Article III of the By -Laws of the Owasso Planning Commission states that the offices of
Chairman, Vice - Chairman, and Secretary are to be elected biennially at the first meeting of the
Commission after July 1 of each of the even - numbered years.
The duties of the three offices are listed below for your information and review:
Chairman - The Chairman Shall Have the Following Duties:
(1) Preside at all meetings.
(2) Assist in Preparing the Agenda.
(3) Follow the Agenda.
(4) Allow all Sides of a Case to be Heard.
Vice - Chairman - The Vice - Chairman Shall Preside at all Meetings in the Absence of the
Chairman.
Secre - The Secretary Shall Have the Following Duties:

and declared a quorum present.

reviewed the minutes of May 10, 1994. Dewey Brown moved, seconded by Gary
Wells, to approve the minutes as written. A vote on the motion was recorded as follows:

4. Site Plan Review - Best Western Motel - A Request for a Site Plan Review of the
Proposed Best Western Motel to be located on Lot 1, Block 1, Owasso Commercial
Center III.
The Chair introduced the case and the staff review was given by Mr. Rooney.
The site plan for Best Western has been through numerous review processes prior to being
forwarded to the Planning Commission. Most recently, it was reviewed by the Technical
Advisory Committee at their June 1, 1994 meeting. At that meeting there were several
remaining comments regarding the site plan which were included in the packets. Please note that
major concerns had been previously addressed through the other staff and TAC reviews.
The Owasso Best Western will have a total of 60 rooms, requiring 60 parking spaces. 78 total

parking spaces are reflected on the plan. Access to the motel will be obtained from both the
service road and E. 76th Street North via the proposed cul -de -sac east of La Petite Day Care.
The service road access will be obtained from the shared driveway between Golden Corral and
Captain D's.

there would be a pre - construction meeting, seconded by Gary Wells.

OZ -94 -01 Bill Williams (3014) - A Request to Review a Lot Split for Bill Williams. The
Proposed Lot Split is Described as the North 35 Feet of Lot 1 in Block 21 and all of the
Vacated Street Between Lot 1 in Block 21 and Lot 4 in Block 20 of the Original Town
of Owasso, Tulsa County, State of Oklahoma.
The Chair introduced the case and staff review was given by Mr. Rooney.
It may be easier to think of this request more as a lot tieing than a lot split. Abandoned street
right -of way is available, as well as the excess railroad right -of -way. When the applicant looked
at both of these, and the portions of his property not being utilized, it was evident that an
additional lot could be created.
The subject property is zoned CH (Commercial High Intensity), as is the property both to the
north and south. CH zoning districts do not require a minimum lot size, however the applicant
was encouraged to have at least 100 feet of street frontage. Required minimum setbacks in CH,
upon development, also permit building at zero lot line unless abutted by a residential district.
The lot split proposed meets all zoning code criteria for a CH zoned lot.

6. OZ -9404 - Midwest Time Control Inc (0714)- A Request to Rezone a Tract of Land
Described as the E/2 of the NE/4 of the NW/4 of the NE/4 of Section 7, Township 21
North, Range 14 East, Tulsa County, Oklahoma. The Subject Property is Located at the
Southwest Corner of E. 116th Street North and N. 109th East Avenue.
The Chair introduced the case and the staff review was given by Mr. Rooney.
The Owasso Comprehensive Plan, while identifying this area as being appropriate for Low
Density Residential Development, may be considered to be outdated when applied to the existing
physical facts of the area surrounding the subject tract. Hughes Lumber, Bud's Discount
Warehouse and Super H grocery store are all located within a 1/4 mile of this area. The
Owasso Sports Park, also nearby, has increased the diversity of land uses found in this area.
In addition, the tract is abutted by proposed or existing non - residential uses and therefore is
highly unlikely to develop as low intensity residential.
The zoning code does require several items as a safe guard or buffer for the residential district
abutting the subject property. First, the subject property will need to be fenced with a site
obstructing fence or wall along the southerly property line. Second, any actual building will
need to be setback a minimum of 75 feet. Proper enforcement of these requirements at the time
of site plan review should provide an adequate buffer.

Amended Final Plat of Double Oaks Extended, an Addition to the City of Owasso,
Located in Section 29, T21N, R14E of the I.B.M., Tulsa County, Oklahoma. The
subject property would contain 96 Lots on a 29.32 Acre Area. The Double Oaks
Extended Final Plat was Approved by the Planning Commission on May 10, 1994.

