The subject property is further described as a portion of the SW/4 of the SE/4 of Section 21, Township 21 North, Range 14 East. OLS -96 -08 - Legacy Properties. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF SEPTEMBER 10, 1996 REGULAR MEETING - The Commission reviewed the minutes of September 10, 1996, Dewey Brown moved, seconded by Ray Haynes to approve the minutes as written. A vote on the motion was recorded as follows: Ray Haynes - Yes Dewey Brown - Yes Jerry Cole - Yes The motion carried 3-0. 4. Preliminary Plat - Brentwood Park - A request to review a preliminary plat for Brentwood Park, an addition to the City of Owass located immediately east of Brentwood Estates, consisting of 20 residential lots on 8.41 acres, more or less. The subject property is further described as a portion of the SW/4 of the SEA of Section 21, Township 21 North, Range 14 East. The Chair introduced the case and the staff review was given by Mr. Rooney. The Technical Advisory Committee reviewed the preliminary plat and the applicants were provided a list of staff corrections. In addition to staff comments, the utility companies also had several requests for easements at different locations thoughout the plat. 1. Acceleration /Deceleration lanes already exist for this addition as a result of Brentwood Estates. 2. Construction plans (water, sewer, storm sewer, streets) need to be submitted by final plat application. OWASSO PLANNING COMMISSION October 8, 1996 Page No. 2 3. Sidewalks are required along the portion of Brentwood Park that fronts E. 86th Street North. 4. Efforts should be made to save /relocate existing trees planted along N. 139th East Avenue. 5. Addresses are available for the addition and should be included on the final plat application. 6. The wall constructed along E. 86th Street as a portion of Brentwood Estates should continue along Brentwood Park's frontage to ensure continuity. 7. Item 24 in the Covenants needs correction due to spelling error. 8. ONG requests that the Book and Page of their filed easement along E. 86th Street North be included on the plat (Bk 5691, Pg 1321). 9. A 5' drainage easement may need to be added along E. 86th Street North as well as east boundary of the plat. 10. The north boundary of the plat should be changed to include an 11' back -to -back utility easement to ensure the location of all the utilities. 11. ONG requests review of wall location along E. 86th -Street North due to gas line located in the vicinity. The zoning of the property is RS -2 which is identical to that of Brentwood Estates and the convenauts proposed by the applicant are identical to that of Brentwood Estates. Jerry Cole moved to approve the preliminary plat, subject to the above TAC evaluations. Dewey Brown seconded. Review of September Building Report and Lot Availability - Mr. Rooney reviewed the report with the Commission. 7. New Business - A new Quik Trip site plan was discussed and Silvercreek PUD. Easement Closing - Three Lakes II Addition - A request to close a portion of a utility easement located on Lot 43, Block 5, Three Lakes II Addition, said portion described as the northerly 40 feet of the easterly 6 feet of the rear 15 foot utility easement. The Chair introduced the case and the staff review was given by Mr. Rooney. The property is currently developed with an in- ground pool in the rear yard which encroaches into the rear utility easement approximately 4.2 feet. Area utility companies have reviewed the request and have no objections. Ray Haynes moved to approve the easement closing, Charles Willey seconded. Plat Amendment - Central Park Addition - A request for an amendment to the final plat of Central Park, amending the building line on the east side of Lot 22, Block 1, from 25 feet to 15 feet. The Chair introduced the case and the staff review was given by Mr. Rooney. The request involves a change in the building line of a corner lot to 25 feet on the front yard and 15 feet on the corner side yard. The applicant received 100%. approval from the property owners within the addition. Staff has no objections to this request. OWASSO PLANNING COMMISSION November 6, 1996 Page No. 2 Charles Willey moved to approve the plat amendment subject to the approval of a Resolution #86 -12, Dewey Brown seconded. Final Plat - Barrington Estates - A request for a final plat approval for Barrington Estates, an Addition to the City of Owasso, Owasso, OK. Barrington Estates is located immediately east of Barrington Point I, II, and III and contains 127 residential lots on 40.13 acres, more or less. The Chair introduced the case and the staff review was given by Mr. Rooney. The final plat was reviewed by TAC the week of October 14, 1996. No comments or corrections were made from ONG or Southwestern Bell. PSO had requests for additional utility easements for street lighting, as well as two changes to the covenants. Staff recommends approval. Ray Haynes moved to approve the final plat subject to TAC recommendations, Charles Willey seconded. OLS -96 -09 - Owasso Economic Development Authority - A request for an approval of a lot split for a 2 acre parcel of land located in the NE /4 of the NW /4 of Section 20, Township 21N, Range 14E, Tulsa County, State of Oklahoma. The Chair introduced the case and the staff review was