located south of the Owasso Recycle Center and contains 3 acres, more or less.
7. Site Plan Review - Roy Fickle - A request for review of a site plan for Roy Fickle. The

8. Final Plat - Castle Point Commercial Park - A request for a review of the final plat for
Castle Point Commercial Park, a commercial/office addition to the City of Owasso. The
property is described as being located directly north of the Owasso Walmart and is
located within the SW /4 of Section 20, T21N, R14E and contains 8.86 acres more or
less, comprised of 6 commercial lots.
9. Easement Vacation - Simmons Homes - A request for a review of an easement vacation
request on the Northerly 1' of South 11' utility easement on Lot 16, Block 4, Barrington
Point II.
10. Annexation Request - Kaiser - Francis Oil Company - A request for a review of an

MINUTES OF REGULAR MEETING
Tuesday, April 11, 1995
The Owasso Planning Commission met in regular session on Tuesday, April 11, 1995 in the
Council Chambers at the Owasso Community Center per the Notice of Public Meeting and
Agenda posted on the City Hall bulletin board at 4:30 p.m. on Thursday, March 30, 1995.

ITEM 4: SITE PLAN REVIEW - CHURCH OF THE NAZARENE - A REQUEST FOR
A REVIEW OF THE SITE PLAN FOR THE CHURCH OF THE NAZARENE
LOCATED ON LOT 9,--BLOCK 18 ORIGINAL TOWN OF OWASSO
FURTHER DESCRIBED AS 10 S BIRCH OWASSO OK THE GENERAL
LOCATION OF THE SUBJECT SITE IS THE NORTHWEST CORNER OF
BIRCH AND BROADWAY.
The Chair introduced the case, with the staff report given by Mr Rooney. The site plan request
is a reconfiguration of parking facilities for the church to add 21 new parking spaces on the west

side of the church and three handicapped parking spaces along Broadway. The current parking
along Birch Street will be removed. Technical Advisory Committee has reviewed the site plan
and offered no objections. Mr Cole moved to approve the site plan for Church of the Nazarene.

ITEM 5: ANNEXATION REQUEST -A & W DEVELOPMENT - A REQUEST FOR A
REVIEW OF AN ANNEXATION REQUEST BY A.& W DEVELOPMENT
FOR AN APPROXIMATE 100 ACRE TRACT LOCATED NORTH AND
WEST OF THE NORTHWEST CORNER OF E 116TH STREET NORTH AND
GARNETT ROAD FURTHER DESCRIBED AS A PORTION OF THE SE /4
OF SECTION 6 T21N R14E OF THE INDIAN BASE AND MERIDIAN
TULSA COUNTY, OKLAHOMA.
The Chair introduced the case, and the staff report was given by Mr Rooney. A & W
Development has submitted a petition of annexation to the City of Owasso for the above -
described property. The property is currently zoned AG (Agriculture) and will remain in that
zoning classification until a request for rezoning is received. Notification was given as required
by law and the Annexation Committee and Technical Advisory Committee both reviewed the
case and gave unanimous approval. Chairman Haynes moved, seconded by Mr Willey, to
approve the annexation of approximately 100 acres as requested by A & W Development.

ITEM 6: OPUD- I3- PITTMAN. POE, AND ASSOCIATES - A REQUEST FOR A
REZONING OF PROPERTY FROM AG (AGRICULTURE) TO PUD
(PLANNED UNIT DEVELOPMENT) TO ALLOW FOR THE
DEVELOPMENT OF RESIDENTIAL COMMERCIAL SHOPPING OFFICE
RESEARCH AND LIGHT INDUSTRIAL LAND USES. THE SUBJECT
PROPERTY IS DESCRIBED AS A PORTION OF THE NW /4 OF SECTION
20 T21N R14E OF THE INDIAN BASE AND MERIDIAN TULSA
COUNTY OKLAHOMA. THE SUBJECT PROPERTY IS LOCATED SOUTH