The Chair introduced the case and the staff review was given by Mr. Rooney.
E. 80th Place North and N. 124th E. Avenue have now become E. 80th Court North. Residents
felt that this would alleviate potential "through" traffic in their addition, while still leaving access
via N. 123rd E. Avenue. City personnel felt it important to leave N. 123rd E. Avenue as a
public right -of -way. While city staff does not have a strong opinion as to which proposal is
"better ", we do feel that the option that was agreed upon by the Double Oaks Estates
neighborhood seems to please everyone. The amended final plat meets all city requirements.
Gary Wells moved to approve the request for an amended final plat, and a plat name change
from Double Oaks Extended to Double Oaks IV, seconded by Pat Imbriano.

NATIONAL STEAK AND POULTRY
DATE: July 6, 1994
BACKGROUND
The City of Owasso has received a request for a review of the proposed site plan for National
Steak and Poultry, on behalf of Sack and Associates, Inc. As you are aware, National Steak and
Poultry intends to locate a "value- added" steak and poultry facility east of the Max Buchanan
facility in south Owasso.
The site plan submitted by Sack and Associates indicates that a large number of the existing trees
between the Cedarcrest Apartments and the proposed site of NSP will remain intact. This
should greatly add as a natural buffer between the two uses without serious alterations being
made to the existing landscape.
When the Planning Commission reviewed the zoning case for NSP, it was presented that the
nearest the NSP building could be.to the property containing the multi- family dwellings would
be 75 feet. The site plan submitted indicated that the nearest this facility would be to the
apartments would be 240 feet (loading dock area) and 315 feet (to the nearest wall).
As you can see, the site plan reflects a 5th Avenue entrance, an entrance that is currently not
existing. The 5th Avenue entrance will occur as a result of the extension of Main Street to the
east (creating 5th Avenue) and continuing over to the Highway 169 Service Road. It would
seem that traffic congestion on site will be non - existent.
The NSP site plan was reviewed by the Technical Advisory Committee on June 29, 1994. The
only request from that meeting was that the final site plan (for the issuance of building permit)
reflect a 17.5' utility easement along the perimeter of the property for utility access. (See OLS-
94-02)
Staff is recommending approval of the site plan for National Steak and Poultry providing that
a 17.5 utility easement is added.

The City of Owasso is requesting approval of a lot split for the National Steak and Poultry site.
At the June meeting, the Planning Commission approved a rezoning request for a 16.56 acre
area of land from AG (agriculture) and RM -1 (Residential Multi - Family) to IL (Industrial Light),
a portion of which would now be utilized for the NSP site.
This lot split is necessary for two reasons. The first is to create two industrial lots suitable for
development - the northernmost lot to be occupied by the NSP facility. The second is to
establish the right -of -way necessary in this area to create 5th Avenue.
The Owasso Zoning Code requires that IL zoned property have a minimum of 50 feet of street
frontage when abutting any street other than an arterial street or service road, 150 feet when
abutting an arterial or service road. Both lots being created by the lot split would meet either
of those criteria.
The Technical Advisory Committee reviewed the lot split request at their June 29, 1994 meeting.
The only comment received by staff at that meeting was the need for a 17.5 foot utility easement
around the perimeter of both lots to be created.
Again, if this lot split is approved, two separate lots would be created. A northern lot, on which
the NSP facility would be located, of 10.09 acres and a southern lot of 7.41 acres. In addition,
right -of -way would also be dedicated from the northern lot for 5th Avenue.
RECOMMENDATION
Staff recommends approval of OLS- 94 -02.

The City of Owasso is requesting the closing of dedicated public right -of -way located between
Elm Creek Estates First Addition and the Fairview Cemetery off of E. 76th Street North. The
right -of -way, labeled as Gem Drive on the Elm Creek Estates First Addition plat, has existed
prior to 1977.
It appears that at one time when the cemetery was created, it was necessary to have public right -
of-way east of the cemetery to access the interior of what was once unplatted area. When Elm
Creek Estates was platted, however, access to this interior portion was made via N. 120th E.
Avenue rather than utilizing the existing Gem Drive.
As mentioned, Gem Drive has existed prior to 1977 and has remained as a fenced 25' portion
of grass between the rear lot lines of the homes in Elm Creek Estates and Fairview Cemetery.
Recently, the City of Owasso formed a committee to look into the possibilities of utilizing this
area for additional gravesites. A majority of the area is sloped and would require substantial
improvements to develop as additional cemetery property. Please refer to the attached
memorandum from the Cemetery Review Committee regarding these issues.
In early June, a neighborhood meeting was held with property owners in Elm Creek Estates.
Several inquiries had been received about what would be necessary for this 25' portion to be
made part of their property. Because the city is not interested in keeping this property (currently
city crews mow this area), staff encouraged the property owners to move forward with the
closing of this right -of -way.
All property owners who abut this portion of the right -of -way are in support of the closing of
the right -of -way and are sharing in all costs involved. As you are aware, to formally close the
right -of -way after the city's approval of closure, the applicants must file a "friendly" lawsuit to
foreclose on the city's rights to re -open it. The city will not contest this lawsuit and is in strong
support of the closure request.
This item was reviewed by the Technical Advisory Committee at their June 29, 1994 meeting.
At that meeting, it was discovered that TCI Cable does have cable television lines in this area.
TCI does not object to the right -of -way closing provided that they are able to maintain an
easement within that 25 foot portion. The exact width of that easement is not known at this
time, but only a 5 foot easement should be necessary.
RECOMMENDATION
Staff recommends approval of the closing of right -of -way known as "Gem Drive" between Elm
Creek Estates First Addition and Fairview Cemetery.