given by Mr. Rooney. A tract of land containing 13.7 acres make up the Oak Tree Business Park plat which were given to OEDA. Two acres were purchased from Hayward Smith and Betty Jane Smith, because this purchase was less than 5 acres, a lot split approval was required prior to the closing which is to be October 29, 1996. Dewey Brown moved to approve the lot split, Charles Willey seconded. Chairperson Secretary Date MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: FINAL PLAT - BRENTWOOD PARK DATE: November 8, 1996 BACKGROUND The City of Owasso has received a request to review a final plat for Silver Creek Development for their proposed development titled Brentwood Park. Brentwood Park is located east of the existing Brentwood Estates subdivision and would contain approximately 8.41 acres of single - family residential housing upon completion, totalling 20 lots. The preliminary plat for Brentwood Park was approved at the October 8, 1996 regular Planning Commission meeting. The Technical Advisory Committee reviewed the final plat during the week of November 4, 1996. The Technical Advisory Committee was delivered a copy of the final plat for Brentwood Park with a memorandum requesting their review prior to Friday, November 8, 1996. Comments were received from PSO stating that the utility easements shown on the Brentwood Park final plat satisfy their requirements. TCI contacted staff via telephone to state that they had no comments with the final plat. Lee Miller of ONG contacted staff via telephone that the final plat shows the existing 17.5' utility easement filed with the book and page along the southern boundary of the addition, but it needs to be indicated as an ONG easement and identified in Lots 19 and 20. Also, continue the 15' u/e around the cul -de -sacs in the front of the lots, not just along N. 139th E. Avenue. Staff would recommends that Mr. Miller's requests be conditions of approval. Mr. Lutz of the Engineering Division of Public Works also reviewed that final plat for Brentwood Park and had no additional comments and /or corrections. Construction plans, although limited because of existing infrastructure being utilized from Brentwood Estates, have been reviewed and approved by Mr. Lutz. The applicants have applied for their necessary permits from the DEQ. If the plat is approved by the Planning Commission, it will be forwarded to Council upon receipt of the DEQ permits. Mr. Lutz will be in the audience to answer any questions you may have about this item. As stated during preliminary plat review, perhaps the most significant of planning staff comments had concerned the inclusion of a sidewalk along E. 86th Street North. The acceleration and deceleration lanes already exist along the entrance off of E. 86th Street North, however the requirement for sidewalks with development along arterial streets was not a portion of the Subdivision Regulations when Brentwood Estates developed. The applicants will be required to add sidewalks along the portion of E. 86th Street North that abuts their portion of the development. In addition, the applicants will continue the same type of fencing along E. 86th Street North found at Brentwood Estates. The zoning of the subject property is RS -2 (Residential Single- Family Medium Density) which is identical to that of Brentwood Estates. The lot sizes are comparable in nature and the covenants proposed by the applicant are identical to that of Brentwood Estates. A copy of the Brentwood Estates Plat is attached for your information and review. RECOMMENDATION Staff is recommending Planning Commission approval of the final plat for Brentwood Park providing the following are added: 1. The 17.5' utility easement is identified along the southern boundary of the plat through Lots 19 and 20 of Block 1, and that it be identified as an ONG easement. 2. DATE: November 5, 1996 BACKGROUND The City of Owasso has received a request for a review of a lot split from Legacy Properties, Inc. The subject property is located within Lot 1, Block 5 of Ator heights third Addition located along the Garnett Road private access road, south of Mowery's Funeral Home. The subject property is zoned CG (Commercial General) and a location map is attached for your information and review. This lot split, if approved, would create two commercially zoned lots at the above described location. One lot, located along the southern portion of the subject property, would contain the dimensions of 116.46 x 250', while the northernmost lot would be 98 x 250' with square footage totals of 29,115 and 24,500 respectively. The bulk and area requirements for property within a CG district require a minimum lot width of 50 feet and both of the proposed lots would meet this requirement. The Owasso Technical Advisory Committee reviewed the lot split request at their October 30, 1996 regular meeting. At that meeting no comments and /or concerns were offered by the utility companies. Staff had no comments regarding the request. Attached, for your information and review, are complete legal descriptions for both of the tracts to be created. Also attached is a preliminary site plan for the proposed buildings to be located on the property if the lot split is approved. Understand, however, that this is not a site plan submittal