Final Plat - Betty Smith Business Park - A request for a review of the final plat for Betty
Smith Business Park, an addition to the City of Owasso. The subject property is
described as a part of the NW /4 of Section 20, Township 21 North, Range 14 East,
Tulsa County, Oklahoma, and contains 1 lot on 15.70 acres, more or less. The subject
property is located south of E. 96th Street North, west of the Owasso Expressway.
5. Final Plat - Hidden View Addition - A request for a review of the final plat for Hidden
View Addition, an addition to the City of Owasso. The subject property is located at the
southeast corner of Fifth and Carlsbad and contains 10 residential lots on 1.94 acres,
more or less.
6. Site Plan Review - Mingo valley Shopping g enter - A request for a review of a site plan
for Mingo Valley Shopping Center. The Subject site is located on a portion of Tract D,

CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 13, 1996 REGULAR
MEETING AND THE MARCH 7, 1996 SPECIAL MEETING - The Commission
reviewed the minutes of February 13, 1996, Jerry Cole moved, seconded by Gary Wells
to approve the minutes as written.

4. Preliminary Plat - Betty Smith Business Park - A request for a review of the preliminary
plat for Betty Smith Business Park, an addtion to the City of Owasso. The subject
property is described as a part of the NW /4 of Section 20, Township 21 North, Range
14 East, Tulsa County, Oklahoma, and contains 1 lot on 15.70 acres, more or less. The
subject property is located south of E. 96th Street North, west of the Owasso
Expressway.
The Chair introduced the case and staff review was given by Mr. Rooney. The
preliminary plat was review by the Technical Advisory Committee at their meeting on
February 28, 1996. The utility companies requested a 17.5 perimeter utility easement
be added. Also, PSC stated that an easement has been recorded by separate instrument
along the northern boundary of the plat and should be shown. Mr. Tuttle, the engineer

for the project, advised that the building line south of drainage easement may shift
northward slightly. Staff requires acceleration/deceleration lanes at the entrance and
inclusion of the city landscape covenant within the convenants of the addition.
Mr. Willey stated concerns with infra- structure on 96th Street. Mr. Haynes confirmed
that City Council will be reviewing this item for approval.
Gary Wells moved to approve the preliminary plat for the Betty Smith Business Park,
also to inform City Council of the concerns to the infra- structure of 96th Street, seconded
by Charles Willey.

5. OLS -96 -01 - John Williams - A request for a review of a lot split described as Lot And
the east 150 feet of Lot 2, Block 2, Ram Plaza Addition. Ram Plaza is located at the
northwest corner of E. 86th Street North and N. 129th East Avenue.
The Chair introduced the case and staff review was given by W. Rooney. The lot split
was reviewed by the Technical Advisory Committee on February 28, 1996. The only
comment by staff and the utility companies was a request for a 15' utility easement along
the eventual west property line of the entire lot to be created.

6. Site Plan - Sterling House Corporation - A request for the review of a site plan for an
Elderly Assisted Living Facility to be located on Lot 3 and the east 150 feet of Lot 2,
Block 2, Ram Plaza Addition. The subject property is located west of N. 129th Eat

Avenue, immediately south of the Owasso Ninth Grade Center.
Mr. Haynes introduced the case. and staff review was given by Mr. Rooney. The staff
has concerns that two additional curb cuts would exist on the lot immediately to the
west,and two more on the lot further to the west, leaving us with six curb cuts. Mr.
Rooney feels it is important to limit the amount of access points to the subject property.
An alternative access drive for the westerly access point was developed and would allow
for joint utilization between the assisted living facility and the eventual user to the west.
Jerry Cole moved to approve the site plan with the following conditions:
1. That the site plan submitted be amended to include the alternate access
drive as shown in Option 2.
2. That the applicant proceed with a plat amendment changing the "limits of
no access" as shown on the original Ram Plaza plat.

