4. OZ- 00- 05 /OPUD -19 — Pittman Poe & Associates - A request for the rezoning of a 80.3
acre parcel of land located on the north side of E 106`h Street N, west of N Garnett Road,
Proposed is a rezoning from AG (Agriculture) to PUD (Planned Unit Development) with
underlying zoning of OM (Office Medium), RD (Residential Duplex), and RS -3
(Residential Single - Family High Density). The property is described as the E/2 of the
SW /4 of Section 7, T -21 -N, R -14 -E.
5. OZ -00 -06 — Theresa Spears — A request for the rezoning of a 7.88 acre parcel of land
located on the north side of E 96' Street N and the east side of N Garnett Road. The
property is described as a portion of the S/2 of the SW /4 of the SWA of Section 17, T -21-
N, R -14 -E. Proposed is a rezoning from AG (Agriculture) to CG (Commercial General).
6. OZ -00 -07 — Chamev & Charney - A request for the rezoning of a 10 acre parcel of land
located on the north side of E 96' Street N and the west side of N Mingo Road. The
property is described as a portion of the SEA of the SE /4 of Section 13, T -21 -N, R -13 -E.
Proposed is a rezoning from AG (Agriculture) to CG (Commercial General) and CS
(Shopping Center).
7. OPUD -20 — Forest Creek Business Park L.L.C. — A request for the rezoning of a 6.35
acre (more or less) parcel of land located on the west side of Owasso Expressway north of
E 76 " Street N. The property is described as a portion of the NE /4 of the NEA of the
SE /4 of Section 30, T -21 -N, R -14 -E. Proposed is a rezoning from CG (Commercial
General) to PUD (Planned Unit Development) with CG underlying zoning.
8. Final Plat — QuickTrip Commercial Center #2R — A request to review a final plat for
QuickTrip Commercial Center, consisting of a 1.56 acre lot. The subject property is
located on E 760' Street N east of the Owasso Expressway. The site is currently occupied
by the Owasso Veterinary Hospital.

The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on April
7, 2000 at 11:00 AM.
1. CALL TO ORDER — Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

Bob Randolph moved to approve the minutes on the March 14, 2000 meeting. Bill Ellison
seconded the motion. The vote on the motion was as follows:

4. OZ -00 -02 Joe Wolfe — A request for the rezoning of property described as the N /2,
NW /4, SW /4 of Section 28, T -21 -N, R -14 -E. The subject property is 20 acres, more or
less, and is located northeast of the Graceland Acres Addition. Proposed is a rezoning
from AG (Agriculture) to RS -3 (Residential Single- Family High - Density).
Tim Rooney presented the item and described the location of the property. He stated that
a large drainage channel does run through a portion of the property, which would require
regrading prior to any development. This property was annexed in March of this year.
A portion of the Ehn Creek Interceptor runs across the property and would serve the
development. Notices were mailed to surrounding property owners and a legal
advertisement was published in the Owasso Reporter on March 23, 2000. Staff has

received one call wanting to know why the lot Mr. Wolfe owns in Graceland Acres was
not included in the request. Mr. Wolfe was present to answer any questions. The
following are comments that were made by surrounding property owners.
Mark Graham — Considers Graceland Acres to be a small community type
development. Does not want the traffic and is not in support of the rezoning. He also
had questions regarding the easement for access into the addition.
Robert Thomas — Concerns regarding the street in which the traffic will be using.
Jim Phillips — Questioned as to whether the property is annexed into the City.
Maxine Thomas — Drainage concerns in the area. Does not like the idea of access
into the subject property going through the lot Mr. Wolfe owns in Graceland Acres:
Bob Bates — Concerned with the water run off in the area.
Ray Haynes stated that tonight's discussion is on the zoning change of the property. The
platting process will show the drainage plan and,that,will be at alater date.- Tim Rooney
stated that Mr. Wolfe could use access through the lot that he owns or use the mutual
access easement off of 76& Street North.. He suggested ,that if the nearby homeowners
would put an asterisk by their name on the sign -in sheet, he would send them notification
when the platting process begins.
Ray Haynes moved to approve the rezoning request subject to access being made on the
westside of the property. Tim Rooney advised the Commissioners that to make
conditions such as this at the platting process. It will need to be made during the platting
process. Charles Willey seconded the motion. The vote on the motion was as follows:

