1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 6:00 p.m.
and declared a quorum present.

MEETING - The Commission reviewed the minutes of August 9, 1994. Jerry Cole

4. Site Plan - S -R Investments - A Request for a review of the site plan for S -R
Investments, a commercial structure to be located on the north 35' of Lot 1, Block 21
and all of the vacated street right -of -way between Lot 1, Block 21 and Lot 4, Block 20
of the Original Town of Owasso, Tulsa County, Oklahoma. The subject property is
located directly north of the Depot Steak House.
The Chair introduced the case and the staff review was given by Mr. Rooney.
Lee Rollins has submitted a site plan on behalf of 5 -R Development for review by the Owasso
Planning Commission. The subject site is located on the west side of Atlanta Street, directly
north of the Depot Restaurant. The subject property was created via a lot split approved by the

Technical Advisory Committee reviewed this site plan at their July 27, 1994 meeting and no
comments were received from the utility companies.

SUBJECT: SITE PLAN REVIEW FOR THREE LAKES APARTMENTS
DATE: September 8, 1994
BACKGROUND
Mr. Gary Hassenflu of Garrison Commercial in Merriam, KS has submitted a site plan for a
garden apartment complex to be located on Lot 13, Block 3 of Three Lakes Addition. The
subject site is generally located on the north side of E. 83rd Street North, 400' east of the Ace
Hardware property. The current zoning of the property is RM -2 which would permit multi-
family housing.
The apartment complex will consist of 12 8 -unit buildings (96 apartments). Each building would
be two stories high with the units beings equally divided between 2 and 3 bedroom units (48 -
2 bedroom and 48 - 3 bedroom units). An 8 1/2 x 11" site plan is attached for your
information and review and a larger site plan will be presented to the Planning Commission at
the regular meeting.
The site plan is lacking in three areas, the first of which is sidewalks. School buses will not
circle through the private property to pick up the students. Sidewalks should be added to the
entire property frontage on E. 83rd Street North.
The site plan indicates 217 parking spaces, more than what would be required for the amount
of units and type being proposed. However, the site plan does not indicate handicapped parking
spaces and these should be added to the plan. A total of 7 handicapped parking spaces would
be required to be marked.
Trash receptacles have not been shown on the site plan as well. As with most apartment
complexes, trash receptacles are located near the parking areas where they can be accessible to
both a large group of people and the trash hauler. Staff would request that the areas in which
these receptacles sit be screened on three sides.
The Owasso Technical Advisory Committee reviewed the site plan at their August 31, 1994
meeting and requested a 17.5' utility easement around the perimeter of the subject property.
Staff concerns surrounded around a detention plan for the property. An approved
drainage /detention plan will need to be obtained prior to any building permit.
RECOMMENDATION
Staff is recommending approval of the site plan for Three Lakes Apartments providing that the
following conditions are met:
1. Sidewalks are to be added along the entire property frontage abutting E. 83rd
Street North.
2. 7 handicapped parking spaces are to be labeled.
3. Trash receptacle areas are to be screened on three sides.
4. A 17.5' utility easement is to be added around the perimeter of the subject
property. '
5. An approved drainage /detention plan prior to the issuance of a building
permit.
6. A pre- construction meeting shall be held with staff prior to any construction.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Dennis Hodo, applicant and agent for Mr.
& Mrs. Joe Caudle, owners.
REQUESTED ACTION AND PURPOSE: A request for the rezoning of property from
AG (Agriculture) to CS (Commercial Shopping Center District) to allow for commercial
development.
LOCATION AND SIZE: The property is described as the East 572' feet of the North Half
of the Northeast Quarter of the Northeast Quarter of Section 19, Township 21 North, Range
14 East and contains 8 acres, more or less. The general location of the property is the
southwest corner of E. 96th Street North and Garnett Road.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by E. 96th
Street North, while further north across the street lies partially developed with a gas
station /convenience store zoned CS. The subject property is abutted on the east by Garnett
Road, while further east lies undeveloped property zoned AG. The property to the south of
the subject property is zoned RMT (Residential Townhouse District) and is not within the
city limits of Owasso. The property immediately to the west is property involved in
rezoning case OZ- 94 -06, while further west lies undeveloped property zoned AG.
COMPREHENSIVE PLAN: The Comprehensive Plan identifies this area as being
appropriate for commercial node type development, but not to the extent of the applicants
request.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments ", and Chapter 6 "Commercial District Provisions."
SITE INFORMATION: No unusual development hardships are noted, other than drainage
detention will be monitored closely be engineering staff upon development. You may recall
this item was brought to your attention at the annexation hearing for this property.

ANALYSIS
The proposed rezoning, if approved, would create an 8 acre area of commercially zoned
property abutting both E. 96th Street North and Garnett Road. Scheduled intersection
improvements to this area, increased traffic as a result of the new elementary school and the
eventual development of Bailey Ranch Estates and the golf course property, certainly make
commercial zoning and development at this intersection an advantageous request.
Staff's only concern with this request is the depth of the requested commercial zoning off of
Garnett Road. As you can see when the area zoning map is reviewed, commercial zoning to
the north does not extend to the west quite as far as what is being requested by the applicant.
Staff feels it is very important to remain consistent on both the north and south sides of E.
96th Street North, so that any commercial development would "match up" and not extend
any further to the west than the other.
For instance, if the applicants request were to be granted by the Planning Commission,
several residents of the El Rio Vista Addition would effectively end up with commercial
development in their back yard. However, a slight deviation of the rezoning request would
ensure that the residents on the north side of E. 96th Street are protected.
Staff has received numerous complaints from property owners who's rear yards back up to
commercial development in the Three Lakes Addition and would like to avoid that scenario
again, if possible. Even though this request would have E. 96th Street North between the
residences in El Rio Vista and any commercial development, staff views limiting how far the
commercial zoning extends westward off of Garnett as eliminating any possible unwanted
conflict by all involved.
The applicant should be advised that acceleration /deceleration lanes, as well as sidewalks,
will required along E. 96th Street North and Garnett Road during the platting process and /or
site plan review process should the Planning Commission and City Council approve this
request.
RECOMMENDATION
Staff is recommending partial approval of the rezoning request due to the adjacent zoning
pattern and development to the north. Staff recommends approving rezoning of the easterly
300 feet of the North Half of the Northeast Quarter of the Northeast Quarter of Section 19 to
CS (Commercial Shopping Center), while the remaining 272 feet be zoned RS -2 (Residential
Single Family Medium Density) to be tied into the applicants requested RS -2 zoning in
rezoning case OZ -94 -06

