OWASSO PLANNING COMNIISSION MINUTES OF REGULAR MEETING Tuesday, July 11, 1995, 7:00 PM Owasso Community Center 301 S Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Charles Willey Gary Wells Dewey Brown Jerry Cole STAFF PRESENT Tim Rooney Marsha Hensley The agenda for the meeting was posted in the Owasso City Hall, 207 S Cedar, on Wednesday, July 5, 1995. 1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 p.m. and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 13, 1995 REGULAR MEETING - The Commission reviewed the minutes of June 13, 1995. Dewey Brown moved, seconded by Jerry Cole to approve the minutes as written. A vote on the motion was recorded as follows: Dewey Brown - Yes Charles Willey - Yes Ray Haynes - Yes Gary Wells - Yes Jerry Cole - Yes The motion carried 5 -0. 4. OZ -95 -06 - First Bank of Owasso - A request for a rezoning of property from RM -1 (Residential Multi- Family Low Density) to CG (Commercial General) on property located within the 8500 Block of North 123rd E. Avenue, immediately north of the Sequoyah Pointe Living Center. Jerry Cole moved to approve the request for rezoning, seconded by Charles Willey. OPUD -9 (a) - Dominion Corporation - A request for review of a Planned Unit Development amendment, said amendment to the underlying zoning of the PUD, changing a 6.94 acre portion from RS -3 (Residential Single - Family High Density) to RTH (Residential Townhomes). The subject property is located in the extreme southeast corner of the Bailey Golf Ranch. The Chair introduced the case and the staff review was given by Mr. Rooney. The property is currently undeveloped, however the residential areas to the north are currently under development. The applicant is requesting an amendment to the underlying zoning of a previously approved PUD, changing said zoning from RS -3 to RTH, in order to allow for residential townhouse development rather than residential single - family. Access to this area of the PUD would still be coming south from E. 86th Street North through the developing residential areas to the north and would not adversely effect traffic in existing areas. Approximately 40 surrounding property owners were present to protest the zoning change. The following list was compiled from comments made by citizens and the applicant: CITIZENS: A petition was signed by the property owners in that area, everyone in the neighborhood is against the townhomes. If there was a site obstructing fence, we would have no breeze. An interest as to whether the easements can be changed. - Richard Cramer 2. Afraid that the value of the homes in the area will go down. - Fred Prickett Owasso Planning Commission Minutes of July 11, 1995 Page No. 3 3. Does not want to see more rental property in that area. Concerns with drainage in that area. - Roger Whiteside 4. There is a drainage problem in the neighborhood already. - Jim Testerman 5. We oppose multi housing and are worried about the traffic in the area, RS -3 would be much more acceptable. - Donnie Wooten 6. There is a bad taste for apartments because of the ones already in the area. - Don Ketcherside 7. Townhomes will be setting up against her property, taking her privacy away. - Lois Prickett 8. There will be a lack of privacy due to the two -story buildings. The traffic problems will do nothing but get worse. - Victor Sanders 9. The townhomes will be buffers from the golfballs that come flying in the backyard. - Mike Eubank 10. Concerns with traffic, crime and speeding. We already have apartments in the area to worry about, why have something else. - Donna Green COMMENTS FROM THE APPLICANT: 1. We are not planning on building apartments, it is townhomes we are trying to market. Although, we do not have development plans as of yet. 2. We have been trying to resolve the drainage issues. 3. There will be a solid concrete fence surrounding the area. 4. I have no interest in buying homes in your area for a through street because of the crime of the area, the entrance into the division will be on 86th Street North. Jerry Cole moved to approve the request for rezoning, seconded by Ray Haynes. Chairperson Ray Haynes recessed the meeting at 8:20 p.m. and reconvened at 8:35 p.m. 6. OLS -95 -03 - Blanche In Ig ima - A request for a review of a proposed lot split application. The subject property is located at Lot 6, Block 1, Three Lakes Addition, further described as 11611 E. 84th Court North. The Chair introduced the case and the staff review was given by Mr. Rooney. Dewey Brown moved to approve the request of a lot split, seconded by Charles Willey. A vote on the motion was recorded as follows: Charles Willey - Yes Dewey Brown - Yes Gary Wells - Yes Ray Haynes - Yes Jerry Cole - Yes The motion carried 5 -0. 