OWASSO PLANNING COMMISSION !MINUTES OF REGULAR MEETING Tuesday, May 9, 2000 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Larry Helton Bob Randolph Charles Willey MEMBERS ABSENT Bill Ellison STAFF PRESENT Donna Sorrells Marsha Hensley The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on May 5, 2000 at 9:30 AM. 1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE APRIL 11, 2000 REGULAR MEETING. Charles Willey moved to approve the minutes on the April 11, 2000 meeting. Larry Helton seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Larry Helton - Yes Charles Willey - Yes The motion carried 4 -0. 4. OZ- 00- 05 /OPUD -19 - Pittman Poe & Associates - A request for the rezoning of a 80.3 acre parcel of land located on the north side of E 106" Street N, west of N Garnett Road. Proposed is a rezoning from AG (Agriculture) to PUD (Planned Unit Development) with underlying zoning of OM (Office Medium), RD (Residential Duplex), and RS -3 (Residential Single- Family High Density). The property is described as the E/2 of the SW /4 of Section 7, T -21 -N, R -14 -E. Donna presented the item to the Commissioners. She described the location of the property and also explained the concept of a PUD. She stated that this would be a concurrent review of OZ -00 -05 and OPUD -19. Staff's opinion of OZ -00 -05 is consistent with the Comprehensive Plan and the Amendments Chapter of the Zoning Code. Staff recommends approval of OZ- 00 -05, rezoning the subject property from AG to OM (23.2 acres), RD (16.9 acres) and RS -3 (40.2 acres). OPUD -19 is also consistent with the Comprehensive Plan and the Planned Unit Development portion of the Owasso Zoning Code. Staff recommends approval of OPUD -19 subject to the following conditions: i ) I . That the applicant's Development Text and Outline Development Plan be considered the Outline Development Plan as required by the PUD Chapter or the Owasso Zoning Code. OWASSO PLANNING COMMISSION May 9, 2000 Page No. 2 2, That within OPUD -19, the maximum number of development units shall not exceed 33.5. 3. That the applicant address lot configuration, secondary vehicular circulation, and pedestrian circulation at the time of site plan review. 4. That sidewalks be required along E. 106°i Street N. 5. That a trail system be required throughout the greenway as required by the Comprehensive Plan. 6. That a detailed drainage report, certified by an engineer, be required at the time of platting. 7. That no flag lots be permitted within this development 8. That the reference on page 6 of the PUD text pertaining to a lien being placed on a Homeowner's "personal property" be changed to "real property". 9. That minor transfers (10% increase in a development area's density) of dwelling units from one form of residential development area to another can occur is a significant change in the character of the either development area is not created. 10. That no building permits be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 11. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. 12. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 13. That acceleration/deceleration lanes be required on E. 106' Street N. 14. Detailed landscaping plans (type, species, size, location and irrigation) shall be required to be submitted with site plans of any office development. Said plans will be reviewed by staff and must be approved by the Planning Commission. 15. That sidewalks be provided as set required by section 3.4 "Sidewalks" of the Owasso Subdivision Regulations. There were several surrounding property owners present to express their concerns to the Commissioners. The main concern was drainage in the area, for instance, the water run off control that comes across 96" Street North. Ray Haynes explained that many times, problems with drainage are solved when new development comes. Ray also suggested that these concerns need to be heard during the platting process. Ray Haynes moved to approve rezoning request OZ -00 -5 and OPUD -19, subject to staff recommendations being met and the design to remain as close as possible to what is being presented tonight, Charles Willey seconded the motion. OZ -00 -06 - Theresa Spears - A request for the rezoning of a 7.88 acre parcel of land located on the north side of E 96" Street N and the east side of N Garnett Road. The property is described as a portion of the S/2 of the SW /4 of the SW /4 of the SW /4 of Section 17, T -21 -N, R -14 -E. Proposed is a rezoning from AG (Agriculture) to CG (Commercial General). Donna presented the item. She explained that the applicant is requesting rezoning on a parcel of land approximately 6.9 acres from AG (Agriculture) to CG (Commercial General). The applicant, Theresa Spears, is unprepared to state a proposed use for the property. Notices were mailed to surrounding property owners on April 24, 2000 and the legal advertisement was published in the Owasso Reporter on April 27, 2000. The subject property was posted on April 27, 2000. No calls have been received regarding this rezoning. Ms. Spears was present to answer any questions or concerns. Mr. Joe Caudle, a nearby property owner expressed concerns with drainage in the area. Ray Haynes moved to approve the rezoning request, Bob Randolph seconded the motion. OZ -00 -07 - Charnev & Charnev - A request for the rezoning of a 10 acre parcel of land located on the north side of E 96'n Street N and the west side of N Mingo Road. The property is described as a portion of the SE /4 of the SE /4 of Section 13, T -21 -N, R -13 -E. Proposed is a rezoning from AG (Agriculture) to CG (Commercial General) and CS (Shopping Center). OWASSO PLANNING COMMISSION May 9, 2000 Page No. 4 The location of the property was described along with the surrounding land use. Donna also explained the potential uses, allowed by right, within the CG (Commercial General) zoning district. The zoning code requires a 6 -foot high screening wall or fence at the time of development. A drawing of this screening wall will be required upon site plan review. Notices were mailed to surrounding property owners and a legal advertisement was published in the Owasso Reporter. Mr. David Charney, the applicant, was present to address any concerns. Charles Willey moved to approve the rezoning. Larry Helton seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Larry Helton - Yes Charles Willey - Yes The motion carried 4-0. 