5. OZ -00 -03 — David Charnev — A request for the rezoning of property located within the
SE /4 of Section 9, T -21 -N, R -14 -E. The subject property is located east of US Highway

169 and north of E. 106' Street North and contains 30 acres more or less. Proposed is a
rezoning from AG (Agriculture) to OM (Office Medium).
Tim Rooney presented the item and described the location of the property. This request
is a parcel of land approximately 30 acres in area requesting an OM district in order to
allow for the development of the proposed Tulsa Technology Center. OM zoning permits
Cultural and Recreational facilities. Water to the property would be provided by
Washington County Rural Water District, sanitary sewer service would run into the Ehn
Creek Interceptor. A decision will be made prior to construction regarding the details of
how the sewer line will be constructed and how it will be paid for. Notices were mailed
to surrounding property owners and the legal advertisement was published in the Owasso
Reporter. Two calls were received both were pleased with the proposed development.
Mr. David Charney, the applicant, made a brief presentation. He explained that Opal
Robinson donated this land. He spoke of the planned major accesses being 145' East
Avenue, 106' Street North and U.S. 169 service road. The proposed technology center
will focus on computers and high tech uses for computer science. The following are
comments made from several surrounding property owners:
=John 'Stier —Questions as to whether items #6, #7 and #8 are tied together.
Rich Halbrook — Concerns' regarding that the City does not send notices to
property owners for the platting process. Is there some way we can produce an
ordinance that would require notification on the platting process?
Linda Pennekamp — Expressed concerns regarding not having a voice in the
community because of her residence being in Rogers County. Stated that
transporting the school children two miles to a technology center would be much
better than taking them into Tulsa.
Traffic issues on 145' E Avenue and 106' Street North were discussed. Tim explained
that the Planning Commissioners do not address street problems. The Capital
Improvement Committee would solve these issues.
Ray Haynes moved to approve the rezoning request subject to each resident, which
desires to be notified of the platting process, receive notification by the City of Owasso.

6. OZ -00-04 - Pittman. Poe & Associates - A request for the rezoning of property located
within the E/2 of Section 16, T -21 -N, R -14 -E. The subject property is located east of US
Highway 169 and south of E. 106` Street North and contains 157.5 acres, more or less.
Proposed is a rezoning from AG (Agriculture) to RS -3 (Residential Single- Family High
Density), RTH (Residential Townhouse), RM -2 (Residential Single - Family High
Density), OM (Office Medium), CS (Commercial Shopping Center) and CG (Commercial
General). The purpose of the rezoning is to provide underlying zoning necessary for
OPUD -18.
Tim Rooney presented the item to the Commissioners. He explained that OZ -00-04
rezoning and OPUD -18 would be discussed at the same time, but requires separate votes.
Mr. Tim Terrell with Pittman -Poe was introduced and made a brief presentation. Mr.
Terrell presented a color -coded PUD map and he explained the different uses that are
included in the PUD request. Mr. David Charney asked the Commissioners and
surrounding property owners if they had any questions. The following is a list of
comments and concerns:
Don Sider - More apartments are not needed in Owasso:
Noble Sokolosky - Had property with bad drainage problems, these problems
were corrected after development, the water run off was much better. Has done
work with Pittman -Poe and feels they will do a great job on this project.
Linda Pennekamp - Questioned the platting process, can you go down or up in
density? Possibly change the density to RS -2 just along the south portion.
Mike Hacker - Had concerns regarding the opening of 139` East Avenue. Also
wants consideration of what the residents to the north are going to see behind
them, which is houses that are 10' apart. Consider making larger lots to the very
southern portion of this development.
Beverly Dunaway - She feels that the City of Owasso will not let the streets
deteriorate with the technology center coming. Might need apartments at this
location to help accommodate the technology center students.

