CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:07 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE AUGUST 8, 2000 REGULAR MEETING. Bob Randolph moved to approve the minutes on the August 8, 2000 meeting. Bill Ellison seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Bill Ellison - Yes Charles Willey - Yes The motion carried 4 -0. 4. Election of Officers - Chairman Vice - Chairman Secretary The Chair opened the floor for nominations for Chairperson. Annexation - A & W Land Development - A request for annexation of a 17.65 acre parcel of land generally described as a portion of the southeast quarter (SE /4) of the northeast quarter (NE /4) of Section 6, Township 21 North, Range 14 East and located west of N. Garnett Road and north of E. 116ffi Street N. (Ward 1) Donna presented the case to the Commissioners. The subject property is zoned AG (Agriculture). If annexation is approved, the property will require rezoning and platting prior to development. The Technical Advisory Committee reviewed the request at the August 30, 2000 regular meeting. There was discussion on the ability of Washington County Rural Water District 3 to provide adequate fire protection. A later conversation with a representative from Washington County RWD3 was confident that the district could meet the fire suppression standards. The Annexation Committee reviewed the request at their meeting held September 7, 2000 and recommended approval. Staff recommends approval of this annexation request subject to the following condition: 1. A sealed engineering report or letter confirming the ability of Washington County RWD3 to provide adequate fire protection standards be submitted prior to approval of any plat associated with the annexed property. Ray Haynes moved to approve the annexation request subject to the above staff and TAC recommendations, Charles Willey seconded the motion. Final Plat - Forest Creek Business Park - A request for review of a final plat for Forrest Creek Business Park containing 13 commercial lots on a 6.4 acre tract of land located west of N. Garnett Road and north of E. 76' Street N. and generally described as a portion of the northeast quarter (NE /4) of the southeast quarter (SE /4) of the southeast quarter (SE /4) of Section 30, Township 21 North, Range 14 East. (Ward 4) Donna presented the item to the Commissions and described the location. The developer has submitted sewer and water extension plans to DEQ for review. The Technical Advisory Committee reviewed the plat at the August 30, 2000 regular meeting. Oklahoma Natural Gas, Southwestern Bell and Cox Communications requested the addition of a 15' utility easement across the rear property lines of lots 12 and 13 and an increase in the rear utility easement to 17.5'. The revisions have been made to the plan. Staff recommends approval of the final plat for Forest Creek Business Park subject to the following conditions: 1. DEQ permits be issued prior to forwarding the final plat to the City Council for review. 2. Utility Easements shall be dedicated to the public prior to submittal of the final plat to the City Council. 3. The City of Owasso be made beneficiary of the covenants, conditions and restrictions. 4. Article VIII, Section 1 should state that all signage will require the issuance of a sign permit by the office of Community Development. Final Plat - Metro Heights - A request for review of a final plat for Metro Heights containing 52 residential lots on a 15.42 acre tract of land located east of N. Mingo Road and north of E. 106' Street N. and generally described as a portion of the northwest quarter (NW /4) of the southwest quarter (SW /4) of Section 7, Township 21 North, Range 14 East. The final plat was reviewed by the Technical Advisory Committee at the August 30, 2000 regular meeting with the following comments being made: 1. The Owasso Fire Department has requested two (2) additional hydrants to be located at: The northwest corner of Lot 11, Block 1, and The northeast corner of Lot 8, Block 2 2. SWB requested 5' back to back easements between Lots 3 & 4, Block 1 and between Lots 1 & 2, Block 2. 3. Item 11 under the Covenants and Restrictions: delete the reference to Washington County Rural Water District #3 and replace with City of Owasso. Staff recommends approval of the final plat for Metro Heights subject to the following conditions: 1. DEQ permits be issued prior to forwarding the fnud plat to the City Council for review. 2. All TAC comments be addressed prior to forwarding the final plat to City Council 3. Sidewalks be provided along all public rights -of -way including N. Mingo Road 4. Acceleration/deceleration lanes be provided along N. Mingo Road. (Ward 3) Donna presented the item. The Technical Advisory Committee reviewed the site plan at the August 30, 2000 regular meeting and the following comments were recorded: 1. Applicant should maintain 1 1/z % grade on the sanitary sewer. 2. Applicant should determine whether or not any portion of the site lies with the 100 year flood plain. Building finish floor should be 12" above flood elevation. 3. Minimum parking stall to 9' x 20' 5. 