7. _ Easement Closing - PB Homes. Inc. - A request to close the western most 1 foot of the
eastern I F utility easement located on Lot 7, Block 2, Double Oaks III Addition. The
subject property is located at 7902 N. 126th East Avenue.
The Chair introduced the case and the staff report was given by Mr. Rooney. The
request for easement closing was sent to the Owasso Technical Advisory Committee on
March 5, 1996. The utility companies have responded that they have no objections to
the request as they have no utilities located within that portion of the.easement. Staff
recomments approval of the easement closing request.
Ray Haynes moved to approve the easement closing request with the recommendation for
the applicant to bring a foundation survey to the City Council meeting, seconded by Gary
Wells.

Mr. Haynes introduced the item. Mr. Rooney recommended this item to be tabled.

Mr. Rooney reported on Hidden View Subdivision, stating that it was approved by the
Board of Adjustment.
11. Discussion of Development In and Near Owasso
Mr. Rooney stated possible opening for Warehouse Market to be May 1, 1996. Ribbon
cutting ceremony for National Steak and Poultry is set for April 25, 1996.

SUBJECT: FINAL PLAT - BETTY SMITH BUSINESS PARK
DATE: April 5, 1996
BACKGROUND
The City of Owasso has received a request to review a final plat for Betty Smith Business Park.
The subject property is located in a portion of the NW/4 of Section 20, Township 21 North,
Range 14 East, Tulsa County and consists of 1 lot totalling 15.70 acres, more or less. The
applicants are the Owasso Economic Development Authority.
The subject property is currently zoned Planned Unit Development, of which this portion is
designated for Commercial development. The end use of the subject property will be an office
and vehicle fleet storage facility for Oklahoma Natural Gas and is estimated to employ
approximately 30 people. While the proposed use is not commercial (the use would be classified
in the Owasso Zoning Code as Office), it is within the guidelines of the PUD.
The preliminary plat was reviewed by the Planning Commission and approved at the March 12,
1996 regular meeting with the conditions that the Technical Advisory Committee's
recommendations be met by the applicant and that a notice also be attached when the plat
reached the City Council level regarding the E. 96th Street North condition.
The final plat was reviewed by the Technical Advisory Committee at their regular meeting on
March 27, 1996. At that meeting, the engineer discussed the building line around the south side
of the pond on the property. As discussed in the memorandum presented to the Owasso
Planning Commission for preliminary plat review, there was a possibility that this building line
would shift slightly (see attached preliminary plat memorandum). As the enclosed final plat
reflects, that line has shifted to encompass both the low areas around the pond and the rather
steep drop off as you approach the pond from the south. No comments and /or corrections were
suggested by the utility companies attending the meeting.
In review, I feel it is important to reiterate those comments mentioned by staff at the preliminary
plat review. The first is the requirement for acceleration /deceleration lanes at the entrance of
the subject property. These lanes will be required as a portion of the street construction and will
not be permitted to be deviated in any manner. JThe second is the inclusion of the city landscape
covenant within the covenants of the addition. The covenants, as well as the city landscape
covenant, are enclosed /attached for your information and review.
Construction plans have been submitted by the applicant. A copy of a memorandum from Doug
Groves of the Engineering Division has been attached for your information and review
acknowledging their submittal. Permits must be issued by the State Health Department for the
construction of the sanitary sewer and water lines prior to this item being placed on the Owasso
City Council agenda for action.
RECOAMENDATION
Staff is recommending Planning Commission approval of the final plat for Betty Smith Business
Park with the noted staff comments.

SUBJECT: PRELIMINARY PLAT - BETTY SMITH BUSINESS PARK
DATE: March 12, 1996
BACKGROUND
The City of Owasso has received a request to review a preliminary plat for Betty Smith Business
Park. The subject property is located in a portion of the NW /4 of Section 20, Township 21
North, Range 14 East, Tulsa County and consists of 1 lot totalling 15.70 acres, more or less.
The applicants are the Owasso Economic Development Authority.
The subject property is currently zoned Planned Unit Development, of which this portion is
designated for Commercial development. The end use of the subject property will be an office