The Chair introduced the case, and the staff report was given by Mr Rooney. PUD #13 contains
126.805 acres of undeveloped land, with the exception of a residence. The subject tract is
bordered by U.S. Highway 169 on the east, Garnett Road on the west, 96th Street North on the
north, and property zoned RE (Residential Estates) on the south. The planned zoning would
allow for the development of a single - family low density residential area and a multi - family low
density area, allowing villa and townhome development. Other zoning areas include an
office /research /and light industrial area and commercial tracts. Although the Comprehensive
Plan calls for the area to be zoned low density residential, it was last updated in 1985 and is
outdated as it applies to this area. The applicant's request follows existing development trends.
Several area residents were present and voiced their concerns. The major areas of concern were
low water pressure, drainage, and the condition of 96th Street North. The main concern of the
residents was that of drainage and the problem of water standing in the area. A detailed
drainage report will be submitted by the applicant. Planning Commission concerns related to
the condition of 96th Street North, notably the fact that it is a two -lane street and will be
carrying much traffic and there are dangerous areas where the street curves. A concern was also
expressed about the intersection at 96th St N and Garnett Rd.
Mr Cole moved, seconded by Mr Willey, to approve OPUD -13 subject to the following
conditions:
1. That the applicant's Development Text and Conceptual Development Plan be considered
to be the Outline Development Plan as required by the PUD Chapter of the Owasso
Zoning Code.
2. That, unless specifically set out in the standards and conditions of this PUD, single -
family detached lots shall meet all the necessary requirements of a typical RS -1 district.
That a subdivision plat be approved by the Owasso City Council and filed with the
County Clerk's Office prior to the issuance of a building permit. Said covenants shall
incorporate all PUD standards and conditions of approval and make the City of Owasso
beneficiary.
4. All conditions imposed by the Owasso Technical Advisory Committee for subdivision
plat approval be met as conditions of the PUD.
5. A detailed drainage report be submitted by the applicant.

6. That within the PUD, the maximum number of dwelling units shall not exceed 170 units.
7. Sidewalks shall be provided along all streets within the PUD subject site, as well as East
96th Street North and Garnett Road.
8. That all landscaping plans for the buffer areas shall be reviewed and approved by the
Owasso Planning Commission and installed prior to the construction of any area abutting
the residential portion of the PUD.

ITEM 7: OZ- 95- 02 -TYANN DEVELOPMENT - A REQUEST FOR REZONING OF
PROPERTY FROM AG (AGRICULTURE) TO CG (COMMERCIAL
GENERAL) AND OM (OFFICE MEDIUM) LOCATED IN THE SE /4 OF THE
NW /4 OF SECTION 20 721N R14E OF THE INDIAN BASE AND
MERIDIAN TULSA COUNTY OKLAHOMA AND CONTAINS 18.39
ACRES MORE OR LESS. THE SUBJECT PROPERTY IS GENERALLY
LOCATED NORTH OF THREE LAKES ADDITION WEST OF SMITH
ELEMENTARY.
Tyann Development requested a rezoning of recently annexed property from AG to CG and OM.
The property is located directly north of Three Lakes II subdivision, east of U.S. Highway 169,
and west of Smith Elementary School, and contains approximately 18.399 acres. Although most
of the plot will be zoned CG, an OM buffer zone will be required between the CG zoning and
the existing residential area. The buffer area will require the construction of a site obstructing
fence, a minimum setback of 40 feet from any of the abutting residential and school property,
and substantial landscaping along the abutting lines with the residential property. A detention
area has been included in the southeast comer of the property. Several citizens were present
with a list of their concerns. Those concerns included water pressure, drainage, the type of
fence and where it will be placed, drainage, types of businesses allowed and their hours, size
of buildings, lighting, traffic through the residential area, what will happen to existing trees, will
this development encourage loitering, does the site plan have to be followed, the width of the
buffer zone, commercial uses close to a school, and a detention pond close to a school. Mr
Steve Compton, representing the developer, addressed each of the concerns. The residents were
reminded that the Planning Commission will review any plat and all site plans that may occur
within this property.

ITEM 8: OLS -95 -02 -CITY OF OWASSO - A REQUEST FOR A LOT SPLIT BY THE
CITY OF OWASSO. THE SUBJECT PROPERTY IS DESCRIBED AS BEING
LOCATED IN THE NE /4 OF SECTION 31 T2IN R 14 OF THE INDIAN
BASE AND MERIDIAN TULSA COUNTY OKLAHOMA AND CONTAINS
APPROXIMATELY THREE ACRES. THE SUBJECT PROPERTY IS
LOCATED SOUTH OF THE OWASSO RECYCLE CENTER.
The City of Owasso requested approval of a lot split for property located south of Precision
Components and the Recycle Center. The three -acre tract will be split into two 11h -acre tracts.
One of the tracts will be purchased by a company wanting to relocate. The property is zoned
AG (Agriculture) and will need to be rezoned prior to the property being utilized. The
Technical Advisory Committee requested a 17.5 foot utility easement around the perimeter of
both lots created by the lot split. Mr Willey moved, seconded by Mr Brown to approve the
requested lot split.