7. OPUD -20 - Forest Creek Business Park L.L.C. - A request for the rezoning of a 6.35 acre (more or less) parcel of land located on the west side of Owasso Expressway north of E 760' Street N. The property is described as a portion as a portion of the NE /4 of the NE /4 of the SE /4 of Section 30, T -21 -N, R -14 -E. Proposed is a rezoning from CG (Commercial General) to PUD (Planned Unit Development) with CG underlying zoning. Donna presented OPUD -20 to the Commissioners. She described the property and the location of the property. The property lies within the 100 -year flood plain and the site also is bound on the west by floodway. A detailed drainage report will be required at the time of platting. Staff has received two phone calls regarding this request. Both were asking what the development would be and neither having negative comments. It is staff's opinion that this request is consistent with the PUD portion of the Owasso Zoning Code, and does follow the Comprehensive Plan for the area. Staff recommends approval of OPUD -20 subject to the following conditions: 1. That all requirements of an Outline Development Plan as required by the PUD Chapter of the Zoning Code be met at the time of the submission of the Final Site Plan for site plan review. Development Text should also meet all requirements and be resubmitted at that time. 2. That a detailed drainage report, certified by an engineer, be submitted at the time of platting. 3. That sidewalks be required from buildings to parking and building to building within the interior of the PUD. 4. That the Final Site Plan meet all requirements of Chapter 10, Off - Street Prinking, of the Owasso Zoning Code. OWASSO PLANNING COMMISSION May 9, 2000 Page No. 5 5. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. 6. That no building permits be issued within the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 7. That all covenants of the subdivision plat of the PUD property shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. Mr. Raymond Lord, the applicant, was present to answer any questions regarding this request. Mr. Lord stated that single curb cuts for buildings #12, 13 and 14 would be shown in the platting process. Charles Willey had questions concerning the entrance into the project. Ray Haynes wanted to be assured that the parking area will be paved and that there will be acceleration/deceleration lanes coming off the service road. Mr. Lord stated that there would be ample space for acceleration/deceleration lanes. Mr. Lord also stated that as many trees as possible will be retained. Ray Haynes moved to approve OPUD -20 subject to the above staff recommendations, Larry Helton seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Larry Helton - Yes Charles Willey — Yes The motion carried 5 -0. 8. Final Plat — OuikTria — A request for review of a final plat for QuikTrip Commercial Center, consisting of a 1.56 acre lot. The subject property is located on E 76ie Street N east of the Owasso Expressway. The site is currently occupied by the Owasso Veterinary Hospital. Donna presented the item and described the location of the property. She stated that sidewalks will be required the length of the property along E 761' Street N. The Technical Advisory Committee reviewed the preliminary plat at their April 26' meeting. At that meeting ONG commented that an existing group of four meters might have to be relocated. Donna also explained that due to the fact it is a single -site plat and there were no unresolved issues, the preliminary plat can be presented to the Commissioners as a Final Plat. Ray Haynes had concerns regarding the sanitary sewer in the area. Mr. Steve Powel with die QuikTrip Corporation explained that easements for the sewer systems are J not complete but there is a verbal agreement. There will be a shared cost of the sewer by Wendy's, QuikTrip and the car wash next door. Mr. John Dix with the QuikTrip Corporation slated that they are moving because of the need for a larger lot. Mr. Dix also explained that the access points into the project would improve the 76" Street North OWAS,SO PLANNING COMMISSION May 9, 2000 Page No. 6 and Highway 1 -69 intersection. Ray Haynes moved to approve the final plat subject to the requirements from staff and TAC being met. Bob Randolph seconded the motion. Sorrells — City Planner BACKGROUND The City of Owasso has received a request from the Baptist Retirement Centers of Oklahoma for the review of the final plat for Bradford Park, Phase One. Bradford Park is located on the west side of N. 129th E. Avenue south of E. 761h Street N. A location map is included on the plat within your packet. The subject property contains one (1) lot on 18.661 acres. At the April 11, 2000 regular meeting of the Planning Commission, the preliminary plat for Bradford Park was reviewed and unanimously approved. The Technical Advisory Committee, at their May 31, 2000 regular meeting, reviewed the final plat for Bradford Park, Phase One. Comments by the members of the Technical Advisory Committee have been satisfactorily addressed and are reflected on the final plat contained in this packet. The concept for this development is duplex and four -plex units oriented along private roads. All units will remain under the control and ownership of the Baptist Retirement Center and will be leased on a "lifetime" basis. The roads, detention and other stormwater facilities and common areas will be installed and maintained by the Retirement Center. The developer has not yet secured permits from DEQ for the construction of sanitary sewer and water improvements. These permits will be required prior to final plat approval by City Council. RECOMMENDATION Staff recommends approval of the Bradford Park final plat with the following condition: 1. All required DEQ permits will be obtained prior to the final plat being forwarded to the Owasso City Council for approval. 2. Acceleration/deceleration lane will be constructed. ATTACHMENTS I. Bradford Park Final Plat CITY OF OWASSO Planning Department SITE PLAN OWASSO VETERINARY HOSPITAL Staff Report Donna S. Sorrells — City Planner BACKGROUND The City of Owasso has received a request for review of a site plan for a 1.73 acre site described as Lot 5, Castle Point Commercial Park, and located at 8811 N. Owasso Expressway. The property will accommodate the Owasso Veterinary Hospital. The subject property is zoned AG (Agriculture). The floor area of the Veterinary Hospital is approximately 6518 square feet with an additional 1920 square feet of commercial lease space attached. The parking requirement for this facility is 1 space per 200 square feet of building floor area. Based on this requirement, the applicant would need to provide 42 parking spaces on the site. The applicant has met this requirement and provided the 2 required handicap spaces. All utilities are available to the site. Drainage will be directed to the east end of the property which was designated on the plat as drainage detention easement. At the time of Technical Advisory Committee review, Public Works requested an erosion and sedimentation control plan. This plan has been submitted to Public Works as requested.