PSO stated that an easement has been recorded by separate instrument along the northern
boundary of the plat and should be shown. The engineer for the project, Jeff Tuttle, also
advised that the building line south of the drainage easement may possibly shift northward
slightly depending upon final drainage reports. Please note that the 75' building line shown on
the west boundary of the plat is in compliance with the landscape buffer condition of the PUD.
Staff's has two comments regarding the preliminary plat. The first is the requirement for
acceleration/deceleration lanes at the entrance of the subject property. These lanes will be
required as a portion of the street construction and will not be permitted to be deviated in any
manner. The second is the inclusion of the city landscape covenant within the covenants of the
addition. The covenants, as well as the city landscape covenant, are attached for your
information and review.
It should be noted that the overland drainage easement shown on the plat encompasses the area
of the pond. This portion of the PUD does not contain the large pond that causes the "jog" in
E. 96th Street North, but rather the smaller pond to the east. It is both the applicant and ONG's
intention to utilize the pond for both detention purposes and as a focal point of the site plan.
The pond will require some form of drainage structure at the northwest portion of the pond,
however the goal is to leave the pond in as much a natural state as possible.
Final plat action will still be required for this property, as well as completed and approved
construction plans prior to City Council approval. If approved, it is likely you will see the final
plat, as well as the site plan for the ONG facility at the April Planning Commission meeting.
RECOMMEDATION
Staff is recommending Planning Commission approval of the preliminary plat for Betty Smith
Business Park with the changes noted by the Technical Advisory Committee and staff.

Landscaping
No lot owner shall plant any tress br shrubbery in dedicated utility easements or
rights -of -way which would potentially-endanger, threaten, or harm any utilities, located within,
said easements or rights -of -way.
If it is determined by the municipality that any trees or shrubbery located within said
easements or rights -of -way are damaging or endangering utilities in said easements or rights-
of-way, the city shall have the right to remove said trees or shrubbery upon five (5) days
notice thereof at the lot owner's expense, or within such time the lot owner may remove
same.

SUBJECT: FINAL PLAT - HIDDEN VIEW ADDITION
DATE: April 4, 1996
The City of Owasso has received a request to review a final plat from A & W Development for
their proposed development titled Hidden View Addition. Hidden View is located at the
southeast corner of W. 5th Street and Beaumont and is a resubdivision of Lot 1, Block 1, hale
Addition. The subject plat, if approved, would contain 10 lots on 1.94 acres, more or less. The
Owasso Planning Commission reviewed the preliminary plat for Hidden View Addition at the
February 13, 1996 regular meeting and unanimously recommended approval.
The Technical Advisory Committee reviewed the final plat at their March 27, 1996 meeting.
At that meeting, no comments and /or recommendations were made by the utility companies.
The final plat contains all of the recommendations made by staff during the preliminary plat
review with the exception of including all of the platted property in the square mile section
within the location map. This oversight is minor, and will be included on the filed copy.
As you may recall from the preliminary plat review, the most significant of the staff comments
was regarding the need for Variance from the Board of Adjustment. The applicant applied for
a variance of the Owasso Zoning Code, Chapter 4, Section 430 in order to allow for 60' wide
single family residential lots in an RS -3 district. The Board of Adjustment acted on this request
at their February 27, 1996 regular meeting and unanimously recommended approval. A copy
of the minutes from that meeting are attached for your information and review.
Again, as has become policy regarding the review of final plats, for to Council action on the
final plat, all construction plans must be reviewed and approved by the Engineering Division of
Public Works and Oklahoma State health Department.
As stated at the time of preliminary plat review, rarely has the Planning Commission had the
opportunity to review "infill" development within an older portion of the community. Staff
opinion is that this development eliminates a vacant corner within the community and would
benefit this neighborhood through the new homes that would be constructed.
RECOMMENDATION
Staff is recommending Planning Commission approval of the final plat for Hidden View
Addition.