and the applicant would be required to process a site plan review at an additional meeting. Rooney - Community Development Director BACKGROUND APPLICANT AND STATUS OF APPLICANT: Tim Terral, agent for owner. REQUESTED ACTION AND PURPOSE: A request for the rezoning of property in order to establish underlying zoning for OPUD -14 (see next agenda item) from RS -2 (Single - Family Residential Medium Density) and AG (Agriculture) to RS -2 (Single- Family Residential Medium Density) and CS (Commercial Shopping Center). LOCATION AND SIZE: The general location of the subject property is the northwest corner of E. 86th Street North and N. 145th E. Avenue. A copy of the complete legal descriptions for both areas involved in the rezoning are attached for your information and review, as well as subject maps. The subject property contains approximately 141.30 acres, more or less. The portion requesting rezoning to RS -2 is comprised of 136.30 acres, while the portion requesting CS zoning totals 5 acres. EXISTING LAND USE: The subject property is currently undeveloped. SURROUNDING LAND USE: The subject property is abutted on the north by the proposed phase III of Nottingham Estates and several large parcel land owners with single - family residences. To the east of the subject property lies N. 145th E.Avenue, while further east lies undeveloped land and single - family residential development zoned RS -40 (Roger's County). To the southeast lies Pamela Hodson Elementary zoned C -1 (Roger's County), while south of the subject property lies E. 86th Street North and the undeveloped Kaiser Francis property zoned OL (Office Light) and RS -2 (Single - Family Residential Medium Density). West of the subject property lies the proposed Brentwood Park and future phases of Brentwood Estates, also zoned RS -2. APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments ", Chapter 4 "Residential District Provisions" and Chapter 6 "Commercial district Provisions ". SITE INFORMATION: No unusual development hardships are noted. Staff Report OZ -96 -01 Page 2 of 2 ANALYSIS The proposed rezoning, if approved, would create the needed underlying zoning in order for OPUD -14 to be considered by the Planning Commission. While a more detailed review of the overall plans for the subject property are contained within the OPUD -14 staff report (next agenda item), it is important to review some of the basic facts when reviewing this rezoning request. A majority of the land located within this square mile section, and the square mile section to the south, is currently zoned for residential development at an RS -2 density or higher. These areas would consist of Windsor Lake I and II, Windsor Lake II Extended, Camden park, Barrington Point I, II, and III, Barrington Estates, Brentwood Estates, Brentwood Park, Copper Meadows, and a large portion of the Kaiser - Francis property. Not only is the request for RS -2 zoning consistent with the past development trends in the area, it also meets the Comprehensive Plan of the area. The 5 acre parcel which is requested to receive CS (Commercial Shopping Center) zoning also is consistent with the Comprehensive Plan and its recommendations for creating commercial nodes at the intersections of arterial streets. The "activity centers ", as they are described by the Comprehensive Plan, call for 20 acres of commercial zoning at each intersection with 5 acres being located at each corner. If the zoning request is approved by the Planning Commission, as well as OPUD -14, all typical development review processes will occur. Please note that staff is likely to request that presentation of OZ-96-01 and OPUD-14 occur simultaneously, rather than individual presentations on both. Aseparate vote on OZ-96-01 and OPUD-14 will be required. RECOMMENDATION Staff views a rezoning and use of this property in the residential manner that is proposed is consistent with the existing zoning patterns in this area, in fact it would be an extension of what is found immediately to the west, and recommends approval of the RS -2 zoning. CITY OF OWASSO Community Development Department OPUD-14 Staff Report CONCEPT OF A PUD The concept behind a Planned Unit Development is that it provides a creative alternative to a conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity and flexibility than could be achieved by traditional zoning in planning and development of large parcels of land. The PUD concept allows the developer to "collect or pick -up" all the developable floor area allowed by the various parcels zoned commercial or office and all the lots allowed by those parcels zoned single - family, and "place" them back onto the subject tract based upon an approved master plan and text (including bulk and area standards) that considers the physical conditions on and around the entire tract. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete, coordinated plan of development for a larger parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND Planned Unit Development #14 is 131.30 acres in size, all of which is undeveloped. A portion of the subject tract is zoned RS -2 (Residential: Single - Family Medium Density) District, while a majority of the subject tract is zoned AG (Agriculture). It is located between 86th and 96th Street North, west of 145th East Avenue. PUD #14 will lie northeast of the existing Brentwood Estates addition and the proposed Brentwood Park addition. Portions of the subject tract are abutted on the west by the proposed Brentwood Park Addition and undeveloped RS -2 zoned property. Northern portions of the subject tract are bordered by the proposed additional phases of the Nottingham property and several large acre home sites outside of the city limits zoned AG (Agriculture). The subject tract is bordered on the east by 145th East Avenue and on the south by E. 86th Street North. (See Case Map) The applicant is requesting approval of PUD supplemental zoning on the subject tract that would be developed in accordance with a submitted Outline Development Plan and Text. The plan and text call for the development of 5 acres of Commercial Shopping (CS) at the southeast corner of the subject site, abutting N. 145th E. Avenue and E. 86th Street North, and 131.3 acres of residential development which would include allowance for the development of three different sized residential lots. Staff Report OPUD -14 Page 2 of 9 This PUD application is accompanied by a zoning application (OZ- 96 -01) requesting a zoning consisting of 5 acres of CS (Commercial Shopping) and 136.3 acres of RS -2 (Residential Single - Family Medium Density). The staff has recommended approval of Zoning Case OZ- 96-01, but has also recommended that additional landscaping and setback requirements for that area within the OPUD -14 application. The following analysis is based upon the zoning case OZ -96 -01 being approved per staff's recommendation for additional landscaping and setback requirements. STAFF ANALYSIS Because PUD's are not a normal agenda item at every Planning Commission meeting, I feel it is important to establish a quick review of the PUD requirements and process. The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall determine: (1) Whether the PUD is consistent with the Comprehensive Plan. (2) Whether the PUD is in harmony with the existing and expected development of surrounding areas. (3) Whether the PUD is a unified treatment of the development possibilities of the project site. (4) Whether the PUD is consistent with the stated purposes and standards of the PUD Ordinance. (a) Permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; (b) Permit flexibility within the development to best utilize the unique physical features of the particular site; (c) Provide and preserve meaningful open space; (d) Achieve a continuity of function and design within the development. Staff Report OPUD -14 Page 3 of 9 CONSISTENCY WITH COMPREHENSIVE PLAN The Comprehensive Plan is implemented through the use of the zoning process. This means that when zoning or PUD requests are presented to the Planning Commission and City Council, they should be consistent with the Comprehensive Plan or logical reasons should be presented to show that the plan needs to be amended. The Comprehensive Plan designates the majority of the subject tract to be developed as Low Density Residential. In addition, a portion of the subject tract located in the southeast corner is designated to be utilized as Medium Density Residential and Commercial- Office. When one reviews the applicant's submittal of residential areas of varying lot sizes throughout the development, one may conclude that the request does not adhere to the Comprehensive Plan guidelines low density. However, it should be noted that a majority of the land that has developed within the square mile section bounded by N. 129th E. Ave, 96th Street, N. 145th E. Ave, and 86th Street has developed in a medium density format or higher. When the Comprehensive Plan was completed in 1985, it was stated that necessary infrastructure (water and sewer lines) were not anticipated to be located within this area in the near future and thus the lower density. Also, the Comprehensive Plan states that if, for example, an area designated for Low Density Residential Development and a rezoning to RS -3 (Residential High Density) is requested, this is not in conflict with the plan. However, if Residential Low Density is designated and Industrial High Density is proposed, then it is in conflict. Three different sized residential lots are proposed within the area designated for residential development. The southern one -third of the subject property is designated for 70 x 125' (average) titled executive homesites. The second area is located within the northern two - thirds of the subject property and will feature 80 x 130' lots (average) titled premier homesites. The third area is located east of the planned Nottingham III addition and around the existing pond with average lot sizes of 100 x 135' lots. Planning Staff would recommend allowing slight deviations in density of dwelling units (10 %) from one form of single - family residential area to another single -family residential area providing no significant change in the character of the either area is created. The Comprehensive Plan also designates 20 acres of proposed commercial development at the intersections of arterial streets (5 on each corner) termed "activity centers. " The "activity centers" would allow for commercial, office, and multi -family housing development. The applicants have indicated a preference