OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Tuesday, November 14, 2000 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Charles Willey Bob Randolph Bill Ellison Larry Helton MEMBERS ABSENT STAFF PRESENT Donna Sorrells Stan Ewing Marsha Hensley The agenda for the regular meeting was posted in the Owasso City Hall, 207 S Cedar, on November 7, 2000 at 1:30 PM. 1. CALL TO ORDER — Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE OCTOBER 10, 2000 REGULAR MEETING. Charles Willey moved to approve the minutes of the October 10, 2000 meeting, Larry Helton seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Bill Ellison — Yes Charles Willey - Yes Larry Helton — Yes The motion carried 5 -0. Ray Haynes stated that the rezoning request (OZ- 00 -11) for the Caudle property has been withdrawn. 4. OLS -00 -06 — The Greens at Owasso — A request for review of a lot split for The Greens at Owasso located south of E. 86h Street N. between N. 145' & N. 129' E Ave. Donna presented the case to the Commissioners and described the property location. She stated that the subject property is zoned PUD (Planned Unit Development) with RM -1 (Residential Multi Family, Low Density) and OM (Office Medium) underlying zoning. This request would create two lots from Lot 2, Block 1. The Technical Advisory Committee reviewed the lot -split request at the November 1, 2000 meeting. At that meeting the Owasso Fire Department recommended a temporary paved turn- around with a minimum 75' radius at the east end of the primary drive. The lot -split request is for financing purposes only. Mr. Kim Fugitt with Lindsey Management was present to answer questions. There was a short discussion regarding the vicinity map, questioning which lots will be developed first and which will be held for a future phase. OWASSO PLANNING COMMISSION November 14, 2000 Page No. 2 .Staff recommends approval of OLS -00 -06 subject to the following conditions: 1. A temporary paved turn- around with a minimum 75' radius be required at the east end of the primary drive. Ray Haynes moved to approve the lot split request subject to the above staff recommendation; Bob Randolph seconded the motion. The vote on the motion was as follows: Ray Haynes - Yes Bob Randolph - Yes Bill Ellison - Yes Charles Willey - Yes Larry Helton - Yes The motion carried 5 -0. 5. Easement Closure - Homes Unlimited - A request for review of the partial closing of a 17.5' Utility easement along the west property line of Lot 20, Block 5, El Rio Vista H, located 10809 E 96' Place North. Donna presented the case and described the property. She presented the background on the property. In 1983, there was a request for a partial closure of this easement. The Planning Commission approved but the City Council denied the closure. The Technical Advisory Committee reviewed the request on November 1, 2000. Oklahoma Natural Gas and Owasso Public Works had objections to the closure. A request to PSO to submit in writing their approval or objection after their validation. ONG submitted a letter objecting to the easement closure on November 3, 2000, but reversed that objection with a letter staff received on November 9, 2000. Owasso Public Works also reversed their objection with a letter on November 10, 2000 and Southwestern Bell had no comments. Staff recommends approval of the closing of the east 8' of the west 17.5' of the south 70' of Lot 20, Block 5, El Rio Vista 11. Ray Haynes moved to approve the easement closure, subject to the utility companies having no objections to the release. Also approval is subject to the utility company employee, who signed the letters, having the authority to do so. Larry Helton seconded the motion. Garnett Road. The subject property is generally described as a portion of the S/2 of the NEA of Section 61 Township 21N, Range 14E. A location map is shown on the plat for your convenience. The subject property is zoned RS -3 (Residential Single - Family, High Density). ANALYSIS A portion of the subject property was recently annexed into the City of Owasso and was subsequently rezoned to RS -3. The Planning Commission approved the rezoning subject to the condition that storm drainage and streets within all previous phases of Country Estates be accepted by Public Works and City Council prior to Planning Commission approval of the Final Plat for Country Estates V. The applicant should coordinate with Public Works to accommodate this condition of approval. The Technical Advisory Committee reviewed the preliminary plat at the November 29, 2000 regular meeting. Sorrells — City Planner BACKGROUND The City of Owasso has received a request for review of a site plan for a 1.18 acre site plan described as a portion of Lot 1, Block 1, Owasso Market. The subject property is located north of E. 96`h Street N. and west of N. 129th E. Avenue. A location map is shown on the site plan for your convenience. ANALYSIS Chili's Grill & Bar will be located in the Owasso Market adjacent to E. 96`h Street N. in front of the shopping center portion of the Market between Kohl's and Wal -Mart. The applicant has proposed a 4081 square foot restaurant building. The parking requirement for this facility is 1 space per 150 square feet of building area. Based on this requirement, the applicant would need to provide 28 parking spaces, including 2 handicap accessible spaces. One of the handicap spaces must be van accessible. The applicant has provided 90 parking spaces, including 5 handicap accessible spaces of which 2 are van accessible. One loading birth is required and has been provided for this facility. Drainage is directed to the southeast to the existing swale within the U.S. Highway 169 right -of- way. All utilities are available to the site. Refuse collection is located at the northeast (rear) area of the building and is associated with the loading/service area of the restaurant. Community Development - Show adjacent parking /circulation. 2. Community Development - Construction may be initiated given the submission of a letter acknowledging 1) the owners and contractor's explicit understanding of the risk of proceeding prior to site plan approval; and 2) an acceptable scope of work to be allowed prior to site plan approval - also to be acknowledged by City of Owasso. 3.