BOARD OF ADJUSTMENT PUBLIC HEARING
3. OBOA-96-02 - A & W Development - A request for a Variance of the Owasso Zoning
Code, Chapter 4, Section 430, Bulk and Area Requirements in Residential Districts, to
allow for 60' wide residential lots in an RS -3 (Residential Single - Family High Density)
zoning district. The subject property is located at the S/E corner of Carlsbad and Fifth
Street, Owasso, OK.
Mr. Rooney presented the staff report. He stated the applicants are requesting a
Variance to allow for the development of single - family residential lots at a width of 60
feet on RS -3 zoned property. The subject property is described as a portion of Lot 1,
Block 1, Hale Addition, City of Owasso, OK.
Several surrounding property owners were present. Mr. James McDonough (307 West
4th) had concerns with the traffic and drainage in that area. Mr. Rooney explained to
Mr. McDonough that ten single family dwellings normally do not generate a lot of
traffic. Mr. Rooney also stated we could possibly look at placing a stop sign in that
area. Regarding the drainage problem Mr. Rooney assured the property owners that the
plat will be reviewed by the Planning Commission and also approved by the Engineering
Department of Owasso Public Works Authority.

Ms. Houdyshell motioned to approve the Variance request. The motion was seconded
by Mr. Whitaker.

4. OBOA-96-03 - Carolyn A. Sherwood - A request for a Variance of the Owasso Zoning
Code, Chapter 4, Section 430, Bulk and Area Requirements in Residential Districts, to
allow for a residential home addition to encroach into a rear yard setback and a rear
utility easement in an RS-3 (Residential Single - Family High Density) zoning district.
The subject property is located at 411 E 20th Court, further described as Lot 27, Block
2, Ator Heights Addition, City of Owasso, Owasso, OK.
Mr. Rooney presented the staff report. He stated the applicant is requesting a Variance
in order to allow for the construction of an addition to her single - family dwelling. The
addition proposed would encroach into a rear yard utility easement and the RS -3 rear
yard setback requirements. Single- family lots developed in an RS -3 zoning district are
required to have a minimum rear yard setback of 20 feet. Many residential properties
contain rear utility easements, such as water, sewer, electric, gas, telephone, and cable.
This request for a Variance was forwarded to area utility companies in order to provide
them with an opportunity to locate their utility lines. Oklahoma Natural Gas commented
that they had a gas line servicing dwellings on both sides of the easement. Owasso
Public Works Authority commented that they had a sewer line located within the
easement.
Because of the above two utility concerns, staff cannot recommend any encroachment
into the utility easement.
Ms. Houdyshell moved to approve the variance request to encroach into the required rear
yard setback, however no encroachment into the utility easement. Seconded by Mr.
Whitaker.

5. OBOA-96-04 - Jeff Scott - A request for a Special Exception of the Owasso Zoning
Code, Chapter 6, Section 610, Uses Permitted in Commercial Districts, to allow for a
used dealership in a CS (Commercial Shopping Center) zoning district. The subject
property is located immediately north of Mazzio's restaurant, further described as a
portion of Lot 1, Block 20, Elm Creek Estates First Addition, City of Owasso, OK.

Mr. Rooney presented the staff report. The Staff recommends approval of the Special
Exception request to allow for the development and use of a used automobile sales
business in a CS district with the following four (4) conditions:
1. A detailed drainage report with on -site detention be submitted to, and approved
by, the Engineering Division of the Owasso Public Works Department prior to
the issuance of the building permit.
2. Five parking spaces (one designated for handicapped parking) be designed on the
site.
3. A landscaping plan be submitted with the building permit application and
approved by the Community Development Director priot to the issuance of the
building permit.
4. Free - standing pole signage shall be limited to 30 feet in height and 150 square
feet in surface display area.
Mr. Whitaker moved to approve the request for a Special Exception providing the four
conditions were met as discussed. Mr. Vines seconded the motion.