Donna Priore — Questioned whether there has been an environmental study of the
area. There is an abundance of wildlife. Requested to delete the multi - family
housing and commercial and approve only the single family.
There was discussion regarding water run off problems and discussion on the possibility
of environmental studies being performed. Mr. Chamey explained that the lots along the
south portion would be approximately 70' wide, which is larger than required for an RS-
3. Also, sewer concerns for the area was addressed. Tim Rooney made a brief
presentation. He described the concept of a PUD and he stated there is 10% flexibility on
a PUD. The Owasso 2010 Master Plan shows this as a mixed -use development and
appropriate for this use. Buffer requirements include a 6 -foot "privacy" fence to
separate commercial development that abuts residential. Notification was sent to
surrounding property owners and legal advertisement appeared in the Owasso Reporter.
The property was posted on March 23, 2000. Mr. Rooney stated that staff recommends
approval of OZ -00-04 and recommends approval of OPUD -18 subject to the following
conditions:
1. That the applicant's Development Text and Conceptual Development Plan
be considered to be the Outline Development Plan as required by the PUD
Chapter of the Owasso Zoning:Code.
2. That unless specifically:,.set out in the standards and conditions of this
PUD, single -family lots shall meet the requirements of a typical RS -3
district. With the exception of the southern most 120' boundary of the
PUD to be changed to RS -2 zoning district.
3. Within OPUD -18, the maximum number of dwelling units shall not exceed
815.
4. That the reference on page 16 of the PUD text pertaining to a lien being
place on a Homeowner's Association member's "personal property" be
changed to "real property"
5. That minor transfer (10% increase in a development area's density) of
dwelling units from one form of residential development area to another
can occur if a significant change in the character of either development
area is not created.
6. That all conditions imposed by the Owasso Technical Advisory Committee
for subdivision plat approval be met as conditions of the PUD.
7. That no building permits be issued within any portion of the PUD until all
criteria outlined within Chapter 8 of the Owasso Subdivision Regulations
are met by the developer.

8. All covenants of any subdivision plat containing property within the PUD
shall incorporate all PUD standards and conditions of approval and make
the City of Owasso beneficiary.
9. That a detailed drainage report be submitted at the time of platting, and
certification of such document be an engineer.
10. Acceleration/Deceleration lanes will be required on E. 106' Street North
and N. 145' E. Avenue.
11. Sidewalks will be required along E. 106"' Street North and N. 145' E
Avenue, as well as along office and commercial areas within the
development.
12. No flag lots are permitted within any portion of the PUD.
13. If needed, commercial area may be required to provide on -site detention.
This to be determined at site plan review for commercial property.
14. Detailed landscaping plans (type, species, size, location and irrigation)
shall be required to be submitted with site plans of any commercial
development. Said plans will be reviewed by staff and must be approved
by the Planning Commission.
15. That within the commercial areas of development, no free - standing pole
sign shall be greater than 30' in height and that monument signs will be
strongly encouraged.
16. North 139'e East Avenue,,will not be opened for access.
Charles Willey stated that he felt the commercial areas will be a benefit to the city and
knowing the developers, this project will be done in good taste. He also stated to insure a
view of undeveloped land, you need to buy the property. Tim Rooney suggested that
anybody that would like to have site plan review notice sent to them, to mark the sign -in
sheet and he will send them a notice prior to the Planning Commission meeting.
Ray Haynes moved to approve the rezoning subject to the above conditions of the PUD
being met, the southernmost 120' boundary of the PUD to be RS -2 zoning district and
with the addition of the above item #16 stating no access will be made off of 139,' East
Avenue. Bill Ellison seconded the motion. The vote on the motion was as follows:

7. OPUD -18 — Pittman, Poe & Associates — A request for review of a Planned Unit
Development with the E/2 of Section 16, T -21 -N, R -14 -E. The subject property is
located east of US Highway 169 and south of E. 106` Street North and contains 157.5
acres, more or less. Proposed is a PUD designation to allow for a mixed use residential,
office, and commercial development. Action on this item is contingent upon favorable
review of Agenda Item #6.
This item was discussed along with item #6.
Ray Haynes moved to approve OPUD -18 subject to staff recommendations, Charles
Willey seconded the motion. The vote on the motion was as follows:

