7. Final Plat Amendment - Double Oaks Extended (2914 - A Request for Approval of an
Amended Final Plat of Double Oaks Extended, an Addition to the City of Owasso,
Located in Section 29, T21N, R14E of the I.B.M., Tulsa County, Oklahoma. The
subject property would contain 96 Lots on a 29.32 Acre Area. The Double Oaks
Extended Final Plat was Approved by the Planning Commission on May 10, 1994.

1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 p.m.
and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF APRIL 12, 1994 - The Commission
reviewed the minutes of April 12, 1994. Dewey Brown moved, seconded by Charles
Willey, to approve the minutes as written. A vote on the motion was recorded as

4. Site Plan Review. - Pete Kourtis - A Request for a Site Plan Review of Kourtis Office
Center, Lots 11 and 12, Block 2, Elm Creek Commercial Corner.
The Chair introduced the case and the staff review was given by Mr. Rooney.
The site plan does adhere to Owasso Zoning Code requirements for setbacks, parking, etc. It
should be noted that this area is zoned CG (Commercial General), suitable for both commercial
and office uses. At this time, two tenants have been identified. Pete Kourtis Homes and Delta
Software plan to locate their facilities at this location.

5. OZ -9402 Elaine Parmley_(3114)-A Request to Rezone a Tract of Land Located in
Section 31, T21N, R14E from RS -3 (Residential Single - Family High Density) to CG
(Commercial General). The Subject Property is More Particularly Described as Lots 3
& 4, Block 33, Owasso Original Town Addition and is Generally Located at the
Southeast Corner of S. Main Street and Fourth Avenue.
The Chair introduced the case and staff review was given by Mr. Rooney. Mr. Rooney
explained in his report that the property was once used as a residence. He went on to say that
if approved, this would be the first IL zoning within this block.
While it is possible that at one time the subject property could obtain IL zoning, staff felt it was
not a logical expansion at this time. A letter from nearby and surrounding property owners
opposing the request was presented to the Planning Commission,
Robert Young stated that the property has not been used residentially due to being located within
the flood plain. He explained that it had been over thirty years since the property flooded.
Melody Hayes stated she has been there for many years and has two children. There are no
sidewalks and all activity is within the street. She felt it needed to stay as residential.
Charles Willey moved to deny the request to rezone, seconded by Pat Imbriano.

6. OZ -9403 - City of Owasso (3114)- A Request to Rezone a Tract of Land Located in the
NE/4 of Section 31, T21N, R14E from an AG (Agricultural) and RM -1 (Residential
Multi- Family Low Density) districts to IL (Industrial Light). The General Location of
the Subject Property is Directly South of Cedarcrest Apartments.
The Chair introduced the case and the staff review was given by Mr. Rooney.
As stated in the previous zoning case, the expansion of a zoning of this intensity should be of
a logical planned pattern, rather than "spot zoning' to be surrounded by a largely different
zoning classification. This site is abutted on two sides by industrial zoning and development and
a rezoning of this property to the same classification is logical. In fact, without a rezoning, one
is likely to never see the subject property develop further in any manner.

8. Final Plat - Double Oaks Extended - A Request for a Review of a Final Plat for Double
Oaks Extended, an Addition to the City of Owasso, Located in Section 29, T21N, R14E
of the I.B.M., Tulsa County, Oklahoma. The Subject Property would Contain 95 Lots
on a 29.32 Acre Area.
The Chair introduced the case and the staff review was given by Mr. Rooney.
Two citizens were present to voice objections to the Double Oaks Extended Final Plat. They
explained that when they purchased their lots, they were showed a map that had larger lots on
the Double Oaks Extended property, not the smaller ones being proposed. They asked the
Planning Commission to table the plat.
Mr. Rooney explained that the plat meets all Zoning Code and Subdivision Regulation
requirements and therefore should not be tabled or denied. He stated the concerns voiced by
the gentleman may be valid, but need to be addressed by the developer. Mr. Rooney offered
to set up a meeting with the developer and the gentleman so that opposing parties could discuss
this before Council action.
Gary Wells moved to approve the Final Plat for Double Oaks Extended, seconded by Dewey
Brown, with the recommendation that Mr. Rooney set up a meeting with the developer and the
aggrieved parties.

would contain 46 Lots on a 26.49 Acre Area.

Division with several corrections being requested. All major changes have been made and any
remaining changes are viewed as minor and should not prevent action on this final plat. The
Planning Commission and the applicant should note that no action will be taken on this plat by
the City Council until a final set of construction plans exist.

Property would contain 46 Lots on a 26.49 Acre Area.
The Chair introduced the case and the staff review was given by Mr. Rooney. He explained that
the two areas of concern during the preliminary plat have been addressed. Sanitary Sewer was
obtained via an easement through the Brentwood Estates property. An agreement has been
reached regarding the construction entrance. The Planning Commission recommended that the
developer install this road as quickly as possible.

LOT 1, BLOCK 1, OWASSO COMMERCIAL CENTER III

BACKGROUND
The City of owasso has received a request from Robert Patel for a review of a site plan for the
Owasso Best Western Motel to be located on Lot 1, Block 1 of Owasso Commercial Center III.
The general location of the property is directly east of the Golden Corral restaurant. The subject
site is zoned CS (Commercial Shopping Center) district which permits a motel by right.
The site plan for Best Western has been through numerous review processes prior to being
forwarded to the Planning Commission. Most recently, it was reviewed by the Technical
Advisory Committee at their June 1, 1994 meeting. At that meeting there were several
remaining comments regarding the site plan which are attached for your information and review.
Please note that major concerns had been previously addressed through the other staff and TAC
reviews. The site plan enclosed within your packet contains all recommended
changes /corrections.
The Owasso Best Western will have a total of 60 rooms, requiring 60 parking spaces. 78 total
parking spaces are reflected on the plan. Access to the motel will be obtained from both the
service road and E. 76th Street North via the proposed cul -de -sac east of La Petite Day Care.
The service road access will be obtained from the shared driveway between Golden Corral and
Captain D's.
The applicant is aware that separate permits will be needed for all signage on the site. Staff has
no reservations regarding the finalized site plan contained within your packet.
recommendation
Staff would recommend approval of the proposed site plan, subject to a preconstruction meeting
to be held with the Community Development staff upon obtaining a building permit.