35 parking spaces are required for this facility. The above modification have been done and reflects on the site plan presented. Sorrells — City Planner BACKGROUND Richard and Cathy Kramer, owners, have requested a review of a lot split for an unplatted property located at 708 N. Carlsbad. The subject property is located in the "Old Town" area and is zoned RS -3 (Residential Single - Family, High Density). A location map is attached for your information and review. The existing lot is 150' wide with a depth of 144.40'. A plat survey of the existing lot is attached for your information and review. ANALYSIS The plat survey submitted by the applicant does not verify if N. Carlsbad was extended as a public right -of -way. It does appear as if it was, but staff would recommend confirmation be required prior to a building permit being issued. If it was not extended as public right -of -way, an access easement must be executed prior to the issuance of a building permit. The minimum lot width in the RS -3 district is 65'. The applicant proposes dividing the property into two tracts, 70' and 80' wide with 144.40' depth. The existing house lies within what will be, if approved, Tract A. Each lot, as proposed, would be legal and compliant with RS -3 zoning requirements and the Owasso Subdivision Regulations. An exhibit showing the proposed lot split is attached for your information and review. According to the Owasso Subdivision Regulations, sidewalk will be required along the front of the Tract B. The lot split was reviewed by the Technical Advisory Committee at the September 27, 2000 regular meeting and no comments were recorded. RECOMMENDATION Staff recommends approval of OLS -00 -05 with the following condition: 1. Sidewalk be installed along the front of the property, aligned with existing, at the time of construction on Tract B. 2. Verification of N. Sorrells — City Planner CONCEPT OF A PUD The concept behind a Planned Unit Development is to provide a creative alternative to a conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity and flexibility than could be achieved by traditional zoning in the planning and development of large parcels of land. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete coordinated plan of development for a larger parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND Planned Unit Development #21 is 61.24 acres, more or less, all of which is undeveloped. Currently, the property is in the process of being annexed. Upon annexation, the property will be zoned AG (Agriculture). The Planning Commission unanimously recommended approval of the annexation at the August 8, 2000 regular meeting. The subject property is located west of N. 145th E. Avenue and south of E. 116th Street N. (State Hwy. 20). The property is surrounded on the north, east and south by rural residential, undeveloped parcels and on the west by U.S. Highway 169. The applicant is requesting approval of PUD supplemental zoning on the subject tract that would be developed in accordance with a submitted Outline Development Plan and text. The PUD application is accompanied by a zoning application OZ- 00 -10. The plan and text call for the development of 27.87 acres of CS (Shopping Center) located, generally, on the western half of the subject property adjacent to U.S. Highway 169, 14.33 acres of CG (Commercial General) located across the northern boudary of the property along E. 116th Street N. (State Highway 20), 10.14 acres of OM (Office Medium) located along the eastern half of the south property line adjacent to a proposed public right -of -way and immediately south of the commercial fronting E. 116th street N. adjacent to a proposed north -south right -of -way, and 8.91 acres of IM (Industrial Moderate) located within the central interior of the property adjacent to the proposed north -south right -of -way. Staff is proposing a concurrent review of OPUD -21 and OZ- 00 -10. STAFF ANALYSIS The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall determine: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of the surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD Ordinance. a. Permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. Permit flexibility within the development to best utilize the unique physical features of the particular site; c. Provide and preserve meaningful open space; d. Achieve a continuity of function and design within the development. CONSISTENCY WITH COMPREHENSIVE PLAN The 2010 Land Use Master Plan is implemented through the use of the zoning process. Therefore PUD and rezoning requests are obliged to be consistent with Comprehensive Plan or logical reasons should be presented to show that the plan needs to be amended. The Comprehensive Plan designates the subject property to be developed as, primarily, high intensity Commercial/Office with a small portion designated medium intensity Commercial/Office and the remaining portion of the property designated high intensity Corporate Technical. It is staffs opinion this proposed rezoning is in compliance with the Comprehensive Plan except with respect to the IL (Industrial Light). It is, however, staffs opinion that an IL (Industrial Light) designation would not constitute a significant deviation from the Comprehensive Plan and is appropriate within this proposed development. Harmony with Existing and Expected Development Approximately 1/4 mile to the east and 1/2 mile to the north are existing rural residential developments. The remaining surrounding property is undeveloped rural residential/agriculture. This proposed PUD will constitute the first significant development of the area, so is difficult to identify as harmoniuos with existing development. As previously stated, the proposed development conforms with the developmental guidelines established in the Comprehensive Plan. Therefore, it is consistant with expected development trends in the area. The applicant has thoughtfully arranged the land uses with the most intensive along the