8. Preliminary Plat — Woodridge Estates — A request for review of a preliminary plat for
Woodridge Estates, a 94 lot, 41.69 acre subdivision described as a portion of the E/2 of
Section 16, T -21 -N, R -14 -E. The subject property is located east of US Highway 169
and south of E 106' Street N.
Tim described the location of the property. He stated the Woodridge Estates are
comprised of 94 lots on 41.69 acres. It is a portion of the single- family tract of the
previously reviewed PUD. The park areas shown on the plat act as buffers between the
single family and the office, commercial and multi - family areas of the PUD. Drainage of
the area was discussed briefly. The Technical Advisory Committee reviewed the plat at

their March 29, 2000 meeting. There were few comments made at that meeting and the
corrections have been included on the plat.
Ray Haynes moved to approve the preliminary plat subject to the requirements from staff

9. OLS -00-01 - Boos Builders - A request for review of a lot split of the east 40 feet of
Lots 1, 2, 3, and 4, Block 1, Central Park II Addition.
Tim presented the item to the Commissioners. This lot split would create four "new"
properties that would be conveyed to the Central Park Homeowners Association. This
item can be viewed as a house keeping- matter. The approval of this lot split would result
in the "legal" separation of the East 40 feet of Lots 1, 2, 3 and 4 of Block 1. TAC
reviewed this item on March 29, 2000 and there were no objections.

Tim presented the item to the Commissioners. He stated that Camden Park 3I has been
reviewed several times beginning as early as 1994. The Technical Advisory Committee
reviewed the final plat on March 29, 2000. No additional comments were provided
except for the several address changes, which are included on the plat.

11. Preliminary Plat - Owasso Market H - A request to review the preliminary plat for
Owasso Market II, a resubdivision of Lots 3, 4, 5, and 7 of Block 1 of Owasso Market.
The subject property contains 5 lots on 25.76 acres, more or less. -Owasso Market II is
located on E. 96h Street North, west of US Highway 169.
Tim presented the item and described the property. The rezoning of this property
allowed for the relocation of an access drive (N. 119th E. Ave) farther to the west, as
well as allowing for the creation of an additional large lot for an anchor tenant and
additional commercial properties. The Technical Advisory Committee reviewed the
preliminary plat at their March 29, 2000 meeting. No comments were made at that
meeting. The Commissioners discussed a screening fence being shown at the time of site
plan review.
Ray Haynes moved to approve the preliminary plat for Owasso Market II subject to staff
recommendations, Charles Willey seconded the motion. The vote on the motion was as

12. Preliminary Plat — Bradford Park — A request to review the preliminary plat for
Bradford Park, a one lot, one block 18.66 acre subdivision located south of E. 76'h Street
North and west of N. 129' E Avenue.
Tim presented the item to the Commissioners. He explained that Bradford Park was a
part of OPUD -17 and this portion calls for single - family attached dwellings with private
streets and park and detention areas. The Technical Advisory Committee reviewed this
plat at their March 29, 2000. There were a large amount of questions so staff scheduled
an additional meeting on April 5, 2000 to address these concerns. Those concerns have
been addressed and are included on this plat. The applicants were present to answer any
concerns or questions that the Commissioners might have. Water run off was discussed.
The applicant stated that there will be three ponds to hold run off water.

