CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting to order at 7:00 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 17, 1992 - The Commission reviewed the minutes of December 17, 1992. Gary Wells moved, seconded by Pat Imbriano, to approve the minutes as written. OZ -92 MR ROBERT LONG (2014) - A REQUEST TO REZONE A TRACT OF LAND IN THE SOUTHEAST QUARTER (SE/4) OF SECTION 20, TOWNSHIP 21 NORTH, RANGE 14 EAST FROM AG TO OL, GENERALLY LOCATED ON THE NORTH SIDE OF 86TH STREET NORTH, BETWEEN 123RD EAST AVENUE AND FOOD LION SUPERMARKET - The Chair introduced the case and the staff review was given by Tim Rooney. The applicant is requesting a rezoning of the property to OL to allow for the development of an insurance office and possible expansion to include a travel agency at a later time. The property is undeveloped and contains approximately 1.9 acres. The building scheduled for development is intended to be low profile in elevation and should resemble more closely a residence than a typical office building. This would allow for a smooth transition from the office use to the residential zoning to the west and north of the subject site. Property to the east of the site is zoned OL and is currently undeveloped. The applicant was present. Following questions and comments from the Commission and general public, Dewey Brown moved to recommend to the City Council that the zoning request be approved subject to a 35 foot wide buffer zone of AG being maintained along the property line shared by the subject site and the residential development to the north. NEW BUSINESS - Mr Rooney distributed a draft document of the Subdivision Regulations. Chapters 1 -3 will be reviewed by the Commission at the February meeting. 5. REPORT ON PREVIOUS COUNCIL ITEMS - Mr Rooney reported that OPUD- 11(Ram Plaza) rezoning had been tabled by the City Council at their January 5, 1993 meeting until questions raised by the Council concerning the limitations of certain types of proposed commercial uses within the PUD, more particularly, restaurants other than fast -food types were answered. The item was heard at the January 19, 1993 City Council meeting. The City Council voted to amend the Protective Covenants, striking all references to restaurants of any type in the limitations on commercial uses. They then approved the rezoning with the amended Protective Covenants. 6. DISCUSSION OF DEVELOPMENT IN AND NEAR OWASSO - Staff discussed current development and construction in the Owasso area, including the relocation of Kentucky Fried Chicken. Also discussed, was a meeting to be held by the German Corner business owners on Wednesday, January 27, 1993. 7. ADJOURNMENT - Pat Imbriano moved, Dewey Brown seconded, to adjourn the meeting. A vote on the motion was recorded as follows: Pat Imbriano - Yes Dewey Brown - Yes Gary Wells - Yes Charles Willey - Yes Ray Haynes - Yes The motion carried 5 -0 and the meeting was adjourned at 7:23 p.m. Chairperson Secretary Date MEMORANDUM TO: THE OWASSO PLANNING COMNIISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: ANNEXATION REQUEST DATE: February 5, 1993 BACKGROUND The City of Owasso has received an annexation petition from Mr. and Mrs. Mac Borgna and Mrs. and Mrs. D.M. Sokolosky for their jointly owned property totaling approximately 1 acre in area. The subject property is located on the south side of E. 76th Street North, between Perry's Restaurant and a Veterinarian's Office, both of which are in the City Limits. The subject property is shown on the attached map and is currently undeveloped. This request for annexation was forwarded to members of the Owasso Technical Advisory Committee for comment, and has been heard by the Owasso Annexation Committee on January 25, 1993. No comments opposing the annexation were received from the Technical Advisory Committee and a copy of the Annexation Committee's minutes have been enclosed for your review. If annexation is approved, the site is not serviced by City sewer and this will be a development challenge that will need to be addressed by the owner /developer prior to any construction activity. In addition to sewer service, on -site drainage needs to be addressed as well. A rezoning and platting of the land will also be required prior to any development. A copy of the City of Owasso's Annexation Policy has been enclosed for your review. The Owasso Annexation Committee unanimously recommended approval of the annexation request, citing that it met all of the annexation requirements with the exception of the 20 acre requirement. RECOADENDATION Given the above recommendation from the Annexation Committee and the fact that the subject property would be required to go through several review processes to eliminate the two development challenges, staff recommends approval of the annexation request. CONSIDER APPROVAL