CALL TO ORDER AND ROLL CALL - Chairperson Ray Haynes called the meeting to order at 7:00 p.m. and declared a quorum present. 2. CONSIDER APPROVAL OF THE MINUTES OF MAY 20, 1993 - The Commission reviewed the minutes of May 20, 1993. Charles Willey moved, seconded by Dewey Brown, to approve the minutes as written. A vote on the motion was recorded as follows: Charles Willey - Yes Dewey Brown - Yes Ray Haynes - Yes The motion carried 3 -0. 3. PRELIMINARY PLAT - WINDSOR LAKE III 921-21-14) - A request for a Review of the Preliminary Plat for Windsor Lake III, an Addition to the City of Owasso; Being a Part of the E/2 of Section 21, T21N, R14E, Tulsa County, Oklahoma. Windsor Lake III is Generally Located just South of Windsor Lake II, East of 129th East Avenue. The City of Owasso initially received a preliminary plat for Windsor Lake III in May for review at the Technical Advisory Committee and Planning Commission meetings. Due to several "changes" recommended at the TAC meeting and due to the addition of four lots from the amended Windsor Lake II final plat, staff strongly recommended that Mr. Charney and Mr. Sokolosky resubmit the preliminary plat for Windsor Lake III in order to address these concerns. The enclosed preliminary plat has addressed those changes. Owasso Planning Commission Minutes of June 17, 1993 Page 2 of 6 At the June 2, 1993 TAC meeting, the Windsor Lake III preliminary plat was reviewed again. Staff recommended Planning Commission approval of the preliminary plat conditioned upon the following TAC recommendations: 1. All rear, back to back easements a minimum of 11 feet. 2. Add a 10 foot easement along the north property line of Lot 8, Block 2. 3. Add a 10 foot easement along the north property line of Lot 9, Block 3 and across the north line of the neighboring drainage detention area. 4. Add a 5 foot easement along the shared property lines of both Lots 6 and 7 of Block 3. 5. Add 11 foot easements to the rear of Lots 11 and 9 of Block 5 by separate instrument. (This is to enable the utility companies to loop the service of the utilities) 6. Add 17.5 foot easements east of Block 5 and south of Block 6 by separate instrument. (This is also to enable the utility companies to loop the service of the utilities) 7. Easement through Lots 10 and 15 of Block 1 to be increased to 15 feet. 8.Easements need to be dimensioned on the following lots: Common lot line between Lots 12 and 13, Block 2 Common lot line between Lots 3 and 4, Block 5 Common lot line between Lots 3 and 6, Block 5 Common lot line between Lots 10 and 11, Block 5 Common lot line between Lots 12 and 13, Block 5 9. Easements need to be dimensioned in the following lots: Lot 16, Block 1 Lot 8, Block 3 Lots 1 and 2, Block 4 10. Change the bearing along the west lot line of Lot 13, Block 5 11. Correct the dimension of the rear lot line of Block 5 to match dimension. 12. Add a 2" conduit across the entrance road from 129th East Avenue. 13. Add a 6 or 8 inch conduit at the south end of 132nd East Avenue. 14. Street names to conform to staff copy. 15. If 'Drainage Detention Area" is to be utilized as "Park Area" it designated as such on the plat. COVENANTS 1. Setback lines designated in the covenants need to be changed to reflect RS-2 zoning requirements (Front yard = 30 feet, back yard = 20 feet). PRELIMINARY PLAT - BARRINGTON POINT (21- 21 -14) - A Request for a Review of the Preliminary Plat for Barrington Point, an Addition to the City of Owasso; Being a Part of the NW/4 of the SWA of Section 21, T21N, R14E, Tulsa County, Oklahoma. Barrington Point is Generally Located just North of Owasso High School, East of 129th East Avenue. Mr. Rooney presented the report that the City of Owasso initially received a preliminary plat for Bamngton Point in May for review at the Technical Advisory Committee and Planning Commission meetings. Due to several "changes" recommended at the TAC meeting and due to staff's recommendation of the developer providing access to unsubdivided land to the east, staff recommended that Mr. Kourtis resubmit the preliminary plat for Barrington Point in order to address these concerns and to allow the Planning Commission to view both Barrington Point and Windsor Lake III together as they are abutting properties. The enclosed preliminary plat has addressed those changes previously recommended by staff. At the June 2, 1993 TAC meeting, the Barrington Point preliminary plat was reviewed again. Staff recommended Planning Commission approval of the preliminary plat conditioned upon the following TAC recommendations: 1. All rear, back to back easements a minimum of 11 feet. 2. Provide an access easement to cover a 38 foot radius cul -de -sac (pavement type to be the same as remainder of street). 3. Provide an 8 inch PVC conduit at the entrance to the subdivision from 129th E. Avenue. 4. Provide a 3 inch PVC conduit across N. 130th E. Avenue, from Lot 3 of Block 2 to Lot 8 of Block 3. 5. Provide a 4 inch PVC conduit across N. 133rd E. Avenue, from Lot 8, Block 4 to Lot 11, Block 5. 