CONCEPT OF A PUD
The concept behind a Planned Unit Development is to provide a creative alternative to a
conventional development where a particular tract is under common ownership or
control, and a detailed plan (Outline Development Plan) for the development of the tract
as a unit is proposed and submitted for public input and review. The PUD allows for
greater creativity and flexibility than could be achieved by traditional zoning in the
planning and development of large parcels of land.
The use of a PUD technique is a way to amend a zoning ordinance in accordance with a
complete, coordinated plan of development for a larger parcel, rather than piecemeal the
changes by using variances of the zoning regulations.
Planned Unit Development #19 is 80.3 acres in size, all of which is undeveloped.
Currently, the entire tract is zoned AG (Agriculture) and was annexed by the City of
Owasso in March of this year. The subject property is located on the north side of E.
106th Street N. between Gannett Road and Mingo Road.
The property is bound on the east and west by unplatted parcels (Tulsa County) zoned
AG (Agriculture) with residences. To the north is the Owasso Sports Complex, zoned
AG. Adjacent to the northeast corner of the site is Hale Acres Subdivision, zoned RS -1
(Residential Single - Family, Low Density). The property to the south is undeveloped and
unplatted and was rezoned to PUD in February of 1999. The development, known as The
Lakes at Bailey Ranch will be mixed use consisting of high- density single - family
residential, patio homes, townhomes, multi - family residential, Office and shopping
center.
The applicant is requesting approval of PUD supplemental zoning on the subject tract
that would be developed in accordance with a submitted Outline Development Plan and
Text. The PUD application is accompanied by a zoning application (OZ- 00 -05). The
plan and text call for the development of 36 acres of single - family residential with RS -3
(Residential Single Family, High Density) development, 14.2 acres of RD (Residential
Duplex) development, 19.3 acres of OM (Office Medium Intensity) development and
10.8 acres of parklopen space.
Staff is proposing a concurrent review of OPUD -19 and OZ- 00 -05.
STAFF ANALYSIS
The Zoning Code identifies that the Planning Commission shall conduct a public hearing
and shall determine:
1. Whether the PUD is consistent with the Comprehensive Plan.
2. Whether the PUD is in harmony with the existing and expected development
of the surrounding areas.
Whether the PUD is a unified treatment of the development possibilities of
the project site.
4. Whether the PUD is consistent with the stated purpose and standards of the
PUD Ordinance.
a. Permit innovative land development while maintaining appropriate
limitation on the character and intensity of use assuring
compatibility with adjoining and proximate properties;
b. Permit flexibility within the development to best utilize the unique
physical features of the particular site;
c. Provide and preserve meaningful open space;
d. Achieve a continuity of function and design within the development.
CONSISTENCY WITH COMPREHENSIVE PLAN
The 2010 Land Use Master Plan, recently completed and adopted by the Planning
Commission and City Council in January of this year,is implemented through the use of
the zoning process. This means that when zoning or PUD requests are presented to the
Planning Commission and City council, they should be consistant with the
Comprehensive Plan or logical reasons should be presented to show that the plan needs to
be amended.
The Comprehensive Plan designates the subject property to be developed as low- intensity
residential accommodating greenway /pedestrian trail.
The southerly 19.3 acres are designated as office, the middle 19.3 acres of the PUD will
be developed as single - family detached residential and the northern portion of the site,
adjacent to the Owasso Sports Complex is planned 14.2 acres of single - family duplex.
It is staff s opinion that the residential portions of this PUD plan are in line with the
Comprehensive Plan. Although the Plan does not call for office uses on the north side of
E. 106th Street N., it did call for an extensive area of commercial/office along the south
side of the road. Since the approved PUD development plan for the Lakes at Bailey
Ranch does not utilize the entire area allotted by the Comprhensive Plan as
commercial/office, it is staffs opinion this use is appropriate and does not significantly
deviate from the spirit of the Plan.
Harmony with Existing and Expected Development
There has been a trend with new development in the Owasso area toward more mixed -use
developments. The area ofthe subject property is just such a case with the previouly