BACKGROUND
Mr. Bill Williams is requesting a lot split from the Owasso Planning Commission for an area
of property containing a previously abandoned street right -of -way, the northerly 35 feet of an
existing platted lot, and purchased excess right -of -way from. AT & SF Railroad. The subject
property is located west of the intersections of Atlanta Street and First Avenue, immediately
north of the Depot Steak House. The property is undeveloped at this time, however there are
two concrete areas contained on the proposed lot.
It may be easier to think of this request more as a lot tieing than a lot split. Abandoned street
right -of -way is available, as well as the excess railroad right -of -way. When the applicant looked
at both of these, and the portions of his property not being utilized, it was evident that an
additional lot could be created.
The subject property is zoned CH (Commercial High Intensity), as is the property both to the
north and south. CH zoning districts do not require a minimum lot size, however the applicant
was encouraged to have at least 100 feet of street frontage. Required minimum setbacks in CH,
upon development, also permit building at zero lot line unless abutted by a residential district.
The lot split proposed meets all zoning code criteria for a CH zoned lot.
The lot split request was presented to the Technical Advisory Committee on June 1, 1994. No
comments opposing the request were received at that meeting. Oklahoma Natural Gas did feel
it necessary to inform the applicant of a gas regulator located on the property that could interfere
with future site plans. The applicant is aware of the regulator and a copy of those notes from
the Technical Advisory Committee are attached for your information and review.
RECOMMENDATION
Staff recommends approval of OLS- 94 -01.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Midwest Time Control, Inc., applicant.
ownership is contracted based on obtaining rezoning of the property.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
RMH (Residential Mobile Home)to IL (Industrial Light District) to allow for the
development of clock manufacturing business.
LOCATION AND SIZE: The property is described as the E/2 of the NEA of the NW/4 of
the NE/4 of Section 7, Township 21 North, Range 14 East and contains 5 acres, more or
less. The general location of the property is the southwest corner of E. 116th Street North
and N. 109th East Avenue.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by E. 116th
Street North, while further north across the street lies property zoned Agriculture and
Commercial General. The subject property is abutted on the east by undeveloped property
zoned CS. The property to the south of the subject property is zoned RMH and contains
mobile home housing. To the west of the subject site is 109th E. Avenue and a church on
Agriculturally zoned property.
COMPREHENSIVE PLAN: The Comprehensive Plan identifies this area as being
appropriate for Low Density Residential Uses. However, it is important to note that the
Comprehensive Plan may be outdated in this area as its current zoning classification (RMH)
would not be low density. E. 116th Street North is identified as a primary arterial to provide
for proper access for higher intensity land uses however.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", and Chapter 7 "Industrial District Provisions."
SITE INFORMATION: No unusual development hardships are noted.

ANALYSIS
The proposed rezoning, if approved, would create a 5 acre area of industrially zoned
property for Midwest Time Control, Inc. Midwest Time Control, Inc., is currently located
in Owasso (off of Main Street) and is looking for an area in which to expand their
operations. All related business operations of Midwest Time Control, Inc., are conducted
entirely within the building with no outdoor storage.
As stated previously, the Owasso Comprehensive Plan, while identifying this area as being
appropriate for Low Density Residential Development, may be considered to be outdated
when applied to the existing physical facts of the area surrounding the subject tract. Hughes
Lumber, Bud's Discount Warehouse and Super H grocery store are all located within a 1/4
mile of this area. The Owasso Sports Park, also nearby, has increased the diversity of land
uses found in this area. In addition, the tract is abutted by proposed or existing non-
residential uses and therefore is highly unlikely to develop as low intensity residential.
Staff feels the IL zoning classification may not necessarily be the zoning classification that is
best suited for a use like Midwest Time Control, Inc., however the Owasso Zoning Code
does not allow a use such as this to be placed in any form of Commercial district. Certainly,
one can reach the conclusion that manufacturing small clock parts and a use such as what is
being proposed by National Steak and Poultry are different. However, both uses are within
the confines of an IL zoning district. Hopefully, items such as this can be addressed when
the Owasso Zoning Code is updated.
The zoning code does require several items as a safe guard or buffer for the residential
district abutting the subject property. First, the subject property will need to be fenced with
a site obstructing fence or wall along the southerly property line. Second, any actual
building will need to be setback a minimum of 75 feet. Proper enforcement of these
requirements at the time of site plan review should provide an adequate buffer.
Letters were sent to surrounding property owners and notification was published in the
Owasso Reporter. To date, staff has received several calls regarding the rezoning request
but none have been opposed to the operation being proposed by Midwest Time Control, Inc.

RECOMMENDATION
Staff is always encouraging of development within or near the German Corner area. In fact,
staff believes that within the next five years this area will see increased development of this
nature and therefore is recommending approval of the rezoning request.

Notice is hereby given that a public hearing will be held before the Owasso Planning
Commission in the Owasso Community Center, 301 South Cedar, Owasso, Oklahoma at 7:00
PM on the 14th day of June, 1994. At that time and place, the Owasso Planning
Commission will consider a request from Midwest Time Control, Inc., applicant, for a