The Cemetery Review Committee recently held its second meeting regarding the cemetery
property. The review committee consists of Marcia Boutwell, Ralph Griffin, 7oEllen Krantz,
Rohn Muhn, and myself.
In review, the committee was formed to investigate possible positive and negatives regarding
adding additional cemetery plots along a 25 foot strip of property abutting the Elm Creek
Addition (east side of the cemetery). An abutting property owner had contacted our office
regarding constructing a new fence, and wanted to know if his fence could be moved a few feet
to the west, thus including some of the 25 foot strip of land.
The Committee, through separate and joint site inspections of the area found the following:
1. Portions of the 25 foot strip along the east boundary of the cemetery does contain utilities
(phone and cable). These would need to be relocated.
2. The City's cemetery fence (4 foot - chain link) is in need of repair along a large portion
of the 25 foot strip.
3. Several abutting property owners have taken it upon themselves to fence in the 25 foot
area as a portion of their rear yard. One owner, in particular, has even terraced their
portion for gardening purposes.
4. It would be possible to add one more row of gravesites if this 25 foot strip is utilized.
This would allow for an additional 133 gravesite based upon the length of the east
boundary of the cemetery.
5. The City currently mows and maintains those areas not fenced in by the abutting property
owners.
Based upon the above findings, the Committee found three options available regarding the use
of the 25 foot strip of property:
1. It is possible to an add an additional row of gravesites. 133 plots at $300 per plot would
total approximately $39,900 in additional revenue. However, this would be off -set by
costs of moving utilities, fence relocation and construction of new 4 foot chain link fence
($900 if installed by the city, $1637 if contracted out), possible retaining wall, and long
term care of lots.
2. Deed the land back to the abutting property owners only if the abutting property owners
paid for one, uniform, site obstructing fence between the cemetery and their property.
Sell the land at its market value to the abutting property owners and place money from
the sale of the land into the cemetery maintenance fund.
When reviewing those options, the team strongly felt that adding more cemetery plots within this
strip would not be in the best interest of the city as far as public relations were concerned,
regardless of whether or not the city owns the land, and any financial gain would be offset by
bad PR.
The group felt either Option 2 or 3 seemed to work well, but all expressed that it was difficult
to make a recommendation not knowing if the City Council wanted to stay in the cemetery
business.

BACKGROUND
Mr. and Mrs. Hayward Smith have submitted to the City of Owasso a petition for annexation
of their jointly owned property totaling more than 10.32 acres. The subject properties are shown
on the attached map and are currently undeveloped.
Both properties are currently zoned AG (Agricultural) and would remain zoned AG upon
annexation. All property annexed by the City of Owasso is required to be zoned the lowest
zoning classification (AG) until any rezoning request is received. A copy of the City of
Owasso's annexation policy is attached for your information and review.
If annexation is approved, both sites will have to go through all platting requirements of the City
of Owasso prior to any development. Initial development challenges presented to the
owner /developer consist of extending sewer /water service to the sites and storm water detention
on site.
Notification of the annexation request was published in the Owasso Reporter on June 30, 1994
to notify the public of the annexation request before the Planning Commission. This notification
will be followed by notification published two consecutive weeks in the Owasso Reporter on
June 7 and 14, 1994 to notify the public of any possible City Council action regarding the
request. A copy of the procedures for annexation is also attached for your information and
review.
The Owasso Technical Advisory Committee reviewed this request at their June 29, 1994 meeting
and no objections to the annexation request were noted. The Owasso Annexation Committee
reviewed the request at their June 29, 1994 meeting and unanimously recommended approval
of the annexation. A copy of the minutes from that meeting are attached for your information
and review.
To date, staff has received no comments opposing the annexation.
RECOMMENDATION
Staff is recommending approval of both annexation requests from Mr. & Mrs. G. Hayward
Smith.