6. Add 7.5 foot easements north and south of the property line shared by Lots 8 and 9 of Block 4. 7. Eliminate Lots 19 through 23 of Block 2 as these have been determined to be needed by the Project Engineer for drainage detention area. 8. Add a limits of no access to north and south side of entry road. 9. Street names to conform to staff copy. 10. If "Drainage Detention Area" is to be utilized as "Park "Area" it needs to be designated as such on the plat. COVENANTS 1. Item No. 4, reference to Homeowners Association should be changed to "Barrington Point Association" rather than "Windsor Lake Association." 2. Item No 15, "Electric, Telephone, Cable Television Service" needs to be changed to conform with that of recently recorded subdivision plats. FINAL PLAT - OWASSO COMMERCIAL CENTER II (30 -21 -14) - A Request for a Review of the Final Plat for Owasso Commercial Center II, an Addition to the City of Owasso, Tulsa County, Oklahoma; Being a Part of the NE /4 NW /4 NW 14 of Section 32, T21N, R14E. Owasso Commercial Center H is Generally Located on East 76th Street North, East of Highway 169, Between Perry's Restaurant and Owasso Veterinary Hospital. C. The Final Plat was presented to the Owasso Technical Advisory Committee at is June 2, 1993 meeting. Comments received regarding this plat concerned misspellings within the covenants on the plat itself. The applicant is aware of those errors. Staff recommended that the Planning Commission review this plat as a final plat due to its simplified nature (1 Block, 1 Lot) . In addition to the Technical Advisory Committee review, this item was reviewed by the Owasso Board of Adjustment for a variance request. The applicants were required to obtain a variance because of the property not meeting the bulk and area requirements of a CG (Commercial General) District. The applicants have submitted an agreement to obtain a private easement through the LaPetite property in order to provide a private sewer service line to their property. Staff has further reviewed these plans and has found no problems or issues of concern. Ray Haynes moved, Charles Willey seconded, to approve the Final Plat as corrected. Request to Amend the Zoning Code of the City of Owasso, Oklahoma, A City initiated request to amend the zoning code of the city of owasso, oklahoma relating to Chapter 5, Section 510, Principal Uses Permitted In Office Districts. More Specifically, to Allow for the Development of Beauty Salons and Barber Shops in an OM (Office Medium Intensity), Zoning District. Owasso Planning Commission Minutes of June 17, 1993 Page 5 of 6 It appears that at the time of establishing the zoning code, the permitted activities within an OM district were strictly limited to those that did not involve the retail sale or display of merchandise and is specified numerous times in list above. It also appears that those accessory uses permitted by Special Exception in an OL or OM district were more so directed toward an urban atmosphere or "downtown Tulsa ". Many times services like those are offered in the round floor of high rise office buildings. Mr. Rooney explained that while attention should be paid to the amount of retail sales and merchandise displayed in OM districts, it should also be noted that standards derived from a Zoning Code for the City of Tulsa may not necessarily be appropriate for the City of Owasso. Furthermore, Mr. Rooney suggested that the Owasso Zoning Code should be amended to permit beauty salons /barber shops to operate in an OM district by Special Exception. This would allow the Owasso Board of Adjustment to place conditions on applicants requesting this Special Exception. Amount of floor area utilized for the display of retail items, hours of operations, and signage could all be restricted in some manner as a condition of approval by the Board of Adjustment. It would also permit the Board of Adjustment to review traffic impact, building elevations, and compatibility of surrounding uses on a site specific basis. Dewey Brown moved, seconded by Charles Willey, to approve the Text Amendment to allow Beauty salons /Barber shops in OM Zoning Districts. New Business - A memo was presented by Mr. Rooney from Mr. Ray on changing Planning Commission meeting days. Discussion will be held at the July meeting when all members are present. 8. Report on Planning Items Previously Forwarded to City Council for Action - Windsor Lake II, Ram Plaza and Brentwood Final Plats were all approved. Mr. Crismond did not appeal the Planning Commission's denial of his rezoning request. 