ITEM 9: PRELIMINARY PLAT - CASTLE POINT COMMERCIAL PARK - A REQUEST
FOR A REVIEW OF THE PRELIMINARY PLAT FOR CASTLE POINT
COMMERCIAL_ PARK, A COMMERCIAL /OFFICE ADDITION TO THE
CITY OF OWASSO. THE PROPERTY IS DESCRIBED AS BEING LOCATED
DIRECTLY NORTH OF THE OWASSO WAL -MART AND IS LOCATED
WITHIN THE SW /4 OF SECTION 20 T21N R14E AND CONTAINS 8.86
ACRES MORE OR LESS COMPRISED OF SIX COMMERCIAL LOTS.
Tyann Development has submitted a request for a review of the preliminary plat for Castle Point
Commercial Park. This is an 8.86 acre tract located immediately north of Wal -Mart. It was

recently annexed and zoned CG and OM. When this property was rezoned, the City Council
requested the ability to enforce the covenants of this addition, if the developer does not enforce
them, and that item has been added to the covenants. All comments presented by the Technical
Advisory Committee have been addressed. Mr Cole moved, seconded by Mr Wells to approve
the Preliminary Plat for Castle Point Commercial Park.

ITEM 10: FINAL PLAT -THE VILLAGE AT SOUTHERN LINKS - A REQUEST FOR A
REVIEW OF THE FINAL PLAT FOR THE VILLAGE AT SOUTHERN
LINKS AN ADDITION TO THE CITY OF OWASSO THE PROPERTY IS
LOCATED SOUTH OF E 86TH STREET NORTH AND LIES WITHIN THE
W/2 OF SECTION 30 T21N R14E AND CONTAINS 61 RESIDENTIAL
LOTS ON 17.19 ACRES.
Items 10, 11, and 12 were discussed as one, however, each of the three items was voted on
separately. This development is located south of 86th Street North and is the development
surrounding the southern portion of the golf course. The property is zoned PUD and allows for
several different size residential lots. No commercial, office, or multi- family development is
included within this portion of the PUD. All three plats have been reviewed by the Technical
Advisory Committee. All comments received from that committee have been addressed. The
Golf Authority has expressed some concerns about the covenants for the development. The
developers will be meeting with the Golf Authority at their April meeting. An area of
contention for the Planning Commission was a statement in the staff report alluding to the fact
that The Summit may become a "gated" community. That issue was discussed at length, with
the developer assuring the Commission that it is not his intention to "gate" The Summit.

Links.

LINKS AN ADDITION TO THE CITY OF OWASSO THE PROPERTY IS
LOCATED IMMEDIATELY WEST OF THE VILLAGE AT SOUTHERN
LINKS AND LIES WITHIN THE W/2 OF SECTION 30, T21N, R14E AND
CONTAINS 23 RESIDENTIAL LOTS OF 11.31 ACRES.
Mr Wells moved, seconded by Mr Willey to approve the Final Plat for The Estates at Southem
Links.

ITEM 12: FINAL PLAT -THE SUMMIT AT SOUTHERN LINKS - A REQUEST FOR A
REVIEW OF THE FINAL PLAT FOR THE SUMMIT AT SOUTHERN LINKS
AN ADDITION TO THE CITY OF OWASSO. THE PROPERTY IS
IMMEDIATELY SOUTH OF THE ESTATES AT SOUTHERN LINKS AND
LIES WITHIN THE W/2 OF SECTION 30 T21N R14E AND CONTAINS 29
RESIDENTIAL LOTS OF 15.30 ACRES.
Mr Willey moved to approve the Final Plat for The Summit at Southern Links, with the
following paragraph being stricken from the staff memorandum:
"It is also likely that the areas contained with The Summit at Southern Links will
contain some form of 'private access" to this portion of the development. An
agreement will have to be obtained between the developers and city emergency
and utility services as to the extent of which this "private access" is utilized.
Again, this agreement will likely be presented to the Planning Commission at a
later date for approval."