mentioned Lakes at Bailey Ranch as well as Hale Acres, which has a mixture of
residential uses.
One of the primary benefits of the mixed -use PUD concept is the distribution of land uses
within the community. For intance, the proposed Office within the subject area offers the
possibilty of neighborhood residents' use of the space, thus alleviating their need to travel
to a place of employment, further alleviating additional traffic. This is only one
simplified example of the benefits of the PUD concept which, when extrapolated, become
many.
It is staff s opinion that development which would be permitted with both the requested
underlying zoning as well as the proposed PUD, would be consistent with existing and
expected development.
Leeal, Plannine and Site Engineering
The applicant has provided two on -site lakes within the natural drianage way on the site,
as well as significant greenway /park adjacent to the lakes and through the site. A detailed
drainage report is recommended for this development at the time of platting.
The open space is, apparently, in line with the Comprehensive Plan's call for
greenway /pedestrian trail in this area. The Development Plan does not address the
pedestrian trail issue. Staff would recommend the requirement of a trail system related to
the greenway and extending through the site. Staff would also recommend the inclusion
of a sidewalk along E. 106th Street N. in addtion to the required internal sidewalk system.
Vehicular circulation is well planned with a single boulevard entrance on to E. 106th
Street N. and a stub -out for connection with fixture devleopment to the east. Staff would
recommend the applicant consider a future connection to the west, also.
Unified Treatment of the PUD Subiect Area
The applicant has effectively utilized the project site and its existing natural features.
The creation of lakes and the associated open space within the primary natural
drainageway will be a valuable amenity for the neighborhood.
The Outline Development Plan does not address lot layout and secondary circulation
patterns. It should be noted at this time, the solutions regarding these issues should meet
the standards of the Owasso Subdivision Regulations. Staff recommends no flag lots be
permitted.
OZ -00 -05
It is staff s opinion that OZ -00 -05 is consistent, in spirit, with the Comprehensive Plan
and the Amendments Chapter of the Zoning Code. Staff recommends approval of OZ-
00-05, rezoning the subject property from AG to OM (23.2 acres), RD (16.9 acres) and
RS -3 (40.2 acres).
OPUD -19
It is staffs opinion that OPUD -19 is consistant with the Compehensive Plan and the
Planned Unit Development portion of the Owasso Zoning Code. Staff recommends
approval of OPUD -19 subject to the following conditions:
That the applicant's Development Text and Outline Development Plan be
considered the Outline Development Plan as required by the PUD Chapter of
the Owasso Zoning Code.
2. That within OPUD -19, the maximum number of development units shall not
exceed 335.
3. That the applicant address lot configuration, secondary vehicular circulation,
and pedestrian circulation at the time. of site plan review.
4. That sidewalks be required along E. 106th Street N.
5. That a trail system be required throughout the greenway as required by the
Comprehensive Plan.
6. That a detailed drainage report, certified by an engineer, be required at the
time of platting.
7. That no flag lots be permitted within this development.
8. That the reference on page 6 of the PUD text pertaining to a lein being
placed on a Homeowner's "personal property" be changed to "real property".
9. That minor transfers (10% increase in a development area's density) of
dwelling units from one form of residential development area to another can
occur if a significant change in the character of the either development area
is not created.
10. That no building permits be issued within any portion of the PUD until all
criteria oulined within Chapter 8 of the Owasso Subdivision Regulations are
met by the developer.
11. That all conditions imposed by the Owasso Technical Advisory Committee
for subdivision plat approval be met as conditions of the PUD.
12. All covenants of any subdivision plat containing property within the PUD
shall incorporate all PUD standards and conditions of approval and make the
City of Owasso beneficiary.
13. That acceleration /deceleration lanes be required on E. 106th Street N.
14. Detailed landscaping plans (type, species, size, location, and irrigation) shall
be required to be submitted with site plans of any office development. Said
plans will reviewed by staff and must be approved by the Planning
Commission.
15. That sidewalks be provided as set required by section 3.4 "Sidewalks" of
the Owasso Subdivision Regulations.