9. Discussion of Development In and Near Owasso - Owasso Commercial Center III Final Plat will be reviewed by the Planning Commission next month. It is the understanding of staff that a Motel is interested in this property. Also, the Board of Adjustment will review a special exception request for a Sonic Drive -In near Walmart. A vote on the motion was recorded as follows: Charles Willey - Yes Ray Haynes - Yes Dewey Brown - Yes The motion carried 3 -0 and the meeting was adjourned at 8:20 p.m. Chairperson Secretary Date MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: OWASSO COMMERCIAL CENTER III - FINAL PLAT DATE: July 7, 1993 BACKGROUND: Previously, a final plat for the property contained within Owasso Commercial Center III was approved by the Owasso Planning Commission and City Council. Originally, this plat was entitled Owasso Commercial Center II. This approved plat was never filed with the County and has since expired. Since that time, the Planning Commission and City Council have approved a final plat titled Owasso Commercial Center II for a completely different property, this plat has been filed. Because the applicants original plat had the same title, it was necessary for the title of the resubmittal to be changed to Owasso Commercial Center III. This plat, essentially, is the same plat that has received previous approval from the Planning Commission and the Owasso City Council with the exception of a minor change in one lot line. The lot line that has been changed involves the lot line shared by Lots 1 and 2 of Block 1 in the northern portion of the proposed plat. An 8 1/2 x 11" copy of the original submittal has been enclosed for your information and review. The final plat was presented to the Owasso Technical Advisory Committee at its June 30, 1993 meeting. No objections were voiced regarding the amended plat. The Technical Advisory Committee did have several required corrections to be made to the submitted plat: 1. The perimeter easement needed to be shown along the north side of the existing Lot 2 (Captain D's property). 2. Dimensions needed to be provided on all easements shown. 3. Easements needed to be shown for the proposed storm sewer. 4. Covenants need to be corrected to reflect a "Commercial" rather than a "Residential" development. 5. Question mark needs to be erased between the words "Owasso" and "Commercial ". In addition, several corrections need to be made to the submitted construction plans. A memorandum from Mr. Munn of the Engineering Department and Mr. McElhenney of INCOG is enclosed stating these corrections for your information and review. A copy of the proposed construction plans is available in my office and will also be available at the meeting should you wish to review these drawings. RECOMMENDATION, The final plat for Owasso Commercial Center III complies with the Owasso Subdivision Regulations; therefore, the staff recommends approval of the final plat subject to the minor corrections recommended by the Technical Advisory Committee being completed prior to this item being forwarded to the Owasso City Council for approval. ENCLOSURE: 1. Owasso Commercial Center III final plat and covenants. 2. Owasso Commercial Center II final plat (never filed). 3. Comments from Mr. Munn and Mr. McElhenney. MEMORANDUM TO: Timothy Rooney, City Planner FROM: Engineering Department DATE; June 29,1993 Comments for the June 30,1993 T.A.C. meeting. These comments are broken down per agenda items. First will be comments from the City Engineer(John McFlhenney), then from the engineering department. 2. Resubmittal of Owasso Commercial Center III - Page 5 - Add another set of columns to the drainage table for the developed condition with detention. Page 5 - Complete the grading plan by matching the proposed contours with the existing contours along the south lot lines with the QT and day care. Page 6 - Station either end of the water line encasement, and note this as concrete encasement. Pages 15 and 16 - What is the 100 year water surface elevation in each detention, how will the outflow be restricted to the design outflow rate? 4. Elm Creek Clinic -Final Plat - 1 Are any improvements planned? 2 Is water and sewer available at the site? 3 Storm water detention is required. Proposed Car Wash - Sheet 1 Location map shows 96th Street North, should be 76th Street North. Sheet 1 How is the drains going to be sewered? Sheet 2 Storm sewer pipes should be a minimum of 15 -inch, and of equal capacity as the incoming 2x4 RCB. Sheet 2 Show slopes and lengths on all pipe profiles. Sheet 2 Install bend at all changes of direction in sewers (at northeast comer of the site). Sheet 2 Add curb opening detail to reflect the stormwater detention calculations (B =1.2 ft., H =1.5 ft.). Engineering Department comments: 2. Owasso Commercial Center M - Plat - Need to show a perimeter easement along the north side of Lot -2. * Provide dimensions on all easements shown. * Show easements for the proposed storm sewer. Covenants - Legal description has different bearings than the plat. * Question mark needs to be erased between the words "Owasso" and "Commercial ". * It appears that the covenants reflect "Residential" instead of "Commercial ". Plans - Show relative Bench Mark on all sheets. * Plat reflects a 25' B.L. & U.E. on N. 116th E. Site Plan = Need Bench Mark shown * What type of material will the parking lot be? * Will there be curb and gutter along Sides of the parking lot? the north, west and south MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: ELM CREEK CLINIC - FINAL