Mr Rooney announced an annexation request at the southeast corner of 86th St N and 129th E
Ave.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: A & W Development, applicants and
owners.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
AG (Agriculture) to RS -3 (Residential Single - Family High Density District) to allow for
residential development.
LOCATION AND SIZE: The property is described as being north and west of the
northwest corner of E. 116th Street North and Garnett Road and contains approximately 100
acres more or less. The complete legal description is attached for your information and
review.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the west by the Westport
Addition zoned AG (Agriculture). The subject property is abutted on the south by E. 116th
Street, Hughes Lumber, and the Mennonite Church zoned AG and CG, while further south
lies the Hale Acres addition zoned RS -1. North of the subject property is predominately
undeveloped land, while east of the subject property is Garnett Road, while further east is
also predominately undeveloped land. Both areas are zoned AG (Agriculture)
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", and Chapter 4 "Residential District Provisions."
SITE INFORMATION: No unusual development hardships are noted, other than drainage
detention will be monitored closely be engineering staff upon development. You may recall
this item was brought to your attention at the annexation hearing for this property.

ANALYSIS
The proposed rezoning, if approved, would create an approximate 100 acre area of
residentially zoned property with access to both Garnett Road and E. 116th Street North.
This is the first residential rezoning request to be reviewed by the Planning Commission in
this area of the community in over 10 years.
Staff has reviewed this request and feels that any RS -3 development would not be detrimental
to surrounding property owners and will only enhance this area of the Owasso community.
Again, the applicant is requesting a 100 acre area of RS -3 zoning. RS -3 zoning exists in
many areas of Owasso, the most recent of which to develop are the Double Oaks and Copper
Meadows areas.
While staff can sympathize with those neighboring property owners who would have
preferred the subject property to remain an open field and not be developed in any manner,
the owners of the subject property do have a right to develop their property providing it is
not detrimental to the surrounding properties. The German Corner area, an area which for
many years has been in a state of decline and decay, would receive a tremendous boost upon
a new residential addition in their area. While the Westport Addition is zoned Agriculture,
the most appropriate zoning category would be RS -2 as the lots contained within that addition
would meet that zoning bulk and area requirements. There is a fine line between RS -2 and
RS -3, and staff does not feel that this will impact that area in a negative manner.
Staff has received many inquiries regarding this zoning request. Approximately 90% of
these inquiries have centered around false information - that the zoning would allow for
homes to be built on septic and /or lagoon. Staff met with several of the property owners
from this area, along with the applicants, to explain the rezoning request. After being
informed of the facts regarding the rezoning case, those individuals who attended the meeting
did not appear to have objections. Most of the individuals did express concerns regarding
the covenants of any proposed development. One letter was received opposing the rezoning
request.
The subject property was posted the last week of April and legal ads were published in the
Owasso Reporter. Letters were also mailed to property owners within 300' of the rezoning
request. Copies of the legal ad and letter are attached for your information and review.
The applicants should note that acceleration /deceleration lanes as well as sidewalks will be
required along E. 116th Street North and Garnett Road as a part of any platting process and
subdivision development.

Staff is recommending approval of the rezoning request from AG (Agriculture) to RS -3
(Residential Single - Family High Density) zoning district.

In response to your letter regarding zoning earing for application
Oz -95 -03 by A &W Devel.opmbnt on May 09, 1995, we would like to provide
the following imput for the hearing.
As adjacent major property owners, we hereby protest the requested
zoning change for high intensity residential single family zoning.
Our objections are as follows:
The proposed high density residential zoning would not be in
harmony with the established low density rural housing pattern of the
neighborhood and would depress property values. The area is dotted
with 2 and more,acre estates and our desire is to make the area around
the German corner a nicer place to live. High density zoning would
invite a build up of tacky lower cost subdivision which would require
a considerable amount of additional school, sewer facilities, police
protection, etc. Recent studies have shown that high density housing
also invites increased crime, drugs, gangs, and other undes±table activ-
ities.
We,therefore, would like to ask the board to modify the zoning
request to allow only low density, single family zoning, which would
direct a more natural growth in tiLne with the existing neighborhood.
Also, a 200 foot plus wide strip of this property along North
Garnett road should be zoned or set aside for commerical use because
North Garnett road is an expressway feeder road and most properties
along this road are already zoned or established with commercial or
industrial use.