ANNEXATION REQUESTS
ANNEXATION POLICY
1. While there is no minimum tract size, properties of larger than
20 acres are preferable.
2. All properties should be contiguous to existing city limits.
3. All properties should be annexed into the city limits as the
lowest zoning classification, that is, AG, agricultural.
Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed
into the city will be legal, but non - conforming, which means
that they may continue but cannot be expanded without proper
zoning.
4. All public infrastructures that do not met city standards will
not be improved by the city until brought to the city standard
and accepted by the City Council. Such public facilities must
be improved at owners expense by the establishment of a special
assessment district or some other financing method.
S. Where a city limit boundary ends at a dedicated street, the
boundary will not include the street right -of -way. This policy
will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be
considered for annexation for a six month period after
rejection by the City Council.

2. CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 29, 1993 - Rodney Ray
moved, seconded by Steve Compton, to approve the minutes. Motion carried 6 -0.
ANNEXATION REVIEW
3. G. Hayward & Betty Jane Smith - An approximate 1.66 acre tract located north of the
Owasso Fire Station; further described as being located in the NW /4 of the SW /4 of
Section 20, T21N, R14E, Tulsa County; AND
An approximate 8.86 acre tract located west of the Three Lakes II, east of Highway 169,
and north of the Owasso Wal -Mart; further described as being located in the NW /4 of
the SW /4 of Section 20, T21N, R14E, Tulsa County.
Mr. Rooney presertted the annexation item. It was explained that both properties are
currently zoned AG (Agriculture) and would remain zoned that way until any formal
rezoning was received by the city. In addition to the zoning requirements prior to
development, all platting requirements would need to be met. It was also explained that
both water and sewer would need to be extended to the property.
Mr. Rooney stated that if this item was approved, it would be forwarded to the Owasso
Planning Commission on July 12, 1994 and possibly to City Council on July 19, 1994,

adjournment. The meeting was adjourned at 5:13 PM.

SUBJECT: FINAL PLAT - BAILEY RANCH ESTATES
DATE: July 7, 1994
BACKGROUND
The City of Owasso has received a request to review a final plat for Bailey Ranch Estates (Phase
1). Bailey Ranch Estates is a planned unit development located 1/4 mile north of E. 96th Street
North, east of Garnett Road. Phase I of this development reflects that it would consist of 118
lots on 40.64 acres of property.
The Technical Advisory Committee reviewed the preliminary plat at their April 27, 1994
meeting. At that meeting, the applicants were supplied with a list of staff corrections to the plat.
In addition to staff comments, the utility companies also had several requests for easements at
different locations throughout the plat. The Owasso Planning Commission reviewed the
preliminary plat containing the corrections recommended by staff and the Technical Advisory
Committee at their May 10, 1994 meeting and unanimously recommended approval.
Once again, the plat itself reflects two of three entrances we will see off of N. Garnett Road.
Each entrance will utilize an acceleration /deceleration lane as recommended within the PUD.
Also, the applicant utilizes limits of no access within the subdivision, thus eliminating significant
amounts of curb cuts along the major through street (E. 100th Street North).
The final plat for Bailey Ranch Estates was reviewed at the June 29, 1994 Technical Advisory
Committee meeting. At that meeting, the following additions /corrections were collected by
utility representatives and staff:
1. Change the southern easements on Lot 4, Block 2 and Lot 31, Block 6 to 11
feet instead of 10 feet.
2. Add two 5 foot utility easements along the shared lot lines of Lots 4 & 5,
Block 7.
3. Add an 11' u/e to be recorded by separate instrument along the north side of
the north boundary line of the plat.
4. Add a 15' u/e south of the north boundary line of the plat.
Additional comments that staff made prior to the meeting are listed in a separate memorandum
to the TAC committee attached for your information and review.
The final plat and covenants within your packet include all of the above recommended changes.
As it was stated when the preliminary plat was reviewed, the platting process for the Bailey
Ranch Estates plat was a smooth one. Numerous meetings were held with staff to establish
necessary items to be included on the plat and within the construction plans. A memorandum
from Rohn Munn is also attached to inform you of the status of the construction plans. Please
be advised that final plats will not be released until a final set of construction plans are accepted
by the Public Works Department.
RECOMMENDATION
Staff is recommending Planning Commission approval of the final plat for Bailey Ranch Estates

Presently, construction of the sanitary sewer system has begun on the above mentioned project, and
everything seems to be going fine.
There are revisions that need to be made by the engineer on the water, storm sewer, and paving.
However, the revisions are not critical. On a whole, this subdivision looks very good and will
probably turn out to be the best construction project in Owasso.