PLAT DATE: July 7, 1993 BACKGROUND: Elm Creek Clinic is a proposed one lot - one block subdivision, located just north of Owasso Lumber on the East Highway 169 service road. The area contained within the proposed plat was previously contained within Lot 1, Block 19 of Elm Creek Estates. The property contains approximately 30,046 square feet and is zoned CS (Commercial Shopping Center District). Due to its simplified nature (one lot - one block), staff is requesting that this be processed as a final plat. The Elm Creek Clinic final plat was presented to the Technical Advisory Committee at its June 30, 1993 meeting. The only correction regarding the plat was that the "point of beginning" utilized in the legal description would need to be indicated on the plat. In addition, one correction to the Deed of Dedication needs to be made. In Section 1 "Streets and Utilities ", subsection B "Electric and Communication Service ", second paragraph, the addition of "communication service" needs to be added. RECOMMENDATION: The final plat for Elm Creek Clinic complies with the Owasso Subdivision Regulations; therefore, the staff recommends approval of the final plat subject to the point of beginning being indicated on the plat and "Communication Service" being added to the Deed of Dedication, Section 1, Subsection B, Paragraph 2 prior to this item being forwarded to the Owasso City Council for approval. ENCLOSURE: Elm Creek Clinic Final Plat MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: RODNEY J. RAY, CITY MANAGER SUBJECT: PLANNING COMMISSION MEETINGS DATE: June 9, 1993 As you are aware, conflicts between the Owasso Planning Commission and Municipal Court, in regards to the use of the meeting room at the Community Center, continue to surface. Originally, Owasso Municipal Court was to utilize the meeting room at the Community Center every Thursday evening except the third Thursday of each month in order to allow the Planning Commission to utilize that room. However, more recently the Municipal Court due to an increase in case load, has had to occasionally add an additional night. When it is necessary for the Municipal Court to add an additional night, it is the third Thursday of each month. Recently, I had the opportunity to meet with Judge Hilsabeck regarding the meeting conflict and investigated the possibilities of scheduling the Municipal Court nights for a different evening of the week. Currently, such a rescheduling by the Court is not possible. Mr. Rooney has made me well aware of the Planning Commission's concerns when meeting in the alternate room in the Community Center. Unfortunately, as long as the case load through the Municipal Court continues at its current rate or increases, the conflicts in the scheduling of the meeting room will not decrease. In effort to avoid this conflict, I am requesting that the Planning Commission consider and discuss the possibilities of scheduling their meetings to a different evening. Any Monday evening or the second Tuesday of each month is available for your consideration in the upcoming year. Such a move would decrease the likelihood of a conflict, however please note that this is simply a request for discussion of an idea. Decisions relating to your meeting times are exclusively yours, and I would hope this request would not be viewed as a directive rather than a request. I would like to apologize for the confusion regarding this matter. If you have any questions, please do not hesitate to contact Mr. Rooney or myself at 272 -2251. MEMORANDUM TO: THE OWASSO PLANNING COMMISSION FROM: TIMOTHY ROONEY, CITY PLANNER SUBJECT: TEXT AMENDMENT - OWASSO ZONING CODE CHAPTER 12, CREATING SECTION 1260 DATE: July 6, 1993 BACKGROUND: The Community Development Department recently received and approved two building permits for auto related businesses within commercially zoned property located at 206 and 208 N. Main Street. One of the uses, an auto body shop, was required to be heard by the Owasso Board of Adjustment, and a public hearing was held for that use in 1992. The other use, an automotive business providing basic service and minor repair, and was permitted by right and no Board of Adjustment action was required. A major concern, however, arose with approving both of these building permits. Both proposed business and the structure in which the activities would be performed were to be located on lots that already had a pre- existing non - conforming use. In both cases, a single - family dwelling existed on the lots. Certainly, one can reach the conclusion that automobile body shops and repair services are not compatible with single family housing. However, the Owasso Zoning Code contained no prohibition of such "dual" use when one of the uses is a pre - existing, non - conforming use, be it commercial, industrial, office, or residential zoning. Responsible planning dictates that unrelated dual uses on one lot is not favorable and not to be embraced by gny community. While the underlying zoning is commercial, this is an older portion of the