BACKGROUND
Homes Unlimited, Inc. is requesting review of a proposed closing of a portion of an existing
utility easement within El Rio Vista II located north of E. 96`h Street N. and west of N. Garnett
Road at 10809 E. 96`h Place N. The property is described as Lot 20, Block 5, El Rio Vista H. A
location map is attached for your information and review.
The background on similar requests on this particular property is extensive. A previous request
for a partial closure of this easement was approved by the Planning Commission in September,
1983, and was subsequently denied three times by the City Council.
The TAC evaluation in September, 1983, showed the following:
1. An existing electric line is located 2.5' underneath the house.
2. An existing gas line is located 3' from the building.
ANALYSIS
The residence, built in 1983, on the subject property was constructed over a 17.5' utility
easement along the west property line. Homes Unlimited has requested a partial closure of the
utility easement.
The Technical Advisory Committee reviewed the request at the November 1, 2000 regular
meeting. Both ONG and Owasso Public Works recorded objections to the closure. Both ONG
and OPW agreed to have their respective utilities field located and submit written objection or
approval afterward. Staff also requested PSO submit, in writing, their approval or objection after
field verification. On November 3, 2000 ONG submitted a letter stating a continued objection to
the easement closure, but reversed that objection in a subsequent letter received by staff on
November 9. PSO submitted a letter stating no objection to the easement closure as no electric
mains are located within the easement. OPW field located the existing sewer main inside the
easement and on November 10, submitted a memo stating no objection. SW Bell stated they had
"no comment" regarding the easement closure request. Copies of the responses from the various
utility providers are attached for your information and review.
Obviously there are discrepancies between where utilities within the easement were thought to
be located in 1983, and what has been field verified by the various utility providers recently, but
it is staff's opinion the current opinions are more accurate, since field locations can be verified.
RECOMMENDATION
Staff recommends approval of the closing of the east 8' of the west 17.5' of the south 70' of Lot
20, Block 5, El Rio Vista II.

Homes Unlimited, Inc. would like to request the City of Owasso to commence the
proceedings for the partial closure of one certain easement located on propery currently
owned by Gary and Lisa Gaylord. They recently purchased the property from Smiley L
Freeman. The reason for this request is the house encroaches on the easement. ONG,
PSO and the City of Owasso have already checked their lines and none are beneath the
structure or in the portion we are asking to be closed.

2) a coy of letter from Payne Surveying showing Legal description

The attached surveyed plat shows the location of the sanitary main at the west lot
perimeter. The distance from the west edge of the house to the main is about 8 feet
which is sufficient space for any maintenance required on the main. However, closing
the east 8 feet of the existing 17.5 -foot easement would leave only 9.5 feet for City and
other private utilities.
The sanitary main centerline is approximately 1.7 feet from the property line which (if
the closure be approved) would leave less than 7.5 feet for location and maintenance of
other utilities. Other agencies may have restrictive clearances for other utilities in
proximity to their lines. While Public Works has no objection to a 9.5 -foot easement
with our sanitary line standing alone, we do not believe that this space would be
sufficient with the presence of other utilities.

mentioned lot, PSO has no problem with releasing this easement. We do have a
service to the home located within the easement but language in the Restrictive
Covenants will maintain a 5' easement (2.5' on either side of service cable).
Joe Green, our local engineer has verified this information in the field.

The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on
October 6, 2000 at 8:30 AM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF THE SEPTEMBER 12, 2000
REGULAR MEETING.
Bill Ellison moved to approve the minutes on the September 12, 2000 meeting, subject to
a correction on Item 4. It should read as follows:
The Chair opened the floor for nominations for Secretary. Bill Ellison was
nominated by Charles Willey, with the nomination being seconded by Ray
Haynes. The nominations were declared closed and Bill Ellison was elected
Secretary by acclamation.
Bob Randolph seconded the motion with the above correction. The vote on the motion
was as follows:

Bob Randolph - Yes
Bill Ellison - Yes
Charles Willey - Yes
Larry Helton - Yes
The motion carried 5 -0.
4. OLS -00 -05 - Kramer - A request for review of a lot split for an unplatted residential
property located at 708 N Carlsbad. (Ward 4)
Donna presented the case to the Commissioners and described the property location. The
applicant proposes dividing the property into two tracts, 70' and 80' wide with 144.40'
depth. The existing structure lies within, if approved, Tract A. A sidewalk will be
required along the front of Tract B. The Technical Advisory Committee reviewed the
request at the September 27, 2000 regular meeting and no comments were recorded.
Discussion was held regarding whether a lot split can be approved legally on unplatted

property. Mr. Kramer was present to answer questions or concerns. It was agreed upon,
by the Commissioners, that Mr. Kramer needed to present a final plat request at the
November Planning Commission meeting.
Ray Haynes moved to table the lot split request until a final plat for the property is
approved by the Planning Commission; Charles Willey seconded the motion. The vote on
the motion was as follows:

5. OZ- 00- 10 /OPUD -12 - Pittman Poe & Associates - A request for rezoning of a 61.24
acre parcel of land located west of N. 145s' E Ave and south of E. 116' Street N. (State
Highway 20). The property is generally described as a portion of the northeast quarter
(NE /4) of Section 9, Township 21 North, Range 14 East. Proposed is a rezoning from
AG (Agriculture) to PUD (Planned Unit Development) with an underlying zoning of CS/
(Shopping Center), CG (Commercial General), IL (Industrial Light) and OM (Office
Medium). (Ward 1)
Donna presented the case and described the property. She explained that the plan calls
for 27.87 acres of CS (Commercial Shopping), 14.33 acres of CG (Commercial General),
10.14 acres of OM (Office Medium) and 8.91 acres of IL (Industrial Light). Staff feels
this proposal is in compliance with the Comprehensive Plan except for the IL zoning.
Sidewalks will be required along all public rights -of -way associated with the subject
property. The applicant may wish to consider establishing an escrow account for the
installation of the sidewalk along Highway 20 until after improvements are done. An
existing development with the same name (Interchange Business Park) is located further
south on Highway 169. At the time of platting the applicant needs to select an alternative
title. Staff recommends approval of OPUD -21 and OZ -00 -10 subject to the following
conditions:
1. The applicant should consider extension of the U.S. Highway 169 service road
northward from the Tulsa Technology Center.
2. The applicant should consider extension of the east -west oriented public right -of-
way westward to the U.S. Highway 169 service road and development of this
roadway as a collector road.
3. Location of the east -west oriented public right -of -way should be located entirely
within the subject property or a legal agreement with the adjacent property owner
should be supplied for the location of the road centered along the property lines.

4. The following items should be addressed at the time of platting:
a) A north -south right -of -way should be developed as a collector.
b) Sidewalks along right -of -way
c) Acceleration/deceleration lanes along State Hwy. 20 and N. 145 E
Ave.
d) Renaming of development
e) Detailed covenants and restrictions governing the unified design and
function of the PUD.
Charles Willey moved to approve OPUD -21 and OZ -00 -10 subject to the above
conditions being met, Larry Helton seconded the motion. The vote on the motion was as
follows:

6. OZ -00 -12 - A & W Land Development - A request for rezoning of a 17.65 acre parcel
of land located north of E. 116'" Street N. and west of N. Garnett Road. The property
is generally described as a portion of the southeast quarter (SE /4) of the northeast
quarter (NE /4) of Section 6, Township 21 North, Range 14 East. Proposed is a
rezoning from AG (Agriculture) to RS -3 (Residential Single - Family, High - Density).
(Ward 1)
Donna presented the item to the Commissions and described the location. Notices were
mailed to surrounding property owners and legal advertisement was published. Calls
were received from a couple of property owners, wanting confirmation that this request is
the extension of the existing development. One call expressed concern with drainage in
the area. Discussion was held regarding drainage problems in the area. Donna stated
that these drainage issues need to be resolved prior to construction of Phase V.
Staff recommends approval of OZ -00 -12 subject to the following conditions:
1. Development impact issues related to all areas of Country Estates be
addressed at the time of platting of Phase V.
Ray Haynes moved to approve the rezoning subject to the above TAC and Staff
recommendations, Larry Helton seconded the motion. Mr. Haynes revised the motion by
adding, that drainage problems and acceptance of streets within all previous phases of
Country Estates be resolved to the satisfaction of Public Works and the Community

