less. The preliminary plat for Nottingham Estates II-V was
approved in May of 1996. The subject property is zoned RS -2 (Residential Single - Family Medium
Density).
The Technical Advisory Committee reviewed the final plat for Nottingham Estates V at their February
23, 2000 regular meeting. At that meeting, area utility companies have the opportunity to request
additional service easements, as well as utility easements for street lighting. In addition to utility
company concerns, staff also provides comments and/or corrections regarding the subject property.
The following comments /corrections were recommended from that meeting:
1. PSO requested back to back (5' & 5') at various locations, plat provided to the engineer.
2. ONG requested the installation of 4" PVC on cul -de -sac crossings on 139's, 3 to 4 feet
south of Lot 12, Block 5 and Lot 18, Block 5.
3. Addresses were provided
4. OPWA commented that additional detention was likely to be required. Engineer noted that
the plat was part of the overall drainage scheme (ponds adjacent just to west of site). Mr.
Lutz noted that portions of the east boundary and southeast comer were at lower elevations
and probably would not drain into the proposed pond. Also recommended interceptor back
to the west located between cul -de -sacs to convey street drainage.
With the exception of item number 4, these comments have been addressed and are included on the
final plat within your packet.
The Engineering Division of the Public Works Department has reviewed construction plans and sent
them back to the developer's engineer for revisions. Permits from DEQ are necessary for both water
and sanitary sewer construction prior to this item being forwarded to the City Council. Additionally,
the above noted concerns regarding stone water detention will also need to be addressed prior to any
formal Council action
Acceleration/Deceleration lanes have been installed along E. 96 "' Street North as a requirement for the
previous platting of Nottingham Estates IV.
RECOMMENDATION
Staff recommends Planning Commission approval of the final plat for Nottingham Estates V.

NOTTINGHAM ESTATES H

The City of Owasso has received a request for review of a preliminary plat for Nottingham
Estates II. Nottingham Estates II is a proposed 92 lot residential addition located on a 68.56
acre tract. The subject tract is located immediately east of Pleasant View Estates (Tulsa County)
and Nottingham Estates. Access to this addition will be via E. 96th Street North and will tie into
Nottingham Estates.
The Technical Advisory Committee reviewed the preliminary plat at their May 1, 1996 meeting.
At that meeting, the utility companies supplied the developer with several different comments
and requests regarding utility easements. All of those requests will be included on any final plat
application. In addition to the utility company comments, staff also provided a list of all of the
city comments regarding the plat and construction plans. Those comments are as follows:
1. Limits of No Access need to be added along the double fronted lots the back
up to N. 138th E. Avenue.
2. Provide a lot area total sheet for the addition.
3. The park area needs to be designated as a private park.
4. Covenants need to be supplied. The developer has stated that these will be
similar to that of Nottingham Estates.
5. 15' utility easements need to be added within the front building lines of all
lots.
6. Acceleration /Deceleration lanes need to be constructed along E. 96th Street
North.
7. Addresses and street names are available.
8. Change the street labeled as N. 138th E. Avenue to N. 136th E. Avenue
The construction plans have been submitted for review. Please note that storm water detention
will occur throughout most of the area identified as park area and will include a pond with a
private picnic shelter. These plans are currently in the review stage. This is a preliminary plat,
and the Planning Commission will see it again. No action will occur on any final plat until the
construction plans have been approved by the Engineering Division of the Public Works
Department and permits to construct have been issued by the Oklahoma State Health
Department.

An additional item of note is the likely development of Nottingham Estates II. The area
contained within this plat is likely to develop in phases, the first of which will be the most
northerly portion of the plat. The developer should be commended for giving the staff and the
Planning Commission the opportunity to look at the whole picture at the beginning of the
project, rather that a project that is piece - mealed together.
RECOMMENDATION
Staff recommends approval of the preliminary plat of Nottingham Estates II with the inclusion
of staff's recommendations /comments and those of the area utility companies.

The City of Owasso has received a request from the Larkin Bailey Foundation for the review of a
preliminary plat for the Lakes at Bailey Ranch. The Lakes at Bailey Ranch is located at the southeast
comer of E. 106`s Street North and Garnett Road. A location map is depicted on The Lakes at Bailey
Ranch preliminary plat that is included within your packet. The proposed preliminary plat would
contain 9 lots on 146.51 acres, more or less. The subject property was rezoned from AG (Agriculture)
to PUD (Planned Unit Development) in December of 1998.
The Technical Advisory Committee reviewed the preliminary plat for The Lakes at Bailey Ranch at
their February 23, 2000 regular meeting. At that meeting, area utility companies have the opportunity
to request additional service easements, as well as utility easements for street lighting. In addition to
utility company concerns, staff also provides comments and/or corrections regarding the subject
property. The following comments /corrections were recommended at that meeting:
1. ONG noted that a line extension for gas is required from the south and east. Engineer
suggested underground meeting to discuss details on this large -scale project
2. Applicant's engineer suggested that additional platting and replatting would be needed as
the site develops. Noted that perimeter easements would be provided at final platting of
individual lots. Exact requirements for easements were unknown
3. PSO commented that 3 phase would be brought in from the east and north
4. S WBT commented that they would also like an underground meeting.
The above comments did not require a re- drawing of the preliminary plat included within your packet.
As this is a preliminary plat, no permits from DEQ for the construction of water and sanitary sewer
have been secured at this time. Again, the nature of the development and platting of this property will
be different than what the Planning Commission may be accustomed with typical residential
development.
Regarding the preliminary plat itself, the subdivision of the subject property meets all property
development standards for the approved PUD.. The subject property contained within this plat consists
primarily of the commercial and office of the overall PUD consisting of a bank site, commercial
shopping, office areas, as well as areas for both a medical center and an alzheimer facility. Sidewalks
will be required along Garnett Road and E. 106 "' Street North, as well as acceleration/deceleration
lanes. This plat is preliminary in nature, thus requiring additional review by the Planning Commission
in final plat form if approved by the Planning Commission on March 14, 2000.
RECOMMENDATION
Staff recommends Planning Commission approval of the preliminary plat for The Lakes at Bailey
Ranch.