community and much of the surrounding development occurred quite some time ago and is residential (single and multi - family) in nature despite its underlying zoning. While it is important for a zoning code to not be perceived as anti- development with too many restrictions, it is also a priority to preserve the integrity of previously developed areas as well. In order to avoid non - compatible development of this nature in the future, staff is proposing a text amendment that would eliminate gny new use being established on property already containing a non - conforming use, unless: 1. Each existing and proposed use, including all accessory buildings and uses, shall be located on a lot or a parcel of land having a required area for each such use. 2. These uses shall be so located that the lot or parcel of land can be divided into smaller lots or parcels of land, each of which will contain not less than the required area, and on each of which the number and location of structures will comply with the requirements of this Ordinance when considered as a separate lot or parcel of land. By simply adding these two requirements to the Owasso Zoning Code, non - compatible development similar to that which has occurred on Main Street would be restricted. For example, the lot on which Eddie's Transmission is located is 10,500 square feet in area. The zoning code would require a minimum of 8,400 square feet of lot area for the single - family residence, plus the additional lot area that would be required for a commercial business. If this requirement were in place at the time of building permit review, the additional use proposed on the above lot would have been denied. RECOMMENDATION: Staff is Planning Commission approval of the text amendment to Chapter 12 of the Owasso Zoning Code, creating Section 1260, "Nonconforming Uses Limit Other Uses ". The applicant is proposing a 2400 square foot building for medical uses, accompanied by 18 parking spaces. In addition, a free - standing sign is also being requested by the applicant. The zoning of the property, CS (Commercial Shopping Center District), does permit a physical therapy office. Staff has reviewed this site plan and is recommending that the Planning Commission require the applicant to submit a detailed landscaping plan, said plan to be approved by the City Planner, prior to the issuance of the building permit. Landscaping should be utilized by the applicant to break up the parking area mass as viewed from the service road. Also, it should be noted that the applicant will be required to obtain a separate permit for the proposed sign. The applicant is proposing a 7080 square foot building which would house both a car wash portion and a vacuum area. As you may remember, access to this property was limited to one thirty -five foot access drive from E. 76th Street North. The approximate locations of this access point have been added to the proposed site plan. Staff is also recommending a detailed landscaping plan be submitted by the applicant and approved by the City Planner prior to the issuing of any building permit. Also, it should be noted by the applicant that any proposed signage would require a separate permit. RAY, CITY MANAGER SUBJECT: PLANNING COMMISSION MEETINGS DATE: June 9, 1993 As you are aware, conflicts between the Owasso Planning Commission and Municipal Court, in regards to the use of the meeting room at the Community Center, continue to surface. Originally, Owasso Municipal Court was to utilize the meeting room at the Community Center every Thursday evening except the third Thursday of each month in order to allow the Planning Commission to utilize that room. However, more recently the Municipal Court due to an increase in case load, has had to occasionally add an additional night. When it is necessary for the Municipal Court to add an additional night, it is the third Thursday of each month. Recently, I had the opportunity to meet with Judge Hilsabeck regarding the meeting conflict and investigated the possibilities of scheduling the Municipal Court nights for a different evening of the week. Currently, such a rescheduling by the Court is not possible. Mr. Rooney has made me well aware of the Planning Commission's concerns when meeting in the alternate room in the Community Center. Unfortunately, as long as the case load through the Municipal Court continues at its current rate or increases, the conflicts in the scheduling of the meeting room will not decrease. In effort to avoid this conflict, I am requesting that the Planning Commission consider and discuss the possibilities of scheduling their meetings to a different evening. Any Monday evening or the second Tuesday of each month is available for your consideration in the upcoming year. Such a move would decrease the likelihood of a conflict, however please note that this is simply a request for discussion of an idea. Decisions relating to your meeting times are exclusively yours, and I would hope this request would not be viewed as a directive rather than a request.