ANALYSIS
The applicant is requesting rezoning on a parcel of land approximately 6.9 acres in area
from AG (Agriculture) to CG (Commercial General).
The Comprehensive Plan shows this area as medium intensity commercial. It is staff s
opinion that rezoning the subject property to CG is entirely in line with the
Comprehensive Plan.
The applicant is unprepared, at this time, to state a proposed use for the subject property.
It should be noted, that pri6r to development of the site, a site plan must be submitted for
review and approval.
The potential uses within the CG (Commercial General) zoning district are retail and
services, office, cultural and recreational, gasoline sales and automotive services,
restaurants, off - street parking and outdoor advertising and hotel and motel. For a detailed
listing of permitted uses within the zoning district, please refer to the Owasso Zoning
Code Chapter 6, Section 610.
As required by the Owasso Zoning Code, Chapter 2, Section 250, a six foot high
screening wall or fence will be required at the time of development. A detail of the wall
or fence design will be required at the time of Site Plan review.
Notices were mailed to surrounding property owners on April 24, 2000 and the legal
advertisement was published in the Owasso Reporter on April 27, 2000. Copies of each
have been attached for you information and review. Additionally, the subject property
was posted on April 27, 2000. Staff has not received any phone calls regarding this
rezoning.
RECOMMENDATION
Staff recommends approval of the rezoning request from AG (Agricultural) to CG
(Commercial General).