Oakwood. Oakwood is located between E. 106" and E. 116'h Streets North and is immediately east of
Mingo Road (N. 97h E. Avenue). A location map is depicted on the Oakwood preliminary plat that is
included within your packet. The proposed preliminary plat would contain 53 lots on 15.42 acres,
more or less. The subject property was rezoned from AG (Agriculture) to RS -3 (Residential Single -
Family High Density) in December of 1999.
The Technical Advisory Committee reviewed the preliminary plat for Oakwood at their February 23,
2000 regular meeting. At that meeting, area utility companies have the opportunity to request
additional service easements, as well as utility easements for street lighting. In addition to utility
company concerns, staff also provides comments and/or corrections regarding the subject property.

1. PSO requested back to back (5' & 5') easements at various locations. Plat provided to the

5. ONG — a 2,500' line extension required to site. Sok, Vines, and others are negotiating at
this time in shared cost
6. Sanitary Sewer will be available on the west side of the subject property with Ranch Creek
II line replacement. Water is at 96'h and Mingo
7. An additional drainage easement is needed on the south side of Lot 8, Block 2
These comments /concems have been noted or addressed and are included on the preliminary plat
within your packet.
As this is a preliminary plat, no permits from DEQ for the construction of water and sanitary sewer
have been secured at this time. Please note, however, that DEQ has advised the City of Owasso that
they will not approve further sanitary sewer extensions in the area bounded by E. 106' Street North,
Memorial Drive, E. 126 "' Street North, and Garnett Road until Phase II of the improvements to the
North Owasso Interceptor are completed. This work is currently underway, but depending on the
timing of construction and final platting, the applicant may need to wait for DEQ permits until such
time that the line is completed.

development standards for an RS -3 district. Sidewalks will be required along Mingo Road, as well as

The Department of Environmental Quality (DEQ) recently received your request for information by fax.
This fax raised three specific questions, which this letter will attempt to clarify.
Physical description of the area north of the 106 °i Street North lift station
As mentioned in recent telephone conversations, the area north of the 106 °i Street North lift station that is
being studied by the Owasso Public Works Authority (OPWA) is rou,ghly bounded by 106 °i Street North
on the south, 126 °i Street North on the north, Memorial Drive on the west and Garnett Road on the east.
This entire four square mile area is not included in the study area, but most developed portions of this area
are being studied.
Definition of an extension
The DEQ defines a sewer line extension as any construction of additional lines to provide sewer service
to more than one residence. ]'his definition encompasses all new sewer line construction except private
service connections.
Status of Country Fstates IV
As you are aware, a construction permit for this project was issued by the DEQ on July 29, 1999. This
permit contained a provision requiring the OPWA to inform the DEQ in writing of the completion of the
North Owasso Interceptor Project prior to the connection of Country Estates IV to the Owasso wastewater
collection system. "I -he North Owasso Interceptor Project was completed and the connection of Country
Estates IV was macle, but bypasses have continued. As a result, the decision was made to extend the
North Owasso Interceptor north to 116"' Street North to replace an undersized 8-inch line with a 15 -inch
line. In the interim, the OPWA has placed a plug in the line connecting Country Estates IV to the
collection system. This plug will remain in place until the interceptorextension is complete.
Development of the lots within Country Estates IV is not due to begin until after the interceptor is
extended. Until this project is completed, the DEQ will not approve further extension of the collection
system in that area.

