CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE OCTOBER 8, 1996 REGULAR MEETING AND OCTOBER 25, 1996 SPECIAL MEETING - The Commission reviewed the minutes of October 8, 1996 and October 25, 1996, Dewey Brown moved to approve the mantes with an amendment of adding Bill Ellison to the members present list on the October 25, 1996 minutes, Jerry Cole seconded. A vote on the motion was recorded as follows: Ray Haynes - Yes Dewey Brown - Yes Bill Ellison - Yes Charles Willey - Yes Jerry Cole - Yes The motion carried 5-0. 4. FINAL PLAT - BRENTWOOD PARK - A request to review a final plat for Brentwood Park, an addition to the City of Owasso located immediately east of Brentwood Estates, consisting of 20 residential lots on 8.41 acres, more or less. The subject property is further described as a portion of the SWA of the SE/4 of Section 21, Township 21 North, Range 14 East. The Chair introduced the case and the staff review was given by Mr. Rooney. The Technical Advisory Committee reviewed the final plat. PSO and TCI had no comments and /or corrections. ONG shows the existing 17.5' utility easement in Lots 19 and 20. Also, continue the 15' u/e around the cul -de -sacs in the front of the lots. The applicants will be required to add sidewalks along the portion of E. 86th Street North that abuts their portion of the development. Ray Haynes moved to approve the final plat for OWASSO PLANNING COMMISSION November 12, 1996 Page No. 2 Brentwood Park subject to staff's memorandum and the following recommendations: 1. The 17.5' utility easement is identified along the southern boundary of the plat through Lots 19 and 20 of Block 1, and that it be identified as an ONG easement. 2. That the 15' u/e be continued and identified in the front of all the cul -de- sac lots. Charles Willey seconded the motion. INC. - A request to review a lot split located within a Portion of Lot 1, Block 5, Ator Heights Third Addition. The subject property is located south of Mowery Funeral Homes, North of 9100 N. Garnett Road. The Chair introduced the case and the staff review was given by Mr. Rooney. The subject property is zoned CG and would create two commercially zoned lots. One would contain the dimensions of 116.46 x 250', while the northernmost lot would be 98 x 250'. At the TAC meeting on October 30, 1996 no comments and /or concerns were offered. Staff has no objections to this request. Jerry Cole moved to approve the lot split, Dewey Brown seconded. A vote on the motion was recorded as follows: Ray Haynes - Yes Dewey Brown - Yes Jerry Cole - Yes Bill Ellison - Yes Charles Willey - Yes The motion carried 5-0. 6. OZ -96 -01 - TIM TERRAL - A request for rezoning of property currently zoned RS -2 (Residential Single - Family Medium Density) and AG (Agriculture) to RS -2 (Residential Single - Family Medium Density) and CS (Commercial Shopping Center). The purpose of the request is to establish underlying zoning for OPUD -14. The general location of the subject property is north and west of the northwest corner of E. 86th Street North and N. 145th E. Avenue. The entire subject property contains 136.30 acres, more or less. OWASSO PLANNING COMMISSION November 12, 1996 Page No. 3 The Chair introduced the case and the staff review was given by Mr. Rooney. The proposed rezoning would create the needed underlying zoning in order for OPUD -14 to be considered by the Planning Commission. The request for RS -2 zoning is consistent with the past development trends in the area, it also meets the Comprehensive Plan of the area. The 5 acre parcel to receive CS zoning also is consistent with the Comprehensive Plan. Staff recommends approval of the RS -2 zoning, also staff recommends approval of the requested CS zoning. Jerry Cole moved to approve the rezoning request, Charles Willey seconded. OPUD -14 - TIM TERRAL - A request for approval of a Planned Unit Development OPUD -14 is located north and west of the northwest corner of E. 86th Street North and N. 145th E. Avenue. The entire subject property contains 136.31 acres, consisting of 131.30 acres of residential development and 5 acres of commercial development. The Chair introduced the case and the staff review was given by Mr. Rooney. The Planning Commission reviewed a presentation made by the applicant and received comments and questions from approximately 10 interested citizens. There were concerns with traffic problems in that area and drainage questions. Also, concerns regarding fire and police protection. Dewey Brown moved to approve the OPUD -14 request subject to staff's memorandum and the following recommendations: 1. That the applicant's Development Text and Conceptual Development Pan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. 