86th Street North and the Owasso Expressway. A location map is enclosed for your information
and review.
To assist in orienting you as you review this site plan, the Drug Mart building is located
immediately south of the proposed building. This building can be constructed at a zero lot line
(as is indicated on the enclosed site plan) providing it meets certain BOCA and Fire Code
requirements. Building plans have been received for the structure and it will be entirely
sprinkled.
The first entry into the parking lot is directly opposite the southern travel lane across the
Walmart parking lot. For example, if you travel between RCB Bank and Sonic and come to the
stop sign at the southern end of the Walmart parking lot and turn right (now heading east) and
continue to drive east, you would arrive directly at this point of entry into this parking lot. Staff
is recommending that a stop sign be installed as you exit the subject property's parking lot at
this location and the one to the north.
The Technical Advisory Committee reviewed the site plan at their March 27, 1996 regular
meeting. Comments from utility companies and city personnel were as follows:
1. Add an additional 6.5' to the existing 11' utility easement that runs
north /south behind the proposed structure.
2. Stop signs be added at both exits from the parking lots.
3. That a fire hydrant be added within the parking lot island that is proposed to
contain a sign (see site plan).
The applicant has met all parking requirements as 171 parking spaces are required by the Zoning
Code and 178 are being provided. Six handicapped parking spaces are required and have been
indicated as well. The site plan indicates 23 parking spaces to the rear of the facility, primarily
for employee parking. Curb cuts from the main access drive have been limited to one, and this
singular access point is aligned with existing traffic patterns in the area.
Stormwater run -off will flow to underground storm sewer locations within the parking lot with
the exception of the rear of the building. That portion will flow to a recessed area located on
the southern boundary of the site plan in the rear of the building and then be piped underground
to the west. The recessed basin will also involve a small amount of detention in order to avoid
adversely effecting the capacity of the existing storm sewers for Reesors and Drug Mart.
A separate permit is required for any signage for the proposed shopping center. The applicants
came in and met with staff about one month prior to submitting their site plan which has resulted
in a submitted site plan which addresses staff concerns and has resulted in minimal corrections.
Questions are often asked by applicants as to how much detail should be shown on a site plan
and what way is the best to approach the site plan and this submittal will be used as an example
from this point forward.
RECOMMENDATION:
Staff would recommend approval of the proposed site plan as presented with the condition of a
pre - construction meeting with staff prior to obtaining the building permit and the three conditions
noted by staff.

BACKGROUND
The City of Owasso has received a request for a review of a lot split from John Williams. The
subject property is located within Lot 1, Block 2 of the Ram Plaza Addition located at the
northwest corner of E. 86th Street North and N. 129th E. Avenue. A location map is attached
for your information and review.
The applicant is requesting a lot split, creating a two parcels from Lot 1. The first lot would
include all of Lot 1 except the East 66.19 feet thereof. This would then create one lot which
is 170' x 263.13' and a secondary lot which is 66.19' x 263.13'. As you may recall from the
March Planning Commission meeting in which a similar lot split request was approved on Lots
2 and 3; that request resulted in an excess parcel with the dimensions of 72' x 263.13'. These
two remaining parcels would then be combined to in a sense "recreate" Lot 2 with dimensions
of 138.34' x 263.13'. Legal descriptions of the applicants lot split request is attached for your
information and review, as well as a rough sketch of how all of these lot splits would be laid
out if approved.
The Owasso Technical Advisory Committee reviewed the lot split request at their March 27,
1996 regular meeting. At that meeting no comments and /or concerns were addressed by the
utility companies.
Staff's only comment is to once again point out to the Planning Commission and the applicant
that the limits of no access along the southern boundary of E. 86th Place North will need to be
changed to coincide where the access points will be developed off of that street. This item was
discussed at the March Planning Commission meeting and now that the lot split are complete,
this will be able to be addressed all at once.
Both lots to be created meet the requirements of the Subdivision Regulations and the Owasso
Zoning Code for both lot split procedures and size of lot for the zoning district in which it is
located (PUD, underlying zoning of CS).
RECOMMENDATION
Staff recommends approval of OLS -96 -02 with the following conditions:
That the applicant proceed with a plat amendment changing the "limits of no
access" as shown on the original Ram Plaza plat.