CONCEPT OF A PUD
The concept behind a Planned Unit Development is to provide a creative alternative to a
conventional development where a particular tract is under common ownership or
control, and a detailed plan (Outline Development Plan) for the development of the tract
as a unit is proposed and submitted for public input and review. The PUD allows for
greater creativity and flexibility than could be achieved by traditional zoning in the
planning and development of large parcels of land.
The use of a PUD technique is a way to amend a zoning ordinance in accordance with a
complete, coordinated plan of development for a larger parcel, rather than piecemeal the
changes by using variances of the zoning regulations.
BACKGROUND
Planned Unit Development #20 is 6.5 acres, more or less in size, all of which is
undeveloped. Currently the tract is zoned CG (Commercial General). The subject
property is located north of E 76th Street N on the west side of the Owasso Expressway.
The site is bound on the west by RM -1 (Residential Multi - Family, Low Density) which is
occupied by the Owasso School Bus Barn. To the north the property is abutted by the
Owasso Auto Clinic and is zoned CG (Commercial General). There are three parcels,
two at the northeast corner of the site and one at the southeast, zoned IL (Industrial Light
Manufacturing and Research and Development). The parcels to the northeast are
occupied by Jim's Auto Service and A Tint and Moore, the parcel to the southeast by
Keller Williams. The property to the south is occupied by the Homeland/Stage/Dollar
General/Bumper to Bumper Auto Parts Center and is zoned CS (Shopping Center)
The applicant is requesting approval of PUD supplemental zoning on the subject tract
that would retain the CG (Commercial General) underlying zoning and be developed in
accordance with a submitted Outline Development Plan and Text. The plan and text call
for the development of the +/ -6.5 acre parcel as a business park with 15 buildings ranging
in size from 1,800 to 6,500 square feet.
STAFF ANALYSIS
The Zoning Code identifies that the Planning Commission shall conduct a public hearing
and shall determine:
1. Whether the PUD is consistant with the Comprehensive Plan.
2. Whether the PUD is in harmony with the existing and expected development
of the surrounding areas.
3. Whether the PUD is a unified treatment of the development possibilities of
the project site.
4. Whether the PUD is consistant with the stated purpose and standards of the
PUD Ordinance.
a. Permit innovative land development while maintaining appropriate
limitation on the character and intensity of use assuring
compatibility with adjoining and proximate properties;
b. Permit flexibility within the development to best utilize the unique
physical features of the particular site;
c. Provide and preserve meaningful open space;
d. Achieve a continuity of function and design within the development
CONSISTENCY WITH COMPREHENSIVE PLAN
The 2010 Land Use Master Plan, recently completed and adopted by the Planning
Commission and City Council in January of this year,is implemented through the use of
the zoning process. This means that when zoning or PUD requests are presented to the
Planning Commission and City council, they should be consistent with the
Comprehensive Plan or logical reasons should be presented to show that the plan needs to
be amended.
The Comprehensive Plan designates a portion of the subject property to be developed as
Commercial/Office while the majority of the site is proposed to be Park/Recreational.
Given the existing uses surrounding the subject property, and the proximity of Rayola
Park to the site, it is staffs opinion that the community would not be adversely affected if
the site is developed as a complement to the existing uses.
Harmony with Existing and Expected Development
As stated previously, the surrounding land uses include Commercial and Light Industrial,
primarily, and the area which is zoned RM -1 is currently the location of the Owasso
Public Schools bus bam and maitenance facility.
The intention of the applicant is to provide commercial buildings to service small
businesses. The buildings and grounds will be maintained by means of an association,
which will upkeep the property and landscaping around each building and the common
areas.
It is staffs opinion that the proposed PUD would be consistent with existing and expected
development.
Leeal, Planning and Site Engineering
According to the FEMA Flood Insurance Rate Map No. 400210 0002 D, dated April 15,
1992, this site lies within the 100 year flood plain. The site also is bound on the west by
floodway.
The site engineering and design should comply with all Owasso Subdivision Regulations,
with particular attention paid to Section 3.9 Flood Plain Areas and Section 3.13 Storm
Water Detention.
Due to the Flood Plain and Floodway designations of the site, staff recommends the
requirement, at the time of platting, of a detailed drainage report and certification of that
report by an engineer.
The proposed building layout and circulation appear to be efficient and adequate. There
is proposed a single access to the interior lots from Owasso Expressway. Four lots will
front and individually access Owasso Expressway.
Pedestrian circulation has not been addressed on the Preliminary Site Plan. It is staffs
recommendation that continuous circulation, from parking to building and building to
building, be required throughout the interior of the site at the time of site plan
development.
Unified Treatment of the PUD Subject Area
The proposed PUD is well integrated allowing for unified access and circulation and the
sharing of parking among the internal buildings. It should, however, be noted that the
Preliminary Site Plan does not show adequate parking for the building square footage
shown. There will need to be some redesign and, possibly, some building size reduction
to supply the required parking based upon the developer's stated intended use of retail
and services.
Staff has received two phone calls regarding this PUD application. Both asking what the
development would be and neither having negative comments regarding the application.
RECOMMENDATION
OPUD -20
It is staffs opinion that OPUD -20 is consistent with the Planned Unit Development
portion of the Owasso Zoning Code and, while not entirely consistent with the
Comprehensive Plan (which shows this particular site as park), does follow the spirit of
the Comprehensive Plan for the area.
Staff recommends approval of OPUD -20 subject to the following conditions:
1. That all requirements of an Outline Development Plan as required by the
PUD Chapter of the Zoning Code be met at the time of the submission of
the Final Site Plan for site plan review. Development Text should also
meet all requirements and be resubmitted at that time.
2. That a detailed drainage report, certified by an engineer, be submitted at the
time of platting.
3. That sidewalks be required from buildings to parking and building to
building within the interior of the PUD.
4. That the Final Site Plan meet all requirements of Chapter 10, Off - Street
Parking, of the Owasso Zoning Code.
5. That all conditions imposed by the Owasso Technical Advisory committee
for subdivision plat approval be met as conditions of the PUD.
6. That no building permits be issued within the PUD until all criteria outlined
within Chapter 8 of the Owasso Subdivision Regulations are met by the
developer.
7. That all covenants of the subdivision plat of the PUD property shall
incorporate all PUD standards and conditions of approval and make the
City of Owasso beneficiary.

BACKGROUND
The City of Owasso has received a request from QuickTrip Corporation for a review of a Final Plat
for QuickTrip Commercial Center #2R located on E. 76th Street N. east of the Owasso Expressway
in the current location of the Owasso Veterinary Clinic. The plat consists of 1.5 acres, more or less.
A location map is attached for your information and review.
QuickTrip is currently located across the street on the north side of E. 76th Street N. This store
will be abandoned upon the openning of the new store.
Sidewalks will be reuqired the length of the property along E. 76th Street N.
The Technical Advisory Committee reviewed -the preliminary plat for the subject property at their
April 26 regular meeting. Due to a proposed drive location, Mark Kerr of ONG commented an
existing grouping of four meters might have to be relocated. Mr. Kerr said he would look into this
and contact the consultant. He also said this would not be an obstacle to construction, that the
meters could be relocated. This was the only concern of the advisors.
It is staffs opinion this Preliminary Plat can be presented to the Commission as a Final Plat, at the
applicants request, due to the fact it is a single -site plat and there were no unresolved issues from
the TAC meeting.
RECOMMENDATIONS
Staff recommends approval of the Final Plat for QuickTrip Commercial Center #2R.