2. That unless specifically set out in the standards and conditions of this PUD, single -family lots shall meet the requirements of a typical RS -2 district. 3. That unless specifically set out in the standards and conditions of this PUD, all commercial development shall meet the requirements of a typical CS district. 4. That within the PUD, the maximum number of dwellings shall not exceed 467 (underlying Rs -2 zoning would permit up to 525 dwelling units). 5. That the reference on page 16 of the PUD text pertaining to a lien being placed on a Homeowner's Association member's "personal Property" be changed to "real property." That minor transfers (15 % increase in a developments area's density) of dwelling units from one residential development area to another can occur if a significant change in the character of either development area is not created. 7. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. 8. That no building permits be issued within any portion of the PUD until all criteria outlined with Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 9. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 10. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. 11. That if the street layout proposed is similar to that which is proposed, a stop sign shall be required at the third 4 -way intersection from E. 86th Street North. 12. That the Northernmost access point to N. 145th E. Avenue from the PUD property shall line up with the southernmost access point of the Whispering Pines Addition (Rogers County). 13. Acceleration /Deceleration lanes will be required on E. 86th Street North and N. 145th E. Avenue. 14. Sidewalks will be required along E. 86th Street North and N. 145th E. Avenue. 15. No flag lots are permitted within any portion of the PUD. 16. If needed, commercial area may be required to provide on -site detention. This to be determined at site plan review for commercial property. 17. Detailed landscaping plans (type, species, size, location, irrigation) shall be required to be submitted with site plans of any commercial development. Said plans will be reviewed by staff and must be approved by the Planning Commission. Said amendments, if approved, to be forwarded to the Owasso City Council on November 19, 1996. This item was tabled, to be presented at a later date. 9. Report on Monthly Building Permit Activity. Chairperson Secretary Date MEMORANDUM TO: THE OWASSO PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: OLS -96 -10 OWASSO PROPERTIES ONE, INC. DATE: December 8, 1996 BACKGROUND Mr. Mark Enterline of Owasso Properties One, Inc:; has requested a review of a lot split for property located with the S/2 of the S/2 of the SEA of Section 20, Township 21 North, Range 14 East, City of Owasso, Tulsa County, State of oklahoma. The general location of the requested lot split is immediately west of the Food Lion property, between Food Lion and Robert Long's Insurance /Diana's Travel offices. A location map is attached for your information and review, as well as a subject map. The entire tract from which the applicant is requesting a lot split totals 188,422 square feet or approximately 4.33 acres, more or less. The individual tract to be split measures 185' x 217' and would consist of 40,145 square feet or .92 acres, more or less. Complete legal descriptions of the entire tract and the subject lot are attached for your information and review. The applicant is requesting this lot split for the future location of a bank. The entire subject property is zoned OL (Office Light) and banks, as well as other financial institutions, are classified as a Use Unit 11 by the Owasso Zoning Code. All Use Unit 11 uses are permitted outright in OL districts. If the lot split is approved by the Planning Commission, a site plan for the proposed bank will need to be submitted and approved by the Planning Commission prior to the issuance of a building permit. The lot split was reviewed by the Technical Advisory Committee the week of November 25, 1996. The only comments received by the Technical Advisory Committee centered around the need for a 17.5' utility easement around the perimeter of the proposed lot split. Staff has become custom to this request when reviewing lot splits and this should not be considered as being out of the norm. No other comments from the Technical Advisory Committee were noted and staff has no other comments /concerns regarding this request. WO#10464 2114.20 C: \10464.DOC 11/08/96 MEMORANDUM TO: THE OWASSO PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: OLS -96 -11 ROARK