The agenda for the meeting was posted in the Owasso City Hall, 207 S Cedar, on June 6,
at 11:00 AM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.
2. ROLL CALL
3. CONSIDER APPROVAL OF THE MINUTES OF MAY 14, 1996 REGULAR
MEETING AND THE MAY 17, 1996 SPECIAL MEETING - The Commission
reviewed the minutes of May 14, 1996 and the minutes from May 17, 1996, Charles
Willey moved, seconded by Jerry Cole to approve the minutes as written. A vote on the
motion was recorded as follows:

4. Final Plat - Nottingham Estates II - A request for a review of a final plat for Nottingham
Estates II, an addition to the City of Owasso containing 15 lots on 12.84 acres.
Nottingham II is located directly east of Pleasant View Estates (Tulsa County) and
Nottingham Estates.
The Chair introduced the case and the staff review was given by Mr. Rooney.
The TAC members had the opportunity to provide input to the developer regarding
easements at their May 29, 1996 meeting. Mr. Haynes questioned the applicant on why
Phase II was being developed next instead of Phase IV (which abuts East 96th Street).
Mr. Compton stated it was a cost business decision, utilities will be coming out of Phase
I, this schedule will help break up the cost. Utilities will not have to come from Phase
I to Phase IV. Nottingham Estates Phase III will be next then Phase IV will be

developed.
Jerry Cole moved to approve the final plat subject to the approval by the Engineering
Division of the Public Works Department and permits to construct the water and
wastewater lines have been issued by the Oklahoma State Department of Health.
Seconded by Ray Haynes. A vote on the motion was recorded as follows:

OLS -96 -06 - Joseph A. McCormick - A request for a lot split in Lot 1, Block 2, Ram
Plaza, an addition to the City of Owasso, Tulsa County, State of Oklahoma.
The Chair introduced the case and the staff review was given by Mr. Rooney.
This lot split would end up creating three lots on the north side of E. 86th Place north.
One lot will occupy the Sterling House Assisted Living Facility. The western most lot
would create a 95' parcel in which Warehouse Foods could expand. The middle lot
would be the Hardware Store. There were several concerns regarding two pending lot
splits for the same property. There were no comments from the TAC meeting at their
May 29, 1996 regular meeting. Staff recommends approval of this lot split with the
following conditions:
1. That the applicant proceed with a plat amendment changing the "limits of
no access" as shown on the original Ram Plaza plat.
2. That the applicant process a lot- tieing agreement.
Jerry Cole moved to deny the request for a lot split. Seconded by Charles Willey.
The Planning Commission discussed this item further. Jerry Cole withdrew his motion
to deny, Charles Willey withdrew his second.
Ray Haynes moved to approve the lot split, subject to the above requirements. Dewey
Brown seconded. A vote on the motion was recorded as follows:

6. Site Plan Review - Michael Roark - A request for a review of a site plan for a retail
hardware store located on a portion of Lots 1 and 2, Block 2, Ram Plaza.
The applicant has requested that this item be withdrawn from the agenda.
7. New Business - Ray Haynes suggested a statement be drawn up to show the applicant
that it may be necessary to come to the Planning Commission meeting or the item may
be tabled until the next meeting.
8. Report on Planning Items Previously Forwarded to City Council - None
9. Discussion of Development In and Near Owasso - Mr. Rooney briefly discussed an
annexation request.

SUBJECT: SITE PLAN REVIEW FOR DR. FRANKLIN'S OFFICE
LOT 7, BLOCK 1, RAM PLAZA
DATE: July 5, 1996
BACKGROUND:
Dr. Franklin has submitted a proposed site plan for a new dental office to be located on Lot 7,
Block 1 of Ram Plaza. More specifically, the subject site is located at 12700 E. 86th Place
North, directly north of the lots that house Mazzio's Delivery, Melodie's Tailor Shop, Owasso
Computer Systems and Dr. Standridge's office. Chiropractic Office. Access to this site is via
E. 86th Place North (the public street that runs from N. 129th E. Avenue to the Warehouse
Foods parking lot). An area map is attached for your information and a site plan is enclosed
within your packet for review. Please note that "North" is oriented to the bottom of the site
plan.
Review of the site plan by staff indicated that all necessary parking requirements have been met
by the applicant as 17 parking spaces have been provided, one of which has been designated for
the physically challenged. A trash enclosure area has been provided as well as several
landscaping areas.
The Technical Advisory Committee reviewed the site plan via facsimile. No comments opposing
the site plan have been received.
Staff would recommend the inclusion of a pre - construction meeting with city personnel prior to
obtaining the building permit and the reminder that a separate permit would be needed for any
signage.
RECOMMENDATION:
Staff recommends approval of the proposed site plan as presented with the condition of a pre -
construction meeting with staff prior to obtaining the building permit.