for commercial development at this area as described within their PUD application. OZ -96 -01 would provide for an underlying zoning of CS (Commercial Shopping Center). Staff Report OPUD -14 Page 4 of 9 Due to the proximity of Pamela Hodson Elementary, staff encouraged the applicants to include language within the PUD that limited the type of commercial activity that could possibly accompany commercial development. The applicants have included language within the application that prohibits free standing bars or taverns and adult entertainment businesses. With the previous facts in mind, it would be staff's opinion that the PUD proposed by the applicant would be consistent with the Comprehensive Plan. Harmony With Existing and EVeeted Development Any large development such as the proposed PUD is going to create rapid changes within a community and new demands will be placed upon our existing infrastructure. It is important to note, however, that in a community like Owasso, this growth would be likely to occur regardless of this development. The PUD simply has the potential to increase the demand for services more quickly and therefore shortens the schedule for determining solutions. In reviewing existing development, it would appear that the proposed PUD and subsequent subdivision would be a logical expansion of the Brentwood Estates, proposed Brentwood Park, and Nottingham Estates area. When reviewing future development possibilities south of E. 86th Street North (Kaiser Francis Property), zoning exists on this property to develop predominately in a residential manner. This is also the case along a large portion of the subject property's east boundary with residential lots in Roger's County. Because of the 5 acre commercial area being proposed also would appear to be consistent with development trends at arterial intersections. Property at the southwest corner of the E. 86th Street and N. 145th E. Avenue intersection is zoned OL (Office Light) and has not developed. Property at the southeast corner (Rogers County) is developed as Pamela Hodson Elementary School, however it is zoned C -1 which would have permitted a multitude of commercial uses. Property at the northeast corner is zoned AR ( Roger's County) and contains a large portion of undeveloped land. It is staff's opinion that development which would be permitted with both the requested underlying zoning, as well as the proposed PUD, would be consistent with existing and expected development with one exception. (See Unified Treatment of the PUD Subject Area) Staff Report OPUD -14 Page 5 of 9 Legal, Planning and Site Engineerin While the applicants have stated within the application that both the proposed detention pond and the existing pond will contain and address their drainage needs, staff would recommend the requirement of a detailed drainage report and certification of such document by an engineer at time of platting. If the report would indicate that a larger drainage detention area is needed, a result in the number of planned residential lots is likely to occur. Typically, these items are addressed during the platting stages of the subject property. Internal street patterns and the connections to future stages of Brentwood Estates' streets appear to be of a logical and sensible pattern. A possibility of "thru" traffic traversing the subdivision exists; however staff would also state that if the proposed lot layout proceeds in the manner indicated by the PUD submittal, a stop sign should be required at the third 4 -way intersection from E. 86th Street North. This would meet current spacing requirements contained within the City of Owasso's Residential Neighborhood Traffic Control Policy. The applicants have indicated one access off of E. 86th Street North and two off of N. 145th E. Avenue. Staff has no concerns with the number of access points being proposed, but would suggest that the northernmost access point on N. 145th E. Avenue line up with that of the southernmost access point of the residential addition in Roger's County (Whispering Pines). Furthermore, staff would also recommend the inclusion of acceleration /deceleration lanes at each entrance point off of any arterial street. Pedestrian traffic is likely to be in demand due to the proximity of the Pamela Hodson Elementary School and any commercial development that would take place at the intersection. Staff would also recommend the inclusion of sidewalks along both E. 86th Street North and N. 145th E. Avenue. The lot layout proposed within the PUD conceptual development plan is relatively solid and would appear to meet the requirements of the Owasso Subdivision Regulations. The first cul -de -sac off of the southernmost access from N. 145th E. Avenue, however, contains what would appear to be a "flag lot." In order to be consistent with staff and Council comments regarding "flag lots ", staff would also recommend that no flag lots be permitted. Staff Report OPUD -14 Page 6 of 9 Unified Treatment of the PUD Subject Area A review of the applicant's Illustrative Site Plan for "Silver Creek" finds an excellent utilization of the project site. As stated within the applicant's submittal, drainage within the undeveloped project site is oriented mostly from north to south in nature. The utilization of