OF THE MINUTES OF AUGUST 15, 1991 SPECIAL MEETING - Pat Marlar moved, seconded by Steve Compton, to approve the minutes of both meetings as written. Motion carried 8 -0. ANNEXATION REVIEW 3. D.M. and Phyllis Sokolosky and Mac and Sally Borgna (2114) - A Tract of Land Located on 76th Street North, East of Highway 169, between Perry's Restaurant and Owasso Veterinary Hospital. Staff reviewed the case as presented by the memorandum in the agenda packet. The subject tract is approximately 1 acre in size and would be zoned AG upon annexation. Currently, the property is undeveloped. Staff stated several development challenges would need to be addressed by the owners of the property, most notably storm water drainage and sanitary sewer service. Staff stated the owners of the property will be required to connect to sewer services at their expense and the City of Owasso would not be assisting financially in that area. It was discussed that the applicant may be able to run a line to tie into the sewer main along an existing private easement that Perry's Restaurant utilizes for sewer. It was also stated the applicant is aware that this concern needs to be resolved prior to development. Several boards and commissions will hear this property prior to any development as zoning and special exceptions will be required, as the plan for development are a car wash at this time. The Annexation Committee did express concern over the ability to solve the sewer problem for that type of use. Following discussion, Pat Marlar moved, second by Bob Allen, to approve the annexation request. Motion carried 8 -0. Tim stated this item would be heard by the Owasso Planning Commission on February 18, 1993 and by the Owasso City Council on March 16, 1993. 4. ADJOURNMENT - Rodney Ray moved, second by Steve Compton for adjournment. Meeting adjourned at 5:20 PM. ANNEXATION POLICY While there is no minimum tract size, properties of larger than 20 acres.are preferable. 2. All properties should be contiguous to existing city limits. All properties should be annexed into the city limits as the lowest zoning classification, that is, AG, agricultural. Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by Council on March 1, 1988. Sokolosky PO BOX 8 Owasso Phyllis Sokolosky P O Box 8 74055 MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: FINAL PLAT - LONG COMMERCIAL CENTER DATE: February 10, 1993 BACKGROUND: Enclosed is a copy of the Final Plat for Long Commercial Center. As you may recall, this rezoning case was heard by the Planning Commission at the January Planning Commission Meeting. Because the essentials of a Preliminary Plat were presented at that time as well, Planning Staff is requesting that this plat be processed as a Final Plat due to its simplified nature. The Preliminary Plat was presented to the Owasso Technical Advisory Committee at its February 3, 1993 meeting. Comments received regarding this plat concerned wording within the covenants on the plat itself and notification to add the City of Owasso signature block. The enclosed plat has accommodated those concerns. Staff has further reviewed the Final Plat of Long Commercial Center and has found no problems. RECOMMENDATION: I recommend approval of the Final Plat for Long Commercial Center. ATTACHMENTS: 1. Final Plat of Long Commercial Center. MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: SITE PLAN REVIEW FOR ROBERT LONG'S INSURANCE OFFICE ON 86TH STREET, BETWEEN 123RD EAST AVENUE AND FOOD LION SUPERMARKET DATE: February 5, 1993 BACKGROUND Mr. Robert Long has submitted a site plan for his insurance office with possible addition to include a travel agency on 86th Street, between 123rd East Avenue and Food Lion Supermarket. The address of this property will be 12315 E. 86th Street North. It would appear that Mr. Long's site plan has met all of the City of Owasso's Zoning Code requirements for development within an OL district. Adequate parking and setbacks have been established, while landscaping and a pedestrian pathway incorporating into that of "Central Park's" has also been included. As stated in the rezoning case, absolutely no flow restrictions shall occur along the drainage ditch to the rear of the property. In addition, storm water detention will need to be handled on site and approved by the City Engineer. The only concern noted by staff was the width of the driveway shown. Staff would recommend that the driveway width be increased to 25 feet as opposed to the 18 feet shown on the site plan submitted. The site plan was presented to the Owasso Technical Advisory Committee on February 3rd, and no additional recommendations for changes were received. RECOMMENDATION Staff would recommend approval of the proposed site plan conditioned upon the following: 1. Driveway width being increased to 25 feet. 2. No flow restrictions to occur along the drainage ditch. 