FAMILY, LLC DATE: December 8, 1996 BACKGROUND As you are aware, Mr. Michael D. Roark has been before the Planning Commission twice before in 1996 to request lot split approvals within the Ram Plaza Addition. In order to provide the Planning Commission sufficient information regarding the third request, I feel it is necessary to provide you a proper review of the history regarding the located within Block 2 of the Ram Plaza Addition. RAM PLAZA (AS FILED) Lot 1, Block 2 is 266.19' wide x 263.13' deep, Lot 2, Block 2 is 222.00' wide x 263.13' deep, Lot 3, Block 2 is 200.00' wide x 263.13' deep. See map titled "RAM PLAZA" attached for information and review. MARCH - 1996 Sterling House Corporation requested a lot split for the East 150' of Lot 2, Block 2 of Ram Plaza Addition. The east 150' combined with Lot 3, Block 2 of Ram Plaza Addition created one lot measuring 350' x 263.13' on which the Sterling House Elderly Assisted Living Facility could be located. This lot split was filed and the facility is constructed. See map titled "RAM PLAZA - MARCH 1996 ". APRIL - 1996 Michael Roark requested a lot split within Lot 1, Block 2 of Ram Plaza Addition. One lot was proposed to include all of Lot 1 except the east 66.19' of Lot 1, thus creating a lot which is 170' x 263.13'. The remaining 66.19' would then be combined with the remaining 72' of Lot 2, Block 2 from the Sterling House lot Split (see above) creating a lot with the dimensions of 138.34' x 263.13'. This lot split was not filed because by the applicant because after it was approved, the applicant was approached by neighboring property (Warehouse Market) for additional property. (see next item) See map titled "RAM PLAZA - APRIL 1996 ". Staff Report OLS -96 -11 Page 2 of 3 JUNE - 1996 Michael Roark requested a lot split within Lot 1, Block 2 of Ram Plaza Addition. Warehouse Market approached Mr. Roark about purchasing land within Lot 1 of Block 2 (the lot immediately east of Warehouse Market) for future expansion. This lot split created a 95' wide parcel immediately east of Warehouse Foods for expansion, with the remnant parcel of Lot 1 (171.19') being combined with the remnant parcel of the Sterling House lot split (72') to create a "middle" lot with measurements of 243.19' x 263.13'. At this time, there was considerable discussion between the Planning Commission and staff regarding having two lot splits approved (the April and the June lot splits) with a possibility that the initial request by Mr. Roark would be filed instead. The Planning Commission ended up approving this lot split request with the understanding that the first request would end up being null and void. However, all were uncomfortable that no letter had been submitted to officially make the initial lot split request by Mr. Roark null and void. The site plan for the Mr. Roark's proposed hardware store was then approved on this large, "middle" lot. See map titled "RAM PLAZA - JUNE 1996 ". NOVEMBER - 1996 As Rain Plaza exists currently, there are 3 lots within block 2. From East to West, the first is the Sterling House Lot which is 350' x 263.13', and consists of all of the original Lot 3 and a portion of Lot 2. The second lot (or middle lot) is 243.19' x 263.13' and is the planned site of the Hardware Store, and consists of portions of the original Lot 2 and Lot 1. The third lot is 95' x 263.13' and is planned for future expansion of Warehouse Market, and consists of a portion of the original Lot 1. Mr. Roark approached staff in November seeking an additional lot split at this time, requesting that the east 28' of the original Lot 1 be split and combined with the westerly 72' of the original Lot 2 (remnant from the Sterling House split) to create an additional "middle" lot measuring 100' x 263.13'. This would then shrink the rather large Hardware Store lot created in June of 1996 to a measurement of 143.19' x 263.13'. See map title "RAM PLAZA - PROPOSED ". Because I felt this request would again generate considerable discussion, I requested three things from Mr. Roark in order to process this request: 1. Supply staff with a letter stating that the Lot Split approved by the Planning Commission on April 19, 1996 be abandoned in order to clear up the issue of two existing lot splits on the same property. This was a concern well expressed by the Planning Commission. Staff Report OLS -96 -11 Page 3 of 3 2. Supply a letter with the application explaining the reasons behind this request. 