SUBJECT: ANNEXATION REQUEST BY NEW LIFE ASSEMBLY OF GOD, INC
DATE: July 5, 1996
The New Life Assembly of God, Inc have submitted to the City of Owasso a petition for
annexation of property totaling approximately 17.40 acres. The subject property is shown on
the attached map and is partially developed with the eventual site of the New Life Assembly of
God church. Copies of the annexation petition filed by the New Life Assembly of God, as well
as the annexation policy, are attached for your information and review.
The subject property is currently zoned AG (Agricultural) and would remain zoned AG if
annexed. All property annexed by the City of Owasso is required to be zoned the lowest zoning
classification (AG) until any rezoning request is received and approved by the Planning
Commission and the City Council.
The Annexation Committee conducted its meeting on June 27, 1996 to review the request. At
that meeting, staff presented several concerns regarding the annexation request. The first
concern is that the subject property is not contiguous to the existing city limits of Owasso. As
stated within the city's annexation policy, all properties to be annexed should be contiguous to
existing city limits. Clearly the request before you is not contiguous and therefore would not
meet this requirement. Staff believes, however, that the applicant could meet this requirement
by obtaining the permission from Tulsa County to allow for annexation of the Garnett Road
right -of -way from the Country Estates location to the subject property.
The second concern regarding the request is the site itself. The request to operate a church at
this location was approved through INCOG, and as a result, several different conditions /wavers
were required or granted. The most notable condition was a waiver of the paved parking
requirements for a period of one year. While I do not feel it would be appropriate to annex this
property and deviate from the conditions and /or waivers established through another planning
board, these are certainly items that the Annexation Committee, Planning Commission, and City
Council need to be aware of prior to making a decision. I have attached information from the
INCOG case for your information and review.
The Owasso Technical Advisory Committee reviewed the annexation request at their June 26,
1996 regular meeting. No comments opposing the annexation were received from area utility
providers, however the Owasso Fire Department did submit comments regarding the large
distance between the site and any existing fire hydrants.
Notification of the annexation request was published in the Owasso Reporter on May 25, 1995
to notify the public of the annexation request before the Planning Commission on June 13th.
That notification will be followed by notification published two consecutive weeks in the Owasso
Reporter to notify the public of City Council action regarding the request. Copies of the
procedures for annexation, as well as the legal ad which was published, are also attached for
your information and review.
The Annexation Committee recommended to table this request in order for the applicant to be
able to meet the annexation requirements.
ADDMONAL COMMENTS
Staff was required to place this item on the Planning Commission agenda due to the publication
in the Owasso Reporter which had to be published before the Annexation Committee conducted
its meeting in order to meet the legal notice requirements.
RECOMMENDATION
Based on the subject property not being contiguous to the city limits of Owasso and the
recommendation by the Annexation Committee, staff recommends tabling this request until the
applicant also applies for right -of -way annexation along Garnett Road in order to be contiguous
to the city limits of Owasso.

ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city. limits as the
lowest zoning classification, that is,. AG, agricultural.
Landowners may then petition for rezoning if -they desire
further development of their.property. All legal uses annexed
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
and accepted by the City Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a - city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation .for a six month period after
rejection by the City Council.

Presentation;
The applicant, Bret Lambert, 6218 North 129th East Avenue, Owasso, Oklahoma,
submitted a plot plan (Exhibit P -1) and informed that Phase 1 of the construction will
begin in approximately nine months, and additional space will be added as church
growth increases. He stated that Phase 1 will consist of a sanctuary and classroom
space.
Comments and Questions:
Mr. Alberty asked if there is a reason for gravel parking, other than economics, and
Mr. Lambert advised that economics is the only reason. He informed that there is
gravel parking across the street from the church property,
Mr. Alberty remarked that he would not be supportive of permanent gravel parking,
because of the proximity of the church to a residential development.
Mr. Walker stated that he would be amenable to approving temporary gravel parking
for one year only.