Development Department prior to Planning Commission approval of the final plat for
Country Estates V. The vote on the motion was as follows:

7. Site Plan - Forest Creek Business Park - A request for review of a site plan for Forest
Creek Business Park P.U.D. The subject property contains 6.36 acres and is located
north of E. 76' Street N. and west of U.S. Highway 169 (Owasso Expressway). (Ward
4)
Donna presented the item and described the location of the property. The site plan is
consistent with the PUD Outline Development Plan and Text previously approved.
Parking requirements were discussed with the applicant providing 185 spaces including
four handicap accessible spaces. Donna stated that it was staffs opinion that nine
additional spaces (5 handicap) will need to be shown on an amended site plan. An
agreement with ODOT has been submitted in order to utilize a portion of the Owasso
Expressway right -of -way for landscaping. The Technical Advisory Committee reviewed
the site plan on September 27, 2000. The applicant, Mr. John Roop, was present to
address any concerns.
Staff recommends approval of the Forest Creek Business Park site plan subject to the
following conditions:
1. The platted 17.5' utility easement along the rear boundary of the
westernmost lots (east side of the floodway) must be maintained.
2. An amended site plan showing nine additional parking spaces, including
five additional handicap spaces be submitted prior to issuance of building
permits.
3. The applicant should coordinate electrical service with PSO.
4. Dumpster or cart storage, whichever is applicable, should be screened with
6' wood fencing.
5. A fully executed agreement specifying approval by ODOT of the use of
the right -of -way as paved, permanent parking be submitted to the City
Planner prior to the issuance of any building permit.

8. Site Plan — Owasso Medical Center — A request for review of a site plan for the Owasso
Medical Center located south of E. 86' Street N. and east of N. 1291 E. Avenue. The
subject property contains 15 acres and is described Lot 1, Block 1, ROC Owasso H and
Lot 7, Block 1, ROC Owasso.
Donna presented the item. She explained that this submittal utilizes less than half of the
land area available. A building of 33,073 square feet is proposed with 35,400 square feet
of future phases. Drainage will be directed to the southeast to an existing detention facility
and all utilities are available to the site. The Technical Advisory Committee reviewed the
site plan at the September 27, 200 meeting. Mr. Michal Biery with Davies Architects was
present to answer any questions from the Commissioners. Staff recommends approval of
the site plan.

Donna presented the case to the Commissioners. At the time of final plat approval, all
parties agreed that the development would occur under a blanket easement over the entire
development. The Technical Advisory Committee reviewed the easement plat and only
one comment was recorded. Additional easements might be required due to differing
design standards between PSO and Verdigris Valley electric companies. Staff recommends
— approval of the easement plat for the Greens at Owasso.

BACKGROUND
The Greens at Owasso, a Limited Partnership, is requesting a review of a lot split for The Greens
at Owasso located south of E. 86t11 Street N. between N. 145`h and N. 129`h E. Avenues. A
location map is attached for your information and review.
The subject property is zoned PUD (Planned Unit Development) with RM -1 (Residential Multi -
Family, Low Density) and OM (Office Medium) underlying zoning. The requested lot split
would create two lots from Lot 2, Block 1, The Greens at Owasso and Owasso Golf and Athletic
Club.
ANALYSIS
The applicant is requesting this lot split for financing purposes only. Review of the approved
site plan shows no conflict with this request. Discussions with the applicant reveal a desire to
construct the buildings located on what would be Lot 2A first, and those on Lot 2B as a future
phase.
The request was reviewed by the Technical Advisory Committee at the November 1, 2000
regular meeting. The Owasso Fire Department recommended a temporary paved tam- around
with a minimum 75' radius be required at the east end of the primary drive through apartment
complex to allow for emergency vehicle circulation.
RECOMMENDATION
Staff recommends approval of OLS -00 -06 subject to the following condition:
1. A temporary paved turn- around with a minimum 75' radius be required at the east
end of the primary drive.