The City of Owasso has received a request to review a preliminary plat for A & W Development
for their proposed development titled Country Estates. Country Estates is located north and west
of the northwest corner of E. 116th Street North and Garnett Road and would contain
approximately 100 acres of single - family residential housing upon completion. Phase I of this
development reflects that it would consist of 136 lots on 41.93 acres of property. Please note
that action on this request is contingent upon approval of Item #4.
The Technical Advisory Committee reviewed the preliminary plat at their April 26, 1995
meeting. At that meeting, the applicants were supplied with a list of staff corrections to the plat.
In addition to staff comments, the utility companies also had several requests for easements at

The construction plans are still in their review process and should not be looked on as lacking
any significant information at this time as this is a preliminary plat. A memorandum from Rohn
Munn, Engineering Technician, is attached for your information and review. The plat itself
reflects two entrances, one each from Garnett Road and E. 116th Street North. Each entrance
will be required to utilize an acceleration /deceleration lane. Phase I of Country Estates does
contain a detention area.
As stated in the rezoning case, several property owners had concerns regarding the covenants.
The covenants of this addition are of a fairly standardized nature, requiring 2 car garages, 50%
brick or stone, etc. A copy was provided to Mrs. Bailey of the Westport addition to share with
those property owners who attended the meeting.
RECOMMENDATION
Staff is recommending Planning Commission approval of the preliminary plat for Country
Estates.

REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
AG (Agricultural) to IL (Light Industrial) to allow for industrial development.
LOCATION AND SIZE: The property is located directly south of the Owasso Recycle
Center and involves two newly created lots (OLS- 95 -02). The complete legal description of
both lots are attached for your information and review. The subject property contains 3
acres, more or less.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by Fifth
Avenue, while further north lies the Owasso Recycle Center and Precision Components. The
Owasso Recycle Center is zoned RM -1 and operates via a special exception, while the
Precision Components facility is zoned IL. To the east of the subject property is
undeveloped property zoned IL, the northern most portion of which will contain the National
Steak and Poultry facility. South of the subject property is undeveloped land owned by the
City of Owasso zoned AG (Agriculture), while west of the subject tract is a large drainage
area, while further west is the sewage treatment facility and the animal shelter. This area is
also zoned AG (Agriculture).
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 7 "Industrial Land Uses ".
SITE INFORMATION: No unusual development hardships are noted.
ANALYSIS
The proposed rezoning, if approved, would create an 3 acre area of industrial zoned property
for the applicant. The subject property, although not surrounded by industrial zoning, is
virtually surrounded by industrial land uses. While currently zoned AG (Agriculture), it is
unlikely that the subject property would develop if the current zoning pattern was to remain.
The subject property was recently approved as a two -lot lot split.

The light industrial zoning being requested does conform to the surrounding development
trend of this area and staff feels further development of this area will enhance the
marketability of a light industrial base in the City of Owasso. All utilities are available to
the subject property and the ability to develop this property is not thwarted due to its
proximity to residential areas. The extension of Fifth Avenue to the Owasso Expressway
will provide better access to the site as well.
Letters were sent to surrounding property owners within 300' of the subject property and
notification was published in the Owasso Reporter on April 20, 1995. The subject property
was also posted the last week of April. Staff has received no comments opposing the
annexation request.
RECOMMENDATION
Staff feels a rezoning and use of this property in an industrial manner would be consistent
with the existing development patterns and uses in this area. Staff recommends approval of
the rezoning request from AG to IL.

SECTION 700 PURPOSES OF INDUSTRIAL DISTRICTS
700.1 General Purposes
The Industrial Districts are designed to:
a. Achieve the industrial objectives of the Comprehensive Plan.
b. Meet the needs for industrial services and goods of the City
of Owasso trade area.
c. Preserve and promote the development of efficient industrial
areas and to minimize the adverse effects of industrial uses