highway (U.S. 169 and State 20) corridors and the industrial buffered by commercial and office from existing and future users of the adjacent properties. It is staffs opinion that this development would be harmonious with existing and expected development. Legal, Planning and Site Engineering The applicant has identified the terrain of the subject property as "characterized by relatively flat terrain with two minor drainageways" with no on -site floodplain and stable soils which are excellent for development. Although not shown on the Outline Development Plan, detention facilities, either site - specific or common, will be required during subsequent phases of the planning process. During the annexation of the Coffee Creek PUD (formerly Woodridge) and the Tulsa Technology Center site located south of the subject property, the extension of the service road along the east side of the U.S. Highway 169 corridor was proposed. Staff believes the further extension of the service road northward connecting to the conceptually planned service road along State Highway 20 would be logical and sound devlopment practice. Staff recommends the applicant consider this extension of the service road northward. If the applicant choses this option, at the time of platting this road should be shown as a collector road. The Outline Development Plan shows an east -west oriented public right -of way centered along the eastern portion of the southern boundary of the property. The applicant should, at the time of platting, provide staff with a signed, legal agreement with the adjacent property owner stating affirmative agreement of the use of that portion of their property for that purpose. Otherwise, the entire right -of -way should be located within the applicant's property. Staff recommends the applicant consider extending this road westward to the U.S. Highway 169 service road and the road be developed to collector road standards. The north -south oriented public right -of -way, which bisects the property, should be developed as a collector road unless the service road is extended northward. Sidewalks will be required along all public rights -of -way associated with the subject property. Construction of the internal sidewalks would be required as building construction occurs. Construction of the walks along N. 145th E. Avenue and State Highway 20 (E. 116th Street N.) are required at the time of development. The applicant, however, may wish to consider establishing an escrow account for the installation of the sidewalk along State Highway 20 until after the planned improvements to that road. Acceleration/deceleration lanes will be required at the time of platting. The applicant has proposed to name the subject development "Interchange Business Park ". An existing development further south on U.S. Highway 169 is named the same. According to Section 2.3.2.A of the Subdivision Regulations for the City of Owasso, the proposed name of a subdivision should not duplicate or too closely resemble the name of an existing subdivision in Tulsa or Rogers Counties. Therefore, staff recommends that at the time of platting, the applicant select an alternative title for the development. Unified Treatment of the PUD Subject Area The applicant effectively utilitized the site and its existing features and thoughtfully located the various land uses proposed within the PUD. A Property Owner's Association will be established. At the time of platting, detailed covenants and restrictions should be submitted governing the unified design and function of the Planned Unit Development. RECOMMENDATION Staff recommends approval of OPUD -21 and OZ -00 -10 subject to the following conditions: 1. The applicant should consider extension of the U.S. Highway 169 service road northward from the Tulsa Technology Center. 2. The applicant should consider extension of the east -west oriented public right -of -way westward to the U.S. Highway 169 service road and development of this roadway as a collector road. 3. Location of the east -west oriented public right -of -way should be located entirely within the subject property or a legal agreement with the adjacent property owner should be supplied for the location of the road centered along the property line. 4. Sorrells — City Planner BACKGROUND The City of Owasso has received a request by Forest Creek Business Park, L.L.C. for review of a site plan for Forest Creek Business Park P.U.D. The subject property is 6.36 acres, more or less, and is located north of E. 76 Street N. and west of the Owasso Expressway (U.S. Highway 169). A location map is shown on the site plan for your information and review. The property is zoned PUD (Planned Unit Development with CG underlying zoning. ANALYSIS The primary motivation for the applicant to zone the property PUD was to allow for both uniformity and flexibility of design of the site plan. For instance, the applicant has provided for uniform access to parking across the development. Although individual lots may be purchased, all units will have access to all parking. This site plan is consistent with the PUD Outline Development Plan and Text previously approved by the Planning Commission and City Council. Within the Text, the applicant stated Forest Creek Business Park will service small businesses and the intention to provide retail - oriented spaces at the front (east) end of the development while the interior of the development would accommodate "more service related businesses ". Based on this intention and subsequent conversations with the developer, the parking