BACKGROUND
The City of Owasso has received a request for a review of a lot split from Ron Witten. The
subject property is located within the Mingo Commerce Center plat and is a portion of Lot 1,
Block 1. Mingo Commerce Center is located on immediately north of E. 80th Street North,
between Mazzio's restaurant and Wildwood Apartment.
Mingo Commerce Center, filed in December of 1993, is a 3 lot subdivision consisting of two
small lots (Lots 2 & 3) which front on to E. 80th Street North and 1 large lot (Lot 1) which is
located immediately north of the smaller lots. Lot 1 also contained a 50' strip of land which
provided its access to E. 80th Street North. The access was created to be privately owned,
constructed, and maintained.
Recently, the Owasso Board of Adjustment reviewed a request from Equipment One in order
to allow an equipment rental facility to operate in a CS (Commercial Shopping Center) zoning
district. This request included a site plan review with numerous restrictions. Once approved,
the access was constructed by Mr. Witten and a building permit has been subsequently issued
for the construction of the Equipment One facility.
After the private road was constructed, it was discovered that a sliver of land (measuring in
widths from 8.17' at its north end and smaller at the south end) remained between the roadside
edge and the actual boundary of the Equipment One property. In order to provide "legal" access
to Lot 2 and provide for a better fencing opportunity, the applicants are requesting that this strip
of land be split from the original 50' wide piece of land.
The Technical Advisory Committee reviewed this request at their March 27, 1996 regular
meeting. The only comment received from the utility companies was to ensure that the utility
easement be maintained. The applicant does not wish to vacate the easement as it is platted.
Staff has no objections to the lot split application.
RECOMMENDATION
Staff recommends approval of OLS- 96 -03.

The City of Owasso has received a request for a review of a lot split from John J Livingston.
The subject property is located within Lot 1, Block 19 of Elm Creek Estates First Addition. The
subject property fronts on to E. 80th Street North and is directly east of the Owasso Auto Zone
and Owasso Physical Therapy Clinic.
The proposed lot split would create two separate parcels of land which would front on to E. 80th
Street North. The first parcel would be immediately east of the Owasso Auto Zone and Owasso
Physical Therapy Clinic, would have the dimensions of 300.23' x 435.26', and is the future site
Attic Storage of Owasso. The Board of Adjustment recently approved a Special Exception in
order to permit mini- storage units to be developed within a CS (Commercial Shopping Center)
zoning district. The second lot to be created would be immediately east of the first parcel and
would have the dimensions of 300.23' x 337.88'. Please note that due to the curvature of E.
80th Street North, the second parcel will have a slightly larger dimension on its east boundary
than on its west (see attached subject map).
The Owasso Technical Advisory Committee reviewed this request at their March 27, 1996
regular meeting. The only comment received from the utility companies was to ensure that a
17.5 utility easement be granted along the west, south and east boundaries of the entire subject
property. Staff had no comments regarding the application.

BACKGROUND:
The City of Owasso has received a request for the closing of a portion of a utility easement
located on the north 17.5 ' of Lot 2, Block 3, Windsor Lake II. The subject property is
currently developed with a single- family residence and the applicant are wishing to construct an
in- ground pool in their back yard. Due to some spacing limitations, it is necessary for the
applicant to seek that a portion of the 17.5' utility easement be closed. A site plan of the lot,
as well as the proposed pool, is enclosed for your information and review.
The easement closing request was reviewed by the Technical Advisory Committee at their March
27, 1996 regular meeting. No utility companies had any objection to the applicant's request,
in fact the only utilities located within the easement are SWBT & PSO. Both are located in the
northern most portion of the easement and would not be effected by the 5.5' closing.
Staff has no objections to the request.
RECOMMENDATION:
Staff recommends approval of the easement closing request, closing the southern most 5.5' of
the northerly 17.5' utility easement on Lot 2, Block 3, Windsor Lake II.

Dear Marsha:
I want to submit the following proposal for a variance on the utility easement on the
back (North side) of my residence at 13305 East 93rd Street North, for the
construction of a concrete gunite swimming pool.
In order to provide safety for my family and friends that may use the proposed pool, I
request that the existing easement on the north of 17.5 feet be reduced to 12 feet.
This will help keep the edge of the pool a safe distance from the house and patio.
The American Pool Company, who I plan to have build the pool, has already had the
utilities flagged. Please refer to the drawing (Exhibit A) which reveals that only
telephone and electric utilities are buried within this easement. They are only 5 feet
from the back of my property line. All other utilities are buried on the sides or front of
my property. The drawing in Exhibit B shows more detail regarding the layout of the
proposed pool and the decking surrounding it.