SECTION 720 ACCESSORY USES PERMITTED IN INDUSTRIAL DISTRICTS
720.1 Accessory Uses Permitted
Accessory uses customarily incident to a principal use permitted in an
industrial district are permitted in such district.
720.2 Accessory Use Conditions
a. Accessory buildings shall meet the minimum building setback lines of
the applicable district.
b. An accessory building erected as an integral part of the principal
building shall be structurally a part thereof, shall have a common
wall therewith, and shall comply with the requirements applicable
to the principal building.
c. Accessory storage of materials, equipment, or products within 200 feet
of an abutting R or AG district shall be screened by the erection of a
screening wall or fence along the lot line or lines in common with the
abutting R district.
d. Business signs for scientific research facilities and institutions not
exceeding in the aggregate .5 square feet of display surface area per
one (1) lineal foot of street frontage may be erected on each street
frontage of a lot. Ground signs shall not exceed 30 feet in height.
No business sign shall be located within 50 feet of an R or AG dis-
trict if visible from such distrct. Illumination, if any, shall be by
constant light and be hooded so as to not have any upward glare.
e. Except as provided in (d) above, accessory signs in the IL, IM, and
IH districts are subject to the use conditions in Use Unit 21.

Roy Fickle has submitted a site plan for review by the Owasso Planning Commission. The
subject site is the western most lot created via a lot split approved by the Owasso Planning
Commission in April, and is located south of Fifth Avenue, directly south of the Owasso
Recycle Center. A copy of the lot split, Mr. Fickle's property is highlighted, is attached for
your information and review. Action on this item is contingent upon the approval of the
rezoning request from AG to IL (see agenda #6).
Light Industrial zoning permits the development of light manufacturing industries by right. Mr.
Fickle's business makes and refurbishes polycarts used for residential/commercial refuse. The
materials submitted by Mr. Fickle indicate a 40 x 80' building, thus requiring a minimum of
four parking spaces per the Owasso Zoning Code. The site plan submitted indicates 6 parking
spaces (one of which is designated for the handicapped) and a small area for landscaping on the
property.
The site plan was reviewed by the Owasso Technical Advisory Committee at their April 26,
1995 meeting. The only comments that resulted from that meeting were staff oriented. Staff
is recommending that the access drive shown on the plan as being 15 feet in width be widened
to a minimum of 20 feet and that all surfaces that are going to be driven on be of a "dust free
all- weather material." Therefore, the surfaces indicated as gravel on the site plan would need
to be amended.
RECOMMENDATION
Staff would recommend approval of the proposed site plan as presented conditioned upon the
widening of the access drive to 20 feet and the parking and access drives being constructed of
a dust free all- weather material.

A request for a review of the final plat for Castle Point Commercial Park has been submitted
to the City of Owasso by Tyann Development. Castle Point Commercial Park is an 8.86 acre
tract located immediately north of Walmart, east of Highway 169 and was recently annexed and
zoned CG and OM. The preliminary plat for Castle Point Commercial Park was approved by
the Owasso Planning Commission in April.
The Technical Advisory Committee reviewed the final plat on April 26, 1995. Comments from
that meeting included (1) the clarification of an easement measurement at the rear of Lot 3 on
the plat, (2) fire hydrant locations will be verified at the time of site plan review and (3)
clarification of the street name (Owasso Expressway). Staff's only comment was to ensure that
the applicants were aware that acceleration /deceleration lanes will be required.
All comments have been addressed at this time. Please be advised that when the rezoning of
this property was presented to the City Council for action, several agreements were made
between Tyann Development and the Council regarding the content of the covenants. The
Council specifically requested to have the ability to enforce the covenants of the addition, should
the developer and /or its successor not enforce them. This has been added to the covenants.
If the Planning Commission approves the final plat request, the plat will not be presented to the
Owasso City Council until the construction plans have been reviewed and approved by the Public
Works Department and permits issued by the State Health Department for the construction of
water and wastewater lines.
RECOMMENDATION
Staff recommends approval of the final plat for Castle Point Commercial Park.

BACKGROUND:
The City of Owasso has received a request for the vacation of a portion of a utility easement
located on the northerly one foot of the southern most 11 foot utility easement located on Lot
16, Block 4, Barrington Point H. The subject property is currently developed with a single -
family residence, however no utilities are located within that portion of the utility easement that
the applicant is seeking to be vacated. A site plan for the dwelling on the lot is enclosed for
your information and review.
The site plan originally reviewed by staff showed that the building would be located outside of
the 11'. utility easement but would require a stemwall survey. Currently, the City of Owasso
requires stemwall surveys whenever a proposed structure will be located within 6 feet of a utility
easement. The initial stemwall survey indicated that there was no conflict, however when the
applicant was to receive the land surveyor's inspection plat and certificate for loan purposes, the
structure was shown encroaching into the easement approximately 1 foot.
The Technical Advisory Committee reviewed the easement request at their April 26, 1995
meeting and had no objections to the request. Please be advised that there are no utilities located
within this portion of the easement and the structure would still meet the required side yard
setback requirements of an RS -2 district if the vacation request is approved.
RECOMMENDATION:
Staff recommends approval of the easement vacation request, vacation the northern most foot
of the southerly 11 foot utility easement on Lot 16, Block 4, Barrington Point lI.