7. Easement Closing - John J. Livingston - A request for a review of an easement closing request located within Lot 1, Block 19, Elm Creek Estates Addition. The subject property is located immediately south of Wildwood Apartments on E. 80th Street North. The Chair introduced the case and the staff review was given by Mr. Rooney. Charles Willey moved to approve the Easement Closing, seconded by Dewey Brown. Final Plat - The Fairways at Bailey Ranch - Kourtis Properties - A request for a review of the final plat for The Fairways at Bailey Ranch. The subject property is located north of E. 86th Street North, east of the clubhouse facility and contains 80 lots on 29.68 acres, more or less. The Chair introduced the case and the staff review was given by Mr. Rooney. Mr. Rooney explained that the Preliminary Plat for The Fairways had been approved by the Planning Commission at the January regular meeting. Ray Haynes moved to approve the final plat for The Fairways at Bailey Ranch, seconded by Dewey Brown. A vote on the motion was recorded as follows: Charles Willey - Yes Dewey Brown - Yes Gary Wells - Yes Ray Haynes - Yes Jerry Cole - Yes The motion carried 5 -0. 9. Final Plat - Country Estates - A & W Development - A request for a review of the final plat for Country Estates. The subject property is located north and west of the northwest corner of E. 116th Street North and Garnett Road and contains 138 lots on 41.38 acres, more or less. The Chair introduced the case and the staff review was given by Mr. Rooney. The Technical Advisory Committee reviewed the final plat at their June 28, 1995 meeting. Charles Willey moved to approve the final plat, seconded by Gary Wells. Report on Planning Items Previously Forwarded to City Council. #OZ -95 -05 - Kaiser- Francis, was denied 1 -4, amended to take out commercial, withdrawing all RM -1 zone, neighbors are still concerned about Office Light by Pam Hobson. 12. A vote on the motion was recorded as follows: Dewey Brown - Yes Charles Willey - Yes Ray Haynes - Yes Gary Wells - Yes Jerry Cole - Yes Owasso Planning Commission Minutes of July 11, 1995 Page No. 7 The motion carried 5 -0 and the meeting was adjourned at 9:10 p.m. Chairperson Secretary Date MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: EASEMENT CLOSING REQUEST - LEE ROLLINS DATE: August 1, 1995 BACKGROUND: The City of Owasso has received a request for the closing of a portion of a utility easement described as the easterly one foot of the western most 17.5 foot utility easement located on Lot 1, Block 1, Ram Plaza. The subject property is currently within the development process for a mixed use commercial /office structure, however no utilities are located within that portion of the utility easement that the applicant is seeking to be closed. A subject map has been enclosed for your information and review. The site plan originally reviewed by staff showed that the building would be located immediately adjacent but outside of the 17.5' utility easement, thus requiring a stemwall survey. Currently, the City of Owasso requires stemwall surveys whenever a proposed structure will be located within 6 feet of a utility easement. The initial stemwall survey indicated that there was no conflict, however when the applicant received the bank survey it reflected an encroachment of .2 feet. Due to a lack of items for a regular Technical Advisory Committee meeting, requests for input from the Technical Advisory Committee were sent via facsimile, and no objections to the closing request were received by staff. A copy of all correspondence received from the TAC members is attached for your information and review. Please be advised that there are no utilities located within this portion of the easement and the structure would still meet the required side yard setback requirements of the PUD. Staff has no objections to the utility easement closing request. RECOMMENDATION: Staff recommends approval of the easement closing request, thus closing the eastern most l' of the westerly 17.5' utility easement on Lot 1, Block 1, Ram Plaza. ATTACHMENTS: 1. No utilities are located within this portion of the utility easement and all property development standards are currently, and would continue to be, in compliance with the City of Owasso.