the existing lake within the northerly portion of the site is appropriate. In addition, the applicant's have indicated a second detention area along the southern portion of the proposed development and have also indicated that this detention area not resemble a "square- hole" detention facility but rather one that is aesthetically pleasing, with surrounding area usable by the residents of Silver Creek. As a result, this area has also been designated as a private park. Although it may not be necessary at the time of development, staff would recommend that the possibility of requiring on -site detention for the commercial development area not be restricted and should be addressed during site plan review, if needed. Staff further recommends that CS (Commercial Shopping Center District) development standards contained within the Owasso Zoning Code be designated as the development standard for the commercial area. As staff has indicated in the past, the importance of some form of buffer between any commercial and residential areas cannot be stressed enough. Often times, conflict between the two different land uses occur, usually resulting in an unhappy resident more often than an unhappy commercial business. A large part of a Planner's responsibility is not only the "technical" review of a proposed development but also to anticipate any potential conflicts which could arise. While there is no specific buffer requirement, staff has recommended the utilization of a more dense residential development (i.e. multi - family housing) or significant landscaping as buffer's in the past. While the area surrounding the proposed commercial node is slightly denser than a typical RS -2 addition, staff still feels some form of buffer in addition to the Zoning Code's requirement of a 6 foot "privacy" fence should be included. Staff would recommend that detailed landscaping plans (type, species, size, location, irrigation) be required to be submitted with the building site plan within any portion of the commercial areas. Said landscaping plans would then be reviewed by staff to ensure that compatible relationships between the differing uses are maintained. The Planning Commission would also be required to review and approve these plans. Staff Report OPUD -14 Page 7 of 9 While PUD submittals are often times complex in nature and not easily understood, it is extremely beneficial in two significant manners. The first, is it allows for staff, Planning Commission, Council and most importantly - citizens - to see a complete picture of how an entire subject area will develop. This prevents a "piece- mealed" community and eliminates potential surprises. It assists in knowing the entire infrastructure needs of the addition and assists the city in planning and scheduling other improvements. The second is that it essentially allows for conditional zoning. While many of the requirements recommended by staff to be conditions of approval are currently contained within other development documents of the city, some are not. If this were a standard rezoning, not only would the flexibility of the applicant to shift densities be restricted, but the ability for staff, the Planning Commission, and Council to address areas that are unique to the subject property but not found within development documents would be limited too. In short, providing a PUD is well- thought by the applicant and reviewed by the staff, Planning Commission and Council properly, it can be an asset to both the applicant and the community. Attached for your information and review is a copy of the case map, as well as letters of notification sent to property owners within 300' of the subject property, the legal advertisement that appeared in the Owasso Reporter, and a copy of the application. Enclosed within your packet of information is a large case map as well as the applicants submitted materials. The subject property was posted with notification at the intersection of E. 86th Street North and N. 129th E. Avenue on October 18, 1996. RECOMMENDATION: Given the above analysis, it is the staff's opinion that OPUD -14 is consistent with the Comprehensive Plan and the PUD Chapter of the Zoning Code and, therefore, staff recommends approval subject to the following conditions: 1. That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. 2. That unless specifically set out in the standards and conditions of this PUD, single - family lots shall meet the requirements of a typical RS -2 district. 3. That unless specifically set out in the standards and conditions of this PUD, all commercial development shall meet the requirements of a typical CS district. Staff Report OPUD -14 Page 8 of 9 4. That within the PUD, the maximum number of dwellings shall not exceed 467 (Underlying RS -2 zoning would permit up to 525 dwelling units). 5. That the reference on page 16 of the PUD text pertaining to a lien being placed on a Homeowner's Association member's "personal property" be changed to "real property." 6. That minor transfers (10% increase or decrease in a development area's density) of dwelling units from one residential development area to another can occur if a significant change in the character of either development area is not created. 7. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. 8.