ANALYSIS

property abutting E. 96th Street North. Scheduled intersection improvements to this area,
the new elementary school and the anticipated shift in growth to the north and west of
Owasso proper all present themselves as variables in this request.
Staff has reviewed this request and feels that any RS -2 development would not be detrimental
to surrounding property owners and will only enhance this area of the Owasso community.
Again, the applicant is requesting a 12 acre area of RS -2 zoning, which could become an
approximate 15 -16 acre area if the commercial zoning is trimmed back as staff is
recommending (See OZ- 94 -05).
The applicants should note, however, that acceleration /deceleration lanes as well as sidewalks
will be required along E. 96th Street North as a part of any platting process and subdivision
development.
Staff has received no objections to the rezoning request from surrounding property owners.
RECOMMENDATION
Staff is recommending approval of the rezoning request from AG (Agriculture) to RS -2

DATE: September 7, 1994
BACKGROUND
Mr. & Mrs. Mike Judkins and Mr. & Mrs. Mark Farris are requesting a lot split approval from
the Owasso Planning Commission for property located within the Copper Meadows II Addition
(Lots 12 & 13, Block 1).
Apparently, when the residence on Lot 13, Block 1 was constructed, it was built too close to the
property line due to a surveying error. When this problem was discovered and brought to my
attention, I explained that the owner of Lot 13 had two options. The first option would be to
come to the Planning Commission and obtain a lot split approval providing that there was
enough area from Lot 12 to take and still meet RS -3 bulk and area requirements (i.e. setback
requirements, required lot frontage, etc.). The second option was to go to the Board of
Adjustment for a variance of the RS -3 setback requirements.
Because there was adequate property available from Lot 12, the applicants were encouraged to
come before the Planning Commission. The lot split being proposed by the applicants will not
effect any existing structures nor does it impact any utility easements. The proposal meets all
RS -3 bulk and area requirements and staff has no objections to the request.
RECOMMENDATION
Staff recommends approval of OLS- 94 -04.

BACKGROUND:
The Tulsa Metropolitan Area Planning Commission recently forwarded the City of Owasso a
rezoning request by Charles Burris for A & W Development to rezone a 109 acre tract of land
located north and west of the northwest corner of E. 116th Street N. and Garnett Road. The
subject property is currently zoned AG (Agriculture) and the applicants are requesting an RS
zoning classification. Due to the subject property's proximity to the city limits, staff felt it
important for a review to be heard by the Owasso Planning Commission.
The zoning referral process is an "input hearing" only. This means:
1. TMAPC's public notice will state the item is before the referral Planning Commission
for an "input hearing" and that no vote and no recommendation will be made by the
local commission. It will also state that the concerns and issues raised at the "input
hearing" will be compiled and sent to TMAPC.
2. The local community will place the item on their agenda before the local commission as
an "input hearing" which signifies that no vote or recommendations will result. Local
staff would emphasize at the local meeting the nature of the referral process and that final
recommendations are, by law, the responsibility of the TMAPC. Local citizens should
be advised and encouraged to present their comments and written opinions to the
TMAPC.
3. The compiled local comments and concerns would be read at the TMAPC meeting and
thereby be entered into the minutes of the meeting. The local planner could read
comments if in attendance and respond more completely to any questions about the local
meeting.
Zoning to the south of the subject property (while still being on the north side of E. 116th Street
N.) consists of AG, CG, and CS. The property to the east of the subject property is contains
Garnett Road, while further east lies AG and CG zoning. The property to the north and west
of the subject site is also zoned AG.
Staff has reviewed the request and would like to address the following concerns:
If the zoning request is approved and development occurs, both water and sewer services would
be provided by the City of Owasso. Based on the zoning requested, it is likely that the lots
would be too small for septic systems thus requiring sewer. All water and sewer infrastructure
would need to meet city standards. Streets, however, would not be at the city's standards. The
outcome would be a county addition which utilizes city sewer and water, pays a higher rate for
that use, and an addition that would not meet city requirements for annexation due to a lesser
street standard. The developer, in a sense, would be utilizing the same services as subdivisions
located in the city to the south but would not be paying the same development costs. In a
situation such as this, the staff would always desire annexation into the city prior to
development. This, hopefully, would eliminate any potential for future conflict. Staff would
strongly encourage the applicants to look into annexation possibilities.
Staff's other concern would center around the size of the residential lots being proposed. With
the exception of the Westport Addition, most residential lots in this area of the community are
substantially larger and are of an AG -R nature. Depending on the actual lot size of the lots
created, the density of this addition may be a question.
Also, a note of interest was the case map itself. The case map indicated a triangular shaped area
on the west side of the railroad tracks. Realizing that this is only an input hearing for zoning,
not platting, I still find myself concerned about this property. How would one access this area?
No right -of -way (other than railroad) appears to be shown.
An area map is included for your information and review. Again, these are some of staff's
concerns regarding the zoning request and should by no means be viewed as all inclusive or a
recommendation.