requirement would break down as follows: Building 1 -10 (See attached reduced Site Plan) Parking Required Service and Trades —1 space per 400 s.f. Total: 40,100 s.f. 100 Building 11 (See attached reduced Site Plan) Restaurant -1 space per 150 s.f. Total 5,600 s.f. 37 Building 12 -13 (See attached reduced Site Plan) Retail —1 space per 200 s.f. Total: 11,300 s.f. 57 Total Parking Required: 194 spaces Of the total parking required, six spaces are required to be handicap accessible with one van accessible space. The applicant has provided 185 spaces including four handicap accessible spaces. After review of the site plan, it is staff's opinion that the additional required spaces, both regular and handicap can easily be added to the plan. However, it is staff's opinion that although the handicap space requirement is six, the need for more appropriate distribution would increase the requirement. A minimum of two handicap accessible spaces will be required between buildings 12 and 13, three spaces between buildings 10 and 11, and for each two remaining buildings, one space should be located so as to be convenient to each. In summary, a total of nine additional spaces are required, including at least two additional handicap accessible spaces, with a staff preference for five additional handicap spaces. The applicant has submitted an agreement with the Oklahoma Department of Transportation to utilize a portion of the Owasso Expressway (U.S. Highway 169) right -of -way west of the service road for landscaping. The agreement does not specifically state that the area may be utilized for paved parking. Although, this may be assumed by the applicant and, possibly, ODOT, staff would recommend the language of the agreement reflect the specific agreement to this use. Staff also recommends the requirement of a fully executed copy of this agreement prior to any issuance of building permits. As specified by the Owasso Subdivision Regulations, sidewalks are required along all public rights -of -way. Given the unusual circumstances regarding the use of the adjacent right -of -way for parking, an unconventional approach to the sidewalk issue may be required. Staff recommends the applicant be required to provide continuous pedestrian access across the east side of the property, located along the right -of -way when possible and tying into the walks to located in front of the buildings otherwise. Staff has reviewed and approved the submitted landscape plan. The site plan was reviewed by the Technical Advisory Committee at the September 27, 2000 regular meeting. A copy of the memo noting comments resulting from the meeting are attached for your information and review. RECOMMENDATION Staff recommends approval of the Forest Creek Business Park Site Plan subject to the following conditions: 1. The platted 17.5' utility easement along the rear boundary of the westernmost lots (east side of the floodway) must be maintained. 2. An amended site plan showing nine additional parking spaces, including five additional handicap spaces be submitted prior to issuance of building permits. 3. The applicant should coordinate electrical service with PSO. 4. Dumpster or cart storage, whichever is applicable, should be screened with 6' wood fencing. 5. A fully executed agreement specifying approval by ODOT of the use of the right -of- way as paved, permanent parking be submitted to the City Planner prior to the issuance of any building permit. Sorrells — City Planner The City of Owasso has received a request for review of a site plan for a 15 acre site plan described as Lot 1, Block 1, ROC Owasso II and Lot 7, Block 1, ROC Owasso. The subject property is located south of E. 86`h Street N. and east of N. 129`h E. Avenue. A location map is attached for your information and review. ANALYSIS The Owasso Medical Center is planned to be a multi -phased project. The current submittal utilizes less than half the land area available. With the current submittal, the applicant is proposing a 33,073 square foot building with 35,400 square feet of future expansion shown. The parking requirement for this facility is 1 space per 150 square feet of building floor area. Based on this requirement, the applicant would need to provide 220 parking spaces including 7 handicap accessible spaces. One of the handicap accessible spaces must be van accessible. Total requirements, upon completion of the future phases, will be 456 spaces including 9 handicap accessible spaces. The applicant has provided 238 spaces including 14 handicap accessible spaces. Therefore, the as future construction occurs, the applicant will be required to supply 218 additional spaces. One loading birth is required for this facility at the time of phase one development. The applicant has informed staff that all deliveries will be of the small -box variety and the front door drop off area will act as their loading birth. Drainage will be directed, primarily to the southeast to the existing detention facility. Public works has reviewed and approved the grading and drainage, sedimentation and erosion control, and site - specific utility plans for the subject property. All utilities are available to the site. The refuse service area has been appropriately located and screened. Staff has reviewed and approved the submitted landscape plan. The Technical Advisory Committee reviewed the site plan at the September 27, 2000 regular meeting and comments were recorded. Copies of the TAC memorandum as well as the applicant's written response to those comments are attached for your information and review.