VI. Fairways VI is located immediately west of Fairways II Addition, immediately north of the Hale
Addition (Tulsa County). A location map is depicted on the Fairways VI plat which is included within
your packet. The proposed final plat would contain 42 single- family residential lots on 15.37 acres,
more or less. The preliminary plat for Fairways VI was approved by the Planning Commission in June
of 1999.
The Technical Advisory Committee reviewed the final plat for Fairways VI at their February 23, 2000
regular meeting. At that meeting, area utility companies have the opportunity to request additional
service easements, as well as utility easements for street lighting. In addition to utility company
concerns, staff also provides comments and/or corrections regarding the subject property. The
following comments /corrections were recommended from that meeting:
1. Street name Change— from E. 98" Ct N to N 98"` E Ct
2. Add limit of no access along rear of lots that abut Mingo Road.
3. ONG requested an 8" conduit across E. 93`d Street N, 4" conduit across N. 98' E. Court

The Engineering Division of the Public Works Department has reviewed construction plans and a
permit from DEQ has been issued to construct the sanitary sewer improvements. Staff is currently
waiting on the permit from DEQ approving the water improvements. If the Planning Commission
approves the final plat for Fairways VI, it will not be forwarded to the City Council for action until
that permit is received from DEQ.
Additional requirements of this plat are sidewalks along Mingo Road (N 97 "' E. Avenue), as well as
acceleration/deceleration lanes.
RECOMMENDATION
Staff recommends Planning Commission approval of the final plat for Fairways VI.

BACKGROUND:
The City of Owasso has received a request from David Vines to review a re -plat for Lots 13 and 14,
Block 4, Hale Acres 2nd Addition. The subject property is located South of E. 116' Street North,
North of E. 114" Street North, immediately east of the Owasso Sports Park. A location map is
attached within your packet. The proposed re -plat would contain 9 lots on 2.57 acres, more or less.
The subject property is zoned RS -3 (Residential Single - Family High Density).
The Technical Advisory Committee reviewed the re -plat for Lots 13 and 14, Block 4, Hale Acres 2nd
Addition at their February 23, 2000 regular meeting. At that meeting, area utility companies have the-
opportunity to request additional service easements, as well as utility easements for street lighting. In
addition to utility company concerns, staff also provides comments and/or corrections regarding the
subject property. The following comments /corrections were recommended at that meeting:
1. All utilities agreed that the cul -de -sac would be served from the front. They requested a 20
foot easement in the front yard
2. Staff requested that the drawing be re- submitted in plat format, owner name, surveyor,
acres, number of lots, signature blocks, etc. Addresses were provided.
3. OPWA noted that the water line extension would need to extend to the end of the cul -de-
sac. Applicant would need to obtain spec for the blowoff assembly. Applicant stated that
Robert Carr said drainage could be conveyed to existing bar ditch on E. 114'' Street N.
4. Fire Protection Officer stated that there was a hydrant located at the southeast comer of E.
1140' Street N. and N. 106'h E. Avenue. No additional hydrants required.
These comments /concerns have been noted or addressed and are included on the preliminary plat
within your packet.
As this is a re -plat, no permits from DEQ for the construction of water and sanitary sewer have been
secured at this time. Please note, however, that DEQ has advised the City of Owasso that they will not
approve further sanitary sewer extensions in the area bounded by E. 106'' Street North, Memorial
Drive, E. 126'' Street North, and Garnett Road until Phase II of the improvements to the North Owasso
Interceptor are completed. This work is currently underway, but depending on the timing of
construction and final platting, the applicant may need to wait for DEQ permits until such time that the
line is completed.
Regarding the plat itself, the subdivision of the subject property meets all property development
standards for an RS -3 district. In fact, the front yard setback of 45 feet is well in excess of the 25'
setback that is required. Although a re -plat, this plat is preliminary in nature, thus requiring additional
review by the Planning Commission in final plat form if approved by the Planning Commission on
March 14, 2000.
RECOMMENDATION
Staff recommends Planning Commission approval of the re -plat of Lots 13 and /I , Block 4, Hale
Acres 2' Addition.

The Department of Environmental Quality (DEQ) recently received your request for information by fax.
This fax raised three specific questions, which this letter will attempt to clarify.
Physical description of the area north of the 106 °i Street North lift station
As mentioned in recent telephone conversations, the area north of the 106t1i Street North lift station that is
being studied by the Owasso Public Works Authority (OPWA) is roughly bounded by 106i1' Street North
on the south, 126 °i Street North on the north, Memorial Drive on the west and Garnett Road on the east.
This entire four square mile area is not included in the study area, but most developed portions of this area
are being studied.
Definition of an extension
The DEQ defines a sewer line extension as any construction of additional lines to provide sewer service
to more than one residence. This definition encompasses all new sewer line construction except private
service connections.
Status of Country Estates IV
As you are aware, a construction permit for this project was issued by the DEQ on July 29, 1999. This
permit contained a provision requiring the OPWA to inform the DEQ in writing of the completion of the
North Owasso Interceptor Project prior to the connection of Country Estates IV to the Owasso wastewater
collection system. The North Owasso Interceptor Project was completed and the connection of Country
Estates IV was made, but bypasses have continued. As a result, the decision was made to extend the
North Owasso Interceptor north to It 6'I' Street North to replace an undersized 8 -inch line with a 15 -inch
line. In the interim, the OPWA has placed a plug in the line connecting Country Estates IV to the
collection system. This plug, will remain in place until the interceptor extension is complete.
Development of the lots within Country Estates IV is not due to begin until after the interceptor is
extended. Until this project is completed, the DEQ will not approve further extension of the collection
system in that area.
