Preliminary Plat - Betty Smith Business Park - A request for a review of the preliminary plat for Betty Smith Business Park, an addition to the City of Owasso. The subject property is described as a part of the NW/4 of Section 20, Township 21 North, Range 14 East, Tulsa County, Oklahoma, and contains 1 lot on 15.70 acres, more or less. The subject property is located south of E. 96th Street North, west of the Owasso Expressway. 5. OLS -96 -01 - John Williams - A request for a review of a lot split described as Lot 3 and the east 150 feet of Lot 2, Block 2, Ram Plaza Addition. Ram Plaza is located at the northwest corner of E. 86th Street North and N. 129th East Avenue. 6. Site Plan - Sterling House Corporation - A request for the review of a site plan for an Elderly Assisted Living Facility to be located on Lot 3 and the east 150 feet of Lot 2, block 2, Ram Plaza Addition. the subject property is located west of N. 129th East Avenue, immediately south of the Owasso Ninth Grade Center. 7. Adjournment MEMORANDUM TO: THE OWASSO PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY' COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: PRELIMINARY PLAT - BETTY SMITH BUSINESS PARK DATE: March 12, 1996 BACKGROUND The City of Owasso has received a request to review a preliminary plat for Betty Smith Business Park. The subject property is located in a portion of the NW 14 of-Section 20, Township 21 North, Range 14 East, Tulsa County and consists of 1 lot totalling 15.70 acres, more or less. The applicants are the Owasso Economic Development Authority. The subject property is currently zoned Planned Unit Development, of which this portion is designated for Commercial development. The end use of the subject property will be an office and vehicle fleet storage facility for Oklahoma Natural Gas and is estimated to employ approximately 30 people. While the proposed use is not commercial (the use would be classified in the Owasso Zoning Code as Office), it is within the guidelines of the PUD. The preliminary plat was reviewed by the Technical Advisory Committee at their regular meeting on February 28, 1996. At that meeting, the utility companies requested a 17:5 perimeter utility easement be added to the entire perimeter of the subject property. In addition, PSO stated that an easement has been recorded by separate instrument along the northern boundary of the plat and should be shown. The engineer for the project, Jeff Tuttle, also advised that the building line south of the drainage easement may possibly shift northward slightly depending upon final drainage reports. Please note that the 75' building line shown on the west boundary of the plat is in compliance with the landscape buffer condition of the PUD. Staff's has two comments regarding the preliminary plat. The first is the requirement for acceleration/deceleration lanes at the entrance of the subject property. These lanes will be required as a portion of the street construction and will not be permitted to be deviated in any manner. The second is the inclusion of the city landscape covenant within the covenants of the addition. The covenants, as well as the city landscape covenant, are attached for your information and review. It should be noted that the overland drainage easement shown on the plat encompasses the area of the pond. This portion of the PUD does not contain the large pond that causes the "jog" in E. 96th Street North, but rather the smaller pond to the east. It is both the applicant and ONG's intention to utilize the pond for both detention purposes and as a focal point of the site plan. The pond will require some form of drainage structure at the northwest portion of the pond, however the goal is to leave the pond in as much a natural state as possible, Final plat action will still be required for this property, as well as completed and approved construction plans prior to City Council approval. If approved, it is likely you will see the final plat, as well as the site plan for the ONG facility at the April Planning Commission meeting. RECOMMNDATION Staff is recommending Planning Commission approval of the preliminary plat for Betty Smith Business Park with the changes noted by the Technical Advisory Committee and staff. If it is determined by the municipality that any trees or shrubbery located within said easements or rights -of -way are damaging or endangering utilities in said easements or rights -. of -way, the city shall have the right to remove said trees or shrubbery upon five (5) days notice thereof at the lot owner's expense, or within such time the lot owner may remove same. MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: OLS -96 -01 AND SITE PLAN STERLING HOUSE CORPORATION ELDERLY LIVING FACILITY DATE: March 7, 1996 BACKGROUND Sterling House Corporation Elderly Living Facility is requesting a lot split of a subdivided parcel of land located within the Ram Plaza Addition, just south of the Owasso Ninth Grade Center. The complete legal description of the subject property, and those of the tracts that would be created, is enclosed within your packet for your information and review. In addition to the lot split request, the applicant is also requesting a review of a site plan. Because the two are successive items on the agenda, staff has reviewed both requests in one memorandum. The lot split request was reviewed by the Technical Advisory Committee at their February 28, 1996 regular meeting. At that meeting, the only comment by staff and the utility companies was a request for a 15' utility easement along the eventual west property line of the entire lot to be created. No other comments or concerns were noted by the utility company. Staff's only comment centered around the western access drive to the subject property. Notes from the Ram Plaza PUD file (1992) indicate that one of the positives about this development was the restriction on the amount of curb cuts by use of "shared" access points. If the access point was to be left at its current position on your site plan, staff was concerned that two additional curb cuts would exist on the lot immediately to the west, and two more on the lot further to the west, leaving us with six curb cuts. The original plat contained two shared access points (See Ram Plaza plat attached for your review). While the PUD is certainly a "conceptual" development plan, staff still feels it is important to limit the amount of access points to the subject property. An alternative access drive for the westerly access point was developed and is attached for your information and review. The alternative access would allow for joint utilization between the assisted living facility and the eventual user to the west. In order to allow for this to occur, the applicant must process a plat amendment, changing the "limits of no access" as they appear on the plat. The applicant is aware that this will be necessary should the Planning Commission approve the site plan and would begin that process prior to project completion. Both lots to be created meet the requirements of the Subdivision Regulations and the Owasso Zoning Code for both lot split procedures and size of lot for the zoning district in which it is located (PUD, underlying zoning of CS). RECOMMENDATION Staff recommends approval of both OLS -96 -01 and the site plan for Sterling House Corporation's Elderly Living Facility with the following conditions: 1. That the site plan submitted be amended to include the alternate access drive as shown in Option 2. 2. That the applicant proceed with a plat amendment changing the "limits of no access" as shown on the original Ram Plaza. plat. ATTACHMENTS/ENCLOSURES 1. DATE: March 7, 1996 BACKGROUND: The City of Owasso has received a request from PB Homes, Inc., for the closing of the westerly I .foot of the eastern 1 F utility easement located on Lot 7, Block 2, Double Oaks III Addition. A reduced copy of the Double Oaks III subdivision plat is attached for your information and review, as well as the site plan for the dwelling that has been constructed on the subject property. The request for easement closing was sent to the Owasso Technical Advisory Committee via facsimile on March 5, 1996. The utility companies have responded that they have no objections to the request as they have no utilities located within that portion of the easement. There are no plans for additional utilities to be located within that portion of the easement All side yard setbacks have been met by the applicant and the structure is in compliance with the property development standards of an RS -3 (Residential Single -Family High Density) zoning district. RECOMMENDATION: Staff recommends approval of the easement closing request, closing the westerly F of the eastern I V utility easement located on Lot 7, Block 2, Double Oaks III Addition. The home constructed on this lot is encroacking approximately 5 to 6 inches into this easement. No utilities are located within this portion of the easement and all property development setbacks are curently, and would continue to be, in compliance with the City of Owasso. The subject property is located on Garnett Road, directly west of the Owasso Fire Station and currently contains Joe's Print Shop, Ator Animal Hospital, Jazzercize, etc. I have scheduled this meeting for Thursday. March 7. 1996 at 5.30 PM in the Community Development Conference Room. All items regarding this request will be presented to you at that time.