3. Attend this Planning Commission meeting. Although the history of the property does create confusion, this application for lot split does formally eliminate a prior approval which generated much discussion earlier in the year and maintains 3 "buildable areas" for new construction within Block 2 of Ram Plaza Addition, as well as a 95' wide area for future expansion of Warehouse Market. While staff made it well known how I felt about Mr. Roark's lot split applications at the June 1996 meeting, I do believe that this lot split (if approved and filed) should end all confusion regarding Block 2 of Ram Plaza. The Technical Advisory Committee had no comments regarding the lot split request as this property was subdivided and sufficient utility easements are already in place. There have been two splits on this lot to date. In April I submitted a lot split request for Lot 1. After I had submitted that request Warehouse Market approached me about selling a portion of Lot 1 which would also require a split, or a split in a different place. In the absence of a firm arrangement with them I left my original request in place and it was approved by the Planning Commission on April 19, 1996. In June Warehouse Market requested a lot split for Lot 1 after offering me a contract for a portion of land. I postponed my development plans to accommodate their efforts for a future expansion. This lot split was granted by the Commission on June 11, 1996. This second lot split made the original split of April 19 unnecessary. Upon my closing with Warehouse Market, it was necessary for me to buy the remaining portion of Lot 2 which had been split for Sterling House with the intention of building my store and having sufficient area left for a future development. Parking, curb cuts, etc. in my site plan reflected that intention and was approved on June 11. My present request is to split the portion of my property which would accommodate that future development to the east of my store and west of Sterling House. This is consistent with apparent Commission intentions when they created a 72 foot lot split off of Lot 2 for Sterling House. I propose that that same area should be 100 feet wide instead of 72 feet. To accomplish this I could either abandon my original lot split (which was 66.19 feet) or ask that it be amended to be 100 feet instead of 66.19 since nothing was ever filed using it. Insurance Offices are defined as a Use Unit 11 within the Owasso Zoning Code. All uses that are described as a Use Unit 11 are permitted outright in the OL district. The site plan indicates a total of 14 parking spaces, two of which have been designated for the handicapped. Please note that the amount of required parking spaces, based on the size of the proposed use, is eight. Also, only one handicapped parking space would be required. the applicant has exceeded this requirement. In addition, planting area around the building as well as a partial 6' privacy fence is also proposed. The site plan was reviewed by the Technical Advisory Committee during the week of November 25, 1996. No comments and /or concerns were forwarded to this office as a result of that review. An area map is attached for your information and review, as well as a copy of the Mingo Commerce Center plat. The subject property is currently zoned IL (Industrial Light). This enclosed manufacturing shop is defined as a Use Unit 24 within the Owasso Zoning Code. All uses that are described as a Use Unit 24 are permitted outright in the IL district. The site plan indicates a total of 41 parking spaces, two of which have been designated for the handicapped. Please note that the amount of required parking spaces, based on the size of the proposed use, is 33 and the applicant exceeds that requirement. Two handicapped spaces would be required and the applicant meets that requirement as well. The site plan was reviewed by the Technical Advisory Committee during the week of November 25, 1996. No comments and /or concerns were forwarded to this office from any of the utility companies with the exception of ONG. ONG commented that the area in which the site plan indicates a desire to obtain gas service did not have a gas line near it and the applicant would need to extend service to that area. Staff specifically commented on two areas. The first, provided by the Engineering Division of Public Works, was for the applicant to supply some method of getting storm water to the detention area by either a crown road and curb inlet or area inlet up stream of the detention pipe. Please note that the detention facility is already in place. The second, is the requirement of a screening fence along the shared property line with Wildwood Apartments. Whenever an Industrial Use abuts residentially zoned property, a screening fence is required. Said screening wall or fence: 1.