3. Storm water runoff detention approved by the City Engineer. ATTACHMENTS 1. Site Plan A SITE PLAN NOT OT SCALE LAKERIDGE ADDITION SUBJECT SITE OZ-92 MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY CITY PLANNER SUBJECT: EASEMENT CLOSING - QUIK TRIP CONVENIENCE STORE, HWY 169 AND EAST 76TH STREET NORTH DATE: February 5, 1993 BACKGROUND The subject tract is located on the north side of E. 76th Street North, just east of the service road abutting Highway 169 and is zoned CS (Commercial Shopping) and is developed with a convenience store. The tract is abutted on the East by Braum's Ice Cream Store, on the North by Captain D's Seafood Restaurant, on the West by the service road for Highway 169 and on the South by 76th Street North. The surrounding zoning is also CS. The applicant is requesting to close the South 50 feet of the West 17.5 feet, and the South 17.5 feet of the East 32.5 feet of the West 50 feet of the utility easement located in the southwest corner of Lot Three (3), Block One (1) of the Owasso Commercial Center. The reason for this request is to allow for the expansion of the Quik Trip parking area and to add additional parking spaces for the store. The easement currently does not contain any utilities as they are located in the ODOT right -of -way. If the easement is closed, the applicant will have to carry out legal action to foreclose on the City's right to reopen the easement. This process is handled through the District Court and is handled as a "friendly" case. The Technical Advisory Committee at their February 3, 1993 meeting reviewed this case and did not have any objections to the closing of the subject easement. RECOMMENDATION I recommend approval of the closing of the South 50 feet of the West 17.5 feet, and the South 17.5 feet of the East 32.5 feet of the West 50 feet of a public utility easement generally located in the southwest corner of Lot Three (3), Block One (1) of Owasso Commercial Center with the condition that the vacation be handled through the proper legal process of District Court. Lot 3, Block 1 Owasso Commercial Center MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: _ TIMOTHY ROONEY, CITY PLANNER SUBJECT: SITE PLAN REVIEW FOR QUIK TRIP EXPANSION LOCATED AT 11501 EAST 76TH STREET NORTH DATE: February 5, 1993 BACKGROUND Quik Trip Corporation has submitted a site plan for review by the Owasso Planning Commission for the expansion of their store located at 11501 E. 76th Street North. The actual convenience store itself will not be expanded, but rather the amount of parking to be provided on -site and the addition of another fuel pump at the facility. Quik Trip Corporation will be leasing excess right -of -way from Oklahoma Department of Transportation to allow for the expansion of the above mentioned parking and fuel pump facilities. Because some of the utilities (Water, Electric, Telephone, and Gas) are located within this right -of -way to be leased, Quik Trip Corporation will be providing an agreement similar to the one enclosed within this packet, to all of the companies involved to insure the continued utilization of this area for services. Staff has no objections to the expansion of the current facilities, as often times it is a scene of much congestion. It is staff's opinion that the additional parking provided by Quik Trip will assist in alleviating this congestion. The site plan was presented the Technical Advisory Committee on February 3, 1993. Mr. Augustine, Owasso Public Works Director, recommended that an additional box culvert be placed at the existing entrance on the west side of the property to alleviate drainage problems in the area. In addition, Mr. Augustine requested the Quik Trip sign be located further east on the site (away from the water line) or a written agreement submitted regarding the safety of said line. It should be noted that Quik Trip has accommodated these requests on the enclosed site plan. In addition to the Owasso Planning Commission's approval, the submitted site plan must also be approved by the Oklahoma Department of Transportation as a portion of the site is right -of -way being leased from that entity. If any changes are recommended by that entity, this site plan will be presented to the Planning Commission for re- approval. RECOMMENDATION Staff would recommend approval of the proposed site plan, subject to ODOT's approval. ATTACHMENTS 1. Site Plan Maps for Quik Trip 2. A majority of the contents of the Subdivision Regulations you have previously reviewed during 1991 and 1992. Members of the Subdivision Regulations Review Committee consisted of myself, Mike Augustine, Richard Hall, Rohn Munn, and Steve Compton. Please review and be prepared to comment on Chapters 1 through 3 of the document at the February 18, 1993 Planning Commission Meeting.