BACKGROUND
Kaiser- Francis Oil Company has submitted to the City of Owasso a petition for annexation of
their property totaling approximately 356.5 acres. The subject property is shown on the attached
map and is currently undeveloped.
The subject property is currently zoned AG (Agricultural) and would remain zoned AG upon
annexation. All property annexed by the City of Owasso is required to be zoned the lowest
zoning classification (AG) until any rezoning request is received and approved by the Planning
Commission and the City Council. A copy of the City of Owasso's annexation policy is attached
for your information and review. If annexation is approved, the subject property will have to
go through all platting requirements of the City of Owasso prior to any development. It should
be noted that upon any development of this property, acceleration /deceleration lanes would need
to be included for all entries along N. 129th E. Avenue and E. 86th Street North, as well as
sidewalks.
Notification of the annexation request was published in the Owasso Reporter on April 27, 1995
to notify the public of the annexation request before the Planning Commission on May 9th. That
notification will be followed by notification published two consecutive weeks in the Owasso
Reporter on May 4 and 11, 1995 to notify the public of City Council action regarding the

further development of their property. All legal uses annexed
into the city will be legal, but non - conforming, which means

BACKGROUND
Mr. and Mrs. Michael & Nancy Criswell and W. and Mrs. Joe & Vicky Ramey have submitted
a petition for annexation of their individually owned properties, each totaling approximately 2.5
acres. The subject properties are shown on the attached map. Because the Ramey property does
not currently abut the city limits, annexation of the Criswell property is necessary in order to
consider the Ramey request as the Criswell property abuts both the east boundary of Bailey
Ranch Estates (city) and the Ramey property. The Criswell property is developed with a single -
family residence and the Ramey property is currently under development for a single- family
residence. Due to the proximity of both requests, staff has presented one memorandum for both
items.
The subject properties are currently zoned RE (Residential Estates) and would become zoned AG
upon annexation. All property annexed by the City of Owasso is required to be zoned the lowest
zoning classification (AG) until any rezoning request is received and approved by the Planning
Commission and the City Council. A copy of the City of Owasso's annexation policy is attached
for your information and review. If annexation is approved, staff would recommend a rezoning
request to RE.
It should be noted that both subject properties currently utilize septic, but will have the ability
to tap into the sewer located on the Bailey Ranch Estates property during phase III of its
development. The road is a private roadway requiring no maintenance by the City of Owasso,
therefore no publicly maintained infrastructure would be annexed into the City if annexation was
approved.
Notification of the annexation request was published in the Owasso Reporter on April 27, 1995
to notify the public of the annexation request before the Planning Commission. That notification
will be followed by notification published two consecutive weeks in the Owasso Reporter on
May 4 and 11, 1995 to notify the public of City Council action regarding the request. A copy
of the procedures for annexation are also attached for your information and review.
The Technical Advisory Committee reviewed this request at their April 26, 1995 meeting and
had no objections to the annexation request. The Owasso Annexation Committee reviewed the
annexation requests at their April 27, 1995 meeting and recommended denial on both the
Criswell and Ramey requests (3 -2 and 2 -2 -1). Please note that both subject properties are listed
as separate items on the agenda and should be acted upon separately, with action on the Criswell
request first.

BAILEY RANCH ESTATES
ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the
lowest zoning classification, that is,_ AG, agricultural.
Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
and accepted by the City Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
5. Where a - city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.

City Council Hearing which will include a map and text of the
proposed annexation.*
6. City Council hearing and action on the proposal.
7. If the proposal is approved by the City Council, an Ordinance will
be prepared, approved, published, and filed of record with the
office of the County Clerk, with a map of the property annexed.
CITIZEN SPONSORED ANNEXATION:
1. Submission to the City Planner of an application and petition and an
administrative fee as prescribed by Ordinance.
2. Review by a Standing Annexation Committee and recommendation to the
